Mr. Engman also announced two presentation dates to the Board and the public ; Stormwater Mitigation on June 7th and Asset Management on July 29th Persons to be Heard and Board Comments — None Report of County and City Representatives Councilman Joel Zumoff from the City of Ithaca reported on the fences put up to deter suicides . The City does not like them but reluctantly agreed to the extension of time for the college to determine a more aesthetically pleasing way to help deter tragic outcomes . He also reported that the County has suspended all roadwork due to the State budget crisis and not receiving the funds from the State for the work . The City is not in the same situation and scheduled construction will continue . Mr. Zumoff noted that the Vine Street Cottages developers held a neighborhood meeting with about 30 people attending . He also reported that the City passed a resolution in support of sweat-free apparel for City employee uniforms . This was spearheaded by a group of college students and the Board of Public Works is in the process of discussing the issue and the Council expects a recommendation next week. Mr. Zumoff then mentioned the dredging of the inlet . The City expects to decide on the site for the dredge spills that cannot be very far from the source . The Board of Public Works will recommend one to the Council for their July meeting . Mr. Engman asked Mr. Zumoff what the City is thinking in terms of the property that they own that is in the Town of Ithaca and whether they were still considering that site as a fill site once the dredge spoils are dry. Mr. Zumoff stated that the decision of where to put the spoils TB 6-7-2010 Page 2 of 19 when they are dry is a ways off and the decision he was speaking of was the precursor to that; where the spoils are going to be kept until they dry , but he would keep our interest in mind . There was no report from the County AGENDA ITEM Public Hearing Regarding the Draft Official Town Map Supervisor Engman opened the. public hearing at 5 : 46pm . There was no one wishing to address the Board and the public hearing was closed . Consider SEQR Mr. Engman brought the Board 's attention to the revised , red - lined SEAR before them . Mr. Kanter explained that comments were added to clarify that site-specific proposals for development of road construction would receive site -specific environmental review. The roads have been reviewed for alignment and right-of-way but not the physical aspects of the roads . Susan Riha and Eric Levine moved and seconded the motion as drafted for discussion . Mr. DePaolo had questions regarding the West Haven Rd and Coy Glen impacts of the additional roads which will be "shortcuts" for some and therefore impact those neighborhoods . Discussion followed with Ms . Brock reiterating that projects involving those roads would still need their own SEQRs and SEQRs can be re -evaluated when needed . Mr. Kanter added that the updated map shows many roads that are already approved and on file with the County from approved subdivision plats and this is just tying up the loose ends . The map has not been updated since the late 60s . The only portion that hasn 't been is West Hill Drive and Bundy Road and having them there reserves those areas for the Town where they would like to see a road as opposed to where a developer might want to see a road . Mr. DePaolo understood that , but he wanted the impact of the changes to be more accurately explained in the SEQR form . Discussion followed with verbiage worked out to add to the SEQR . The verbiage was added by a motion for an amendment moved by Ms . Hunter and seconded by Mr. DePoalo with a unanimous vote . TB RESOLUTION NO . 2010-107 : SEQR Adoption of Amendments and Revisions to Official Map of the Town of Ithaca WHEREAS , this action is the adoption of amendments and revisions to the Official Map of the Town of Ithaca ; and WHEREAS , the amended and revised Official Map shows existing and proposed streets , highways , parks and trails in the Town of Ithaca ; and WHEREAS , this is an unlisted action pursuant to the New York State Environmental Quality Review Act ( SEQRA) 6 NYCRR Part 617 and Chapter 148 ( Environmental Quality Review) of the Town of Ithaca Code , for which the Town of TB 6-7-2010 Page 3 of 19 Ithaca Town Board is acting as Lead Agency in the environmental review with respect to the adoption of amendments and revisions to the Official Map ; and WHEREAS , the Town Board , at a public hearing held on June 7 , 2010 , has reviewed and accepted as adequate the Short Environmental Assessment Form ( EAF) , Parts I and II , for this action , prepared by the Town Planning staff ; now therefore , be it RESOLVED , that the Town of Ithaca Town Board hereby makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law, 6 NYCRR Part 617 New York State Environmental Quality Review and Chapter 148 of the Town of Ithaca Code for the above referenced action as proposed , based on the information in the EAF Part 1 and for the reasons set forth in the EAF Part 11 , and , therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact Statement will be required . Consider approval TB RESOLUTION NO , 2010=108 : Adoption of Amendments and Revisions to