The Planning Board of the Town of Ithaca met in an adjourned session
on July 17 , 1979 , ( adjourned from July 10 , 1979 ) in Town Hall , 126 East
Seneca Street ( second floor ) , Ithaca , N . Y . , at 7 : 30 p . m .
PRESENT : Chairman Henry Aron , Bernard Stanton , James Baker , Edward

Chairman Aron declared the adjourned meeting of the Town of Ithaca
Planning Board duly opened at 7 : 35 p . m .
Chairman Aron advised the Board of the decision of the Court in the
Ivar Jonson Subdivision Matter ( Texas Lane ) in favor of the Planning
Board and Mr . Jonson . A copy of the decision was distributed by the
Secretary to each Planning Board member present .
ADJOURNED PUBLIC HEARING : CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR
INLET VALLEY LAND CO - OP , INC . , 171 CALKINS ROAD , TOWN OF ITHACA TAX PARCEL
N0 . 6 - 33 - 1 - 4 , APPROXIMATELY 97 ACRES , JERRY WEISBURD .
® Chairman Aron asked for a report from the ad hoc committee to walk
the site under discussion - - Messrs . Baker , Stanton , and May . Mr . May
stated that he was personally very satisfied . He noted that he had had
several concerns as far as the dam goes , but that it looked to him as
though it has been well thought out . He stated that it is a very attrac -
tive use for the land and involves minimum density .
w Mr . Baker stated that he really did not have much to add except to
note that the road , of course , is being constructed and it looks like it
is going to enhance the property . He said he was a bit concerned about
the handling of water coming down off the hill during construction . He
stated that the land is certainly suited to the kind of development being
planned . He noted that because of the plateau and the way it protects
each lot makes the development very private and the plateau lends itself
very well to this development .
Mr . Stanton stated that he thought that it was pretty obvious that
if the developer continued to use the old road , it would be disastrous .
He stated that he tended to agree with the Town Engineer about the need
for culverts on the two swales . Mr . Stanton commented that there are
three or four people using water out of the dam and added that the dam is
a very suitable resource and enhances the property . He stated that from
his understanding of what is proposed to be done with the land , it is a
very fine use .

Mr . Fabbroni stated that he / no further comments beyond his comments
on the natural drainage paths that he made at the last meeting .
Chairman Aron stated that the Board should look to the Environmental
Assessment Form which the Board members have in hand and he asked for
comments from the Board .
Planning Board - 2 - July 17 , 1979
MOTION by Mr . Bernard Stanton , seconded by Mr . James Baker :
RESOLVED , that the Town of Ithaca Planning Board , acting as lead
agency in the .review of the proposed Inlet Valley Land Co - Op , Inc . Sub -
division on Calkins Road , approves the Environmental Assessment Form as
completed by the applicant , as amended July 10 , 1979 ; and
FURTHER RESOLVED , pursuant to the State Environmental Quality Review
Act , Parts 617 , this action is classified as an " unlisted action " . The
Planning Board has determined from the Environmental Assessment Form and
all pertinent information that the above -mentioned action will not signi -
ficantly impact the environment and will , therefore , not require further
environmental :review .
There being no further discussion , the Chair called for a vote .
Aye - Stanton , Baker , Grigorov , Aron , May .
Nay - None .
Abstain - Mazza .
The MOTION was declared to be carried .
Mr . Aron stated that the Board had before them a proposed resolution ;
that the Board had discussed this proposal in depth ; and that he would
like to propose a motion .
Mr . Weisburd , referring to the Environmental Assessment Form , stated
that he had received a letter from the New York State Department of
Environmental Conservation stating that this project is unlisted ; other
agencies may be involved but the optional coordinated procedures for
designating lead agency and determining significance will not be followed .
He stated that the Department of Environmental Conservation has deter -
mined that the project will not have a significant effect on the
environment . Mr . Weisburd noted that , unfortunately , a copy was sent to
the Supervisor of the Town of Spencer . Said letter , dated July 13 , 1979 ,
signed by David S . Wazenkewitz , Permit Administrator , NYS D . E . C . , Region
7 , Environmental Quality Office , 7481 Henry Clay Boulevard , Liverpool ,
New York 13088 , was entered into the record , and is attached to the
Official Minutes of this Meeting filed in the Official Minute Book of
r the Planning Board ,
Mr . Buyoucos read from his Memo of July 10 , 1979 , to the Planning
Board , as follows : " . . . . This appears to be an imaginative concept on the
part of the developers . It may be that this is the sort of venture which
would be appealing to many people in the community . It departs from the
accepted standard of property ownership with which the Town Planning Board
and the Town Board are familiar ; the procedures of control and supervision
developed over the years relate primarily to individual outright owner -
ship of each separate parcel of land . In the case of this venture , each
" owner " does not own the land but owns stock in a co .- operative based on
his holding a proprietary lease to a parcel of land in the Co - Op . . . It
may be that any one person who wishes to become a part of the Co - Opera -
tive may find no objections to entering into that sort of co - operative
• venture . It may be others might find objections . This is a matter of
right and taste for each person who seeks to acquire an interest in the
Co -Operative ' s lands . "
Mr . Buyoucos continued and stated that he has not approved the
By - Laws nor does he intend to do so . He stated that it is important that
the Town have certain enforcing procedures , noting that this is an unusual

