Barney (Town Attorney), Dan Walker (Town Engineer), Floyd Forman (Town Planner), George Frantz (Assistant Town Planner). ALSO PRESENT: L. Roscoe, D. Brittain, Bruce Brittain, Karen Baum, Attorney S.K. Egan, John C. Vice Chairman Kenerson declared the meeting duly opened at 7:00 p.m. and accepted for the record the Clerk's Affidavit of Posting and Publication of the (Notice of Public Hearings in Town Hall and the Ithaca Journal on June 10, 1991, and June 13, 1991, respectively, together with the Secretary's Affidavit of Service by Mail of said Notice upon the neighbors of each of the properties under discussion, as appropriate, upon the Clerk of the Town of Ithaca, upon the Resident Engineer of the NYS Department of Transportation, upon the Clerk of the City of Ithaca, upon the Tompkins County Commissioner of Planning, and upon the applicants and /or agents, as appropriate, on June 17, 19910 Vice Chairman Kenerson read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, If Office of Fire Prevention and Control. AGENDA ITEM: CONTINUED CONSIDERATION OF PROPOSED SCOPE FOR CORNELL UNIVERSITY GENERIC ENVIRONMENTAL IMPACT STATEMENT (G /EIS). i Town Engineer Danl�Walker stated that all the comments that came in from the Planning Board members and the general public are noted on his 7 -page summary dated June 18, 1991. The referenced summary is attached hereto as Exhibit #1. Mr. Walker, along with the Board, reviewed at length the compilation of the comments. The Proposed Scope of Issues and Outline for the Draft Generic Environmental Impact Statement, with amendments as noted, is attached hereto as Exhibit #2. if At this point, Chairperson Grigorov noted that this was not a ® public hearing, buti� asked if there were anyone from the public who wished to comment. ft Planning Board -2- June 18, 1991 Dooley Kiefer, member of the Town Conservation Advisory Council, commented on trees as to their age, size, etc. Chairperson Grigorov noted that the Board had completed their review and asked if anyone were ready to offer a motion for approval of the Draft Scope. MOTION by Mr. William Lesser, seconded by Mr. James Baker. WHEREAS. 1." Cornell University has requested that the Town Board rezone certain of its lands in the area bounded by NYS Rte, 366, Game Farm Road, and Cascadilla Creek from Residence District R -30 to a Special Land Use District, 2. This is a Type I action under the criteria set forth in 6 NYCRR Part 617, and Section V of Town of Ithaca Local Law No. 5 of 1988 Providing for Environmental Review of Actions in the Town of Ithaca. 3. The Town of Ithaca Planning Board notified other involved agencies of its intent to declare itself Lead Agency for the environmental review associated with the request by the University for the rezoning and with the proposed future development of University lands in the Town of Ithaca between Cascadilla Creek on the north and the vicinity of Snyder Hill Road and Honness`Lane on the south and extending from the City of Ithaca to the Town of Dryden, and received no objection to same. 4. The Planning Board, therefore, on May 21, 1991, designated itself Lead Agency for environmental review for this action. 5. The Planning Board, at its regular meeting on May 21, 1991, made a positive determination of environmental significance for this proposed action and directed the applicant to prepare a generic environmental impact statement which will identify and analyze the cumulative impacts of the request for the rezoning and the proposed future development of University lands in the Town of Ithaca between Cascadilla Creek on the north and the vicinity of Snyder Hill Road and Honness Lane on the south and extending from the City of Ithaca to the Town of Dryden. 6. The Planning Board at its April 16, 1991 meeting was presented with a draft scope for the required generic environmental impact statement and has solicited and received public comment on the draft scope. 7. The Planning Board has reviewed the draft scope and revisions to it since April 16, 1991, public comments regarding it, and staff recommendations at its regular meetings on May 21, 1991, and June 18, 1991. THEREFORE, IT IS RESOLVED. Planning Board -3- June 18, 1991 • That the Town of Ithaca Planning Board approve and hereby does approve, as amended, the Draft Scope for the Generic Environmental Impact Statement, dated May 31, 1991, and revised by the Planning Board on June 18, 1991, which will identify and analyze the cumulative impacts of the request for the rezoning and the proposed future development of University lands in the Town of Ithaca between Cascadilla Creek on the north and the vicinity of Snyder Hill Road and Honness Lane on the south and extending from the City of Ithaca to the Town of