Chairperson Grigorov declared the meeting duly opened at 7:30 P.M. and accepted for the record the Clerk's Affidavit of Posting and Publication of the Notice of Public Hearings in. Town Hall and the Ithaca Journal on June 29, 1992, and July 2, 1992, respectively, together with the Secretary's Affidavit of Service by Mail of said Notice upon the various neighbors of each .of the properties under, discussion, as appropriate, upon the Clerk of. the City of Ithaca, upon the Tompkins _County Commis:s:ioner .of - Planning, upon the Clerk .of the Town of Enfield, and upon the applicants and /or agents, as appropriate, on .June 29, 19929 Chairperson Grigorov read the assembled, as required by the New York Office of Fire Prevention and Control. CONSIDERATION OF THE CLARIFICATION OF CERTAIN CONDITIONS IMPOSED BY THE PLANNING BOARD IN THEIR JUNE 21 1992 APPROVAL OF THE-SOUTH HILL RETAIL /OFFICE COMPLEX FINAL SITE PLAN, The Planning Board granted. preliminary and final site plan approval for the proposed construction of a retail /office complex, with associated parking and landscaping improvements, as shown on the site plan_ entitled "South Hill Retail /Office Complex ", dated April 21, 1992,.revised through May 26, 1992, prepared by Trowbridge and Wolf, Landscape Architects, with conditions. The Board- discussed the clarification of certain conditions imposed June 2, 1992. MOTION by William Lesser, i seconded by Candace Cornell. Planning Board -2- July 7, 1992 RESOLVED, that, in the matter of the consideration of the clarification of certain conditions imposed by the Town of Ithaca Planning Board in its June 2, 1992 approval of the South Hill Retail /Office Complex Final Site Plan, said Planning Board hereby amends, for purposes of clarification, condition "f" of said June 2, 1992 Resolution granting Preliminary and Final Site Plan Approval to read as follows. 'If. Gasoline pumps are not permitted on the parcel, nor are enterprises such as bars that derive 500 or more of their gross revenues from the sale of alcoholic beverages for on -site comsumption, and" There being no further discussion, the Chair called for a vote. The clarification of certain conditions with respect to the June 21 1992 Planning Board approval of the South. Hill Retail /Office Complex Final Site Plan on Danby Road was declared duly closed. ADJOURNED PUBLIC HEARING (FROM JUNE 21 1992) CONSIDERATION OF SITE PLAN APPROVAL FOR THE PROPOSED LANDSCAPE AND TRAFFIC IMPROVEMENTS TO EAST HILL 6- 62 -2 -- 1..12.1, LOCATED AT-JUDD C. CORNELL PLAZA SHOPPING CENTER, TOWN OF 6- 62-2- 1.22,_ AND 6-- .62- 2 -12, FALLS ROAD AND ELLIS HOLLOW UNIVERSITY, OWNER /APPLICANT; JOHN ITHACA TAX PARCELS NO. 12.4 + /- ACRES TOTAL, ROAD, BUSINESS DISTRICT MAJERONI, AGENT. Chairperson Grigorov declared the Adjourned Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. The proposed project will improve landscape and traffic, circulation in the East Hill. Plaza parking lot to handle present uses and all future uses currently allowed under Town of Ithaca zoning, including the development of Parcel #62 -2 -1.22 for future retail /restaurant /office uses. Edward B. Abbott, P.E., of Larsen Engineers, responded to Town Planner Floyd Forman on June 19, 1992, as follows: "Floyd Forman, Senior Planner Town of Ithaca Planning Board 126 East Seneca Street Ithaca, NY 14850 Dear Mr. Forman:. As requested, we have reviewed the seven page report for the East Hill Plaza improvements and additions prepared by Travers Associates. F Y Planning Board -3- July 7, 1992 The report covers the existing plaza, an additional 13,780 square feet retail area, and a 8000 square feet high turnover restaurant. The plan shows separate right turn and left turn driveway exits from the shopping center to both Judd Falls Road and Ellis Hollow Road and extra width entrances at both locations. We find the planned access will handle the anticipated-traffic. It also appears the driveway layouts allow some flexibility for adjustments that may be desirable as traffic volumes increase and actual traffic patterns are observed. It is our opinion that the proposed access and overall circulation plan will operate at a satisfactory level of service. The internal parking lot layout; based on scaling (no dimensions given) also provides adequate circulation. Review of the development data provided and the traffic data we have from the Draft Generic Environmental Impact Statement (DGEIS) indicates traffic volumes within the capacity of existing and proposed roadways. The location and spacing of the driveways are sufficient for developing gaps at the driveways when the Judd Road - Ellis Hollow Road intersection is rebuilt and signalized. There appearing to be no further discussion or comments from the Board, Chairperson Grigorov asked if anyone were prepared to make a motion. MOTION by Virginia Langhans, seconded by James Baker. WHEREAS. 