The Town of Ithaca Planning Board met in regular session on
Tuesday , June 3 , 1980 in Town Hall , 126 East Seneca Street , Ithaca , New
York , at 7 . 30 p . m .

Chairman Aron declared the meeting duly opened at 7 : 30 p . m . and
accepted for the record the Clerk ' s Affidavit of Posting and Publication
of the Notices of Public Hearings ( 3 ) in Town Hall and the Ithaca
Journal on May 23 and 27 , 1980 , and May 29 and June 2 , 1980 ,
respectively .
Chairman Aron read aloud the following Memorandum from Town
• Supervisor Noel Desch to the Chairman of the Planning Board dated May 6 ,
1980 : " Please express my appreciation to the members of the Planning
Board for the exeptionally fine job you all have done to update our sign
ordinance . I have circulated a copy to each of the Town Board members
and expect to have a public hearing at our regular Town Board meeting on
June 9 , 1980 , to consider its adoption . % I am also interested in the
status of your work on Planning Board procedures . Can you tell me when
you expect to have this in a form adoptable by the Town Board ? "
APPROVAL OF MINUTES - November 1 , 1977

REPORT OF THE BUILDING INSPECTOR - Lewis D . Cartee
On behalf of Mr . Cartee , Mr . Fabbroni reported that 6 permits were
issued during the month of May 1980 for $ 37 , 000 . 00 in improvements , as
compared with 22 permits issued in May of 1979 for $ 293 , 163 . 00 in
improvements . Mr . Fabbroni also commented on two houses which were
moved and the upcoming 32 units of Ellis Hollow Multiple Family which is
the first phase of 101 units being developed by Ivar Jonson ( Clivark ) .
REPORT OF THE rCOWN ENGINEER - Lawrence P . Fabbroni
Mr . Fabbroni reported that the Trumansburg Road Tank has been
emptied and sand blasted and painting is being proceeded with . Mr .
Fabbroni reported that the Stone Quarry Road cleanup is just about
completed . Mr . Fabbroni reported that there is a little way to go on
cleanup with regard to the West Hill sewer . Mr . Fabbroni reported , with
• regard to the painting of Town Hall , that there have been a couple of
snags - - painters ' strikes , etc . , so it will probably be a couple of
months before startup . Mr . Fabbroni reported that his primary work
right now is anticipating the CETA work crew in connection with the park
building program . Mr . Fabbroni reported on a number of drainage
problems and the status of Tareyton Drive and Muriel Street . Mr .
Fabbroni reported that the Highway Department is presently doing paving
work to take advantage of present prices , commenting that normally at
this time of year they do drainage and patch up . Mr . Fabbroni described
the special projects of the summer with drainage normally attended to
this time of year . Mr . Fabbroni reported that there has been a lot of
activity with regard to traffic counting which is being done for the
whole Town . Mr . Fabbroni commented that within the next month he hoped
to have a map - full for traffic all around the Town .
Chairman Aron commented that Mr . Fabbroni ' s report was very
interesting and asked if Mr . Fabbroni had something on traffic to which
he could go back to make a comparison . Mr . Fabbroni stated that he did
have in some cases - - South Hill , for example . Mr . Fabbroni commented
that there is a lot of activity now amongst the Cornell community and
the Town discussing the Forest Home by - pass and the East Ithaca
connector . Mr . Fabbroni stated that they are , at this point , two
separate projects , though there are still discussions where , or if , each
will go . Mr . Fabbroni discussed the status at this point and how it is
rather a mixed bag .
REPORT OF THE TOWN PLANNER - Barbara Z . Restaino
Planning Board 3 June 3 , 1980
• Mr . Stanton asked about the status of the Tareyton Park , wondering
if it would happen this year or next year . Mrs . Restaino stated that it
should happen this summer if we are quick and if the Feds come through ,
adding that there is not a whole lot more to do because it depends upon
finishing the backstop and filling in with top soil . Mrs . Restaino
stated that the grass is taking pretty well as a result of the
reseeding . Mr . Stanton commented that people are pleased , obviously .
Mr . Stanton wondered about Forest Home . Mr . Fabbroni stated that he has
not gone back to Dick Lewis .
Mrs . Bronfenbrenner wondered what the final hookup date is for
sewer , to which Mr . Fabbroni replied , July 1981 .
Mrs . Restaino reported that the last leg of the draft of the new
zoning ordinance will go to the Attorney within the next two or three
weeks which is good news for us . Mrs . Restaino stated that we have been
working on it for two or three years now and people before us have too
for several years . Mrs . Restaino stated that we are finally making some
progress .
Mr . May stated that he had a general question concerning youth
playgrounds and asked if Mrs . Restaino had talked to anyone with
negative comments . Mr . May stated that the school system in the
Northeast is somewhat negative and has mentioned maintenance , costs ,
injuries , etc . Mrs . Restaino stated that this is a school district
problem , commenting that it sounds like they should take it down .
• PUBLIC HEARING : CONSIDERATION OF SITE PLAN APPROVAL FOR A CAR WASH IN A
BUSINESS " D " DISTRICT AT EAST HILL PLAZA , TAX PARCELS NO , 6 - 62 - 2 - 1 . 121 ,
6 - 62 - 2 - 12 , 6 - 62 - 2 - 1 . 13 . STEWART KNOWLTON , PARTNER , GROFF ASSOCIATES .
Chairman Aron declared the Public Hearing in the above - noted matter
duly opened at. 7 : 48 p . m . and read aloud from the Notice of Public
Hearings as posted and published and as noted above . Mr . Knowlton was
present and appeared before the Board . Chairman Aron stated that every
Board member had received a brochure of materials compiled and prepared
by Mr . Knowlton with respect to the proposal before the Board . Chairman
Aron congratulated Mr . Knowlton on a job very well done and stated that
this type of presentation makes the Planning Board job a little easier .
Mr . Knowlton stated that he appreciated Chairman Aron ' s kind words .
Mr . Knowlton stated that in going back in the researching of the history
of the " D " and " C " zones of the Barnes Farm as we knew it some twelve
years ago , he thought it would be helpful to set that down in the
booklet in order to provide some historical background as to what has
been going on there . Mr . Knowlton stated that the booklet describes the
rezonings that took place in 1968 whereby the " C " zone and the " D " were
created . Mr . Knowlton stated that entire property , some 22 acres , was
rezoned as " C " and a portion as " D " , with the portion as " D " lying right
along Judd Falls Road north to the back corner of the P & C . Mr .
Knowlton stated that he tried to build the background of the Barnes Farm
• and the entire project so the Board could see what they have dealt with
to make the development pattern meet the scope of the 1968 rezoning .
Mr . Knowlton stated that twelve years ago there was consideration for a

