The Town of Ithaca Planning Board met in regular session on Tuesday, July 18, 2000, in Town Hall,
126 East Seneca Street, Ithaca, New York, at 7:30 p.m.
PRESENT: Eva Hoffmann, Vice Chairperson; Tracy Mitrano, Board Member; Larry Thayer, Board
Member; Rod Howe, Board Member; Jonathan Kanter, Director of Planning; Mike Smith, Planner.
EXCUSED: Fred Wilcox, Chairperson; George Conneman, Board Member; John Barney, Attorney
for the Town; Daniel Walker, Director of Engineering.

Vice Chairperson Hoffmann declared the meeting duly opened at 7:37 p.m., and accepted for
the record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in
Town Hall and the Ithaca Journal on July 10, 2000, and July 12, 2000, together with the properties
under discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of Danby, upon
the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public
Works, and upon the applicants and /or agents, as appropriate, on July 12, 2000. (Affidavit of Posting
and Publication is hereto attached as Exhibit #1.)
Vice Chairperson Hoffmann read the Fire Exit Regulations to those assembled, as required by
the New York State Department of State, Office of Fire Prevention and Control.
AGENDA ITEM: PERSONS TO BE HEARD.
Vice Chairperson Hoffmann opened this segment of the meeting at 7 :37 p.m., and asked if any
members of the public wished to be heard. With no persons present to be heard, Vice Chairperson
Hoffmann closed this segment of the meeting at 7:38 p.m.
AGENDA ITEM: SEAR, Determination, Ainslie /Singer Subdivision - Modification, Hayts Road.
Vice Chairperson Hoffmann opened this segment of the meeting at 7:38 p.m.
Vice Chairperson Hoffmann stated that she could see the main difference in the subdivision
from looking at the map provided to the board. It is six lots instead of seven lots. The lot on the
eastern edge had a narrow entrance road. There were four larger lots in the middle.
Rob Ainslie, Hayts Road, stated the subdivision was drawn up to conform to Health
Department standards. It was drawn up incorrectly. It could not be subdivided into seven parcels. It
was necessary to sell the property in six sections. It was sold to one person.

Vice Chairperson Hoffmann stated that she is glad that it was sold to one owner.
Mr. Ainslie stated that he is not sure if it will remain one piece. They needed to come before
the board to make sure it was subdivided properly. They needed the correct subdivision in order to
close on the property.
Bert Gildersleave, 4135 Tichenor Road, stated that he bought the property from Mr. Ainslie. At
this point he does not have immediate plans for the property. He does plan to keep the majority of
the parcel as a whole unit.
Vice Chairperson Hoffmann closed this segment of the meeting at 7:42 p.m.
RESOLUTION NO. 2000 -65 - SEQR: Preliminary and Final Subdivision Approval, Subdivision of Tax
Parcel No. 24 -5 -2. Havts Road.
MOTION made by Tracy Mitrano, seconded by Larry Thayer.
WHEREAS:
1. This action is Consideration of Preliminary and Final Subdivision Approval for the proposed
modification of the previously approved subdivision of a 57.7 +/- acre parcel on Hayts Road into
six lots on Town of Ithaca Tax Parcel No. 24 -5 -2, AG- Agricultural District. The 57.7 +/- farm
parcel is proposed to be subdivided into six residential lots consisting of three 4 +/- acre lots, one
2.1 +/- acre lot, one 20.7 +/- acre lot, and one 22.8 +/- acre lot. Robert H. Ainslie and Judy L.
Singer, Owners /Applicants, and
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively
determined to act as Lead Agency in environmental review with respect to Subdivision
Approval, and
3. The Planning Board, on July 18, 2000, has reviewed and accepted as adequate the Short
Environmental Assessment Form Part I prepared by the applicant, a Part II prepared by the
Town Planning staff, a survey map entitled "Subdivision Map Showing Proposed Subdivision
by Robert Ainslie and Judy Singer Located on Hayts Road, Town of Ithaca, Tompkins County,
New York," dated April 1, 2000, prepared by T. G. Miller PC, Engineers and Surveyors, and
other application materials, and
4. The Town Planning staff have recommended a negative determination of environmental
significance with respect to the proposed subdivision.
NOW, THEREFORE, BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby makes a negative determination of environmental
significance in accordance with the New York State Environmental Quality Review Act for the above
referenced action as proposed and, therefore, neither a Long Environmental Assessment Form, nor
an Environmental Impact Statement will be required.

