/ TOWN OF ITHACA PLANNING BOARD
TUESDAY , JULY 22 , 1980
The Town of Ithaca Planning Board met in regular session in Town Hall ,
126 East Seneca Street ( second floor ) , Ithaca , N . Y . , on Tuesday , July 22 ,
1980 , at 7 : 30 p „ m .
PRESENT : Chairman Henry Aron , Liese Bronfenbrenner , James Baker ,
Barbara Schultz , Carolyn Grigorov , Lewis Cartee , Barbara Restaino .
Chairman Aron declared the meeting duly opened at 7 : 32 p . m . , noting
r the presence of a quorum .
APPLICATIONS FOR SIGN PERMIT
1 . Interstate Brands Corp . ( Millbrook ) , 606 Elmira Road .
The Board :reviewed the application for sign permit for the Millbrook
Bread store at (306 Elmira Road , such application being for a 21 sq . ft ,
sign on the front of the building reading " Save up to 507o Bakery Thrift
Shop " .
Mr . Aron asked if this sign were in violation of the Sign Law and also
if this were the limit of signage permitted for this building . Mr . Cartee
stated that the sign is in violation in that it has been erected prior to
the obtaining of a permit , and further , that this sign would complete the
total signage permitted for this building , any additional signage allowable
only by variance .
MOTION by Mr . Henry Aron , seconded by Mrs . Liese Bronfenbrenner :
RESOLVED , that the Town of Ithaca Planning Board recommend and hereby
does recommend -to the Town Board approval of the sign presently in place
at the Millbrook Bread store at 606 Elmira Road , such sign being 21 sq . ft .
in size and reading , " Save up to 50% Bakery Thrift Shop " .
There bein ;; no further discussion , the Chair called for a vote .
Aye - Aron , Bronfenbrenner , Baker , Schultz , Grigorov .
Nay - None .
The MOTION was declared to be carried unanimously .
2 . Danby Builders Co . , Inc . , 969 East Shore Drive .
The Board reviewed the application for sign permit from Danby
Builders Co . , I :nc . , located at 969 East Shore Drive , such application being
for a 12 sq . ft . sign located beside the front door facing south and
reading " Danby Builders Co . Inc . "
Mr . Cartee stated that this sign is on the building owned by John .
C . Lowery and housing John C . Lowery , Inc . Mr . Cartee stated that this
sign was also in place prior to application for sign permit .
Mr . Aron asked if this sign is otherwise in compliance with the present
sign law . Mr . Cartee stated that , if allowed , it would comply with the
present law .
MOTION by :Mr . Henry Aron , seconded by Mr . James Baker :
RESOLVED , that the Town of Ithaca Planning Board recommend and hereby

does recommend to the Town Board approval of the sign presently in place
at the John C . - Lowery , Inc . building at 969 East Shore Drive , such sign
being 12 sq . ft , in size and reading " Danby Builders Co . Inc . " and located
�a beside the front: door facing south .

