WHEREAS,; a plan, report and map, . including an estimate of cost, have been duly

and construction, pursuant to Article 12-C of the Town Law, of suer system
improvements to be' . known ,.,and identified as the Town of, Ithaca Columbia St. Joint
Interceptor Replacement , Improvement, and hereinafter also referred to as
"Improvement," to provide such sewer Improvement including extensions, to . the present

The replacement of an existing 323 foot long 18" insulated sanitary sewer
interceptor located on the Colombia Street Pedestrian Bridge with 323 feet of a new
18"insulated sanitary sewer interceptor at the same location in conjunction with the
Columbia Street Pedestrian Bridge replacement project, together with related ancillary
facilities . The Columbia Street Pedestrian Bridge is located near the intersection of

Present : Herb Engman , Supervisor; Bill Goodman , Deputy Supervisor; Board
Members Pat Leary , Eric Levine , Rich DePaolo , Susan Riha and Tee -Ann Hunter
Staff: Bruce Bates , Alfred Carvill , Judy Drake , Jonathon Kanter, Paulette Terwilliger

Meeting called to order at 5 : 32 . An executive session was added to discuss
possible litigation .
Continuation — Public Hearing regarding the 2011 Town of Ithaca Preliminary
Budget
Supervisor Engman noted that the public hearing was still open on the Preliminary
Budget and the following topics were outlined for discussion . Each were voted on
individually at the end .
a. Fire Tax Rate Increase — Mr. Engman discussed the options outlined by
Mr. Carvill .
b. Discuss the General Part-Town Highway Fund — No Increase
Proposed
c. Discuss the General Town-Wide Fund — No Increase Proposed
(1 ) Discuss reallocation of Funds from Bus Operations=TCAT to
Youth and Senior Projects — Joint Youth Commission -- This topic
garnered the most discussion with some Board members feeling that
the Town should not cover the County' s decision to cut back because it
would send the message that we would always cover them . The
County needs to be responsible for their commitment to the youth as
much as , if not more than , the Town . There was also a lot of confusion
about what exactly is funded and who exactly would be served by the
additional monies .
Mr. Engman felt strongly that the funding needs to be given and he had
identified other areas of the budget that could be' adjusted to
accommodate the additional funds . He felt that the programs needed
to know now in order to finish their budgets and that they shouldn 't be
held hostage by the budget process off the Town and County. They
had decisions to make and people would lose jobs with the delay and
uncertainty.

The draft motion was moved by Herb Engman with no second . Failed .
Rich DePaolo offered a second motion which was subsequently
withdrawn by him .
It was decided that the spokespersons for the youth group and Cornell
Cooperative Extension would be asked to address the Board at the
next meeting to answer questions and attempt to give the Boar a better
picture �of what the funding is for.
d . Discuss the Town of Ithaca Sewer Rent Schedule Increase
e. Amend TB Resolution TB 2010- 186 : Adopt a New Water Rate
Schedule Effective January 1 , 2011 for Water Rates, Charges, and

TB RESOLUTION NO . 2010=1 ,95m, APPROVAL OF AN INCREASE IN THE FIRE
PROTECTION FUND REAL PROPERTY TAX
WHEREAS , the Town Board has prepared and discussed a budget for 2011 that
includes fire protection to the Town of Ithaca community while also taking into
consideration the economic net tax impact to the taxpayer household and

WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for
a public hearing to be held by said Town on October 18 , 2010 at 5 : 58 p . m . to hear all
interested parties on a proposed Resolution for Approval of an Increase in the Fire
Protection Fund Real Property Tax, and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and
WHEREAS , said public hearing was duly held on said date and time at the Town Hall of
the Town of Ithaca and all parties in attendance were permitted an opportunity to speak
on behalf of or in opposition to said proposed resolution , or any part thereof; and
WHEREAS , pursuant to the New York State Environmental Quality Review Act
("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been
determined by the Town Board that adoption of the proposed resolution is a Type II
action because it constitutes " routine or continuing agency administration and
management , not including new programs or major reordering of priorities that may
affect the environment , " and thus this action is not subject to review under SEQRA ,
NOW , THEREFORE BE IT
RESOLVED , That the Town Board approves and directs the Town Budget Officer to
instruct the Tompkins County Department of Assessment to change the 2011 real
property fire protection tax rate from $3 . 23 to $3 . 57 per $ 1 , 000 assessed valuation .