Dryden. • There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Baker, Langhans, Lesser, Smith, Hoffmann, Aronson. Nay - None. The MOTION was declared to be carried unanimously. CONSIDERATION OF SUBDIVISION PROPOSED SUBDIVISION OF TOWN F ITHACA TAX PARCEL ACRES TOTAL AREA, INTO FOUR LOTS RANGING IN SIZE F 1 +/- ACRE IN SIZE, LOCATED AT 402 WARREN ROAD THE INTERSECTION OF HANSHAW AND WARREN ROADS), • R -15. LOIS S. FOGELSANGER, OWNER /APPLICANT. APPROVAL FOR THE NO. 6- 71 -1 -39, 3 +/- ROM .5 +/- ACRE TO (NORTHWEST CORNER OF RESIDENCE DISTRICT Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. A map was appended to the bulletin board. Jack Burns, Realtor with Wilsen Associates, approached the Board and stated that Mrs. Fogelsanger has hired him to sell her property. Mr. Burns noted that three acres were involved. Mrs. Fogelsanger would like to subdivide her land into four lots, adding that the existing house would remain in place. Mr. Burns said that Mrs. Fogelsanger wants to keep intact the woods to the north and sell that portion last, because Mrs. Fogelsanger has recently purchased a house right nearby and would like to still be able to walk in the woods. Chairperson Grigorov read into the record the Conservation Advisory Council Environmental Review Committee's comment as follows: "If Planning Board sees a way to "adjust" the lot lines to ensure that more trees will be preserved when development occurs, please do so." Eva Hoffmann mentioned that since the house is on a corner it might be nice to be able to reduce the number of curb cuts. Ms. Hoffmann wondered about the possibility of having a joint driveway between Lot #3 and Lot #4; that would also reduce the number of trees that would have to be cut down, and there would just be one curb cut there • instead of two. In other words,.Ms. Hoffmann wondered if Lot #3 and Lot #4 could share a driveway from Warren Road. Ms. Langhans Planning Board -4- responded that that would be difficult to do house. Ms. Hoffmann stated that it is just a June 18, 1991 in trying to sell possibility. This action is the Consideration of Subdivision Approval for the • proposed subdivision of Town of Ithaca Tax Parcel No. 6- 71 -1 -39, 3 +/- acres total area, into four lots ranging in size from .5 +/- acre to 1 +/- acre in size, located at 402 Warren Road (northwest corner of the intersection of Hanshaw and Warren Roads), Residence District R -15. 2. This is an Unlisted action for which the Town of Ithaca Planning Board has been legislatively determined to act as Lead Agency in environmental review. 3. The Planning Board, at Public Hearing on June 18, 1991, has reviewed the Short Environmental Assessment Form and an environmental assessment of the proposed action prepared by the Assistant Town Planner, comments by the Environmental Review Committee of the Conservation Advisory Council, a plat entitled "Proposed Subdivision, Lands of Lois Fogelsanger, Hanshaw and Warren Roads, Town of Ithaca, Tompkins County, New York ", dated March 14, 1991, prepared by Richard A. Slade, L.S., and other application materials. 4. The Assistant Town Planner has recommended a negative determination of environmental significance for this action. THEREFORE, IT IS RESOLVED. • That the Planning Board make and hereby does make a negative determination of environmental significance for this action as proposed. Slade, L.S., and other application materials. THEREFORE, IT IS RESOLVED: 1. That the Planning Board waive and hereby does waive certain requirements for Preliminary and Final Subdivision Approval, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board. 2. Chairperson Grigorov declared the matter of Consideration of Final Subdivision Approval for the Lois Fogelsanger Four -Lot Subdivision duly closed. • • PUBLIC HEARING: CONSIDERATION OF SUBDIVISION APPROVAL FOR THE PROPOSED SUBDIVISION OF TOWN OF ITHACA TAX PARCEL NO. 6 -24 -1 -14.2, 2.1 +/- ACRES TOTAL AREA, INTO TWO LOTS, LOCATED ON THE WEST SIDE OF TRUMANSBURG ROAD OPPOSITE WOOLF LANE, AGRICULTURAL DISTRICT. TERRANCE J. AND TERRY J. FISK, APPLICANTS. Chairman Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Mr. Fisk addressed the Board and stated that there were no existing structures on the two proposed lots. Chairperson Grigorov reviewed the Conservation Advisory Council Environmental Review Committee's comments with the Board. [ERC report attached hereto as Exhibit #3.] Assistant Town Planner George Frantz inquired about public water on the site. Town Engineer Dan Walker responded that public water is available on the site, but public sewer is not yet available. Mr. Frantz noted, for the record, that he had walked the site. Chairperson Grigorov noted that this was a Public Hearing and asked if there were anyone from the public