APRIL 21 , 1981
• The Town of Ithaca Planning Board met in regular session on Tuesday ,
April 21 , 1981 , in Town Hall , 126 East Seneca Street , Ithaca , N . Y . , at 7 : 30
p . m .
PRESENT : Chairman Montgomery May , James Baker , Liese Bronfenbrenner ,
Carolyn Grigorov , David Klein , Edward Mazza , Lawrence Fabbroni ( Town Engineer ) ,
Nancy Fuller ( Secretary ) .
ALSO PRESENT : J . Victor Bagnardi , Stewart D . Knowlton , Douglas Knowlton ,

Chairman May declared the meeting duly opened at 7 : 35 p . m .
PUBLIC HEARING : C;ONSIDERATION OF FINAL SITE PLAN APPROVALFOR PROPOSED
ADDITION TO THE P & C MARKET AND FOR AN ADDITION TO HOUSE A RACQUET BALL
COMPLEX , AT EAST FILL PLAZA , TAX PARCEL NO . 6 - 62 - 2 - 1 . 121 . STEWART D . KNOWLTON .
Chairman May declared the Public Hearing in the above - noted matter duly
opened at 7 : 35 p . m. , and accepted for the record the Clerk ' s Affidavit of
Posting and Publication of the Notice of Public Hearings in Town Hall and
the Ithaca Journal on April 13 , 1981 , and April 16 , 1981 , respectively .
Mr . Knowlton appeared before the Board and circulated a booklet which he
had prepared containing pictures of East Hill Plaza taken over the years
depicting what it was and what it is and denoting the " softening effect " that
0has taken place over those years .
Mr . Knowlton displayed his architect ' s rendering of the racquet ball
complex as drawn by Mr . Victor Bagnardi . He described how it is to be tied
into Franklin Printing and what was to be the hardware store . He stated that
the trees that are shown are the trees that they are going to use . He noted
that he has been in consultation with a Trumansburg Nursery and stated that
on the west and south portion small - leaf linden trees will be used . He
commented that there trees may be seen in place on the Ithaca Commons between
the banks . He stated that they are very hardy trees and they are using them
because of the drive that will go around behind from the parking lot to the
by - pass road . He :Mated that these trees will take a lot of punishment . He
stated that they will be of 3 " caliper , 12 ' to 15 ' high on a 22 - foot building .
Mr . Knowlton stated. that the smaller trees shown will be ewes . He noted that
the stone planter is in there already . He noted also that there will be four
strategic spots for flowering shrubs , vibernum . .
Mr . Knowlton displayed a large site plan with the changes made in the
parking that reflect Mr . Fabbroni ' s concerns . He stated that there will be
no parking at all near the building . He stated that there will be the same
throat connection , no dead end , with circulation for safety . He stated that
the site plan also shows the plantings and added that they will plant all of
the area that they know will not be destroyed .
Mr . Mazza asked how soon Mr . Knowlton anticipated phase 3 to be moving
ahead . Mr . Knowlton replied that he hoped phase 3 would be moving in the
spring of next year , i . e . , a year from now .
Mr . Klein asked if he were actively working on it . Mr . Knowlton replied
that he was .
Mr . Knowlton spoke of a " patio " off the P & C where the traffic is to be

yyvvMr . Klein wished to confirm that there were no dumpsters or trash /behind
the building . Mr . Knowlton did confirm that and stated that they are getting
along well with the P & C in re the compactors for their operation .
Mr . May asked if there were any comments from the public .
Mrs . Shirley Raffensperger spoke of the traffic flow within the Plaza
and the road cut on to the connector road if , indeed , it is built . Mr .
Knowlton , indicating on the plan , stated that that road is existing now .
He stated that the portion of the road from the Doctor ' s office to Ellis
Hollow Road has been deeded over already . Mr . Fabbroni stated that this
location of the road cut shown on the plan opposes , i . e . , is opposite , the
driveway to Summerhill Apartments .