Official Map of the Town of Ithaca WHEREAS , Section 270 of New York Town Law authorizes the Town Board to establish an official map of that part of the town outside the limits of any incorporated city or village showing the streets , highways and parks theretofore laid out , and may also show drainage systems ; and WHEREAS , the current Official Map of the Town of Ithaca dates back to 1968 and has not been changed or amended since then ; and WHEREAS , Section 273 of New York Town Law authorizes the Town Board to change or add to the official map of the town so as to lay out new streets , highways , drainage systems or parks , after first referring any such proposed changes or additions to the Planning Board for a report thereon ; and WHEREAS , the Town Highway Superintendent/Director of Public Works prepared a draft proposed , revised Official Map , dated February 2010 , showing the current and proposed streets , highways , parks and trails in the Town of Ithaca , which represented changes from the 1968 Official Map ; and WHEREAS , the Town Board discussed the draft revised Official Map as described above at its regular meeting on March 8 , 2010 , and referred the proposed TB 6-7-2010 Page 4 of 19 changes to the Official Map to the Planning Board for a report and recommendation ; and 1 9 WHEREAS , the Town of Ithaca Planning Board reviewed the draft Official Map , dated February 2010 , held a public hearing on the draft Official Map at its meeting on April 6 , 2010 , and recommended in PB Resolution No . 2010-027 that the Town Board adopt the proposed revised Official Map with the changes shown on the February 2010 draft along with the following additional changes : ( 1 ) add Cradit Farm Road 's name to the map ; and (2) add the future portion of the Westview Subdivision road connecting the existing end of Larisa Lane to Schickel Road as an approved future road ; and WHEREAS , the Highway Superintendent/Director of Public Works has made the changes recommended by the Planning Board , and in addition has removed Town walkways from the proposed Official Map and made formatting changes to it , and has changed the Creation Date of the draft revised Official Map of the Town of Ithaca to May 10 , 2010 ; and WHEREAS , at its May 10 , 2010 meeting , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held by said Town on June 71 2010 at 5 : 35 p . m . to hear all interested parties on the proposed changes to the Official Map of the Town of Ithaca ; and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to the proposed changes to the revised Official Map ; and WHEREAS , this is an Unlisted Action for which the Town of Ithaca Town Board , acting as lead agency in the environmental review with respect to said adoption of amendments and revisions to the Official Map has , on June 7 , 2010 , made a negative determination of environmental significance , after having reviewed and accepted as adequate the Short Environmental Assessment Form , Parts I and II , prepared by the Town Planning staff; NOW , THEREFORE , be it RESOLVED , that the Town Board of the Town of Ithaca hereby accepts and adopts the amendments and revisions to the Official Map of the Town of Ithaca as shown on the May 10 , 2010 version of the Official Map , which version shall hereafter constitute the Official Map of the Town of Ithaca , effective June 8 , 2010 . AGENDA ITEM Public Hearing regarding Waiving or Reducing the Temporary Certificate of Occupancy Fee for Longview Supervisor Engman opened the public hearing at 6 : 08 p . m . There was no one wishing to address the Board on this subject and the public hearing was closed . TB RESOLUTION NO , 2010=109@ APPROVAL OF WAIVER FOR THE TEMPORARY CERTIFICATE OF OCCUPANCY FEE PURSUANT TO TOWN OF ITHACA CODE, CHAPTER 125 , TITLED , BUILDING CONSTRUCTION AND FIRE PREVENTION , SEC. 125=7 13(9) (a) [21 fa-el , IN ORDER TO REFUND LONGVIEW WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held by said Town on June 7 , 2010 to hear all interested parties on the proposed waiver of Temporary Certificate of Occupancy fees pursuant to Town of Ithaca Code , Chapter 125 , Titled , Building Construction and Fire Prevention , Sec . 125-7 B (9) (a) [2] [a-e] , in order to refund Longview/Ithacare , and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal; and WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed fee reduction , or any part thereof ; NOW THEREFORE BE IT RESOLVED , that the governing body of the Town of Ithaca does hereby approve a waiver and reimbursement of the $2 , 000 Temporary Certificate of Occupancy Fee pursuant to Town of Ithaca Code , Chapter 125 , Titled , Building Construction and Fire Prevention , Sec . 