venture and that there is a complexity of interests here between the
Co - Operative and the proprietary leaseholders . He ' stated that he thought
that the suggestion that has been made in the proposed resolution is made
to facilitate the ability of the Town Engineer , the Town , etc . , to give
notice to persons without having to make extensive searches in each case .
Mr . Buyoucos read from Item # 1 of the proposed resolution , as follows :
" The premises shall be used and the construction , alteration and addition
to , of all improvements on the premises shall comply with all applicable
Federal , State and Local laws , codes , ordinances , rules and regulations .
This is required of both the Corporation or Proprietary Lessor and each
Proprietary Lessee . "
Mr . Buyoucos read from Item #2 of the proposed resolution , as follows :
" Each proprietary lease shall contain a provision requiring the leaseholder
to designate irrevocably an officer of the Corporation as the lessee ' s
agent to receive and accept on behalf of such leaseholder ( 1 ) any notice
which the Town may serve on any leaseholder and ( 2 ) service of process in
any action or proceeding commenced by the Town , which , in both such cases
relate to the enforcement of laws against the Corporation with respect to
common lands , common elements or other matters in which the leaseholders
have been granted or have easements , rights of user or other interests .
This provision shall be drafted in consultation with -the Attorney for the
Town . "
Mr . Buyoucos stated that he had discussed #2 ( above ) with the Attorney
for the Corporation , Mr . Bruno Mazza . Mr . Buyoucos proceeded to describe
the reasoning for Item #2 , noting that it merely says that each proprie -
tary leaseholder must designate an agent to receive notice and process . He
pointed out that this is a highly recommended procedure in connection with
condominiums .
Mr . Buyoucos continued on with Item # 3 of the proposed resolution ,
which read : " 'Phe Corporation shall file with the Town Clerk : a . Copy of
Certificate of Incorporation and any amendments thereto . b . Copy of
By - Laws and each amendment thereof . c . The name and address of the
officers of the Corporation and of the person designated by the leasehol -
ders as their agent to receive notice and service of process . d . The
name and address of each leaseholder and a brief description of the area
covered by his leasehold . e . Copy of offering plan and approval by State
Attorney General or proof of exemption from requirement of approval , all
when obtained . " Mr . Buyoucos explained that this is in order to have
readily available information as to ownership .
Mr . Buyoucos then discussed Item #4 of the proposed resolution , which
read as follows : " It is the determination of the Planning Board that its
approval of the Subdivision and the issuance of any building permit should
not be construed to mean that any plan offering to sell or lease any
interest in the property in the Subdivision has been approved by the State
Attorney General ( if in fact such approval is required and the Corporation
is not exempt from such requirement ) , or that it has been approved by this
Board , or that all other applicable requirements of law have been met . It
should also be made clear that approval of the Subdivision does not mean
• that the streets in the Subdivision meet Town specifications or that such
streets will be accepted by the Town . Any applicant for a building permit
should be made aware of the foregoing . To this end , t: he Building Inspector ,
in consultation with the Town Attorney , shall develop a concise statement
substantially embodying the foregoing and other related matters which
shall be contained in or attached to any building permit which is issued .
Each Building Permit shall refer to the resolution of the Planning Board

