The Town of Ithaca Planning Board met in regular session on Tuesday, July 6, 1999, in Town
Hall, 126 East Seneca Street, Ithaca, New York, at 7:30 p.m.
PRESENT: Fred Wilcox, Chairperson; Eva Hoffmann, Board Member; George Conneman, Board
Member; James Ainslie, Board Member; Tracy Mitrano, Board Member; John Barney, Attorney for
the Town (7:40 p.m.); George Frantz, Assistant Town Planner.
EXCUSED: Larry Thayer, Board Member; Jonathan Kanter, Director of Planning; Dan Walker,
Director of Engineering; Mike Smith, Planner.

Chairperson Wilcox declared the meeting duly opened at 7:33 p.m., and accepted for the
record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town
Halt and the Ithaca Journal on June 28, 1999, and June 30, 1999, together with the properties under
discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of Danby, upon the
Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public
Works, and upon the applicants and /or agents, as appropriate, on June 30, 1999. (Affidavit of
Posting and Publication is hereto attached as Exhibit #1.)
Chairperson Wilcox read the Fire Exit Regulations to those assembled, as required by the
New York State Department of State, Office of Fire Prevention and Control.
Chairperson Wilcox asked the members of the board and the public to stand. Board Member
Bob Kenerson passed away, Sunday, June 20, 1999. He was a veteran of World War II having
served in the Air Force. He also served on the United Way including five years as the Executive
Director. Board Member Kenerson spent many years active in the community in many organizations
including the Mason's, Rotary Club, and the Republican Committee. He also served many years on
the Town of Ithaca Planning Board. Chairperson Wilcox asked that everyone take a moment of
silence to remember him.
PUBLIC HEARING: Consideration of Final Site Plan Approval for the proposed construction of
Phase II of the Summerhill Apartments, consisting of 84 apartment units, 113 parking spaces,
walkways, and landscaping, located on a 6.4 ± acre parcel on Summerhill Lane, Town of
Ithaca Tax Parcel No. 62 -2 -1.27, MR Multiple Residence District. The project site contains a
0343 ± acre delineated wetland, which will be incorporated into a stormwater retention and
drainage system. Ivar Jonson, Owner /Applicant; Lawrence P. Fabbroni, P.E., L.S., Agent.
This public hearing was originally scheduled for June 15, 1999, but was postponed until July
6, 1999 due to lack of a quorum of voting Board Members.
Chairperson Wilcox stated he wanted to apologize to the applicant for the delay.

Larry Fabbroni, 127 Warren Road, stated that they have obtained the required variance from
the Zoning Board of Appeals. The location of the lights and the type of lighting has been submitted.
There will be a light over each entranceway and lights on the corners of the building for safety.
Board Member Hoffmann stated that the lights on the corners are out in the open.
Mr. Fabbroni stated that the lights are mounted for safety reasons.
Mr. Fabbroni stated that the larger trees have been moved to the parking area to shade and
screen the parking area. They have added 220 plantings in addition to the 70 plantings previously
suggested. The Planning Department requested that there be a drawing to include the additional 220
plantings. There is a natural hedgerow around the site to help seclude the development.
He stated that the design details for the storm water management system are carried over
from the original resolution. He believes the storm water management system has been satisfied.
They have discussed the control of the overflow retention area that will utilize the wetland area with
Mr. Walker and Mr. Noteboom. A silt fence will be around the entire site during construction.
They have submitted details of the curbing. This curbing will allow the creation of more
handicap parking spaces. The curbs can be marked out at grade and allow ground level access from
the parking area to the walkway area. They have added handicap parking spaces throughout the
entire site. This totals eleven handicap parking spaces.
Chairperson Wilcox asked Mr. Fabbroni to explain how they can eliminate curbing to create a
handicap parking space.
Mr. Fabbroni stated that it is a rolled asphalt curbing that will be between the parking space
and the walkway. They are at the same grade as the parking space. This does not require a
handicap ramp. Twenty -five percent of the units need to be handicap adaptable. If this occurs, then
they would knock out curbs to create more handicap parking spaces. Eleven handicap spaces
should be enough for handicapped residents.
Board Member Hoffmann stated that the handicap spaces do not appear larger than other
parking spaces.
Mr. Fabbroni stated that the handicap spaces are on the end. The walkways adjacent to those
spaces are 5 -feet.
George Frantz, Assistant Town Planner, stated that all the walkways are at the same level as
the parking lot. In standard parking lots, there is an extra 4 -feet of parking "lot assigned to handicap
parking spaces. The applicant is able to use the adjacent walkway as the extra 4 -feet of space.
Board Member Hoffmann asked if it is allowed.

