' Monday , February 22 , 2010 at 4 : 30 p . m .
Final Minutes
Call to Order -- Meeting was called to order at 4 : 35p . m . Board Member Riha and Judy
Drake were absent .
Agenda Item : Report from Community Science Institute — Steve Penningroth
( See Attachment # 1 )
Steve Pennigroth from the Community Science Institute gave a presentation on the
research and testing that they have done over the past 3 years . The Town funds a
portion of the research . He went over how the testing is done , and what it tells them .
He stated that he was not used to looking at data for policy setting guidelines , but he did
try to look at it that way and give the Board data that they could use as a base of
knowledge from which to start .
The Board had questions about the training and process involved in taking the samples
and asked what they could do to limit the levels . Mr. Pennigroth did say that a huge
contributor is agriculture , lawns , golf courses , and sport fields as far as phosphorus
levels and that limiting those pollutants would help . He also discussed sedimentation
levels and stated that Ithaca is a natural wetland and what is happening is that the land
is trying to convert itself back to wetland naturally . There are options to control this ,
such as the Stream Setback Law and dredging , but he did not want to state a policy
recommendation . Discussion followed .
Agenda Item : Consider guidelines for MOU and Conservation Easement
re : Northeast
Supervisor Engman gave a brief update on the issue and reported that at the Planning
Committee Meeting , it was requested that Board Members who had ideas on what
should be in the MOU should submit them to Jonathan and that they would be compiled
and discussed at the Town Board meeting . The idea is to put together a negotiating
team to meet with Cornell and Briarwood II representatives regarding the conservation
easement . Supervisor Engman added that the Town Board is not making a decision
because of threats of being sued . He stated that the Town gets threats all the time and
that what the Town is trying to do is protect that which is valuable while allowing
development if it is feasible . Discussion followed regarding who would be on Ahe
negotiating team and the need for parameters . The need for good communication
between the team and the Board was emphasized .
Supervisor Engman moved to establish a negotiating team and Councilwoman Leary
seconded . Discussion followed on exactly who would be on the team and why. The
issue was what the parameters would be , and it was discussed that the negotiating
team would develop these and bring them back to the full Board for approval , whether

that approval was unanimous or not . The motion was approved to set up a negotiating
team to begin developing a very clear map of what areas are to be considered for the
conservation easement which would be brought back to the Board . The Board would
meet at the end of this meeting in Executive Session with Counsel to discuss the
acquisition of real property , which may give more parameters for the Team to use .
Agenda Item : Report from Town Supervisor and Town Officials
Supervisor Engman summarized his written report . There was some discussion on the
billing issue with the Town of Ulysses .
Update - County Treatment Capacities for Water & Wastewater - J . Weber
Jim Weber gave a summary on the TG Miller 15 -year update report . Mr. Weber said
there were no surprises in the report . The County will be giving a presentation at the
Public Library on March 4 th
Town Clerk's Office Remodeling
Paulette Terwilliger distributed a plan for the remodeling of the Town Clerk's office to
make it more user friendly and welcoming to the public .
Agenda Item : Report from Town Committees
Budget -- Meeting Wednesday
Personnel — Discussed the Code position
Planning — Setting priorities , revisiting Scenic Viewsheds
Public Works — Changed meeting time to 10 : 30 and Staff will be asked to come only if
their area of expertise is needed , so there are fewer wasted staff hours .
Operations — Looking into changing the Property Maintenance Law for better
enforcement mechanism .
Codes and Ordinances — Supervisor Engman reported TCCOG progress with the gas
drilling issue and local laws
Comprehensive Plan — Review of 1993 Plan is done and meetings are now going to be
held twice a month instead of breaking off into smaller committees .

Health Consortium — Ms . Drake was absent , but Supervisor Engman stated that they
are still working on the Union Representation and the changes are significant enough
that it will come back to the Board for approval
Agenda Item : Scheduling of SAC Meetings
There was discussion regarding the Board 's wish to attend SAC meetings , but that the
time does not work for them . It was decided that the Agenda Setting SAC would be
moved to 3 : 30 prior to the Town Board Study Sessions and the newspaper would be
notified of this change and the possibility of a quorum being present .