125-7 B (9) (a) [2] [a-e] , paid in April 2010 for a Temporary Certificate of Occupancy. AGENDA ITEM Presentation of Town of Ithaca Stormwater Management Plan Annual Report to NYS Department of Environmental Conservation Darby Kiley gave an overview of the report . Councilman DePaolo asked how the DEC ensures compliance and Ms . Kiley responded that they do spot checks on projects and TB 6-7-2010 Page 6 of 19 some towns have been audited . One of the items a local municipality was cited for was not having a plan to address stormwater issues , and the Town is working on that right now. AGENDA ITEM Johnson Controls Proposal for the IAWWTP — Chris Kalwara Mr. Kalwara gave a presentation on what Johnson Controls is proposing and their history and achievements with other municipalities . (Attachment # 1 ) The Board had questions regarding the length of the benefit versus the machinery bought and the upkeep of the machinery . Mr. Kalwara responded that the company guarantees the savings , so they are very , very careful and research the components they propose . Mr. Engman added that because this is a partnership , the Town will be working with the City of Ithaca and the Town of Dryden and an RFP will have to be developed and sent out and the Board would review that also . The repairs have to happen and grants have been applied for with some success , but , either way, we are going to have to pay for these improvements . The Board thanked Mr. Kalwara , AGENDA ITEM Discuss the Cornell/Conifer Proposal Mr. Kanter gave a brief summary statement . This is a recommendation from the Planning Committee that the Town Board move forward on the concept of a Planned Development Zone ( PDZ) and refer the project to the Planning Board for Site Plan Review so they can receive initial comments from the Planning Board . Andy Bodewes from Conifer Realty then addressed the Board . Mr. Bodewes stated that this is a Conifer proposal and they are proposing all the development , not Cornell , as reported by the Ithaca Journal . Conifer is proposing senior housing and a park-and - ride ; nothing else is being considered or proposed . That said , the Town has asked Confer, in an effort of good planning processes , to consider what could happen on the rest of the land and they have done that in concept form only . Nothing besides the senior housing and park-and - ride are being proposed and anything else shown is for concept planning purposes only . Conifer will be working with INHS to develop the senior housing and it will be similar if not identical to Conifer Village Senior Apartments . John Caruso from Passero Associates then addressed the Board . Mr. Caruso talked about the process and meetings they have been through up to this point . They have met with Town Staff and the Planning Committee to clarify their objectives and meet the needs of the community as well as address some common concerns . Mr. Caruso had a map delineating the three sections of the property . They looked at the Route 96 Corridor Study and the Comprehensive Plan and looked at the possible uses for the remaining land and the current allowable land uses . They defined neighborhood commercial uses , workforce housing , and institutional housing and offices and how that fit in with compatibility when looking at a PDZ . These discussions led toward the idea of a Planned Development Zone versus multiple Residence zoning . By going with a PDZ , they were able to look globally at the site SEQR for the potential uses in the remaining lands and their impacts associated with TB 6-7-2010 Page 7 of 19 the development of the remaining lands . They will look at the gamut of uses and their impacts on things such as traffic , stormwater management , access , pedestrian access , density, etc , and they have a jumpstart on those issues . They also clarified the process . They identified going to the Planning Board , and back to the Town Board and defined how the process would happen . The framework is there for future development for whomever develops the remaining land whenever it is developed . Mr. Bodewes stated that they have a draft PDZ as a starting point for initial review. Mr. Engman interjected that the action before the Board tonight is whether the Town Board feels comfortable enough with the concept to refer it to the Planning Board to get their initial comments , but we do not have the draft PDZ written up and that is not what will be reviewed . The recommendation is just to pass the concept on to the Planning Board and begin a draft PDZ for the Planning Committee to begin discussing . Board Comments/Questions Ms . Hunter asked what "workforce housing" meant . This is a new term being used quite a lot and what exactly does it mean ? Mr. Bodewes referred the question to John Livigne from Cornell who stated that "we ' re not sure ; it would be something to median income individuals or below. " Mr. Engman added that it was discussed at the Planning Committee and they indicated that what they had in mind was median income housing , not very low income and not higher income . Ms . Hunter asked if we had the ability to define that and asked how long we could make that a requirement once the investors have gotten their return . Mr. Bodewes responded that the Board could and Mr. Kanter and Ms . Riha added that that would be part of the PDZ requirements . Discussion followed . Mr. DePaolo and Ms . Hunter had questions about the draft PDZ Mr. Bodewes mentioned and they were concerned about forwarding the project to the Planning Board without having seen the draft . Mr. Kanter and Mr. Engman explained that the proposal would be going forward as a concept only, not the PDZ ; the PDZ would start at the Planning Committee which would then forward its recommendation on to the Town