Staff Present: Bruce Bates, Director of Code Enforcement; Susan Brock, Attorney for the Town; Creig Hebdon, Engineer; Jonathan Kanter, Director of Planning; Susan Ritter, Planner; Mike Smith, Planner; Debra DeAugistine, Deputy Town Clerk Call to Order Chairman Wilcox declared the meeting duly opened at 7:04 p.m. and accepted the secretary's p posting of the two public hearings on the agenda. Persons to be heard No one came iforward to address the board. AGENDA ITEM Continuation of SEOR Determination: Circle Apartments Expansion, 1033 Danby Road Mr. Wilcox invited audience to address the board specifically regarding the environmental review. Pauline Layton, 1 1029 Danby Road., commented on unresolved drainage issues within a few feet of her back property line. Her back yard has been soggy in the past few years. She created a ditch between her property line and the source of the water, which has improved flow away from the property to the north, but water still finds a way through. The developer plans to move their ditch closer) to her property line. The fill will -start right at the property line, and water will seep out at the edge of the fill right into her back yard. Ms. Layton also addressed plantings. The pine trees called for in the plan are not a good idea. Even if they survive the deer eating off the lower branches, they don't make a good screen. At that location they will be overshadowed by her existing full grown willows. Pine trees are not doing well in that neighborhood =- many of her pines have died. She would prefer to be screened by deciduous bushes, which would not grow so big that they'd be fighting with the willow trees. She also has a concern about increased traffic, having a difficult time crossing route 96B to retrieve her mail. Ms. Erb established that this would happen) at peak times. Chris Hodges, 16ISaunders Road, was concerned about how the new buildings will look from 96B. The current College Circle complex is tucked back from the road with trees buffering the buildings from view, lending a suburban feel to the campus. The buildings closest to the road will be replaced with taller ones. She doesn't want to see that corridor begin to look like a wall. Bringing more students also creates more density, which creates issues from a public safety standpoint. She hopes that with the expansion they will continue to be sensitive. Mr. Hebdon reported that he has not heard complaints about the drainage before today -- ever since they constructed the connector road. •. m•.... ....w- w.+w.ww........�.,...�,.. There's one significant change in the existing condition as a result of the two 40 -bed clusters on the Loop Road bed: the existing diversion ditch will be hard piped underneath the Loop Road and will no longer pass between the Circle Apartments property and ILayton's. The swale they leave between these two buildings will pick up incidental runoff from the lawn panels and a portion of the roof. The great deal of flow from the past will be mitigated by the pipe system that conveys it into the stormwater detention system. Relocation of the sanitary sewer will be a good opportunity to put a check dam into the backfill of the sanitary sewer main so, that any groundwater that migrates along that bedding stone will be forced to come out in daylight so it can be managed, as opposed to places that cause problems for the neighbors. Dave Harding, QPK Design, responded to Ms. Layton's concern about the plantings. The plans show a row of white pines along the property line, but they would be happy to accommodate deciduous trees. Ms. Erb expressed concern with monoculture: if it's all one type of tree, we will lose them all in the next blight. Mr. Harding agreed with. Ms. Erb that it's best to diversify. They will be exploring LEED guidelines, and minimizing mowed areas. There continues to remain a vegetative stand of 20 -30 feet along the Layton property; they plan to leave this undisturbed. It will evolve back into a naturalized landscape, anyway, by natural succession by virtue of it being on the other side of the swale. Mr. Sieverding addressed the visual impact of the plan, stating that the new buildings closest to the road are 50 feet from the highway right -of -way line, and from the right -of -way line, there's additional green space before the edge of the pavement, so the buildings are approximately 75 feet from the edge of the road. Vince Nicotra, QPK Design, showed the building fagade, which is stepped to break up the mask. The buildings closest to the road will be two -story, which is the smallest of the building types and have the same material palette that exists on the fronts of the buildings now.