The meeting of the Zoning Board of Appeals of the Town of Ithaca
was held on August 61 1955 at '11 : 00 A . M. in the barn of the Walter
Heasley farm at 572 Warren Road to discuss the appeals as advertised
in the Ithaca Journal of July 28th . The members present were :
Elmer Phillips , chairman ; Thomas Smith ; and William Rolston . Others
present were : Harry Gordon, town zoning officer; applicants ; Mr . Laret te ;
and about 20 neighbors of George Peters .
The chairman called the meeting to order and stated that the first
order of business was - to consider . the petition of Robert J . Alexander ,
110 Clover Lane , to vary the requirements of Section 2 of the zoning
ordinance by permitting him to build a garage closer to the property
line than allowed by the ordinance .
After hearing applicant and Mr . Layette and after visiting the premises ,
the board unanimously adopted the following resolution :
WHEREAS , applicant needs protection for his car and there is no
other practical place to build a garage ; and
WHEREAS, Mr . Layette objected to the variance as being too close to
his lot which at the present time has no building on it; and
WHEREAS, there are practical difficulties and an unnecessary hardship
in carrying . out the strict letter of Section 2 of the zoning ordinance ; and
WHEREAS, the variance applied for is in general accord with the
spirit of the ordinance , the public safety and welfare will be,served
and substantial justice will be done if said variance is granted , and
consideration having been given to the promotion of the health, safety,
morals and general welfare of the community, be it
RESOLVED , that the variance applied for be and is hereby granted
and an order to said effect shall be entered in the office of the tom
clerk .
The next order of business was to consider the application of
George Peters , 418 Warren Road . His petition is for the extension of a
non-conforming use by building a display room and repair shop for
servicing television and radio . sets which hs -- is -n(Yw doing in the basement
of his home . About twenty people were present who objected . Their
spokesmen were : Mr . Blair , Mr . � Warren, Mr . Rooney and Mr . Luck . Mr .
Peters read a lengthy letter . Mr . Warren stated that the neighbors tried
to get together with Nor . Peters , but to no avail . Mr . Luck stated that
Mr . Peters posted sales notiees and has conducted sales . Mr . Blair
made the statement that the foundation was to be put up for a Cornell
house ( Vetsburg surplus) . Mr . Peters was not quite sure when ' he put in
the foundation, but thought it was late in 1952 . Mr . Blair made the
statement that the property lay dormant since 1953 and all of 1954 and
the original construction of home was started about June 1953 and stopped
building about August 19530
After lengthy discussion by both sides , Mr . Peters stated that he
was going on vacation the next two weeks . The board moved to postpone
action for two weeks .
There being no other business , the meeting was adjourned .