who had any comments or questions. Althena Grover, of 1486 Trumansburg Road, approached the Board and stated that the lot in question is a very wet lot, and building on the lot would be a problem for the developers. A question was raised concerning whether public sewer would be available to the lot. Mr. Walker replied that the Town would be extending public sewer to the lot. There appearing to be no one else from the public who wished to speak to this matter, Chairperson Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. Stephen Smith wondered about run -off from the proposed site to other sites. Mr. Smith also wondered about an Ordinance concerning limiting run -off. Mr. Walker responded that in this particular case, he thought it was primarily a local problem, and development behind the proposed properties would potentially cause additional problems for the proposed properties. Mr. Walker offered that the area is relatively flat and the soils are slow drying in the Spring. Mr. Walker said that the size of the lot provides sufficient room to place a house on the land. MOTION by Mrs. Virginia Langhans, seconded by Mr. Robert Kenerson: WHEREAS. 1. This is an Unlisted action for which the Town of Ithaca Planning Board has been legislatively determined to act as Lead Agency in environmental review. 3. The Planning Board, at Public Hearing on June 18, 1991, has reviewed the Short Environmental Asssessment Form and an environmental assessment of the proposed action prepared by the Assistant Town Planner, comments by the Environmental Review Committee of the Conservation Advisory Council, a plat entitled "Sketch Plan Showing Proposed Subdivision for Future Lands of Terrance J. and Terry J. Fisk ", dated April 23, 1991, prepared by Allen T. Fulkerson, L.S., and other application materials. • 4. The Assistant Town Planner has recommended a negative determination of environmental significance. THEREFORE, IT IS RESOLVED. That the Planning Board make and hereby does make a negative determination of environmental significance for this action as proposed. There being no further discussion, the Chair called for a vote. CONSIDERATION OF MODIFICATION OF SITE PLAN ED REPLACEMENT OF THE EXISTING FACADE AND :ILL PLAZA SHOPPING CENTER WITH A NEW FACADE AND TAX PARCELS NO. 6 -62 -2 -1.121 AND -12, BUSINESS UNIVERSITY, OWNER; JOHN MURRAY, SIBLEY REAL AGENT. Chairperson Grigo;rov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Mark Stevens, of (Sibley Real Estate Services, Inc., appeared before the Board, displayed a model of the Plaza for the Board's review, and stated that there are two basic portions of the East Hill Plaza; the very left end of the Plaza where the P &C is currently located, and the center section where all the smaller satellite stores are located. Mr. Stevens said that, basically, there is no major change to the existing canopy, it is just a new "skin" that would be installed over the current canopy using the current support systems already in place. Mr. Stevens said that the footprint, height, or square footage of the building would not change. Mr. Stevens stated thatil there would be no parking changes to the property. Board Member Aronson stated that the current facade in the center extends some distanceabove the roof line. Mr. Stevens said that • that section would be lowered about 3 -1/2 feet. Board Member Kenerson asked about lighting. Mr. Stevens responded that there will be new lighting underneath the facade, adding that there will be a back -lit sign that runs the whole length of the Plaza. Mr. Stevens offered that there would be no changes to the sidewalk whatsoever. Mr. Stevens stated that the facade system is a metal building panel system that is a steel structure with metal "skin ", and the roof panels are a standing "seam" roof, and there will be an effect of a ripple or ridge approximately every 24" on center. Ms. Aronson wondered about the 'panels that are upright and whether or not they served a function or whether they were purely decorative. Mr. Stevens responded that they are more decorative, adding, the eastern portion of the building being 300' long, Cornell was concerned about introducing just one roof line that ran on and on, so it was an attempt to break it up into bays of approximately 25' each. Board Member Lesser said that he felt the improvements were long overdue. Mr. Lesser stated that he would be very disappointed if this was not used asil an opportunity to extend the general site improvements in that'iarea, he would like to see something done in the parking lot, such as trees to break up the parking lot, and he would also like to see something done to consider the traffic flows through that parking lot because it is awful. Mr. Stevens offered that the P &C