Jon Bosak will be a voting member in Board Member Riha's absence. Persons to be Heard There was no one wishing to address the Board at this time. SEQR Determination, Public Hearing Consideration of Preliminary Site Plan Approval and Special Permit for the proposed Cornell University Plantations Welcome Center located on Comstock Knoll Drive off Plantations Road Town of Ithaca Tax Parcel No. 67 =1 -6, Low Density Residential Zone The proposal involves the construction of a 6,000 +r- square foot Welcome Center which will include a visitor lobbv. educatinnal aYhihit aria flinvihln ' :....� also Include a 44 +J- space parkincl lot and visitor arrival area new stormwater facilities a new combined pedestrian Pathway and access route to connect the site elements, and new outdoor lighting and landscaping Cornell University Owner /Applicant; Christine Carstensen, Agent Don Rakow, Director and. Jon Newert, Architect Mr. Newert gave a presentation and overview with slides about the Welcome Center. There will be a Welcome Center, a connecting driveway and visitor parking and drop - off. The applicants are required to have a Silver LEED certification and they hope to achieve Gold. The layout of all the elements were depicted and discussed. PB 11.18.2008 Pg. 2 Board Comments /Questions Chairperson Howe asked if there were any environmental issues, and Mr. Newerk felt the only one was the re- grading and stormwater management, which has been mitigated. Chairperson Howe noted that the Board did have a letter from Creig Hebdon stating that the SWPPP was in order. He also asked about the parking spaces, and Mr. Rakow stated that it was not the intention of Plantations to increase the number of spots, it is more of a shuffling of location, but the numbers remain the same or very, very close. Board Member Erb had several changes to the SEQR form. Some measurements were missing and there was a typo on one of the referenced plans. The changes were not substantial and did not alter the environmental impact in either direction. Board Member Talty noted the snow collection area and felt they should keep that in mind for other projects. He was impressed and pleased that this was thought of as he felt many architects and planners do not think of what to do with the snow and do not plan for it. Mr. Rakow added that it was important to the Plantations for many reasons, not least of which is the runoff and either flooding or contaminating the plantings. That was the overriding factor in planning for the collection area. There was some discussion regarding the disposal of the asbestos in the building being demolished. The contractor is responsible for disposing of it properly, and they follow all DEC rules and guidelines. The contractor is certified by the State for this type of disposal. Part of the building permit process is having all that information. Alternate Member Bosak brought attention to the "if budget allows" note regarding the solar panels. There was some discussion about the solar panels being referred to as potential. Alternate Member Bosak thought they. did not look conditional on the plans and it was a significant item. He thought having the panels may or may not influence a vote, maybe not on this particular project, but in general, so should they be on approved plans as a "may be built ?" Mr. Bates stated that if the build -out was different from the plans, they would need to have an as -built survey done before a certificate of occupancy would be issued. He also noted that the Planning Board signs -off on the project so if it was not built to the Boards approval, he could not issue a certificate of occupancy. Mr. Kanter stated the Planning Board has added language in the past approving a plan as shown with a notation that if a particular aspect is not built, that does not change the approval. Alternate Member Bosak also asked about the lights and why they were not LED. Mr. Newerk stated it was a cost issue. Board Member Thayer thought it was a "welcome addition." And Board Member Conneman restated that he would like to see samples. Chairperson Howe asked for a review on the phasing /timeline. Mr. Newert stated that they hoped to begin in Spring 2009 and finish for the June 2010 Alumni Reunion, so 12- 14 months. The what actually starts first is up to the contractor. PB 11.18.2008 Pg. 3 Mr. Rakow and Mr. Martin stated that they would have a better idea closer to Final Approval, and they will also have samples for the Board. Chairperson Howe opened the public hearing at 7:40 p.m. Joel Harlan spoke in favor of the project, but he wanted to know why a road can't be built to join with Route 366, Chairperson Howe closed the public hearing at 7:42 p.m. There were typographical changes to the SEAR resolution. PB 11. 18.2008 Pg. 6 39 The preliminary site plan is approved subject to the following conditions: a. submission of record of application for and approval status of all necessary permits from any county, state, and /or federal agencies, and b. submission of a truck routing plan to indicate that all demolition and construction traffic shall access and exit the site without traveling through the Forest Home neighborhood, for review and approval by the Town's Director of Engineering prior to the issuance of a demolition of building permit, and c. all buildings being demolished will require individual demolition permits from the Town of Ithaca Building Department, and d. submission of a letter from the Village of Cayuga Heights Fire Department stating fire department access to the site and facilities is adequate, and e. submission of additional