1. This action is the Consideration of Site Plan Approval for proposed landscape and traffic improvements to East Hill Plaza to Shopping Center, 6- 62 -2 -1 -1.22, Judd Falls Road Town of and 6- 62 and Ellis Ithaca -2 -12, Hollow Tax Parcels 12.4 + /- acres Road, Business No. 6 -62 -2- 1.121, total, located District "C". at 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively determined. to act as Lead Agency in environmental review with.respect to the proposed site plan. 3. The Planning Board, at a Public Hearing held on June 2, 1992- and contined on July 2, 1992, has reviewed and accepted as adequate the Short Environmental Assessment Form Part I prepared by the applicant, Parts II and III prepared by the Town planning staff, and a site plan entitled "Landscape Improvements, East Hill Plaza ", dated May 10, 199.2, revised May 28, 1992, prepared by Cornell University Real Estate Department, a traffic study. dated Planning Board -4- July 7, 1992 May 28, 1992, prepared by Travers Associates, application materials. and other 4. This Board, July 71 is an Unlisted Action acting as Lead Agency 1992, made a negative for which the Town in environmental determination of of Ithaca Planning review, has, on significance. 3. The Planning Board,. at a Public Hearing held on June 2, 1992 and continued on July 7, 1992, has reviewed the Short Environmental Assessment Form Part I prepared by the applicant, Parts II and III prepared by the Town planning staff, a site plan entitled "Landscape Improvements, East Hill Plaza ", dated May 10, 1992, revised May 28, 1992, . prepared by the Cornell University Real Planning Board -5- July 7, 1992 Estate Department, a traffic study dated May 28, 1992, prepared . by Travers Associates, and other.application materials. an original 4. The proposed landscaping improvements reduce the amount of available parking by a total of 53 spaces, and the 503 remaining spaces fall short of meeting the Town of Ithaca Zoning Ordinance parking requirements of the Business "C" District by 39 spaces, therefore, a variance from the Zoning Board of Appeals is required. 5. The traffic study prepared by Travers Associates, dated May 28, 1992, evaluates internal traffic circulation for existing uses and potential development of the "out- parcel" for a maximum of 130 vehicular trips during the weekday peak P.M. hour, said study having been reviewed and found to be adequate by Town Engineering staff, Planning staff, and Larsen Engineers, NOW, THEREFORE, BE IT RESOLVED. 1. That the Planning Board hereby finds that the traffic study, dated May 28, 1992, prepared by Travers Associates, provides an adequate basis for the proposed internal traffic circulation improvements (including intersection of the entrances with public streets) as they pertain not only to the existing uses, but also future development of the "out- parcel ", provided the development of the "out- parcel ", will not generate more than 130 additional vehicular trips during any weekday peak hour nor shall the entire shopping center, including the "out - parcel ", generate more than 820 vehicular trips during any weekday peak hour for the entire mall.. 2. That the Town of Ithaca Planning Board hereby grants Preliminary and Final Site Plan Approval to the proposed landscape and traffic improvements, as shown on a portion of a site plan entitled "Landscape Improvements, East Hill Plaza ", dated May 10, 1992, revised May 28, 1992, prepared by the Cornell University Real Estate Department, .subject to the following conditions. a. Submission-of an original and two (2) copies of the final site plan for approval by the Town Engineer. b. The granting of a variance by the Zoning Board of Appeals for less than the required number of parking spaces. 3. That the Planning Board hereby recommends that the Zoning Board of Appeals grant the required variance relative to parking. There being no further discussion, the Chair called for a vote. Planning Board -6- July 7, 1992 Chairperson Grigorov declared the matter of consideration of site plan approval for the proposed landscape and traffic improvements to East Hill Plaza Shopping Center duly closed. AGENDA ITEM CONTINUED DISCUSSION OF ALTERNATIVE SKETCH PLANS FOR THE PROPOSED SUBDIVISION OF TOWN OF ITHACA TAX PARCEL NO. 6- 24- 3 -3.2, 105.07 + /- ACRES TOTAL, LOCATED BACKLOT OF 1201 -1251 TRUMANSBURG ROAD (NYS ROUTE 96), RESIDENCE DISTRICTS R15 AND R -30, INTO AS MANY AS 110 LOTS. CAYUGA CLIFFS DEVELOPMENT CORP., OWNER /APPLICANT; T.G. MILLER ASSOCIATES, AGENT Chairperson Grigorov opened discussion on the above -noted matter and read aloud from the Agenda as noted above. Maps were appended to the bulletin board. It