HomeMy WebLinkAboutPB Minutes 1993-11-161 i f0 ' i OCT TOWN OF ITHACA PLANNING BOARD NOVEMBER 16, 1993 The Town of Ithaca Planning Board met in regular session on Tuesday, November 16, 1993, in Town Hall, 126 East Seneca Street, Ithaca, New York, at 7:30 p.m. PRESENT: Chairperson Carolyn Grigorov, Robert Kenerson, Virginia Langhans, James Ainslie, Eva Hoffmann, Herbert Finch, Stephen Smith, Floyd Forman (Town Planner), Daniel Walker (Town Engineer), John Barney (Town Attorney). ALSO PRESENT: Attorney Shirley Egan, Gregory Bell, Nancy Goody, Lewis Roscoe, Cheryl Smith, Deborah O'Connor, William Frandsen, John Gutenberger, John Whitcomb, Niels Otani, J. Earl Thomas. Chairperson Grigorov declared the meeting duly opened at 7:35 p.m. and accepted for the record the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on October 20, 1993, and October 28, 1993, respectively, together with the Secretary's Affidavit of Service by Mail of said Notice upon the various neighbors of each of the properties under discussion, as appropriate, upon the Clerks of the City of Ithaca and the Town of Ithaca, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, upon the Tompkins County Assessment Department, and upon the applicants and /or agents, as appropriate, on October 28, 19936 Chairperson Grigorov read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. AGENDA ITEM: PERSONS TO BE HEARD. There were no persons present to be heard. Chairperson Grigorov closed this segment of the meeting. PUBLIC HEARING: CONSIDERATION OF THE DRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENT (DGEIS) PREPARED BY CORNELL UNIVERSITY IN ORDER TO EVALUATE POTENTIAL ENVIRONMENTAL IMPACTS OF A PROPOSED REZONING AND POSSIBLE CAMPUS DEVELOPMENT SCENARIOS FOR A PORTION OF AN 8261-ACRE TRACT OF LAND BOUNDED BY ROUTE 366 AND SNYDER HILL ROAD, GAME FARM ROAD, AND JUDD FALLS ROAD, RESIDENCE DISTRICT R -30. NANCY GOODY, PROJECT MANAGER. Chairperson Grigorov declared the Public Hearing in the above - noted matter duly opened at 7:37 p.m. and read aloud from the Notice of Public Hearings as posted and published and as noted above. Planning Board 2 November 16, 1993 Chairperson Grigorov asked what happened to the comments submitted regarding the Draft Generic Environmental Impact Statement and whether they were recorded into the findings. Town Planner Floyd Forman responded that the comments were recorded in the Final. Environmental Impact Statement and that all of the comments and questions received will be responded to as part of the Final Environmental Impact Statement, the findings will come from and after the Final Environmental Impact Statement is written. Chairperson Grigorov stated that the Statement itself will not be revised but there will be a place for the answers to be attached to it. Town Planner Floyd Forman stated t) the process. Mr. Forman stated that document will be considered as part of Impact Statement. at was how corrections the Final he understood made to the Environmental Town Attorney John Barney agreed that, mechanically, it would be easier to take the existing document and do an addendum to it of corrections and additions, or indications, of why a particular comment was mentioned but not adopted. Chairperson Grigorov asked how much longer the public had to submit comments. Town Planner Floyd Forman responded that the public had until November 29, 1993 to submit any comments or questions to the Planning Department. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone from the public wished to speak. No one spoke. Town Planner Floyd Forman stated for the Board's information that he would place an ad in the Ithaca Journal letting the public know what the comment period is in case anyone wished to comment on the Draft Generic Impact Statement. There appearing to be no further discussion, Chairperson Grigorov closed the Public Hearing regarding the Draft Generic Environmental Impact Statement at 7:40 p.m. AGENDA ITEM: APPROVAL OF MINUTES - June 15, 1993. MOTION by Virginia Langhans, seconded by Herbert Finch: RESOLVED, that the Minutes of the Town of Ithaca Planning Board Meeting of November 16, 1993, be and hereby are approved as written. Planning Board 3 November 16, 1994 There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Langhans, Ainslie, Finch, Smith. Nay - None. Abstain - Hoffmann. The MOTION was declared to be carried. AGENDA ITEM. REPORT OF THE TOWN PLANNER. Town Planner Floyd Forman addressed the Board and stated that the agenda items for the next Planning Board meeting would be; Ithacare