details about colors and materials to be used for the facilities, prior to final site plan approval. A vote on the motion was as follows: Ayes: Howe, Conneman, Thayer, Bosak, Talty, Erb and Wilcox Nays: None The motion was carried unanimously. Consideration of a sketch plan for the Proposed Ithaca College Wetland Mitigation Plan, as Part of the Athletics and Events Center Project, located off Coddington Road near Rich Road, W. Northview Road, and the Water Tower Road, Town of Ithaca Tax Parcel No.'s 42 -1 -9.2 and 43 -1 -4, Medium Density Residential Zone. The proposal involves the construction of approximately 4 2 acres of wetland in two locations on Ithaca College lands to compensate for approximately 2.77 acres of wetland beina lost as part of the Athletics and Events Center project. Ithaca Colleeae, Owner /Applicant: Richard Couture, Associate Vice- President of Facilities Agent. Rick Couture, Ithaca College; David Herrick, TG Miller Architects; Herbert Sieverding, Intergraded Acquisitions and Ron LeCain, LeCain, Wetland Consultant Mr. Herrick gave a brief history of the project and Mr. LeCain gave an overview of the project with types of plants and specific locations of the new wetlands. The documentation is very similar to what was submitted with the FEIS. The College is looking to fulfill its wetland mitigation commitment in two sites, the Raponi parcel and a parcel between Northview Road and Rich Road. PB 110 18.2008 Pg. 7 Mr. LeCain showed where the parcels were and described the topography and the methods he will use. The topography is challenging because it is sloped. They will be making natural berms to offset this and create the wetlands. He has had Cornell students surveying the land as part of a class and will be hearing their recommendations later in the week. The Army Corps of Engineers has reviewed the project and although they have not given formal approval, they have indicated they agree with his findings and plans informally. Mr. LeCain looked at many sites and the entire Ithaca College property, and they stayed away from the Unique Natural Area. They came back to the two original sites referred to in the preliminary site plans and the EIS. Board Comments There was some discussion on the numbers as far as loss vs. and amount of replacement wetlands. Mr. Herrick said there was a change from 3.8 to 2.8 in total for all phases of total wetland destroyed. Board Member Wilcox noted that there is not a lot of 1.5 to 1 acre mitigated. He comes up with a tenth He is also concerned by the lack of alternate areas proposed sites. Board Member Erb noted that the bike /pedestrian pathway is not shown correctly and the final plans should show it correctly. Alternate Member Bosak asked if the replacements would function as well as the existing and Mr. LeCain replied yes, hopefully even better because the current wetlands are infested with invasive species which they hope to keep out of the replacements. Chairperson Howe asked how the success would be monitored and Mr. LeCain stated that the Army Corp of Engineers requires an inspection and a report in 5- years. Board Member Wilcox noted the Town would probably ask for an independent survey. Board Member Erb asked Mr. Couture what the Appendix A he was referring to in his letter was because she couldn't find it. Mr. LeCain replied that it was the maps. Chairperson Howe summarized that tonight the Board just had to decide if they were comfortable with the plan that they put forward and then they would come back with a site plan. He went on to add that Mike was looking for guidance from the Board as to whether it would need to be classified as an unlisted item not requiring a supplemental EIS. Ms. Brock wanted to interject that she thought the Board should not be segmenting the wetlands out of the EIS. She felt the Board was looking at the impacts from the mitigation and that was not examined in the EIS because the College did not PB 11.18.2008 Pg. 8 know where the wetlands would be built. She felt a supplemental EIS is needed. She also had a question about the conservation easement mentioned in the packet, and Mr. Couture replied that the College was talking with the Finger Lakes Land Trust, and they were getting a positive response. Discussion then turned to Susan Brock's suggestion of a supplemental environmental impact statement. Board Member Wilcox stated he was nervous about the possibility of segmentation and he thought there should be one. A letter from Tompkins County Planning was discussed and its implications regarding notification of neighbors. David Herrick asked for some clarification on why the Town felt one was needed. He felt the SEQR law, although allowing the Lead Agency to require one at any time, it did limit its need for one to significant environmental impacts not addressed in the EIS. He felt they did acknowledge where the sites would be, and although they considered other possibilities, they ended right back to what was noted as the probable location. He said that the plan and narrative are very consistent with what was presented, and he asked if there are significant impacts that the Board felt were not previously understood or presented, what were they? Ms. Brock said the EIS did not discuss what the impacts were of creating the wetlands in those locations such as the current ecological communities are now and what would happen when they were changed. She felt that was not addressed since the College did not know for sure where the final site would be. David Herrick agreed that the final size and location was not known but the ecological communities