• number of things and pointed out Exhibit " D " in the booklet which showed
the original rendering of the Plaza development indicating the number of
things which were considered as part of that development . Mr . Knowlton
pointed out in the booklet an article from the Ithaca Journal , May 14 ,
1969 , [ Exhibit E ] , legal notices , Minutes , Tax Map # 62 [ reduced ] , and
stated that all of this reflects the development of the Barnes property .
Mr . Knowlton utilized an aerial photo , commenting that it is more
current in order for the Board to see how they were affecting the
neighborhood and the local residents . Mr . Knowlton stated that , using
the Barnes property as the center , he would refer to a half mile of
roads and , within the scope of that half mile of roads running north ,
east , south , and west , he would point out that to the north there is no
residential property , just Eastern Artificial Breeders and their
acreage , easterly there are three residences with all the rest Cornell
property , south there is the Sheep Farm and then the Swine Farm . Mr .
Knowlton stated that in the one - half mile of roads are Pine Tree Road
and Snyder Hill Road and the first house does just fall into this circle
[ indicating ] . Mr . Knowlton stated that to the west there is the other
" C " zone in which is the house on the corner - - the EAI house rented to
employees and -the Marine Midland Bank , the Bowling Alley and the Skating
Rink . Mr . Knowlton pointed out the little old schoolhouse which is a
residence and -the caretaker ' s house for the Cemetery . Noting again that
this is all in that one - half mile of roads , Mr . Knowlton stated that
this is also a large buffer zone and which , also , has actually four
residences , as you would call them , houses .
• Referring again to the booklet , Mr . Knowlton noted that there are
Minutes of the zoning Board of Appeals meeting of February 19 , 1975 ,
where a car wash was proposed in the " C " zone - - where the Depot is now ,
and stated that that request was denied because the Board felt a car
wash was a Business " D " use . Mr . Knowlton showed where the " D " zone of
the East Hill Plaza goes , noting that it is just as it was established
in 1968 . Mr . Knowlton stated that they are proposing a four -bay type of
unit in " this "' parking lot [ indicating ] as an adjunct to the gas
service . Mr . Knowlton stated that he would describe the reasons for
this request - - ( 1 ) requests that are being made to them by the public
which are getting to be a large quantity , particularly since the gas
unit is there and the cars are there , ( 2 ) on - site as opposed to behind
the P & C so as to take care of the people in their parking lot and
serve them ; ( 3 ) 8 . 3 miles from the Credit Union to Elmira Road and back
which is a problem with gas approaching $ 2 . 00 per gallon . Referring to
the shopping center itself , Mr . Knowlton stated that they have talked
about a post office substation and commented that the Federal government
moves very slowly . Mr . Knowlton stated that a post office and a car
wash - - that kind of service - - is a fulfillment of a need that is
there , adding that they hear about it all the time . Mr . Knowlton stated
that such a facility does not offend anybody and is nothing new and is a
focal point for " these " cars [ indicating ] and available to the gas unit
as an adjunct to it .
Mr . Knowlton stated that the proposed facility is a very
• simplified , masonary , secured block type of unit with a truss roof which
0s a good looking , not flat , roof . Mr . Knowlton distributed photographs

