The easy solution is to add two feet to the back of the it in compliance with the zoning and leave a rear yard in excess of 30 feet. Nard than seeking a variance since Mr. Lucente owns 25 acres in the back o the very deep ditch, the current lot line is in the center of the ditch and the ake it out of the ditch. Both the staff and Board were concerned that the building should have a sprinkler system, and asked whether Cornell{ would install one. At the time, Cornell had neither the allocated money, nor the time to install the system. Cornell has since approved a sprinkler and they have a contract and an installer- ready to start. Ms. Erb voiced concerned about the building being occupied without sprinklers. Mr. Beyers said he would agree to a stipulation in the resolution that says they won't occupy the building after a certain date withiut the sprinkler system being installed. Mr. Wilcox closed, the public hearing at 7:22 p.m. Ms. Schmitt agreed that the proposed new language in the resolution provides more impetus for the code enforcement officer to enforce. PIS RESOLUTION No. 2010 -075: Preliminary and Final Site Plan Approval and Special Permit, Cornell University Wilson Lab Modular Office Time Extension, Tax Parcel No. 63- 1-8.2, Dryden Road (NYS Rt 366) at Wilson Lab Entrance Moved by Hollis E'rb; seconded by Rod Howe WHEREAS: This action involves consideration of Preliminary and Final Site Plan Approval and Special Permit for the proposed time extension for the Cornell University Wilson Lab Modular Offices located north of the intersection of Dryden Road (NYS Route 366) and Pine Tree Road, Town of Ithaca lTax Parcel No. 63- 1 -8.2, Low Density Residential Zone. The project involves a request for an eight year extension of the Site Plan Approval and Special Permit for the 4,200 +/ square foot modular office currently situated at the Wilson Laboratory complex. The modular office received Site Plan Approval in 2000 and a time extension was granted in 2008 that expires on December 31, 2010. The project includes plans to add fire sprinklers to the facility. There are no other modifications, improvements, additional development or, other physical changes proposed as part of this request. The Planning Board held a public hearing on September 2, 2008 and adjourned consideration of the proposed time extension for Special Permit and Site Plan Approval for the 4,200 + /i square foot modular building because of questions regarding a sprinkler variance for;the modular building; and 4. The Town of, Ithaca Zoning Board of Appeals discussed the sprinkler variance at its October 27, 2008 meeting, where a Zoning Board of Appeals resolution to rehear the case failed to receive the necessary number of votes, so the sprinkler variance remains valid; and 5. On December 16, 2008, the Planning Board granted Preliminary and Final Site Plan Approval and Special Permit, both of which will expire on December 31, 2010; and 6. The Planning Board has reviewed and accepted as adequate application materials, including a "Request for Extension of Site Plan Approval Narrative" with attachments, date - stamped August 19, 2010, prepared by Steve Beyers, and other application materials; NOW THEREFORE BE IT RESOLVED: That the Planning Board hereby grants Special Permit for the proposed time extension for the 4,200 +/- square' foot modular building in the Wilson Laboratory complex, finding that the standards of Article XXIV Section 270 -200, Subsections A — L, of the Town of Ithaca Code, have been met and subject to the following condition: a. PB 09 -21 -2010 Page 7 of 10 PUBLIC SCOPING SESSION: The purpose of the Public Scoping Session is to consider public comments on the Draft Scoping Document (dated August 18, 2010) regarding the scope and content for thel Draft Environmental Impact Statement (EIS) that will be prepared for the proposed Cornell University Energy Recovery Linac (ERL) facility, located north of the Pine Tree Road and Dryden Road (NYS Route 366) intersection (at Wilson Lab Entrance), Town of Ithaca Tax Parcel No.'s 63- 1 -8.2, 63- 1 -2.2, 63 -1 -12, 63 -1 -3.1 and 63- 1 -3.3, Low Density Residential Zone (LDR). The proposal involves construction of an underground accelerator tunnel (14 -foot diameter and 1 +/- km long), a cryogenic facility, and an extension to the existing Wilson Laboratory (185,000 +/- gross square feet of building space). The project will also involve new stormwater facilities, parking, outdoor lighting, and landscaping. Cornell University, Owner; Steve Beyers, P.E., Engineering Services Leader, Agent. The proposed actions, which include Site Plan