was noted that the R -30 zoning is in the flatest land and the R -15 zoning applies to the land with the steepest slopes -- 110 lots are proposed. Assistant _Town Planner George Frantz addressed the Board and noted that he had discussed the following with Don Sweezy of T.G. Miller Engineers. Mr. Frantz said that there is a concern with the density on the site because of only one outlet. Mr. Frantz stated that one possibility would be to acquire a right of way through the Seventh Day Adventist Church property up to Route 96 for a second access point to the site, adding, one problem with that is the grade. Board Member Cornell wondered if anyone had talked to the church elders concerning the right of way. Mr. Frantz responded that he had not. Mr. Sweezy said that the church has been non - responsive, not negative, but just no response. Continuing, Mr. Frantz pointed out on the map that.he ran "this" out to the hospital property so if they desire they can easily extend up to the hospital entrance. Indicating on the map, Mr. Frantz said "this" is the proposed right of way reservation into the lower end of the hospital property. Ms. Cornell wondered if that would be a road -- Mr. Frantz answered, eventually, yes. Ms. Cornell said that. one thing she liked about it is that it does not have the panhandle shaped lots. Mr. Frantz noted that one problem is the lack of connection into the Berggren property. Mr. Frantz said that the steep slopes are in the lower third or so on the Cayuga Cliffs site, the steep slopes continue up on the Berggren property, right up to Hillcrest Drive. Mr. Frantz said that if there were a parkway built on that alignment down to the railroad bed there would not be any access to that parkway from the Berggren property. Mr. Frantz noted that the topo of the Berggren property is fairly steep. Chairperson Grigorov asked if anyone on the the Board had any comments. Planning Board -7- July 7, 1992 Board Member Langhans stated that she likes this development, but she also liked the townhouses -- if some of the area could be used for townhouses, then maybe the developer could get away from the little tiny lots. Mr. Reizes said that he is opposed to Plan No. 4 for several reasons. First of all, 35 % -40% can't be built on because of steep slopes, yet the next door property could be a Town parkway down through the exact kind of steep slopes. The road layout on this plan is parallel roads, with double frontage lots, 10,000 to 12,000 sq. ft. lots, a lot of expensive road being built, very few lots and no lots facing it from the west. If that kind of a system is imposed, that is really a taking of property -- if the government is going to draw up plans for a developer saying, we like this highway and we don't want you to build on that. Chairperson Grigorov stated that this is not a government plan. Chairperson Grigorov said that she would rather see more cluster rather than all those little lots -- Mr. Reizes responded that he would too. Town Engineer Dan Walker said that if the Board wanted to see clustering and try to preserve the open space as much as possible, and not put the onus and liability of ownership onto the Town for areas that cannot be used for parkland, then it is very appropriate to have specific building sites identified on the final plat, and, in fact, actually have proposed building plans shown, and grading plans shown. Candace Cornell.. mentioned the slopes and the type of soil. Mr. Frantz said that between the open space and the highway there is about 25% permanent open space, the Town is requesting 8.9 acres as the park and open space dedication. Mr. Frantz noted that this is a 26 -acre proposed permanent open space dedication, it can be owned by a Homeowners' Association. Mr. Sweezy stated that the developer would like to work with the townhouse idea at the top. Mr. Frantz commented that to preserve the integrity of the woodland from a biological standpoint, one is looking at a spacing in the range of 500 feet between any homes built in the wooded areas. Ms. Cornell thinks it really depends on the density, one would have to come up with how many places a house could be placed safely. Chairperson Grigorov wondered what was going to be done about the road right of way. Mr. Frantz said that the road would be built to the current Town of Ithaca specifications. The road will be built as part of the subdivision plat, but it will have an additional right of way and an additional setback to make sure that in future years the road is functioning as a secondary connector down West Hill, the homes that are along it will not be adversely impacted by 10,000 cars a day. Mr. Frantz said that the inspiration for the upper portion .of the subdivision came from Frank Harding from the City of Ithaca. The