approving the subdivision . " Mr . Buyoucos explained that this is in order
to limit the scope of Planning Board involvement . He stated that this is
where the Planning Board can be of service to people without interfering
in the Co -Op ' s inner workings .
Mr . Buyoucos stated that he did not see any offering plan until this
morning and he has not read it yet . He added that he was quite certain
that most of these conditions will be included in any offering plan .
Mr . Stanton questioned the matter of filing certain documents with
the Town Clerk and asked if this were usual . Mr . Buyoucos said it was .
Mr . Stanton noted that most of the things in the , pr.oposed resolution are
just good business . Mr . Buyoucos agreed .
Mr . May stated that the conditions do not seem to impose any hard -
ships .
_= Mr . Weisburd stated that first of all , he wanted to thank Mr . Buyoucos
very much and that he appreciated his acting on this . He stated that he
felt that it is fair . Mr . Weisburd asked Mr . Buyoucos what copy of the
offering plan he had , wondering if it were the preliminary copy .
Mr . Buyoucos said that he did not know ; Mr . Mazza gave him this copy .
Mr . Weisburd stated to Mr . Buyoucos that he would like to trade
documents , the one that Mr . Weisburd had being the one that came out of
Mr . Buyoucos ' conversation with Mr . Mazza and is a little more up to date .
Mr . Weisburd stated that it should be understood that some of these items
will come in time , such as names and addresses . He noted that they have
filed with the Attorney General , adding that they will have to file an
amendment to the offering plan . With regard to the SPEDES permit , Mr .
Weisburd stated that they do have in hand the response from the D . E . C . ,
which he mentioned earlier . He pointed out that the Tompkins County
Health Department will not issue their final approval until the SPEDES
permit is in , and , that they are making everyone aware of this . He stated
that they will guarantee return of money if the SPEDES permit does not come
U in . Mr . Weisburd thanked Mr . Buyoucos again , and the Board .
Mr . Aron asked if there were any questions from the public . There
were none . Mr . Aron asked if there were any questions from the Board .
Mr . Fabbroni stated that as long as it is understood . that the drainage
ways as they now exist would be maintained in the course of building this
road , that is fine . Mr . Fabbroni stated that there will be a culvert
under the road .
Mr . Weisburd agreed , except that he would not like to put in this
culvert here ( indicating on map ) . He stated that it would mean taking out
two very large old trees . He stated that it is a real easy matter if they
could avoid it .
Mr . Fabbroni stated that he thought it was reasonable , just looking
at the topography . He noted that the fact is that it will not be a Town
road .
Mr . Fabbroni raised the question of the dam and asked if Mr . Weisburd
had any clear picture of what he is going to do . Mr . Weisburd stated that
they are going to bring in an excavator and take out about thirty years of
silt . He said that they are going to have access for fire trucks . He
stated that they will leave vehicular access to the dam at all times in

order to keep their insurance down .
Mr . Fabbroni noted that along these lines , and recognizing the fact
that it is not a Town road , he would wonder if their maintenance program
will make it accessible to " this " property at all times ( indicating on
map ) .
Mr . Weisburd stated that there will be in the area at all times a
four - to - five ton dump truck with a backhoe .
Mr . Fabbroni wondered if , on the gravel that they might excavate ,
they had any clear picture in mind . Mr . Weisburd said , yes , they have
poked in the pit . He noted that there is overburden that they can put
back from the road cut , and , that some borrow may be made up at the top
of the property " here " ( indicating on map ) .
There followed a discussion led by Mr . Buyoucos in re planning
matters . He stated that in connection with the road , it should be noted
somewhere . . . . providing that the roads shall be properly maintained for
people going to and from on the public roads and for fire trucks and
ambulances . He stated that that should be a condition . . . . proper
maintenance and so on .
Mr . Buyoucos cited Section 280 - a , Town Law : " 1 . or ( b ) a
street shown upon a plat approved by the planning board as provided in
sections two hundred seventy - six and two hundred seventy - seven of this
article , as in effect at the time such plat was approved " , and so on .
• Mr . Weisburd noted that the By - Laws specify that everyone has access
to his leasehold over the road . He then corrected himself and noted that
it is in the proprietary lease . He cited from the proprietary lease , as
follows : " THE PARTIES HERETO COVENANT WITH EACH OTHER AS FOLLOWS :
ARTICLE I . FIRST : Lessor shall keep in good order the roadways and
common lands without the parcels and intended for the general use of the
cooperative . The Lessee shall give the Lessor prompt notice of any
accident or defect known to the Lessee in requiring repairs to be made ;
and all such repairs shall be at the expense of the Lessor , unless the
same shall have been rendered necessary by the intentional wrongful act or
neglect or carelessness of the Lessee or any of the family , guests ,
employees or subtenants of the Lessee , in which case -the expense is to be
borne by the Lessee . SECOND : The Lessor shall maintain and manage the
property as first - class property of its kind , and shall keep the grounds ,
common lands , and roadways cleaned and maintained . However , a majority
of the shareholders of record shall have complete and sole discretion to
determine the manner and extent of maintaining and operating the roadways
and property , -the types of service to be provided and in what manner and
also what services shall be increased , reduced , changed , modified , added
or eliminated . . . . . . "
Mr . Buyoucos noted that the amended By - Laws do not specify Town
specs for road as previously set forth .
Mr . Weisburd stated that , in essence , the road is a driveway and
• everybody has :interest in the land which does front on a public road .
Mr . Buyoucos pointed out to Mr . Weisburd that he does not want to
find himself in the position of having this come up farther on down the
road .
Mr . Buyoucos , drawing together Sections 277 ( 1 ) and 280 - a ( 5 ) ,

