TOWN OF ITHACA PLANNING BOARD
TUESDAY , DECEMBER 4 , 1979
The Town of Ithaca Planning Board met in regular session on Tuesday ,
December 4 , 19791 in Town Hall , 126 East Seneca Street ( second floor ) ,
Ithaca , N . Y . , at 7 : 00 p . m .

Chairman Aron opened the Work Session at 7 : 00 p . m .
WORK SESSION - DISCUSS"ION OF SIGN ORDINANCE REVISION
With their copies of the proposed draft of the revisions to the sign
ordinance in front of them , the Planning Board members reviewed various
sections in detail . Page by page notations and questions were marked and
discussed , with the Secretary maintaining the master working copy . The
sign ordinance committee will meet and make appropriate adjustments . For
the record , the following notes were made :

Mrs . Restaino - concerned about historic neon signage seems to be Ok
through varying process .
Mr . Fabbroni - Section 1 . 03 - 5 and 8 . 01 - 3 - - problem in juxtaposition - -
contradictory ? e . g . , free - standing signs existing = 100 sq . ft . , 907o are
50 sq . ft . or less . Variance , then has to be in compliance - - does 1 . 03 - 5
mean anything ? -- - 1 . 03 - 5 says that if they are non - conforming now , they are
later . 1 . 03 - 5 :should be clearer . " There shall be nothing known as a legal
non - conforming use after five years . "
• Mr . Stanton - Can we find out how many signs there are over 36 sq . ft . ?
Mr . Fabbroni - 2J . 01 - 4 - - what constitutes " over a roof " ? Mansard type roof

WORK SESSION - PROPOSED PLANNING BOARD BY - LAWS DISCUSSION .
` It was agreed that discussion on the proposed by - laws be postponed
since the discussion of the sign ordinance took over an. hour . and public
hearings had been scheduled .

Planning Board - 2 - December 4 , 1979
Chairman Arron declared the Public Hearing in the above - noted matter
duly opened at 8 : 10 p . m . and presented for the record the Clerk ' s Affidavit
. of Posting and :Publication of the Notice of Public Hearing in Town Hall and
the Ithaca Journal on November 26 , 1979 , and November 29 , 1979 , respectively .
Mr . T . G . :Miller , Consulting Engineer for Mr . Chase , appeared before
the Board and stated that Mr . Chase has formally notified the Town Engineer
that they would like this approval consideration deferred for the moment .
Mr . Miller expressed their apologies to the Board and -the neighbors and
commented that they are having some problems with the economics of the
sewer and are looking at on- site sewage disposal and larger lots . Mr .
Miller requested that the matter be adjourned until they can make these
determinations .
MOTION by Mr . Henry Aron , seconded by Mr . Bernard Stanton :
RESOLVED , that the Public Hearing scheduled for this date , December 4 ,
1979 , in the matter of consideration of final subdivision approval for
proposed subdivision , 10 lots backlot of Ridgecrest Road , Town of Ithaca
Tax Parcel No . 6 - 45 - 1 - 2 . 2 , Lagrand E . Chase , be and hereby is cancelled ,
to be rescheduled and re - advertised at such time as Mr . Chase is prepared
to apply for a subdivision hearing .
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be carried unanimously .
APPROVAL OF MINUTES
The Planning Board reviewed the Minutes of November 6 , 1979 , as
presented by Ms . Perry and discussed various needed corrections . Since
the time had come for the next Public Hearing scheduled , this matter was
tabled for further discussion later in the meeting .
PUBLIC HEARING : CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR 3 - LOT
SUBDIVISION , 1698 SLATERVILLE ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 56 - 3 - 14 .

