Excused Fred Wilcox, Jon Bosak Staff Present Jonathan Kanter, Director of Planning; Bruce Bates, Director of Code Enforcement; Chris Balestra, Environmental Planner; Susan Brock, Attorney for the Town; Paulette Terwilliger, Deputy Town Clerk Call to Order Chairperson Howe declared the meeting duly opened at 7:02 p.m., and accepted for the record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on August 10, 2009 and August 12, 2009, together with the properties under discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of Danby, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants and /or agents, as appropriate, on August 12; 2009. He noted that Ellen Baer would be a voting member. AGENDA ITEM Persons to be heard None. AGENDA ITEM Consideration of Preliminary and Final Subdivision Approval for the proposed 2 -lot subdivision located at 103 & 105 Hickory Place, Town of Ithaca Tax Parcel No.'s 53 -1 -15.13 and 53 -1- 15.14, Medium Density Residential Zone. The proposal involves subdividing off a +/- 546 square foot triangular piece of land from 103 Hickory Place, which will be consolidated with 105 Hickory Place. It appears that this piece of land was conveyed in 1996 without subdivision approval from the Town of Ithaca Planning Board. Carmine & Lucille Gerard, Owners /Applicants; Suzanne Gerard, Agent. David Tyler, Attorney for the Owners addressed the Board. He stated that the attorney who handled the transaction is deceased and the owners are not in good Final PB 8 -18 -2009 Page 2 of 12 health and do not recollect the events. Therefore, the submitted materials reflect everything known. The reason for the conveyance was that there was a little encroachment of the driveway and his client decide to convey the triangle rather than do an encroachment agreement which would put the driveway on his land. ADOPTED RESOLUTION: PB RESOLUTION NO. 2009 — 079 SEQR Preliminary and Final Subdivision Approval Gerard 2 -lot Subdivision 103 and 105 Hickory Place Tax Parcel No.'s 53. -1 -15.13 and 51-1 -15.14 Town of Ithaca Planning Board August 18, 2009 Motion made by George Conneman, seconded by Kevin Taltly. WHEREAS: This is consideration of Preliminary and Final Subdivision Approval for the proposed 2 -lot subdivision located at 103 & 105 Hickory Place, Town of Ithaca Tax Parcel No.'s 51-1 -15.13 and 51-1- 15.14, Medium Density Residential Zone. The proposal involves subdividing off a +/- 546 square foot triangular piece _of land from 103 Hickory Place, which will be consolidated with 105 ' Hickory Place. It appears that this piece of land was conveyed in 1996 without subdivision approval from the Town of Ithaca Planning Board. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting as Lead Agency in an environmental review with respect to Subdivision Approval, and 3. The Planning Board, on August 18, 2009, has reviewed and accepted as adequate a Short Environmental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff, a recently amended survey map entitled "Survey Map of 103 Hickory Place, Town of Ithaca, Tompkins County, New York ", prepared by Kenneth A. Baker, dated September 1.1, 1986 and amended July 15, 2009, and a survey map entitled "Survey Map of 105 Hickory Place, Town of Ithaca, Tompkins County, New York ", prepared by Kenneth A. Baker, dated September 23, 1991, and other application materials, and 4. The Town planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; Final PB 8 -18 -2009 Page 3 of 12 NOW THEREFORE BE IT'RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required. A vote. on the motion was as follows: AYES: Howe, Conneman, Riha, Talty, Baer and Erb NAYS: None Absent: Bosak and Wilcox The motion passed unanimously. Chairman Howe opened the public hearing at 7:05p.m. There was no one wishing to address the Board at this time. The Board had no further questions and the public hearing was closed at 7:07p.m. Motion made and seconded with minor changes approved. After ,the vote, the Agent thanked both Sandy Polce and Mike Smith for their work in researching the issue and assisting him with the project. WHEREAS: 1. Final PB 8 -18 -2009 Page 5 of 12 AGENDA ITEM Consideration of Preliminary and Final Site Plan Approval for the proposed modification to the Cornell University Merrill Family Sailing Center project located at 1000 East Shore Drive, Town of Ithaca Tax Parcel No. 19 -2 -29, Lakefront Commercial Zone. The modification includes not constructing the +/- 1,200 square foot boat storage building that was approved as part of the original sailing center project. Cornell University, Owner /Applicant; Mike