suggested using the following wording : Any street shall be in such
condition that it may be passed by police , fire fighting equipment , am-
bulances , etc . Mr . Buyoucos handed Town Law to Mr . Mazza and asked what
he thought . Mr . Mazza stated that he was not sure he wanted to respond
to even that at this point because of possible conflict of interest .
Mr . Fabbroni suggested covering it in two ways . ( 1 ) We make
specific reference to whatever provisions there are that the road is owned
and maintained wholly by the Co - Operative - - whether it goes through a
leasehold , it goes through a corporation that the road is a part of and
maintenanced by . He said , take leasehold #2 , for example - - what happens
when this road goes through a leasehold ?
Mr . Weisburd stated that the leasehold does not actually include the
road ; the road itself is common land owned by the corporation .
Mr . Fabbroni pointed out that if the Co -Operative wholly owns and
maintains the road and gives access to each leasehold , then we have
answered " access to " . ( Section 280 - a . ) He noted that then we have
quality of maintenance such that emergency vehicles , police , fire , etc . ,
will have as much of a chance to gain access to one of these leaseholds
as - anyone else . He added that if we tie down these matters , we have
covered the intent of what is in these sections of law . ( No citation
given . )
Mr . Buyoucos asked how wide this road is - - the paved portion . Mr .
Weisburd stated that it has a 15 ' rideable surface plus 3 ' shoulders on
each side .
• Mr . May noted that there is one fairly short radius and wondered if
that would be any trouble for fire trucks . Mr . Fabbroni stated that a
75 ' radius should pose no problem .
Mr . Buyoucos , citing Section 280 - a ( 1 ) , read : " No permit for the
erection of any building shall be issued unless a street or highway giving
access to such proposed structure has been duly placed on the official map
or plan . . . " , and further , citing Section 280 - a ( 5 ) , read : " For the
purposes of this section the word " access " shall mean that the plot on
which such ' structure is proposed to be erected directly abuts on such
street or highway and has sufficient frontage thereon to allow the ingress
and egress of fire trucks , ambulances , police cars and other emergency
vehicles . . . "
Mr . Weisburd stated that the tax map will always show one plot .
Mr . Buyoucos noted that the plot directly abuts on Calkins Road .
Mr . Buyoucos , repeating again from Section 280 - a ( 5 ) , read : " . . .
plot on which such structure is proposed to be erected directly abuts on
such street or highway and has sufficient fro.ntage thereon to allow the
ingress and egress of fire trucks , ambulances , police cars and other
emergency vehicles , " , and , continuing with citation , read : " and , a
frontage of fifteen feet shall presumptively ( emphasis added by Mr .
• Buyoucos ) be sufficient for that purpose . Mr . Buyoucos stated that if
you interpret " plot " to mean the entire parcel , then , he thought , they
must have a frontage of at least 15 ' on the Calkins Road , and , he thought ,
actually they have more than that .
Mr . Weisburd stated that there is 21 ' for the right of way .

Mr . Buyou. cos recommended that this should be a condition : That the
width of the strip of land surveyed for purposes of the street is 21 ' and
that the traveled portion thereof shall be at least 151

Mr . Buyoucos , cit / Section 280 - a ( 3 ) , read : " Where enforcement of
the provisions of this section would entail practical difficulty or
unnecessary hardship , or where the circumstances of the case do not require
the structure to be related to existing or proposed streets or highways ,
the applicant for such a permit may appeal from the decision of the ad -
ministrative officer having charge of the issue of permits to the board of
appeals or other similar board , in any town which has established a board
having power to make variances or exceptions in zoning regulations , and
the same provisions are hereby applied to such appeals and to such board
as are provided in cases of appeals on zoning regulations . . . . "
Mr . Buyoucos suggested to Mr . Weisburd that he consult with his
lawyers and when he wishes to get a building permit , if there have been
second thoughts , he could appeal toothe Zoning Board of Appeals .
Mr . Buyoucos said that maybe the Planning Board will say that Mr .
Weisburd is the one that is going to take a chance in this , but that he
( Mr . Buyoucos ) really thought that there should be a specific condition
that the road shall be maintained at all times in proper condition to
afford safe and adequate passage for motor vehicles to all leaseholds in
the subdivision .
Mr . May felt that Leaseholds # 5 and # 7 could be a problem since the
. driveway is off the road , and , perhaps , it should be wider for emergency
vehicles .
Mr . Weisburd explained the reasoning for the driveway set up , sta -
ting that it is like any private driveway to any private home .
Mr . May felt that there is a hang - up on this - - access to the resi -
dence is a little different . He stated that the Planning Board ' s
responsibility should be that the apparatus can get to the leasehold .
Mr . Buyoucos pointed out that the Board has that responsibility
according to Town Law ,
Mr . Weisburd suggested that in applying for their building permit
for these sites there could be included a condition in terms of what
access over the public land in terms of emergency vehicles - - and that
would be subject to Mr . Fabbroni ' s approval . He stated that the right of
way will be included with the proprietary lease and the building permit
will include , for the engineer ' s review , provision to get emergency vehi -
cles to the leaseholds .
Mr . Buyoucos stated that the Planning Board cannot authorize any -
thing that is going to mislead people . Mr . Buyoucos stated that one of
two things can be done : It has been known for Zoning Boards of Appeals
and Planning Boards and Town Boards to approve the issuance of building
permits on all lots except a couple of lots . This would enable Mr .
• Weisburd to proceed with the main part and then when he was ready to bring
something to the Planning Board , it could authorize building permits be
issued for those particular lots .
Iter . Fabbroni suggested that private access be developed to leaseholds
# 5 and # 7 sufficient in width or alignment to allow access for emergency

