TOWN OF ITHACA PLANNING BOARD
SEPTEMBER 21, 1999
The Town of Ithaca Planning Board met in regular session on Tuesday, September 21, 1999, in
Town Hall, 126 East Seneca Street, Ithaca, New York, at 7:30 p.m.
PRESENT: Fred Wilcox, Chairperson; Eva Hoffmann, Board Member; George Conneman, Board
Member; James Ainslie, Board Member; Tracy Mitrano, Board Member; Jonathan Kanter, Director of
Planning; John Barney, Attorney for the Town; Mike Smith, Planner.
EXCUSED: Larry Thayer, Board Member; Daniel Walker, Director of Engineering; George Frantz,
Assistant Town Planner.

Chairperson Wilcox declared the meeting duly opened at 7:32 p.m., and accepted for the
record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town
Hall and the Ithaca Journal on September 13, 1999, and September 15, 1999, together with the
properties under discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of
Danby, upon the Tompkins County Commissioner of Planning, upon the Tompkins County
Commissioner of Public Works, and upon the applicants and /or agents, as appropriate, on
September 15, 1999. (Affidavit of Posting and Publication is hereto attached as Exhibit #1.)
Chairperson Wilcox read the Fire Exit Regulations to those assembled, as required by the
New York State Department of State, Office of Fire Prevention and Control.
AGENDA ITEM: PERSONS TO BE HEARD.
Chairperson Wilcox opened this segment of the meeting at 7:33 p.m., and asked if any
members of the public wished to be heard. With no persons present to be heard, Chairperson
Wilcox closed this segment of the meeting at 7:34 p.m.
AGENDA ITEM: SEOR Determination, Raponi Two Lot Subdivision, 346 Coddington Road.
Chairperson Wilcox opened this segment of the meeting at 7:34 p.m.
Frank Raponi, 346 Coddington Road, stated that he and his son purchased the lot at 346
Coddington Road. He passed away and did not have a chance to legally take part of the lot. His
Aunt Lillian Raponi sold them the lot. She wanted him to build the house that now exists. Mr. Raponi
was not interested at the time because he was still working. He suggested that his son take the
corner lot and he would take the lot behind. Mr. Raponi stated that he never legally had a chance to
take the lot.

Mr. Raponi stated that it has been proposed that he have 20 feet of frontage. In return, he
needs to give 27 feet in the back of the house in front to make up the footage. They planned to use
the same driveway. In the resolution it states that provisions of an easement granting the right of use
access to Coddington Road over the existing asphalt drive on parcel B to any current or future owner
of parcel A be recorded in the deeds for both parcels. He does not know what an easement would
do. It was thought that there would not be a problem because it would be family. The two girls own
the house now and he is the legal guardian. In a few years, they will be able to sell the house if they
like. If the house changes hands, he wants to be able to get to his property. He is willing to leave the
road as it is.
Jonathan Kanter, Director of Planning, stated that subdivision is being created where only one
tax parcel currently exists. If the board approves the two as shown, one of them is a flag lot with
insufficient frontage on Coddington Road, Parcel B has most of the driveway that used to be
attached to the house. They have created a subdivision that separates off most of the driveway from
the house. A cross easement would allow full use of the driveway
Attorney Barney asked if Parcel A could construct a new driveway.
Mr. Raponi stated that they could put a driveway on the opposite side of the house. He would
be willing to allow the new owner use of the driveway but they must agree to maintain it.
Attorney Barney stated that the board does not want to create a lot that has no effective
practical way to get out to the road. There needs to be an easement to allow them to use the
driveway.
Mr. Kanter stated that there are two other possible ways of access. One is to create a new
driveway. It is not desirable because the Town would like to see minimal additional curb cuts on
Coddington Road. The other possibility is parcel B getting access off the roadway to the water tank.
Ithaca College owns it. The Town maintains it.
Attorney Barney stated that an example of an agreement would say the owner of the front
parcel has the right to exit onto the driveway, but in exchange will undertake certain responsibilities.
The problem is that there is no one able to give that agreement. With minors involved, the guardian
does not have that authority without a court order.
Mr. Raponi stated that his lawyer could draw up an agreement and present it to the Town.