economic tax impact to the taxpayer household ,

TB RESOLUTION NO . 2010-198 : RESOLUTION INCREASING SEWER RENTS AND
CHARGES IN THE TOWN OF ITHACA SEWER IMPROVEMENT AREA
WHEREAS , through Town Board Resolution No . 2009-237 , the Town Board of the
Town of Ithaca exercised its authority under the Town of Ithaca Code and New York
General Municipal Law Article 14- F to establish and impose sewer rents and charges by
resolution , effective January 1 , 2010 , and
WHEREAS , the Town Board wishes to revise the sewer rents and charges , effective
January 1 , 2011 , and

WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for
a public hearing to be held by said Town on October 18 , 2010 at 5 : 54 p . m . to hear all
interested parties on a proposed Resolution Increasing Sewer Rents and Charges in the
Town of Ithaca Sewer Improvement Area , and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and
WHEREAS , said public hearing was duly held on said date and time at the Town Hall of
the Town of Ithaca and all parties in attendance were permitted an opportunity to speak
on behalf of or in opposition to said proposed resolution , or any part thereof ; and
WHEREAS , pursuant to the New York State Environmental Quality Review Act
("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been
determined by the Town Board that adoption of the proposed resolution is a Type II
action because it constitutes " routine or continuing agency administration and
management , not including new programs or major reordering of priorities that may
affect the environment , " and thus this action is not subject to review under SEQRA ,
NOW , THEREFORE , be it
RESOLVED , that the Town Board of the Town of Ithaca hereby establishes and
imposes the following sewer rents and charges for use of the Town of Ithaca sewer
system , effective January 1 , 2011 :
( 1 ) Effective January 1 , 2011 , there is hereby imposed a sewer rent payable
by all users connected to the Town -wide sewer system at a rate of $3 . 81
per 1 , 000 gallons of water consumed .
(2) In addition , and notwithstanding the foregoing rate structure , there shall be
a minimum base charge for regular quarterly bills sent on or after January
15 2011 , in the amount of $30 . 48 , which minimum charge is based on
8 , 000 gallons of usage , regardless of whether that amount is actually
used .
(3) Multiple housing and mobile home parks of over two dwelling units , using
a master water meter, will be computed as follows : The quarterly master
water meter reading will be divided by the number of dwelling units and
the sewer rent charge will be figured on this number as if the unit was
individually metered . The sewer rent will then be multiplied by the number
of units on the master water meter and this will be the billing rendered and
the amount payable . If the calculation of the water consumed per dwelling
unit is less than the amount that would be permitted before exceeding the
minimum sewer rent set forth above , then the billing will be calculating by
multiplying the number of units served by the master water meter times
the minimum sewer rent set forth above [e . g . , if there were 20 dwelling
units on the master meter, and the total water consumption shown by the

master meter was 100 , 000 gallons , the sewer rent payable would be
$609060 (20 units times $30 . 48) rather than $381 . 00 ( 100 , 000 gallons at
$3 . 81 per 1 , 000 gallons) ] .
(4) The charges set forth above shall be effective with respect to bills
rendered on or after the effective dates set forth above , even if the
measurement is for consumption prior to the above effective dates ( i . e . ,
any bill rendered on or after January 1 , 2011 , shall be calculated at the
rate of $3 . 81 per 1 , 000 gallons even if the sewer use occurred prior to
January 1 , 2011 ) .
(5) In the event a property is connected to public sewer, but is not connected
to a water meter, the sewer rent shall be based upon estimated water
consumption as reasonably determined by the Director of Public Works
based upon recognized methods of estimating typical consumption for the
type of facility involved (e . g . , gallons per day per bedroom) . If such
property is a one - or two-family dwelling , the minimum sewer rent shall be
$64 . 77 .

