The Town of Ithaca Planning Board met in regular session on
Tuesday , April 21 , 1987 , in Town Hall , 126 East Seneca Street , Ithaca ,
New York , at 7 : 30 p . m .

Chairman May declared the meeting duly opened at 7 : 30 p . m . , and
accepted for the record the Clerk ' s Affidavit of Posting and
Publication of the Notice of Public Hearings in Town Hall and the
Ithaca Journal on April 13 , 1987 and April 16 , 1987 , respectively ,
together with the Secretary ' s Affidavit of Service by Mail of said
Notice upon the various neighbors of each of the properties under
discussion , upon each of the applicants and / or agents , as appropriate ,
upon parties with interest , and upon the Tompkins County Commissioner
of Planning , on April 15 , 1987 .
REPORT OF THE TOWN PLANNER WITH RESPECT TO THE COMMONLAND COMMUNITY
SERVICE ROAD ,
Ms . Beeners appended a map to the bulletin board and stated that
two main events have happened since the Planning Board last discussed
the matter of the Commonland Community service road , the first being
clarification by the Town Attorney as to the status of the right of
way in the alternate location , which is through the Marion property
opposite Towerview Drive . Ms . Beeners stated that it was Town
Attorney Barney ' s feeling that the descriptions and the circumstances
with respect to that right of way are adequate for the construction of
a road by the developer in that location . Ms . Beeners made reference
to a statement received , copies of which were distributed to the Board
members , from Mrs . Clausen whose two properties are separated by the
original service road location . Ms . Beeners stated that the current
recommendation. at this time is to relocate the service road to the
alternate location opposite Towerview Road and that that access road
be restricted to one -way ingress from Slaterville Road into Commonland
Community , for emergency vehicles , except as may be subsequently
amended by the Town of Ithaca , and also subject to the right of way in
the same location which is presently held by the City of Ithaca . Ms .
Beeners noted that item # 2 in the draft resolution is basically that

• the design be approved by the Town Engineer and by the Department of
Transportation . Ms . Beeners also noted that construction is to be
completed prior to the issuance of any certificates of occupancy for
Commonland Two , with placement in escrow of necessary funds for the
construction of this access road . A third condition recommended by
Ms . Beeners was that a 20 - foot easement be provided along the west
edge of the formerly approved service road location . Ms . Beeners
stated that this would be along the eastern edge of the Clausen house
property for the purpose of trail development at a later date by the
Town between Slaterville Road and Penny Lane , with the understanding
that the trail easement might be relinquished at a later date if a
more appropriate connection were to materialize somewhere along the
Six Mile Creek corridor . Ms . Beeners added that the Six Mile Creek
Committee was not in favor of the establishment of a trail in this
location between the Clausen parcels because they did not want to
encourage access to Six Mile Creek straight down , which is in an area
of the Creek that is reserved for more pasive purposes . The Committee
would prefer to be able to acquire a connection to the Six Mile Creek
and Circle Greenway trails that would be farther to the west . Ms .
Beeners stated that the reason she is recommending a 20 - foot easement
through that area at this time is just to provide for things if a
better one does not come along somewhere down the road . Indicating on
the map , Ms . Beeners said that the area would be from Slaterville Road
on down through " this " edge on the Clausen property to connect up with
the cul de sac Penny Lane and Penny Drive , Ms . Beeners noted that
pedestrian connection could occur on any potential extension of Penny
Drive to the western area where trail use is encouraged . Ms . Beeners
also noted that it would not necessarily mean that there would be an
increase in pedestrian movement into the eastern areas . Ms . Beeners
indicated that: she did not see any construction of that trail in the
near future because there are several alternatives that need to be
continually checked out by the Six Mile Creek Committee along
Slaterville Road .
Mrs . Langhans wondered about an easement going through private
property . M .; . Beeners pointed out that the Town has acquired
easements through subdivision approvals , adding that it was her
understanding , after discussions with Town Attorney Barney , that that
type of easement would be accomplishable , and that it would be
possible to :have that easement , and , if this land were somehow
acquired by Mrs . Clausen , for instance , it still could remain . Ms .
Beeners offered that in that location , adjacent to Mrs . Clausen ' s
house property , it would not impact any development on either parcel
which she owns . The 20 - foot easement would provide for adequate
buffering if the 5 - foot trail is constructed at a later time .
Mrs . Grigorov asked if this would be protected from having the
actual road there . Ms . Beeners offered that the Town would not have
any more interest in " this " piece of land [ indicating on the map ] ,
except for one potential trail connection , because the service road
alternate location would be about " here " [ again indicating on the
• map ) ,
Mr . Weisburd , developer of Commonland Community , spoke from the