Approval and Special Permit by the Town of Ithaca Planning Board, and possibly variances) by the Town of Ithaca Zoning Board of Appeals are Type I actions (construction of 'a non - residential facility with more than 25,000 square feet of gross floor area) pursuant to the State Environmental Quality Review Act, 6 NYCRR Part 617, and Chapter 148 of the Code of the Town of Ithaca titled "Environmental Quality Review." Mr. Wilcox opened the public scoping session at 7:34 p.m. Mr. Bilderback gave a short description of the project. The ERL is a new source of hard x -rays -- the first of its kind. It will allow scientists to nondestructively peer into the interior of small objects, such as viruses, nonoparticles, cells, catalysts, and interfaces of batteries. Faculty, staff, and students will use the facility as a research tool for their programs in physics, biology, materials science, chemistry, and medicine. Cornell's goal is to be the first to upgrade their storage ring; they hope others throughout the world will follow and look to them for guidance. The project will require an increase in the physical scale of their laboratory. The circumference of the ring needs to increase from '/2 mile to 1.2 miles in length. They want to reuse the tunnel and all equipment in it, and will need new space to add buildings totaling 260,000 sf. The new buildings will have green roofs, and are at or below grade to minimally impact the look and feel of the adjacent natural areas. Energy efficiency is built into their designs. They're investigating reuse of hot water waste heat from the cryo plant to heat nearby buildings and greenhouses.. Mr. Bilderback described how they will pull the parking lot back from the creek and use the current space as la vegetative buffer. They will build a permanent pedestrian bridge across the creek so parking can spill over to the old, underused Oxley lot. Heavy construction will last for two of the five years and will involve excavating 225,000 cubic yards of dirt to be trucked away. The plan calls fo ' the closure of one lane of Judd Falls Road by the cryo plant for 6 months. They will maintain, a pedestrian bikeway through that area. The ERL will allow them to build staff back up to the 2005 level of about 200 people. During the first 15 years of construction and operations, the ERL will cumulatively generate $1.3 billion of economic activity in New York. Mr. Wilcox noted Ithat aside from oral comments, written comments will be accepted through September 24, and these comments will be used to revise the draft scoping document. Joel Harlan, Newfield, is in favor of the project. Doug and Bruce Brittain, 135 Warren Road, provided their comments. They agreed with Mr. Harlan that this is a very exciting project and it will be nice to do it right. They went through the scoping document and noted their comments, which will be provided in writing. The public scopingi session ended at 8:09 p.m. Mr. Conneman stated that the Brittains raised a valid neighborhoods It's important to consider the trucks entering and Pine Tree Road that would not normally go there. PB 09 -21 -2010 Page 8 of 10 point regarding traffic in the neighborhoods like Forest Home Upon request, Ms. Moynihan Schmitt explained that the goal of scoping is to focus on the EIS: to gather public comments orally and in writing, then to hold sessions with the applicant to prepare the final scope. Comments from the interested and involved agencies will also be incorporated. Mr. Wilcox stressed that if the Board wants something studied as part of the environmental review, it must be part of the scoping document. State law makes "scope creep" difficult once that document is set. Mr. Conneman'commented that GIS devices will route traffic, including trucks, through Forest Home and elsewhere. Trucks and buses can get stuck on roads in Forest Home that are not meant for vehicles of that size. He said that enforcement needs to be included even if there is a traffic plan because of the popularity of these devices. Mr. Milla a revised sketch plan for the proposed Vine Street Cottages project located on Streets, Town of Ithaca Tax Parcel No.'s 59 -1 -1, 59 -1 -2, 59 -1 -3 and 59 -1 -4, idential Zone. The revised proposal involves the development of up to 19 single - J 10 attached townhouse units on 3.4 +/- acres. The proposal will also involve a ormwater facilities, landscaping, a playground, and improved connections to the ration Way. Susan J. and Harold Mix, Owners; Agora Homes and Development, Homes, described the comments and concerns that have been addressed in plan. Clover Lane has been made two -way