Swartwout, Agent. Mike Swartwout stated that they were asking for the modification to not build the storage building as planned. He added that they needed the approval to receive their Certificate of Occupancy. Chairman Howe stated that he understood from the submitted materials that the elimination of the storage building was due to financial concerns and Mr. Swartwout agreed. Board Member's asked if any activities would not take place in the main building now that it was going to be used for storage. Mr. Swartwout responded that the plan had always been to use the main building for storage of the competitive boats. The option of storing some in the additional building to allow for repairs on some boats will not be there. Board Member Erb asked if and where shrink - wrapped boats would be stored now. Mr. Swartwout responded that there would be shrink - wrapped boats stored as in the past in the same areas as usual with an additional 10 -12 dinghies on the docks that will be flipped over and shrink - wrapped. Board Member Talty asked if the storage building was in the future if funds became available and Mr. Swartwout did not want to speak for the Athletic Department. Board Member Erb about landscaping for that vacant area and Mr. Swartwout was not aware of any. ADOPTED RESOLUTION:. PB RESOLUTION NO. 2009 — 081 SEOR Preliminary & Final Site Plan Approval Merrill Family Sailing Center 1000 East Shore Drive Tax Parcel No. 19 -2 -29 Town of Ithaca Planning Board August 18, 2009 Motion made by Susan Riha, seconded by Hollis Erb. WHEREAS: 1. The proposed action includes Consideration of Preliminary and Final Site Plan Approval for the proposed modification to the Cornell University Final PB 8 -18 -2009 Page 6 of 12 Merrill Family Sailing Center project located at 1000 East Shore Drive, Town of Ithaca Tax Parcel No. 19 -2 -29, Lakefront Commercial Zone. The modification includes not constructing the +/- 1,200 square foot boat storage building that was approved as part of the original sailing center project. Cornell University, Owner /Applicant; Mike Swartwout, Agent, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting in an environmental review with respect to the project, and 3. The Planning Board, at a meeting held on August 18, 2009, has reviewed and accepted as adequate the Short Environmental Assessment Form (EAF) Part I prepared by the applicant and Part II, prepared by the Town Planning staff, modified plans showing the deletion of the storage building, .including Sheet L2 titled "Proposed Site Plan," and Sheet 1-3, titled "Grading Plan, Sediment & Erosion Control Plan, Water Quality Plan & Details," and other application materials, and 4. The Town Planning staff has recommended a negative determination of environmental significance with respect to the proposed site plan approval, NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the above referenced actions as proposed, based on the information in the EAF Part I and for the reasons set forth in the EAF Part 11, and, therefore, a Draft Environmental Impact Statement will not be required. A vote on the motion was as follows: AYES: Howe, Conneman, Riha, Talty, Baer and Erb NAYS: None Absent: Bosak and Wilcox The motion passed unanimously. Chairman Howe opened the public hearing at 7:18 p.m. There was no one wishing to address the Board at this time. Susan Brock noted that the revised plans still mention a pole and guy wire and asked if the intention was to leave them. Mr. Swartwout responded no, and stated that he would make sure that notation was removed on the final submission. WHEREAS: 1. Submission of one original set of revised sheets L2 & L3 on mylar, vellum, or paper, signed and sealed by the registered land surveyor(s), Final PB 8 -18 -2009 Page 8 of 12 engineer(s), architect(s), and /or landscape architect(s) who prepared the materials, to be retained by the Town, and b. Any outstanding conditions of the original site plan approval, granted on October 7, 2007 and noted in Planning Board Resolution No. 2007- 107, shall apply. AGENDA ITEM Consideration of Preliminary and Final Site Plan Approval, Special Permit and a Recommendation to the Zoning Board of Appeals Regarding a Sign Variance for the proposed Ithaca Arts and Ithaca Media Arts project located at 1458 Slaterville Road, Town of Ithaca Tax Parcel No. 58 -2 -28, Medium Density Residential Zone. The proposal involves converting the downstairs portion of the existing building for part time day and after school educational programs for children. There are no interior or exterior changes to the building proposed. Robert