Minutes of Meeting
of
Zoning Board of Appeals of Town of Ithaca
October 21 ,, '1956
William McGuire , Rocco Lucente , applicants .
The meeting of the Zoning Board of Appeals of the Town of " Ithaca
was held on October 20 , 1956 at 11 :00 A . M . in the town barn as
advertised in the Ithaca Journal on ' October 13 and ' 15 , 1956 . The
members present were : William Rolston; Aldus Fogelsanger ; Robert Powers ;
David Powers ; and Constance E . Cook, seeretar�r :
Others present were : Ben Boynton, town zoning ' officer ; Harry Gordon,
town supervisor , William McGuire ; Dick Mitchener ; John Elerbar , Mr . and
Mrs . Laughlin, Decker and Mr . and Mrs . Robert Child .
The meeting was called to order by Mr . Rolston; who was appointed
temporary chairman .
The application of William McGuire for permission to construct a
building for the Finger Lakes Tool and Die Company on Five Mile Drive
was considered . Five Mile Drive is now zoned for residential use . Mr.
McGuire testified that his factory would be ' for precision manufacturing ;
there would bey surface grinders and band saws but ' no noise could be heard
outside the building . Others stated their objections to an industrial .
use in a residential zone .
The application was unanimously denied upon the ground that the
board had no jurisdiction . The . petition asked , in effect , for a change
of zone from Besidential to cormnercial and the board had no jurisdiction
to grant such change .
Next the application of Rocco Lucente concerning lots in Christopher
Circle was considered .
After hearing testimony and after discussion, the board uponmotion
duly made and seconded , unanimously adopted the following resolution :
WHEREAS, Ch.ristopher Circle is part of a subdivision laid out but
not recorded before the ordinance became effective ; the lot dimensions
are as follows :

large and irregular ; because of the topography the lot lines could not
be redrawn without producing a hardship on applicant ;
WHEREAS , no objections have been expressed to the board , and there
are practical difficulties and an unnecessary hardship in carrying out
the strict letter of Section 9 of the zoning ordinance and
WHEREAS, the variance applied for is in general accord with the
spirit of the ordinance , the public safety and welfare will be served

and substantial justice will be done if said variance is granted, and
consideration having been given to the promotion of the health, safety,
morals and general welfare of the community, be it
RESOLVED , that the variance applied for be: and is hereby granted and
an order to said effect shall be entered in the office of the town clerk .
There being no further business , the meeting was adjourned .