`These buildings will be aligned with the houses along the road. Mr. Talty commented on garbage at the complex, saying that sometimes it's pristine; sometimes it's terrible. He would like to see more consistency with regards to garbage in the area. Mr. Howe withdrew the motion on the SEQR since there is revised language. Mr. Howe moved the new resolution as drafted; Mr. Beach seconded the motion. Changes were made to the EAF and the resolution as recommended by Ms. Brock. College. lants; Herman Sieverding, AICP, Integrated Acquisition & Development Mr. Wilcox opened the public hearing at 8:05 p.m. The Board discussed the College Circle parking lot on IC's property: Ms.. Brock pointed out that the ZBA granted an area variance instead. of a use variance for the lot in 2003. Mr. Sieverding responded that the intent is to request a use variance; he is working on the application now, Ms. Layton commented on several aspects of the project. She said that in past projects, construction noise has started earlier than 7 a.m. with the warming 'up of vehicles and equipment. Shel also stated that smaller parking spaces would make more sense if they could limit the size of the vehicles students could drive. She said it was good that the Planning Board required bike racks near the new buildings and community center, but wondered why they weren't also requiring them outside the.old buildings. She also thought .a shuttle would help alleviate traff ic, and that students would be more likely to use one in winter months when students otherwise have to digs their cars out of the snow. Ms. Hodges wondered why parking will not be located: behind the buildings. She also thought there should be an interior connector road to the retail development at College Crossing, so students don't have to exit onto 96B to reach the store. Mr. Wilcox closed lI the public hearing at 8:23 p.m. Ms. Erb said she would like the developer to screen the parking lot with more landscaping on the western and southwestern sides. Mr. Talty commented that putting parking behind the buildings was a valid point. Mr. Sieverding responded that they are trying to stay faithful to the original design concept of College Circle apartments, which is groupings of buildings clustered around open green PB 06 -15 -2010 Page 5 of 11 spaces. The fronts of those buildings face the vehicular and pedestrian traffic and parking lots and the� open green space is at the backs of the units. He said he would be happy to add the landscaping suggested by Ms. Erb. Mr. Sieverding responded to the bike rack question by saying that students don't use them since they don't want to leave them out over night. Mr. Sieverding will come back with a bike rack plan that incorporates both new and old buildings. The Board discussed the connection between the apartments and College Crossing, calling attention to the letter from Evan Monkemeyer regarding the topic. Mr. Sieverding stated that they have incorporated a connection, but not a vehicular connection. A vehicular con, nection would encourage using the connector road as a shortcut through College Crossing to 96B and King Road by both students and non- students. They've worked out the details and have drafted an agreement with Mr. Monkemeyer for a shared bikeway /walkway. The Board had a concern that 6 feet is very narrow for a bikeway /walkway, and concluded that 8 feet would be more appropriate. Mr. Sieverding agreed to this change. The Board addressed Ms. Layton's concern regarding hours of construction and agreed that construct Iion activity should occur only between 7 a.m. and 7 p.m. Mr. Talty warned that there should be no warming up of diesel engines prior to 7 a.m. That's consistent with the Town's noise ordinance. Complaints regarding violations of the noise ordinance are directed to the Building Code department and enforced by the Sheriff's department. Mr. Bates said that he has not received any noise complaints about IC since he started working for the Town. The Board discussed setting maximum occupancy rates for the apartments to accommodate possible changes in tenancy in the future to something other than student housing. PB RESOLUTION No. 2010 -048: Preliminary Site Plan Approval, Circle Apartments Expansion, 1033 Danby Road, Tax Parcel No.'s 43- 1 -2.2, 43 -1 -2.3 and 41 -1 -30.2 Moved by Kevin' Talty; Seconded by George Conneman WHEREAS: 1. AND BE IT FURTHER RESOLVED: That the Townlof Ithaca Planning Board hereby authorizes, according to Section 270 -227 (A) (4) of the Town Code, the standard 180 square foot parking space to be reduced to no less than 170 square feet, finding that the applicant has demonstrated good cause for the reduction and that the current situation using 170 square foot spaces has worked'for the remainder of the property. AND BE IT FURTHER RESOLVED: 1. That the Town of Ithaca Planning Board hereby approves the requested increase in total occupancy of the 212 apartment units in the Circle Apartments development from the previously approved 750 persons to a total not to exceed 1,030 persons, subject to the following conditions, and recommends