for rezoning, Sanctuary Drive - Mr. Lucente for a 12 -lot subdivision, and Headstart Program in the Church of Latter Day Saints. Mr. Forman then stated that he had given each of the Board Members a copy of the Environmental Impact Statement for Peregrine Hollow. Mr. Forman gave a brief overview about the Peregrine Hollow Project and stated that this was a proposed 225 -lot Cluster Subdivision that borders Eastern Heights Park off Snyder Hill Road. The project includes townhouses, single family homes, and possibly some units for the elderly. Mr. Forman stated that the developer was Ralph Varn. Mr. Forman stated that the Town of Dryden Planning Board has a Public Hearing scheduled for Thursday, December 2, 1993, at 8:15 p.m. Mr. Forman stated that both he and Daniel Walker would be attending this meeting and wanted to open the invitation to any of the Planning Board Members that wished to attend. Town Engineer Daniel Walker addressed the Board and stated that there were drainage problems that were caused by the Eastern Heights subdivision. The Town has been correcting the drainage problems in the Park Lane area. Mr. Walker stated that uncontrolled drainage may cause problems for properties in the lower portion of the Town of Ithaca. The developer is proposing a series of onsite retention ponds and diversions to minimize any offsite problems. Board Member James Ainslie asked Mr. Walker what type of drainage was present there. Town Engineer Daniel Walker responded that the drainage was all open channel. Mr. Walker stated that the average slope on this site was between 5 and 20 percent. Chairperson Grigorov, referring to Peregrine Hollow, asked how the size of the proposed lots in the Town of Dryden compared to the existing lots in the Town of Ithaca. Town Engineer Daniel Walker stated that the lots were about the same size as R -15 requirements which presently exist on Eastern Heights Road in the Town of Ithaca. Mr. Walker stated that there 0 Planning Board 4 November 16, 1994 were a few concerns that would need to be discussed with the Town of Dryden. Mr. Walker briefly explained the details involved with the water, and the charges that the Town of Dryden pays to the Town of Ithaca for maintenance charges. Mr. Walker stated that the Town of Dryden has the right to purchase additional capacity from the wastewater treatment plant for sewage flows. Mr. Walker stated that there are concerns with the capacity of the sewer and that there would be a full evaluation of that concern. Mr. Walker stated that there was also a threshold level to consider as well. Phase I of the development would be 48 single family units and townhouses and would be in the Town of Dryden only in this phase. There was some discussion of the traffic and low visibility levels on Snyder Hill Road and Slaterville Road. Town Engineer Daniel Walker stated that there was 20 lots proposed within the Town of Ithaca and would require Town of Ithaca Subdivision Approval, which would possibly be Phase II or III, but it would not be in the near future. Town Attorney John Barney stated, for the record, that his office has in the past represented Varn Brothers, but his office was not representing them as far as Mr. Barney knew with anything having to do with the Town of Ithaca, but he was not certain what the office's role was regarding the Peregrine Hollow application in Dryden, but that there may be some involvement there. Chairperson Grigorov stated that the Peregrine Hollow Public Hearing will be held in the Town of Dryden on December 2, 1993, which will be before the Town of Ithaca Planning Board meets again. Town Engineer Daniel Walker stated that the Town of Dryden will be accepting written comments regarding Peregrine Hollow Subdivision until December 12, 19930 Cheryl Smith addressed the Board and stated that the developer, Ralph yarn, had made a model of the whole site plan, including elevation drawings. It would be necessary for Mr. Varn to appear before the Planning Board when it gets to the stage that would involve the Town of Ithaca. PUBLIC HEARING: CONSIDERATION FOR FINAL SUBDIVISION APPROVAL OF ITHACA TAX PARCEL NO. 56 -03 -13.21 2.244 + /- ACRES INTO FIVE LOTS; 4 RESIDENTIAL LOTS OF 0.364 + /- ACRES, 0.452 + /- ACRES, 0.504 + /- ACRES, 0.397 + /- ACRES; AND 0.545 + /- ACRES FOR THE EXTENSION OF PARK LANE TO SLATERVILLE ROAD (ROUTE 79), AND A 60- FOOT ROAD RIGHT OF WAY FOR ACCESS TO THE REMAINDER OF THE PROPOSED SUBDIVISION, RESIDENCE DISTRICT R -15. WILLIAM FRANDSEN, OWNER; DANIEL WALKER, TOWN ENGINEER, AGENT. Planning