Mrs . Raffensperger commented on the clear way from the P & C out to the
southerly exit as opposed to using the service station , and asked if Mr .
Knowlton anticipated making this safe and clear that the primary exits from
the parking lot are from Judd Falls Road and the P & C . Mr . Knowlton said ,
" Yes . " Mrs . Raffensperger said that this will require different markings .
Mr . . Knowlton said , " Yes . " Mr . Knowlton spoke of a double stripe off Ellis
Hollow Road and also from Judd Falls Road . Mrs . Raffensperger spoke of
people going directly down to the edge toward Ellis Hollow Road and then out .
Mr . Knowlton said that he would try double lines there again . Mrs . Raffens -
perger spoke of parking in front of the stores . Mr . May stated that he had
considerable concern about that himself and that he hoped no one gets killed
• trying to reach a :fire . Mr . Knowlton said that he was very concerned himself .
Mr . May stated that the placing of signs in tire rims is just not very good
right now . Mr . Knowlton agreed .
Mr . Fabbroni ;stated that he would repeat that when and if the new road
comes into being , and when and if phases 3 and 4 of the proposed development
come along , the Town is going to be looking to limiting the access points to
the extent that the exits are the three exits that Mr . Knowlton shows on
the picture before us , and that the whole activity on the corner takes on
a whole different frame of reference . Mr . Fabbroni noted that he said this
the last time , and he is saying it again .
Mr . Knowlton stated that his response today is that they are trying to
stop - gap an intersection problem by taking a 60 ' right of way behind the
Plaza . He stated that he agreed with what Mr . Fabbroni was saying in the
sense that he believes this has a very functional purpose in trying to
alleviate a problem on8e corner . He stated that he thought there will
come a time for this to a very important link .
Mr . Fabbroni :Mated that he did not disagree and added that it is to
the Town ' s best interest and to Mr . Knowlton ' s also to control the access
better than we have before . Mr . Knowlton agreed .
Mr . Klein asked if the finish material of the Phase 1 building be the
same on all sides . Mr . Knowlton said , yes , it will be a completely finished
building .
• Mr . Fabbroni inquired about the exterior of the P & C and Mr . Knowlton
stated that it will be a block , painted , addition as it is now .
Chairman May asked if there were any further questions from the public .
There were none . Chairman May declared the Public Hearing duly closed at
8 ; 00 p . m .
Planning Board - 3 - April 21 , 1981
MOTION by Mr . David Klein , seconded by Mrs . Liese Bronfenbrenner :
RESOLVED , that the Planning Board of the Town of Ithaca grant and hereby
does grant Final Site Plan Approval for proposed addition to the P & C
Market and for an addition to house a Racquet Ball Complex , at East Hill
Plaza , Town of Ithaca Tax Parcel No . 6 - 62 - 2 - 1 . 121 , as shown on Plan entitled ,
" East Hill Plaza - Ithaca , Racquetball " , 1 " = 40 ' , Drawing Number SP481RB ,
drawn by SDK , Approved by S . D . Knowlton , dated 4 / 11 / 81 , revised 4 / 20 / 81 ,
such plan indicating Phase 1 ( Racquetball ) and Phase 2 ( P & C Addition ) ,
and being accompanied by Architect ' s rendering of portion of exterior of
said Racquetball addition , all as presented and described by Stewart D .
Knowlton .
There being no further discussion , the Chair called for a vote .

PUBLIC HEARING : CONSIDERATION . OF SITE PLAN APPROVAL FOR PROPOSED WAREHOUSE ,
60 ' x 100 ' , AT , 610 ELMIRA ROAD , FORMERLY OCCUPIED BY DAIRYLEA , TAX PARCEL NO .
6 - 33 - 3 - 2 . 3 . IACOVELLI BROS . CONST . INC .
Chairman May declared the Public Hearing in the above- noted matter duly
opened at 8 : 01 p . m . and accepted for the record the Clerk ' s Affidavit of
Posting and Publication of the Notice of Public Hearings in Town Hall and
• the Ithaca Journal on April - 13 , 1981 , and April 16 , 1981 , respectively .
