Persons to be Heard There was no one wishing to address the Board . City and County Reports and Board Comments Board Comments Mr. Engman noted that we are still waiting on the County regarding funding for the Municipal Youth programs which will have an affect on our budget if they decide not to continue funding those programs . Fire Commissioner's Quarterly Report (Attachment 1 ) Commissioner Gilligan gave the report with a packet of handouts . Of note is that the Department is in contract negotiations and the Mayor's budget does not reflect any pay increase which is not likely. The handouts were reviewed . Mr. Gilligan stated that he believed the department was working without a contract right now, which concerned the Board and the Board discussed the Town 's involvement in decision making and bargaining which is not very involved . 5 : 45 p. m . Public Hearing re. : Snyder Hill Water Main Water Improvement Project (Attachment #2) The public hearing was opened at 5 : 58p . m . Mr. Weber gave the Board some background on the project and noted the handout . The public hearing was closed at 6 : 02 p . m with no one wishing to address the Board . Motion was made by Ms . Leary , seconded by Ms . Hunter and referred for discussion . Mr DePaolo asked whether there was a SEQR and Mr. Weber responded that there was not ; it was a replacement in -kind and therefore a Type II action . Mr. DePaolo noted that he brings this concern up at each water improvement project , because it is not clear to him why and he is concerned that larger pipes encourage development and would therefore need SEQR . Discussion followed . Mr. Weber reiterated that it is due to ageing and in conjunction with the road repair. 1 Final Mr. Carvill also spoke about the financing aspect and a minor change was made to allow for the option of serial bonds . TB Resolution No . 2010=183 Adopt Public Interest Order for Snyder Hill Water Main Water Improvement At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County, New York , held at the Town Hall , 215 North Tioga Street , in Ithaca , New York , in said Town , on the 18th day of October, 2010 , at 5 : 45 o'clock P . M . , Prevailing Time . PRESENT : Supervisor Engman , Councilman Goodman , Councilman Levine , Councilwoman Leary, Councilwoman Hunter, Councilman DePaolo , Councilwoman Riha In the Matter PUBLIC of INTEREST A Proposed Water Improvement in the Town of ORDER Ithaca, Tompkins County, New York, pursuant to Article 12-C of the Town Law, to be known as the Town of Ithaca Snyder Hill Water Main Water Improvement. WHEREAS , a plan , report and map , including an estimate of cost, have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Ithaca , Tompkins County, New York , relating to the creation and construction , pursuant to Article 12-C of the Town Law, of water system improvements to be known and identified as the Town of Ithaca Snyder Hill Water Main Water Improvement, and hereinafter also referred to as the "Improvement," to provide such water Improvement including extensions , to the present Town water improvement, such water system Improvement to be constructed and owned by the Town of Ithaca , and WHEREAS , after said plan , report and map , including estimate of cost, were prepared by a competent engineer, duly licensed by the state of New York, and filed in the office of the Town Clerk , the said Town Board did , on September 13 , 2010 , duly adopt an Order reciting the proposed Improvement, a description of the boundaries of the proposed benefited area , the maximum amount proposed to be expended for the Improvement, the proposed method of apportioning the costs of such Improvement, the proposed method of financing to be employed , the fact that a plan , map and report describing the same are on file in the Town Clerk's office for public inspection , and specifying that said Town Board shall meet at the Town Hall , 215 North Tioga Street , in Ithaca, New York , in said Town , on the 18th day of October, 2010 at 5 : 45 PM Prevailing Time , for the purposes of conducting a public hearing on such proposal to provide said Improvement, and to hear all persons interested in the subject thereof concerning the same , and WHEREAS , copies of said Order were duly published and posted according to law, and said Town Board did , at the time and place specified in said Order, duly meet and consider such proposal and held a public hearing in which it heard all persons interested in the subject thereof, who appeared at such time and place , concerning the same , and 2 Final WHEREAS , the Town Board now desires to authorize the Improvement based on the evidence offered at such time and place , and WHEREAS , at its regular meeting on October 18 , 2010 , the Town Board has determined approval , construction and implementation of the Improvement are a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act , because the Action constitutes " replacement, rehabilitation or reconstruction of a structure or facility, in kind , on the same site , including upgrading buildings to meet building or fire codes, unless such action meets or exceeds any of the thresholds in section 617 . 