The Town of Ithaca Planning Board met in regular session on Tuesday , Nov .
6 , 1979 , in the Town Hall , 126 East Seneca Street ( second floor ) , Ithaca , N . Y .
at 7 : 30 p . m .
PRESENT : Chairman Henry Aron , Montgomery May , Edward Mazza , Barbara Schultz ,
Carolyn Grigorov , Liese Bronfenbrenner , and Larry Fabbroni (Town Engineer ) .
ALSO PRESENT : Stewart Knowlton , Groff Associates , and Carol Eisenberg ,
Ithaca Journal .
Chairman Aron declared the meeting duly opened at 7 : 35 p . m . and noted that
a Quorum was present .
ADJOURNED PUBLIC HEA9RING : MONKEMEYER MATTER , 5-LOT SUBDIVISION , EAST KING ROAD .
At 7 : 36 p . m . , Mr . Aron declared the _Public Hearing on the 'Monkemeyer 5 -lot
subdivision duly opened and noted that the Notice of Public Hearing had been
duly advertised and posted .
Mr . Monkemeyer had left word that his plans are incomplete . He further
informed the office that the Health Department and his engineer have not com-
pleted the proper'`phans for presentation .
Some discussion went on about the delay in presentation . Mr . Aron asked
the Board to consider adjourning this Public Hearing until Dec . 4 , 1979 . Mr .
May said he would second it , but Mr . Mazza objected , saying he did not want it
on that agenda . Further discussion ensued until a motion , satisfactory to all ,
was presented .
Liese Bronfenbrenner proposed a motion to adjourn the Monkemeyer Public
Hearing and Mr . May seconded it :
RESOLVED , that the Town of Ithaca Planning Board adjourn , and does hereby
adjourn , the Monkemeyer Matter , 5 -Lot Subdivision , East King Road , until such
time as Mr . Monkemeyer has prepared all the required materials .
There being no further discussion , the Chair called for a vote .
Aye - Aron , Bronfenbrenner , May , Mazza , Schultz , Grigorov .
Nay - None . Carried unanimously .
Mr . Aron declared the Public Hearing adjourned at 7 : 39 p . m. .

APPROVAL OF MINUTES
MOTION by Liese Bronfenbrenner , seconded by Mr . May :
RESOLVED , that the Planning Board Minutes of February 7 , 1978 , be and are
hereby approved as written .
There being no further discussion , the Chair called for a vote .
Aye - Aron , May , Grigorov , Bronfenbrenner .
Nay - None .
Abstain - Schultz , Mazza .
The MOTION was declared to be carried by majority vote .
MOTION by Liese Bronfenbrenner , seconded by Mr . May :
RESOLVED ,- that the Planning Board Minutes of September 19 , 1978 , be and
are hereby approved as written .
There being no further discussion , the Chair called for a vote .
Aye - Aron , May , Grigorov , Bronfenbrenner .

Abstain - Schultz , Mazza .
The MOTION was declared to be carried by majority vote .
At 7 : 45 p . m . , Mr . Aron stated that copies of the reports from the Sign
Ordinance Committee and the Planning Board Procedures Committee had been handed
out to Board members . All members agreed to read the reports and be ready to
discuss them . A work session was tentatively scheduled to start at 7 : 00 p . m *
and run until 8 : 00 p . m . on Dec . 4 , 1979 , just before the start of the regularly
scheduled Planning Board meeting . It was further agreed that the Nov . 13 , 1979 ,
meeting of the Board was to be cancelled by the new scheduling of the work session .
At this point , Mr . May said he cannot be at the Nov . 20 , 1979 , meeting .
PUBLIC HEARING : CONSIDERATION OF SITE PLAN APPROVAL FOR OFFICE!F:BUILDING AND
STORAGE IN THE REAR OF EAST HILL PLAZA , TOWN OF ITHACA TAX PARCEL NO . 6- 62- 2-13 . 2 .
GROFF ASSOCIATES , STEWART KNOWLTON ,
Mr . Aron declared the Public Hearing duly opened at 7 : 40 p . m . An affadavit
was presented stating a Notice of Public Hearing has been advertised and posted :

Mr . Knowlton presented his case , illustrating the site with several large-

scale maps and referring to maps in the Board ' s possession .
Mr . Aron complimented Mr . Knowlton on a fine presentation of his proposal .
Mr . Knowlton pointed out the site of the proposed office building and
storage area . He stated that the green hatchet- shaped area contained a 60- ft .
access road on Judd Falls Road and the site for the proposed office building .
A parking area would also be included . He further stated that -the area directly
to the right would be an open , fenced storage area . He also stated that this
site is directly behind the Plaza but separated by a drive , which completely
encircles the Plaza stores . Mr . Knowlton said that the land had been previously
used for storage and no adverse consequences had resulted .
Mr . Aron asked about the fence . Mr . Knowlton said a chain- link fence would
be used instead of a solid fence to avoid painting . Mr . Know.1ton further stated
that the chain- link fence would allow the area to be seen at night . He also
stated that the Cornell Safety Patrol checks the area . He stated the land on
the other side contained bull pens and a hay field .
Mr . Aron asked whether greenery would .be put along the side of this area
facing the stores . Mr . Knowlton said it could and that some landscaping was