inspiration for the lower portion of the subdivision was after North Sunset Drive in. the Village of Cayuga Heights, Mr. Frantz stated that this plat combines the elements of probably the two most successful subdivisions in Tompkins County history, there is nothing unusual about this plat, it is working elsewhere, and it will work here. Mr. Frantz said that the homes can.be built and can be attractive, one thing about them is that with the 75 -foot minimum Planning Board -8- July 7, 1992 setback the odds are they are going to be 20 feet above the road, which means there will be a very nice view. Mr. Forman, commenting on the setback, said that the idea of a setback is that if one lives along a main road that has a significant amount of traffic it will have a minimal impact if you design a significant amount of buffer between you and the cars going by. Chairperson Grigorov wondered if a road reservation can be required without having the Town Board approval. Town Engineer Dan Walker responded, if it is going to be reserved for potentially Town acquisition the Town Board would have to approve the location. In conclusion, Mr. Reizes said that the Board has helped and something could be worked out between all the plans. Chairperson Grigorov noted that more cluster would be good. Chairperson Grigorov closed the discussion of the Cayuga Cliffs project. PUBLIC HEARING: CONSIDERATION OF SUBDIVISION APPROVAL FOR THE PROPOSED SUBDIVISION OF 14,000 + /- SQUARE FEET FROM TOWN OF ITHACA TAX PARCEL NO. 6 -24 -1 -41921 10.61 + /- ACRES TOTAL; LOCATED AT 294 HAYTS ROAD, AGRICULTURAL DISTRICT,. FOR CONSOLIDATION WITH TOWN OF ITHACA TAX PARCEL NO. 6 -24 -1 -41.8, 1.48 + /- ACRES TOTAL, LOCATED AT 289 HAYT.S ROAD, AGRICULTURAL_ DISTRICT. JOSEPH AND NOREEN MARSIT, OWNERS; MATTHEW WHITTEMORE AND JODIE MEYERS, APPLICANTS. Chairperson Grigorov declared the Public Hearing An the above -noted matter duly open and read. aloud from the Notice of Public - Hearings as posted and published.and_as noted above. Mr. Whittemore addressed the Board and stated that the proposal is for the subdivision of Tax Parcel #24 -1 -41.2 for consolidation with Tax Parcel #24 -1 -41.8. The purpose is to give Parcel Number 6 -24 -1 -41.8 a 50' strip from Parcel Number 6 -24 -1 -41.2. Town Planner Floyd Forman asked Mr. Whittemore to explain the driveway road situation that runs off Hayts Road -- there appears to be a hammerhead. Mr. Whittemore responded that years ago John McLean was going to develop all the land, and that hammerhead or 50 feet was going to be the Town turnaround -- that was never accomplished before he passed away. Mr. Forman asked if the land was ever subdivided. Mr. Whittemore answered, to the best of his knowledge, no. Attorney Barney offered that it may have been subdivided before the effective date of the Town Subdivision Regulations. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone had any comments or questions. No one spoke. The matter was brought back to the Board for discussion.. This action is the Consideration of Subdivision Approval for the proposed subdivision of 14,000 + /- square feet from Town of Ithaca Tax Parcel No. 6 -24 -1 -41.2, 10.61 + /- acres total, located at 294 Hayts Road, Agricultural District, for consolidation with Town of Ithaca Tax Parcel No. 6 -24 -1 -41.8, 1.48 + /- acres total, located at 289 Hayts Road, Agriculatural District. 29 This is an Unlisted Action for which the Town of Ithaca Planning Board has been legislatively determined to act as Lead Agency in environmental review. 3. The Planning Board, at a Public Hearing held on July 7, 1992, has reviewed and accepted as adequate the Short Environmental .Assessment Form Part I prepared by the applicant, Parts II and III prepared by the Town planning staff, a sketch plan entitled "Survey Map of Lands on Hayts Road ", dated November 13, 1987, prepared by Howard Schlieder, P.E., L.S., and other application materials. 4. The Town planning staff has recommended a negative determination of environmental - significance for the proposed subdivision and consolidation, as proposed. NOW, THEREFORE, BE IT RESOLVED:, That the Town of_Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above - described action and, therefore, an Environmental Impact Statement will not be required. The Zoning Board of Appeals, at a Public Hearing held on June 24, 1992, granted the necessary variances for lack of frontage on a public road (Town Law Section 280 -a variance) and less than the required lot width along a public road. NOW, THEREFORE, BE IT RESOLVED., 1. That, the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board. 