TB RESOLUTION N0 . 2010-199 : Amending Resolution TB 2010- 186 — New Water
Rate Schedule Effective January 1 , 2011 for Water Rates, Charges , and Other
Fees Chargeable to Consumers of Water in the Town of Ithaca
WHEREAS , at the October 18 , 2010 Town Board meeting , the Town Board of
the Town of Ithaca adopted resolution number TB 2010- 186 , titled "Adopt a New Water
Rate Schedule Effective January 1 , 2011 for Water Rates , Charges , and Other Fees
Chargeable to Consumers of Water in the Town of Ithaca" , and
WHEREAS , a error in one of the calculations was discovered after adoption ,
NOW , THEREFORE , be it
RESOLVED , that the second sentence under "Water Rate Schedule Effective
January 1 , 2011 " is hereby amended to read as follows : "This rate is equal to $3 . 52 per
100 cubic feet" , and be it further
RESOLVED , that resolution number TB 2010- 186 , as revised , is hereby restated
to read as follows :
"WHEREAS , through Town Board Resolution No . 2009-236 , the Town
Board of the Town of Ithaca established a water rate schedule and charges ,
effective January 1 , 2010 , and

of the Town of Ithaca water system , effective January 1 , 2011 :
A . The following water rate schedule and charges shall apply for
the use of water and for the purposes set forth in Town Code Chapter 261 , Water
Rates :
WATER RATE SCHEDULE
Effective January 1 , 2011
The rate charged for water consumption shall be $4 . 70 per 1 , 000 gallons .
This rate is equal to $3 . 52 per 100 cubic feet . The foregoing rate will be the rate
charged for all regular quarterly bills sent on or after January 1 , 2011 . Actual or
base consumption may occur prior to January 1 , 2011 .

Notwithstanding the foregoing rates , the following minimum base charges
shall be applicable to the meter size indicated below, for regular quarterly bills
issued on or after January 1 , 2011 . The table below also shows the amount of
water consumption that is permitted before the minimum base charge would be
exceeded :

Multiple Housing and mobile home parks of over 2 dwelling units , using a
master meter, will be computed as follows : The quarterly master meter reading
will be divided by the number of dwelling units and the water charge will be
figured on this number as if the unit was individually metered . The water charge
will then be multiplied by the number of units on the master meter and this will be
the billing rendered . If the calculation of the water consumed per dwelling unit is
less than the allowable consumption for a three-quarter inch meter, then the
billing will be calculated by multiplying the number of units on the master meter
times the minimum charge for a three -quarter inch meter (e . g . , if there were 20
dwelling units on the master meter, and total water consumption shown by the
master meter was 100 , 000 gallons , the billing would be $940 . 00 (20 units times
$47 . 00) rather than $470 . 00 ( 100 , 000 gallons times $4 . 70 /1 , 000 gallons) ) .
The water application fee for each new application for water service shall
be the charges for new water connections charged by the Southern Cayuga Lake
Intermunicipal Water Commission including application fees , meter charges ,
service tap fees , inspection fees , accessory materials , installation costs , and any
other fee or cost charged by the Southern Cayuga Lake Intermunicipal Water
Commission for connecting new water services .
An annual charge for each fire protection main serving a fire suppression
system will be billed along with the first quarterly water bill of the calendar year.

The annual charge for this service shall be $20 . 00 per diameter inch of the pipe
supplying the fire suppression system or such other amount as is charged by the
Southern Cayuga Lake Intermunicipal Water Commission for such systems . The
pipe supplying the fire suppression system is the pipe needed to supply the fire
suppression system , installed downstream of the system control valve .
B . In addition to any other charges due to the Southern Cayuga
Lake Intermunicipal Water Commission or the Town , there shall also be due to
the Town a charge of $25 for disconnecting and a charge of $25 for reconnecting
water service where water service has been disconnected pursuant to Town
Code § 261 -4 for failure to pay water rates or other charges . "

Consider Approval of Employee Wages for 2011
TB RESOLUTION NO . 2010=200 = Approval of Employee Wages for 2011
WHEREAS , the governing Town Board of the Town of Ithaca has reviewed the
proposed wages for the Town of Ithaca non -collective bargaining employees and
collective bargaining employees for the year 2011 , utilizing the wage scale approved by
the Town Board October 7 , 2010 ;
Now, therefore , be it
RESOLVED , the governing Town Board of the Town of Ithaca does hereby approve the
said wages for the non -collective bargaining employees and collective bargaining
employees for the 2011 Final Budget , and as filed in the Human Resources Office .