consents to all the improvements mentioned, but does not consent • to improving the parking lot. AGENDA ITEM: CONSIDERATION OF A RECOMMENDATION TO THE TOWN BOARD WITH RESPECT TO A PROPOSED LOCAL LAW AMENDING THE ZONING ORDINANCE RELATING TO PROCEDURES FOR SITE PLAN APPLICATIONS. Chairperson Grigorov opened discussion on the above -noted matter. . �I Planning Board 1 -13- June 18, 1991 Board Member Lesser wondered about an extension of the date with respect to an initiIal request for site plan. Attorney Barney responded that the nature of the site plan negotiation may require more than 24 months. Chairperson Grigo ov noted that this was not a public hearing. Bill Hilker, of Burns Road, addressed the Board and stated that he was representing the Town of Ithaca Taypayers' Association. Mr. Hilker asked about an establishment of a new Zoning District, and wondered, if, in the past, that was the Planning Board's duty or has it always been the Town Board function. Virginia Langhans responded that it would be the Town Board. Mr. Hilker stated that the Association has problems with some of the language within the subject proposed local law, Mr. Hilker referred to Page 2, Section 46 -a, No. 2, last sentence: "The Planning Board shall make its determination within thirty (30) days after the hearing and forward the same to the Chairman or Clerk of the Board of Appeals." Mr. Hilker said that it does not say what happens if one does not do that, and he felt that there should be a statement saying that if it does not happen, then it goes on as if it were approved. In other words, what does the applicant have as an alternative if it goes over 30 days? 9 • Mr. Hilker referred to Page 4, Section 46 -d, No. 9. "The effect of the proposed development on environmentally sensitive areas including but not limit to wetlands, floodplains, woodlands, steep slopes, and water courses, and on other open space areas of importance to the neighborhood or community." Mr. Hilker stated that the Association feels No. 9 should be deleted since there is no definitive part of the zoning that says where these things start; where they leave off; there is no identification of them; there are no definitions of them. Attorney Barney responded that whether it is in or out those considerations are there automatically as a result of SEQR. Mr. Hilker referred to - e Page 5, Section 46 e, No. 3. Mr. Hilker felt that the time constraints are very, very rigorous; it takes a developer maybe one or two years just to put a package together and to get it through the Board. No building permit shall be issued for a project with an approved final site plan until the applicant has furnished to the Town'Engineer an irrevocable letter of credit in an amount to be approved by the Town Engineer. Such letter of credit shall insure that all items on the site plan that nay be deemed necessary to provide for adequate traffic flow, utilities, and other infrastructure items are constructed in accordance with the approved final site plan and any other pertinent specifications and requirements. The Planning Board may waive the requirement or may accept other evidence or promise of completion of required facilities for the site plan if, in' its discretion, it determines that there is no need for th& letter of credit. 2. No final certificate of occupancy or certificate �~ compliance shall be issued until all irprovements shown the final site plan as approved by the Planning Board are installed orl until a sufficient performance guarantee, sup:: as a letter of credit, has been provided to the Town improvements'! not yet completed. The sufficiency of suc:n performance guarantee shall be determined by the Town Engineer after consultation with the Building Inspector or other persons designated by the Planning Board. The Planning Board may waive the requirement for such Performance guarantee .if, in its discretion, it determines that the guarantee is not needed. 3. Unless, work has materially commenced in accordance with the final site .plan within one year from the issuance of the building permit authorizing such work, or within twenty -four months of the date the Planning Board gave final site plan approval, whichever is earlier, not only the building permit but the site plan approval (both final and preliminary) shall expirell and the permissible uses and construction on the property shall revert to those in effect prior to the granting of any site plan approval. The Planning Board, upon request of the applicant, after a public hearincr, and upon a - finding that the imposition of the time limits "set forth above would create an undue hardship on the applicant, may extend the time limits for such additional periods as the PlanningllBoard may reasonably determine.
