HomeMy WebLinkAboutPB Minutes 1982-03-02 c • TOWN OF ITHACA PLANNING BOARD MARCH 2 , 1982 The Town of Ithaca Planning Board met in regular session on Tuesday , March 2 , 1982 , in Town Hall , 126 East Seneca Street , Ithaca , N . Y ., , at 7 : 30 p . m . PRESENT : Chairman Montgomery May , Barbara Schultz , Edward Mazza , Virginia Langhans , David Klein , Bernard Stanton , James Baker , Lawrence P . Fabbroni ( Town Engineer ) , Peter M . Lovi ( Town Planner ) , Lewis D . Cartee ( Town Building Inspector ) , Nancy M . Fuller ( Secretary ) . ALSO PRESENT' . William Downing , Architect , Louis W . Munchmeyer , M . D . , Claudia Montague ( WHCU ) , Dave Maley ( WTKO ) , Tamar Sherman ( Ithaca Journal ) . Chairman May declared the meeting duly opened at 7 : 30 p . m . and noted that because of the Secretary ' s broken wrist this meeting will be taped using Michael Ocello ' s home tape recorder . The Secretary distributed several documents to the Board members including , among others , Mrs . Grigorov ' s report of the County Planning Board Meeting of February 10 , 1982 . APPROVAL OF MINUTES - DECEMBER 1 , 1981 MOTION by Mr . Montgomery May , seconded by Mr . Bernard Stanton : RESOLVED , that the Minutes of the Town of Ithaca Planning Board Meeting of December 1 , 1981 , be and hereby are approved as written . There being no further discussion , the Chair called for a vote . Aye - May , Mazza , Stanton , Schultz , Klein , Langhans , Baker . Nay - None . The MOTION was declared to be carried unanimously . REPORT OF THE TOWN BUILDING INSPECTOR , LEWIS D . CARTEE The Building Inspector ' s Report of Building Permits Issued for the month of February 1982 had been received by the Planning Board members with their Agendae . Mr . Cartee noted that three permits had been issued in the month of February 1982 for $ 47 , 500 . 00 in improvements , as compared to six permits issued in February 1981 for $ 39 , 541 . 00 in improvements . REPORT OF THE TOWN ENGINEER , LAWRENCE P . FABBRONI Planning Board - 2 - March 2 , 1982 . Mr . Fabbroni reported that the Soil Conservation Service had allocated $ 5 , 500 to fix over $ 75 , 000 worth of damage caused by the flood in October , 1981 . Discussion followed in re the Forest Home area damage , possible re - review of funding allocation , and permanency of the damage . Mr . Fabbroni stated that there will be meetings with Cornell University , Mr . Fabbroni stated that in two weeks an additional run to the shuttle will be added to Northeast Transit . A survey was completed in the last 22 months which showed that a lot of people use this service in the morning . Mr . Fabbroni reported that East Ithaca Transit is beyond belief - - the latest figures show that 8 , 800 passengers in the last four weeks used the bus service , as compared with an estimate a year ago of about 2 , 000 passengers in a month . Mr . Fabbroni reported on the SOS progress ( Safer Off - System ) , describing the work on Stone Quarry Road . Mr . Fabbroni stated that the new computer had just arrived . He commented that it came crated in about ten parts and was assembled by Peter Lovi , Mike Ocello , and him and was operating - all in less than two hours . Mr . Fabbroni invited Board members to come upstairs to see a demonstration of its capabilities . • Mr . Fabbroni reported that the Park Program work for 1982 was being worked up . Mr . Fabbroni reported that he had met with the Fire Evaluator - a Mr . Proper - and went through the basic criteria that he goes through in evaluating fire station locations . Mr . Fabbroni commented that Mr . Proper in essence stated that the City is well served . Mr . Fabbroni discussed No . 6 Fire Station and Central Fire Station , commenting that Mr . Proper appeared to indicate that No . 5 Fire Station is redundant . Chairman May complimented Mr . Fabbroni on his efforts with the East Ithaca Transit situation , and Transit for the area in general , stating that his efforts have been well rewarded in ridership . Chairman May thanked Mr . Fabbroni for his report . REPORT OF THE TOWN PLANNER , PETER M . LOVI Mr . Lovi spoke about the IBM Displaywriter System that had recently arrived in the Town Offices and is already in use . He is working , among other things , with the County Assessment Department in terms of a data base . Mr . Lovi also spoke about the fire stations matter and • described his efforts to date . Chairman May thanked Mr . Lovi for his report . Planning Board - 3 - March 2 , 1982 . PUBLIC HEARING : PLANNING BOARD REVIEW OF PROPOSED MEDICAL OFFICE BUILDING PLANS , AS PROPOSED BY DR . LOUIS W . MUNCHMEYER , ON A FOUR ACRE PORTION ( REAR ) OF LANDS PRESENTLY OWNED BY WILLIAM AND KAY W . GILCHER , AT 1317 TRUMANSBURG ROAD , ITHACA , N . Y . , TOWN OF ITHACA TAX PARCEL NO . 