Board . Discussion followed regarding the three scenarios and what is allowed now and what could be allowed with a PDZ . There was a lot of discussion on the SEAR process for this proposal and future proposals , and Ms . Brock reiterated that other proposals would be required to go through the SEQR process . The SEAR review would be site- specific . The SEAR for the PDZ would be generic . Once a specific site project was proposed , the SEAR would be reviewed with the additional information and it would either be reopened or supplemented according to the site specifics . A neighbor of the proposed PDZ addressed the Board asking if his property , which appeared to be blocked out of the PDZ , would be eligible for the PDZ? Mr. Kanter asked for his contact information and said he would discuss it with him . The Board moved the resolution for discussion . Ms . Hunter and Mr. DePaolo were concerned about the PDZ going to the Planning Board and the Town Board having not seen it . Discussion followed and Mr. DePaolo offered an amendment to remove the TB 6-7-2010 Page 8 of 19 resolved clause sending the concept to the Planning Board . Ms . Hunter seconded it . Discussion followed with other Board members reiterating and explaining that the PDZ is not going to the Planning Board and the Planning Board is only looking at the proposal in a concept form so the developers could get initial comments and concerns from them which may then be discussed in conjunction with the drafting of the PDZ by the Planning Committee and the Town Board . Discussion followed and Mr. DePaolo withdrew his amendment . a . Consider resolution of support of concept and referral to the Planning Board for Sketch Plan Review and Preliminary Comments TB RESOLUTION NO . 2010-110 : Support Concept of Pursuing a Planned Development Zone ( PDZ) for the Conifer/Cornell Proposal , Trumansburg Road , and Refer Conifer/Cornell Proposal to Planning Board for Sketch Plan Review and Preliminary Comments WHEREAS , the Town of Ithaca Town Board discussed a proposal by Conifer Realty, LLC and Cornell University on a parcel located on Trumansburg Road/Route 96 (Tax Parcel No . 24 . -4-5 . 2) to initially develop a 15 acre portion of the 35 +/- acres of land currently owned by Cornell with a Phase I development to include a 60 +/- unit senior apartment building , an 80 +/- unit assisted living facility (Terrace at Ithaca) , and a park- and - ride lot consisting of 115 +/- parking spaces and a bus shelter. The remaining lands (20 +/- acres) will be retained by Cornell University for future development that could include a mix of uses , such as workforce housing , a small-scale neighborhood commercial or office development , and a future unspecified Cornell educational/institutional facility. The full development of the site would include a future road that could be dedicated to the Town of Ithaca connecting West Hill Drive through the site to Trumansburg Road , and WHEREAS , the Town of Ithaca Town Board referred the Conifer/Cornell proposal to the Town of Ithaca Planning Committee for a recommendation , and WHEREAS , the Planning Committee met on April 8th and May 13th , 2010 to discuss the Conifer/Cornell proposal and voted to recommend that the Town Board consider developing a Planned Development Zone ( PDZ) for the entire Cornell site to accommodate the Phase I Conifer/Cornell proposal and a range of possible future development scenarios for the remaining lands to be retained by Cornell , and also recommended referring the Conifer/Cornell proposal at this time to the Town of Ithaca Planning Board for an early sketch plan review and preliminary comments , now, therefore , be it RESOLVED , that the Town Board of the Town of Ithaca hereby supports the concept of pursuing a Planned Development Zone ( PDZ) for the entire Cornell site as described above to accommodate both the Phase I development and a range of future development scenarios on the remaining Cornell land , subject to all of the reviews and TB 6-7-2010 Page 9 of 19 approvals that will be required in order for the applicant to pursue this proposal , and be it further RESOLVED , that the Town Board of the Town of Ithaca hereby refers the Conifer/Cornell proposal to the Town of Ithaca Planning Board for sketch plan review and preliminary comments . MOVED : Councilwoman Riha SECONDED : Councilman Goodman AYES : Engman , Goodman , Riha , DePaolo , Levine and Hunter NAYS : None Motion passed unanimously . AGENDA ITEM Consider Resolution of Support for the Property Assessed Clean Energy ( PACE) Program Supervisor Engman explained the program and noted the Q&A sheet provided . Councilman DePaolo asked who would bond for the funds and who would be responsible if something happened . Mr. Engman thought that it would be the County as this is a large program and he was not familiar with all the details , " having gone by the supplied "suggested resolution" . TB RESOLUTION NO . 