4" of Title 6 of the New York Code , Rules and Regulations , and thus approval , construction and implementation of the Improvement are not subject to review under SEQRA; NOW , THEREFORE , BE IT RESOLVED , by the Town Board that it be and hereby is determined as follows : ( 1 ) The notice of hearing was published and posted as required by law and is otherwise sufficient. (2 ) That all of the property within the proposed benefited area is benefited by the proposed Improvement. (3) That all of the property benefited is included within the proposed benefited area . (4) That the proposed method of apportioning the costs of the Improvement should not be changed . (5) It is in the public interest to authorize , establish , and make the Town of Ithaca Snyder Hill Water Main Water Improvement as hereinafter described , and be it FURTHER RESOLVED , that the Town Board does hereby approve , authorize and establish the Town of Ithaca Snyder Hill Water Main Water Improvement in the area of the Town described as follows and as more particularly shown and described in said plan , report and map presently on file in the office of the Town Clerk: It is proposed to install 2800 ft of new 8" water main , replacing the existing main , on the east side of Snyder Hill Rd . together with related ancillary facilities , and be it FURTHER RESOLVED , that the area hereby determined to be benefited by said Town of Ithaca Snyder Hill Water Main Water Improvement is all of that portion of the Town outside of the Village of Cayuga Heights, and be it FURTHER RESOLVED , that all of the allocable costs of said Improvement shall be borne wholly by property within the Town of Ithaca water improvement benefited area , being the entire area of the Town outside of the Village of Cayuga Heights , and be it FURTHER RESOLVED , that the maximum proposed to be expended by the Town of Ithaca for the Improvement , including costs of rights of way, construction costs , legal fees and other expenses , is $ 300 , 000 , which shall be financed as follows : temporary financing under a bond anticipation note (s) , and upon maturity of the bond anticipation note (s) , consider the issuance of serial bonds of said Town of Ithaca to mature in annual installments over a period not to exceed 20 years , such bonds to be paid from assessments levied upon and collected from the several lots and parcels of land in said Town of Ithaca water system benefited area which are deemed benefited by said Improvement, so much upon and from each as shall be in just proportion to the amount of the benefit which the Improvement shall confer upon the same , and be it 3 Final FURTHER RESOLVED , that this Order is subject to a permissive referendum in the manner provided in Town Law Article 7 and Town Law Section 209-q , and be it FURTHER RESOLVED , that the estimated expense of the aforesaid Improvement does not exceed one-tenth of one per cent of the full valuation of the taxable real property in the area of said Town outside of villages and , therefore , in accordance with the provisions of subdivision 13 (a) of Section 209-q of the Town Law, the permission of the State Comptroller is not required for such improvement, and be it FURTHER RESOLVED , that pursuant to subdivision 6 (d) of Section 209-q of the Town Law, the Town Clerk is hereby directed and ordered to cause a certified copy of this Order to be duly recorded in the Office of the Clerk of the County of Tompkins within ten days of the date this Order becomes effective pursuant to Town Law Section 91 , which when so recorded , shall be presumptive evidence of the regularity of the proceedings and action taken by the Town Board in relation to the aforesaid improvement The question of the adoption of the foregoing Order was duly put to a vote on roll call , which resulted as follows : Engman , Aye ; Goodman , Aye ; Levine , Aye ; DePaolo , Aye ; Hunter, Aye , Leary Aye ; Riha , Aye The Order was thereupon declared duly adopted 5 : 47 p . m . Public Hearing re. : Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC) Water Rate Charges and Application Fees Increase Mr. Engman opened the public hearing at 6 : 10 p . m . and noted for the public that this is the rate that Bolton Point charges . There was no one wishing to address the Board and the public hearing was closed . TB RESOLUTION NO . 2010-184 : Amend the Southern Cayuga Lake Intermunicipal Water Commission Agreement Increasing the Water Rate Charges and Application Fees WHEREAS , the Town Board of the Town of Ithaca held a public hearing at the Town Hall , 215 North Tioga Street , Ithaca , New York , on the 18th day of October 2010 , for the purpose of considering an increase in the Water Rate Charges and Application Fees associated with the Southern Cayuga Lake Intermunicipal Water Commission Agreement , Now therefore be it : RESOLVED , that the Town Board approves and authorizes the execution of an amendment to the agreement of intermunicipal cooperation between the Town and several other municipalities pursuant to which the Southern Cayuga Lake Intermunicipal Water Commission was formed , which amendment would increase the water rate charged by the Commission from $2 . 65 per 1000 gallons to $2 . 