Mr. Frantz stated that is does provide adequate space for somebody to enter and exit a
vehicle from a wheelchair. He does not know if there are rules and regulations, but there are
standards. Andy Frost, Building Inspector, would be reviewing this and making the final
determination.
Board Member Hoffmann asked if Mr. Frost had seen the plans.
Mr. Frantz stated that Mr. Frost would review this when the applicant applies for a building
permit.
Board Member Hoffmann stated that if the spaces need to be bigger, then the parking spaces
need to be reconsidered.
Mr. Frantz stated that if they have to change the number of parking spaces it is modification of
site plan approval.
Mr. Fabbroni stated that the Planning Board requested a recreation area for children. They
have included a sandbox, swing set with three swings, and a play structure. They have included 5
bike racks. Sitting benches have also been included in the site. There are four dumpsters on the
site. They are screened on 3 sides.
Board Member Hoffmann asked if there are 2 benches near the play structure.
Mr. Fabbroni stated that there are 2 benches near the play structure and there are 2 additional
benches in the area.
Board Member Hoffmann stated that it would be convenient to have the benches near the play
structure for the parents.
Mr. Fabbroni stated that the two -story drawing shows a dimension of 32 feet 10 inches. The
height maximum in the Town is 38 feet. Most of the buildings on the site, are two -story buildings.
There are two three -story buildings. The three -story buildings are 37 feet and two inches. They are
proposing terraces off the ends of the buildings with roofing.
Board Member Hoffmann asked if the Town could have drawings showing the elevation of the
buildings.
Mr. Fabbroni stated that he would provide the drawings to the Town. This has been a
collaborative possess between the Town and the applicant. The proposal has come along way from
the original proposal in 1981.
Board Member Mitrano stated that she is familiar with this architecture and it will be an
attractive apartment complex. - I .
Board Member Hoffmann asked if David Fernandez has been hired for the landscaping.

Mr. Fabbroni stated that they asked his opinion on species to be planted. He would not do the
plantings himself. Mr. Jonson will do most of the plantings himself. There is a great variety in the
plantings.
Board Member Hoffmann asked how many plantings there would be.
Mr. Fabbroni stated that there would be 220 plantings.
Board Member Hoffmann asked if there would be more plantings around the parking area.
Mr. Fabbroni stated that they have included more plantings around ;the parking area. The
plantings will help to shade the parking area. He explained that he has worked with many landscape
architects that are unable to see where plantings should be located until the building and walkways
are in place. The board does need some commitment. The applicant is committed to 220 plantings.

Mr. Frantz responded that fescue could be grown anywhere. A natural fescue grows 1 to 2
feet in height. Lawn fescue is mowed.
Chairperson Wilcox opened the public hearing at 8:14 p.m., and asked if any members of the
public wished to be heard.