subdivision of a 1.34 +/= acre lot into two parcels, located at 346 Coddington Road on Town of
Ithaca Tax Parcel No, 42 =1 =9.14, Residence District R -15. Parcel A will contain 0.64 +/ acres,
and Parcel B will have 0.70 +/- acres. Estate of Stephen J. Raponi, Owner /Applicant; Frank
Raponi, Agent, and
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively
determined to act as Lead Agency in environmental review with respect to Subdivision
Approval, and
3. The Planning Board on September 21, 1999, has reviewed and accepted as adequate a Short
Environmental Assessment Form Part I, submitted by the applicant, and Part II prepared by
the Town Planning staff, a plat entitled "Survey Map, No, 346 Coddington Road, Town of
Ithaca, Tompkins County, New York," prepared by Lee Dresser, Licensed Land Surveyor,
dated 6129199, and other application materials, and
4. The Town planning staff has recommended a negative determination of environmental
significance with respect to the proposed Subdivision Approval;
NOW THEREFORE, BE IT RESOLVED.
That the Town of Ithaca Planning Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review Act
for the above referenced action as proposed and, therefore, neither a Full Environmental
Assessment Form, nor an Environmental Impact Statement will be required.
AYES: Wilcox, Hoffmann, Conneman, Ainslie, Mitrano,
NAYS: None.

proposed subdivision of a 1.34± acre lot into two parcels, located at 346 Coddington Road on
Town of Ithaca Tax Parcel No. 42. =1 -9.12, Residence District R -15. Parcel A will contain 0.64±
acres, and Parcel B will have 0.70± acres. Estate of Stephen J. Raponi, Owner /Applicant;
Frank Raponi, Agent.
Chairperson Wilcox opened the public hearing at 7 :50 p.m., and asked if any members of the
public wished to be heard. With no persons present to be heard, Chairperson Wilcox closed the
public hearing at 7:51 p.m.

Chairperson Wilcox stated that he is bothered by the access to and from parcel B. He is glad
that there will not be an additional curb cut on Coddington Road.
Board Member Hoffmann stated that she has lived with a shared driveway for 30 years.
Things have worked very well.
Board Member Hoffmann asked if they could put into the conditions the possibility that the
gravel road be used for access.
Attorney Barney stated that the road is a limited maintenance road. It is not maintained
regularly. The Town would be uncomfortable turning it into a public road. It maybe used differently in
the future.
NOTION made by Tracy Mitrano, seconded by James Ainslie.
WHEREAS:
1. This action is consideration of Preliminary and Final Subdivision Approval for the proposed
subdivision of a 1.34 +/- acre lot into two parcels, located at 346 Coddington Road on Town of
Ithaca Tax Parcel No. 424414, Residence District R45. Parcel A will contain 0.64 +/- acres,
and Parcel B will have 0.70 +/- acres. Estate of Stephen J. Raponi, Owner /Applicant; Frank
Raponi, Agent, and
2. This is an Unlisted Action for which the Town of Ithaca Planning Board, acting as lead agency
in environmental review with respect to Subdivision Approval, has on September 21, 1999,
made a negative determination of environmental significance, after having reviewed and
accepted as adequate a Short Environmental Assessment Form Part I, submitted by the
applicant, and Part 11 prepared by the Town Planning staff, and
3. The Planning Board, at a Public Hearing held on September 21, 1999, has reviewed and
accepted as adequate a plat entitled "Survey Map, No, 346 Coddington Road, Town of Ithaca,
Tompkins County, New York," prepared by Lee Dresser, Licensed Land Surveyor, dated

NOW, THEREFORE, BE IT RESOLVED.
1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary
and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists,
having determined from the materials presented that such waiver will result in neither a
significant alteration of the purpose of subdivision control nor the policies enunciated or
implied by the Town Board, and
2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision of Town of Ithaca Tax Parcel No. 42- 1414, consisting of 1.34 +/ acres,

following conditions:
a. Obtaining of any necessary variances by the applicant from the Zoning Board of
Appeals with respect to the lack of required lot width at the street line or at the setback
line, or relating to any other zoning non - conformities of either Parcel A or Parcel B, prior
to the signing of the plat by the Planning Board Chair, and
b. Provision of an easement granting the right of use and access to Coddington Road over
the existing asphalt drive on Parcel B to any current or future owner of Parcel A to be
recorded in the deeds for both parcels, and submission to the Town of the language for
such easement for review and approval by the Attorney for the Town prior to the signing
of the plat by the Planning Board Chair.