87 per 1000 gallons , said changes to be effective January 1 , 2011 MOVED : Councilman Goodman SECONDED : Councilwoman Riha VOTE : Aye : Engman , Goodman , Leary , Riha , Hunter, Levine and DePaolo 4 Final Motion passed unanimously . 5 : 49 p. m . Public Hearing re. : Southern Cayuga, Lake Intermunicipal Water Commission (SCLIWC) 2011 Budget There was some discussion on the process and Mr. Engman reported that the increase started out much larger but they worked it down . The Commission has the same problem as the Town ; infrastructure is aging and will need to be replaced . TB RESOLUTION NO. 2010=185 : Adopting the Southern Cayuga Lake Intermunicipal Water Commission Preliminary 2011 Budget as the Southern Cayuga Lake Intermunicipal Water Commission Final 2011 Budget BE IT RESOLVED that the Town Board of the Town of Ithaca held a public hearing at 215 North Tioga Street , Ithaca , New York on the 18th day of October 2010 for the purpose of considering the 2011 Southern Cayuga Lake Intermunicipal Water Commission Preliminary Budget as the 2011 Southern Cayuga Lake Intermunicipal Water Commission Final Budget ; and it is further RESOLVED that at such time and place all persons interested in the proposed budget were heard concerning the same ; and it is further RESOLVED that the Town Board of the Town of Ithaca has considered and approves the 2011 Southern Cayuga Lake Intermunicipal Water Commission Preliminary Budget as the 2011 Southern Cayuga Lake Intermunicipal Water Commission Final Budget MOVED : Councilman DePaolo SECONDED : Councilman Levine VOTE : Aye : Engman , Goodman , Leary, Riha , Hunter, Levine and DePaolo Motion passed unanimously . 5 : 52 p . m . Public Hearing re. : Town of Ithaca Water Rate Schedule Increase Public Hearing was opened at 6 : 13 p . m . with no one wishing to address the Board and the hearing was closed . The Board discussed the increase and the fact that water consumption is going down due to conservation , but the infrastructure still needs maintenance and we are starting to work towards a reserve fund for that. TB RESOLUTION NO . 2010=186 : Adopt a New Water Rate Schedule Effective January 1 , 2011 for Water Rates , Charges , and Other Fees Chargeable to Consumers of Water in the Town of Ithaca WHEREAS , through Town Board Resolution No . 2009-236 , the Town Board of the Town of Ithaca established a water rate schedule and charges , effective January 1 , 2010 , and WHEREAS , the Town Board wishes to revise the water rate schedule and charges , effective January 1 , 2011 , and 5 Final WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held by said Town on October 18 , 2010 at 5 : 52 p . m , to hear all interested parties on a proposed Resolution to Adopt a New Water Rate Schedule Effective January 1 , 2011 for Water Rates , Charges , and Other Fees Chargeable to Consumers of Water in the Town of Ithaca , and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed resolution , or any part thereof ; and WHEREAS , pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been determined by the Town Board that adoption of the proposed resolution is a Type II action because it constitutes "routine or continuing agency administration and management , not including new programs or major reordering of priorities that may affect the environment , " and thus this action is not subject to review under SEQRA , NOW , THEREFORE , be it RESOLVED , that the Town Board of the Town of Ithaca hereby establishes and imposes the following water rate schedule and charges for use of the Town of Ithaca water system , effective January 1 , 2011 : A . The following water rate schedule and charges shall apply for the use of water and for the purposes set forth in Town Code Chapter 261 , Water Rates : WATER RATE SCHEDULE Effective January 1 , 2011 The rate charged for water consumption shall be $4 . 70 per 1 , 000 gallons . This rate is equal to $ . 0628 per 100 cubic feet . The foregoing rate will be the rate charged for all regular quarterly bills sent on or after January 1 , 2011 . Actual or base consumption may occur prior to January 1 , 20111 Notwithstanding the foregoing rates , the following minimum base charges shall be applicable to the meter size indicated below for regular quarterly bills issued on or after January 1 , 2011 . The water charge will then be multiplied by the number of units on the master meter and this will be the billing rendered . If the calculation of the water consumed per dwelling unit is less than the allowable consumption for a three- quarter inch meter, then the billing will be calculated by multiplying the number of units on the master meter times the minimum charge for a three-quarter inch meter (e . g . , if there were 20 dwelling units on the master meter, and total water consumption shown by the master meter was 100 , 000 gallons , the billing would be $940 . 00 (20 units times $47 . 00) rather than $470 . 00 ( 100 , 000 gallons times $4 . 70 / 1 , 000 gallons) ) . The water application fee for each new application for water service shall be the charges for new water connections charged by the Southern Cayuga Lake Intermunicipal Water Commission including application fees , meter charges , service tap fees , inspection fees , accessory materials , installation costs , and any other fee or cost charged by the Southern Cayuga Lake Intermunicipal Water Commission for connecting new water services . An annual charge for each fire protection main serving a fire suppression system will be billed along with the first quarterly water bill of the calendar year. The annual charge for this service shall be $20 . 