a
floor and stated that there would be a Town water main on most of what
is already constructed , and a Town easement would have to remain for
the water regardless of whether there is an easement for pedestrian
traffic .
Mr . Klein. asked , if the access road were relocated , could that be
used for the trail . Ms . Beeners responded that it could be in a
location that would mean having to walk along Slaterville Road .
Mrs . Langhans wondered if the Town needs 20 feet for a water
easement , with. Mr . Flumerfelt responding , yes , that is required .
Mr . Weisburd addressed the Board and asked for clarification on
building the road on the City of Ithaca right of way which runs along
the Marion property . Mr . Weisburd wondered , if the road were built ,
would the Town then take that as a Town road even though it would be
an easement and not property deeded to the Town . Mr . Weisburd stated
that , if that were the case , he would certainly like to see it stated
for the record that the Town would do that . Chairman May stated that
he did not think the Town would be taking it as a Town road , the
Planning Board was only opening it for emergency vehicles . Town
Attorney Barney stated that it was his understanding that Mr . Weisburd
had title . Mr . Weisburd stated that he did not have title ; Mr . Marion
has title ; he [ Weisburd ] has a 60 - foot easement . Town Attorney Barney
stated that the Town would be willing to take the easement rights .
• Mr . Weisburd stated that the Town , then , would be willing to take over
the road as a restricted Town road , as opposed to deeding that land
over . Mr . Weisburd stated that it would be necessary to state , for
the record , that if the road were built they would not run into the
problem of the: Town saying , " You built it , but we need the deed . " Mr .
Weisburd pointed out that all he can do is give up the easement
rights . Mr . Weisburd also pointed out that his attorney , Peter Walsh ,
thought that their easement rights were not sufficient to reach from
Slaterville Road to Penny Lane , Mr . Weisburd stated that , while he
was happy to build the road , he did not want to be in a position where
he was liable from the Marions because he built in an area where he
did not have the rights to build .
Dr . Lesser wondered if there had been any discussion on
temporary emergency use as far as access , in terms of plowing and
keeping it open , so that it was usable in an emergency , and at the
same time preventing cars from using it on a regular basis . Ms .
Beeners stated that one item was the signage , and also there was the
possibility of using a chain and a padlock for access by the Town
highway crew . Ms . Beeners stated that this will be discussed with
John Dougherty , Superintendent of Public Works , City of Ithaca , as to
securing a pad. lock key for their maintenance use .
There appearing to be no further questions or comments , Chairman
May asked if anyone wished to make a motion .
MOTION by Mrs . Carolyn Grigorov , seconded by Dr . William Lesser :
Planning Board - 4 - April 21 , 1987
• RESOLVED , that the Town of Ithaca Planning Board approve and
hereby does approve the alternate location of the proposed Commonland
access road , such location being within a right of way presently held
by the developer through Town of Ithaca Tax Parcel No . 6 - 58 - 1 - 24 , with
the following conditions :
1 . Said access road shall be restricted to ingress by emergency
vehicles , except as may be subsequently amended by the Town of
Ithaca , and shall also be subject to the right of way in this
same location which is presently held by the City of Ithaca .
2 . The design of said access road shall be approved by the Town
Engineer and by the New York State Department of Transportation .
The construction of the access road shall be completed prior to
the issuance of any certificates of occupancy for " Commonland
Two " . Placement in escrow of the necessary funds for the
construction of this access road shall be considered an
acceptable alternative for the fulfillment of this condition .
3 . A 20 - foot: easement shall be provided along the west edge of the
former proposed access road location between Town of Ithaca Tax
Parcels No . 6 - 58 - 1 - 20 and 6 - 58 - 1 - 33 . 3 , for the purposes of
maintaining , repairing , and replacing a water line , and for the
purposes of trail development at a future date , between
Slaterville Road and Penny Lane . It is understood that such
• trail easement may be relinquished by the Town of Ithaca at a
future time , if more appropriate trail routes are obtained .
4 . The developer shall be satisfied by his legal counsel that he has
authority to convey an easement at the above -mentioned alternate
location .
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be carried unanimously .
Chairman May declared the discussion of the Commonland service
road duly closed at 7 : 50 p . m .
PUBLIC HEARING : CONSIDERATION OF APPROVAL OF PROPOSED MODIFICATIONS
TO THE APPROVED SITE PLAN ( FEBRUARY 17 , 1987 ) FOR PHASE III OF
EASTWOOD COMMONS , 66 UNITS AND PAVILION APPROVED , PROPOSED TO BE
MODIFIED TO 65 UNITS AND PAVILION . OFF HONNESS LANE ON HARWICK ROAD
AND PRESENTLY -• NAMED SUNNYSLOPE LANE , MULTIPLE RESIDENCE DISTRICT .

