Agenda Item 4 : 35 Public Hearing regarding a proposed water improvement. Ridgecrest Road Water Tank Project a . Consider approval Supervisor Engman opened the public hearing at 4 : 35 p . m . There was no one present to comment on the item . Mr. Weber passed out three documents , the Engineer's Report , the NYS Department of Health memo and a map showing where the tank is located . He also had a map showing where the service area is . He stated that the specifications have been on file with the Town Clerk, Councilwoman Riha asked where people will get their water from during the project and Mr. Weber responded that there will be no interruption in services . Supervisor Engman closed the public hearing at 4 : 38p . m . Motion was moved and seconded . TB RESOLUTION NO . 2010-100 : Authorizing and Establishing the Town of Ithaca Ridgecrest Water Tank Improvement. WHEREAS , a plan , report and map , including an estimate of cost , have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Ithaca , Tompkins County, New York , relating to the creation and construction , pursuant to Article 12 -C of the Town Law, of [water][sewer] system improvements to be known and identified as the Town of Ithaca Ridgecrest Water Tank Improvement , and hereinafter also referred to as the " Improvement, " to provide such water Improvement including extensions , to the present Town water improvement , such water system Improvement to be constructed and owned by the Town of Ithaca , and WHEREAS , after said plan , report and map , including estimate of cost , were prepared by a competent engineer, duly licensed by the state of New York, and filed in the office of the Town Clerk, the said Town Board did , on May 4th 2010 duly adopt an Order reciting the proposed Improvement , a description of the boundaries of the proposed benefited area , the maximum amount proposed to be expended for the Improvement , the proposed method of apportioning the costs of such Improvement , the proposed method of financing to be employed , the fact that a plan , map and report describing the same are on file in the Town Clerk's office for public inspection , and TB 5-24-2010 Page 2 of 13 specifying that said Town Board shall meet at the Town Hall , 215 North Tioga Street , in Ithaca , New York , in said Town , on the 24th day of May, 2010 at 5 : 35 PM Prevailing Time , for the purposes of conducting a public hearing on such proposal to provide said Improvement , and to hear all persons interested in the subject thereof concerning the same , and WHEREAS , copies of said Order were duly published and posted according to law, and said Town Board did , at the time and place specified in said Order, duly meet and consider such proposal and held a public hearing in which it heard all persons interested in the subject thereof , who appeared at such time and place , concerning the same , and WHEREAS , the Town Board now desires to authorize the Improvement based on the evidence offered at such time and place , and WHEREAS , at its regular meeting on May 24th , 2010 the Town Board determined construction and implementation of the Improvement , which is an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act , will not result in any significant adverse environmental effects ; NOW , THEREFORE , BE IT RESOLVED , by the Town Board that it be and hereby is determined as follows : ( 1 ) The notice of hearing was published and posted as required by law and is otherwise sufficient . (2) That all of the property within the proposed benefited area is benefited by the proposed Improvement. (3) That all of the property benefited is included within the proposed benefited area . (4) That the proposed method of apportioning the costs of the Improvement should not be changed . (5) It is in the public interest to authorize , establish , and make the Town of Ithaca Ridgecrest Water Tank Improvement as hereinafter described , and be it FURTHER RESOLVED , that the Town Board does hereby approve , authorize and establish the Town of Ithaca Ridgecrest Water Tank Improvement in the area of the Town described as follows and as more particularly shown and described in said plan , report and map presently on file in the office of the Town Clerk : Relining of the interior of the Ridgecrest Road water tank , which is a 500 , 000 gallon steel tank located on Ridgecrest Road . The work will require the removal of the existing coating on the inside walls of the tank to bare metal . The new coating will be a 2 coat epoxy system to be TB 5-24-2010 Page 3 of 13 placed in accordance with ANSI and AWWA standards to a thickness of 8 millimeters , and , and be it FURTHER RESOLVED , that the area hereby determined to be benefited by said Town of Ithaca Ridgecrest Water Tank Improvement is all of that portion of the Town outside of the Village of Cayuga Heights , and be it FURTHER RESOLVED , that all of the allocable costs of said Improvement shall be borne wholly by property within the Town of Ithaca water improvement benefited area , being the entire area of the Town outside of the Village of Cayuga Heights , and be it FURTHER RESOLVED , that the maximum proposed to be expended by the Town of Ithaca for the Improvement , including costs of rights of way, construction costs , legal fees and other expenses , is $ 150 , 000 . 