2010 — 111 : SUPPORT FOR AMENDING EXISTING ENABLING LEGISLATION (A40004) REGARDING MUNICIPAL SUSTAINABLE ENERGY FINANCING PROGRAMS WHEREAS , most energy consumed in the Tompkins County community is used for heating and lighting buildings , making retrofitting the existing building stock key to making significant strides in reducing energy use in the community; and WHEREAS , in November 2009 , by Chapter 497 of the Laws of 2009 , the State of New York authorized an amendment of the General Municipal Law by creating Article 5- L to allow municipalities to create Property Assessed Clean Energy Programs (known in New York State as "Sustainable Energy Financing Programs") to promote the deployment of renewable energy systems and energy efficiency improvement measures at residential and commercial properties ; and WHEREAS , Sustainable Energy Financing Programs assist property owners interested in making energy efficiency improvements or installing renewable energy systems in their buildings by providing a new financing mechanism to augment federal and state incentive programs ; and WHEREAS, Sustainable Energy Financing Programs are self supporting and designed to have no adverse budgetary impact to the municipality administering the program , and will be an "opt- in " benefit affecting only those residents who choose to participate ; and TB 6-7-2010 Page 10 of 19 WHEREAS , the Town of Ithaca wishes to increase the energy efficiency of existing buildings , reduce energy costs for residents , reduce carbon emissions to help mitigate climate disruption , reduce the negative health effects of fossil fuel emissions , create and retain local jobs in the energy audit and energy contracting sector, and bolster the local economy by saving residents monies which would otherwise be spent on energy costs ; and WHEREAS , the Town of Ithaca wishes to explore mutually beneficial ways of : • Leveraging private sources of capital with other public and private resources to accomplish these objectives ; and • Coordinating efforts with Federal , State , and other agencies and authorities to assure that activities are compatible with the plans and programs of the cooperating municipalities ; and WHEREAS , the Sustainable Energy Financing Program enabled by Article 5- L should be amended to allow broader sources of funding while securing and facilitating such programs , and such legislation is now pending in the New York State Senate and Assembly, now therefore be it RESOLVED , That the Town Board the Town of Ithaca supports pending legislation in the NYS Senate (#S7683) and companion legislation in the NYS Assembly A11243 to amend , strengthen and correct technical deficiencies within the current enabling laws authorizing Sustainable Energy Financing Programs , RESOLVED , further, That the Town of Ithaca Town Clerk is authorized to forward this resolution in support of amending current enabling laws authorizing Sustainable Energy Financing Programs to Governor David A . Paterson , Senate Majority Leader Malcolm Smith , Senate Minority Leader Dean Skelos , Senator George Winner, Senator James Seward , Senator Michael Nozzolio , Assembly Speaker Sheldon Silver, Assembly Majority Leader Ron Canestrari , Assembly Minority Leader Brian Kolb , Assemblywoman Barbara Lifton , and the New York State Association of Counties/ New York State Association of Towns/New York Conference of Mayors . TB 6-7-2010 Page 11 of 19 AGENDA ITEM Consider Approval of the 2011 PEGASYS Capital Budget Councilman DePaolo explained the budget and history of PEGASYS . TB RESOLUTION NO . 2010-112 : RESOLUTION APPROVING THE 2011 PEGASYS CAPITAL BUDGET WHEREAS , the Franchise Agreement between Time Warner Entertainment- Advance/Newhouse Partnership (TWC) and the Town of Ithaca , effective 5/29/03 , authorizes TWC to collect $0 . 15 per subscriber per month to be used for the purchase of equipment for PEGASYS ; and WHEREAS, the Town of Ithaca is a member of the PEGASYS Access Oversight Committee , which was created by the City of Ithaca to deal with a variety of matters related to public access , including making recommendations regarding the amount of PEGASYS equipment to be acquired each year over the term of the City' s franchise agreement with TWC ; and WHEREAS, the PEGASYS Access Oversight Committee has been charged with making a recommendation regarding the annual budget and facilities for the coming year, to be approved by participating municipalities by June 30 of the current year; and WHEREAS, the total capital budget for the life of the ten -year agreement was estimated to be $200 , 000 ; and WHEREAS, the Access Oversight Committee has approved a 2011 capital budget in the amount of $28 , 500 . 00 as shown on the attached document titled "2011 PEGASYS Capital Budget" ; and WHEREAS , pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been determined by the Town Board that this is a Type II action because it constitutes " routine or continuing agency administration and management , . . . " and thus adoption of this capital budget is not subject to review under SEQRA , THEREFORE , BE IT RESOLVED , that the Town of Ithaca Town Board approves the attached 2011 PEGASYS Studio Capital Budget . AGENDA ITEM Withdrawn -- Discuss Pine Tree Road Agreement Supervisor Engman explained that there were still concerns from the County and Cornell regarding the agreement and it was withdrawn . TB RESOLUTION NO . 