The MOTION was declared to be carried unanimously .
3 . Additional Agenda Item : Classic Tan , East Hill Plaza ,
The Board agreed to review an application for sign permit which
was received after the completion of the Agenda for this meeting from
Groff Associate: , Stewart Knowlton as agent , for a new business to be
located in the east end of the former FBC building at East Hill Plaza , and
to be known as " Classic Tan " . Mr . Cartee stated that this store will be
located between " Aquarium " and " Roy ' s Barbecue " , east of the Cornell
Credit Union at East Hill Plaza , and is 21 sq . ft . in size . Mr . Cartee
stated that the color and pictorial matter on the proposed sign was unknown
at this time .
Mr . Aron asked if the size of the proposed sign complies with the
present sign law . Mr . Cartee stated that it did . Mr . Aron asked where it
would be placed . Mr . Cartee replied that it would be on the face of the
building .
Mrs . Schultz commented that there was insufficient information
delineated on the application to enable her to make a proper evaluation .
Mr . Aron agreed .
MOTION by Mr . Henry Aron , seconded by Mrs . Barbara Schultz :
RESOLVED , that the Town of Ithaca Planning Board table and hereby does
table review of the application for sign permit for " Classic Tan " , East
Hill Plaza , until more specific information pertaining to such sign is
obtained , such as material to be used , color , more detailed drawing .
There being no further discussion , the Chair called for a vote .
Aye = Aron , Bronfenbrenner , Baker , Schultz , Grigorov .
Nay - None .
The TABLING MOTION was declared to be carried unanimously .
PROPOSED ABANDONMENT BY THE TOWN OF ITHACA OF HUDSON STREET EXTENSION
Mr . Aron stated that he has walked this area with Mr . Fabbroni and
noted that it is in excellent shape , no dirt , good repair , etc . , and has
been and is used as a parking area for. Therm , Inc . Mr . Aron stated that
he would recommend to the Planning Board that they consider favorably
• the Town Board ' s pursuing the proposed abandonment of Hudson Street Exten -
sion . Mr . Aron referred to the proposed resolution on this matter and the
attached map as prepared by Mr . Fabbroni for the Board ' s consideration .
A brief discussion followed .
Planning Board - 3 - July 22 , 1980
MOTION by Mr . Henry Aron , seconded by Mr . James Baker :
• WHEREAS , Hudson Street Extension as presently platted was deeded to
the Town of Ithaca by Therm Electric Meters Co . , Inc . in 1953 ; and
WHEREAS , in 1953 Hudson Street Extension served property other than
that owned by Therm , Inc . ; and
WHEREAS , Hudson Street Extension no longer serves any property other
than that owned by Therm , Inc . , Therm , Inc . having purchased all surroun -
ding lands directly served or with a possibility of being served in the
future ; and
WHEREAS , Therm , Inc . has now requested that the Town Board abandon
Hudson Street Extension as a. Town Highway ,
NOW , THEREFORE , BE IT RESOLVED , by the Planning Board of the Town of
Ithaca that Hudson Street Extension be considered for legal abandonment by
the Town Board of the Town of Ithaca .
By way of discussion , Mrs . Bronfenbrenner asked if there were any
problem with safety vehicles getting in . Mr . Aron replied , absolutely none ,
adding that there is a beautiful round - a - bout .
There being no further discussion , the Chair called for a . vote .
Aye - Aron , Bronfenbrenner , Baker , Schultz , Grigorov .
. Nay - None .
The MOTION was declared to be carried unanimously .
DISCUSSION OF FINAL DRAFT - PLANNING BOARD BY - LAWS
The members having before them the final draft of the proposed
Planning Board By - Laws which they had had for discussion on July lst , Mr .
Aron asked that the record show that the Planning Board highly commends
Mr . Edward Mazza who chaired the by - law committee and his committee members
and especially Nancy Fuller for being so patient in writing and re -writing
the by - laws . He stated that many hours have been put into this document ,
hopefully to a successful conclusion - - its adoption by the Planning
Board and approval by the Town Board . Following this statement , to which
the members present agreed , the Planning Board proceeded to review page by
page the final draft . of the proposed by - laws . with the only change in the
document before them being .on page 5 , Article V , Section 1 , the first
sentence , wherein the word " resolution " was changed to " Chairperson " .
MOTION by Mr . Henry Aron , seconded by Mr . James Baker :
RESOLVED , that the Town of Ithaca Planning Board adopt and hereby
does adopt By - Laws as set forth in the Final Draft bearing revision date
of June 26 , 1980 , as further revised by the changing of the word " resolu -
tion " to the word " Chairperson " on page 5 , Article V , Section 1 , in the
first sentence , and recommends Town Board approval of said By - Laws , as
adopted by said Planning Board , on this date , July 22 , 1980 .
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be carried unanimously .
Turning now to the Planning Board ' s collection of various policy
• statements and / or policy resolutions , as compiled by Mrs . Fuller upon
suggestion of the by - laws committee , the Board reviewed the document before
them , having had same in hand in preparation for the July . lst meeting of
the Board .
The Planning Board agreed upon the following " Policies " Sheet to be
in effect as of this date , July 22 , 1980 , such Sheet indicating the
particular effective date of each such Policy .
TOWN OF ITHACA PLANNING BOARD
POLICIES
1 . It is a policy of the Town of Ithaca Planning Board to put forth a
good faith effort to assure that its membership represents to the
fullest extent possible each of those various neighborhoods compri -
sing the Town of Ithaca , to wit : Northeast Ithaca , South Hill ,
West Hill , East Ithaca , Forest Home , Lake Shore , Renwick Heights ,
and Elmira Road area .

