The proposal involves subdividing the +/- 35.41 acre parcel into three lots, where parcel 1 is +/- 8.97 acres and contains the existing Biggs B Building, parcel 2 consists of 25.52 acres of undeveloped land, and parcel 3 is +/- 0.92 acres and contains an existing +/- 2,250 square foot building (K- house). AGENDA ITEM SEQR Determination: Cornell University Building Demolition Project — Time Extension, 380 Pine Tree Road Chairman Wilcox explained that Cornell withdrew their proposal for a parking lot but they are now simply proceeding with just the required landscaping. The public hearing notice said parking lot, but not he felt this was not a problem because the proposed use is more benign than the advertised use. Tom LiVigne, from Cornell was available for questions from the Board. Discussion followed on the timeline for the landscaping. Mr. Bates had concerns about the enforcement aspect because there currently are no dates or deadlines. Ms. Erb was concerned about how long it has already taken for this project to be completed with the landscaping that was required months ago. Mr. Kanter noted that there are deadlines in the resolution for the Board to set. Discussion followed. The SEAR form was reviewed with minor changes made. PB RESOLUTION NO. 2010 -023: SEAR DETERMINATION: CORNELL UNIVERSITY BUILDING DEMOLITION PROJECT — TIME EXTENSION, 380 PINE TREE ROAD Motion by Rod Howe; seconded by Hollis Erb WHEREAS: This act modifica Racquet No. 62 -1 on is consideration of Preliminary and Final Site Plan Approval for ion to a condition of approval for the demolition of the former Courtside and Fitness Club, at 380 Pine Tree Road, Town of Ithaca Tax Parcel -5, Community Commercial Zone. The approved site plan called for the PB Final 03 -16 -2010 Page 5 of 10 former ;fitness club site to be re- landscaped, with a Planning Board approved plan, ifs the site had not been redeveloped by March 1, 2010. The proposed modification calls for extending the resolution condition deadline to allow time for the applicant to prepare a landscaping plan. Cornell University, Owner /Applicant; Thomas P. LiVigne, Director, Real Estate Department, Agent and 2. The Planning Board, in granting Preliminary and Final Site Plan Approval for the demolition of the Courtside Racquet and Fitness Club, Tax Parcel No. 62 -1 -5, on February 19, 2008 (Resolution No. 2008 -017) imposed certain conditions of approval, including Condition 2(d) that "If the site at 380 Pine Tree Road is not redeveloped by March 1, 2010, then the site of the demolition shall be re- landscaped, and a landscape plan and planting schedule shall be submitted to the Planning Board for review and approval', and 3. The Planning Board issued a Negative Declaration of Environmental Significance on February 19, 2008 with respect to the Building Demolition Project, and 4. The applicant submitted a letter, dated March 10, 2010, requesting the Planning Board provide an extension of the aforementioned deadline to allow the applicant time to prepare a landscape plan, and 5. This is 'an Unlisted Action for which the Town of Ithaca Planning Board is acting as Lead Agency in environmental review with respect to this action, and 6. The Planning Board, at a Public Hearing held on March 16, 2010, has reviewed and accepted as adequate a letter requesting said modifications from Tom P. LiVigne, Director, Cornell University Real Estate Department, and 7. The Town Planning staff has recommended a negative determination of environmental significance with respect to this action; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required. PB Final 03 -16 -2010 Page 6 of 10 AGENDA ITEM PUBLIC HEARING: Consideration of Site Plan Modification for the proposed time extension request for the Cornell University Building Demolition Project located at 380 Pine Tree Road,. Town of Ithaca Tax Parcel No. 62 -1 -5, Community Commercial Zone. On February 19, 2008, the Town of Ithaca Planning Board approved the demolition of the Courtside Racquet Club building with the requirement that if the site is not redeveloped by March 1, 2010, then a landscaping plan shall be submitted to the Planning Board for the site to be re- landscaped. I The applicant is requesting a three month extension so that a proposal for a satellite parking lot could be provided to the Planning Board for review and approval. Cornell University, Owner /Applicant; Thomas P. LiVigne, Director, Real Estate, Agent. Chairman Wilcox opened the public hearing at 7:28 p.m. The Board discussed deadline dates and the basic plan was discussed. Mr. LiVigne noted that their intent was to keep it as minimal as possible because it is prime real estate and they hope to be before the Board soon with a plan. When asked whether it would be flowers or mown lawn, he said they would prefer not to mow it, but they would be flexible. The University was nervous about short deadlines and the Board responded that they had had plenty of time and they were not overly sympathetic to the University because this was supposed to be done over a year ago. Due dates were inserted into the draft resolution. The public hearing was closed at 7:45 p.m. PB RESOLUTION NO. 2010 -024: PRELIMINARY AND FINAL SITE PLAN APPROVAL MODIFICATION OF A CONDITION OF APPROVAL FOR THE DEMOLITION OF THE COURTSIDE RACQUET AND FITNESS CLUB TAX PARCEL NO. 62 -1 -5 380 PINE TREE ROAD Motion by RodlHowe; seconded by Fred Wilcox WHEREAS: 1. This action is consideration of Preliminary and Final Site Plan Approval for modification to a condition of approval for the demolition of the former Courtside Racquet and Fitness Club, at 380 Pine Tree Road, Town of Ithaca Tax Parcel No. 62 -1 i 5, Community Commercial Zone. The approved site plan called for the former fitness club site to be re- landscaped, with a Planning ' Board approved plan, if the site had not been redeveloped by March 1, 2010. AGENDA ITEM Consideration of a sketch