Board 5 November 16, 1994 Chairperson Grigorov declared the Public Hearing in the above - noted matter duly opened at 8:06 p.m. and read aloud from the Notice of Public Hearings as posted and published and as noted above. At this time, Chairperson Grigorov stated, for the record, that she and Board Member Eva Hoffmann had viewed the site. Town Attorney John Barney addressed the Board and stated that there had been ongoing negotiations between Mr. Frandsen, Mrs. Quick, and the Town of Ithaca for the creation and completion of Park Lane which has been proceeding for a number of years, more actively negotiated in the past couple of years. Mr. Barney stated that an agreement had been reached between all parties involved and the subdivision approval request that the Board will discuss tonight is the result of those agreements in an effort to get Park Lane opened and available for public use and for the Town's use. The Town agreed as part of the agreement to present this to the Planning Board which is the role that Daniel Walker has, but he is not acting as an agent specifically for either Mr. Frandsen or Mrs. Quick. Town Engineer Daniel Walker addressed the Board and stated that the Frandsen property preliminary subdivision approval had already been granted.. Mr. Walker stated that Park Lane had already been constructed, inspected and approved by the Town Highway Superintendent. The public utilities of water and sewer were already constructed to serve all four lots and that Mr. Walker, as Town Engineer, has already inspected and approved the water and sewer construction. Mr. Walker stated that having four lots fronting on Park Lane was consistent with the Preliminary Subdivision Approval. Board member Virginia Langhans asked if Brian Drive would be finished. Town Engineer Daniel Walker stated that at this point it was rough graded and that the drainage ran down Brian Drive to Park Lane and then down the hill. Mr. Walker stated that the road had been fully cleared. Town Attorney John Barney stated that there are some letters and understandings that the location of Brian Drive had been agreed upon for quite some time. Board Member James Ainslie asked if there was any reason to believe that this subdivision would be built on now. Town Engineer Daniel Walker stated that the four residential lots would be sold and built on within the next five years. Mr. Walker stated that the reason for the road is to open Park Lane. Planning Board 6 November 16, 1994 Bill Frandsen addressed the Board and stated that the water main was designed to go up John Street and come down Brian Street and a request was made that Mr. Frandsen finish the water that runs up to John Street and complete the circle all the way. Niels Otani of 122 Park Lane addressed the Board and asked that the Planning Board not allow Park Lane to be opened for safety reasons. Mr. Otani stated that the road is dangerous, steep, and there is an extreme curve at the point where Park Lane would open onto Route 79. Mr. Otani suggested two possible scenarios that could result from opening Park Lane. 1) cars could slide into Route 79, and, 2) an increased possibility for a head -on accident due to the blind curve. Mr. Otani stated that cars would not be able to stop until it was too late because they would not be able to see the stalled car until they were right on top of it. Mr. Otani stated that if someone were to come to his house for help he would not hesitate to tell them that he had warned the Town of how dangerous it was before the road was opened. Mr. Otani stated that he would implore that the Board approve of the development without approving the opening of Park Lane. Board Member Eva Hoffmann asked Mr. Otani if he knew of any specific accidents in Eastern Heights. Mr. Otani stated the he did not know of any accidents. Board member Virginia Langhans asked Mr. Walker what the grade of the road was. Mr. Walker responded that it was right at the maximum amount that the Town would allow, 9 %. Cheryl Smith addressed the Board by asking if there were regulations regarding school buses in relation to the grades of the public roads. Town Engineer Daniel Walker stated that if it is a public road that is maintained, he did not feel that there were any limitations. Town Attorney John Barney concurred with Mr. Walker's statement. Earl Thomas addressed the Board and stated that he has been fighting this extension since the 1986 Town Board meeting where it was originally proposed to build the extension of Park Lane down to Slaterville Road. Mr. Thomas