Mr . Larry Iacovelli appeared before the Board to request approval for
an enclosed storage building with two overhead doors and three passage doors ,
measuring 1001 x 60 ' , for placement on the land formerly occupied by Dairylea .
He stated that the proposed storage building will be all open inside and that
he will use the existing building there , 28 ' x 28 ' , for his office space .
The Planning Board members had received with their agenda a copy of the
proposed site plan , a copy of the type of ' building to be built , and a copy of
a survey map of the premises formerly occupied by Dairylea dated 10 / 18 / 71 .
Chairman May asked if there were any questions from the public . There
were none , there being no one present to speak to this matter . Chairman May
declared the Public Hearing closed .
Mr . Klein inquired if the rear yards and set back were okay . Mr .
Fabbroni replied that they really do not apply , noting that this is a piece
of land within the Light Industrial District , as it is like a campus situa -
tion . Mr . Fabbroni noted that Mancini and Sons is some 100 ' from this pro -
lperty . He stated that the positioning of the building does not violate the
Light Industrial District in that respect and complies with the ordinance .
Mr . Fabbroni stated that what Mr . Iacovelli is proposing is a Republic Steel ,
" Butler - type " of building , more or less a pre - engineered type of building .
Mr . Fabbroni stated that the zoning is for light industrial uses and which
provides for storage or warehousing uses . Mr . Fabbroni stated that there
is not a whole lot to say about it , but added that it is all a part
,really
of Mancini ' s original development .
Mr . May inquired about drainage . and Mr . Fabbroni said that he foresaw
no problem in that :regard . Discussion was held on road access including the
other entrance off Five Mile Drive .
It was noted by the Board members that the proposed zoning ordinance

zoning designation map indicates that the present light industrial district
•will be exactly the, same .
Mr . May asked if there were any further questions on the building or the
site .
Mr . Mazza stated that he had no questions but that he wanted to indicate
that he will not be voting on this matter because he represents Mr . Iacovelli .
Turning to the Environmental Assessment Form ( Short Form ) , a copy of
which each member :had received with their agenda , Mr . May stated that all
the questions thereon had been answered " No " . Mr . May asked if there were
any concerns or questions . There were none .
MOTION by Mr . Montgomery May , seconded by Mrs . Carolyn Grigorov :
RESOLVED , that the Town of Ithaca Planning Board , acting as lead agency
in the review of the proposed warehouse , 60 ' x 100 ' at 610 Elmira Road , Ithaca ,
New York , Tax Parcel No . 6 - 33 - 3 - 2 . 3 , for Iacovelli Brothers Construction , Inc . ,
approve and hereby does approve the Environmental Assessment Form as completed ;
and
FURTHER RESOLVED , that pursuant to the State Environmental Quality Review
Act , Part 617 , this action is classified as Unlisted ; and
FURTHER RESOLVED , that the Town of Ithaca Planning Board , has determined
from the Environmental Assessment Form and all pertinent information , and
• from the Town Engineer ' s review and recommendation , as reviewer , that the
above -mentioned action will not significantly impact the environment and ,
therefore , will not require further environmental review .
There being no further discussion , the Chair called for a vote .
Aye - May , Baker , Bronfenbrenner , Grigorov , Klein .
Nay - None .
Abstain - Mazza . Carried unanimously .
MOTION by Mrs . Liese Bronfenbrenner , seconded by Mr . James Baker :
RESOLVED , that the Town of Ithaca Planning Board grant and hereby does
grant Site Plan Approval for a 60 ' x 100 ' warehouse , as proposed by Iacovelli
Brothers Construction , Inc . , Mr . Lawrence Iacovelli , Applicant , to be construc -
ted at 610 Elmira Road , Tax Parcel No . 6 - 33 - 3 - 2 . 3 , the site formerly occupied
by Dairylea , with the existing building thereon to be used as office space
for Mr . Iacovelli .