2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for square feet from Town of consolidation of said 6 -24 -1- 4.1_.8 as proposed the proposed Ithaca Tax Parcel tract with Town and as shown on a subdivision of No. 6 -24 -.1 of Ithaca Tax sketch plan 14,000+/ - -41.2 and Parcel No. entitled "Survey Map of Lands prepared by Howard Schlieder, following: on Hayts Road ", P.E., L.S.., dated November conditioned 13, 1987, upon the a. Submission of an original and four (4) full -size prints of the final survey may showing the entire parcel to be subdivided and items noted as being required on the Preliminary and Final Subdivision Checklist, and approval of said survey by the Town Engineer. b. That the parcel so subdivided shall be transferred to the owner of Town of Ithaca Tax Parcel No. 6 -24 -1 -41.8, and be consolidated with said parcel. c. All improvements on Town of Ithaca Tax Parcel No. 6 -24 -1 -41.8 shall be shown on such final survey. d. Planning Board Chairperson and Consolidation closed. -11- July 7, 1992 Grigorov declared the Two -Lot Whittemore Subdivision Preliminary and Final Subdivision Approval duly AGENDA ITEM. CONSIDERATION OF A REQUEST TO ELIMINATE A CONSTRUCTION EASEMENT OVER LOT NO. 14 AT CHASE FARM AND CONSIDERATION OF A RECOMMENDATION ON SAME TO THE TOWN BOARD. Attorney Barney noted that when Chase Farm was a production, so to speak, the Planning Board required and the Town Board agreed, that there be an easement for construction traffic provided to Chase Lane, together with an easement for access by emergency vehicles. The owner of Lot #14 became Citizens Savings Bank as a result of foreclosure, and they have.in turn sold it. . There appearing to be no further discussion or comments from the Board, Chairperson Grigorov asked if anyone were prepared to offer a motion. MOTION by William Lesser,, seconded by Virginia Langhans: RESOLVED, that, in the matter of the consideration of a request to eliminate a construction easement over Lot No. 14 at Chase Farm and consideration of a recommendation on same to the Town Board, the Town of Ithaca Planning .Board hereby recommends to the Town Board that the Supervisor of the Town of Ithaca be authorized to execute the release of only that portion of a temporary easement for .ingress and egress for emergency vehicles and for construction vehicles relating to the temporary construction entrance for ingress and egress for construction vehicles over Lot No. 14, thereby reserving to the Town of Ithaca the continued easement for ingress and egress by emergency vehicles, said easement being depicted on a survey entitled "Resurvey of Lot 14 - Chase Farm Subdivision - Phase One ", prepared by George C. Schlecht, P.E., P.L.S., dated May 12, 1992, and FURTHER RESOLVED, that the Town of Ithaca Planning Board hereby permits this change as a slight modification to the previously approved plat for the Chase Farm Subdivision - Phase One. There appearing to be no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Baker,, Langhans, Lesser, Finch, Cornell. Nay - None. Chairperson Grigorov declared the matter of a request to eliminate a construction easement over Lot No.. 14 at Chase Farm duly closed. OTHER BUSINESS. Town Engineer Dan Walker stated that the Matthew Wall property that was approved by the Preliminary and Final Subdivision on May 5, Town has a Planning 1.99.2. Mr. plat of the Board for Walker said Planning Board -12- July 71 1992 that the plat is not a legal plat because it only shows the parcel that is being taken off. Mr. Walker said that waivers were requested by the owner's attorney based on a hardship issue that the cost of a survey would be very costly; it is a wooded area. There being no further discussion or comments from the Board, Chairperson Grigorov asked if anyone were prepared to offer a motion. MOTION by William Lesser, seconded by Robert Kenerson: RESOLVED, that the Town of Ithaca Planning Board waive and hereby does waive the following additional requirements shown on the Final Subdivision Checklist with respect to the Matthew Wall Subdivision approval of May 5, 19926 1. Exact boundary lines of the tract, indicated by a heavy line, giving dimensions to the nearest one hundredth foot, angles to the nearest one -half minute, and at least one bearing; the traverse shall be balanced and closed with an error of closure not to exceed one to two thousand; the type of closure shall be noted. 2. Surveyor's certificate: certificate signed and sealed by a registered land surveyor to the effect tht (1) the plat is a correct representation of all exterior boundaries of the land surveyed and the subdivision of it. There being no further comments or questions, the Chair called for a vote. Aye - Grigorov, Kenerson, Langhans, Baker, Finch, Lesser. Nay - None. Abstain - Cornell. Chairperson Grigorov declared the matter of further waiver of final plat requirements for the Matthew Wall 2 -lot subdivision duly closed.