RESOLUTION NO. 2000 -66 - Preliminary and Final Subdivision Approval, Subdivision of Tax Parcel

MOTION made by Larry Thayer, seconded by Rod Howe.
WHEREAS:

1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary
and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists,
having determined from the materials presented that such waiver will result in neither a
significant alteration of the purpose of subdivision control nor the policies enunciated or implied
by the Town Board.
2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision of Town of Ithaca Tax Parcel No. 24 -5 -2 into six lots as shown on the
survey map entitled "Subdivision Map Showing Proposed Subdivision by Robert Ainslie and
Judy Singer Located on Hayts Road, Town of Ithaca, Tompkins County, New York," dated
April 1, 2000 and prepared by T. G. Miller PC, Engineers and Surveyors, subject to the
following condition:
a. approval by the Tompkins County Health Department of any necessary on lot sewage
disposal systems, prior to the issuance of any building permit;
AND BE IT FURTHER RESOLVED:
That the Town of Ithaca Planning Board hereby waives the requirement for any park land dedication
or payment of a fee in lieu of such land dedication, having determined from the materials presented
that a proper case does not exist for requiring that a park or parks be suitably located as part of the
proposed plat, and that such waiver will result in neither a significant alteration of the purpose of
subdivision control nor the policies enunciated or implied by the Town Board.
A vote on the MOTION resulted as follows:
AYES: Hoffmann, Mitrano, Thayer, Howe.
NA YES: None.

AGENDA ITEM: SEAR Determination, Montessori School Addition - Site Modifications, 120
East King Road.
Vice Chairperson Hoffmann opened this segment of the meeting at 7:50 p.m.
Board Member Mitrano stated that she previously disqualified herself when a Montessori
School application came before the board. Her son has not been enrolled in Montessori School for 3
years. She has not taken part in Montessori School activities. She feels it is appropriate for her to
vote on the application.
Vice Chairperson Hoffmann stated that the information that the board received noted changes
in the window and door layout. There are some interior changes. Vice Chairperson Hoffmann stated
that she would like to hear about the interior changes in detail.

Peter Demjanec, Demjanec & Associates, stated that the applicant submitted three drawings
to the board. The changes that have been made are shown on the floor plan. The board previously
approved a classroom with two lesson rooms and a kitchenette. The owners wish to build a
classroom without the two lesson rooms. They would like to replace the lesson rooms with a
bathroom and mechanical room. The kitchenette is relocated. The exit door out of the multipurpose
room has been moved.
Vice Chairperson Hoffmann stated that the drawings do not note the name of the rooms being
referred to. Where is the kitchenette located?
Mr. Demjanec stated that it is located toward the bottom of the drawing from the bathroom. It
is adjacent to the entry door into the classroom. Mr. Demjanec showed the differences between the
1997 floor plan and the 2000 floor plan to the board.
Mr. Kanter stated that the footprint of the addition remains the same. There are minor interior
and exterior changes.
Vice Chairperson Hoffmann stated that the original plan has doors leading out from the main
classroom. Is that still the case?
Mr. Demjanec stated that it is not the same.
Vice Chairperson Hoffmann stated that one could leave the classroom through the main
entrance or from the two doors leading out on the other side of the building.
Mr. Demjanec stated that they could exit directly to the exterior out of the north fagade.
Vice Chairperson Hoffmann asked what are the exterior changes.
Mr. Demjanec stated that the proposed elevation and the north elevation of the construction
drawings are indistinguishable. The proposed east elevation and the east elevation of the
construction drawings differ in that the single exit door is separated from the run of windows by one
module and is moved slightly to the south.
Vice Chairperson Hoffmann stated that there is also a window that has been removed. The
original drawing shows two windows.
Mr. Demjanec stated that the window has not been removed. It is shown on the east elevation
of the construction drawings. It is located in the existing building.
Vice Chairperson Hoffmann asked if there are other changes to the outside on the ground.
Mr. Demjanec responded that there were no changes to the footprint.
Vice Chairperson Hoffmann stated that she noticed the drawings of the parking signs and the
new manhole detail.