AGENDA ITEM: SEAR Determination, Garage Addition, 140 Westview Lane.
Chairperson Wilcox opened this segment of the meeting at 7:55 p.m.
James Fowler, 140 Westview Lane, stated that he would like to attach another garage to the
building. Due to deed restrictions he needs to come before the board. He does not know of any
objections by the neighbors.
Chairperson Wilcox asked if there is an existing gravel or concrete pad.
Mr. Fowler stated that the garage would not intrude into the landscaping. It is used as parking
space. There is currently a single car garage.
Board Member Hoffmann asked if the garage addition would block the view of neighbors.
Mr. Fowler stated that the roofline would be lower than the existing roofline. His neighbors do
not have any objection to the addition.
Board Member Hoffmann stated that this area has restrictions on what can be planted so that
views are not obstructed.
Mr. Fowler stated that the existing wall of the garage blocks the view.

Board Member Hoffmann stated that the retaining wall would be next to the garage. What is
the distance between the proposed garage and the retaining wall?
Mr. Fowler stated that it would be about 6 inches. There will be stone and a drainage pipe in
this area. The siding will be the same.

39.652, located at 140 Westview Lane, Residence District R -15. James L. Fowler,
Owner /Applicant, and
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively
determined to act as Lead Agency in environmental review with respect to Site Plan
Approval, and
3. The Planning Board, on September 21, 1999, has reviewed and accepted as adequate a
Short Environmental Assessment Form Part 1, submitted by the applicant, and a Part 11
prepared by Town Planning staff, plans prepared by James L. Fowler, dated August 23, 1999;
and other application materials, and
4. The Town Planning staff has recommended a negative determination of environmental

AGENDA ITEM: SEAR Determination, Frandsen Subdivision — Section 4, Lots D4 and D5, Park
Lane.
Chairperson Wilcox opened this segment of the meeting at 8:06 p.m.
Charles Guttman, Clinton House, stated that Mr. Frandsen received Preliminary Subdivision
approval for a 60 -lot subdivision in 1986. He has received Final Approval for 34 of the 60 lots. Two of
the lots, D4 and D5, have frontage on a proposed road known as Edwin Drive. To date, Mr.
Frandsen has not done anything to construct the road. He does not have immediate intentions of
constructing the road. He has been in communication with the owners of the lots behind D4 and D5.
The back of D1 is adjacent to D5. The back of D2 is adjacent to D4. He is proposing that the board
grant Final Subdivision approval for lots D4 and D5. Mr. Frandsen's intention is to convey D5 to the
owners of D1. The owners of D1 would like to have a larger backyard. The owners of D2 wish to do
the same. The intent is to have a larger back yard and have protection from development in their
back yard. The owner of Lot D5 might construct a swimming pool or basketball court in the future.
This would be the extent of any development.
Chairperson Wilcox closed this segment of the meeting at 8:09 p.m.

WHEREAS.
1. This action is consideration of Final Subdivision Approval for the proposed subdivision of Lots
D4 and D5 from Tax Parcel No. 56 =3 -13.36 in the "Frandsen Subdivision, Section 4." Lot D4
will be consolidated with Tax Parcel No. 56 -3 -13.6 (Lot D2) and D5 will be consolidated with
Tax Parcel No. 56m343.7 (Lot D1). Residence District R45, William Frandsen,
Owner /Applicant, and
2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively
determined to act as Lead Agency in environmental review with respect to Subdivision
Approval, and
3. The Planning Board, on September 21, 1999, has reviewed and accepted as adequate a
Short Environmental Assessment Form Part 1, submitted by the applicant, and a Part 11
prepared by Town Planning staff, a plat entitled, "Section 4 — Lots D4 & D5 — Edwin Drive
(Proposed), "prepared by R. James Stockwin, Licensed Land Surveyor, dated August 2, 1999,
and other application materials, and

significance with respect to the proposed Subdivision Approval of Lots D4 and D5.
NOW THEREFORE BE IT RESOLVED.
That the Town of Ithaca Planning Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review Act
for the above referenced action as proposed, and, therefore, neither a Full Environmental
Assessment Form, nor an Environmental Impact Statement will be required.
AYES: Wilcox, Hoffmann, Conneman, Ainslie, Mitrano.
NAYS: None,