Ithaca Tax Parcel No. 62 -2- 1.127, MR Multiple Residence District. The project site contains a
0.343 ± acre wetland, which will be incorporated into a stormwater retention and drainage

2. This is a Type I Action for which the Town of Ithaca Planning Board, acting as Lead Agency in
environmental review with respect to Site Plan Approval, did on March 2, 1999 make a
negative determination of environmental significance; and
3. The Planning Board, on March 23, 1999, did grant Preliminary Site Plan Approval, with
conditions, for the proposed project; and
4. The Zoning Board of Appeals, on April 14, 1999, did consider and grant the necessary
variance(s) for the proposed project; and
5. The Planning Board, at a public hearing on July 6, 1999, has reviewed and accepted as
adequate a set of drawings entitled "Summerhill Apartments Phase 11 Site Plan', dated
12129198 and revised 5199; "Summerhill Apartments Water & Sewer Plans" dated 1118199;
"Summerhill Apartments Phase 11 Yard Setbacks" dated 1124199 and revised 3199; and
"Summerhill Apartments Phase 11 Landscaping Erosion Control & Drainage Conditions" , dated
1125199 and revised 5199; a set of drawings prepared by Steph "en Cluggish, Architect,
including two entitled "Summerhill Apartments'; Summerhill Lane, Ithaca NY, dated 6114199,
showing elevations with height dimensions, and other application materials, prepared by
Lawrence P. Fabbroni, P. E., L. S.
NOW, THEREFORE, BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby grants Final Site Plan Approval for the
proposed construction of Phase ll of the Summerhill Apartments, as shown on drawings
entitled, "Summerhill Apartments Phase ll Site Plan', dated 12129199 and revised 5199;
"Summerhill Apartments Water & Sewer Plans" dated 1118199; "Summerhill Apartments Phase
ll Yard Setbacks" dated 1124199 and revised 3199; and "Summerhill Apartments Phase ll
Landscaping Erosion Control & Drainage Conditions'; dated 1125199 and revised 5199, all
prepared by Lawrence P. Fabbroni, P.E., L.S., and other application materials, subject to the
following conditions to be met prior to the issuance of a building permit, except for condition

a. that all proposed water and sewer mains and appurtenances be constructed to Town of
Ithaca specification with final design details to be reviewed and approved by the Town
Engineer,
b, submission of a complete landscaping and planting schedule, including location,

final material specifications of all improvements, including proposed water and sewer
line connections;
e. record of application for and approval status of all necessary permits from all relevant
county, state and federal agencies;

Ithaca.

AGENDA ITEM: PERSONS TO BE HEARD.
Chairperson Wilcox opened this segment of the meeting at 8:23 p.m.
Beverly Livesay, 147 Snyder Hill Road, stated that there are dramatic differences and
understandings about the Zoning Ordinance and the character of the East Hill Plaza. It is important
to include the public. The public has made certain assumptions. The Town of Ithaca Town Board
and Planning Board have also made assumptions. The assumptions are dramatically apart. It is
extremely important to get the public's opinion and to look at the last 30 years. The development of
the East Hill Plaza needs to be looked at. Drive - through banks are different from drive - through fast
food restaurants. The motel is much like the apartment buildings. It does not make it something
other than a small community shopping center. It is important for the board to take a close look at
development.
With no other persons to be heard, Chairperson Wilcox closed the public hearing at 8:27 p.m.
AGENDA ITEM: General discussion regarding commercial development and zoning in the
Town of Ithaca.
Chairperson Wilcox opened this segment of the meeting at 8:28 p.m.
Board Member Hoffmann stated that this came up at the last meeting)
Mr. Frantz stated that members of the board can discuss what they perceive to be the current
issues with regard to what needs to be addressed about commercial development.
Board Member Hoffmann stated that there need to be small commercial centers throughout
the Town, so people will not have to drive throughs- residential neighborhoods to do their shopping.--r-
She wished that East Hill. Plaza had remained a small community shopping center. Over the years it