Chairman Aron declared the Public Hearing in the above - noted matter
duly opened at 8 : 20 p . m . and presented for the record the Clerk ' s Affidavit
of Posting and Publication of the Notice of Public Hearing in Town Hall and
the Ithaca Journal on November 26 , 1979 , and November 29 , 1979 , respectively .
Mr . T . G . Miller was present as consultant to Mr . Foote .
Chairman Aron read a letter from Mr . Thomas G . Miller , P . E . , P . L . S . ,
dated November 15 , 1979 , addressed to Mr . Henry Aron , Chairman , Town of
Ithaca Planning Board , as follows :
" Re : Charles Foote Property
1698 Slaterville Road
Town of Ithaca
Tax Parcel No . 56 - 3 - 14
Dear Mr . Aron :
As you may recall , when Mr . Foote and I met with the Planning Board on
Planning Board - 3 - December 4 , 1979
October 23 , 1975) , we were most concerned with approval of the subdivision of
the portion of Mr . Foote ' s property which lies along Slaterville Road . We
had also hoped to discuss access to the upper ( northern ) part of his property
from Snyder Hill Road and Eastern Heights , too , but the Board suggested we
request to do so in writing which prompts this letter .
I have discussed this matter recently with Larry Fabbroni , Town
Engineer , so he is familiar with the situation .
Mr . Foote had been given some assurances in the past , as subdivision
approvals were extended to Eastern Heights , that he would ultimately have
access to the upper part of his property from Nancy Street , Kings Avenue
and Sky - Vue Road as shown on the attached marked up portion of the Tax Map ,
Recently Mr . Foote has learned that the Town of Ithaca has acquired
the entire portion of the Eastern Heights property which adjoins Mr . Foote ' s
property on the north and has made the east half of the parcel into a Town
Park thus obliterating Sky - Vue Road and part of Kings Avenue as public
streets . This , of course , cuts off any possibility of access to Mr . Foote ' s
Property from these streets .
Mr . Foote therefore requests the Board plan for access to his property
in any further development of this park and reserve the necessary right - of -
way over Nancy Street and part of Kings Avenue now as -they show on the
portion of the attached tax maps or by means of some other mutually agreeable
alternative location .
If you have any questions , need any additional information or wish us to
meet with you please let us know . "
Mr . Fabbroni displayed maps of Eastern Heights and indicated the Foote
property in relation to that and described the part given to the Town for a
park and general purposes , noting that at the time it was subdivided he saw
no right of way evidences . Mr . Fabbroni noted that access is best from
property to the west or from property to the east , nevertheless there is no
access to this property . He also noted that access from Slaterville Road
is not particularly good either . Mr . Fabbroni stated that the fact that
the Town took an area for a park means that the Town should use the entirety
of that area as a park ; the area that was taken for general purposes could
be used as a park , water tank , road , etc . , there being a lot more flexibility
to that land than what was taken for a park . He noted that the Town took
half of the most removed part as a park and the rest for general purposes .
Mrs . Grigorov wondered if the Frandsen problem could be solved at the
same time this is solved .
that being the reason he was not present ,
Mr . Miller commented that Mr . Foote ' s brother died / and stated that in
October the Board granted preliminary approval with condition for driveway .
He noted that sewer is imminent .
Mr . Richard Lovelace asked what the access is to the property . Mr .
Stanton replied that Slaterville Road is the access .
There being no further comments from the public , the Chair closed the
Public Hearing at 8 : 30 p . m .
Mr . Mazza asked Mr . Miller if these pipes ( indicating on map ) have
been set . Mr . Miller stated that they have .
Mr . Mazza noted that there is going to be rights of way on both Deeds

" B " and " C " ( indicating ) and Mr . Foote uses the driveway also .
Mr . Stanton recalled that the Board had some discussion about the
frontage on one lot - - 74 ' frontage and noted that the fact is that the
house will be set back .
MOTION by Mr . Edward Mazza , seconded by Mr . Henry Aron :
RESOLVED , that the Town of Ithaca Planning Board grant and hereby
does grant Final Subdivision Approval for 3 - lot Subdivision , 1698 Slater -
ville Road , Town of Ithaca Tax Parcel No . 6 - 56 - 3 - 14 , as proposed by Mr .
Charles Foote , with the condition that the deeds conveyed with these lots
are subject to and granted for the rights of way over the existing drive -
way ,
There being no further discussion , the Chair called for a vote .

