Chairman Grigorov declared the meeting duly opened at 7 :30 p.mo
and accepted for the record the Clerk's Affidavit of Posting and
Publication of the Notice of Public Hearings in Town Hall and the
Ithaca Journal on October 8, 1990, and October 11, 1990, respectively,
together with the Secretary's Affidavit of Service by Mail of said
Notice upon the various neighbors of the property under discussion,
upon both the Clerk and the Building Commissioner of the City of
Ithaca, upon the Tompkins County Commissioner of Planning, and upon
the applicants and /or agent, on October 11, 1990.
Chairman Grigorov read the Fire Exit Regulations to those
assembled- as required by the New York State Department of State,
Office of Fire Prevention and Control.

Chairman Grigorov declared the Public Hearing in the above -noted
matter duly opened at 7 :33 p.m. and read from the Agenda as noted
above. Mr. Robert Drake was present. The documents before the Board
are attached hereto as Exhibit #1, Short EAF including Parts I. II,
and III, Exhibit #2, Resolution No. 73 of the Town Board, March 12,
1990, accepting a certain portion of Max's Drive; Exhibit #3, Survey
Map entitled "Portion of Lands of Robert Drake & Charles W. Drake ",
prepared by James P. McNamara, P.L.S., dated February 5, 1990; Exhibit
#4, a copy of Exhibit #3 upon which Town staff had imposed the new
lots, the modified lot, and the proposed extension of Max's Drive, and
entitled "Components of Proposed Subdivision by Robert Drake, Max's
Drive "; Exhibit #5, a reduced copy of Tax Map No. 28, prepared by Town
staff and showing the parcels being subdivided and the subdivision
location, entitled "Location Map, Robert Drake Subdivision ".

Board Member Robert Kenerson stated, for the record, that he
would abstain from any discussion of or voting on the Drake
Subdivision because of possible conflict of interest.
Assistant Town Planner George Frantz appended a large copy of the
survey map to the bulletin board and described the proposal. Mr.
Frantz stated that the proposal involves the subdivision of
approximately 4.55± acres of land into three lots ranging in size from
1.25± to 1.74± acres, and .08± acre for consolidation with an existing
residential lot. Mr. Frantz stated that the proposal also involves
the construction of approximately 350 feet of public road. Mr. Frantz
noted that homes already exist on two of the four lots involved in
this proposal.
Board Member Lesser asked about the extension of the road and
what was involved. Mr. Frantz responded that the Town Board had
accepted Max's Drive up to the boundary between Lot No. 4 and Lot No.
3, adding that the road is not yet complete, however, that part was
accepted by the Town Board in March 1990, Dr. Lesser wondered about
the reference to the modification of lot lines. Mr. Frantz stated
that that refers, in addition to adding Lots No. 2, 4, and 6, to Mr.
Drake's widening of Lot No. 3, which is actually an existing lot from
a 1986 subdivision, by an additional 25 feet. Dr. Lesser wondered if
there were any particular reason for the extension of that lot by 25
feet. Mr. Drake, noting that there is a water source underneath,
• stated that there is also an extensive "fault" which complicates the
well placement. Mr. Drake pointed out that there is a lot of sulphur
water in this area which further complicates the matter and made it
necessary to add 25 feet to the lot. Mr. Drake stated that the well
would be on the far corner of the lot. Dr. Lesser asked if the land
were part of an Agricultural District at this time, to which Mr. Drake
replied, yes, and added that he knew of no subdivision constraints
involved.
Town Planner Susan Beeners mentioned a park site and Mr. Drake
stated that he had run into opposition with that. Chairman Grigorov
wondered if the opposition were from the public, with Mr. Drake
indicating that it was not. Mr. Drake described a large wooded area
and spoke of what he envisioned as a park. Mr. Frantz stated that the
primary problem that staff had with the proposed park site was the
fact that it is, essentially, a ravine which is about 30 feet deep
with extremely steep sides, and not really something that he felt the
Town could develop as :a safe and appropriate public park. Mr. Drake
offered that a park could possibly be established in the future and,
utilizing the map, described where.
Chairman Grigorov stated that Dooley Kiefer, Chair of the
Environmental Review Committee of the Conservation Advisory Council,
had asked her to ask some questions in her absence. Chairman Grigorov
stated that Ms. Kiefer wanted her to ask about the stream. Mr. Drake
stated that the stream does not drain into Cayuga Lake. Chairman
• Grigorov stated that Ms. Kiefer wanted her to ask where the houses
were to be placed on the lots. Mr. Drake stated that the houses were
to be placed on the front sides of the lots because the back side