vehicles .
Mr . Buyoucos suggested that , after his previous suggestion , the
following be added to the previous paragraph : Provided that building
permits shall not be issued for lots # 5 and # 7 until such time as the
sponsor has extended roads subject to the above condition to lots # 5 and
# 7 .
MOTION by Mr . Henry Aron , seconded by Mr . Montgomery May :
RESOLVED , that this adjourned Public Hearing in the matter of con -
sideration of final subdivision approval for Inlet Valley Land Co - Op , Inc . ,
be and hereby is recessed until after the adjourned Public Hearing is held
in the matter of consideration of preliminary - subdivision approval for
the proposed Lagrand Chase Subdivision backlot of Ridgecrest Road .
There being no further discussion , the Chair called for a vote .

ADJOURNED PUBLIC HEARING : CONSIDERATION OF PRELIMINARY SUBDIVISION
APPROVAL FOR PROPOSED SUBDIVISION BACKLOT OF RIDGECREST ROAD , TOWN OF
ITHACA TAX PARCEL NO . 6 - 45 - l - 2 . 2 , LAGRAND E . CHASE .
Chairman Aron declared the adjourned public hearing in the above -
noted matter duly opened at 8 : 45 p . m .
He stated that the Board would look at the Environmental Assessment
Form as presented by Mr . Chase and dated July 6 , 1979 . Mr . Aron noted
that the Board members have all received a copy of this form and asked if
they had read it . They all had . Mr . Aron asked if there were any ques -
tions .
Mr . . Mazza stated that he has a question on page 2 , Item # 12 , which
indicates that the traffic generated per day is unknown , and he wondered
if there were any way to put this in . Mr . Fabbroni stated that he thought
100 cars per day could be put in .
Mr . May questioned the building unknowns in Item # 7 , page 2 . Mr .
Chase stated that they are seeking home sites and would put a limit on
proposed buildings , and , it is just a guess . Mr . Fabbroni stated that it
really does not limit Mr . Chase in terms of what he can do - - it gives
some concrete form for a basis of environmental assessment - - at least it
has some scale .
Mr . Chase noted that we are dealing with a few of these that are
pretty good sized parcels and someone might build a home and then they
might want an attached building , a little barn or garage . Anything they
• build has to receive an approval by the Building Inspector . There might
be other . buildings on this other than the primary dwelling .
Mr . Aron asked if Mr . Chase meant buildings that would be inhabited .
Mr . Chase said no . - - like a garage - - this is an R- 15 zone and they must
comply .
Mr . Mazza stated that this form is not to limit a developer , it is

to determine any significant environmental impact . Mr . Fabbroni noted
that it may affect maybe 1 + % of the whole area .
Mr . May stated that he did not see how the Board can pass on this
EAF with all these unknowns shown . Mr . Chase suggested noting that this
is whatever is allowed under the zoning restrictions . He wondered about
the coverage per lot .
Mr . Aron pointed out that this process is completely new and Mr .
Chase has never been subjected to this before . He said that it is the
duty of the developer to put everything in there within the requirements
of R- 15 - - a matter of maximum things . Mr . Aron stated that it will pro -
tect Mr . Chase as well as the environment and everybody , including the
surrounding neighborhood .
Mr . Mazza noted that Mr . Chase ' s development will be geared toward
the medium income segment of the population and if he has that idea he
probably knows what the medium income segment would build there . Mr .
Mazza suggested that Mr . Chase might be able to make a guess based on
that . He asked how many square feet of land would that cover basically .
Mr . Chase thought maybe 6 + acres .
At this point , the Board , together with Mr . Fabbroni and Mr . Chase ,
went over the EAF completely . Certain amendments were made with the
agreement of Mr . Chase and he signed the EAF as of this date . ( A copy
of the final submitted EAF is appended to the Official Minutes of this
meeting filed in the Official Minute Book of the Planning Board maintained
in the Clerk ' s Office . )
MOTION by Mr . Bernard Stanton , seconded by Mr . Edward Mazza :
RESOLVED , that the Town of Ithaca Planning Board , acting as lead
agency in the review of the proposed subdivision backlot of Ridgecrest
Road , Town of Ithaca Tax Parcel No . 6 - 45 - 1 - 2 . 2 , Lagrand E . Chase , Develo -
per , approve and hereby does approve the Environmental Assessment Form
as completed this date ; and
FURTHER RESOLVED , that pursuant to the State Environmental Quality
Review Act , Part 617 , this action is classified as Unlisted ; and
FURTHER RESOLVED , that the Town of Ithaca Planning has determined