The MOTION was declared to be carried unanimously .,
Turning now to the access question , Mr . Mazza stated that the access
that is proposed is going to cut through some of the Town of Ithaca general
purpose land . Mr . Mazza asked if the Town is going to get some of it back
from Mr . Foote to make up for the right of way .
Mr . Fabbroni stated that that is a legitimate request and added that
this is a fail - :safe alternative and if one opens up later better from east
to west rather Than to the north , that is all to the good .
Mr . Miller stated that he is concerned with the development of the
area behind Eastern Heights and that street access is provided to Mr .
Foote ' s land , so , as the streets are developed , he will have access from
that direction .
Mr . Aron read a proposed resolution , as follows :
" WHEREAS , the Planning Board approved Section Two , Eastern Heights Subdivi -
sion , June 11 , 1968 , with no apparent provision for access to the Charles
Foote property :south of such subdivision , Block 5 , Lot : 2 through 4 , plus
Park ; and
WHEREAS , over the last eleven ( 11 ) years no other access along more suitable
grades has been provided through the lands of Frandsen and Blanpied ( formerly
Eipper ) to the west to said Foote property ; and
WHEREAS , the property of Charles Foote within the Town of Dryden to the east
of his property here in question has no present designated access through
adjacent lands in the town of Dryden ; and
WHEREAS , the Town of Ithaca was given a portion of Section Two , Eastern
Heights Subdivision including Block 5 , Lots 2 through 4 as part for a park
and part for general purposes ; and
WHEREAS , access from Slaterville Road within the Foote property both in the
Town of Ithaca and the Town of Dryden is undesirable because of topography ,
NOW , THEREFORE , BE IT RESOLVED , that the Planning Board of the Town of Ithaca
recommend and hereby does recommend to the Town Board that the Official Map
of the Town of :Ithaca be amended to include a proposed access from the
Frandsen property through the property taken for general purposes to the
Foote property until such time that a more preferred and accessible access
through the present Blanpied property or adjacent lands in the Town of
Dryden is officially identified , and further

RESOLVED , that any disposition of property by Mr . Foote in the Town of
Dryden will keep open access through that land to his Town of Ithaca parcel
• with any failure to adhere to this stipulation invalidating any guarantee of
access by the Town of Ithaca . "
Mr . Lovelace stated that the question of grade from Slaterville is
questionable - - why ? - - because it is too steep ? - - he questions that .
Mr . Fabbroni stated that as you approach the Frandsen property , you are
on a plateau , but overall slope exceeds 10% and any road that is proposed
would have to wiggle -waggle along .
Mr . Lovelace asked if there were anything from the east and west . Mr .
Fabbroni replied that there was not at this time and that is the purpose of
the resolution . Referring to the Blanpied problem and the Town of Dryden ,
Mr . Fabbroni said that we do not know what they have in mind and added that
the best way at this time is from Frandsen property , his portion being below
Tudor Road . Mr . Fabbroni stated that he would rule out Nancy Street since
the other one follows the slope a little better .
Mrs . Grigorov wondered if there were any way to make it a through road
to Slaterville Road . Mr . Lovelace felt that that would be very unfortunate ;
it is -..obvious what a cut would do .
Mr . Mazza stated that the only problem he has is that we are going to
designate this on the official map and we are saying that we are going to
take this back maybe . Mr . Mazza wondered how does anybody who is going to
purchase this have faith in this if later Mr . Foote does not keep his access
• open - - how does that person find out about this ? Mr . Mazza asked if there
is any way to proceed without it being designated on the official map ; could
we recommend to the Town Board that they give him access ?
Mr . Fabbroni asked Mr . Mazza if he would buy the upper piece of the
Foote property if the general purpose access is not there ? Mr . Mazza said
that he might if the price were right . Mr . Mazza suggested that maybe the
thing to do is not designate it but give guarantee that if .certain things
happen . . .
Mr . Miller :stated that Nancy Street , as steep as it is , was approved as
a public street and rough graded and now it has been taken over and there
has been no abandonment of it - - it must be on the map .
Mr . Fabbroni stated that it shows on the map but a deed was never
accepted for than highway - - it still shows as a . road right of way . Mr .
Fabbroni stated that the point in the resolution earlier is that the approved
subdivision prov =ides no access whatsoever to his land .
Mr . Miller :stated that what Mr . Foote is concerned about is if you
decide to require access through the Frandsen property , unless it is on the
map ten years down the road - - resolutions get lost .
Mr . Mazza suggested that the resolution be filed in Miscellaneous
Records at the Clerk ' s Office - - it would always show up in Foote ' s
abstract .
Mr . Fabbroni agreed with putting some burden back on Mr . Foote not to
landlock himself , it being conceivable that better access could be found .
Mr . Fabbroni stated that we could file this resolution in the Miscellaneous
Records .