2010- 113 : Authorization to Enter into an Encroachment License between Stephen Lucente and the Town of Ithaca Regarding 10 Sanctuary Drive Sewer Easement WHEREAS, Stephen Lucente (Owner) is the owner in fee simple absolute of a parcel of land with improvements thereon in the Town of Ithaca , County of Tompkins , State of New York, commonly known and designated as 10 Sanctuary Drive , Ithaca , New York , Tax Parcel No . 73- 1 -9 . 8 (the " Premises") , as more particularly described in the following two deeds to Owner: ( 1 ) from Margie L . The Town has no mechanism in place for issuing such permits ; no fee schedule , forms , paperwork, tracking , or policy . The Town has permitted public displays such as the Ithaca College 4th of July display, but up to this point , private displays were not allowed . Discussion followed . Upon motion by Councilman DePaolo and seconded by Councilman Goodman , the Board moved into closed session to seek the advice of Counsel at 8 : 01 p . m . Unanimous . Upon motion by Councilman DePaolo and seconded by Councilwoman Hunter, the Board returned to open session . Unanimous Councilman DePaolo moved and Supervisor Engman seconded the draft resolution for discussion . The Board discussed which committee the topic should be referred to in order to start the process of developing a mechanism for permitting firework displays . Supervisor Engman noted that the question the Board needed to answer was whether or not they wanted to allow private displays . When considering that , there could be places that could have numerous displays , which would disturb a wide range of neighbors . The displays do not fall under the Town 's noise or light ordinances . The wording of the new law was discussed and Mr. Bates noted that the last fireworks display permit for Ithaca College took over 40 hours of research and inspection time , some of which was on the weekend . The cost to the Town for display permits is pretty big . Councilman Levine moved an amendment to the resolution , adding that the issue be sent to the Codes & Ordinances Committee for review and a recommendation to the Board . Seconded by Councilwoman Riha . Motion passed 4 to 1 with Mr. Engman voting no and Ms . Hunter abstaining . TB RESOLUTION NO . 2010- 114 : SUSPENSION OF THE CODE ENFORCEMENT DEPARTMENT' S AUTHORITY TO ISSUE PERMITS FOR FIREWORKS, PURSUANT TO NEW YORK PENAL LAW SECTION 405 .00 WHEREAS , the New York Legislature passed an amendment to New York Penal Law Section 405 . 00 , effective October 4 , 2009 , to allow private displays of fireworks ; TB 6-7-2010 Page 14 of 19 WHEREAS , Penal Law Section 405 . 00 previously only allowed the public display of fireworks ; WHEREAS , the Code Enforcement Department became aware of the change in Penal Law Section 405 . 00 in March of 2010 ; WHEREAS , under Penal Law Section 405 . 00 ( 1 ) the Town Board has the authority to appoint who may approve applications and issue permits for the display of fireworks , and WHEREAS , the Town does not have a policy, procedure , forms , inspection criteria , or fee schedule in place to deal with the change in law allowing for the private display of fireworks ; NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca does hereby suspend the Code Enforcement Department's authority to issue permits for fireworks and instructs the Director of Code Enforcement to ensure that no fireworks permits are issued until further direction from the Board , and FURTHER RESOLVED , that the issue be referred to the Codes and Ordinances committee for review and recommendation to the Town Board . Terwilliger added that she had researched the topic and spoken with Mr. Carvill , who explained that since the Town does a line- item budget , and this was identified and budgeted for in the adopted budget , that is the crucial point . If the piece of equipment comes in at or under budget , the Board has already in essence approved it through the budget process . Ms . Brock asked Mrs . Terwilliger to forward the research to her. TB RESOLUTION NO . 2010 — 117 Approval of Specifications and Authorization to Solicit Bids for the Purchase of a Rear Mounted Boom Mower . Fracking Moratorium Supervisor Engman received a request for a letter of support for a bill that is going to be introduced in the legislature . Councilwoman Riha knew about it also , and added that the moratorium is just until the EPA finishes its study. Ms . Riha stated that she felt the EPA is a separate issue and she would rather the moratorium was until the State got all their rules and regulations and inspections and the like finished . Parks, Trails, and Preserves: ■ South Hill Recreation Way was prepared for the 5 / 10K race. ■ Completed putting in drainage at the Warren Road Walkway. ■ Site checks and mowing. ■ Salem Park playground construction started back up for the year. Water: ♦ Hydrant and valve maintenance was performed. ♦ PRV Tour with Bolton Point was completed. ♦ Removed a tree at the Cliff Street water pump station. ♦ There were three water main breaks in the Penny Lane area. ♦ Lawn repairs done on water main repair sites from the winter Sewer: ► Weekly pump station checks were performed . ► Dig Safely New York mark outs were performed. Engineering: 4 Inspected 30 weekly simple SWPPPs. -4 Managed ten full SWPPPs. A Development review on various projects. Traffic