Mr . Aron asked about the entrance to the storage area and Mr . Knowlton
pointed it out on the map , the entrance being straight back from Judd Falls Rd .
Mr : -May -expressed` the thought that noise from- this . site_ might -be -a nuisance
to- -the- -pograms_ at the E . A . I Co - Op . J
Liese Bronfenbrenner asked about the 20- ft . side lot usually required .
Mr . Fabbroni said it was not necessary in the case of open storage . Some dis-
cussion ensued between Mr . May , Mr . Mazza , Liese Bronfenbrenner , and Larry
Fabbroni on this point . .
Mr . Aron brought ,otothe attention of the Board the decision of the Board
of Zoning Appeals . He stated that the following resolution was made by Mr .
Francese and seconded by Mr . Austen , being carried unanimously .
ON THE BASIS OF THE ABOVE FINDINGS , RESOLVED that the Zoning Board of
Appeals of the Town of Ithaca grant , and does hereby grant , a variance from
the requirements of the Town of Ithaca Zoning Ordinance for Town of Ithaca
Tax Parcel No . 6- 62- 2- 13 . 2 , Groff Associates , Owner , Stewart Knowlton , Partner ,
that portion shown , on the site plan submitted to said Board of Appeals by said
appellants , dated Oct . 19 , 1979 , said variance to permit the use of the land
for a contracting business and outside storage of construction materials and
equipment ; subject to the following condition . that the site plan for the
entire development be approved by the Planning Board of the Town of Ithaca .

More discussion went on about the storage of materials . Mr ,. Fabbroni'.
asked about landscaping . Mr . Knowlton said it was to be landscaped quite
definitely .
Mr . Aron asked for further questions . Mr . Knowlton asked about building
plans . Mr . Fabbroni said building plans must be submitted to the Board , just
basic building type , elevations , and landscaping .
Mr . Fabbroni asked - about drainage . Mr . Knowlton replied that a 10- ft .
drainage easement was already established , which goes all the way around the
property .
Mr. Mazza asked whether the fence would_ be on the_ property line or- set back .
'Mr . Knowlton stated that he would be agreeable to any_ .kind.o f__set - back_ that the
_Planni`nn Bodrrdm`ight require .
Liese Bronfenbrenner ` said there will be increased truck traffic` ' on nearby
roads . Mr . Fabbroni commented that there will not --be so much traffic generated
per day , as Liese Bronfenbrenner may think .
Mr . Aron asked for further questions on the Environmental Assessment Form .
MOTION by Mr . May , seconded by Mr . Mazza :
RESOLVED , the Town of Ithaca Planning Board , acting a,§ lead agency in the
review of the proposed office building and storage in the rear of the East Hill
Plaza , approves the Environmental Assessment Form as completed by the applicant .
Pursuant to the State Environmental Quality Review Act ( SEAR) Parts 617 ,
this action is classified as an " unlisted action . " The Planning Board has
determined from the Environmental Assessment Form and all pertinent information
that the above-mentioned action will not significantly impact the environment
and will , therefore , not require further environmental revieca .
Aye - Aron , May , Mazza , Bronfenbrenner , Grigorov , Schultz .
Nay - None . Carried unanimously .
MOTION by Mr . May , seconded by Mr . Mazza :
RESOLVED , that the Town of Ithaca Planning Board grant , and does hereby
grant , site plan approval for the office building and storage in the rear of
East Hill Plaza , Town of Ithaca"Tax; ParcelNo . 6- 62- 2- 13 . 2 . Groff Associates ,
Owner , Stewart Knowlton , Partner , subject to the following :

1 . That a landscaping and architectural plan be presented for final approval
to the Planning Board .
2 . That the chain- link fence along the property line between the Eastern
Breeders and East Hill Plaza be set back 5 ft .

3 . That there will be topographical maps showing exact locations presented to
the Planning Board for final approval .
There being no further discussion , the Chair called for a vote .

Nay - None . Carried unanimously .
Mr . Knowlton said that the U . S . Geological Service has finally acknowledged
the presence of the East Hill Plazaon their .ma.ps . ._ - = ;
Mr . Aron adjourned the Public Hearing at 8 : 26 .
It was noted afterwards that East Hill Plaza is becoming a regional rather
than a neighborhood shopping center . tMrs:- - Bronfenbrenner asked what `_the original
approved�d-ens ty-was for this site . Mr= Fa_bbroni stated that there is no _density con-

, frol-i:n_-Business District-$ such being controlled by parking, pace - etc .
rAPPLICATION FOR SIGN PERMIT - PALEONTOLOGICAL INSTITUTION .
Mr . Aron opened the discussion at 8 : 40 p . m . to consider the Paleontological
Institute ' s sign application . He further noted that it was a free- standing
sign and asked if this sign met requirements .
Mr . Fabbroni said it was usual to consider the sign as a back- to-back sign ,
citing Millbrook ' s as an example , since the message on both sides would be
identical .
Mr . May rioted it was 50 sq . ff : if viewed from across the road and a -variance
,would--be requited .--He -also - no-ted -that f_would be in a V- formation p pendicu-lar
jf&' the road;.
A decision was reached and Mr . Fabbroni was instructed to inform the Insti-
. tute that it should reapply .
REPORTS
Mr . Fabbroni gave the reports of the Town Planner , Building Inspector , and
Town Engineer , touching upon the following points .