cited two nearly fatal accidents that he in had been close the Town Board to on Snyder Hill Road. Mr. Thomas Minutes of 1986 there is a detailed stated that description of he the accidents agreed that an that he was speaking of. Mr. Thomas unacceptable hazard was about to be stated that created. Cheryl Smith addressed the Board by asking if there were regulations regarding school buses in relation to the grades of the public roads. Town Engineer Daniel Walker stated that if it is a public road that is maintained, he did not feel that there were any limitations. Town Attorney John Barney concurred with Mr. Walker's statement. Planning Board 7 November 16, 1994 Cheryl Smith asked who set up the patterns that school buses take. Attorney John Barney stated that the School District sets up their own routes. Cheryl Smith asked about the 10% green space that was supposed to be set aside. Mr. Walker stated that as part of the agreement made between Mr. Frandsen and the Town of Ithaca was that Mr. Frandsen's cooperation in constructing the link through to Slaterville Road would be considered as his requirement for set aside lands, along with the amount of lands in Eastern Heights that had already been set aside. The overall infrastructure that is shown on the Preliminary Subdivision map was set by the Town Board and the Planning Board to meet any open space set aside requirements for this subdivision. Cheryl Smith asked if the set aside was waived for Mrs. Quick's property as well. Town Engineer Dan Walker stated that the Quick's gave a 60- foot right of way to the Town of Ithaca and-that the Town had exceeded -that tremendously, so the Town of Ithaca waived the open space requirements for the Quick property subdivision. Town Attorney John Barney stated that the 60 -foot right of way was in lieu of the 10% set aside should Mrs. Quick ever choose to develop her property. Mr. Frandsen stated that in regard to the open land space this was done in coordination with Eastern Heights. Mr. Frandsen stated that where Mr. Frandsen and Mrs. Quick had lacked the open space required by the Town, Eastern Heights donated the land. Mr. Frandsen and Mrs. Quick gave Eastern Heights the right of way which gave Eastern Heights the access to build and maintain the sewer. There was a definite need for an additional roadway, and there have been thirteen designs for different locations of the roadway and the choice shown on the proposed subdivision map was the location that seemed to make the most sense. Mr. Frandsen stated that both Dan Walker and Larry Fabbroni spent a considerable amount of time making Park Lane the easiest access road that could possibly be built in that location to satisfy that number of houses for an additional exit. Mr. Frandsen stated that he felt that the finished job was excellent. There being no further discussion, Chairperson Grigorov closed the all Public coming from Eastern Heights Hearing and brought it back to the Board for discussion. Board Member Eva Hoffmann stated that she was concerned with the steepness of all roads there both coming from Eastern Heights Planning Board 8 November 16, 1994 up to Snyder Hill Road and this extension of Park Lane, and just because there are other steeper roads that work doesn't mean that the Board shouldn't strive to get a road that poses the safest situation. There appearing to be no further discussion, Chairperson Grigorov asked if anyone were prepared to offer a motion. MOTION by Herbert Finch, WHEREAS. seconded by Robert Kenerson: 10 This action is the Consideration of Final Subdivision Approval for the Ithaca tax parcel 56 -3 -13.2, 2.244 + /- acres into six lots; 4 residential; of 0.364 + /- acres, 0.452 + /- acres, 0.504 + /- acres, 0.379 + /- acres; and 0.545 + /- acres for the extension of Park Lane to Slaterville Road (Rte. 79), and one lot representing the balance of the parcel including a 60 foot road right of way for access to the remainder of the proposed subdivision, Residence District R -15, said subdivision having received Preliminary Subdivision Approval from the Planning Board on July 8, 1986 for a 60 lot subdivision; Frandsen, Owner, Dan Walker, Agent. 