counts have been conducted on various roads . I produced the first edition to create a prototype for Ithaca College Summer Intern Lauren Boardman. Lauren will be working with me and supervising a youth program at the garden location this summer. One of the activities will be producing the newsletter for the gardeners . Linderman Creek is providing space in one of their community rooms for indoor activities and we will be coordinating with urban 4-H who will also being doing a program there one week in July. At this point it appears summer activities will cumulate with an open house in August that you will all be invited too . Words can ' t convey the ' beauty of the spot or the care the gardeners are putting into it you really must just drop in some time and witness for yourselves . While the month of May was very steady for inquiries, interviews and placements for youth seeking employment opportunities contacts were 67 as opposed to last year that ended the month at 92. As reported to the Operations committee last year there was funding for 172 slots from all sources while this year at this point only funding for only 32 is guaranteed. While additional funding may still be appropriated I am using more caution with youth as network partners still have no idea how much or when funding might be allocated. The YES (city expanded equivalent program) has experienced a dramatic increase in contacts and is functioning as outreach for the Town ' s program. As a result some of the 67 would qualify for state/federal funding but are being accepted into the town ' s program to assure a placement. There maybe a last minute reshuffling but it can not be avoided under the circumstances . County Youth Services in its planning response to cuts in Municipal Jobs money has continued to meet with program partners to try and build alternatives for youth. Government regulations make it extremely difficult to hire 14 & 15 year olds even though many of them are highly motivated to work. The lesson is even small innocuous seeming cuts can have huge impacts on effective programs that save the broader community money in the long run . Youth employment provides effective opportunities and outcomes to sites , individuals and families . As part of my ongoing responsibilities to coordinate activity to prevent duplication of service and to provide information to a wide variety of community inquiry as time permits I attend community meetings around issues of wellness , community building and aging. The community garden effort is part of a local health and food security effort. This group provides a vision for healthy communities and how local government can engage with its citizens to meet that vision . Material from the Safe Routes to School program also provides insight on how elements such as sidewalks are essential to the development of healthy communities . I identify substantive information and often provide it Herb for discussion in the appropriate forums . Some of these cutting edge practices maybe appropriate for Ithaca in a time of balancing resources . Challenges with delivery of the Student Work Initiative this year lead me to attend a human Service Coalition Forum on the county budget. I gave handouts of material to both Herb & Al as it obvious there will be impacts . While I support the idea that the policy makers describe a vision and service providers work together to determine how they best meet the vision it appears the old competition model will continue with groups who can mount the most effective appeal will prevail which is not necessarily the same as the most effective programs . Recent articles in the paper about the local economy may provide glimmers of light but economic consequences of the state budget will be felt into the foreseeable future. There will be continued cuts to services and it remains to be seen the impacts on families and children. Consistent with all of this was the presentation by a professor of food science at Lifelong ' s annual luncheon & meeting I attended on May 20, 2010 who spoke on all of the conditions that affect world hunger. The program was very informative and mirrored other forums that talk about creating a culture around food with the return of the "Victory Garden" concept to improve the quality of food and people ' s health. I also actively participated in planning for GIAC Friday Night programming for teens and County Youth Services planning including a meeting with New Roots principal Tina Nilsen- Hodges . This change in type and configuration has eliminated the sporadic outages that staff and board members had been experiencing . A new password is required to access the network. An email was sent to board members about this password , but see Lisa if you need assistance . Additional • 2011 Town Budget worksheets were passed out to Department Heads and will be returned completed to the Town Budget Officer by the end of ithe month . The proposal involves paving the existing stone trail and installing new 12 foot high walkway lighting along the trail. The project also includes placing a 14 ' x 32 ' pre-fabricated storage building near the trail to store seasonal items for the adjacent athletic fields and Circle Apartments . The proposal involves an outline of upgrades to the facility planned for the next five years . CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following have been accomplished over the past month. 