00 , expenditure of current revenues and surplus funds from the Town of Ithaca water system benefited area , and be it FURTHER RESOLVED , that this resolution is subject to a permissive referendum in the manner provided in Town Law Article 7 and Town Law Section 209-q , and be it FURTHER RESOLVED , that the estimated expense of the aforesaid Improvement does not exceed one-tenth of one per cent of the full valuation of the taxable real property in the area of said Town outside of villages and , therefore , in accordance with the provisions of subdivision 13 (a) of Section 209-q of the Town Law, the permission of the State Comptroller is not required for such improvement . FURTHER RESOLVED , that pursuant to subdivision 6 (d) of Section 209-q of the Town Law, the Town Clerk is hereby directed and ordered to cause a certified copy of this Order to be duly recorded within ten days of the date of adoption in the Office of the Clerk of the County of Tompkins , which when so recorded , shall be presumptive evidence of the regularity of the proceedings and action taken by the Town Board in relation to the aforesaid improvement . MOVED : Councilwoman Susan Riha SECONDED : Councilman Eric Levine VOTE : Ayes : Engman , Riha , Goodman , Levine , Leary and DePaolo Nays : None Absent : Hunter Agenda Item Report of Town Officials Verizon Cell Tower — Supervisor Engman explained that Mr. Weber has been approached by Verizon about a possible cell tower at the Trumansburg Road water tank property. TB 5-24-2010 Page 4 of 13 Mr. Weber explained that he was approached about a possible co- location on the Trumansburg Rd water tank and after Verizon looked at it , they decided that it was not high enough and then asked if the Town would be interested in allowing them to build a cell tower on the property. The property is just to the south of Hayts and Hopkins Roads . Mr. Weber noted that having it on town property would not exempt them from the planning process and there would be compensation . They have stated around $ 1 , 200 a month but he has heard that is very low. The Board discussed the views from the site and Supervisor Engman noted that the last two towers that went up have not received much comment and seem to be less intrusive than we thought they would be . Mr. Weber noted that there are fewer trees on this site and there is adequate land available . Discussion followed . The Board indicated that Mr. Weber should indicate that the Board is interested in hearing more details and did not dismiss the idea . Jointly Owned Interceptors Mr. Weber had a map of the interceptors and gave a little background . The map identified the different contributing areas that discharge into the City of Ithaca . There are about 10 areas that tie in and we have an agreement with the City that we will contribute about 42 % of the costs for maintenance/repairs/upgrades . The agreement identified certain streets and meter pits and theoretically they are supposed to measure the flow, but , these meters have not been functioning . The City has hired someone to look into making them work , but for now, they are not and have not for a while . Mr. Weber stated that we are not near our maximum capacity of 42 % . There are two interceptors that are up for maintenance/repairs ; Hector St and the Columbia St Bridge . It is the City's responsibility to maintain and then bill us a portion . We are going to continue to see improvements put forth by the City and we need to have the meter information to know if we are truly culpable for the amounts charged . Also , with the Comprehensive Plan being revised , depending on where we want development , we could shift our percentages to other sections and thus our rate of participation at different locations . For example ; if location A only receives 15% from the Town but section B receives 55% , we could shift the unused percentages from one location to another. Discussion followed . Mr. Weber stated that this is prep work for long-term planning for capital projects and funding . He felt the information is important to have in negotiating with the City and approving or considering the repairs and upgrades . If the City wants to put an 8" line in when only a 6" may be needed , this information would help in the discussions with the City as to our fair share of the expense . The SEAR process was discussed . Road Preservation Law and Road Use Agreement Supervisor Engman gave a handout provided by a firm called DELTA . TCCOG is working on a Road Preservation Law to protect municipalities from the cost of repairs to roads damaged by construction and/or heavy equipment traffic . If municipalities sign up DELTA would provide baseline data and subsequent evaluations of damage . Some municipalities are already signing with them , and others are exploring their options . There is strength in numbers if the town goes with DELTA . He asked Mr. Weber to give TB 5-24-2010 Page 5 of 13 his point of view. Mr. Weber added that the Town has very. few town roads that would incur this kind of damage because most of the main roads are either county or state owned . He also stated that his department could do the baseline studies . Supervisor Engman outlined the costs for legal work and staff time . This is a first- look for the Board and there will be other conversations and pros and cons to look at in the near future . The Town is close to a final draft of the TCCOG -coordinated Road Excavation (or Construction ) Law which is different . The preservation law is to recoup costs of damage to the roads , the road excavation law is to regulate [and define the use] work affecting roads such as pipeline crossings and culvert installation for access roads . Agenda Item Report from Town Committees Budget Committee — Councilman Levine reported that they are meeting on Wednesday and will be working on an asset inventory and that budget worksheets will go out to department heads next week . Supervisor Engman added that he has contacted the company suggested by Councilwoman Hunter and they will come in and give a presentation on asset inventories . Councilwoman Hunter suggested Bolton Point , Southern Cayuga Lake Intermunicipal Water Commission and the City of Ithaca Fire Department also be invited to the presentation . Personnel Committee — Councilwoman Hunter reported that they are working on the tuition reimbursement program the town offers and gave the background . The general sense is that we are open to considering increasing the amount provided , it is $400 a semester now, but there are other ideas being discussed as well as where the money will be in the budget and finally, if it can be funded . The Committee is also still looking at elected officials ' salaries . Results from the questionnaire sent to other municipalities have been tabulated and an average and mean taken . Discussions are ongoing . Planning Committee — Councilwoman Riha reported that they are recommending the Board comment on the Planned Development Zone for the Cornell property being proposed for development by Conifer Realty. There was a lot of discussion on the process for a planned development zone and the different SEQR's . Mr. Kanter summarized the questions the committee (s) need answered as a) Does the Board like the general concept and b) Is a planned development zone the appropriate process to implement it? The discussion will continue at the regular Town Board meeting in June . Public Works Committee — Councilman DePaolo reported that they are meeting Tuesday and will discuss the road excavation law and road preservation law and the potential of Helen 's Way planting which would replace plantings that were removed during a town project to fix a drainage problem and they will also look at the individual looking for financial help for college and his proposed thesis and how it would tie in with the job . Operations Committee — Supervisor Engman reported that the State has changed the law on fireworks ; the change is significant in that anyone who has a license can now put on fireworks displays and there is no difference between public and private displays . The Town has to issue a permit or designate the responsible agency. The basic TB 5-24-2010 Page 6 of 13 question is whether or not the Town wants fireworks at all . If we do , then we head one way, if we do not , then we go another way in establishing a law to facilitate this . There can be no difference between public and private , if they are permitted , we can not differentiate . Councilman Levine noted that other municipalities have their fire departments issue the permits . Mr. Bates responded that it is different in the Town because we do not have our own fire department and there would be a cost involved and given the contract negotiations , that might not be feasible and there is also a legal question on whether or not that is legal . Supervisor Engman also reported that the court had a review by the state and they are concerned about the lack of lighting in the parking lot . The up side is there may be grant money from the court system to help fix the lights . The striping of the lot is being coordinated and scheduled by Mr. Weber. Also , a quote was received from the HVAC company to help with the heating problem in the Town Clerk's office . Discussion followed and Mr. Carvill thought there was money in the budget to pay for it . Codes and Ordinances Committee — Councilman Goodman reported that the draft of the stream setback law is almost ready. The map needs to be revised but they are going to send the language to the next step without the map . They also started the review of the sign ordinance . Supervisor Engman added that the Agricultural Committee is concerned about seasonal signs and the Committee should look at those carefully. The Committee was also asked to look at