00 per diameter inch of the pipe supplying the fire suppression system or such other amount as is charged by the Southern Cayuga Lake Intermunicipal Water Commission for such systems . The pipe supplying the fire suppression system is the pipe needed to supply the fire suppression system , installed downstream of the system control valve . B . In addition to any other charges due to the Southern Cayuga Lake Intermunicipal Water Commission or the Town , there shall also be due to the Town a charge of $25 for disconnecting and a charge of $25 for reconnecting water service where water service has been disconnected pursuant to Town Code § 261 -4 for failure to pay water rates or other charges . Public Hearing re. : Town of Ithaca Sewer Rent Schedule Increase Public Hearing was opened at 6 : 28p . m . and closed with no one wishing to address the Board . There was some discussion and confusion on the numbers and terminology of the draft resolution . The motion was withdrawn and the topic will be reviewed again at the November budget meeting . 7 Final 5 : 56 p. m . Town of Ithaca 2011 Preliminary Budget Public hearing was opened at 6 : 52 p . m . There was no one wishing to address the Board . The public hearing was left open until the next meeting when action might be taken on adoption of the budget at the November 4th meeting . Susan Riha spoke against the Town Board salaries and spoke about the process and where would the Board be cutting ? There are contractual line items in there and when does the discussion happen about whether or not to fund all the requests . Discussion followed . Pat Leary felt strongly that the Town should not stop spending on social programs . There was some discussion on levies and rates and responsibilities of a town versus the county and unintended consequences of the county pulling out of programs . The discussion will continue at the November 4th budget meeting at which time we will hopefully have a better idea of whether the County will be funding the programs in question . There was a major discussion regarding the Fire Protection contract and the $4M price tag . We have no control of costs and no voice in the process . The Board asked Mr. Carvill to run a 2 % wage increase for the Fire Contract to see the effect . The Board also discussed what would happen if they did not approve the purchase of new fire truck(s) and even the possibility of providing our own fire protection . Holochuck Homes Subdivision — Supplemental Draft Environmental Impact Statement (S- DEIS) Regarding Dump Site Clean-up, Trumansburg Road (NYS Route 96) : The Planning Board accepted as adequate for public review the Supplemental Draft Environmental Impact Statement (S-DEIS) for the proposed Holochuck Homes Subdivision, located between NYS Route 96 (Trumansburg Road) and NYS Route 89 (Taughannock Boulevard), Town of Ithaca Tax Parcel No. ' s 24-3 -3 . 2, 25- 1 -5 . 1 , 25 -2-4102, 26-4-37 , 26-4-38, and 26-4-39, Low Density Residential Zone, Medium Density Residential Zone, and Conservation Zone. The proposal involves subdividing a 2 +/- foot wide strip (200 +/- square foot area) from Tax Parcel No. 70- 10-3 . 5 , which will be consolidated to the rear (eastern border) of Tax Parcel No. 70- 10-31 . Cornell University Wilson Lab CLEO Modular Office Building, Synchrotron Drive off NYS Route 366: The Planning Board granted Preliminary and Final Site Plan Approval and Special Permit for the proposed time extension for the Cornell University Wilson Lab CLEO Modular Office located north of the intersection of Dryden Road (NYS Route 366) and Pine Tree Road on Synchrotron Drive, Town of Ithaca Tax Parcel No. 63 - 1 - 8 . 2, Low Density Residential Zone. The project involves a request for an eight year extension of the Site Plan Approval and Special Permit for the 4,200 +/- square foot modular office currently situated at the Wilson Laboratory complex. The modular office received Site Plan Approval in 2000 and a time extension was granted in 2008 that expires on December 31 , 2010. The project includes plans to add fire sprinklers to the facility. There are no other modifications , improvements , additional development or other physical changes proposed as part of this request. Cornell University Energy Recovery Linac — Public Scoping Session, Dryden Road (Route 366) and Pine Tree Road: The Planning Board held the Public Scoping Session to consider public comments on the Draft Scoping Document (dated August 18 , 2010) regarding the scope and content for the Draft Environmental Impact Statement (EIS ) that will be prepared for the proposed Cornell University Energy Recovery Linac (ERL) facility, located north of the Pine Tree Road and Dryden Road (NYS Route 366) intersection (at Wilson Lab Entrance), Town of Ithaca Tax Parcel No. ' s 63 - 1 - 8 .2, 63 - 1 -2.21 63 - 1 - 12 , 63 - 1 -3 . 1 and 63 - 1 -3 . 