CONSIDERATION OF A RECOMMENDATION TO THE ZONING BOARD OF APPEALS WITH RESPECT TO A REQUEST FOR MODIFICATION OF THE SPECIAL APPROVAL GRANTED FOR MAPLEWOOD RESIDENTIAL COMMUNITY BY SAID ZONING BOARD OF APPEALS ON APRIL 19, 1989, TO PERMIT THE RETENTION OF AN EXISTING WAREHOUSE BUILDING ON THE SITE FOR STORAGE SUPPORT OF THE MAPLEWOOD RESIDENTIAL USES; TO PERMIT THE CONSTRUCTION OF ONE LAUNDRY /LOUNGE BUILDING AND ONE PAVILION INSTEAD OF TWO NEW LAUNDRY /LOUNGE BUILDINGS (ONE LAUNDRY FACILITY HAVING BEEN LOCATED IN THE EXISTING COMMUNITY BUILDING), AND, TO PERMIT THE CONSTRUCTION OF ONE VOLLEYBALL COURT IN`THE EASTERN PART OF THE SITE. Wright of Cornell University had informed her that no one was able to attend and represent Maplewood'Residential Community. Mr. Wright requested that the Hearing be postponed until someone could appear on behalf of Maplewood. Ms. Beeners stated that she suggested a tentative date of May 1 19906 Ms. Beeners said that she was asked to send a written response of her concerns. PUBLIC HEARING: CONSIDERATION OF APPROVAL OF CERTAIN AMENDMENTS TO ARTICLE I, SECTION 8 OF THE TOWN OF ITHACA SUBDIVISION REGULATIONS Planning Board -2- April 17, 1990 • WITH RESPECT TO FEES, AS SUCH WERE PREVIOUSLY AMENDED ON FEBRUARY 81 1988, BY RESOLUTION'OF THE TOWN BOARD (NO. 44). Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone present wished to speak. No one spoke. Chairperson Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. There appearing to be no further discussion, Chairperson Grigorov asked if anyone were prepared to make a motion. (Adopted Resolution attached hereto as Exhibit No. 1.) Chairperson Grigorov declared the matter of the Amendment of Subdivision Regulations in re Fees duly closed. PARCEL NO. 6- 64 -1 -2, CORNELL ORCHARDS AREA, R -30. CORNELL UNIVERSITY, OWNER; PHILIP L. COX, ENGINEERING, AGENT. APPROVAL OF MINUTES - DECEMBER 5, 1989 MOTION by Robert Kenerson, seconded by Virginia Langhans: RESOLVED, that the Minutes of the Town of Ithaca Planning Board Meeting of December 5, 1989, be and hereby are approved as written. • There being no further discussion, the Chair called for a vote. Aye - Grigorov, Kenerson, Baker, Langhans, Lesser, Smith. Nay - None. Abstain - Hoffmann. The MOTION was declared to be carried. PUBLIC HEARING. CONSIDERATION OF A RECOMMENDATION BOARD OF APPEALS WITH RESPECT TO A REQUEST FOR SPECIAL TO THE ZONING APPROVAL OF THE PROPOSED "NAIC AIR - SUPPORTED STRUCTURE" PROPOSED TO BE LOCATED ON TOWN OF ITHACA TAX RESIDENCE DISTRICT DIRECTOR, FACILITIES PARCEL NO. 6- 64 -1 -2, CORNELL ORCHARDS AREA, R -30. CORNELL UNIVERSITY, OWNER; PHILIP L. COX, ENGINEERING, AGENT. Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Mr. Cox addressed the Board and stated that there are some long -range plans for the Orchards area that might entail something 20 years down the road. Mr. Cox offered that the ridge height of the structure is 31 • feet. Ms. Beeners stated that the structure would be subject to a building permit and there would have to be a variance granted. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone present wished to speak. No one spoke. Chairperson Planning Board -3- April 17, 1990 • Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. Ms. Hoffmann wondered about the use of the structure. Chairperson Grigorov declared Recommendation to the Zoning Board request for Special Approval of Structure duly closed. the matter of Consideration of a of Appeals with respect to a the proposed NAIC Air - Supported PUBLIC HEARING: CONSIDERATION OF A RECOMMENDATION TO THE ZONING BOARD "OF APPEALS WITH RESPECT TO A REQUEST FOR SPECIAL APPROVAL OF THE PROPOSED CORNELL UNIVERSITY CENTRAL GROUNDS FACILITY, PROPOSED TO BE LOCATED ON PORTIONS OF TOWN OF ITHACA TAX PARCELS NO. 6- 64 -1 -1 AND is 6- 64 -1 -2, SOUTH OF N.Y.S. ROUTE 366, RESIDENCE DISTRICT R -30. CORNELL UNIVERSITY, OWNER, PHILIP L. COX, DIRECTOR, FACILITIES ENGINEERING, AGENT. Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. A map was appended to the bulletin board. Dennis Osika, Grounds Superintendent at Cornell University, approached the Board and stated that the purpose of the proposed project is to build a grounds maintenance facility. The primary operating facility is presently located in the Humphreys Service Building, which is adjacent to the Cornell Steam Plant located on Route 366. The proposal is to relocate to a service section of Campus, which is already being used for a lot of storage supplies. The proposed facility is a pre - engineered, steel slab on grade, structure of approximately 13,000 sq. ft., with about 11,000 sq. ft. main shop facility. The structure is proposed to be two -story at the shop end, the administrative office section would be one - story. There will be employee parking adjacent to the building, with visitor parking in front of the building. There will be a plant holding area, which will be like a shade house for temporary storage of annuals and a lot of other trees and shrubs that are moved around • Campus. It is planned to develop the project in two phases. Mr. osika said that the structure could be built during the summer of 1990 and probably occupied by winter 1990, then landscaped Planning Board • the following Spring with a relatively about the evergreens would remain for a westernmost row. Mr. osika stated that Cornell has two small dump trucks, and only two dump trucks that are rated over 25 tons. The rest of the equipment is primarily pick -up trucks and flat -beds. Chairperson Grigorov noted that this was a Public Hearing and asked if there were anyone from the public who had any comments or questions. Charles Trautmann, President of the Forest Home Improvement Association, spoke from the floor and expressed the Public Hearing his concern about timing of the project. Mr. Trautmann said that the East Ithaca Land Use and Transportation Study Group is actively looking for circulation routes in East Ithaca. It seems to Mr. Trautmann that if this project is constructed this summer it more the or less guarantees • that the Caldwell Road alignment for a circulation route through the Orchards is going to be the only one, because he thinks the project cuts off one possible alternative route for getting through the Orchards with the Summerhill Lane Ext. There appearing to be no one else from the public who wished to speak to this matter, Chairperson Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. and use Eva Hoffmann wondered about herbicides and pesticides, asking where they would be stored. Mr. Osika responded that Cornell has two options. one option is to place and use a metal building adjacent to the proposed project, and the other option would be to use the existing Pathology facility. Possibly a new Pathology facility will be built in the future. There appearing to be no further discussion, Chairperson Grigorov asked if anyone were prepared to make a motion. (Adopted Resolutions - Recommendation to the ZBA attached hereto as Exhibit No. 3.) At this time, Attorney Barney stated, for the record, that his office is doing some legal work on specific matters for Cornell., but is nothing to do with the Town of Ithaca or the Boards. Chairperson Grigorov declared the matter of a Recommendation to the Zoning Board of Appeals in re proposed Cornell University Central Grounds Facility duly closed. • Planning Board FURTHER DISCUSSION COMMUNITY. -5- April 17, 1990 WITH RESPECT TO THE CORNELL MAPLEWOOD RESIDENTIAL It was the consensus of the Board, along with Attorney Barney, to re- advertise the above matter and treat it as a new hearing. Ms. Beeners stated that Albert Wright had asked her to send him a letter bringing up some concerns that Ms. Beeners might have regarding the project. Ms. Beeners wondered whether or not it is true that the warehouse is going to be used for maintaining an inventory of furniture, equipment, and supplies, etc. for Maplewood itself or for more than Maplewood.. Ms. Beeners cited a letter from Chuck Jankey, dated March 27, 1990 in which the water storage Mr. Jankey said that the facility was to be used Virginia exclusively for Maplewood. Ms. Beeners noted a letter addressed to Al Wright from William Paleen, dated April 10, 1990 in which Mr. Wright said that there would be a consolidation of inventory from a number of other