how garages are measured and setback requirements etc . in the Code because the Code Department gets a lot of questions and concerns about that. Comprehensive Plan Committee — Supervisor Engmah reported that the public meeting was not as well attended as was hoped for. Individuals did speak and gave comments the Committee is not used to hearing , which was good to get a different perspective . Comments such as "do away with zoning" and " let private enterprise test the market . " This was certainly not the only public meeting though . Comp Plan Com members will be doing neighborhood meetings and it has been decided that members will not attend their own neighborhood meeting as the moderator. Councilwoman Hunter and Dianne Conneman are meeting tomorrow to discuss the schedule and advertising them Trails & Parks Committee — Councilman Goodman reported that there was a presentation by some CU students on a project they did about the extending the South Hill Recreation Way out to Caroline . The next meeting they will get back to West Hill trails . Supervisor Engman reported that he had made a request to one of our congressional delegates regarding the Gateway trail easement needed across the Emerson property and it did not work. Corporate headquarters at Emerson stated that they did not want any encumbrances that might inhibit the sale of the property so they are not willing to discuss the small portion of the trail that goes through their property. TB 5-24-2010 Page 7 of 13 The good news is that all employees are eligible for retraining/ education through a federal program . Intermunicipal Organizations Watershed Group Councilwoman Leary reported that they were interested in passing a resolution of concern regarding hydrofracking . Councilman DePaolo is preparing a draft . TCCOG — Supervisor Engman reported that they are working on the Road Excavation Law, the Health Consortium , a Cell Tower ordinance and the need for a dog census to help figure out the real costs for dog control for each municipality. ITCTC — Supervisor Engman reported that the policy group accepted the 5 year plan put forth by the planning group . He did not recall the Hanshaw sidewalk being mentioned specifically, but Mr. Kanter said the details were in the 5 year plan , so if that was approved , the Town funds are in there . Aqenda ,Item Consider Appointment of Planning Board Member Supervisor Engman reported that the interview committee is recommending John Beach and the other applicant is looking at the ZBA as well as another person who is looking at other committees such as the Conservation Board , TB RESOLUTION NO . 2010 — 101 : APPOINTMENT OF PLANNING BOARD . MEMBER WHEREAS , a vacancy exists on the Planning Board due to the appointment of Susan Riha to the Town Board ; and WHEREAS , an interview committee interviewed the 2 interested individuals and recommends the appointment of John Beach of 175B Snyder Hill Road ; now therefore be it RESOLVED , that the governing Board of the Town of Ithaca hereby appoints John Beach of 175B Snyder Hill Road , Ithaca, New York, as the member to the Planning Board to fill a currently running seven year term beginning May 24 , 2010 and ending December 31 , 2013 , MOVED : Councilman Goodman SECONDED : Councilwoman Leary VOTE : Ayes : Engman , Riha , Goodman , Levine , Leary and Hunter Nays : None Absent : DePaolo Passed unanimously. Drake reported on the interview process . Discussion followed regarding the fee schedule for Code Enforcement and the fact that retirement costs should be factored in to the total cost . TB RESOLUTION NO . 2010 — 102 : Provisional Appointment to the Electrical / Code Enforcement Officer position. WHEREAS , there is presently a vacancy in the full time position of Electrical / Code Enforcement Officer in the Code Enforcement Department , and WHEREAS , the Director of Code Enforcement and Human Resources Manager interviewed 5 candidates through the solicitation process as there was not a certified eligible listing available from Tompkins County Civil Service , and WHEREAS , the said individuals have determined that Charles Bruner possess the necessary knowledge and skills to satisfactorily perform the duties of the said position , and WHEREAS , Mr. Bruner has been serving in a temporary appointment to the said title since April 5 , 2010 , and WHEREAS , the said position will be appointed provisionally, therefore , the appointee will need to be one of the top three reachable candidates from the next civil service exam for the said position ; now therefore be it RESOLVED , the Town Board of the Town of Ithaca does hereby approve the provisional appointment of Charles Bruner as the Electrical / Code Enforcement Officer for the Code Enforcement Department , effective Monday, June 7 , 2010 , and be it further RESOLVED , this is a 30 hours a week position , at the hourly wage of $21 . 50 , which is an estimated annual salary of $33 , 540 , from account number B8010 . 