PUBLIC HEARING: Consideration of Final Subdivision Approval for the proposed subdivision
of Lots D4 (18,594 t square feet) and D5 (22,962 ± square feet) from Tax Parcel No. 56 =3 -13.36
in the "Frandsen Subdivision, Section 4," for which Preliminary Subdivision Approval was
granted by the Town of Ithaca Planning Board on July 8, 1986, located on the west side of
Park Lane, Residence District R -15. Lot D4 will be consolidated with Tax Parcel No. 56 =3 -13.6
(formerly Lot D2), and Lot D5 will be consolidated with Tax Parcel No. 56 =3 -13.7 (formerly Lot
D1). William Frandsen, Owner /Applicant.
Chairperson Wilcox opened the public hearing at 8:10 p.m., and asked if any member of the
public wished to be heard. With no persons present to be heard, Chairperson Wilcox closed the
public hearing at 8:11 p.m.
Board Member Hoffmann asked which lots have received Final Subdivision Approval. The lots
along John Street and Park Lane have received Final Subdivision Approval. There are a number
along King's Lane that have not received Final Approval.
Chairperson Wilcox asked what the purpose of the triangle shaped area is.
Mr. Guttman stated that it was part of the proposed road. The purpose is to give frontage to
Lot D5.
Mr. Kanter stated that there was a round cul -de -sac going into the triangular piece.

Chairperson Wilcox stated that the Planning Board previously reserved an area for a future
road. The triangle is used for a turn around.
Board Member Hoffmann stated that she thought the parcels along Slaterville Road were
developed. It might not be possible to extend the road.
Chairperson Wilcox stated that it gives the Town the option.
Mr. Kanter stated that there may or may not be an Edwin Drive as a public road. Most of the
lots being sold are not for that type of development purposes. It could raise questions in the future
about what happens to the remaining proposed lots in Section 4.

WHEREAS:
1. This action is consideration of Final Subdivision Approval for the proposed subdivision of Lots

3. Lots D4 and D5 are part of a 60 4ot subdivision, for which the Town of Ithaca Planning Board,
acting as lead agency in environmental review with respect to Subdivision Approval, did on
July 8, 1986, 'make a negative determination of environmental significance, and further, did on
July 8, 1986 grant Preliminary Subdivision Approval to said 60 -1ot subdivision.
4. The Planning Board, at a Public Hearing held on September 21, 1999, has reviewed and
accepted as adequate, a plat entitled, "Section 4 — Lots D4 & D5 — Edwin Drive (Proposed),"
prepared by R. James Stockwin, Licensed Land Surveyor, dated August 2, 1999, and other

members to an interviewing committee. This is to interview candidates for the Planning Board,

Board representatives to the Interviewing Committee for a new member to serve out the seventh

Mr. Kanter stated that the Town Board representatives would be Tom Niederkorn and Carolyn
Grigorov. There are three potential candidates for the position.
Chairperson Wilcox stated that the board received in their packet an executive summary of the
NESTS study.
The North Campus Residential Initiative Final Environmental Impact Statement was accepted
by the City of Ithaca Planning and Development Board,
Mr. Kanter stated that this would be scheduled for discussion October 5, Then October 19,
the Planning Board will hold a public hearing if the Town Board refers the matter.
Mr. Kanter stated that they had a meeting with Ithaca College. The Town Board wanted a
committee to be set up to discuss the South Hill Conservation area. The purpose was to give Ithaca
College an opportunity to express their concerns about the proposed conservation zone. Ithaca
College expressed the feeling that they would prefer the Town to hold off on adopting any new
zoning until they complete their Master Plan,
Board Member Hoffmann stated that Ithaca College's has done studies of the area.
Mr. Kanter stated that Ithaca College had talked to the Planning Board about their Master Plan
studies in the early 1990's. They had done a basic facility plan at that point. The studies were never
expanded upon.
Board Member Hoffmann stated that they tried to convince the Town to wait until they had
completed their Master Plan.

Mr. Kanter stated that Ithaca College has said that they do not have plans to develop anything
in this area. They do not want anyone to make judgements ahead of time without them having a
chance to look at it themselves. The overall goals are similar.
Chairperson Wilcox stated that he received a press release from the New York State
Department of Transportation. It is announcing that they have scheduled a public information
meeting for a project to replace the Route 366 bridge over Cascadilla Creek. The purpose is to
present project objectives, design concepts and solicit public input.
Chairperson Wilcox stated that the board has received a notice that Robert Burchell will be
giving a talk on October 7"' at the Holiday Inn,
Mr. Kanter stated that they received information on a planning course being offered from
September 29 to November. If anyone is interested, please contact the planning office.