Mr . Buyoucos dictated the following paragraphs :
• ROADS : a . The road shown on the final plat of the subdivision
plan now before the Planning Board shall be constructed by the sponsor
and shall be of a minimum width of 21 ' of which 15 ' shall be finished
with such material , in such manner and of such grade as to provide safe ,
comfortable access for motor vehicles including , especially , fire , police ,
ambulance and other emergency vehicles . Thereafter , the road shall be
maintained , repaired , and kept free of snow and ice by the Lessor
( Corporation ) . The road shall be designed by an engineer .
b . The final plat now before the Planning Board shall be
corrected as recommended by the Town Engineer and shall also include a
clear delineation of the spur running westerly along the southerly line
of lots # 3 and #4 ( at least 15 ' west of the southeast corner of lot #4 ) .
The final plat shall be further corrected by showing continuation of the

Mr . Aron asked if there were anything further. that Mr . Buyoucos

6 . It . is the determination of the Planning Board that its approval

General ( if in fact such approval is required and the Corporation is not
exempt from such requirement ) , or that any such plan has been approved
by this Board , or that all other applicable requirements of law have been
met . It should . also be made clear that approval of the Subdivision does
not mean that the streets in the Subdivision meet Town specifications or

permitted sign at their East Hill Plaza Branch . This sign reads
" Citizens " and is located on an angle over the depository . Mr . Fabbroni
noted that the Bank is allowed 21 sq . ft . of signage and they now have

COMMENTS ON SEQR ENVIRONMENTAL ASSESSMENT FORM
Mr . Stanton wished the record to show that he would like to see ,
at least , some effort to re - think the EAF that is presently being used .
He stated that it seemed to him that there are some things in it that
are unnecessary , e . g . , the part asking for future assessment figures ,
he thought that is unnecessary .
Mr . Fabbroni noted that this is a way to assure the continuation
of the character of the neighborhood . He added that traditionally
that is an argument made in three out of four cases .
Mrs . Grigorov stated that she thought that it is important to have
such environmental assessment . \
Mrs . Restaino stated that she thought that under the new SEQR law
that the Town will adopt the matter is covered and the Town is smart
to adopt both the long and the short form . She noted that presently
the Town is using the State SEQR forms .