• of a similar structure , pointing out that his request is for four - bays
which is not as big as the one in the pictures .
Chairman .Aron asked what the proposed total length is , to which Mr .
Knowlton responded , 74 ± feet . Mrs . Bronfenbrenner wondered which way
was in and which way was out . Mr . Knowlton described in as south and
east and exit east . Mrs . Bronfenbrenner commented that that would mean
exiting into traffic from the gas station . Mr . Knowlton pointed out
that the facility is to be recessed back some 15 feet from the traffic
lane or " drive lane " .
Chairman Aron asked if there were any comments from the public .
Town Councilwoman Shirley Raffensperger , 139 Pine Tree Road , spoke
from the floor and asked if the Secretary had received anything from the
public . Chairman Aron stated that Mrs . Fuller had received telephone
calls from Nancy Krook and Mrs . J . Robert Cooke , which would be a part
of the record . Councilman Marc Cramer pointed out that Town Hall is
open to the public during the day for anyone who wishes to discuss Board
agendas . Mrs . Raffensperger asked Mr . Knowlton if he had prepared the
booklet which she had not seen before tonight . Mr . Knowlton stated that
he had . Mrs . Raffensperger commented on both Town Board and Planning
Board Minutes of meetings which took place in 1968 with respect to what
is now East Hill Plaza , stating that missing from the booklet are
hundreds of public comments with concern about traffic . Mrs .
Raffensperger stated that a most undesirable situation still exists in
• spite of assurances with each rezoning approval , although there has been
some slight progress to do something about hazardous traffic that the
neighborhood sees . Mrs . Raffensperger pointed out that merely one - tenth
of a mile beyond the shopping center is a residential neighborhood which
is one of the oldest in the Town of Ithaca and which is facing
increasing difficulties in its residential development . Mrs .
Raffensperger stated that matters have gotten worse even though in 1968
the understanding then was that Kennilworth would make an effort to do
something about the traditionally hazardous intersection on Judd
Falls / Ellis Hollow Roads , but now there is increased traffic with other
intersections added . Mrs . Raffensperger described enormous difficulties
for drivers , commenting that one minute you are on Judd Falls Road and
there is , you think , no one there , and then , someone is there . Mrs .
Raffensperger stated that you cannot make an intelligent , safe ,
judgement as to whether you can go through that intersection . Mrs .
Raffensperger commented that a car wash in itself may be alright , but ,
then without solving the traffic problems you have to deal with the
traffic it generates . Mrs . Raffensperger pointed out that a " by - pass "
was discussed twelve years ago and pointed out further that eighteen
years ago she was shown a map of it . Mrs . Raffensperger stated that
that is a long time to wait . Mrs . Raffensperger stated that she thought
the Planning Board should suggest that the Town Board vigorously pursue
a change in the 55 mph speed and also a change in the entrance and exit
into the service station back to what the Planning Board had recommended
which was only an entrance and not an exit .
• Chairman Aron read the following note prepared by the Secretary :
Planning Board 6 June 3 , 1980
• " Telephone Call from Nancy Krook , 113 Pine Tree Road , May 30 , 1980 , in
re the proposed car wash at East Hill Plaza .
Mrs . Krook will be unable to attend the Planning Board Meeting on June
3 , 1980 , because of a prior commitment to a School Board meeting . She
asked that her comments be entered into the record of the Hearing with
the Planning Board Secretary acting as her agent .
1 . Mrs . Krook is opposed to the addition of a car wash at the East
Hill Plaza .
2 . Mrs . Krook is opposed to the addition of traffic on a road system
that cannot handle what it has already .
3 . The Boy Scouts presently have to pick up the garbage from the
businesses) at Ide ' s Bowling Alley and Skate City ,
4 . The area presently looks like the South Bronx and a car wash would
make it even worse .
5 . It was clearly the intention of the re - zoning for the Plaza that
the area was to be a ' neighborhood convenience center ' .
6 . Any more curb cuts or irregular traffic patterns should not occur
there .
7 . Why must Hie have an instant Elmira Road ?
8 . The neighbors are fleeing the area because of the Judd Falls
Road / Ellis Hollow Road area mess . Several homes are presently for
sale . "
Chairman Aron also read the following note from the Secretary :
" June 3 , 1980
• Mr . & Mrs . J . Robert Cooke
142 Pine Tree Rd .
1 . The intersection is terrible and extremely dangerous .
2 . No more traffic - producing facilities .
3 . Pulling out of Judd Falls Road and Ellis Hollow Rd . intersection is
dangerous ; a lot of traffic - - a car can come up Mitchell St . & if
it is going at any speed it is upon you even though you have looked
around .
4 . The odd alignment of roads is a problem
5 . Something serious is going to happen .
6 . Opposed because of traffic , not car wash , per se . "
Councilwoman Raffensperger stated that she had received telephone
calls from David Macklin and Dick Fischer , both of whom expressed their
opposition to this proposal .
Chairman Aron stated that he would like to say , with respect to the
traffic into the gas station , that he has mentioned it many times that
this Planning Board when it gave approval for that gas station , it
designed a one - way street to get into it - - it was the Town Board who
re - designed it . Mrs . Raffensperger stated that she agreed with Mr . Aron
and asked why does the Planning Board not tell the Town Board that it
was right . Chairman Aron commented that the Planning Board cannot
penalize things for things that have been undone . Chairman Aron asked
about the Town Board committee that has been involved with traffic .
• Mrs . Raffensperger stated that one of the members had talked to Mr .
Knowlton about stop signs , commenting that this also eliminates the
Planning Board ' s wise decision of there being an entrance only . Mrs .
Planning Board 7 June 3 , 1980
• Raffensperger stated that it was her understanding that Mr . Knowlton
told Councilman Powers that these things were not possible under the
terms of the .Lease with the gas station . Mrs . Raffensperger commented
that Supervisor Desch had assured her that he would contact Mr .
Knowlton . Mr . Knowlton stated that he had not .
Chairman .Aron asked if Mr . Fabbroni could tell the Board more about
the increase in the traffic about which everyone seems to be talking .
Mr . Fabbroni stated that from the time staff observed this intersection ,
which was in the Spring of 1977 to this past Spring , there has
definitely been an increase of traffic on the Ellis Hollow leg coming
from the City and the Judd Falls way coming to this corner . Mr .
Fabbroni stated that there is no conclusion as to the Ellis Hollow leg ;
there really has not been much of a change on either of those two legs .
Mr . Fabbroni stated that he would have to do another detailed study of
the traffic at that intersection . Mr . Fabbroni stated that all those
cars were coming from the City and back and there is definitely an
increase on those two legs . Chairman Aron asked how much of an increase
occurred . Mr . Fabbroni stated that he would say a 20 % increase occurred
on those two legs . Mr . May wondered how close that was to saturation .
Mr . Fabbroni responded that it was not even close . Mr . Fabbroni stated
that the problem remains the awkward intersection as everyone admits .
Mr . Fabbroni stated that the solution is simple , however , it is not a
simple solution politically and added that the solution could be built
in two months ' time and designed in two days ' time , but whatever the
maze is to agreement with Cornell , and other parties , is what has made
• it go on for twelve years . Mr . Fabbroni stated that the sound way to
approach it is to relocate Pine Tree Road , regardless of where it goes ,
to Ellis Hollow and Jonson ' s apartments and then to restrict certain
movements in and out of the Plaza . Mr . Fabbroni described the
1 , 000 - foot intersection . Mr . Fabbroni commented that such an
improvement would eliminate 90 % of the safety problem with very
difficult exits . With respect to traffic volumes , Mr . Fabbroni stated
that for six years he has listened to folks from Mrs . Raffensperger ' s
neck of the woods , and speed must be the problem because the numbers are
so small they Eire inconsequential . Mr . Fabbroni described the volumes
in Forest Home and in the Northeast , commenting that the number once
south of Snyder Hill Road is so small that it is really a speed problem .
Chairman Aron asked what the speed limit is from the corner of Judd
Falls and Ellis Hollow passing the shopping center to the elderly
apartments . Mr . Fabbroni stated that it has been lowered to 35 mph ,
however , between Snyder Hill and the intersection it is 55 mph . Mr .
Fabbroni stated that with regard to the section Mr . Aron was talking
about , the Town finally convinced the State to lower to 35 mph from the
City line , and , Judd Falls Road is 35 mph . Mr . Fabbroni stated that
everything is 35 expect the strip that Mrs . Raffensperger talked about .
Chairman Aron asked if that was the State ' s responsibility . Mr .
Fabbroni stated that we tried several years ago to get an area speed
limit through , however , the response we got back was the State ' s famous
speed study . Mr . Fabbroni commented that it depends on where they pick
• to use the numbE! r from - - the swine barn or Mrs . Raffensperger ' s house
- they get a number and there ' s your speed . Mr . Fabbroni described
certain other criteria such as driveways , 100 - foot geometrics , Pine Tree