2 . The Town of Ithaca Subdivision Regulations , as adopted by the Planning
Board on March 24 , 1956 , and approved by the Town Board on March 24 ,
1956 , are included herein as a policy .
3 . In matters of applications for subdivision approval , prior to Public
Hearing , developers shall provide the Planning Board with ten copies
.of the subdivision map and ten copies of the completed Environmental
Assessment Form and be prepared to accompany a designated committee
of the Planning Board on a tour of the proposed site with any other
separate documents such developer deems necessary or appropriate .

4 . In re any ad hoc committee appointed to tour a site proposed for
subdivision approval , permission for such committee to tour such
site shall be sought and received from the owner of such site prior
to entry upon such site . The Chairperson shall request such permis -
sion and the developer shall be responsible for obtaining verified
' permission from the owner or agent .

5 . The matter of parkland shall be considered with every subdivision
proposal presented to the Planning Board and shall be given due and
proper consideration with the Planning Board maintaining its prero -
gative for the decision -making as to the setting aside of. parkland ,
payment in . lieu of land , or there being no need for parkland to be
set aside , pursuant to Town Law , Section 277 , which gives the Planning
Board the right to require parkland within a subdivision , but does not
compel it to do so . Lot size , subdivision size , park size , nearby

parks , topography , etc . , shall be considered in the decision - making
process .

. 6 . As a courtesy to the citizenry of the Town of Ithaca , it is a policy
of the Planning Board to serve notice by mail of public hearings to
he held by said Planning Board for the consideration of requests for
changes in zoning districts , such notification being limited to a
reasonable number of adjacent neighboring property owners . This
courtesy in no way limits or supersedes the notification requirements
set forth in Town Law nor in the Open Meetings Law .

The Planning Board now looked at a proposed " How to Sheet " , as compiled
by Mrs . Fuller upon suggestion of the . by - laws committee . This is to be
a document prepared by the Planning , Zoning and Engineering Department
staff as an aid to developers inpresenting their proposals to the
Planning Board , and is a setting down on paper of the procedures that have
been and are followed by the staff . in apprising developers and / or owners
of the processes involved in presenting their requests . for the Board ' s
consideration . At this point. , this Sheet includes the ten copies require -
ment for subdivision plans and EAF ; the site touring requirement ; the
time limits for proper publication of notices of public hearing ; the
involvement of the Health Department ; the policy sheet .

RESOLVED , thELt the Planning Board of the Town of Ithaca agree and
hereby does agreEl that a " How To Sheet " may be prepared by the Engineering
Department to aid a developer in preparing the necessary documents for
presentation to the Planning Board .

ADJOURNMENT
Upon Motion , the Chair declared the July 22nd , 1980 , meeting of the
Town of Ithaca Planning Board duly adjourned at 8 : 35 p . m . , with the
reminder that the Planning Board meets next on September 9 , 1980 .

ARTICLE I NAME AND STATUTORY AUTHORITY
Section 1 . The name of this organization shall be the Town of
:Ithaca Planning Board ,
Section 2 . 'Phe Town of Ithaca . Planning Board is authorized by
and . operates pursuant to Town Law Article 16 , Sections
271 and 272 , having been established by the Town Board
of the Town of Ithaca by resolution on. February 6 ,
1937 .
ARTICLE II ORGANIZATION AND PURPOSES
Section 1 : The . Town of Ithaca Planning Board is organized as a
board .of eight residents of the Town of Ithaca , one of
whom is devoted to agricultural pursuits .
Section . 2 . The purposes of the Town of Ithaca Planning Board
( hereinafter referred to as " the Planning Board " )
: hall be to consult with and to advise the Town of
Ithaca Town Board ( hereinafter referred to as " the
• Town Board " ) on any matter relating to planning ,
including , but not necessarily limited to , the
following :
a . Assisting in the development of area-wide land use
goals , objectives , policies , and priorities ;
b . Assisting in the identification of specific plans
and programs designed to achieve the area -wide
land use goals . , objectives , policies , and
priorities ; .
c . Assisting in the coordination of planning activi -
ties in the Town of Ithaca ;
d . Serving as a forum for citizen participation and
for the dissemination of information on planning
issues having area -wide implications ;
e . Making comments and recommendations on any matter
referred to the Planning Board by the Town Board
pursuant to Sections 272a , 273 , 274 , and 275 of
Town Law .
Section 3 . The Planning Board shall be responsible for considera-
tion of preliminary and final subdivision requests .
The decision of the Planning Board with respect to
these matters shall be the final approval of the Town
of Ithaca pursuant to Sections 276 , 277 , 278 , and 281
of Town Law .