Mr . Mazza agreed but stated that they file it , and added that he would
also want an equal portion from Foote as a condition .
MOTION by Mr . Edward Mazza , seconded by Mr . Bernard Stanton :
WHEREAS , the Planning Board approved Section Two , Eastern Heights
Subdivision , June 11 , 1968 , with no apparent provision for access to the

4 , plus Park ; and

equal amount of acreage of land taken to provide him with this access
from his land immediately south of the present Town of Ithaca land , and
FURTHER RESOLVED , that this resolution be recorded. by Mr . Foote in
the Tompkins County Clerk ' s Office with sufficient identification that it
will be included in any abstract of title compiled on any of the Foote
property in the Town of Ithaca or the Town of Dryden .

CONSIDERATION OF APPLICATION FOR SIGN PERMIT - - PALEONTOLOGICAL INSTITUTION .
An application for sign permit was reviewed once again by the Planning
Board for the Paleontological Institution on Trumansburg Road . The proposed
signage is to be! a two - faced sign , back - to - back , same copy on both sides ,

24 sq. ft . +, no lights , black on white, located 52 ' from the center line
of Route 96 and set back 19' from the edge of the right of way.
MOTION by Mrs . Carolyn Grigorov, seconded by Mr . James Baker:
RESOLVED, that the Town of Ithaca Planning Board recommend and hereby
does recommend to the Town Board approval of the proposed sign for the
Paleontological Institution on Trumansburg Road, as presented to said
Planning Board this date, December 4, 1979.
There being no further discussion, the Chair called for a vote.

The MOTION was declared to be carried unanimously.
CONTINUATION OF DISCUSSION IN RE APPROVAL OF MINUTES OF NOVEMBER 6, 1979 .
It was the consensus of the Board at this time that this discussion
be deferred until the January 1980 meeting of the Planning Board.
NON-AGENDA ITEM - MONKEMEYER 5-LOT SUBDIVISION ON EAST KING ROAD.
Mr. Evan Monkemeyer was granted permission to appear before the Board
for a short informal discussion of his 5-lot subdivision on East King Road
which presently has been granted preliminarysubdivision approval . Mr .
Monkemeyer noted that water is there, and his plans for the sewer extension,
• as drawn by T.G. Miller, dated November 30, 1979, were looked at and dis-
cussed. for information purposes. Mr.: Monkemeyer asked that if there are
any questions, please tell him now. He noted a turn-around for the proposed
road which is a 100 ' strip.
Mr. Fabbroni noted that .a det.ailis shown for a hydrant , but he did not
see it located. Drainage was discussed. It was noted that a culvert is
shown in the roadway detail and that water goes under the road.
Mr. Fabbroni asked that Mr . Monkemeyer come up with the acreage that
that pipe is going. to drain so the Board has abetter feel for the situation.
Mr . Fabbroni also noted that as Mr: Monkemeyer comes up with the sewer he
(Fabbroni) does not know what Mr. Monkemeyer intends down the line. He
stated that it would be far easier to get the laterals in for the lots.
He asked that Mr. Monkemeyer think about lot size. Mr. Monkemeyer stated
that it is set up for 100 ' lots right now. Mr . Aron asked if there would
be sewer to lot #4. Mr. Monkemeyer said there would. Mr. Fabbroni suggested
keeping the laterals out _of the -manholes because at this point Mr. Monkemeyei
could put__a tee in the main as he is laying it -- a tee with a ring joint.
Mr, Monkemeyer - noted�.,.th-at�.Phe will be able to serve the 27 acres from the
King Road sewer.
Mr. Aron suggested that Mr. Monkemeyer leave the map with Mr. Fabbroni
and continue work on it and come back in January.
Mr. Fabbroni recommended that if it is alright with the Board, he
would go over the engineering with Mr . Monkemeyer and then he can go to
the Health Department .
The Planning Board agreed that Mr. Fabbroni would go over the engineer-
ing drawings with Mr. Monkemeyer in order that he (Monkemeyer) may submit
them to the Health Department prior to the scheduling of a Public Hearing to