facilities off -site. (Letters dated March 27, 1990, and April 10, 1990, respectively, attached hereto as Exhibit No. 4 and Exhibit No. 59 OTHER BUSINESS. Board Member Stephen Smith wondered if the water storage tank would be on the next Planning Board Agenda. Virginia Langhans • wondered about McDonald's Thermal Storage material came Corporation. Ms. Beeners said that Cayuga Lake Estates has not been heard from. Ms. Beeners stated that she has not heard anything regarding the Rosehill Subdivision. Attorney Barney mentioned the Zoning Ordinance in re the proposed height amendment. This will be put on the Agenda as a Public Hearing as soon as possible. At this point, the Board discussed the Coddington Road sewer connections. Several people on Coddington Road are having problems with their septic systems. Dan Walker stated that the Engineering and Planning Departments will be looking at the potential for putting sewer in the best routes, developing a cost estimate, and also determining, in conjunction with the Planning Dept, and conferences • • • Planning Board -6- April 17, 1990 with the Planning Board, whether or not the extension of sewer fits into the Master Plan and concepts of the Town. Chairperson Grigorov commented that there is a problem on West Hill concerning water on Woolf Lane limiting the fire protection. Dan Walker said that there was a watermain extension through the Woolf Lane area along Trumansburg Road to the Ulysses Town line. There was a booster station to provide domestic water service to the residents on Woolf Lane and out on Trumansburg Road; it was installed at the intersection of Woolf Lane and DuBois Road to increase the pressure to an acceptable level for domestic use. That was installed as a temporary measure in conjunction with the ongoing study of water supply needs for the West Hill area. Presently, that booster station does not have the capacity to meet flow requirements at the different fire hydrants. The concerns were raised because residents saw out of service tags on the fire hydrants. The Fire Department is aware that the flow capacity at the hydrants is not the maximum, and they are aware they cannot pump heavily from those hydrants. That has not reduced the level of fire protection in the area. The Town will be meeting with the fire authorities and the Bolton Point people and determining what capacities there are at the hydrants. There was a brief discussion on the Comprehensive Plan from Assistant Town Planner George Frantz. Mr. Frantz also talked about the Resident's Survey that will be mailed to residents of the Town. ADJOURNMENT Upon Motion, Chairperson Grigorov declared the April 17, 1990, meeting of the Town of Ithaca Planning Board duly adjourned at 10:00 p.m. Respectively submitted, Mary Bryant, Recording Secretary, Town of Ithaca Planning Board. :A Amendment of Subdivision Regulations Adopted by Planning Board Approval by Town Board Recommended Planning Board, April 17, 1990 I in re Fees -1- ADOPTED RESOLUTION: Amendment of Subdivision Regulations in re Fees Adopted by Planning Board 'Approval by Town Board Recommended Planning Board, April 17, 1990 MOTION by Mrs. Virginia Langhans, seconded by Mr. James Baker: WHEREAS, the Subdivision Regulations of the Town of Ithaca were adopted by the Town of Ithaca Planning Board on March 24, 1956 and approved by the Town Board of the Town of Ithaca on March 24, 1956, and WHEREAS, said Subdivision Regulations have been thereafter amended from time to time, and WHEREAS, the fees relating -to subdivision applications and other development proposals as set forth. in the Town of Ithaca Zoning Ordinance were amended effective April 3, 1990, and WHEREAS, it is 'deemed desirable and appropriate to amend the • Subdivision Regulations so that the fees charged pursuant to such regulations shall conform to the fee structure set forth in the Zoning Ordinance, with the same effective date; NOW, THEREFORE, IT IS RESOLVED, that the Town of Ithaca Planning Board adopt and hereby does adopt the following amendment of the Town of Ithaca Subdivision. Regulations,. and recommends approval of same by the Town Board of the Town of Ithaca: 