• Section 4 . The Planning Board shall be responsible for those
matters referred to it under the terms of the Town of
Ithaca Zoning Ordinance and the Town of Ithaca Sign
Law .
ARTICLE III MEMBERS
Section 10 Membership . Pursuant to Section 271 of the Town Law ,
members shall be appointed by the Town Board .
There shall be - a total of eight members of the
Planning Board , seven of such members being authorized
by Section 271 ( 1 ) of the Town Law and one additional
member being authorized by Section 2 .71 ( 2 ) of the Town
Law as an agricultural member who derives more than
one -half of his / her income from agricultural pursuits .
Section 2 . Term . Pursuant to Section 271 of the Town Law ,
appointments are for a seven year term , except in the
case oftheagricultural member whose appointment is
for a five year term .
Members may serve more than one term .
Section 3 . Nominations . . At public hearing duly and properly
called for such purpose , the Planning Board Chairper -
son shall appoint a nominating committee consisting of
four members , two of whom shall be members of the
Planning Board and two of whom shall be residents of
the Town of Ithaca but not members of said Planning
Board .
It shall be the duty of the nominating committee to
select at least one candidate for each Planning Board
seat to be filled . Such recommendation ( s ) shall be
presented to the Planning Board at. public hearing with
additional nominations from persons attendant at such
public hearing being permitted before any recommenda-
. tion ( s ) are made to the Town Board .
Section 4 . Vacancies . Vacancies in the membership due to death
or resignation shall be reported by the Planning Board
Chairperson to the Town Board .
Nominations to fill
these vacancies shall be made. in the same manner as
sept forth in Article III , Section 3 , above . Town .
Board appointments to fill vacancies shall be for the
remainder of the unexpired terms .
Section 5 . Duties . Members are expected to attend all regular
Planning Board meetings and to participate actively in
the work of the Planning Board . Absences caused by
illness or by personal matters of importance are

excusable : Three consecutive absences , without prior
notification , from regular Planning Board meetings by
Ci member of the Planning Board shall be considered as
basis for a recommendation by the Planning Board to
the Town Board that such member be relieved of duty .
ARTICLE IV _ OFFICERS
Section 1 . Officers . There shall be a Chairperson and a Vice
Chairperson selected from the membership .
Section 2 , Duties . , The Chairperson shall preside at all meetings
and shall have the usual powers and duties assigned to
that office .
The Vice - Chairperson shall perform the duties in the
absence of the Chairperson .
Section 3 . Nominations . The Planning Board Chairperson shall
appoint a nominating committee consisting of three
Planning Board members at the first regular meeting
of the Planning Board in November of each year .
It shall be the duty of this nominating committee to
recommend to the Planning Board at least one candidate
for each office at the first regular meeting of the
Planning Board in December of that year . The Planning
Board , at that first regular meeting in December , shall
consider the recommendations of the nominating . commit -
tee and any additional nominations from the membership
and make their recommendation to the Town Board . This
recommendation shall be submitted by the Planning Board
Chairperson to the Town Board for their designation to
take effect at the first regular meeting of the
Planning Board in January of the following year . In
the event that the Town Board fails to designate such
officer prior to the first regular meeting of the
Planning Board in January of the following year , the
Planning Board shall elect such officers from its own
members .
Section 4 . Term of Office . The term of office shall begin at the
opening of the first regularly scheduled meeting in
January and terminate at the same time the following
year
Section 5 . Filling of Vacancies . A vacancy in the office of
Chairperson before
f the expiration of the term of office

shall be filled by elevation of the Vice - Chairperson .
A vacancy in the office of Vice - Chairperson during the
term of office shall be filled by appointment by the
Town Board upon the recommendation of the Planning
Board .

