PRESENT: Chairperson Carolyn Grigorov, Robert Kenerson, Virginia
Langhans, Candace Cornell, James Ainslie, William Lesser,

Chairperson Grigorov declared the meeting duly opened at 7:35
p.m. and accepted for the record the Clerk's Affidavit of Posting
and Publication of the Notice of Public Hearings in Town Hall and
the Ithaca Journal on May 10, 1993 and May 13, 1993, respectively,
together with the Secretary's Affidavit of Service by Mail of said
Notice upon the various neighbors of each of the properties under
discussion, as appropriate, upon the Clerk of the City of Ithaca,
upon the Tompkins County Commissioner of Public Works, upon
Tompkins County Commissioner of Planning, upon the Tompkins County
Assessment Department, and upon the applicants and /or agents, as
appropriate on May 12, 1993.
Chairperson Grigorov read the Fire Exit Regulations to those
assembled, as required by New York State Department of State,
Office of Fire Prevention and Control.
AGENDA ITEM: PERSONS TO BE HEARD,
Chairperson Grigorov asked if anyone from the public wished to
speak. No one spoke. Chairperson Grigorov closed this portion of
the meeting.
PUBLIC HEARING: CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR
LOTS NO. 7 & 81 OF THE ANTHONY J. & CLARA T. LEONARDO SUBDIVISION,
ALSO KNOWN AS TOWN OF ITHACA TAX PARCELS NO. 6 -37 -1 -20.8 AND -20.9.
SAID LOTS, ENCOMPASSING 0.85 AND 1.48 ACRES RESPECTIVELY, WERE
GRANTED PRELIMINARY SUBDIVISION APPROVAL BY THE TOWN OF ITHACA
PLANNING BOARD ON MAY 16, 1978, AND ARE LOCATED ON DANBY ROAD (NYS
RTE. 96B) APPROXIMATELY 1,300 FT. SOUTH OF KING ROAD, RESIDENCE
DISTRICT R -15, CLARA T. LEONARDO, OWNER; MARLEA A. LEONARDO,
AGENT.
Chairperson Grigorov declared the Public Hearing in the above -
noted matter duly opened at 7:37 p.m. and read aloud from the
notice of Public Hearings as posted and published and as noted
above.

Assistant Town Planner George Frantz stated that in 1973 the
Leonardo's gotten approval for lots 7 & 8 and Sesame Street. They
were given preliminary approval for the whole thing. And final
approval for 4, 5, and 6 on May 16. The plat was files but they
wrote omit on lots 7, 8, and 9, so they were not approved. Lot 10
was approved two weeks later. The house on Lot 10, Allison Street
is a paper street. 9, 5, and 6 have no frontage. Lots 7 and 8 to
be consolidated for Marlea Leonardo. Mr. Frantz stated that
Allison Street would be better as a cul -de -sac. House would be
located on Lot 7. Clara Leonardo would give agreement for access
from Sesame Street if needed. They are on Town water and sewer.
Lot 9 would be the only lot without final approval.

husband wished to build a home
on the aforementioned
lot,
which is
his mothers land. The
reason that it took so long to
seek
final
approval was because
they had
thought that it was
already
given
final approval in 1978
and did
not find out otherwise
until
they tried
to get a building
permit.
Assistant Town Planner George Frantz stated that in 1973 the

wished to speak regarding the Leonardo Subdivision approval.

would like
to take Allison Street out and that
they
would need
to
redesign
the parcels for road frontage, would

be able to

this without
effecting what Marlea and Joe Leonardo
are trying
to
accomplish
tonight.

Chairperson Grigorov stated that they could still build
their
home
and that they could come back with the new
design at
a later
date.
Chairperson Grigorov asked if there
were any

comments
from the public. No one responded and

That the Town of Ithaca Planning Board hereby makes a negative
determination of environmental significance in accordance with the
New York State Environmental Quality Review Act for the above
reference action as proposed and, therefore, an Environmental
Impact Statement will not be required.