TB RESOLUTION NO , 2010- 201 : Adoption of the 2011 Town of Ithaca Preliminary
Budget as the Town of Ithaca 2011 Final Budget
BE IT RESOLVED that the Town Board of the Town of Ithaca held a public hearing at
215 North Tioga Street , Ithaca , New York on the 18th Day of October and the 4th day of
November 2010 for the purpose of considering the 2011 Town of Ithaca Preliminary
Budget as the 2011 Town of Ithaca Final Budget ; and it is further
RESOLVED that at such time and place all persons interested in the proposed budget
were heard concerning the same ; and it is further

RESOLVED that the fire protection fund real property tax was increased from $3 . 23 per
$ 1 , 000 of assessed value , to $3 . 57 per $ 1 , 000 of assessed value and the water rate
schedule adopted at the October Regular Meeting was amended to read "this rate is
equal to $3 . 52 per 100 cubic feet" and restated in TB Resolution No . 2010- 199 .
BE IT FURTHER RESOLVED that the Town Board hereby approves the adoption of the
2011 Town of Ithaca Preliminary Budget as the 2011 Town of Ithaca Final Budget .

approves delinquent water and sewer charges of $92 , 668 . 70 and $37 , 617 . 62 ,
respectively, for relevy to the 2011 Town and County Tax Roll ; and be it further
RESOLVED , that a certified copy of this resolution along with a listing of those relevied
water and sewer charges are to be delivered to Tompkins County Assessment
Department by the Town Receiver of Taxes for the purpose of adding these delinquent
charges to the 2011 Town and County Tax Roll , the Town Budget Officer for accounting
purposes , and that Southern Cayuga Lake Intermunicipal Water Commission for the
purpose of reconciling and account billing purposes .

Discuss the Town of Ithaca Fee Schedule - Mr. Engman explained that due to New
York State changing the laws regarding dog fees and the need to set them , the other
departments are also looking at their fees and this might be a good time to review them
all . He noted that there are specific guidelines for the Planning and Codes fees and
there were memos from previous fee reviews that were distributed to the Board . Mrs .
Terwilliger gave an update on the dog licensing fee changes coming up in January and
her recommendations . Mr. Engman was not sure which committee would be looking at
the fee schedules , but felt that a review should happen . Discussion followed .

Tax Exempt Status
Mr. Carvill handed out a chart showing tax exempt properties in the town and what that
exempt status does to the fire tax rate and property tax rate and therefore the town 's
budget . Discussion followed . (Attachment #2)

Dog Licensing Fees - Update & Recommendation , November 4, 2010
NYS is transferring the administrative duties of the dog licensing program to municipalities . Of
course , there are not extra funds from the state , but the portion (s) sent to the state and the
county have been changed or eliminated . The state has added an assessment (fee) , which is
earmarked for population control and the clerks in Tompkins County are working with the SPCA
and local vets to set up a program so that these fees are kept local .
We are not recommending a change in the license fees , but by retaining the same total fee , the
Town's share will increase since we will no longer be paying the County a portion of the revenue
(see table below) . For example , a license for an altered dog currently costs $ 10 ; the local fee is
$7. 50 and the statutory fee is $2 . 50 . The Town keeps 53% of the state fee and the County gets
47% . In January, the state fee will be reduced to $ 1 , so if we keep the total license fee at $ 10 , we
need to raise the local fee to $9 . This will require the Town Board to pass a local law increasing
the dog license fees . Why not reduce the total license fee? Because the cost to the Town will be
higher since we will have to pay for license tags and for sending renewal notices .
In light of the feedback we received during the enumeration and the fact that at least 250
unlicensed dogs were "found" and registered , we feel that raising the fee will discourage
compliance .