6 - 24 - 3 - 61 AND , CONSIDERATION OF PLANNING BOARD RECOMMENDATION TO THE TOWN OF ITHACA ZONING BOARD OF APPEALS , Chairman May declared the Public Hearing in the above -noted matter duly opened and accepted for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in 'Town Hall and the Ithaca Journal on February 22 , 1982 , and February 25 , 1982 , respectively . Chairman May read aloud the Notice of Public Hearing as published and as noted above and asked who would like to speak to the matter . Mr . William Downing , Architect , spoke from the floor and passed out a site plan that showed in a larger scale the plan that had been mailed to Board members . In addition , Mr . Downing displayed an aerial photograph and Mr . Downing pointed out Trumansburg Road , the Gilcher property , the new hospital and the old hospital . Mr . Downing pointed to a piece of property on the map and stated that Dr . Munchmeyer has the option to purchase this • property . Hs has made application for a right of way to extend an existing road . The application is to be worked out with Mr . Fabbroni to coordinate this with the road presently there . Dr . Munchmeyer needs the privilege of connecting water and sewer lines to this location . Dr . Munchmeyer proposes to make a right of way 25 feet on the north side of the property which with another 25 feet makes a 50 - foot right of way for the future . Mr . Downing described the site plan in considerable detail . Dr . Munchmeyer spoke from the floor and stated that this plan was the! identical plan that had been recommended before , noting that the property under discussion now is about 300 yards south of that previously recommended . The building and service road are thin. same . The right of way for water and sewer connections has to be worked out with the County and they would like to have recommendations from the Town Boards . Chairman May asked if there were any comments at this point from the public . There were none . The Board members then asked questions with regard to the right of way and the two options being proposed . Lengthy discussion followed with the Town Engineer , Mr . Fabbroni . Chairman May asked if Option # 2 included any Route 96 • options . Mr . Downing stated that it did not . Chairman May noted that no drainage plans or details had been submitted as yet . Mr . Fabbroni stated that this was not a Planning Board - 4 - March 2 , 1982 i . big concern but that drainage details should be shown on final approval maps . Chairman May felt that the Board' could not make a recommendation for final site plan without these detailed plans . This needs to be outlined and needs to be looked at prior to final approval . Mr . Mazza asked how many physicians would have offices in this building . Mr . Downing stated that the final count may be between 7 and 12 physicians , or , may be only 6 . Mr . Downing stated that adequate parking would be provided to be in compliance with the Codes and the access would be clear . Chairman May stated that one recommendation this Board could make would be that if the Zoning Board of Appeals approves this plan that it come back to the Town Planning Board for final site plan approval . Mr . Maz2: a stated that the Zoning Board of Appeals could make this a condition of their approval . Mr . Downing stated that one of their concerns was that this Board indicate in some way that they endorse or approve that this project is a positive step for development of this property and • therefore would have a beneficial effect on the community . This should be one aspect of the Board ' s motion . Dr . Munchmeyer noted that the County Board of Representatives was meeting on the matter at 9 : 00 a . m . tomorrow morning . Mr . Downing suggested that another approach could be that the Planning Board views the project with favor . Lengthy discussion followed with Mr . Fabbroni as to the site plan , drainage , access way ( s ) , etc . Mr . Downing added to the discussion of drainage , ditching , and culverting . Chairman May stated that a motion was in order at this time , but in view of the Secretary ' s problem he would have to write it and so he moved to go into executive session for about five minutes in order to develop a motion . Mr . Stanton seconded the motion to go into executive session , May , Klein , Mazza , Schultz , Langhans , Stanton , and Baker voted aye ; no nays . The Board went into executive session . No action was taken ; a proposed motion was handwritten . After ten minutes , upon motion , the meeting was re - opened to the public . MOTION by Mr . Montgomery May , seconded by Mr . Edward Mazza : RESOLVED , that the Town of Ithaca Planning Board inform and hereby does inform the Town of Ithaca Zoning Board of Appeals that said Planning Board approves in concept the use of approximately four acres ( rear ) of Town of Ithaca Tax Parcel No . • 6 - 24 - 3 - 6 , presently owned by William and Kay W . Gilcher , at 1317 Trumansburg Road , as proposed by Dr . Louis W . Munchmeyer , Jr . , as shown on Site Plan - Medical Office Building - prepared by Planning Board - 5 - March 2 , 1982 z; . William Downing Associates , Architects , Project # 81 - 543 , dated 12 / 8 / 81 , Option 2 dated 2 / 16 / 82 , having determined that : 1 . There is a need for the proposed use in the proposed location . 