• Chairman May declared the Publc Hearing in the above - noted matter
duly opened at. 7 : 55 p . m . , and read aloud from the Notice of Public
Hearings as ported and published and as noted above . Mr . Schickel was
Planning Board - 5 - April 21 , 1987
. present .
Mr . Schickel addressed the Board and stated that the proposal
presented tonight is the revised Phase III , 8 . 49 acres , including
reduction of one unit from Building 32 and also revision to the
parking layout . Mr . Schickel stated that none of the parking is
within 30 feet. of the property line , adding that 66 units and pavilion
were approved on February 17th and that the proposal before the Board
this evening has been modified to 65 units and pavilion .
Chairman May noted that this was a Public Hearing and asked if
there were any questions or comments from the public . No one spoke .
Chairman May closed the Public Hearing at 8 : 05 p . m . and turned the
matter over to the Board for discussion .
Chairman May asked Mr . Schickel when construction of Harwick Road
was going to begin as it was his impression that it would be done
subsequent to Building 33 . Mr . Schickel responded that it will be
done as soon as all necessary steps are in order .
There appearing to be no further questions or comments , Chairman
May asked if anyone was prepared to offer a motion .
MOTION by Mr . Robert Kenerson , seconded by Mr . James Baker :
• WHEREAS :
1 . This action is the consideration of approval of modifications to
the Approved Site Plan ( February 17 , 1987 ) for Phase III of
Eastwood Commons , 66 units and pavilion approved , proposed to be
modified -to 65 units and pavilion .
2 . This is an Unlisted action for which the Planning Board has been
legislatively designated to act a Lead Agency ,
3 . The Town Planner has recommended a negative determination of
environmental significance , subject to the conditions and
requirements of earlier project approvals and other applicable
requirements .
THEREFORE , IT IS RESOLVED :
That the Planning Board , acting as Lead Agency in the
environmental review of this Unlisted action , make and hereby does
make a negative determination of environmental significance , subject
to the conditions and requirements of earlier project approvals and
other applicable requirements .
There being no further discussion , the Chair called for a vote .