REPORT OF THE TOWN PLANNER
Mrs . Restaino reported that Mr . Fabbroni Mr . Cartee Mrs . Fuller ,
p � ,
Mr . Grossman ( Buyoucos and Barney ) , and she have gotten together about
ways of formalizing enforcement procedures and are going to look into
using Court appearance tickets for repeated violators and take care of them
here . Mrs : Restaino commented that this is in the working stage .
Mrs . Restaino reported that the Town has also made another application
for a CETA grant: which would approve labor for Phase 2 of our park projects .
She said that it. is being written with an effort toward giving more latitude
and include other projects such as landscaping pump stations , Town facili -
ties . She stated that it will go before the CETA Advisory Board and they
will decide on that aspect .
Mrs . Restaino reported that there has been another joint .meeting on
the proposed zoning ordinance revisions and any comments are welcome . She
stated that they are proceeding through the whole document and hopefully
she will get input from many members so they can proceed .
REPORT OF THE BUILDING INSPECTOR
Mr . . Cartee reported that in the month of November 1979 , 12 building
permits were issued for a total of $ 394 , 900 . 00 of improvements - - four
one - family homes , one two - family home , one alteration , two additions , one
multiple family structure , one carport and two chimneys . He stated that
this compares with $400 , 500 . 00 of improvements in November 1978 .
REPORT OF THE TOWN ENGINEER
Mr . Fabbroni reported that the primary projects are the sewer exten -
sions ; the contracts have been signed ; expect to start the middle of this
month but if the weather is bad , they will wait until the first of the year .
He noted a_ . 300 ' extension east of Burns Road . He commented that with the
completion Of the Slaterville Road sewer , all the homes in the Town of Ithaca
on Slaterville Road will be served by sewer on the upper side of Burns Rd .
Mr . Fabbroni stated that the five - area sewer extension is completed ,
and added that this 1979 sewer extension involves approximately 1000 ' on
both the upper and lower sides of West Haven Road and a short one on
Valley View Road , both off Elm Street which now has sewer up its complete
length .
Mr . Fabbroni reported that the other major project that is about to
be started is construction of a cold storage facility out at the Town Barn .
He commented thatcertain equipment needs to be under cover , e . g . , park
equipment , salt .
Mr . Fabbroni reported that the Town of Ithaca Northeast Transit has
operated at 20 passengers per bus and continues to operate at that level
which , in terms of capacity , is about 60 - 65% capacity use on the average .
Mr . Fabbroni stated that the Holiday Service will be a one - bus service and
will start a little later in the morning and extend into the midday . He
noted that this service will be in effect from December 17th through
January 11th , weekdays . Mr . Fabbroni indicated that some fine tuning is
being considered such as some changes in the Campus timing which will be
moved up 20 minutes in the spring . He stated that we expect to carry close
to capacity on the buses in the inclement months .
Planning Board - 9 - December 4 , 1979
Mr . Fabbroni reported that Mr . Cartee is following up on many violations
and having good voluntary response . He commented that Mr . Cartee is pur -
suing violations in several areas such as signs , but predominantly in the
area of occupancy violations .
Mr . Lovelace inquired from the floor what the status is of the
structure at 121 Snyder Hill Road . Mr . Fabbroni replied that there is a
zoning violation there and it is being pursued .
FURTHER DISCUSS :[ ON - - SIGN ORDINANCE AND PLANNING BOARD PROCEDURES
Mr . Aron stated that if there were no more input in re the sign
ordinance , which there was not at this moment , he would like to propose
having further discussion at another meeting , Planning Board procedures
also . The Board agreed .
Mr . Stanton wondered if the next step is to go with these to the Town
-Board . Mr . Aron said that that was correct and added that hopefully there
would be one or two members from the Planning Board involved .
REPORT OF THE COUNTY PLANNING BOARD REPRESENTATIVE - COUNCILWOMAN SHIRLEY
RAFFENSPERGER
Since Mrs . Raffensperger was unable to attend this meeting she kindly
forwarded to the Board a written report which is attached to and made a
part of these Minutes , marked page 9A .
CHAIRMAN HENRY ARON YEAR - END SUMMARY
Chairman Aron spoke to the Planning Board members with respect to the
year ' s activities of the Board .
Mr . Aron thanked the Board most warmly for his wonderful year with the
Planning Board as its Chairman , and he thanked the Board members individually
for their excellent work and devotion to duty .
Mr . Aron transmitted to the Board the very kind words that had been
expressed by Supervisor Desch at the last Town Board meeting about the
Planning Board , its members , and its work . The members were most apprecia -
tive of the Supervisor ' s expression of support and look forward to receiving
the Minutes .
Mr . Aron continued and told the Planning Board members that not only
have they done a good job in 1979 , the details of which they are most familia
with , but also it could not have been done without the key personnel who
have spent hours and hours on the subjects that have come before the Planning
Board . He stated that it has been his pleasure of working during the daytime
with Mr . Fabbroni who has spent evenings , mornings , daytimes , working for
the Planning Board and for the public . Mr . Aron expressed his thanks and the
Board ' s thanks to Mr . Fabbroni for his tremendous work and output .
Mr . Aron asked that the record also show that Mrs . Restaino has also
done a very , fine job and is doing a very fine job for the Planning Department
Mr . Aron continued and said that as to Mrs . Fuller who is the right
hand stay of this . organization , if he may call it an organization , she has
straightened out his English and has spent numerous hours , nights , evenings ,
early morning hours at 7 : 30 a . m . you can find her here , and he cannot help
but be admirable to her .