tapers down, adding that the back sides of the
lots will
remain wooded
and undisturbed, and further adding that the
majority
of the wooded
area is being preserved. Chairman Grigorov stated
that
Ms. Kiefer was
concerned about a wet area. Mr. Drake stated
that
there
is no problem
with drainage and pointed out that the lots
in
the subdivision are
well in excess of an acre.
Chairman Grigorov noted that this was a Public Hearing and asked
if anyone present wished to speak. Mr. Allan Gorton, 125 Vera Circle,
spoke from the floor and described several trees which had been cut
down by a person owning a lot not related to the subdivision under
discussion. Mr. Allan Gorton indicated that he was aware that his
concern was not related, however, he wanted to point out the cutting
down of trees. There being no one else who wished to speak, Chairman
Grigorov closed the Pubic Hearing and brought the matter back to the
Board.
There appearing to be no further discussion, Chairman Grigorov
asked if anyone were prepared to offer a motion with respect to SEQR.
MOTION by Dr. William Lesser, seconded by Mr. James Baker:
WHEREAS:
1. This action is the Consideration of modification of lot lines of
• Town of Ithaca Tax Parcel No. 6 -28 -1 -3.77, and further,
Consideration of Subdivision Approval for the proposed
subdivision of three lots from Town of Ithaca Tax Parcels No.
6 -28 -1 -3.62 and 6 -28 -1 -3.72, 124± acres total, located off Max's
Drive, backlot of Vera Circle,
2. This is an Unlisted action for which the Town of Ithaca Planning
Board has been legislatively determined to act as Lead Agency in
environmental review.
3. The Planning Board, at Public Hearing on October 16, 1990, has
reviewed the Short Environmental Assessment Form, a proposed plat
entitled "Portion of Lands of Robert Drake and Charles W. Drake ",
dated February 5, 1990, by James P. McNamara, L.S., and other
application materials.
49 The Assistant Town Planner has recommended that a negative
determination of environmental significance be made for the
proposed action.
THEREFORE, IT IS RESOLVED:
That the Planning Board make and hereby does make a negative
determination of environmental significance for this action as
proposed.

with respect to the subdivision approval request.
MOTION by Mr. Robert Miller, seconded by Dr. William Lesser:
WHEREAS:
1. This action is the Consideration of modification of lot lines of
Town of Ithaca Tax Parcel No. 6 -28 -1 -3.77, and further,
Consideration of Subdivision Approval for the proposed
subdivision of three lots from Town of Ithaca Tax Parcels No.
6 -28 -1 -3.62 and 6 -28 -1 -3.72, 124± acres total, located off Max's
Drive, backlot of Vera Circle,
2. This is an Unlisted action for which the Town of Ithaca Planning
Board, acting as Lead Agency in environmental review, has, on
October 16, 1990, made a negative determination of environmental
significance.
3. The Planning Board, at Public Hearing on October 16, 1990, has
reviewed the Short Environmental Assessment Form, a proposed plat
entitled "Portion of Lands of Robert Drake and Charles W. Drake ",
dated February 5, 1990, by James P. McNamara, L.S., and other
application materials.
THEREFORE, IT IS RESOLVED:
1. That the Planning Board waive and hereby does waive certain
requirements for Preliminary and Final Subdivision Approval,
having determined from the materials presented that such waiver
will result in neither a significant alteration of the purpose of
subdivision control nor the policies enunciated or implied by the
Town Board,
2. That the Planning Board grant and hereby does grant Final
Subdivision Approval to the subdivision as shown on the plat
entitled "Portion of Lands of Robert Drake and Charles W. Drake ",
dated February 5, 1990, by James P. McNamara, L.S., subject to
the following conditions:
a. No construction will occur on Lot 2 or Lot 6 until approval
by the Tompkins County Health Department of on -lot water and
sewer facilities.
b. An instrument reciting the foregoing condition, in
recordable form satisfactory to the Attorney for the Town,
shall be recorded in the Tompkins County Clerk's Office
prior to, or concurrently with, any deed transferring either
of the parcels.

2, shows a second access for homes on Max's Drive,
3, includes, for the Planning Board's consideration, a suitable
proposal for public park and open space dedication as provided
for in the Town of Ithaca Subdivision Regulations.
There being no further discussion, the Chair called for a vote.