has become much larger than originally proposed. Board Member Hoffmann stated that with the
parcels that might change at East Hill Plaza, this should be discussed during the moratorium.
Board Member Mitrano asked what parcel might change.
Board Member Hoffmann stated that it is rumored that Ides Bowling Lanes has been sold.
Mr. Frantz stated that people do not realize the amount of space used by fast food
restaurants. The Ides parcel has little space to accommodate a development, of that type.
Board Member Mitrano stated that it is rumored that Ides has been sold to a Buffalo
developer. The developer is being very secretive about the change.
Board Member Conneman asked how much control the Planning Board has over the changes.
Mr. Frantz stated that the board could have a lot of control if there are more pedestrian
oriented shopping centers. This is the first Burger King that has a 50- foot'' wide front lawn. If the
Judd Falls Plaza is demolished and replaced with something else, the 50 -foot front yard setback
kicks in. Pavement will be replaced with 50 -feet of lawn unless the developer can convince the Town
otherwise. This regulation was adopted in the early 1990's with Burger King and CFCU now coming
into play.
Board Member Hoffmann stated that the Town has made an exception with the expansion of
the P &C.
Attorney Barney stated that it is less likely to give a new development a variance than an
existing development.
Board Member Ainslie stated that many people think that there is a category of neighborhood
commercial.

Chairperson Wilcox stated there has been a lot of discussion about neighborhood and
community shopping centers. These words are not defined.
Attorney Barney stated that the current Zoning Ordinance does not make a distinction. The
new Zoning Ordinance will define the neighborhood and community shopping centers.
Board Member Ainslie stated that many people are confused. The zoning for the area is only
commercial. It is not neighborhood commercial.
Attorney Barney stated that their thought is that the East Hill shopping center was designed to
be a small neighborhood shopping center. This was not much later than the Pyramid Mail
development. It was described as not being that type of mall: In the Town of Ithaca, there are no
other community -sized shopping centers.

recommended that land to be rezoned from R -30 to Agriculture. In the eyes of Town of Ithaca, this
land is to be reserved as agricultural.
Board Member Conneman stated that Cornell University originally developed a plan with pine
trees in front of the gas station.
Mr. Frantz stated that was the original design. There were a number of items promised by the
developer and not carried out.
Board Member Mitrano asked if the board could get Big AI's under control. Across the street
could be a good location for a small new business. It will not happen with the bright lights from the
gas station.
Mr. Frantz stated that he understands it is still under discussion. Hopefully, something will be
done about the lights.
Attorney Barney stated that Mr. Herzing came before the board with a sketchy lighting plan.
Mr. Herzing feels that he is allowed to make changes to his site plan. Legally, he may be right. The
Zoning Ordinance has been amended to eliminate the $10,000 alteration.
Mr. Frantz stated that the Planning Department is working on a possible outdoor' lighting
control ordinance. It can be written in a way that will not allow that type of lighting. It is something
everyone would have to conform to when they come before the board.
Board Member Hoffmann stated she is concerned that the building and canopy at Big AI's is
higher in elevation than in the plan. It makes a difference with the lights if they higher than they are
suppose to be. It might be happening at Woven Hearts also. Thetuildings appear to be higher.
Applicants should not be allowed to raise a building without the Town looking into the potential effects
of it.
Mr. Frantz stated that the building at Woven Hearts is correct. The Planning Department is
looking into an ordinance that does not permit light spillage beyond the: property line. If they have to
elevate the buildings, they must then adjust the lighting factor.