plan for the proposed Cornell University Courtside Satellite Parking Lot located at 380 Pine Tree Road, Town of Ithaca Tax Parcel No. 62 -1 -5, Community Commercial Zone. The proposal involves constructing a +/- 147 space gravel parking lot for Cornell faculty and staff permit holders on a portion of the site. The project also includes a new bus shelter, transit pull -off along Pine Tree Road, lighting, and new landscaping. Cornell University, Owner /Applicant; Thomas P. LiVigne, Director, Real Estate, Agent This agenda item was cancelled. AGENDA ITEM Consideration of a sketch plan for the proposed All- Around Storage Mall located at 602 Elmira Road (NYS Route 13), Town of Ithaca Tax Parcel No. 31 -3 -4, Light Industrial Zone. The first phase of the project involves the construction of a new two -story climate controlled storage building with an office ( +/- 16,800 square feet) and two one -story non - climate controlled storage buildings ( +/- 6,000 and 6,300 square feet) on the +/- 3.6 acre site. The project will also include 10 parking spaces, paved drives, storm water facilities, and other site amenities. The second phase of construction would consist of two additional one -story non - climate controlled stoIrage buildings ( +/- 6,600 and 8,100 square feet) along with the necessary drives. Burkhart Services, Inc., Owner; RJ Development, LLC, Applicant; Rusty J. Luce, Agent Tim Bailey from Hawk Engineering, presented the plan. The site is 3.95 acre and they are proposing 21.25 acres of impervious surface and 1.35 acres of green area for a total of 3.4 acres total disturbance. The site is zoned Light Industrial and the proposal meets the minimums with the exception of the front and side yard setbacks. The proposal involves six structures with 6 days of operation but customers would have unlimited access. Ms. Erb stated that she did not like the color and she thought it needed to be scaled back. She did not see any reason for the largest building to be the one closest to the road and she also did not like the entrance. Mr. Bailey stated that the color could be changed and that the photos were just of an existing similar business. The setback requirements were discussed. Mr. Bailey thought there was something wrong with the Code because he was meeting the area requirements but not the setbacks. Mr. Bates stated that they were meant to be a buffer in this zone. Discussion followed. Mr. Bo�sak noted that the letter from the County reminded the Board that this is a visually sensitive area and this was the entrance to the Town of Ithaca. Ms. Erb asked about the rental truck area and Mr. Bailey responded that they would not be renting trucks but the area was set aside for customers coming in with a rental truck and needing a place to park it. Mr. Hebdon touched on the SWPPP requirements and the initial areas of concern the Engineering Department had with their sketch plans. Ms. Erb brought up the sprinkler requirements and Mr. Bates explained that it is a Town law above and beyond the State law. A sprinkler would be required unless they went to the Zoning Board for a variance. Mr. Bailey responded that that may be a deal breaker. Chairman Wileox listed his comments, one of which was the need for landscaping. Mr. Bosak quoted) the County Planning memo which suggested a smaller size and the impact on the stream. Mr. Bosak reminded the Board and the applicant that the Town was in the process of passing a stream setback law which would probably impact this proposal. Chairman Wilcox gave the public an opportunity to speak. Jon Bentkowsky -- appraised this property. It was at one time Nora Dodd's nursing home. At end, they filled in the site. In 2004, taxes increased and the owner sold it. Mr. Luce purchased it. It has been dormant for three years. This is the third attempt to develop the site; AGENDA ITEMI Consideration of a sketch plan for the development proposed by Dan Mitchell and the Ithaca Beer l Co. on Mancini Drive off Elmira Road (NYS Route 13) on Town of Ithaca Tax Parcel No. 33- 3 -2.2, Low Density Residential and Light Industrial Zones. The proposal involves rezoning a portion of the property to a Planned Development Zone for a newt brewery, pub /restaurant and beer garden. The project would also include agricultural fields and pastures, one residence for the owners family, and potential other residential development on the west side of the +/- 81 acre property. Mancini Realty, Owner; Dan Mitchell, President, Ithaca Beer Co., Applicant Dan Mitchell gave overview of the proposed project. The brewery needs to expand and would like to establish a beer garden which is akin to a park -like setting where you could have a sandwich and a beer in an outdoor, relaxing atmosphere. He would also like to incorporate fields to grow hops and even some animals. The idea is to have a park -like setting with functionality and a destination for people to go to. The parcel is 85 acres and would allow for expansion as they grow. The possibility of residences is also there given the lay of the land and the existing roadways. The zone right now is Light Industrial, but the opportunity is there and he did not want to rule it out. The Board was in'i the archeological II Frantz and Sherer Planning Board coll ;lined favorably towards the project but they were concerned about aspects of the site as referenced in a letter submitted by George ie Baugher. Discussion followed. The Board then discussed the edition regarding Mancini Drive needing to become a public road and PB Final 03 -16 -2010 Page 10 of 10 whether the Board was willing to rescind it. The Board discussed the history and particulars of the condition. In general, the Board was not opposed to the road not being a Town road. Ms. Baugher I and Mr. Frantz addressed the Board and explained their concerns. Discussion followed on timelines and possibilities for archeological studies. AGENDAI' Other Bus!