Chairman Grigorov declared the matter of the Drake Subdivision
and lot line modification duly closed at 7:52 p.m.
SKETCH PLAN REVIEW: PROPOSED TWO -LOT SUBDIVISION, 231 ENFIELD FALLS
ROAD, TOWN OF ITHACA TAX PARCEL N0, 6- 34 -1 -4, RUTH S. ROYCE ESTATE.
Chairman Grigorov declared discussion on the above -noted matter
duly opened at 7:55 p.m. and read aloud from the Agenda as noted
above.
Attorney David A. Tyler approached the Board and stated that he
was representing the Estate of Ruth S. Royce, Attorney Tyler
distributed several documents to the Board members, including a survey
dated July 1990, and deeds dating from 1933, 1934, and 1937. A
completed application had been submitted by Attorney George R. Pfann
on September 14, 1990.
Attorney Tyler stated that the Royce property was conveyed to
Milton and Ruth Royce by two separate deeds, adding that the first
deed conveyed the house lot which is now under contract for sale.
Attorney Tyler stated that the premises were conveyed by Nina Barney
Royce to Milton P. Royce and Ruth S. Royce by deed dated September 7,
1933 and corrected by a deed of correction between the same parties
dated February 9, 1934. Attorney Tyler stated that four years after
the original deed, Nina B. Royce conveyed to Milton and Ruth Royce the
remaining property Nina Royce owned in the area by deed dated May 10,
1937. Attorney Tyler stated that Milton Royce died in 1967, Ruth

• Royce died July 7, 1989, therefore, the property is now in the Estate.
Attorney Tyler stated that somehow over the years the parcels became
combined for tax parcel designation, however, the house and lot
originally on the 1.35± acre "parcel" has been maintained over the
years, adding that there are no residential or commercial buildings on
the other "parcel ". Attorney Tyler noted that the July 7, 1990 survey
[by George C. Schlecht, P.E., L.S.] is the same as the first parcel
deeded as corrected by the deed of correction. Attorney Tyler
reiterated that the land under discussion is owned by the Estate and
shows on the Tax Parcel Map as one parcel of roughly 60 acres.
Town Planner Susan Beeners stated, for the record, that in the
consideration of any future open space reservation, if the remaining
land were to be subdivided in the future, the acreage of the lot
proposed for subdivision should be considered in the overall acreage,
even though it is a very small amount relative to the whole parcel.
Ms. Beeners stated that the subdivision approval process would entail
a public hearing, which has been scheduled for November 6, 19900
Town Attorney Barney, noting that he had reviewed the material
presented with Attorney Pfann's submittal letter of September 14,
1990, stated that, in reviewing the tax maps, and in particular tax
parcel 31 -1 -4, it appears that all of the Royce property has for some
period of time now been considered one tax parcel, adding that as far
back as the map of May 1, 1971, that entire parcel has been shown as
• one tax parcel. Attorney Barney stated that, accordingly, even though
the property may have been conveyed in by separate deeds, it certainly
has been treated as one parcel for tax purposes, and presumably for
other purposes as well, for nearly 20 years, adding that, in view of
that, he would suggest that a subdivision application would be
necessary, which is where we are now.
Discussion followed between Attorney Barney, Attorney Tyler, Ma.
Beeners, and the Board members as to what Attorney Tyler would need to
do in preparation for the November 6, 1990 public hearing. The items
requested included the net lot area once the road right of way is
deducted, the Residence District R -30 setback line, the width of the
lot along the road frontage, the width of the lot 60 feet back from
the right of way with indication that at that point the lot is 150
feet wide, a completed SEQR Short Form, and the fee amount. Attorney
Barney suggested that Attorney Tyler review Section 23 of the Town
Zoning Ordinance, in particular paragraph #3.
Chairman Grigorov asked if there were any further comments or
questions. There being none, Chairman Grigorov declared the sketch
plan review of the Royce Estate two -lot subdivision duly closed.
AGENDA ITEM: STATUS REPORTS, COMPREHENSIVE PLANNING IMPROVEMENT
PROGRAM -- (1) COMPREHENSIVE PLANNING COMMITTEE -- (2) CONSERVATION
ADVISORY COUNCIL -- (3) CODES AND ORDINANCES COMMITTEE.
(1) Assistant Town Planner George Frantz stated that on Wednesday,
October 17, 1990, at 7:30 p.m. in the Cafeteria at NCR, the
Comprehensive Planning Committee will conduct a Public Information
Planning Board -7- October 16, 1990
• Meeting to present results from the 1990 Town of Ithaca Residents'
Survey [the Agenda therefor attached hereto as Exhibit #6]. Mr.
Frantz noted that Town Board Member and Chairman of the Comprehensive
Planning Committee David Klein will give an overview of what the CPC
has done to date.
With regard to the Comprehensive Plan, Mr. Frantz stated that, at
this point, there are several chapters drafted and under review by the
Committee. Mr. Frantz stated that Chapter 3, the Inventory, is the
largest chapter in the Comprehensive Plan and is approximately 50 per
cent complete, with the aim of having the remainder finished by the
middle of next month for presentation to the CPC. Mr. Frantz stated
that the Goals and Objectives Subcommittee of the CPC has been working
extremely hard and has pretty well finished approximately 80 goal and
policy statements which will be the actual foundation of the
Comprehensive Plan. Mr. Frantz noted that this material will be
distributed to the CPC members on October 17th for their consideration
and discussion at their October 23, 1990 meeting [the Agenda therefor
attached hereto as Exhibit #7].
(2) Planning Board Member and Member of the Conservation Advisory
Council Eva Hoffmann reported that she was not able to attend the last
Conservation Advisory Council meeting so she did not know what
happened [Agenda attached hereto as Exhibit #81. Ms. Beeners stated
that the CAC has been drafting a document on open space which is
• somewhat of a preamble to the statement of purpose insofar as the
preservaton of open space goes, including definitions and
classifications.
(3) Ms.- Beeners reported that the October 15th Codes and Ordinances
Committee was cancelled but, hopefully, will be rescheduled for
Monday, October 29, 1990. [Secretary's Note: The C & 0 meeting was
rescheduled for November 5, 1990, the Agenda is attached hereto as
Exhibit #9.]
AGENDA ITEM: MISCELLANEOUS REPORTS -- Proposed NYS Department of
Transportation project, Route 13 widening -- Inlet Valley Water and
Sewer Project -- Upcoming Development Applications -- Cornell
University -NYS Dormitory Authority Bonding package- Master Planning and
Generic EIS preparation -- East Ithaca Circulation Improvements --
Ithaca College- Master Planning and Generic EIS preparation -- Troy
Road Water Storage Tank project -- South Hill Recreation Way -- Route