Chairperson Wilcox stated that if the element is seen then there will be glare.
Mr. Frantz stated that an outdoor lighting control ordinance `would address these lighting
issues.
Attorney Barney stated that the building inspector feels that Woven Hearts has built in
compliance with the site plan.
Board Member Ainslie asked if Mr. Frost has the time to measure everything being built.
Chairperson Wilcox stated that the board needs to keep in mindwhat a two -story house would
look like at the same elevation.
Mr. Frantz stated that staff is used to looking at designs and visualizing what it will look like. It
is more difficult for the board to visualize it. Staff sometimes does a poor job of conveying it to the
board.
Board Member Mitrano asked what type of things the board could do to control some of these
problems.
Board Member Hoffmann stated that bedrock needs to be defined.
Board Member Conneman stated that there are maps that tell where bedrock is. People can
also tell by looking at the soil.
Board Member Mitrano asked if this is something that they should ask of the applicant.
Board Member Conneman responded yes.
Board Member Hoffmann stated that this would allow the board to know what the final
elevation would be.
Attorney Barney stated that if elevation is an element of the board's approval, the applicant
must come before the board. Before Big AI's, the applicant would be allowed to elevate it within so
many feet.
Mr. Frantz stated that there was a good grading plan for Big AI's that gave finished floor
elevations. Summerhill does not have finished floor elevations. This can be addressed in the
requirements for site plan approval. The applicant could provide floor elevations.
Attorney Barney stated that the board has the power to ask for it now. New legislation does
not need to be passed.

Chairperson Wilcox stated that the applicant could move the building 2 -feet in any direction
except up or down.
Mr. Frantz stated the building could be moved 2 -feet in any direction.
Board Member Hoffmann stated that she interprets it as 2 -feet side ways.

Mr. Frantz responded that it does not mention horizontal movement. Therefore, it can be
moved 2 -feet in any direction.
Board Member Hoffmann asked how the board feels about commercial development in the
Town.
Board Member Ainslie stated that many people do not want East Hill to look like Elmira Road,
Elmira Road is becoming vacant. There is more vacant road on Elmira, °Road than on the Commons.
Chairperson Wilcox stated that he is comfortable with the general direction of the zoning.
There are commercial areas set up on East and South Hill. There is no;t an area on West Hill,
Mr. Frantz stated that when the Comprehensive Plan was being drafted, an analysis was done
to create a neighborhood scale shopping center that would serve the future population of West Hill.
The Town would need to rezone 7 acres.
Board Member Ainslie stated that there are not many people who can buy groceries in the
smaller shopping centers. They would go broke. People on budgets need the larger chain stores for
the lower prices.
Chairperson Wilcox stated that they serve a useful purpose as long as they are contained.
Mr. Frantz stated that the Community Corners Shopping Center has as much square footage
as East Hill Plaza. Is the concern that it is a neighborhood or community shopping center or is it a
matter of design?
Board Member Mitrano stated that it is a good question. She thinks it is a matter of design.
Board Member Conneman asked if there was a design for East Hill Plaza that was a small
community shopping center.
Mr. Frantz responded yes. It is on file in the Planning Department. The initial plan showed a
nicely designed pedestrian community shopping center. Then the typical strip shopping center with a
sea of asphalt appeared.

GIVEN that a Public Hearing will be held by the Planning Board of the
Town of Ithaca on Tuesday, July 6, 1999, at 126 East Seneca Street,
Ithaca, N.Y. , at the following time and on the following matter:
7 :30 P.M. Consideration of Final Site Plan Approval for the proposed
construction of Phase II of the Summerhill Apartments,
consisting of 84 apartment units, 113 parking spaces,
walkways, and landscaping, located on a 6 . 4 +/- acre parcel
on Summerhill Lane, Town of Ithaca Tax Parcel No. 62-2-1 . 127,
MR Multiple Residence District . The project site contains a
0 .343 +/- acre delineated wetland, which will be incorporated
into a stormwater retention and drainage system. Ivar
Janson, Owner/Applicant; Lawrence P. Fabbroni, P.E. , L. S. ,
Agent . This public hearing was originally scheduled for June
15, 1999 , but was postponed until July 6, 1999 due to lack of
a quorum of voting Board members.
Said Planning Board will at said time and said place hear all persons in
support of such matter or objections thereto. Persons may appear by
agent or in person. Individuals with visual impairments, hearing
impairments or other special needs, will be provided with assistance as
necessary, upon request. Persons desiring assistance must make such a
request not less than 48 hours prior to the time of the public hearing.