1. Article I, Section 8, subparagraphs 1 and 2 are hereby deleted and the following new Section 8 is inserted, reading as follows: "Section 8. Fees, 1. There shall be paid to the Town the application fees, review fees, hearing and /or agenda fees, escrow deposits, SEQR fees and other charges set forth in Section 84 of the Town of Ithaca Zoning Ordinance, 2. The amounts of such fees, the time of payment of same, the process for 'calculating, depositing and /or paying same, and the dircumstances under which the fees or deposits may be modified shall all be as set forth in such section of such Ordinance." • AND IT IS FURTHER RESOLVED AND RECOMMENDED, that the changes in fees occurring as a result of these Resolutions shall be effective April 3, 1990, the effective. date of the Zoning Ordinance changes EXHIBIT 1 �$ Amendment of Subdivision Regulations in re Fees Adopted by Planning Board Approval by Town Board Recommended Planning Board, April 17, 1990 • -2- referred to above, except that the fees referred to and amended by these Resolutions shall not apply for a period of six months to any project in the Town of Ithaca that has received Preliminary Subdivision Approval or-Preliminary Site Plan Approval prior to April 3, 1990. If only a portion of the project has received preliminary approval, the deferral of fees pursuant to this Section shall apply only to the portion that has such approval. As to those projects to which this deferral applies, the .fees relating to such project shall be payable in accordance with the provisions of the Subdivision Regulations, Zoning Ordinance, and other regulations in effect immediately prior to April 3, 1990. As set forth in the amended Zoning Ordinance, commencing six months from April 3, 1990, the fees, as modified herein, shall be applicable to all subdivision applications regardless of their status on April 3, 1990. This action is the Consideration of a Recommendation to the Zoning Board of Appeals with respect to a request for Special Approval of the proposed Cornell University "NAIC Air - Supported Structure ", proposed to be located on Town of Ithaca Tax Parcel No. 6- 64 -1 -2, south of N.Y.S. Rt. 366 and west of Game Farm Road, Residence District R -30, 2. This is an Unlisted action for which. the Town of Ithaca Zoning Board of Appeals is legislatively determined to act as Lead Agency in environmental review. The Town of Ithaca Planning Board and the Tompkins County Planning Department are involved agencies in coordinated review. 3. The Planning Board, at Public Hearing on April 17, 1990, has reviewed the application materials, including environmental assessment forms, for this action. 4. The Town Planner has recommended a negative determination of environmental significance for this action. THEREFORE, IT IS RESOLVED: 1. The impetus for this request emanates from a budget driven programmatic change in the Maplewood Park project, an emerging need for additional storage space in support of the Maplewood residents, and a continuipg cost avoidance opportunity for the . Department of Residence Life. 1. Project budget overruns put us in the position of being unable to,,,bui1d a second laundry /lounge /storage facility indicated in the original site plan. We eliminated one of this structure in favor of including laundry facilities and additional'' student activity space in the masonry warehouse structure renovated as a community center. This left us with a significant storage deficit. It is also important to point out that retaining this useful facility, with no change in use, avoids the additional negative budget impact of demolition, removal, and landscaping, 2. We must, to support a community the size of Maplewood, have available replacement furnishings, appliances, and heating units, In' addition, a large parts inventory is an essential component of an effective maintenance program. 3. The Department of Residence Life is presently spending about $12,000 annually for the storage of a necessary inventory of furniture and mattresses, and furniture awaiting repair in two remote' "locations; we will consolidate these items and include them in the Maplewood facility.