Ms. Beeners reported that the NYS Department of Transportation
held their first public information meeting on October 10, 1990 on the
proposed widening of Route 13 from the Zikakis automobile dealership
building to approximately the south property line of Bell's
Convenience Store. Ms. Beeners noted that the project involves either
two lanes, improved, or, most likely, four lanes, and includes two
bridges, one near Buttermilk Falls State Park and the big bridge near
• The Waldorf School. Ms. Beeners stated that the Route 13A
intersection with Route 13 will be realigned to make it a little
straighter. Ms. Beeners stated that she felt there were two major

• impacts, one being the Swansbrough house which is across the road from
the Route 13A intersection and which will be taken completely. Ms.
Beeners stated that the second major impact is the Teeter house which
is opposite Bell's Convenience, adding that the Teeter house is a
four -unit apartment house, and further adding that it is going to lose
at least 20 feet of its front yard. Ms. Beeners stated that Bell's
Convenience and The Carpet Warehouse are going to lose 10 or 20 feet.
Ms. Beeners pointed out that there had been an Indian Village in the
vicinity of The Waldorf School area. Ms. Beeners stated that she had
related to the NYS DOT the February 6, 1990 Planning Board Resolution
concerning the Inlet Valley. Water and Sewer Improvements and the
development of a land use master plan for the Inlet Valley area within
the context of an overall Townwide master plan, and with respect to
the extension of infrastructure in that area. [The referenced
Resolution is attached hereto as Exhibit #10.1 Ms. Beeners stated
that it would probably be another month or two before the DOT comes
back with a full report, which will be subject to a public hearing.
Ms. Beeners reported that the Inlet Valley Water and Sewer
project, scheduled for construction probably next Spring, is presently
being reviewed by the City of Ithaca Board of Public Works.
Ms. Beeners reported that upcoming development applications,
tentatively scheduled for the November 6th Planning Board meeting,
include Royce, Shalebrook (Final) , Inlet Valley, Andree, and the
• Cornell Gas Cylinder. [The final Agenda for the November 6, 1990
Planning Board meeting is attached hereto as Exhibit #11.1
Ms. Beeners reported that the NYS Dormitory Authority is
proposing a number of things, some of which area the renovation and
expansion of Hasbrouck Apartments from about 240 units to 310 units,
and changing Pleasant Grove Apartments from family housing to four- or
five -story dormitories including 600 beds and a 200 -seat dining hall.
Ms. Beeners reported that Cornell plans expanding "CC" Lot located in
the City, adding that "A" Lot is going to have 600 to 800 new spaces,
and further adding that there is going to be a new road between Warren
Road and Pleasant Grove Road.
With respect to the East Ithaca Circulation Improvements, Ms.
Beeners reported that there has been an attempt to get the County
Engineer to expedite the process so that the Town can review the
proposed relocation of Pine Tree Road over to Judd Falls Road.
Ms. Beeners reported that the Ithaca College Master Planning and
Generic EIS preparation is commencing, adding that Town Engineer
Walker has been talking to them a lot about water supply.
With regard to the Troy Road Water Storage Tank project, Ms.
Beeners reported that the tank will have a maximum height of 30 feet.
Assistant Town Planner George Frantz reported on the South Hill
is Recreation Way, noting that the acquisitions and the like are being
finished, or at least being readied, and adding that after January 1st
there is some more paper work to be done and a formal contract to be