Planning Board - 6 - April 21 , 1987
• MOTION by Mrs . Virginia Langhans , seconded by Mr . Robert
Kenerson :
WHEREAS :
1 . This action is the consideration of approval of modifications to
the Approved Site Plan ( February 17 , 1987 ) for Phase III of
Eastwood Commons , 66 units and pavilion approved , proposed to be
modified to 65 units and pavilion .
2 . This is an Unlisted action for which the Planning Board on April
21 , 1987 has made a negative determination of environmental
significance , subject to the conditions and requirements of
earlier project approvals and other applicable requirements .
3 . The Planning Board has reviewed this action at a Public Hearing
on April 21 , 1987 .
THEREFORE , IT IS RESOLVED :
That the Planning Board approve and hereby does approve . the
revisions to Phase III of Eastwood Commons as presented on April 21 ,
1987 , subject to the conditions and requirements of earlier project
approvals and other applicable requirements .

PUBLIC HEARING_ : CONSIDERATION OF SUBDIVISION APPROVAL FOR THE
PROPOSED SUBDIVISION OF A 1 ± ACRE LOT FROM A 34 . 71 ACRE PARCEL LOCATED
ON ELM STREET EXTENSION , TOWN OF ITHACA TAX PARCEL NO , 6 - 28 - 1 - 28 . 2 .
HELEN DEGRAFF , OWNER $ DANIEL F . BIZZELL AND DONNA SPOSITO , APPLICANTS .
Chairman May declared the Public Hearing in the above - noted
matter duly opened at 8 : 09 p . m . , and read aloud from the Notice of
Public Hearing 's as posted and published and as noted above . Both Mr .
Bizzell and Ms „ Sposito were present .
Mr . Bizzell approached the Board and stated that the proposal was
for construction of a split - level ranch home on 1 ± acres of land from
a 34 . 71 acre parcel .
Chairman May asked if there were any questions or comments from
the public . There being none , Chairman May closed the Public Hearing
at 8 : 11 p . m . and brought the matter back to the Board .
Ms . Beeners stated that the remaining lands have been developed

•• in respect to the clearing for a road bed , and added that there is
adequate access to the remaining lands through the remaining frontage
and a 50 - foot right of way on Elm Street , and through frontage on West
Haven Road ,
Town Attorney Barney referred to Ms . Beeners ' review of the EAF ,
Part II , Item # C3 - - " Vegetation or fauna , movement of fish or
wildlife species , significant habitats , or threatened or endangered
species ? " , and to Ms . Beeners ' statement thereunder - - " No significant
species or habitats are known on the site , and no significant impact
is expected subject to the conditions in Cl . " Town Attorney Barney
noted that " Cl " indicates that there would be no impact to air
quality , surface or groundwater quality or quantity , noise levels ,
existing traffic patterns , solid waste production or disposal ,
potential for erosion , drainage or flooding problems as long as
selective conservation of vegetation and protection of an existing
drainageway is practiced as part of site development , and as long as
the driveway is sited for adequate sight safety . The remaining lands
have been developed in respect to the clearing for a roadbed . There
is adequate access to the remaining lands through the remaining
frontage and a 50 - foot right of way on Elm Street , and through
frontage on West Haven Road . " Town Attorney Barney wondered if there
would be any difficulty enforcing that . Ms . Beeners responded that it
was a normal part of site development . Mr . Bizzell stated that it was
quite a heavily wooded lot and he did not want to cut down too many
• trees .
Mr . Klein wanted to know where the drainageway is relative to the
site . Ms . Beeners indicated same and noted that it is not really a
high volume drainageway .
There appearing to be no further questions or comments from the
Board , Chairman May asked if anyone were prepared to make a motion .

1 . This action is the consideration of Subdivision Approval for the

2 . This is an Unlisted Action for which the Planning Board has been
legislatively determined to act as Lead Agency for environmental
review .