• Road , straight as an arrow , new shoulders , perfect alignment road . Mr .
Fabbroni stated that when you get done with their criteria you are back
to 55 mph for the whole road . Mr . Fabbroni stated that they did that
for the whole Town and their conclusion - - road by road requests ; 35 mph
for the whole east end of the Town was not warranted . Mr . Fabbroni
stated that thin. Town did not agree and does not agree .
Mrs . Raffensperger stated that it is not just an immediate
neighborhood concern , adding that a large number of people in the area
go to Cornell lots and the Cornell Campus . Mrs . Raffensperger noted
that Mr . Fabbroni had talked about increase in traffic in two years , and
stated that the neighborhood is talking about the period of time from
the development of the shopping center until now with the increase
percentage very large there for not having improved the intersection .
Mrs . Grigorov wondered if the Planning Board could make a report to the
Town Board . Chairman Aron stated that it could .
Mr . Knowlton stated to Mrs . Raffensperger that what she was saying
he agreed with almost 100 % . Mr . Knowlton stated that he did not think
he had ever made a statement to one soul about being able to improve the
intersection , adding that he cannot . Mr . Knowlton stated that in 1968
they [ Groff ] dedicated the right of way for the by -pass , adding that
that was four and one - half acres in reservation , and commenting that
that was twelve years ago and a great concession to make , to grant
whichever the municipality is to align Pine Tree Road with this road .
Mr . Knowlton stated that he cannot do anything about that , adding that
• he did meet wi 4p_h a young man from the County and showed him and Noel
Desch and Bob Flowers an area of pavement attached to Pine Tree Road to
Judd Falls Road that is 116 feet wide with room for five cars abreast .
Mr . Knowlton , commenting , " Good Lord , I will paint stakes , anything , but
I cannot do it . " , stated that he would take the signs down on the 55 mph
zone and added that maybe it would be good for him to get arrested for
taking the sign down . Mr . Knowlton stated that he has never asked for a
rezoning to the best of his knowledge - - site plan approval , yes , within
the scope of what was done in 1968 . Mr . Knowlton stated that he was
sympathetic to the problems , adding that he has volunteered to do
anything . Mrs . Raffensperger asked Mr . Knowlton if he would make the
entrance and exit one way . Mr . Knowlton replied , no , because that is
not the answer , and added that the center line is three cars wide and
the jog is very dangerous .
Chairman Aron declared the Public Hearing closed at 8 : 30 p . m . and
asked for Board discussion .
Mr . Stanton stated that he assumed there would be a fair amount of
water in a car wash and asked where it came from and where it would go .
Mr . Knowlton stated that both water and sewer are entirely within their
right of way . Mr . Stanton wondered if there were plenty of room for
draining it out . Mr . Knowlton stated that there was - - into the sewer .
Mr . May , commenting about the water draining into the bays , wondered
about winter freezing , and noted that there would be a fair amount of
• ice out into the parking lot . Mr . Knowlton stated that would not really
be the case if you use infra red lights as a blotter for what the unit
actually discharges .