were addressed. Mr. Sieverding stated that the Appendices addressed those issues and specifically addressed these two sites and that these were in fact the only two sites that were addressed in the FEIS. Board Member Wilcox asked where the impact of locating these wetlands in these locations was. Not the benefits but the impacts. Mr. Sieverding answered that it is discussed throughout the plan. He was puzzled about the phrase "segmentation of the EIS" because the FEIS has been approved and the discussion included the wetland mitigation plan. Board Member Wilcox stated that that was subject to the final location and Mr. Sieverding responded that they were identified in the final report. Board Member Wilcox said that they were not identified with such detail. Chairperson Howe felt there was not a need and Board Member Erb quoted from the FEIS noting that the loss of the present habitat was not addressed. She felt the Board was asking only for a statement on the impact or damage due to the loss of successional shrub land being made into wetland. Mr. Sieverding asked if that was information that could come from the presentation of material or was the Board identifying that as a significant environmental impact that would require a supplemental EIS? Board Member Erb thought it was not a significant environmental impact but she would take the Attorney for the Town's recommendation. The majority of the Board agreed. PB 119 18.2008 Pg. 9 Board Member Wilcox stated for the record that Mr. Sieverding had given him a map that in his mind shows enough of a difference to warrant a supplemental. Mr. Couture asked what that meant in timeline and Ms. Brock said it would follow the same rules as an EIS. The College can meet with the Town to discuss what is needed, a draft would be prepared, public comment accepted, and a final adopted. Chairperson Howe felt that it should be kept as simple as possible and Mr. Kanter asked for a consensus that formal scoping would not be required. He got that and stated that the SEQR language gives more options for timelines. It can't all happen at one meeting, but since the Board felt it was a very narrow item, it would not take as long as the original. Best case scenario is two meetings but no guarantee. It was decided that the College would meet with Staff and work out the details. Board Member Wilcox wanted to make sure that the public had ample opportunity to comment, and Chairperson Howe agreed. Discussion regarding the Cornell draft Final Transportation- focused Generic Environmental Impact Statement (Final t- GEIS). The t-GEIS includes an identification, examination and evaluation of transportation- related impacts of hypothetical Cornell University population growth scenarios over the next decade on transportation systems and neighborhoods. The t -GETS addresses these impacts by evaluating and proposing mitigation measures to encourage alternatives to single - occupancy vehicle use by those traveling to and from Cornell. The draft Final t -GETS includes copies of all of the public comments submitted regarding the t-GEIS and draft responses to these comments that were considered substantive. Kathryn Wolf, Agent for Cornell University The major item of discussion was the difference in the background growth rate. The original assumption was 1.5 and it is probably closer to 1.76 — 2.16. The implications are not large. The group went back and reanalyzed all the data using 1.8% and 2 %. Two (2) out of thirty -two (32) corridors were affected and had a change of service. They were Cliff Street and Ithaca Road between Maple Ave and Mitchell Street, and these two were already an issue, and the mitigations would not change. When the intersections were reanalyzed with the higher rates, three (3) had a decline occurring sooner or in an earlier scenario and two (2) had an overall level of service change to a lower level of service. Again, the mitigations would not be any different. To summarize, these were already problem areas with mitigations suggested, and even though the rates change, they would not change the mitigations. PB 11.18.2008 Pg. 10 Chairperson Howe thought that tonight was about having the Board think about the responses and determine if they are adequate. Mr. Kanter agreed and stated that the intent was to schedule a follow -up meeting where the Board would consider accepting the final TGEIS as complete and then the notice of completion would be circulated and the final step of a Finding Statement would follow. Mr. Kanter added that Ms. Brock and he had met with the team and gone over all the responses in a lot of detai, and he was comfortable with the document. Board Member Conneman was pleased with the responses and just thought some of the pages could be "tweaked." He addressed going around Forest Home. There was some discussion about additional signage to direct traffic. Board Member Wilcox asked whether the Brittain Brothers had enough time to respond and give their comments. He thought the document incorporated their responses, but he wanted to hear what they thought. Mr. Kanter said there is no mandatory requirement for public comment, but the Board could ask for it. The Board asked the Brittain's if they were prepared to comment this evening, and they responded that they were not. The Board asked them to come to the December 2 "d meeting and provide comments. Ms. Brock added that there were some housekeeping changes and one technical correction. The technical correction was reviewed, and it was decided that the housekeeping ones would be discussed and corrected between Kathryn and Susan.
