AGENDA ITEM Persons to be Patricia Dutt, 135 Westhaven Road, provided written comments on three topics. 1) She and Cynthia Messicci are resubmitting a petition to lower the speed limit on Westhaven Road. 2) She requested that the Town put links to the two West Hill neighborhood groups on the Town's website. 3) Regarding development on West Hill, she requested that the Town not approve any developments larger than 30 units until they have a plan for development that includes the city. See attachment 1. AGENDA ITEM PUBLIC HEARING: The purpose of this public hearing is to consider public comments regarding the Draft Supplemental Environmental Impact Statement (S -DEIS) for the proposed Holochuck Homes Subdivision, located between NYS Route 96 (Trumansburg Road) and NYS Route 89 (Taughannock Boulevard), Town of Ithaca Parcel No.'s 24- 3 -3.2, 25- 1 -5.1, 25 -2 -41.2, 26 -4 -37, 26- 4 -38i and 26 -4 -39, Low Density Residential, Medium Density Residential, and Conservation Zones. The S -DEIS includes an analysis of dump sites that were discovered on the subject property and a proposed remedial action plan to clean up the dump sites. The remedial action is associated with a proposal to construct 106 +/- town home type units in a clustered neighborhood development with two entrances proposed from NYS Route 96 (Trumansburg Road). The development will be concentrated on the west side of the property closest to NYS Route 96, zoned Low and Medium Density Residential, with more than half of the eastern portion of the property, mainly zoned Conservation, remaining undeveloped. The New York State Office of Parks, Recreation, and Historic Preservation proposes to acquire most of the eastern portion of the property as permanent open space. The EcoVillage at Ithaca Generic Environmental Impact Statement (GEIS) prepared in 2001 addressed the potential full build -out at EcoVillage, amendments to Planned Development Zone (PDZ) No. 8 to accommodate the overall EcoVillage development, and the site specific impacts of the Second Neighborhood (SONG). The Findings Statement for the EcoVillage GEIS, adopted by the Planning Board on August 7, 2001, indicated that no significant adverse environmental impacts were anticipated as a result of the modification of the Planned Development Zone or the development of the Second Neighborhood, and that "certain aspects of the development of future neighborhoods may require further environmental review, such as, but not necessarily limited to drainage and stormwater management, visual impacts, and water supply and fire service "; and 5. The Planning Board, at its meeting on October 5, 2010, has reviewed and accepted as adequate the Full Environmental Assessment Form (EAF) Part I prepared by the applicant, Part II of the EAF prepared by the Town Planning staff, has referred to the 2001 GEIS and Findings Statement noted in #4 above, and has reviewed other application materials, including Preliminary Site Plan Review document for Third Residential EcoVillage Experience, dated August 20, 2010; draft Local Law Amending Chapter 271 of the Town of Ithaca Code; Titled Zoning: Special Land Use Districts, to Change EcoVillage Planned Development Zone Provisions Regarding Community Centers and Solar Panels; and drawings, including the following: Subdivision Map Showing Land Exchange at EcoVillage at Ithaca, prepared by Lee Dresser, L.S., dated 8/2/2010; Sheets C100 through C105, Sheets C201 & C202, and Sheet L102, all prepared by T.G. The proposal involves the development of a third residential neighborhood which will include 22 single family homes, 14 +/- carports /garages, 23 +/- surface parking spaces, and a common house that includes space for community functions along with 8 apartments, 2 visitor /guest rooms and 4 offices for residents. The project will also include a new village green between the three neighborhoods, additions and improvements to Rachel Carson Way, and new stormwater facilities and utilities. The proposal also includes subdividing a five acre parcel for the TREE development along with other small changes to the existing EcoVillage parcel boundaries. Ms. Erb opened Ithe public hearing at 8:02 a.m. Ms. Walker gave a brief presentation and reiterated the organization's three goals of sustainability, accessibility, and affordability. Sustainability will be accomplished, in part, through solar panels and passive house construction. These homes have been built extensively in Europe; this is the first major project in the U.S. to use this building technology. They've been designed to make sure people of all ages and abilities can get around. They've accomplished affordability through standardizing the design of the houses and keeping them small and simple. Rick Manning spoke about the landscaping. EcoVillage is a community of gardeners. A modest landscape plan submitted in August focused on Rachel Carson Way, an area where gardeners are less likely to develop gardens. Rachel Carson Way is 25 feet wide, is not tree lined, and says "go fast." As such, it has issues of dust, noise, speed, and safety. They want to create a street that appears more friendly and village -like. After lots of discussion, they came to the idea of a chicane, which also provides traffic calming: it forces people to want to slow down. They'll shift the alignment of