• Mrs . Bronfenbrenner commented that , in many ways , we , the public ,
and some of us too , are dealing with the problem of the original
hearings wherE! a " neighborhood shopping center " was described with a
density as existing under the zoning ordinance and not any amounts .
Mrs . Bronfenbrenner stated that the public hears these things mentioned
and then they feel we have a vote on this . Mrs . Bronfenbrenner stated
that we have to be extremely careful about what we vote upon , adding
that this is not really what it was said to be . Mr . Knowlton asked ,
" What is a neighborhood shopping center ? " Mrs . Bronfenbrenner responded
that she did not know , but they were told that is what it was . Mr .
Knowlton stated that in his industry , a neighborhood shopping center is
250 , 000 square feet , and added that there are community shopping centers
and regional shopping centers . Mrs . Bronfenbrenner commented that Mr .
Knowlton had mentioned 200 , 000 square feet as was also mentioned in the
booklet , and asked whether that number had been amended . Mr . Knowlton
replied that under the ordinance the shopping center could be around
240 , 000 square feet . Mrs . Bronfenbrenner pointed that at the time it
was not specifically that figure for that shopping center . Mr . Knowlton
stated that he really could not comment any further because all of those
people - - Kennilworth - - are gone .
Mrs . Grigorov wondered whether or not a car wash is definitely
permitted in a Business " D " zone and , also , who was going to run the car
wash . Mr . Fabbroni responded that Business " D " includes gas stations
and , as to the car wash aspect , he had asked that question of the Zoning
Board of Appeals four years ago . Mr . Mazza asked what the size of the
• shopping center is now , with Mr . Knowlton responding 97 , 250 square feet
of building plus 723 spaces for parking . Mr . Knowlton stated that there
would be no loss in parking spaces because of the car wash .
Chairman Aron asked Mr . Knowlton if he expected an increase in
business because of the car wash . Mr . Knowlton responded that he
honestly did not because it is too much of an on - site location ,
commenting that they will already be there shopping , etc . , and adding
that for as small a unit as it is which is on - site there probably will
not be much increased business . Mrs . Bronfenbrenner stated that the
traffic pattern problem concerned her , commenting that this seems to be
right on line with that pattern . Mr . Knowlton quipped that he would
volunteer to put a bump there , to which Mr . May responded with a
resounding " no " . Mrs . Grigorov wanted clarification of her thoughts
that the cars would be coming in at a certain spot and would be exiting
at another spot „ Mr . Knowlton clarified the in and out question using
the drawing .
Chairman Aron asked that the Board turn to the matter of the Short
Environmental Assessment Form , marked " Exhibit G " in the booklet , as
signed and submitted by Stewart D . Knowlton under date of May 27 , 1980 .
Chairman Aron stated that the Planning Board would act as lead agency in
the matter of environmental review . Chairman Aron stated that the Short
EAF had been answered in the negative and had been reviewed by the Town
Planner , Mrs . RE! staino , on June 3 , 1980 , with a recommendation for a
• negative declaration . Chairman Aron asked for discussion on the EAF .
Mr . May stated , with respect to Item # 15 - " Is there public controversy
concerning the project ? " - - that he thought the Board had to address the
Planning Board 10 June 3 , 1980
• fact that there is public controversy . Mrs . Bronfenbrenner stated that
she also thought there should be some discussion of Item # 11 - " Will
project result: in major traffic problems or cause a major effect to
existing transportation systems ? " Mr . Mazza commented that this
particular project will not cause traffic problems . Mr . Stanton stated
that he agreed with # 15 being an issue . Mr . Knowlton changed # 15 to
" Yes " and initialled the Short EAF .