2 Ly r r 2 MMM Codes and Ordinances Committee (COQ : The Committee met on May 19, 2010 and completed review of the proposed Stream Setback Law, and discussed possible revisions to the Sign Law (Chapter 221 Town of Ithaca Code) . Staff will work on further modifications to the stream setback map prior to advancing the draft regulations . The next COC meeting is scheduled for June 16 , 2010 at 7 : 00 p.m. Tentative agenda items include continuation of review of amendments to the Sign Law (Chapter 221 of the Town of Ithaca Code), review of comments received regarding proposed amendments to the Conservation Zone, review of proposed Limited Historic Commercial Zone, and possible discussion regarding affordable housing provisions . Planning Committee: The Committee met on May 13 , 2010 to continue discussion regarding the proposed Conifer/Cornell proposal on Route 96, and reviewed the draft Limited Historic Commercial Zone prepared by Planning staff. The Committee voted to recommend to the Town Board to pursue the establishment of a Planned Development Zone on the entire Cornell site to accommodate the proposed development. The Committee also voted to send the draft Limited Historic Commercial Zone (with minor revisions discussed at the meeting) to the Codes and Ordinances Committee for their review and to request that Susan Brock review the draft. The next meeting is scheduled for June 10, 2010. Possible agenda items include discussion regarding the Ithaca Beer Co. proposal, continuation of discussion regarding the proposed Conifer/Cornell proposal on Route 96, and follow-up discussion on the Vine Street development proposal and PDZ. Comprehensive Plan Committee: The Committee held its second Public Information Meeting on May 11 , 2010 . Although attendance was low (approximately five residents and three institutional representatives), the Committee received some interesting comments on the Comp Plan update process. The Committee met at its regular meeting on May 27 , 2010. The Committee heard a presentation by the Ithaca Downtown Alliance regarding its Strategic Plan update, discussed plans for follow-up meetings with neighborhoods in areas around the Town, and had a quick discussion about the May 11th Public Information Meeting. The next meeting of the Committee is scheduled for Tuesday, June 8`i', 2010 at 6 : 30 p.m. to continue a map exercise and discussions regarding growth and development in the Town, and review draft Plan section on demographics and housing. The first neighborhood area meeting (South Hill) is scheduled for Wednesday, June 9, 2010 at 7 :00 p.m. in the Campus Center at Ithaca College. Conservation Board: The next regular meeting of the Conservation Board is scheduled for June 10, 2010 (re-scheduled from the regular meeting date of June P). The Board hopes to finalize recommendations and comments on proposed Conservation Zone amendments . The Board is also scheduling a swallow-wort pulling at the Town' s water tank off of Teton Court in the Deer Run subdivision on June 10`h at 10 AM. Trail Committee: The Committee met on May 13 , 2010 and heard a Cornell student presentation regarding their project that evaluated the possible extension of the South Hill Recreation Way into Caroline. The Committee will meet again in June (date to be determined) to discuss possible strategies for West Hill trail connections into the City. Agriculture Plan: The client committee met on May 12, 2010 and reviewed a revised table of contents and draft sections of the Agricultural and Farmland Protection Plan. The next meeting is scheduled for June 3 , 2010 to review a revised Agricultural Profile of the Town. 3 a , w wn a It s tng ` r �c o , fepa r lee TOW 5'& g Reel ITCTC : The ITCTC (Ithaca-Tompkins County Transportation Council) Planning Committee held a special meeting on May 10, 2010 to continue discussion regarding the draft 2011 -2015 TIP Update. The Planning Committee recommended approval of a TIP Update that includes Federal funding for the Hanshaw Road walkway extension from Salem Drive to Sapsucker Woods Road (so the entire walkway now includes Federal funding), additional Federal funds for the overall Hanshaw Road Reconstruction project to cover increased costs , a safety project around the Coddington Road/Burns Road intersection to improve sight distance and vertical alignment, and Lake Street Bridge Rehabilitation project in the City of Ithaca. The ITCTC Policy Committee met on May 18 , 2010 and approved the 2011 -2015 TIP Update described above. Stormwater Annual Report for 2009-2010 : Planning staff completed the Stormwater Annual Report for the 2009-2010 reporting period. This is the annual update and report that is required to be filed with NYS Department of Environmental Conservation each year under the SPDES general permit. The report will be available for public review and comment and will be presented to the Town Board at the June 7th meeting. Summer Planning Intern: Meghan Jacquet started working with the Planning Department as a summer intern on May 11th, 2010.
