Y . , at 7 : 30 p . m . PRESENT : Chairman Henry Aron , Montgomery May , Edward Mazza , Barbara Schultz , Garolyn Grigorov „ Liese Bronfenbrenner , Nancy Fuller (Sec . ) , and Barbara Restaino (mown Planner ) . ALSO PRESENT : Stewart Knuvlton , Groff Associates ; Ivar Jonson , 111 N . Plain St . ; Fred Brown ; Betty Brown ; Suzanne Fullagar ; Edward W . King , attorney for Gustav Swanson ; and Kathy Kaplan , WTKO . Chairman Aron declared the meeting duly opened at 7 : 30 p . m ., and noted that a Quorum was present . The Clerk ' s affidavit of posting and publication of the notice of public hearings in Town Hall and the Ithaca Journal on August 27 , 1979 , and August 30 , 1979 , was duly presented . APPROVAL OF MINUTES Motion by Henry Aron and seconded by Edward Mazza : RESOLVED , that the Planning Board Minutes of June 1 , 1979 , be and hereby are approved as written . There being no further discussion , the Chair called for a vote . Aye - Aron , May , Mazza , Grigorov , Bronfenbrenner , Schultz Nay - None . Carried unanimously . Motion by Henry Aron and seconded by Montgomery May : RESOLVED , that the Planning Board Minutes of June 12 , 1979 , be and hereby are approved as written . Planning Board - 2- Sept . 4 , 1979 Motion by Liese Bronfenbrenner and seconded by Edward Mazza : RESOLVED , that the Planning Board Minutes of June 26 , 1979 , be and hereby are approved as written . Motion by Barbara Schultz and seconded by Edward Mazza : RESOLVED , that the Planning Board Minutes of July 10 , 1979 , be and hereby are approved as written . Aye - Aron , May , Mazza , Bronfenbrenner , Schultz Nay - None . Carried unanimously . REPORTS Barbara Restaino (Town Planner ) gave the following reports which were ac- cepted by the Board . Report of the Building Inspector - During August , 1979 , permits were granted for 3 single- family homes , 3 accessory buildings , and 4 additions or conversions worth $193 , 900 as compared to the August , 1978 , total of 1 single- family ( renewal ) , 1 expansion (Therm ) , and one addition worth $ 66 , 000 . Report of the Town Planner - The Stone Quarry Road water project will start this month . Report of the Town Planner - Construction is continuing at the Eastern Heights park . Other park work is continuing or has been completed . Grading of Tareyton Drive Park is done and seeding has to be put in . Barbara Restaino brought up two other points . She talked about Types I and II actions of the SEQR law . Edward Mazza agreed to work with her on this for the Board . The other point she mentioned was the proposed Zoning Ordinance draft changes . She said a covering letter concerning the draft Zoning Ordinance would be sent first with comments due by Oct . 10 . PUBLIC HEARING : CONSIDERATION OF SITE PLAN APPROVAL FOR PROPOSED BUILDING EX- PANSION , EAST HILL PLAZA , T014N OF ITHACA TAX PARCEL NO . 6- 62- 2- 1 . 121 . GROFF ASSOCIATES , STEWART KNOWLTON , PARTNER . At 7 : 30 p . m . , Mr . Aron declared the Public Hearing on the East Hill Plaza expansion duly opened . Mr . Stewart Knowlton was present to answer the Board ' s questions . �� Mr . Aron commended Mr . Knowlton on previous presentation of material . l Planning Board - 3- Sept . 4 , 1979 Mr . Knowlton presented the site plan . He pointed out that the yellow areas represented paved portions , yellow lines existing parking , and green unused ex- �. pansion areas . Mr . May asked about drainage . Mr . Knowlton replied by saying there was a drainage ditch providing all-around site drainage . There was a culvert under Ellis Hollow Road . Two french drains would also be used . Mr . Knowlton mentioned several other points . The lawn has been seeded . The area adjacent to Dr . Purdy would be graded . A shelter for the elderly is also being planned (Ellis Hollow Apts . residents ) . Loading and adjacent areas were being graveled . Dumpsters were to be used for waste materials ( this in response to a question by Liese Bronfenbrenner ) . Liese Bronfenbrenner asked about fencing . Mr . Knowlton replied by saying fencing was to be used to keep cars to the parking area and for security . Pole lights were also to be installed for added security . Mr . Knowlton said they wanted to prevent vandalism from occurring . Mr . Knowlton mentioned several points about the building addition itself . Gulls were to be of concrete split- face (contrasting masonry ) and 14 ft . high . One entry would have a 15 ' by 15 ' glass cover . At least one entry would be recessed . Brick was to be used . The store would use Texture I -11 (unfinished but treated plywood ) . A small garden would be attached and planters would be installed at the front of the stores . Mr . Knowlton said he has applied to the Post Office to erect a postal sub- station . Mr . May asked whether the hardware store would be a chain operation . Mr . Knowlton said Emery Waterhouse Hardware was a family operation . Mr . Knowlton said they wanted to start construction immediately because of the availability of materials and quick delivery . Liese Bronfenbrenner asked about signs . Mr . Knowlton replied by saying that the sign was 56 sq . ft . and would be on the building face . Mr . May said there was no sign application included . The Planning Board did agree to approve the sign at Mr . Knowlton ' s request but it still must go to the Town Board for approval . Mr . Mazza noted the sign fee has to be paid still . Mr . Knowlton said he would pay it now if so requested . Motion by Montgomery May and seconded by Carolyn Grigorov . RESOLVED , that the . Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board approval of proposed 56 sq . ft . sign for Trustworthy Hardware Stores , East Hill Plaza , as presented Sept . 4 , 1979 . There being no further discussion , the Chair called for a vote . Aye - Aron , Bronfenbrenner , May , Mazza , Schultz Nay - None . The Motion was declared to be carried unanimously . <, Planning Board - 4- Sept . 4 , 1979 The Board moved on to the SEQR review . Mr . Mazza asked about items 53 and 54 and was satisfied with Mr . Knowlton ' s answers . Mr . May then asked about insul- ation . Mr . Aron explained the sandwiching process , saying that total insulation should not be below R19 . Mr . Knowlton said it was not . Mr . Aron then asked if the Board had any further questions . None were forthcoming . Henry Aron proposed a motion to adopt the Environmental Assessment form and Mr . May seconded it . RESOLVED THAT , the Town of Ithaca Planning Board , acting as lead agency in the review of the proposed East Hill Plaza expansion , Tax Parcel No . 6- 62 - 2- 1 . 121 , approves the Environmental Assessment Form as completed by the applicant . Pursuant to the State Environmental Quality Review Act , Parts 617 , this action is classified as an "unlisted action . " The Planning Board has determined from the Environmental Assessment Form and all pertinent information that the above-mentioned action will not significantly impact the environment and will , therefore , not require any further environmental review . There being no further discussion , the Chair called for a vote . Aye - Aron , May , Mazza , Bronfenbrenner , Grigorov , Schultz Nay - None . Carried unanimously . The Planning Board considered site plan approval for the application of East Hill Plaza , dated 8 / 29 / 79 , together with drawings Al , A2 and A3 . Mr . May then made the motion and Mr . Aron seconded it . RESOLVED THAT , the Town of Ithaca Planning Board grant , and does hereby grant , site plan approval for the East Hill Plaza expansion , Tax Parcel No . 6- 62- 2- 1 . 121 . There being no further discussion , the Chair called for a vote . Aye - Aron , May , Mazza , Bronfenbrenner , Grigorov , Schultz Nay - None . Carried unanimously . PUBLIC HEARING : CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR. PROPOSED SUB- DIVISION 10 LOTS BACKLOT OF RIDGECREST ROAD , TOWN OF ITHACA TAX PARCEL N0 . 6- 45- 1- 2 . 2 . LAGRAND E . CHASE . The Public Hearing was opened at 8 : 26 p . m . by Mr . Aron . At this point , Mr . Aron said a request for postponement of this hearing was received from Mr . Chase because of incomplete work and asked that the Hearing be rescheduled for Sept . 18 , 1979 . Motion by Henry Aron and seconded by Montgomery May . RESOLVED THAT , the Public Hearing in consideration of Final Subdivision approval for proposed subdivision 10 lots backlot of Ridgecrest: Road , Town of isIthaca Tax Parcel No . 6-45- 1- 2 . 2 be adjourned until Sept . 18 , 1. 979 , at 7 : 30 p . m . There being no further discussion , the Chair called for a vote . Planning Board - 5 - Sept . 4 , 1979 Aye - Aron , May , Mazza , Bronfenbrenner , Grigorov , Schultz Nay - None . Carried unanimously . The Public Hearing was adjourned at 8 : 30 p . m . PUBLIC HEARING : FINAL REVIEW UNDER STATE ENVIRONMENTAL QUALITY REVIEW ACT ( SEQR ) FOR SUBDIVISION OFF TEXAS LANE , TOWN OF ITHACA PAX PARCEL NO . 6- 71- 1- 9 . IVAR JONSON . At 8 : 30 p . m . the Public Hearing for the final SEQR review of the Ivar Jonson subdivision was duly opened . Mr . Aron read the following to the Board and -, public . IVAR JONSON SUBDIVISION - ENVIRONMENTAL REVIEW TOWN OF ITHACA PLANNING BOARD The Town of Ithaca Planning Board , acting as lead agency in the review of the proposed Ivar Jonson Subdivision on Texas Lane , approves the Environmental Assessment Form as completed by the applicant . Pursuant to the State Environmental Quality Review Act , Parts 617 , this action is classified as an "unlisted action . " The Planning Board has determined from the Environmental Assessment Form and all pertinent information that the above-mentioned action will not significantly impact the environment and will , therefore , not require further environmental review . SThe following findings were used as a basis for this determination : ( 1 ) There will be no substantial adverse change in existing air quality , water quality , or noise levels ; no substantial increase in solid waste produc- tion ; no substantial increase in potential for erosion , flooding , or drainage problems ; ( 2 ) There will be no removal or destruction of large quantities of vege- tation or fauna ; no substantial interference with the movement of any resident or migratory fish or wildlife species ; no impacts on a significant habitat area ; and no substantial adverse effects on a threatened or endangered species of animal or plant or the habitat of such a species ; ( 3 ) There will be no encouraging or attracting of a large number of people to a place or places for more than a few days compared to the number of people who would come to such-place absent the action ; ( 4 ) There will be no creation of material conflict with the Town of Ithaca ' s plans or goals as officially approved or adopted ; ( 5 ) There will be no impairment of the character or quality of important historical , archeological , architectural , or aesthetic resources or of existing community or neighborhood. character ; • ( 6 ) There will be no major change in the use of either the quantity or type of energy ; Planning Board - 6 - Sept . 