Chairman Aron asked if there were any further discussion with
regard to Exhibit " H " - - an over view of the entire area showing the
proposed car wash unit in relation to the self service gas station ,
plaza stores , Judd Falls Road and the parking area , with the car wash
unit shown in red .
Mr . Fabbroni asked Mr . Knowlton what the size of the pipe which
discharges the water in the roadside drain will be . Mr . Knowlton stated
that it will be a 4 " pipe . Mr . Fabbroni stated that he had no problem
with a 4 - inch pipe . Mr . May offered the comment that this will go into
the sanitary sewer . Mr . Fabbroni stated that Mr . May was right and
inquired about an interceptor . Mr . Knowlton stated that there is a
1 , 000 gallon settling tank from which each one of the bays flows into to
collect before it goes into the sewer system itself . Mr . Knowlton also
• spoke about a sump in each bay - - all collecting into this one 1 , 000
gallon tank . Mr . Knowlton stated that this operation does not need a
permit from the Health Department other than the normal hookup . Mr .
Planning Board 11 June 3 , 1980
• Fabbroni stated that an oil separator should be there . Mr . Knowlton
stated to Mr . Fabbroni that he would talk to him about that and would do
whatever he required . Chairman Aron wondered who was building the car
wash and if he was a qualified person . Mr . Knowlton stated that the
builder was qualified . Mrs . Grigorov wondered what color the roof was
going to be . Mr . Knowlton stated that it would be in beige / brown / tan
color range and would be a shingled roof .
Mr . May stated that he was not sure that a four -bay car wash in
that location is going to be the most desirable from a possibility of
size build - up and from the viewpoint of Judd Falls Road . Mr . May stated
that he was not totally opposed to a car wash but he was not sure about
that location in the middle of the parking lot . Mr . Knowlton noted that
to the 21 parking spaces they are adding about 80 . Mr . May stated that
ice is a concern , adding that that is going to be a traffic lane there
close to the building and noting that Mr . Knowlton was quite right that
it is 15 feetaway , however , people will be passing closely . Mr .
Knowlton stated that the prime reason for the location is the " D " zone ,
adding that that location is the only one that fits within that scope .
Mr . Knowlton commented that what he was hearing Mr . May say in his
comments is that he did not like it out here in the parking lot . Mr .
May stated that he would ask this Board if a car wash is desirable or
best in that location just because it is the " D " zone and the rest is
" C " . Mr . Knowlton stated that the only other possibility is in the " C "
zone behind the P & C . Mrs . Bronfenbrenner wondered about next to the P
& C . Mr . Knowlton thought it would be too crowded there . Mr . May
. recalled that McGuire and Bennett had been considering using that area
for storage and asked if they had decided not to use that area . Mr .
Knowlton stated that he had not heard anything from them so he took that
absence of contact , if you will , a negative . Mr . Knowlton suggested
that another point would be to put it completely behind , i . e . , behind
the Depot in the " C " area . Mr . May wondered about the " green " area
shown on the drawing on Ellis Hollow Road and asked if it were to be
maintained as green space . Mr . Knowlton stated that that was the plan
right now , adding that he was not being evasive . Mr . Mazza wondered if
an island to deter traffic could be created . Mr . Knowlton commented
that they are serving on - site people , not highway public . Mr . May
commented that , for himself , he would be far more comfortable with the
car wash by the Depot . Mr . Mazza pointed out that this still leaves the
" D " zone in place . Mrs . Bronfenbrenner wondered if there could be a
trade - off - - the! " C " to " D " and the " D " to " C " . Mr . Knowlton commented
that the Board was hitting him really quickly with that idea but he did
not see any real problem with that . Mr . Fabbroni noted that the part
that is zoned " D " has a metes and bounds description as shown on
Exhibits " C " and " I " in the booklet presented by Mr . Knowlton and
excluded anything except that area . Mr . Fabbroni suggested a grant of a
" D " area sufficient just for the car wash . Mr . Stanton wondered if this
would be in the interest of the users , adding that it seemed to him to
add one more approval of the lot access way . Mr . Knowlton described the
main entrance into the Depot and stated that they need that access . Mr .
May pointed out , also , the entrance from the hardware store , adding that
if the car wash were serving the people in the shopping center , it would
be their intent to go there . Chairman Aron commented that if Mr .
Knowlton were to wish to leave it in the " D " zone , there would be the