that the Town of Ithaca Zoning Board of Appeals act favorably on the same request for increase in occupancy: a. obtaininlg approval for the same increase in occupancy from the Town of Ithaca p Y Zoning Board of Appeals (as a modification of the ZBA's condition in the variance which was granted in 1990 and modified in 2002), prior to Final Site Plan Approval, and b. submission of evidence of a revised signed long -term agreement between Ithaca College and College Circle Associates, LLC committing to Ithaca College's leasing, management, and supervision of the Circle Apartments as campus housing, including the newly constructed units, with the contingency that if Ithaca College chooses to terminate or change its agreement with College Circle Associates, LLC (or a successor owner) relative' to its involvement in, management of, and supervision of the Circle Apartments, then the maximum occupancy of the project may remain at 1030 persons, provided that College Circle Associates, LLC (or a successor owner) provides management controls on the occupants similar to those provided by Ithaca College regarding security, on- site full -time resident directors and on -site resident managers, compliance with such provisions to be confirmed by the Planning Board upon review at that time; if such controls are not in place, the occupancy shall be reduced to no more than 880 persons; all without prejudice to the developer to apply for occupancy of up to 1,030 persons, if it is so advised and if the Town of Ithaca Zoning Board of Appeals permits such increased occupancy. Consideration of a Sketch Plan for the proposed Third Residential EcoVillage Experience (TREE) project located off Rachel Carson Way, Town of Ithaca Tax Parcel No.'s 28 -1- 26.22, 28 -1 -26.82 and 28 -1- 26.84, Planned Development Zone No. 8. The proposal involves the development) of a third residential neighborhood (TREE) which will include 22 single family homes, 11 carports to accommodate 22 vehicles, a central utility building for heat and hot water, and a common house that includes space for community functions along with 9 residential units and office space. The project also includes a new village green between the three neighborhoods, a flowering meadow, wildlife plantings, a new pond and stream, and improvements to Rachel Carson Way and the existing water system. EcoVillage at Ithaca, Inc., Owner /Applicant; Liz Walker, Organization Manager, Agent. Representatives from EcoVillage gave an overview of the project and answered questions from the Board. They described what an EcoVillage is, introduced their goals of affordability, accessibility, and sustainability, and discussed the architectural and landscape design ideas for the project. Board members were pleased with the sketch plan and unanimously voted in favor of a resolution establishing itself as lead agency to coordinate the environmental review of the development. PB RESOLUTION No. 2010 -049, Lead Agency Intent, Third Residential EcoVillage Experience (TREE), Tax Parcel No's. 28 -1- 26.22, 28 -1 -26.82 and 28- 1- 26.84, Rachel Carson Way,l off Mecklenburg Road (NYS Route 79) Moved by Hollis Erb; seconded by Rod Howe WHEREAS: The Town of Ithaca Planning Board is considering a Sketch Plan for the proposed Third Residential EcoVillage Experience (TREE) project located off Rachel Carson Way, Town of Ithaca Tax Parcel No.'s 28 -1- 26.22, 28 -1 -26.82 and 28 -1- 26.84, Planned Del velopment Zone No. 8. The proposal involves the development of a third residential neighborhood (TREE) which will include 22 single family homes, 11 carports to accommodate 22 vehicles, a central utility building for heat and hot water, and a common house that includes space for community functions along with 9 residents lI units and office space. The Town of Ithaca Planning Board at its meeting on June 15, 2010 has reviewed the Sketch Plan Document for the Third Residential EcoVillage Experience (May 24, 2010) and desires to act as lead agency for purposes of coordinating the environmental review of the project pursuant to 6 NYCRR Part 617 (SEAR) and Chapter 11148 of the Town of Ithaca Code, NOW, THEREFORE, BE IT RESOLVED: That the Town of Ithaca Planning Board hereby proposes to establish itself as lead agency to coordinate thel environmental review of the proposed development, which will require site plan and subdivision approval, possible amendments to Planned Development Zone No. 8, possible height variance, along with other actions that may be taken by involved agencies, if any, in conjunction with the proposal, as described above, and BE IT FURTHER RESOLVED: That the Town of Ithaca Planning Board hereby requests the concurrence of all involved agencies on tHis proposed lead agency designation, said concurrence to be received by the Town of Ithaca Planning Department within thirty days from the date of notification of the involved agencies.