A resolution , addressed to the County Board of Representatives ,
recommending the establishment of Agricultural Diatrict 8 , was passed .
No land in -the Town of Ithaca is included .
The meeting night for the County Planning Board will remain the second
Wednesday of the month .
A nominating; committee was appointed - Yarnell , Bailty , Brown.
The chairman presented a draft resolution re Route 13 recommendation
to the County Board of Representatives .
The resolution indicated that the CFB, after considering the recommendations
of other County advisory boards and the statements of various municipalities ,
had concluded that NYS DOT should be urged to improve existing Route 13 on
an urgent basis and recommended that the B- 1 corridor be introduced into the
formal planning process , along with a restudy of the reconstruction of Route
13 along the existing corridor .
An amendment; -
Resolved , further , that the Tompkins County Board of Representatives is
urged to provide to the Town of Ithaca a statement of its intent to con-
struct with the Town of Ithaca and Cornell University the Forest Home B„v-
Pass prior to the construction of the new Route 13 , and
Resolved , further , that NYS DOT be asked to include as part of their
studies that; connection linking Route 13 in the vicinity of the Airport
to Route 366 in the vicinity of Cornell University .
The amendment was passed .
The resolution passed.
F. Liguori reported on upcoming public meetings on the Multi - County Solid
Waste Facility - they will be scheduled soon .
On the day of the public hearing re Ag . gist 8 , W . Hilker petitioned
the addition of 40 acres on Burns Road in the Town of Ithaca . The CBR
approved that addition. The land is not contiguous to the Ag . Dist and
is not eligible for an Individual Commitment . (G . Evans , County Planning )
I am concerned that the legal notice to an involved municipality and to
adjacent land otirners , required by the Ag and Markets Law , was not given .
I do not know if there is objection on merit that would have been made ,
other than that the parcel is non- contiguous with arra Ag . Dist .