matter of the winter water and icing . Chairman Aron asked Mr . Knowlton
if he could control the de - icing of the area . Mr . May commented that
more salt would be necessary and Mr . Mazza commented that that would
mean more use of the car wash . Mr . Knowlton confessed that he did not
know how to answer that question . Mr . Stanton stated that the car wash
was visually better back there behind the P & Co Mr . May stated that he
wished no offense , but he agreed .
Chairman Aron asked Mr . Knowlton if he would be willing to withdraw
his request and place the car wash in the " C " zone , adding that Mr .
Knowlton should realize that the Planning Board can only recommend to
the Town Board in matters of rezoning . Mr . Mazza stated to Mr . Knowlton
that he would not give up any of his rights if he were to follow this
course , adding that he could come back with this proposal . Mr . Knowlton
stated that , under the circumstances and for the reasons being
discussed , he would consider the relocation of the project into the " C "
zone in behind the Plaza to the east of the Depot Restaurant parking
lot , and , he will so request . Mr . Knowlton asked the Chair if he may
submit his withdrawal . Chairman Aron stated that he accepted the
withdrawal request .

Iacovelli described lot 2 . Mr . Fabbroni stated that the drainage should

wondered what the structures are that are shown on the drawing as little
boxes . Mr . Iacovelli stated that they are existing houses . Mr . Mazza
asked how far the one existing house closest to the proposed cul - de - sac
is from that road . Mr . Iacovelli stated that it was about 25 ' . Mr .
Fabbroni stated that a curved right of way alignment rather than the
angled one as shown would not interfere with the 200 ' frontage shown for
lot numbered " 1 " . Mr . Mazza wondered why it was cornered like that .
Mr . Fabbroni stated that it could be curved easily , adding that if he
builds the road. where shown - - no problem . Mr . Fabbroni stated that it
would be fine , also , if he [ Iacovelli ] wants to give the Town extra