Lewis D . Cartee`, the new Building Inspector , started work November 5 , 1979 .
Permits were granted for 2 1- family , 1 3- family , and 4 additions or ac -
sory buildings for a total of $ 266 , 200 as compated to October , 1978 ' s 5 1- family ,
1 2- family , and 9 additions or accessory buildings for a total of $ 913 , 375 .
He observed that single- family permits had fallen behind the average .
Mr . Fabbroni also noted a number of occupancy violations in the eastern
part of the Town ?ereand are occurring and are being investigated .
The Stone Quarry Road Job s completed but the lower part will not be
finished until December or later because of delivery of (press`ur_r ducing. _vaul.ts .
Sewer extensions along Slaterville , West Haven , and Valley View Roads
received a low bid of approximately $ 67 , 000 , which- is_below- clpated levels .
Mr . Fabbroni said the salt shed would be made of wood as he has seen the
metal salt sheds rusting where used .
Mr . Fabbroni stated buses in the Northeast were running about two- thirds
of capacity or better through the early morning to the third run between 9 : 00
and 10 : 15 .
Tareyton Drive Park has been completed as a ball field . The first phase
of the Eastern Heights Park has been completed . A sledding bill may be added .
The bikeway is being built and should be essentially complete by the end
of the month .
Northview Road West Park . is . ,completed .
Mr . Aron asked about Shirley Raffensperger ' s comments on the B1 bypass ,
stating Board should read report .

RESOLVED , that the Planning Board Meeting be adjourned .
There being no further discussion , the Chair called for a vote .

PUBLIC HEARING : APPEAL OF GROFF ASSOCIATES , APPELLANTS , STE`VART KNOWLTON ,
PARTNER , AS AGENT , FROM THE DECISION OF THE BUILDING
INSPECTOR DENYING PERMISSION TO STORE BUILDING MATERIALS
OUTDOORS TO THE REAR OF EAST HILL PLAZA , TOWN OF ITHACA
TAX PARCEL NO . 6 - 62 - 2 - 13 . 2 , ITHACA , N . Y . PERMISSION IS
DENIED BY THE BUILDING INSPECTOR UNDER ARTICLE VII , SECTION
36 , OF THE TOWN OF ITHACA ZONING ORDINANCE .
FINDINGS OF FACT :
1 . There appears to be no adverse impact on the environment by the proposed
land use .
2 . A building supply use is permitted in Business District " C " , but no
outside storage is permitted , which seems to be an impractical restric -
tion for a building supply operation .
3 . The Appellant has indicated that the building supply operation would
be completely fenced , 3600 , and the location is over 600 feet from Judd
Falls Road and behind an existing shopping center which would make it
virtually invisible from any street .
4 . The site was previously used for outside storage without any evident
difficulties or problems .
5 . No one . appeared in opposition even though all neighbors were notified .
6 . If the proposed use were to have any adverse effect on any land , it
would impact most seriously on the remaining property of the applicant .
7 . It 'would seem to be a reasonable and necessary practical requirement
that a construction business have an adjunct , open , outdoor storage
area for its equipment , supplies , etc .
MOTION by Mr . Peter K . Francese , seconded by Mr . Edward N . Austen :
on the basis of the above Findings ,
• RESOLVED , that / the Zoning Board of Appeals of the Town of Ithaca grant
and hereby does grant a variance from the requirements of the Town of Ithaca
Zoning Ordinance for Town of Ithaca Tax Parcel No . 6 - 62 - 2 - 13 . 2 , Groff
Associates , Owner , Stewart Knowlton , Partner , that portion shown on the

ENCLOSED YARD AREA .
I request permission to store materials involved with the
construction business in the enclosed area marked 'fenced
storage ' as shown on attached plan drawn by J . Victor
Bagnardi , Architect , dated Oct 19 , 1979 for the proposed
Mc Guire & Bennett , Inc . , General Offices and storage
building and yard area .
This particular area of the ' stoarge yard ' will only be
visable from the service drive immediately to the rear of
the former F . B . C . Building , which land is owned by the appli -
cant . To the North the land is owned by or used by Eastern
Artificial Insemination Co - op Inc . , which land is used for
haying purposes .
The Office & Storage Building and Parking area will tend to
screen th e ' fenced storage ' yard area completely from the only
road or street from which one is able to see the area under
discussion .
This same area has been used by the Contractor who had the Town ! s
water and sewer contract for the local area and his occupancy
of this site was met without comment or complaint , to the
best of the applicant ' s knowledge .