2. This 60 lot subdivision which received Preliminary was a Type I Action for which the Town of Ithaca William Approval Planning Board, acting as Lead Agency in environmental review, did at a Public Hearing held on July 8, 1986, make a negative determination of significance, and 39 The current Final Subdivision of four building lots, three of which have been. reconfigured from the Preliminary Approval, the Park Lane Extension, and the remaining land including a 60 foot road right of way for access to the proposed subdivision, is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively determined to act as Lead Agency in environmental review with respect to Subdivision Approval, and 4. The Planning Board, at a Public Hearing held on November 16, 1993, has reviewed and accepted as adequate the Short Environmental Assessment Form Part I prepared by the applicant, a Part II prepared by the Town Planning staff, a subdivision plat entitled "Frandsen Subdivision, Section 3, Town of Ithaca, Tompkins County, New York," prepared by James Stockwin, Stockwin Surveying, and dated November 2, 1993, and other application materials, and 5. The Town planning staff has recommended a negative determination of environmental significance with respect to the proposed action; Planning Board 9 NOW, THEREFORE, BE IT RESOLVED: November 16, 1994 That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above reference action as proposed and, therefore, neither a Long Environmental Assessment Form, nor an Environmental Impact Statement will be required. There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Langhans, Ainslie, Finch, Smith, Hoffmann. Nay - None. The MOTION was declared to be carried unanimously. NOW, THEREFORE, BE IT RESOLVED. 1. That the Town of Ithaca Planning Board hereby waives certain requirements for, Final Subdivision Approval, as shown on the Final Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board. 2. That the Planning Board hereby grants Final Subdivision Approval for the Ithaca tax parcel 56 -3 -13.2, 2.244 + /- acres into six lots; 4 residential; of 0.364 + /- acres, 0.452+/ - acres, 0.504 + /- acres, 0.379 + /- acres; and 0.545 + /- acres for the extension of Park Lane to Slaterville Road (Rte. 79), and one lot representing the balance of the parcel including a 60 foot road right of way for access proposed subdivision as shown on the "Frandsen Subdivision, Section 3, County, New York.," prepared by Surveying, and dated November following conditions. 6 to the remainder of the subdivision plat entitled Town of Ithaca, Tompkins James Stockwin, Stockwin 21 1993, subject to the a. That the Town Board approve the location of Park Lane and Brian Drive, formerly referred to as Kings Lane, in the Preliminary Subdivision plat. There being no further discussion Chairperson Grigorov called for a vote. Aye - Grigorov, Kenerson, Langhans, Ainslie, Finch, Hoffmann, Smith. Nay - None. The MOTION was declared to be carried unanimously. Chairperson Grigorov declared the Public Hearing for the Frandsen Subdivision to be duly closed. PUBLIC HEARING, CONSIDERATION OF SUBDIVISION APPROVAL OF ITHACA TAX PARCEL ACRES INTO FOUR LOTS; 2 RESIDENTIAL 0.379 + /- ACRES, 9.229 + /- ACRES; AND PRELIMINARY NO. 56 LOTS 1.415 AND FINAL -03 -26.2, 12.383+/ - OF 1.361 + /- ACRES, + /- ACRES FOR THE EXTENSION OF PARK LANE TO SLATERVILLE ROAD (ROUTE 79), RESIDENCE DISTRICT R -15. BARBARA QUICK, OWNER; DANIEL WALKER, TOWN ENGINEER, AGENT. Planning Board 11 November 16, 1994 Chairperson Grigorov declared the Public Hearing in the above - noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Town Engineer Daniel Walker stated that there was an easement on this property to maintain a sewer line that flows through the property and that it was important to keep it in the Town's control. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone from the public wished to speak. Town Engineer Daniel Walker stated that the ditches are very deep and that as soon as the Town of Ithaca had ownership, they would be graded, rocks added, cleared, and the road would be widened. Mr. Earl Thomas addressed the Board and stated that the gas main is not straight as shown on the map. Mr. Thomas stated that the markers were located where the gas mains used to be, not where they had been moved to. Town Engineer Daniel Walker stated that the gas main will be located before doing any work in there. Cheryl Mr. Otani addressed the Board and restated his concerns that were mentioned earlier under the Frandsen Subdivision portion of this meeting and once again asked the Planning Board not to open Park Lane for safety reasons. Mr. Otani stated that the ditches were very deep along this portion of the road which would be another hazard to opening up Park Lane. Town Engineer Daniel Walker stated that the ditches are very deep and that as soon as the Town of Ithaca had ownership, they would be graded, rocks added, cleared, and