3 , Low Density Residential Zone (LDR) . The proposal involves construction of an underground accelerator tunnel ( 14-foot diameter and 1 +/- km long) , a cryogenic facility, and an extension to the existing Wilson Laboratory ( 185 ,000 +/- gross square feet of building space). Continuation of Sketch Plan Review — Vine Street Cottages, Mitchell and Vine Streets: The Planning Board continued review of a revised sketch plan for the proposed Vine Street Cottages project and heard additional comments from the public regarding the proposal . Based on the two previous sketch plan discussions , the concept plan has been revised to include a modified access 2 and circulation system, changes in lot layout, a reduction in the overall number of proposed units now totaling 19 single-family homes and 10 townhouse units, and inclusion of an area for a conventional stormwater management system. CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following have been accomplished over the past month. Codes and Ordinances Committee (COQ: The Committee met on September 15 , 2010 and continued review of the draft local law establishing a Limited Historic Commercial Zone and continued review of comments regarding the proposed amendments to Conservation Zones regarding forest management plan requirements. The next COC meeting is scheduled for October 20, 2010 at 7 :00 p.m. Tentative agenda items include continuation of review of the two items mentioned above, review of draft revised regulations regarding fireworks displays , and discussion regarding possible revisions to zoning regulations regarding garages . Planning Committee: The Committee met on September 9, 2010 to review and discuss the revised draft Scenic Resources Report - Town of Ithaca. The next meeting is scheduled for Thursday, October 21 , 2010 at 3 :00 p.m. Tentative agenda items include review and discussion regarding revised draft Planned Development Zones for the Vine Street Cottages proposal and the Conifer West Hill proposal and continuation of review of the Scenic Resources Report (if time permits). Comprehensive Plan Committee: The Committee met on September 23 , 2010 to begin review of draft sections of the Plan prepared by Planning staff during the summer. The Committee focused on the Land Use & Development section. The next meeting of the Committee is tentatively scheduled for Thursday, September 23 , 2010 at 6 : 30 p.m. The Committee will continue review of draft Plan sections, including Natural Resources and possible Agriculture. Conservation Board: The Conservation Board met on October 7 , 2010. Agenda items included continuation of discussion regarding the draft stream setback law and discussion of comments regarding the proposed amendments to the Conservation Zone. The next meeting is scheduled for Thursday, November 4, 2010. Agriculture Plan: The steering committee continued meeting in September to review the draft plan. Conifer West Hill Proposal — Park-and-Ride Lot: Town officials met with representatives from Conifer, Cornell, TCAT and Tompkins County on September 30, 2010 to discuss ownership, maintenance and operational aspects of the proposed park-and-ride lot that is part of the Conifer West Hill proposal on Trumansburg Road. The TCAT Board of Directors had discussed the park- and-ride lot and indicated concerns regarding long-term maintenance costs associated with owning such a facility. TCAT estimated that the costs of operating bus service for a park-and-ride lot in this location might cost between $30,000 and $50,000 per year (this did not factor in possible enhancements or extensions of the current bus routes that serve the area — this would be for new service specific to the Park-and-ride facility). Cornell indicated that they are making the land available for and paying for construction of the park-and-ride lot, but are not proposing to own or maintain the facility. Conifer was concerned that the uncertainty regarding the park-and-ride lot was holding up consideration of the draft Planned Development Zone (PDZ) for their senior housing proposal. The Town Board may want to discuss whether it would be appropriate for the Town to own and maintain a park-and- ride lot. It was suggested at the meeting that information regarding possible costs associated with maintenance of such a facility be obtained (e. g. , mowing, landscaping, plowing, surface repairs, etc.) and that the group meet again to continue discussion. Annual Agricultural Easement Inspection — Ferguson Property: Planning staff completed the required annual inspection of the agricultural easement held by the Town on the Ferguson property, located on Sheffield Road. The inspection confirms that the property is in compliance with the requirements of the agricultural easement. The inspection report is attached for the Board' s information (see memo from Mike Smith dated September 23 , 2010) . Stormwater Workshop : Planning staff attended the workshop on Stormwater Management held by NYS Department of Environmental Conservation on September 21 , 2010 at Town Hall. The presentation focused on the modified stormwater regulations that will take effect later this year. Recreational Trail Grant Program: Planning staff is working with the Trail Committee on a possible grant application under the NYS Recreational Trails Program.