4 , 1979 ( 7 ) There will be no substantial change in the use , or intensity of use , of land or other natural resources , or in their capacity to support existing . uses ; ( 8 ) There will be no hazard to human health or safety created ; ( 9 ) There will be no creation of a material demand for other actions which would result in one of the above consequences , or changes in two or more elements of the environment , no one of which has a significant effect on the environment , nor which , when taken together , result in a substantial adverse impact on the environment . Liese Bronfa_nbrenner stated the form actually deals with actual uses of the law under discussion . She wanted to know about alternatives . Henry Aron said the State requirements were unclear . Motion by Mr . May and seconded by Mr . Mazza . BE IT RESOLVED THAT , the Town of Ithaca Planning Board , acting as lead agency in the review of the proposed Ivar Jonson Subdivision on Texas Lane , approves the Environmental Assessment Form as completed by the applicant . PUBLIC HEARING : CONSIDERATION OF PROPOSED 3-LOT SUBDIVISION ON COMPTON" ROAD , TOWN OF ITHACA TAX PARCEL NO . 6- 45-1- 1 . 2 . GUSTAV SWANSON . The Public Hearing was duly opened at 8 : 50 p . m. by Henry Aron , noting that the Board will commence discussion early but any public that may arrive will be heard . Mr . King was present as the attorney for Mr . Swanson , an out-of- state resident . Mr . King presented the material_ to the Board using a flip chart and • referring to material already submitted to the Board , with particular reference to maps ( Survey map , dated Aug . 4 , 1966 ; Contour map , U . S . G . S . 1949 ; and site plan showing proposed lots A & B , dated Aug . 24 , 1979 ) . Mr . King stated that Mr . Swanson wanted to subdivide his 80 acres into 3 lots . Lot A is a one+/ unimproved lot , known as No . 154 Compton Road ; Lot B is a one+ acre small parcel containing an existing dwelling known as No . 155 Compton Road ; and Lot C containing 78 acres approximately will remain under the owner- ship of Mr . Swanson . Mr . King said a 50 ft . strip reaching to the rear of the property will be retained as access to Lots A and C . Mr . King said the dwelling on Lot B is presently rented to students and that-�a potential buyer has been found for that lot . Mr . King stated that after a personal inspection he found the trees on the property were conifers of varying types . Mr . Mazza asked about the box marked 215± on the Survey map . Mr . King said it was a garage on the line between Lot B and the 50 ft . joint right of way and could be moved in the future at the buyer ' s request . Mr . Mazza had a question on the depth of the bedrock . Barbara Restaino said that information was not relevant . She said the short form of the Environ- mental Assessment Form could have been used here . Mr . King signed the original Environmental Assessment Form when it ( long form ) was found not to be signed . Planning Board - 8- Sept . 4 , 1979 Mr . May init atdd the motion to accept the Environmental Assessment Form . and it was seconded by Mr . Mazza . RESOLVED that , the Town of Ithaca Planning Board , acting as lead agency in the review of the proposed Swanson Subdivision , approves the Environmental Assess- ment Form as completed by the attorney for the applicant . Pursuant to the State Environmental Quality Review Act , Parts 617 , this action is classified as an "unlisted action . " The Planning Board has determined from the Environmental Assessment Form and all pertinent information that the above-mentioned action will not significantly impact the environment and will , therefore , not require further environmental review . There being no further discussion , the Chair called for a Vote . Aye - Aron , Bronfenbrenner , Grigorov , May , Mazza , Schultz Nay - None . Carried unanimously . The motion to approve the Subdivision was made by Mr . Mazza, and seconded by Mr . May with conditions : RESOLVED , that final subdivision approval for proposed 3- lot subdivision on Compton Road , Town of Ithaca Tax Parcel No . 6- 45- 1- 1 . 2 , Gustav Swanson , owner . . . be approved as shown on maps presented to the Planning Board with the following conditions : ( 1 ) that final survey map show that pipes have been set on Lots A and B ; ( 2 ) that: any buyer of Lot A be notified that Health Department approval has not been granted or sought in the Planning Board consideration of this sub- division ; and ( 3 ) that the buyer of Lot B be granted the right to use the 50 ' right of way strip as shown on the Survey map as presented to the Board .