Board Member Thayer stated that the plans are straightforward. He does not have a problem
with them.
RESOLUTION NO. 2000 -67 - SEQR Preliminary & Final Site Plan Approval, Montessori School
Modifications, 120 East King Road, Tax Parcel No. 43- 1 -3.5.
MOTION made by Tray Mitrano, seconded by Rod Howe.
WHEREAS:
1. This action is consideration of Preliminary and Final Site Plan Approval for the proposed
modifications to the previously approved site plan at the Montessori School Main Building,
located at 120 East King Road, Town of Ithaca Tax Parcel No. 43- 1 -3.5, Residence District R-
30. The proposed modifications include changes to the exterior doors and windows and
changes to the interior layout. The size and location of the addition has not changed.

Mr. Demjanec stated that they have submitted drawings to Mr. Frost for a building permit
application. There is a possibility that Mr. Frost may require some changes to the plan. He asked
that in the event that changes are required, would they need to reappear before the Planning Board.
Vice Chairperson Hoffmann asked if they knew what the possible changes are.
Mr. Demjanec responded that it is speculative. It is possible that Mr. Frost will approve the
plans as drawn. He may require some changes, for example, a reverse of a door swing or the
addition of an exit door. He does not know if Mr. Frost will require anything.
Mr. Kanter stated that the board couldn't say at this point until they know what the change is.
There are many things that would need to come back before the board under current site plan
regulations. They could not preapprove something without knowing what the change would be. This
board cannot give a blanket deferral of having to come back. They do not know the scenario.
Mr. Demjanec asked if anything that Mr. Frost may require forestalls them until the next
Planning Board meeting.
Vice Chairperson Hoffmann stated that Mr. Frost follows the rules of the Town. If the rules and
regulations state that something has to come back before one of the boards, then it is the way it has
to go.
Mr. Kanter stated that if it is a code issue that does not result in any actual site plan changes,
then it would not need to come back before the board. If an addition of a door or window were
required, then it would need to come back.
Mr. Demjanec stated that they submitted drawings to Mr. Frost June 6t". He forestalled action
on them pending the outcome of the Planning Board meeting.

Mr. Kanter stated that they would have heard something from Mr. Frost that would have
implied that there would be changes.
Mr. Demjanec stated that he was in a similar situation when he was before the Planning Board
for the middle school. They had a subsequent New York State hearing. New York State required
some changes. It then required them to come back before the Planning Board.
Board Member Mitrano stated that she does not see them having to come back before the
Planning Board.
Vice Chairperson Hoffmann stated that she is puzzled that the Planning Board has not heard
anything about a possible problem before the applicant appeared before the Planning Board.
Mr. Kanter stated that he does not know of specific concerns.
AGENDA ITEM: PERSONS TO BE HEARD.
Vice Chairperson Hoffmann opened this segment of the meeting at 8:10 p.m.
Dan Pascone, Better Housing of Tompkins County, stated that the Development Corporation is
one of the co- general partners in the development of Linderman Creek. Last month they appeared
before the Planning Board. There was a public hearing on their request for final site plan approval.
They received final site plan approval with a few conditions. He is before the board to ask for
reconsideration.
Mr. Fennessey's main concern is with the safety of the tenants in respect to the walkway and
dumpster enclosure. See Attachment #1. If there were another public hearing he would encourage
Mr. Fennessey to attend in person.
Board Member Mitrano stated that she is in favor of a re- hearing. She does remember that the
second applicant at that meeting was talking through the entire presentation. It distracted her
attention to this applicant. She did drive by the site before the previous presentation. She is open to
a complete discussion of the sidewalk. She was not looking at that specific issue when she drove
past the site. There is a specific response to the conditions. It is a respectful way to request that the
board look at it again.
Board Member Howe stated that he would be willing to look at the application again. He would
like to look at the site again.
Vice Chairperson Hoffmann stated that she feels that the board should do a site visit together.
Board Member Thayer stated that he walked the possible route for the sidewalk. He would like
to discuss it some more. He would also like to discuss the dumpsters. It is an attractive 3 -sided
fence around the dumpsters. The dumpster can be seen, but there is also good access to the
dumpster. He does not know what good putting four sides on one dumpster would do. This
dumpster will not be seen.