Agenda Item : Consider Approval of an Electrical/Code Enforcement Officer
Position
Councilwoman Hunter asked that in the future , a more complete financial impact be
given such as retirement costs , etc .
TB RESOLUTION NO . 2010-050 : Creation Civil Service Classification : Electrical &
Code Enforcement Officer
WHEREAS , the Town of Ithaca established compliance under the New York
State Civil Service Agency to qualify employment positions in the Town of Ithaca in
accordance with Section 22 of Civil Service Laws , Rules and Regulations ; and
WHEREAS , by regulation of Civil Service Law the Town must create a position
and approve the job description before making an appointment ; and
WHEREAS , the Town has determined the appropriate position desired is an
Electrical & Code Enforcement Officer;
Now, therefore , be it
RESOLVED , the Town Board of the Town of Ithaca does hereby establish the
following position in accordance with the applicable New York State and Tompkins
County Civil Service rules :
1 . The following position is established and is a position in the competitive class
pursuant to Section 44 of the Civil Service Law :
(a) (One) — Electrical & Code Enforcement Officer
And be it further
RESOLVED , the Town Board does hereby approve the attached job description
for the said position ; and be it further
RESOLVED , the Town Board approves the said position being in the Job
Classification "N " ; and be it further
RESOLVED , the Human Resources Manager is directed to coordinate any
necessary filing with Tompkins County Personnel Department to obtain certification of
the position .

to Prohibit. Vehicles from Standing Within 125 Feet of Either Side of the Winthrop
Drive Crosswalk Located East of Brandywine Drive
RESOLVED , that the Town Board of the Town of Ithaca hold a public hearing at the
Town Hall , 215 North Tioga Street , Ithaca , New York, on the 8th day of March , 2010 , at
6 p . m . for the purpose of considering a proposed LOCAL LAW AMENDING CHAPTER
250 OF THE TOWN OF ITHACA CODE , TITLED "VEHICLES AND TRAFFIC , " TO
PROHIBIT VEHICLES FROM STANDING WITHIN 125 FEET OF EITHER SIDE OF
THE WINTHROP DRIVE CROSSWALK LOCATED EAST OF BRANDYWINE DRIVE ;
and
FURTHER RESOLVED , that at such time and place all persons interested in the
proposed amendment may be heard concerning the same ; and
FURTHER RESOLVED , that the Town Clerk of the Town of Ithaca is hereby authorized

TOWN BOARD STUDY SESSION
FEBRUARY 22 , 2010
1 . The beginning of 2010 has been quite calm and relatively stress-free compared
with the past couple of years . That is primarily due to the completion of the major
contracts requiring negotiation : our first union contract with the Teamsters, Fire with the
City of Ithaca, Fire 2 % with the City and Village of Cayuga Heights, the Recreation
agreement with the City, the sewer plant land with the City, and the joint coal tar
litigation agreement with the City and the Town of Dryden:
I have been following up with the transfer of the sewer plant land. The 2% checks were
finally sent out, delayed by the City ' s wanting the mayor to sign rather than the fire chief.
I am currently working on the water agreement with the Town of Ulysses - we are
considering whether to recommend the addition of a two-way water meter to more
accurately measure our water sales to the Town of Ulysses . I am also following up on the
conservation easement with Ithaca College and the Finger Lakes Land Trust ,
2 . In addition to the regular Town Board issues , I have focused on :
a. Road construction and road preservation laws in anticipation of Marcellus
Shale drilling. This is in cooperation with five other TCCOG
municipalities . The Town is coordinating the payments to Guy Krogh for
the road construction law . Don Barber of Caroline is coordinating the
creation of the road preservation law with the County.
b . Inlet Valley Cemetery — we finally found the suitcase full of material from
the cemetery board of directors . The paperwork has been signed for the
official transfer and we will be developing a master plan for the cemetery.
I (and Rich DePaolo) attended the cemetery workshop at the NYS
Association of Towns training and discovered our only legal obligation is
to mow the cemetery three times per year.
3 . Routine activities include probation reviews for employees , interviews with
the media (Ithaca Journal , WHCU, the Collegian, and the Cornell Daily Sun
during the last month) , talking with walk-ins at Town Hall , responding to
constituents , approving the vouchers and checks for both the Town and Bolton
Point, signing time sheets and time-off requests, meeting with staff regarding
projects, etc .
4 . I was elected the chair of the Ithaca-Tompkins County Transportation Council
following Mayor Peterson . My first official act was to sign the budget
amendment to provide for operating funds for the organization.
5 . Anticipated priorities for the coming month : the NE situation, the
Comprehensive Plan, the Ulysses water agreement, the roads laws, a meeting
with West Hill residents to clarify fire protection, the dog census , and capital
projects planning.