2 . The existing and probable future character of the neighborhood in which the use is to be located will not be adversely affected . 3 . The proposed change is in accordance with a comprehensive plan of development of the Town . The Planning Board wishes to inform the Zoning Board of Appeals that: said Planning Board has discussed the drainage toward the Hospital with the Town Engineer . The Planning Board wishes to recommend to the Zoning Board of Appeals that at such time as the proposed medical office building plans may be approved by said Zoning Board of Appeals , the followincr details should be specifically in place : 1 . DrainagE! details including any moving of the diversion ditch . 2 . Storm sewers in parking lot area . 3 . Curbing . 4 . Lighting . • 5 . Garbage . 6 . Vegetation left on site . 7 . Landscaping . 8 . The specific building and its location upon the proposed parcel . And finally , the Planning Board wishes to inform the Board that in viewing the location of such a facility in the general area , the Planning Board feels that access to an internal roadway is more desirable than a new high -volume intersection with the Trumansburg Road . There being no further discussion , the Chair called for a vote . Aye - May , Mazza , Schultz , Stanton , Baker , Klein , Langhans . Nay - None . The MOTION was declared to be carried unanimously . Chairman May stated that the Zoning Board of Appeals should be the body to speak to the matter of the review of the Environmental Assessment Form at the time they look at the approval , noting that the Planning Board , in this case , is not the lead agency since it is not the final approval granting body . • REVIEW OF MATERIALS RECEIVED FROM THE TOWNE OF HISTORIC SMITHVILLE IN RE SMITHVILLE P . U . D . , ATLANTIC COUNTY , GALLOWAY TOWNSHIP , NEW JERSEY . Planning Board - 6 - March 2 , 1982 • The Secretary reminded the Board members that in December of 1981 the Chairman had asked that she write the following letter to the Town of Smithville Planning Board : " The Chairman of the Town of Ithaca , New York , Planning Board , Mr . Montgomery May , while on a business trip this week in Chicago , Illinois , saw on the television news a segment covering a new housing development in Smithville , New Jersey . The news coverage had pictures and information of your mixed usage development , PUD , zero lot lines , small lots - 45 ' x 112 ' , condominiums , businesses , etc . JMr . May has requested that I write to you in the hope that , through your Board , the Town of Ithaca might be able to obtain information , brochures , booklets , pictures , or any such other material that your Town may have available , for use by its Planning Board . IThank you so much for your assistance . " The Secretary reported that she had received the following letter and enormous package of materials , books , and information on January 19 , 1982 from The Towne of Historic Smithville : " RE : Smithville P . U . D . , Atlantic County , Galloway Township , New Jersey Pursuant: to your request for information regarding the above referenced project , please find attached : 1 ) Handbook of Submission Requirements and Development Controls Applying to The Towne of Historic Smithville 2 ) Annual Update of Decision and Resolution Granting Preliminary • Approval to the Towne of HistoricSmithville , P . U . D . - Summary - 3 ) The Towne of Historic Smithville General Information Packet 4 ) Historic Towne of Smithville Fiscal Impact Report 5 ) Towne of Smithville - Controls For your information , Smithville P . U . D . has been under construction for about one year and remains regulated by Galloway Township Planning Board and the New Jersey Divisions of 1 ) Coastal Resources ; 2 ) Water Resources ; and 3 ) Community Affairs . Approximately two years of review by these agencies led to the conceptual and preliminary approvals which appear in the appendix section of the Handbook of Submission Requirements . Each sub - phase of the development is subject to a full review by all applicable regulatory bodies . If you wish further information or have additional questions , please do not hesitate to call . OLD BUSINESS • Mrs . Schultz reported on the Association of Towns Meeting she attended in New York City . Chairman May commented that one e Planning Board - 7 - March 2 , 1982 r thing that seems to come up regularly is how far ahead of other town boards the Town of Ithaca Planning Board is . NEW BUSINESS Chairman May reminded everyone of the March 16th meeting which will be a joint meeting with the Town Board and Zoning Board of Appeals . He suggested that everyone pull out their copy of the proposed Zoning Law to look it over . The meeting will be held in Town Hall . Chairman May invited Board members to come upstairs to view the new word processing equipment .