the road within the 25 -ft wide corridor and provide planting and stone boulders to shift people's movement through the road. They've been working with the fire department to mitigate their concerns. David Herrick, TG Miller, spoke about utilities. They plan to make a connection between the water system at the Town's West Hill tank to interconnect with Tree and some piping in the second neighborhood group to create a dedicated fire -water system. They're looking at constructing a small pump station in the vicinity of the West Hill tank to provide sprinkler protection for the common spaces of the three groups. The existing traditional domestic water system will Conti ue to function on the existing connection they have at Westhaven. The sanitary sewer system will be a conventional gravity system. Mr. Conneman brought up the concern about air exchange in superinsulated houses. Engineers he has spoken with thought that these homes don't work as well in northern climates. There's concern that a completely sealed home seals in pollutants. Ms. Walker stated that the technology has improved greatly in passive houses; heat recovery ventilators used lin passive houses work very well in bringing in fresh air. Mr. Bates noted Ithat the building code will address the proper ventilation and air exchanges required. The new NYS code coming out in December pays more attention to green building. That the Tow l of Ithaca Planning Board hereby waives certain requirements for Preliminary Subdivision Approval, as shown on the Preliminary Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board, and 2. Submission of any revised cooperative proprietary leases, condominium or homeowners association documents, or other agreements among property owners, including, but not limited to, suitable provisions to assure maintenance of the entrance road and other common utilities and facilities, for review and approval of the Attorney for the Town prior to issuance of any Certificates of Occupancy within the Third Residential EcoVillage Experience; and d. Submission of a certificate or letter signed and sealed by the mortgagee to the effect that he consents to the plat and any dedications or restrictions shown on or referred to on the plat, prior to signing of the plat by the Planning Board Chair; and e. Upon issuance of Final Subdivision Approval, signing of one original or mylar copy and three dark -line prints of the final plat drawing referenced above by the Planning Board Chair, said plat to be filed in the County Clerk's Office, and a receipt of filing provided to the Townj Planning Department, prior to issuance of any building permits; and 3. That the Planning Board hereby finds that there is no need for the reservation of parkland in conjunction with the proposed development of the Third Residential EcoVillage Experience, since the existing and proposed EcoVillage development includes adequate areas for playgrounds, community gardens, recreational opportunities, and other open space amenities, but that should the need for a set aside of land for recreational purposes be determined by the Planning Board when and if additional portions of the EcoVillage property may be further subdivided or developed, such set aside shall be based on the acreage of the original total EcoVillage parcel that existed prior to any development, consisting of 176 +/- acres; and BE IT FURTHER RESOLVED: 1. That the Planning Board hereby grants Preliminary Site Plan Approval for the proposed Third Residential EcoVillage Experience, as shown on the following site plan drawings: Sheets C100 through C105, Sheets C201 & C202, and Sheet L102, all prepared by T.G. Miller P.C., dated 8/20/10; and Sheet L1 01 A, prepared by T.G. Miller, PC, dated 9/27/10; and other application materials, conditioned upon the following, prior to Final Site Plan Approval unless otherwise noted: a. Submission of construction details of all proposed structures, roads, water /sewage facilities, stormwater management, and other improvements; and b. Submission of record of approval for the water and sewer connections by the County Health Department and by the Town of Ithaca Public Works Department prior to construction of said facilities; and e. Revision 'of the road layout modifications on Sheet C101 to address the concerns caused by proposed chicanes or bump -outs as per the Ithaca City Fire Department recommendation in the email from Tom Parsons dated September 17, 2010; and f. Submission of the draft sanitary sewer main easement, satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department, prior to Final Site Plan Approval;) and g. PB RESOLUTION No. 2010 -078: SEOR, Modification of Subdivision Approval, Westview 33 -Lot Subdivision, Schickel Road, Danby Road, Tax Parcel No. 36 -2 -3.2 Moved by Rod Howe; seconded by Ellen Baer WHEREAS: 1. This action involves consideration of modification of Subdivision Approval for the Westview 33 -Lot Subdivision located at the intersection of Schickel Road and NYS Route 96B ( Danby Road), Town of Ithaca Tax Parcel No. 36- 2 -3.2, Low Density Residential Zone. The 2004 subdivision approval involved extending Schickel Road towards the east and creating a loop road for 31 residential lots, with one lot to be consolidated with an adjacent parcel, and one 11/2 +/- acre lot to be used as park site.