Mr . Aron stated that he admires all the good , key personnel with the .
Town of Ithaca and the Town Board who has employed such personnel with such
dedication .
Mr . Aron stated that the taxpayers should be aware of and grateful for
the Town staff and should know that in terms of dollar signs they are
getting their money ' s worth .
Mr . Aron again expressed his gratitude to the Planning Board members
for which they were most appreciative .
Mr . Aron asked that the text of his statement be a part of his report
to the Town Board on December 10 , 1979 .
PLANNING BOARD CHAIRMANSHIP AND - VICE -CHAIRMANSHIP - 1980 .
By unanimous vote , voiced with pleasure , upon Motion of Mr . May
seconded by Mr . Baker , the Planning Board resolved that they would like to
recommend that Mr . Aron be appointed as Chairman of the Planning Board for
the year 1980 , and that the Town Board so appoint Mr . Aron as Planning
Board Chairman , 1980 .
By unanimous vote , voiced with equal pleasure , upon Motion of Mr .
Mazza seconded by Mr . Aron , the Planning Board resolved to recommend to
the Town Board that Mr . May be appointed as Vice - Chairman of the Planning
Board for the year 1980 .
ADJOURNMENT
Upon Motion , the Chair declared the December 4 , 1979 , meeting of the
Town of Ithaca Planning Board duly adjourned at 10 : 15 p . m .

'Dear Mr . Aron ,
As you may recall , when Mr. Foote and I met with the Planning Board on October 23 , 1979 ,
we were most concerned with approval of the subdivision of the portion of Mr . Foote ' s
property which lies along Slaterville Road . We had also hoped to discuss access to the
upper ( northern ) part of his property from Snyder Hill Road and Eastern Heights , too ,
but the Board suggested we request to do so in writing which prompts this letter .
I have discussed this matter recently with Larry Frabboni , Town Engineer , so he is
familiar with the situation.
Mr. Foote had been given some assurances in the past , as subdivision approvals were
extended to Eastern Heights , that he would ultimately have access to the upper part of
his property from Nancy Street , Kings Avenue and Sky-Vue Road as shown on the attached
marked up portion of the Tax Map ,
Recently Mr. Footehhas learned that the Town of Ithaca has acquired the entire portion
of the Eastern Heightsproperty which adjoins Mr . Foote ' s property on the north and has
made the east half of the parcel into a Town Park thus obliterating Sky-Vue Road and
part of Kings Avenue as public streets . This , of course , cuts off any possibility of
access to Mr. Foote ' s property from these streets .

Mr . Foote therefore requests the Board plan for access to his property in any further
development of this park and reserve the necessary right- of-way over Nancy Street and
part of Kings Avenue now as they show on the portion of the attached tax maps or by

WHEREAS , the Planning Board approved Section Two , Eastern Heights
Subdivision , June 11 , 1968 , with no apparent provision for access to
the Charles Foote property south of such subdivision , Block . 5 , Lots 2
through 4 , plus Park ; and
WHEREAS , over the last eleven ( 1. 1 ) years no other access along
more suitable grades has been provided through the lands of Frandsen
and Blanpied ( formerly Eipper ) to the west to said Foote property ; and
WHEREAS , the property of Charles Foote within the Town of Dryden
to the east of his property here in question has no present designated
. access through adjacent lands in the Town of Dryden ; and
WHEREAS , the Town of Ithaca was given a portion of Section Two ,
Eastern Heights Subdivision including Block 5 , Lots 2 through 4 as
part for a park and part for general purposes ; and
WHEREAS , access from Slaterville Road within the Foote property
both in the Town of Ithaca and the Town of Dryden is undesirable because
of topography ,
NOW , THEREFORE , BE IT RESOLVED. , that the Planning Board of the Town
of Ithaca recommend and hereby does recommend to the Town Board that the
Official Map of the Town of Ithaca be amended to include a proposed
access from the Frandsen property through the property taken for general
purposes to the Foote property until such time that a more preferred and
accessible . access through the present Blanpied property or adjacent
lands in the Town of Dryden is officially identified , and further
RESOLVED , that any disposition of property by Mr . Foote in the
Town of Dryden will keep open access through that land to his Town of
Ithaca parcel with any failure to adhere to this stipulation invalida -