-1581 -159, -160, -1611 -162, -163, AND -164, ALSO KNOWN AS LOTS 1,
21 44, 45, 46, 47, 48, 49, AND 50 OF DEER RUN PHASE III -B AND
LOCATED ON WHITETAIL DRIVE, FOR THE PURPOSE OF CONSOLIDATING SAID
0.38 + /- ACRE WITH LANDS OF THE DEER RUN HOMEOWNERS ASSOCIATION.

Chairperson Grigorov declared the Public Hearing in the above -
noted matter duly opened at 7:50 p.m, and read aloud from the
notice of Public Hearings as posted and published and as noted
above.
Edward Hallberg addressed the Board and stated that he would
like to move the eastern most corner westerly by 50 feet to keep
away from the town houses. This would become a buffer and would be
deeded over to the Deer Run Homeowners Association with a letter of
intent.
Ed Conley addressed the Board and stated that he was the
President of Deer Run Homeowners Association who had a recent
meeting at which this plan was presented with very positive
response from the people who had attended. Mr. Conley stated that
he thought it would be a very positive move for the association and
for their neighbors to the rear of their lots.
David Sparrow addressed the Board and stated that he was a
member of the Association and that he supported the developers
intentions to form a buffer in general. He then stated that he had
a couple of concerns; one is about oversights of the drainage flow
from the phase III lots to the rest of Deer Run. Specifically with
a large drainage swail near the back of the near the back of the

Mr. Sparrow wanted to know what firm
visual screening between the phase II
Mr. Hallberg stated that the drainage swail was put in by Deer
Run Associates approximately 2 or 3 years ago and that the drainage
swail will not effect any of the properties. The curbing system
and gutters will take care of the water flow. Mr. Hallberg further
stated that in terms of permanent screening there are no deed
restrictions on file with any of these lots.
Town Engineer Dan Walker stated that there will be a drainage
system put in to properly take care of the water with Chase Pond.
Mr. Hallberg stated that on the Subdivision for Chase Pond the
drainage was basically shown as a swail.
Mr. Walker stated that the specific details of the drainage
needs to be approved by the Town Engineer as required by the
Subdivision approval for Chase Pond. Mr. Walker stated that the
road would cut off most of the drainage from above other than what
is in those lots to the east of the roadway because of the deep cut
that. the roadway was made of.
Assistant Town Planner George Frantz stated that his concern
was that the Town of Ithaca owns a 20 foot right of way that runs
along the boundary of Deer_ Run and Chase Pond,
David Sparrow stated that he was concerned about maintenance
of the swail for Phase II and Phase III and how the buffer will
effect these phases. Mr. Sparrow stated that with the lots in
Phase III being re- landscaped because they are too close to the
Phase II homes.
Mr. Hallberg pointed out the location and types of plants on
the site to the Planning Board, Mr. Hallberg stated that the Deer
Run Homeowners Association would maintain the common land.
There being no further discussion the Chair asked if anyone
were prepared to offer a motion.