Vice Chairperson Hoffmann stated that she takes objection to hearing that it would require an
installation of a 14 foot wide or two 7 foot wide doors. She does not believe that it would be
necessary. It could be a partial stationary wall. Then it could have two smaller doors. It would be
enough for the garbage people to empty the dumpster.
Board Member Thayer stated that they set the dumpster down in a different place every time.
It would be difficult for them. They would have to line up perfectly each time. It would take a lot of
extra time to get it in the same exact spot each time.
Mr. Kanter stated that this particular dumpster was relocated prior to coming before the board.
If the board decides to change it, they may require the applicant to resituate it. The dumpster could
be turned.
Board Member Thayer stated (referring to the walkway to Route 79) that a walkthrough would
be helpful.
Vice Chairperson Hoffmann stated that she does not understand why the issue of safety was
not brought up when they originally talked about it. What has changed?
Mr. Pascone stated that they have had some consultations with the Department of
Transportation (DOT). At one time they thought that the entrance drive would be in the approximate
location of the walkway. The entrance drive was moved. There is a cluster of issues around that
bend in the road.
Vice Chairperson Hoffmann stated that she remembers DOT did have problems with the main
entrance in that location. The board also had a problem with the main entrance being in that location.
She does not remember DOT having any comments about the walkway at that time. The board did
not have a problem with the walkway being in that location as long as the main entrance was up the
road further.
Board Member Thayer stated that the main entrance drive could be lined for a pedestrian
walkway along one side. A sidewalk could be put along the entrance drive. There is plenty of room.
At least half the development could walk out the entrance drive and not be any further than walking
down to the crosswalk. It could be designated as a walkway. It would be much safer for children.
Vice Chairperson Hoffmann asked if there are shoulders next to the pavement.
Board Member Thayer responded that there are shoulders. The grass is high. There could be
a sidewalk.
Vice Chairperson Hoffmann stated that she feels that walkways and sidewalks are not only for
children. They are for everyone and are important for everyone.
Mr. Pascone stated that they would take it into consideration.

Vice Chairperson Hoffmann stated that the board has agreed that they would like to hear the
application again. The board could arrange for a site visit.
Mr. Pascone stated that he would be willing to attend. Mr. Fennessey and the architect could
also be present.
Mr. Kanter stated that it would be on the September 5th agenda.
Vice Chairperson Hoffmann closed this segment of the meeting at 8:26 p.m.
AGENDA ITEM: OTHER BUSINESS.
Mr. Kanter stated that he would like to cancel the August 1St meeting. There are no items at
this time for that meeting. He asked if everyone would be able to attend the August 15th meeting.

Board Member Mitrano stated that she would not be available for the August 15th meeting.
Mr. Kanter stated that they would cancel the August 1St meeting. He will look at the August
15th date and reschedule it as necessary. The Baker Institute is coming back with a revised sketch
plan.
Mr. Kanter stated that the Town Board would like to set up an interviewing committee to fill Mr.
Ainslie's position on the board. They would like two Planning Board members to be on the
committee. The Town Board will appoint the committee at their August meeting. Then they could
start interviews for early September.
Board Member Thayer stated that he is in and out of town the month of September.
Board Member Mitrano stated that she was on the interviewing committee last time. She is
willing to serve on the committee if no one else would like to. If there are people who would like to be
on the committee who have not had a chance, then they should be first.
Board Member Howe stated that he would be willing to serve on the interviewing committee.
Mr. Kanter stated that they have one candidate from before that they can recontact. The Town
will be advertising the opening.