N. & Virginia D. Powers, Owners; Cliff & Debbie Roth, Applicants. Cliff and Debbie Roth were present to answer questions. Mr. Roth handed out a report from Taitem Engineering addressing the classifications in the Building Code of NYS. Board Member Riha asked what exactly the Board was being asked to approve. Ms. Brock explained that educational uses need Special Permit in the zone and a site plan is required because they are changing the use. The use is changing from commercial to educational. Mr. Roth spoke up and added that there was some confusion over that. He thought that the use was still commercial, not educational. Mike Smith explained .that the site plan and special permit were needed because of the educational uses because the proposed use fits into the private educational category in our Code versus the commercial or sales type use previously conducted there. Cliff Agnost, the real estate agent handling the property described the previous use as two apartments upstairs and a video /sound business on the main floor. This use was discontinued for over a year and they went for a variance to allow offices on the first floor (which was approved); subsequently the Roth's came along and wanted to put their school in and that is why they are here. Ms. Roth Final PB 8 -18 -2009 Page 9 of 12 added that the school is not licensed or accredited, it is very casual. Ms. Brock responded that it is a difference in verbiage between the Town Code and the State Code; the end result is the same. A special permit is still needed. Mr. Roth stated that no changes would be made to the building and the business use would be very low -key with the rent being the major financial component. Chairman Howe asked if there were any environmental issues. Board Member asked about noise bothering the tenants and Mr. Roth responded that they were worried about the reverse; the tenants making too much noise for their classes. Motion made and seconded with minor changes. WHEREAS: 1. This action is consideration of Preliminary and Final Site Plan Approval, Special Permit and a Recommendation to the Zoning Board of Appeals Regarding a Sign Variance for the proposed Ithaca Arts and Ithaca Media Arts project located at 1458 Slaterville Road, Town of Ithaca Tax Parcel No. 58 -2 -28, Medium Density Residential Zone. The proposal involves converting the downstairs portion of the existing building for part time day and after school educational programs for children. Chairman Howe opened the public hearing at 7:30 p.m. Board Member Erb asked the Staff for their comments on whether the State was okay with this. Bruce Bates stated that he had not heard from the State yet. The Department of Education does not agree with the State Department of Code, but, he did not think that it mattered in regard to their activities, because it is listed in the Town Code. It will make a difference when it is time to make the building compliant for the occupancy because there may be other things, such as fire separation etc. That would be needed for an educational use. Board Member Erb asked if he had any concerns or would like a contingency statement on the resolution. Mr. Bates responded that if they could produce a copy of the letter from Mr. Hogan for the file, that would validate for the Codes Department their their interpretation. Chairman Howe asked if anything is impeding the Board from going forward at this point and Ms. Brock and Mr. Bates responded that they did not see any issue. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final Site Plan Approval, as shown on the Preliminary and Final Site Plan Checklists, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of Final PB 8 -18 -2009 Page 12 of 12 site plan control nor the policies enunciated or implied by the Town Board, and 2. That the Town of Ithaca Planning Board hereby grants Preliminary and Final Site Plan Approval for the proposed Ithaca Arts and Ithaca Media Arts Schools project, as shown on a drawing titled "Survey Map — No. 1458 Slaterville Road" dated 1/13/2009, prepared by T.G. AND BE IT FURTHER RESOLVED: That the Town of Ithaca Planning Board, acting as the Town of Ithaca Sign Review Board, hereby recommends that the Town of Ithaca Zoning Board of Appeals approve the request for a sign variance to modify the panels for the freestanding sign for the Ithaca Arts and Ithaca Media Arts. There was a discussion about the approving of minutes since there was some confusion last meeting with some members not wanting to approve (and /or thinking that they could not approve) minutes of meetings for which they were not present.