Subdivision Approval for the proposed subdivision of a total

PUBLIC HEARING: (SIGN REVIEW BOARD): CONSIDERATION OF A
RECOMMENDATION TO THE ZONING BOARD OF APPEALS IN RE A REQUEST FOR
A VARIANCE FROM SECTION 5.01 -1 OF THE TOWN OF ITHACA SIGN LAW TO
PERMIT ERECTION OF A SIGN THAT EXCEEDS THE MAXIMUM AREA ALLOWED FOR
WALL SIGN GRAPHICS AT ADVANTAGE SPORT AND FITNESS, INC., EAST HILL
PLAZA, TOWN OF ITHACA TAX PARCEL NO. 62 -2- 10121. CORNELL
UNIVERSITY, OWNER.; JOHN W. MURRAY, ADVANTAGE SPORT AND FITNESS,
INC. APPLICANT.
Chairperson Grigorov declared the Public Hearing in the above -
noted matter duly opened at 8:36 p.m, and read aloud from the
Notice of Public Hearings as posted and published and as noted
above.
John W. Murray, applicant, addressed the Planning Board
stating that he was asking for a variance for the sign to be placed
for Advantage Sport and Fitness. The existing area for a sign is
44 square feet. The sign would be the same size, there are two
side panels that are over where his store would be, the sign would
be located to the left in closest proximity of the doorway; a blank
sign between 'his sign and Cornell Federal Credit Union's sign.
John Murray of Sibley Real Estate addressed the Board as a
representative of Cornell University and stated that Cornell
University had given approval of the proposed use, and sign for the
store.
Dave Auble addressed the Board and stated that he felt that
the Codes and Ordinances Committee should take care of provisions
for signs and not the Planning Board.
Chairperson Grigorov noted that this was a Public Hearing and
asked if anyone from the public wished to speak. No one spoke.
There being no further discussion, Chairperson Grigorov asked
if anyone were prepared to offer a motion.
MOTION by Robert Kenerson, seconded by Candace Cornell:
WHEREAS:

erection of a sign that exceeds the maximum area allowed for
wall sign graphics at Advantage Sport and Fitness, Inc., East
Hill Plaza, Town of Ithaca Tax Parcel No. 62- 2- 1.121.
2. This is an Unlisted Action for which the Town of Ithaca Zoning
Board of Appeals is legislatively determined to be Lead Agency
for environmental review, and

3, The Planning Board, acting as the Town of Ithaca Sign Review
Board, has, at a Public Hearing held on May 18, 1993, reviewed
and accepted as adequate the Short Environmental Assessment
Form Part I prepared by the applicant, a Part II prepared by
the Town planning staff, a drawing showing the proposed sign
and its dimensions, and other application materials, and

Appeals that:
1. A negative determination of environmental significance be made
in accordance with the New York State Environmental Quality
Review Act for the above referenced action as proposed, and
2. It grant the request for a variance from Section 5.01 -1 of the
Town of Ithaca Sign Law to permit erection of a sign at
Advantage Sport and Fitness, Inc., East Hill Plaza, Town of
Ithaca Tax Parcel No. 62- 2- 1.121, that exceeds the maximum
area allowed for wall sign graphics, for the sign proposed.

Chairperson Grigorov declared the matter of a Request for a
Variance from Section 5.01 -1 of the Town of Ithaca Sign Law for
Advantage Sport and Fitness, Inc., to be duly closed at 8:45 p.m.
AGENDA ITEM: REPORT OF THE TOWN PLANNER.
Town Planner Floyd Forman stated that the GEIS would be on the
Planning Board's agenda for the June 1, 1993 meeting to discuss
changed that had been made addressing the comments made by the
Planning Board. Mr. Forman stated that Mary Nichols had stated
that she would add the issue of completeness of the GEIS at the
Planning Board

June 1, 1993 meeting and ask the Board to make a decision as to the
completeness of the document and whether or not the document is
ready for public review.
Mr. Forman stated that the Comprehensive Plan is on the
Board's agenda also to review Chapter 4 and the comments that have
been made. Mr. Forman felt that it could take two meeting to
review the comments made by Elsie McMillan' s and Noel Desch as well
as review the content of Chapter 4 itself. Mr. Forman stated that
he felt Chapter 5 would be discussed at a later meeting.
Mr. Forman stated that Shirley Raffensperger, the Town
Supervisor, had received a letter from Michael Stamm, of Tompkins
County Area Development, suggesting some changes in language
concerning the Town's economic policy, development and local
economy. Mr. Forman stated that he is revising Chapter 3 right now
and asked the Board to give him the authority to incorporate Mr.
Stamm's comments and make the minor revisions in the language.
The Board agreed that Mr. Forman could make the changes
discussed.
Town Planner Floyd Forman stated that he revisions to Chapter
3 had been made and that he will give the Board members the revised
chapter at the next meeting. Mr. Forman stated that the next