REPORT OF THE COUNTY PLANNING BOARD CHAIRWOMAN - TOWN COUNCILWOMAN
SHIRLEY RAFFENSPERGER .
Councilwoman Raffensperger reported on the May 14 , 1980 meeting of
the County Planning Board and stated that the meeting dealt mostly with
several continuing problems involving the role of various County
advisory boards in the planning process , the discussion leading to a
re - evaluation of their function and the formation of a committee to work
on the structure of advisory committees made up of Eleanor Bayley ,
Raymond Hemming , Gould Colman , Barbara Caldwell , and Shirley
Raffensperger . Councilwoman Raffensperger reported that a Resolution
was adopted as a part of this discussion , for transmission to the
interested parties - - Common Council , Board of Representatives , and
municipalities , as follows : " The Tompkins County Planning Board
recommends that when members are appointed to planning advisory boards
such as the Ithaca - Tompkins County Transportation Commission ,
Environmental :Management Council , and the Economic Advisory Board ,
emphasis should be placed upon that member ' s potential to increase the
Board ' s capacity to ( 1 ) define problems , ( 2 ) identify feasible
responses , and ( 3 ) inform the public , the Tompkins County Planning
Board , and decision -making bodies concerning these responses . "
Councilwoman Raffensperger reported on a discussion in this vein with
respect to reducing overlap and potential conflict . She spoke of a
• " lead agency role " , in other words , a " lead board " as the agency
responsible for providing advice to the County Board of Representatives
on a particular category of actions , with a " non - lead board " still
having ample opportunity for involvement through the " lead board " .
Councilwoman Raffensperger described this concept as a possible
technique to tidy up the process and helping to delineate more clearly
who is responsible before a matter goes on to the Board of
Representatives process .
Councilwoman Raffensperger reported on a discussion held which was
a continuation of the problem of the transportation of radio - active
materials , with the Board members suggesting possible controls on the
transporting of radio - active materials . Councilwoman Raffensperger
reported that a recommendation of a special committee on Radioactive
Materials Transportation had been established by the County Board of
Representatives and that the Board of Represenatives did pass on their
recommendation on May 27th . Councilwoman Raffensperger reported that at
the same time they discussed a topic that the County Planning Board had
discussed which was the necessity of the County Planning Board and an
advisory board to consider such transportation . Councilwoman
Raffensperger noted that of the 100 million packages shipped annually in
the United States and designated by the NRC as hazardous , 2 million
involve radio - active . materials and 98 million involve other hazardous
materials , such as explosives , corrosives , poisons , and flammables , and
stated that this was a substantial problem . Councilwoman Raffensperger
• stated that a draft resolution with regard to hazardous materials was
discussed by the County Planning Board .
Planning Board 18 June 3 , 1980
• Chairman Aron wondered if the Federal government had jurisdiction
over the States or could the States tell a transporter - " You cannot
cgme here . " Councilwoman Raffensperger stated that that was unclear ,
adding that radio - active materials are regulated differently from other
hazardous materials , adding further , that it is unclear as to whether or
not local municipalities may effect a transportation ban . Councilwoman
Raffensperger commented that there are different kinds of input from
both the Federal and State governments , adding that there is much less
regulation of other hazardous materials and almost nothing as to
routing . Councilwoman Raffensperger spoke of a Hearing process now
being set up by the Federal Highway Administration with respect to
packaging , routing , and notification regulations .
Councilwoman Raffensperger also mentioned that she had been
contacted by Joseph Leeming , in the City , as to a petition drawn banning
the routing of trucks through Route 79 in the City . Councilwoman
Raffensperger stated that she had made an inquiry to Mr . Fabbroni as to
any impact of such a move , adding that both she and Mr . Fabbroni were
aware that - if you take trucks off somewhere - - they go somewhere else .
Chairman Arron thanked Councilwoman Raffensperger for her report .
CONSIDERATION OF APPLICATIONS FOR SIGN PERMIT
1 . What ' s Your Beef ? - East Hill Plaza .
• Chairman Aron noted that the Planning Board had recommended
approval of the proposed signage for What ' s Your Beef ? to the Town
Board , however , after that they decreased the size of the restaurant
such that now they no longer have enough linear front footage to support
the recommendation , so , the Town Board has sent it back to the Planning
Board to reconsider .
MOTION by Mr . Bernard Stanton , seconded by Mr . James Baker .
RESOLVED , that the matter of the application for sign permit for
" What ' s Your BeE! f0 , East Hill Plaza , be and hereby is deferred until
the next regular meeting of the Town of Ithaca Planning Board , July 1 .,
1980 .
There being no further discussion , the Chair called for a vote .
Aye - Aron , May , Bronfenbrenner , Mazza , Grigorov , Stanton , Baker .

The MOTION was declared to be carried unanimously .
2 . Indian Creek: Antiques - 1406 Trumansburg Road .
The Board members had before them the Application for Sign Permit
as completed and signed by Celia H . Bowers under date of May 15 , 1980 ,
together with a drawing of the proposed sign and specifications therefor
and a letter to Mr . Cartee regarding the proposed sign .

�► Planning Board 19 June 3 , 1980
• Chairman Aron commented that he had seen the sign that is presently
there and it appeared to him to be very amateurish . The Board members
discussed the size of the proposed sign , 38 sq . ft . , and also discussed
whether or not the proposed setback of the sign , 23 ft . , is farther back
from the road than necessary . The Board noted that Mrs . Bowers had
stated on her Application that the sign would be at the top of a steep
slope which runs down to the road and will also be 185 ' and 291 ' ,
respectively , .from the nearest adjoining property lines . Mrs . Bowers
stated that shE! had discussed the sign setback with Mr . Cartee .
Mr . May informed Mrs . Bowers about the proposed new sign ordinance
which , it is hoped , would soon be adopted by the Town Board .
Mrs . Bowers stated that the purpose of the sign is to make it
visible before one gets to the site . Mr . Fabbroni wondered if Mrs .
Bowers needed to have the hours of operation and the arrow . Mrs . Bowers
stated that she felt the arrow was essential as well as the hours .
Mrs . Grigorov commented that the location in which the sign is
proposed is a good one for a variance because it is not typical of R- 15
Residence Distracts . Mrs . Bowers stated that the reason for the size is
the slope . Mr . Mazza wondered if there would be any lighting . Mrs .
Bowers stated that there would be no lighting and added that the sign
would be black and white .
MOTION by Mr . Montgomery May , seconded by Mr . Bernard Stanton :
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board approval of a variance to
allow for a freestanding sign , reading " Indian Creek Antiques ,
Thur . - Sun . 12 : 00 - 5 : 30 ( arrow ) " , to be located on the property known as
1406 Trumansburg Road , owned by Celia and John Bowers , and
FURTHER RESOLVED , that said sign not exceed 24 sq . ft .

DISCUSSION ITEM FOR NEXT PLANNING BOARD MEETING

Planning Board would be discussing the Judd Falls Road / Ellis Hollow
Road / Pine Tree Read intersection .