' Mr . Keller stated that the monument will go right in the middle of
Ms . Schmitt ' s driveway .
Mr . Fabbroni concurred that the monument should go , according to
that has been surveyed , right in the middle . of Ms . Schmitt ' s driveway and
be paved over ; it can be driven flush ; the monument would be a 4 " pipe .
Mr . Fabbroni felt that it could be worked out amenably ; noting - that it is
not preferred_ to have a buried monument , but in this case it would be
acceptable .
There followed a discussion between Attorney Luster , Ms . Schmitt and
Mr . Gates which the Chair ruled out of order .
Mr . Jonson noted one more thing that he has put on the maps and that
is on the two lots at the end of the cul de sac he has shown proposed
• house elevations.
Chairman Aron declared that in view of the fact that it is now 8 : 15
p . m . and there was another public hearing scheduled for. 8 : 00 p . m . , this
public hearing would be closed for approximately 30 minutes in order that
the Board may take up the next matter after which the Ivar Jonson matter
would be taken up again .
PUBLIC HEARING : CONSIDERATION OF PRELIMINARY SUBDIVISION APPROVAL FOR
INLET VALLEY LAND CO- OP , INC . , 171 CALKINS ROAD , TOWN OF ITHACA TAX PARCEL
N0 . 6 - 33 - 1 - 4 , APPROXIMATELY 97 ACRES , JERRY WEISBURD .
Chairman Aron declared the Public Hearing in the above - noted matter
duly opened at 8 : 20 p . m . , and accepted for the record the Clerk ' s Affidavit 1
of Posting and Publication of the Notice of Public Hearing in Town Hall
and the Ithaca Journal on May 8 , 1979 , and May 10 , 1979 , respectively .
Mr . Jerry Weisburd appeared before the Board with Mr . Dennis Lowes ,
of Rowell Associates , Surveyors , Planners , Engineers , in Cortland . Mr .
Weisburd stated that his proposal for a subdivision involves 98 . 5 acres
of land located in an Agriculatural Zone in the Town of Ithaca with frontage
on Calkins Road . He said it is situated right at the bend of Calkins Road
on the slope facing the valley . Mr . Weisburd presented. a large wooden -
scale model of . the land showing in relief the topography , the trees and
the existing farmhouse . Mr . Weisburd had four pages of drawings - - final
plat , general plans , general specifications for water and general specifi -
cations for sewer .
Mr . Weisburd stated that what he is proposing is an extremely low
density type of development which leaves most of the land as open , un -
touched recreational and farm land in perpetuity which includes , among
other things , an- apple orchard . Mr . Weisburd stated that within the
space of 98 acres they are proposing nine proprietary leaseholds or
dwelling units . The first four would be along the southern boundary and
would be each 3 to 4 acres ; an additional four on the ridge adjacent to
the Glen , also 3 to 4 acres ; and one more , which does not show on the
wooden model , but is indicated on the map and has frontage on Calkins
Road . He stated that the leaseholds would comprise about 30 acres and
the remaining land would be common land .
Mr . Weisburd noted one additional change from the informal discussion
with the Board held on April 3 , 1979 , and that is that they are proposing
to _locate an additional separate leasehold which will be a private school .

He stated that the Hickory Hollow School in Newfield is looking for a
new home and they are negotiating with them right now for relocating and
building a school house on this parcel . j
. Mr . Weisburd stated . - that , in terms of the Co - Op , it is a. non - profit
corporation and it has been formed and they now own the land and are in
the process of approving the corporation through New York State . He
said that the members own all the stock . He stated that each stockholder
gets a proprietary lease with exclusive right to the leasehold until they
sell the stock .
Mr . Weisburd stated that the road will be a private road which will
be fully constructed and maintained by the Co - Op .
Mr . Weisburd stated that they are getting ready to go the Health
Department .
Mr . Aron asked if there were any questions from the public ? There
were none . Mr . Aron asked if there were any questions from the Board ?
Mrs . Bronfenbrennerstated that she could see that they have a road
servicing the lower lots , and she asked about servicing the upper lots .
Mr . Weisburd described the service to lot #, 8 , to lots # 1 and #2 , i
branching off to service lots # 3 and #4 , and then a part branching off to
the west servicing the remaining lots .
Mrs . Bronfenbrenner noted that if these are private roads they do
Opot have to be 50 ' or 60 ' widths .
Mr . Fabbroni stated that Mr . Weisburd ' s attorney presented to him
on Friday the By - Laws of the Inlet Valley Land Co - Operative , Inc . Mr .
Fabbroni stated that these by - laws must be reviewed by the Town Attorney
for their completeness ; this is required by the Subdivision Regulations .
Mr . Fabbroni said . that he expects that the Town Attorney will go over
these . in detail . Mr . Fabbroni spoke to one item having to do with the
Town of Ithaca regulations. for road , answering Mrs . Bronfenbrenner ' s
question , in . that the maintenance of the road is borne equally by all
the leaseholds .
Mr . Fabbroni stated that if the developer intends to make the road
part of the corporation agreement or by - laws whereby everyone shares in
the private maintenance of the roads with . . no - . idea of . ever , giving them to
the Town , the Town would review the roads with much different criteria
than if he were going to deed them to the Town at some time .
Mr . Lowes described the roads in detail . Mr . Fabbroni stated that
the Planning Board will review such a road in two different lights depen-
ding on the answer to who will own and maintain them in the future .
Mr . Weisburd stated that it is absolutely positive that the roads
will be private and maintained by the Co -Op forever .
Mrs : Bronfenbrenner wondered about a cul de sac for a turn - around
•for emergency vehicles . Mr . Fabbroni felt that it was kind of meaningless j
for the kind of road we are looking at - - first of all the road is way
in excess . of 500 ' and it is steep .
Mrs Bronfenbrenner asked about fire protection and ambulances getting