and shifted to the west; this will :e Clover Lane on both sides and allow Vine Street to remain private as it is cated to the Town. Clover Lane will be a private street with parking along one street with parking on only one side will calm traffic. The stormwater has one area. There's been a reduction of units from 22 to 19 single family 1 spoke with Vine Street residents and they support the new plan. Mr. Talty voiced concern about people parking along the bend of Clover Lane in winter. He would like it tweaked by maybe widening the street a little. He also asked Mr. Millman about home -sale data in Belle Sherman. Mr. Millman looked at a range of home prices in the ICSD: 16% of homes this year sold for over $300,000. Belle Sherman tracks that percentage almost precisely. Belle Sherman has 2.9 months of supply j whereas Ithaca has 6 months worth of supply, which is considered to be in balance. So there's clearly a demand for this type of housing in Belle Sherman. Mr. Conneman wondered if there was a way to stipulate that the homes be owner - occupied to prevent parents buying homes as investments for students going to college, then keeping the houses as rental properties. Mr. Millman responded that he has not come up with a legal solution to prevent someone from renting their home. This can be accomplished only through a coop. He is willing to continue to look into legal options. He also thinks the price of the homes would make them difficult to use as rentals. PB 09 -21 -2010 Page 9 of 10 Randi Beckman, corner of Worth and Cornell, has taught at Belle Sherman for 25 years, and is happy for a project that will bring children to the school. She's concerned about Worth Street being two -way because many children walk to school in that area and people drive maniacally. She is also concern about drainage with so many units being added and hopes it will be addressed. John Beach realizes they have contacted the City, but encourages people to go to the Board of Public Works as many times as it takes, especially now that there's a potential change in the traffic impacts in a city neighborhood. Garrick Blalock, 1210 Cobb Street, wondered about access to the townhouses now that Vine Street is not in the picture. If the second access point for emergency vehicles is Worth Street, how can they get the facilities on Worth Street upgraded to provide mixed -use pedestrian /vehicle traffic? Ms. Erb and Mr. each agreed that Vine Street provides a third viable access point for emergency vehicles. Mr. Beach recommended that residents put the pressure on the City: speak at every meeting; make them aware of the problems; remind them of their promise to put in sidewalks. Sara Jane Himes, resident of Vine Street, likes the revised plan. She's concerned about the increased traffic on Vine Street, particularly from the townhouses. She thinks it does need some low -grade surface improvements; otherwise, it could become a rutted driveway. Ms. Erb responded that the more you improve it, the more traffic there will be. Posting it as a private road would discourage cut - through traffic. Mr. Kanter thinks that the circulation plan the Town and Planning Boards would want to approve will not close off Vine Street to through traffic. The agreement should clearly state that Vine Street will be open to the public. Mr. Talty commented that if it is a Town road, the taxpayers pay to have it maintained and used; because it is not a Town road and not part of the tax base, technically, the residents can do whatever they want with it. It's been referred to as a driveway. Ms. Himes asked for improvements to the road, but who will make the improvements? Mr. Kanter responded that it currently is a private road that has been used by the public for centuries, so it would be a bad idea to close it to through traffic. When the applicant conveys the road to the four houses, Mr. Kanter recommends that it be conveyed with rights for the public to use it. Ms. Moynihan Schmitt noted that as part of site plan review, the Board has to look at safety concerns and access to emergency vehicles. Mr. Bosak said that he can imagine it being accessible to emergency vehicles, but not to the public. Ann Carson, Mitchell Street, directly across from the wooded lot, commented that Vine Street is not currently posted as a private road. The people from the townhouses will naturally want to go down Vine Street to get to Mitchell. Snow plows go down it, as do garbage trucks. So far, it has not been a problem for fire trucks. It would be a terrible idea to close it off. It's very narrow, so should not be a problem for parking.