2 . This is an Unlisted Action for which the Planning Board , acting
as Lead Agency . for environmental review , has made a negative
• determination of environmental significance , with certain
conditions .
3 . The Planning Board , at a Public Hearing on April 21 , 1987 , has
reviewed the following material :
Short Environmental Assessment Form dated April 9 , 1987 .
Location map , " Bizzell / Sposito , Planning Board , April 21 ,
1987 " .
" Survey Map of a Subdivision of Lands on Elm Street
Extension , Town of Ithaca , Tompkins County , New York " ,
dated April 10 , 1987 , by Howard R . Schlieder ,
N . Y . S . P . E . and L . S .
THEREFORE , IT IS RESOLVED :
1 . That the Planning Board waive and hereby does waive certain
requirements for Preliminary and Final Subdivision Approval ,
having determined from the materials presented that such waiver
will result in neither a significant alteration of the purpose of
subdivision control nor the policies enunciated or implied by the
Town Board ,
2 . That the Planning Board grant and hereby does grant Preliminary
and Final Subdivision Approval to the subdivision as herein
proposed .

Chairman May declared the matter of the Bizzell Subdivision duly
closed at 8 : 15 p . m .
PUBLIC HEARING : CONSIDERATION OF FINAL SITE PLAN APPROVAL FOR PHASE I
OF COLLEGE VIEW PARK , RESIDENCE DISTRICT R - 5 ( MOBILE HOME PARK
DISTRICT ) , AT 136 - 146 SEVEN MILE DRIVE , TOWN OF ITHACA TAX PARCELS NO .
6 - 33 - 2 - 1 AND 6 - 33 - 2 - 2 , WITH SAID PHASE I PROPOSED TO CONSIST OF TEN
NEW MOBILE HOMES AND THE RELOCATION OF TWO EXISTING MOBILE HOMES .
PAUL AND LINDA JACOBS , OWNERS ; WILLIAM ALBERN , ENGINEER .
Chairman May declared the Public Hearing in the above - noted
matter duly opened at 8 : 20 p . m . , and read aloud from the Notice of
Public Hearings as posted and published and as noted above . Both Mr .
and Mrs . Jacobs were present , as was their Engineer , William F .
Albern .
Mr . Albern approached the Board and appended maps to the bulletin
board and noted two very minor points . Mr . Albern stated that the
road has been changed in the " new " park from 20 feet to 24 feet , and ,
a hammerhead will be put in at the west end of the property to conform
• with Fire Chief Olmstead ' s desires for the turn - around . Chairman May
asked Mr . Albern the diameter of the circle to which the hammerhead
will be added , with Mr . Albern responding , 50 feet , noting again the
addition of the hammerhead to the circle . Mr . Flumerfelt suggested to
Mr . Albern that he find room to develop another spur off the next to
the end cornea unit . Mr . Albern stated that that would not be a
problem .
Mrs . Langhans inquired if Phase I were located east of lots 38
and 39 , with Mr . Albern responding that lots 35 , 36 , and 37 are not
included in Phase I , and the cul de sac is not in Phase I .
Town Attorney Barney inquired about where the two existing mobile
homes would be moved to . Mr . Albern responded that Mr . Jacobs did not
know , at this time , which ones he was going to move where .
Chairman May noted that , right at the moment , there are eight
lots existing on the creek side , and the developer will end up with
four lots . Mr . Jacobs stated that # 1 , which is the new house by the
road , will be moved to lot 25 or lot 26 ; # 12 , which also is a new
house , will be moved to lot # 27 . Mr . Jacobs stated that , at this
time , he was not sure where the other two will be .
Chairman May noted that this was a Public Hearing and asked if
there were anyone present who wished to speak .
• Donald Jo :: selyn , 152 Seven Mile Drive , spoke from the floor and
stated that it was the contention of the neighborhood that # 1 was
going to be moved to # 25 or # 26 , and # 12 was being moved to # 27 . Mr .