the road would be widened. Mr. Earl Thomas addressed the Board and stated that the gas main is not straight as shown on the map. Cheryl Smith addressed drainage the Board and asked if the Board ever simply said no when a plan Quick Land resulted as a need because of came before the Board. Town Attorney John Barney stated that people that own land are entitled to do what the Town of Ithaca's Zoning Ordinance permits them to do, but they have to do it within an environmentally balanced way and they have to do it in a way that does not adversely effect other people. The Board must have a justifiable reason to say no and must be within the confines of the Town of Ithaca Zoning Ordinance. Town Planner Floyd Forman stated that both of the subdivisions being discussed tonight are small approvals. Frandsen is four lots and Quick is three lots. Town Engineer Daniel Walker addressed the drainage issues by stating that there have been problems with drainage for a long time in the Eastern Heights area. The diversion that is across the Quick Land resulted as a need because of drainage problems from Eastern Heights. The Eastern Heights layout would not be Planning Board 12 November 16, 1994 acceptable from an Engineering standpoint today because it cuts across the contours instead of following the contours. The whole Park Lane upper drainage ditch is there to transmit water safely from Eastern Heights in the John Street and Brian Drive area down to a major water course that can handle it instead of allowing it to flood houses below it. The Town of Ithaca has had plans to go in and improve that ditch so that it is stable, but were unable to do that because the Town of Ithaca does not own the land. The drainage issues are being addressed and any future subdivision of the Quick's parcel, Blanpied's parcel, or any other parcel, will take those issues into consideration. Chairperson Grigorov closed this portion of the Public Hearing and brought the matter back to the Board for discussion. Board Member Eva. Hoffmann asked about a curb cut north of the easement for drainage, what would be permitted by having that curb cut there. Town Engineer Daniel Walker stated that the Town of Ithaca agreed with the Quick's that the Town would provide a safe grade to their back land from Park Lane. The rocks in the drainage area have dropped about two feet and would be stabilized by flattening that slope out to about 150 feet from the road, and would be 25 feet wide at the base, which will provide a future road bed location for a road way up into the Quick's parcel. Board Member Eva Hoffmann asked about the layout of the Frandsen property that received preliminary approval, and whether or not it had been changed. Town Attorney John Barney stated that there would be a slight change on the southwest side of Park Lane, due to an error of the surveyor which had given Mr. Frandsen more land than he should have been given. Mr. Barney stated that the Planning Board had no right to impose new substantial conditions that did not apply when Mr. Frandsen received preliminary subdivision approval in 1986. Town Engineer Daniel Walker stated that he believed that the alignment of this road will complement emergency drainage improvements that had already been made. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively determined to act as Lead Agency in environmental review with respect to Subdivision Approval, and 4. The Planning Board, at a Public Hearing held on November 16, 1993, has reviewed and accepted as adequate the Short Environmental Assessment Form Part I prepared by the applicant, a Part II prepared by the Town Planning staff, a subdivision plat entitled "Quick Subdivision, Town of Ithaca, Tompkins County, New York," prepared by James Stockwin, Stockwin Surveying, and dated November 2, 1993, and other application materials, and 5. The Town planning staff has recommended a negative determination of environmental significance with respect to the proposed actions NOW, THEREFORE, BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for -the above referenced action as proposed and, therefore, neither a Long Environmental Assessment Form, nor an Environmental Impact Statement will be required. The approval of the location of Park Lane by the Town Board. b. Review of the final plat to show relocation of the sanitary sewer line easement in the southwest corner to show it intersecting the north -south line approximately 40 feet south of the location presently shown, such relocated easement to be approved by the Town Engineer.