Mr . Lowes stated that the slope would be a 10 % maximum . Mr . Weisburd
• stated that they should be well within the limits of the Town specifications:
for maximum grade .
Mrs . Bronfenbrenner stated that they will still need a turn - around .
Mr . Weisburd agreed and stated that they will be able to put that in .
Town Councilman Gust Freeman stated that obviously the developers
have not been to the banks about the possibility of mortgages on a private
road . Mr . Weisburd wondered why he said obviously . Mr. . Freeman replied
that banks will not give mortgages on private roads . Mr . Weisburd said
that this is not true ; they have been to the banks .
Mr . Fabbroni stated that the Town Attorney will want the rights of
the leaseholders to access to their properties spelled out clearly . Mr .
Fabbroni said that the preliminary map showed over a 10 % slope , but the
map , or survey , shows it better . Mr . Fabbroni said that this is prefer -
able to the farm road that is there now . Mr . Baker agreed . Mr . Fabbroni
commented while the discussion is on the road , with that type of grade
more information need be shown on how runoff is control- led .
Mr . Lowes explained to Mr . Fabbroni and the Board that this is
underway . Mr . Lowes described the drainage referring to the map .
Mr . May noted that they are proposing 9 leaseholds plus the school ,
therefore , there will be . 10 . Mr . Weisburd agreed .
Mr . Weisburd stated that they have people interested in the old
farmhouse . He said that they have offered them membership in the Co - Op
but they are leaning away from that . He stated that he did not know if
that would be a problem or not ; right now the Co - Op owns the entire
parcel . He said he would like to leave that as an option for them ;
hopefully when they come back with the Health Department approval and
other decisions they will have that worked out .
Councilman Freeman wondered what would happen if at some time in
the future one of these gentlemen wishes to sell his stock ? Mr .
Fabbroni explained that the Town Attorney will attend to that kind of
question in his review .
Mr . Fabbroni stated that the developer will have to submit a long
form Environmental Assessment Statement with this project .
Mr . Lowes stated that the form is completed and he presented it to
Mr . Fabbroni .
Mr . Fabbroni wished to know what the developer was proposing , if
anything , for the old dam that is in the creek , Woodcock Creek , and
also to what extent they may be considering using the gravel areas on the
site ?
• Mr . Weisburd stated that they will have more of an answer to the
second question at the time of the next meeting - - they are afraid that
they might damage the property too much if they do any gravel extraction .
He asked if , on the first question , Mr . Fabbroni wanted to know about the
dam in r.elations . . to the school ? Mr . Fabbroni stated that it was the
school to which he was referring and noted that there may have to be some

sort of sophisticated pressure system insofar as fire - protection for
the school goes . Mr . Weisburd stated that the school would be of frame
onstruction with direct access to the outside ; there would probably not
e pressurized sprinkler systems . Mr . Weisburd stated that they are j
eeping in mind the reservoir for a source of water for the farmland . i )
Mr . Fabbroni stated that most of his other questions have to do with
some things that he would pursue with Mr . Weisburd in the by. - laws in the ;
course of an office meeting , if that is alright with the Board ; there are
some questions that can be cleared up before discussions with Mr . Buyoucos .
Mr . Fabbroni asked if the developer were planning on individual wells ?
Mr . Weisburd stated that they were . Mr . Fabbroni pointed out to the
developer that he. must be aware of . the Health Department regulations with
regard to SPEDES permits , etc . , which will be a requirement of any final
approval .
Mr . Stanton commented that this proposal seems to him to be a much
better use of land in an agricultural zone that the typical division of
agricultural land . He noted that one of the Planning Board members is a
full - time farmer , and he wondered if he agreed . Mr . Baker stated that
he agreed that this was a good proposal for the land in question .
There being no further discussion , the Chair declared the Public
Hearing in the matter of the consideration of preliminary subdivision
approval for the Inlet Valley Land Co - Op on approximately 98 acres duly
closed at 8 : 45 p . m .

RESOLVED , that the Planning Board of the Town of Ithaca grant and .
hereby does grant preliminary subdivision approval for Inlet- Valley Land
Co - Operative Inc . , 171 Calkins Road , Town of Ithaca Tax Parcel No . 6 - 33 -
1 - 4 , approximately 98 . 5 acres , as presented on May 15 , 1979 , on map
entitled , " Final Plat , Inlet Valley Land Cooperative Inc . , Owner . Jerold
M . Weisburd , Part of Lot 79 , Town of Ithaca , Tompkins County , New York ,
Project No . 1938 , " drawn by Rowell and Associates P . C . , 111 West Road ,
ftCortland , N . Y . 13045 , subject to the review and approval of the By - Laws
of said Cooperative by the Town Attorney and subject to the approval of
the Town Engineer of drainage and roadway plans .
By way of discussion , Mrs . Bronfenbrenner pointed out Appendix A of
the Subdivision Regulations referring to Section 277 ( Approval of Plats ;
Additional Requisites ) and in particular the final paragraph thereof which
stated that the Planning Board may waive certain provisions . The Board
agreed that it will address those matters at the time of final discussion .
There being no further discussion , the Chair called for a vote .