100 , in Job Classification "N" , with benefits , and be it further RESOLVED , the said appointment is a provisional appointment pending the results from the next civil service exam for this position . Consider approval of budget amendment for appointment TB RESOLUTION NO. 2010 — 103 : BUDGET AMENDMENT TO ESTABLISH FUNDING FOR THE POSITION OF AN " ELECTRICAL & CODE ENFORCEMENT OFFICER " WHEREAS : At the February 22 , 2010 Town Board meeting , the Town Board created the " Electrical & Code Enforcement Officer" position in the General Part Town ( B) Fund , and WHEREAS : The 2010 General Part Town Fund ( B) budget does not reflect budgeted funding to support the newly created position , and WHEREAS : The Human Resources Manager and Director of Code Enforcement provided the Town Budget Officer with revenue and expense figures to meet the salary and fringe benefits of the "Electrical & Code Enforcement Officer position , and WHEREAS : The Town Budget Officer seeks the approval and authorization from the Town Board to amend the 2010 General Part Town ( B) Fund Budget, Now therefore be it RESOLVED : That the Town Board approves , directs and authorizes the Town Supervisor and the Town Budget Officer to record the appropriate budgetary amendments for funding the " Electrical & Code Enforcement Officer position . Drake responded and detailed the Civil Service requirements and comments on the job description . TB RESOLUTION NO . 2010 — 104 : Creation of a Civil Service Classification : Sustainability Planner WHEREAS , the Town of Ithaca established compliance under the New York State Civil Service Agency to qualify employment positions in the Town of Ithaca in accordance with Section 22 of Civil Service Laws , Rules and Regulations ; and WHEREAS , by regulation of Civil Service Law the Town must create a position and approve the job description before making an appointment ; and WHEREAS , the Town has determined the appropriate position desired is a Sustainability Planner; Now, therefore , be it RESOLVED , the Town Board of the Town of Ithaca does hereby establish the following position in accordance with the applicable New York State and Tompkins County Civil Service rules : 1 . The following position is established and is a position in the competitive class pursuant to Section 44 of the Civil Service Law: (a) (One) — Sustainability Planner And be it further RESOLVED , the Town Board does hereby approve the attached job description for the said position ; and be it further RESOLVED , the Human Resources Manager is directed to coordinate any necessary filing with Tompkins County Personnel Department to obtain certification of the position . The delay is due to State oversight and the weather and there will be very limited additional time spent by Codes . TB RESOLUTION NO , 2010- 105 : CONSIDER SETTING A PUBLIC HEARING TO HEAR COMMENTS REGARDING REFUNDING THE TEMPORARY CERTIFICATE OF OCCUPANCY FEE TO LONGVIEW/ITHACARE PURSUANT TO TOWN OF ITHACA CODE , CHAPTER 125 , TITLED, BUILDING CONSTRUCTION AND FIRE PREVENTION , SEC. 125-7 13(9) (a) [21 [a-el , WHEREAS , a request for a refund of the Temporary Certificate of Occupancy fee paid by Longview/Ithacare on May 11 , 2010 pursuant to Town of Ithaca Code , Chapter 125 , Titled , Building Construction and Fire Prevention , Sec . 125-7 B (9) (a) [2] [a-e] , has been submitted to the Town by Longview, and WHEREAS , the reasons necessitating a Temporary Certificate of Occupancy are minor and largely due to weather, and WHEREAS , the Director of Code Enforcement has stated that the additional Staff time to close the permit will be minimal , NOW THEREFORE BE IT RESOLVED , that the governing body of the Town of Ithaca does hereby set a public hearing to be held at their regular meeting on June 7 , 2010 at 5 :40p . m . to hear public comments on the request . Respectf submitted , Paulette Terwilliger Town Clerk i 11 W �,�P wirel ess Network Engineering 132 Creek Circle East Syracuse, New York 13057 HAYT CORNERS COMMUNICATIONS FACILITY TOWN OF ITHACA , TOMPKINS COUNTY , NEW YORK Hayt Corners Communications Facility The purpose of the Hayt Corners communications facility is to provide adequate and safe hand-held telephone service to Rt. 96 from DT Ithaca to Trumansburg , Rt. 79 heading west out of Ithaca, Sheffield Rd . from Rt. 79 to Rt. 96 , Duboise Rd . from Rt. 96 to north of Perry City Rd , sections of Perry City Rd . , Glenwood Heights Rd . , Iradell Rd . , Garrett Rd . , Wilkins Rd . , The Cayuga Medical Center Complex and Rt. 34 and the housing areas on the south side of Cayuga Lakes and handoff to our existing Ithaca, Ithaca DT and Trumansburg cell sites . Coverage to this area ( if any) currently originates from Verizon Wireless' existing communications facility called Ithaca DT and Ithaca. Due to increasing demand and changes in mobile telecommunications technology, this service is sporadic at best. To provide a dominant (i . e . , continuous) level of advanced third-generation (3G ) 850 and PCS voice and EVDO communications service to this area , construction of a new, locally-based communications facility is required .