Josselyn , noting that he was speaking on behalf of all the neighbors ,
stated that it was their hope that the Planning Board and that the
Town Board will be able to show , in writing , where the new park is
going to be under the new zoning , and that anything that has not taken
place in the current park , which has been grandfathered all this time ,
will have to abide by the zoning laws that the Planning Board and the
Town have adopted . Town Attorney Barney stated that there will be an
agreement recorded to that effect , as that is part of the conditions .
Mr . Josselyn asked if the State Department of Environmental
Conservation had approved this expansion . Ms . Beeners replied that
they are wait _Lng for the Town to approve the project . Referring to
R- 5 zoning , Mr . Josselyn wondered if all future applicants have to go
through the same steps as Mr . Jacobs , The Board members responded ,
yes . Mr . Josselyn also asked the Board who was going to be doing the
patrolling in the park to make sure that Mr . Jacobs was abiding by the
zoning laws . Chairman May stated that Mr . Frost is the Town Building
Inspector / Zoning Enforcement Officer ,
Mr . Josselyn asked if the mitigating measures that are referred
to in the draft resolution , a copy of which he had , could be explained
to him . Ms . Beeners stated that all mitigating measures have been
based on certain revisions and improvements to the designs that have
been made by the developer since it was initially proposed , including
landscaping and road improvement connections for use by the Fire Dept ,
Ms . Beeners stated that other mitigating measures are included - - what
stringent conditions for development of the park and for their
enforcement - in the archives of the ordinance , which include the
operating permits and the regular inspections . Ms . Beeners noted that
other mitigating measures include certain requirements that the
Planning Board recommended be put on the project , and added that some
of those condtions evolved into the Local Law , which has other
stringent conditions .
Mrs . Grigorov asked if there were anything specific about
landscaping . Ms . Beeners stated that Mr . Albern revised the
landscaping plan to her satisfaction , adding that the exact location
of the plants might be subject to change if it looks like it is going
to improve the situation that she has been satisfied with .
Mr . Josselyn wondered if the drainge field was going to be
underground , with Mr . Albern responding , yes .
Mr . Klein referred to the Planning Board adopted resolution of
December 2 , .1986 and noted that it outlined several existing
conditions that are being accepted by the Board .
Chairman May asked if there were anyone else from the public who
wished to comment . No one spoke . Chairman May closed the Public
Hearing at 8 : 45 p . m . , and asked if the Board were ready to turn to

Planning Board - 11 - April 21 , 1987
• WHEREAS :
1 . This action is the consideration of Final Site Plan Approval for
Phase I of College View Park , Residence District R- 5 ( Mobile Home
Park District ) , at 136 - 146 Seven Mile Drive , Town of Ithaca Tax
Parcels No . 6 - 33 - 2 - 1 and 6 - 33 - 2 - 2 , with said Phase I proposed to
consist of ten new mobile homes and the relocation of two
existing mobile homes .
2 . This is being reviewed as a Type I action for which the Planning
Board has been legislatively determined to act as Lead Agency for
environmental review of the site plan . The Town of Ithaca Town
Board , the Tompkins County Health Department , and the New York
State Department of Environmental Conservation are involved
agencies which have been notified of this determination .
3 . The Planning Board on December 2 , 1986 , approved the overall site
plan as presented at that time and recommended that the Town
Board make a negative determination of environmental
significance , with certain conditions , for the proposed rezoning
of certain lands , on a portion of which this action is proposed .
4 . The Town .Board on March 31 , 1987 , as Lead Agency for the rezoning
of the subject lands , reaffirmed a negative determination of
environmental significance for the rezoning action , contingent
• upon the adoption and implementation of certain mitigating
measures as set forth in drawings and documentation as set forth
at that time for this project , in conditions for final site plan
approval , and in conditions for project implementation and
operation .
5 . A recommendation of a negative determination of environmental
significance for Phase I has been made by the Town Planner ,
contingent upon the adoption and implementation of certain
mitigatincl measures as set forth in drawings and documentation
submitted for this project , and as set forth as requirements of
approval .
THEREFORE , IT IS RESOLVED :
That the Planning Board , acting as Lead Agency in the
environmental review of this action , make and hereby does make a
negative determination of environmental significance for Phase I as
presented at Public Hearing on April 21 , 1987 , contingent upon the
adoption and implementation of certain mitigating measures as set
forth in drawings and documentation submitted for this project , in
conditions for final site plan approval , and in conditions for project
implementation and operation .