There being no further discussion , the Chair called for a vote .
Aye - May , Baker , Bronfenbrenner , Grigorov , Klein .
Nay - None .
Abstain - Mazza .
The MOTION was declared to be carried unanimously .
• REPORT OF COUNTY PLANNING BOARD CHAIRPERSON - - TOWN COUNCILWOMAN SHIRLEY
R FFEN PERGER .
Mrs . Raffensperger noted that the February Meeting of the County Planning
Board had been cancelled due to inclement weather . Mrs . Raffensperger reported

that at the March meeting , the Tompkins Community Hospital Corporation
membership was discussed which resulted in Mr . Gould Colman being the County
� lanning Board ' s representative to that body .
Mrs . Raffensperger discussed the fact that a priority item this year for
the Board has been the housing study involving multi - family , rental , low
income , etc . She :stated that the committee working on this wants to extend
into single family housing since there seems to be the reality that single
family , detached , housing is not a thing of the past because of economics .
Mrs . Raffensperger discussed with the members a recent case before the
Supreme Court of New York in which it was declared that the zoning ordinance
of the Town of North Salem was illegal insofar as it failed to consider and
to provide housing to meet both its own present and future needs and that of
the regions after the Town had - denied a rezoning request of a developer to
permit development of a 48 - unit condominium cluster on a site adjacent to
I - 684 . The Planning Board members requested a copy of this matter as it
appeared in the Planning News .
Mrs . Raffensperger reported that at its April meeting , the County Plan -
ning Board passed -the following resolution : " BE IT RESOLVED , that the
Tompkins County Planning Board does support the enactment of State Legisla -
tion which would require a deposit on all carbonated beverage containers
sold within the State of New York . " She noted that many organizations are
in favor of this including the Association of Towns , the Association of
Mayors , and the League of Women Voters .
Mrs . Raffensperger reported that the Warren Road Improvements are begin -
ning and that contracts are in the works .
Mrs . Raffensperger reported that the fate of TOMTRAN seems to be uncer -
tain , adding that no one knows as this point what the future of that kind of
project might be . Mr . Fabbroni commented that Congress has 45 working days
to act from the time they get such a rescission .
Mrs . Raffensperger reported that ., as Chairman of the County Planning
Board , she talked oto the Board of Realtors , adding that both Mrs . Fuller and
Mr . Cartee helped her with her preparation . Mrs . Raffensperger stated that
a recommendation she made was that a realtor should obtain or see that such
is obtained , a Certificate of Compliance from the municipality involved , and
not to assume that the present use of a building is the proper use .
Mr . May thanked Mrs . Raffensperger for her report .
REVIEW OF PROPOSED REVISIONS TO THE . TOWN OF ITHACA HIGHWAY MAP ,
With Mr . Fabbroni leading the discussion , the Planning Board members
reviewed the proposed " Official Highway Map of the Town of Ithaca " .
Discussions centered upon the proposed road in the area of the Hospital ;
the proposed connector on West Haven Road to Hopkins Road ; the alignment from
Summerhill Lane to Caldwell Road , noting that this is the result of about
eight months of discussion with Cornell University ; and some discussion of
• Burns Road .
MOTION by Mr . Montgomery May , seconded by Mrs . Carolyn Grigorov :
RESOLVED , that the Town of Ithaca Planning Board inform and hereby does
inform the Town of Ithaca Town Board that said Planning Board has reviewed
the proposed Town of Ithaca Highway Map , as it existed on April 21 , 1981 ,

•no area of concern and recommends its adoption .
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be carried unanimously .
Mrs . Grigorov asked Mr . Fabbroni about the placement of bikeways on this
map . Mr . Fabbroni stated that bikeways could be shown on a map like this ,
however , they would have no status on an official highway map .
ADJOURNMENT
Upon Motion , the Chairman declared the April 21 , 1981 , meeting of the
Town of Ithaca Planning Board duly adjourned .