• .Appointments to fill vacancies occurring during the
term of office shall be made for the remainder of the
unexpired term .
Section 6 . 'Voting . The Chairperson and Vice - Chairperson shall
he eligible to vote on all matters coming before the
Planning Board .
ARTICLE V MEETINGS AND PROCEDURES
Section 1 . Meetings . The Planning Board shall hold monthly
meetings on the first Tuesday of the month . ,. except as
otherwise order by the Chairperson .
Special meetings may be called by the Chairperson and
shall be called upon written request of five members .
The purpose of such meeting shall be stated in the
call ; notice sufficient for publication in the official
newspaper ( s ) of notices of public hearing shall be
given with no less than three days ' notice given in all
other cases .
All such meetings shall be held in accordance with the
Open Meetings Law of the State of New York .
Any such meeting may be adjourned to a definite date by
a majority vote of a quorum of members .
Section 2 . Voting . Voting shall be by voice or a show. of hands ,
unless a roll call is requested .
A resolution or other business shall be considered
adopted if a majority of the votes cast is in the
affirmative , a quorum being present .
An abstention from voting shall not- be considered a
vote cast in determining a majority .
A quorum shall consist of five ( 5 ) of the members .
Section 3 . Minutes of Meetings . Minutes of the meeting shall be
prepared by the Recording Secretary employed to per -
form this duty and shall be presented to the Planning
Board for approval .
Section 4 . Special Orders . Each resolution , recommendation , or
report which is directed to a particular unit of
government , agency , board , or the public , shall specify .
to whom it is directed and to whom written. copies
shall be forwarded . It shall be the duty of the Town
Planner to transmit promptly any and all such resolu -
tions , recommendations , or reports .

. ARTICLE VI COMMITTEES
Nominating Committees shall be created as specified in Article III ,
Section 3 , and Article IV , Section 3 . The Planning Board may create
and terminate Standing and Ad Hoc Committees , composed of members of
the Planning Board . The Chairperson may also create and terminate
Ad Hoc Committees . The Committees shall perform such duties as may
be delegated to them by the establishing motion or by the Chairper -
son . In the absence of specific Committee appointments in the
establishing motion , the Chairperson shall appoint Committee members , .
including the Committee Chairperson . The Committees may select such
advisors from outside the membership as they may deem necessary to
perform their tasks .
ARTICLE VII TAFF SUPPORT
The Town Planning , Zoning , and Engineering staff shall provide such
support as may be requested by the Planning Board , within fiscal and
staff limitations .
ARTICLE VIII PARLIAMENTARY AUTHORITY
The rules contained in the current edition of Robert ' s Rules of
Order , Revised shall govern the Planning ..Board in all cases to which
they are applicable and when they are not inconsistent with State or
• Town Law , these, By - Laws , and any special rules of order adopted by
the Town Board ,
ARTICLE IX AMENDMENTS
These By - Laws can be amended at any regular meeting of the Planning.
Board by a two - thirds vote , provided that the amendment has been
submitted in writing at the previous regular meeting and circulated
to all Planning Board members prior to the voting meeting . Any such
amendment shall take effect upon approval of the Town Board .

In . re : Proposed Abandonment of Hudson Street Exteris bn
WHEREAS , Hudson Street Extension as presently platted was
deeded to the Town . of Ithaca by Therm Electric Meters Co . , Inc .
in 1953 ; and
WHEREAS , in 1953 Hudson Street Extension served property
other than that owned by Therm , Inc . ; and
WHEREAS , Hudson Street Extension no longer serves . any
property other than that owned by Therm , Inc . , Therm ; Inc . having
purchased all surrounding lands directly served or with a possibility
of being served in the future ; and
WHEREAS , Therm , Inc . has now requested that the Town Board
abandon Hudson Street Extension as a Town Highway ,
NOW , THEREFORE , BE IT RESOLVED , by the Planning Board of the
Town of Ithaca that Hudson Street Extension be considered for legal ,
abandonment by the Town Board of the Town of Ithaca .