relocation of two existing mobile homes , subject to the conditions as
set forth in the aforementioned Local Law , and to conditions as set
forth in the Planning Board Resolution of December 2 , 1986 , and to all
other applicable laws , rules , and regulations , and further , subject to
the condition that the turn - around at the westernmost end of the
• proposed road shall be revised to include an additional spur adequate

Supervisor Noel Desch , dated April 20 , 1987 , which he read aloud , as

DATE : April 20 , 1987
The Town staff and I have completed our review of the projected impact
on new development in the South Hill water system ( Ridgecrest grid ) .
Even though the number of units likely to be constructed over the next
5 years may reach 400 or more it is not likely that the rate of growth
will be sufficient to cause a serious system reliability problem .
It is , therefore , not necessary to require the developers to
contribute a one time share in the cost of additional storage or more
effective pumping , at this time . When such improvements are
necessary , perhaps in 1989 , the Town may consider financing the
project as a Town wide improvement or depending on the rate of growth
require the developers to share in the cost , at that time .
I have asked Susan Beeners to inform the developers of this decision
and to express our appreciation for their positive attitude throughout
these deliberations . Please also thank the members of the Planning
Board for their attention to these concerns . "
Mr . Monkemeyer addressed the Board and stated that he was in
• agreement with the letter from Supervisor Desch . Mr . Monkemeyer
stated that he had spoken with Mr . Flumerfelt and discussed the
possibilities of installing a drainage retention system , such as a

. pond or a series of ponds , on the site to control the runoff for the
• entire site . Mr . Monkemeyer stated that , in addition , he would like
the Planning Board to consider that future development uphill from
this site also be given consideration for drainage .
Chairman May asked if the pond would be designed so that there
was water in it all the time , adding that the pond should be kept
shallow to reduce the liability . Mr . Monkemeyer responded , yes ,
adding that they would design it large enough to contain most of the
waters from the " Springwood " site or any of the rest of the buildings
that would be placed on the upper portion .
Mr . Flumerfelt stated that there was a previous requirement for
the " Springwood " continued development that the drainageway be
improved all the way down to Danby Road which would involve the
developer going on private property . Mr . Flumerfelt stated that the
drainage channel is rather narrow and constricted at some points down
there and could impose a hardship . Mr . Flumerfelt offered that , in
lieu of that , it seemed like a retention pond would serve the purpose
of controlling runoff .
Chairman May , noting that this was a Public Hearing , asked if
anyone present wished to speak . No one spoke . Chairman May closed
the Public Hearing at 9 : 15 p . m . , and brought the matter back to the
Board for comments and questions .
• Dr . Lesser stated that he was still a little uncertain about the
water supply situation , although it was clearly not an issue at the
moment . Referring to Supervisor Desch ' s memo , Dr . Lesser stated that
the possibility was raised that developers could conceivably be asked
for contributions at some point in the future . Dr . Lesser wondered if
that would be a voluntary gesture at that point , or would the Town
essentially be considering previous commitments on the part of the
developers . Chairman May stated that it was his understanding that it
would be new projects at such time as the saturation level is reached .
Chairman May asked the Board if there were any questions or
comments on the EAF . Mr . Klein suggested that the storm drainage
retention area should be mentioned in the adopted resolution .
There appearing to be no further comments , Chairman May asked if
anyone cared to make a motion .