Town Board Minutes 48 March 12, 1990
• Supervisor Raffensperger noted an additional item to the agenda,
that of Max's Drive,
Town Attorney Barney noted that several months ago the Town Board
approved the acceptance of a portion of Woodgate Lane and about 60'
of Max's Drive. A request has come in from Mr. Wallenbeck to
obtain a building permit to construct a house just south of the 60'
turn around. At the present time, Max's Drive does not go that far
so before we can issue a building permit he would either have to go
to the Zoning Board of Appeals and get a variance or we have to
accept the road and make provisions for the road to be completed.
In view of the fact that the road has had a subbase installed and
we have an application for further subdivision to the east of the
existing subdivision it seemed appropriate to accept the road and
allow Mr. Wallenbeck to get going with his construction this year.
Councilman Whitcomb asked, what stage of construction was the road
in at this moment?
Highway Superintendent Ozolins replied, the subbase is in and in
fact where the turn around is he has put a lot of material in
there . There was an extremely wet area and he has put about two
feet of big size rock, stabilization and about eighteen inches of
gravel on top. He still has put the base on and surface treatment
along with some ditching, however, until all is done it is a
• conditional acceptance.
RESOLUTION NO, 73
Motion by Councilman Niklas, seconded by Councilman Whitcomb,
RESOLVED, that the Town Accept approximately 282 feet plus sixty
foot turn- around of Max's Drive as shown on a map entitled "Part of
Lands of Robert Drake - off Woodgate Lane - Town of Ithaca -
Tompkins County - New York" dated March 14, 1986 subject to the
following:
a. Approval of the construction of such road by the Town
Highway Superintendent and Town Engineer.
b. Approval of the title and deed to such road by the
Attorney for the Town.
c. If the road is not yet constructed, posting of a bond,
cash or letter of credit in an amount determined by the
Town Engineer and Town Highway Superintendent to be
sufficient to complete construction, in a form approved
by the Attorney for the Town, before the issuance of any
building permits for construction on any of the lots.

MOTION by Mrs. Virginia Langhans, seconded by Mr. James Baker:
WHEREAS:
1. The Planning Board, on May 16, 1989, heard a report from the Town
Engineer and Town Planner with respect to the proposed 1989 Water
and Sewer Improvements project -- Inlet Valley,
2. The Town Board, on January 8, 1990, requested that the Planning
Board review the project and make recommendations on potential
priority planning studies and other action items for the lands
within the service area.
3. The Planning Board, on February 6, 1990, has heard a report from
the Engineering and Planning Departments on the project and has
discussed possible land use implications.
THEREFORE, IT IS RESOLVED:
1. That the Planning Board recognizes the public health needs for
the extension of water and sewer mains to serve properties with
in adequate private systems.
2. That the Planning Board recognizes that there are potential
growth- inducing aspects of the project on active agricultural
lands and prime agricultural soils.
3. That the Planning Board also recognizes the planning implications
of the possible widening of Route 13 /Elmira Road,
4. That the Planning Board reports to the Town Board that the
Planning Board presently intends to request developers of all
future subdivisions within the service area to provide an overall
plan for the subject parcel if less than the entire parcel is
proposed to be subdivided, and further, presently intends to
request, in accordance with the Subdivision Regulations, that
clustered development alternative plats accompany any
applications for conventional subdivision for lands then or
recently in active agricultural use.
S. That the Planning Board directs the Town Engineer and Town
Planner to request additional information on the proposed Route
13 /Elmira Road improvements planned by the N.,Y.S. Department of
Transportation.
