HomeMy WebLinkAboutPB Minutes 1979-06-26 TOWN OF ITHACA PLANNING BOARD JUNE 261 1979 The Town of Ithaca Planning Board met in regular session on Tuesday , June 26 , 1979 , in Town Hall , 126 East Seneca Street ( second floor ) , Ithaca , N . Y . , at 7 : 30 p . m . PRESENT : Chairman Henry Aron , Liese Bronfenbrenner , James Baker , Bernard Stanton , Edward Mazza , Montgomery May , Barbara Schultz , Carolyn Grigorov . ALSO PRESENT : Town Councilwoman Shirley Raffensperger , Edgar Raffensperger , John Bodine , Robert McGuire , Carol Eisenberg ( It: haca Journal ) . Chairman Aron declared the meeting open at 7 : 30 p . m . REPORT OF COUNTY PLANNING BOARD REPRESENTATIVE Councilwoman Raffensperger reported to the Board on the June 13 , 1979 , meeting of the County Planning Board , noting that the County Planning Board does not meet in the summer , the next meeting being September 1_ 2 , 1979 . She stated that the Board discussed as part of Mr . Liguori ' s report of the activities of the Ithaca- Tompkins County Transportation Commission , short and long term solutions to the gas shortage problems including car - pooling . It was noted also that the final planning for the Northeast Transit System is underway with a start - up date of September 3 ;, 1979 . Mrs . Raffensperger stated that the Route 13 corridor was discussed and its impacting of farm land . A , .workshop was scheduled for June 18 at the Village of Dryden Hall . Handouts showing the various " B " alternatives were distributed and Mr . Missirian described features of B - 5 and compared them with B - 1 . Mrs . Raffensperger stated that the Committee on Railroad ROW Recrea - tional Trails presented a resolution asking for involvement by those Towns and Villages interested in the development of the recreational trails since it may take some time to develop a community consensus for an acceptable management plan . The resolution recommended that in this interim period these municipalities continue to pursue acquisition and hold rights - of - way intact , and further , that the representatives of these municipalities serving on the County Planning Board serve as liaison to the Railroad ROW Recreation Trails commiittee . The resolution was adopted by majority vote . Mrs . Raffensperger reported that the German Cross Road Bridge matter was discussed , and at this point the problems seem to have been solved . Mrs . Raffensperger reported on one interesting point that came up for discussion when the Dryden Town representative raised the question of whether or not there is a " grandfathering " element in the County Sanitary Code requirements as they pertain to a lot requiring a septic system and such lot being required to be large enough to inscribe a 200 ' circle om it . It appears that a developer there had received subdivision approval about two years ago and then all at once he cannot sell those lots because they cannot be granted Health Department approval . The general feeling of the County Planning Board was that lots approved prior to the revised Code should stand approved . However , after the meeting a notice was printed in the Ithaca Journal which said that all Health Department approvals granted prior to the adoption of the revised Code terminated in July of 1979 . Planning Board - 2 - June 26 , 1979 Chairman Aron thanked Mrs . Raffensperger for her report , particularly in view of the fact that she was not feeling well . ® APPROVAL OF MINUTES MOTION by Mr . The MOTION was declared to be carried unanimously . Mr . May offered a general commendation on the quality of the Minutes that appear before the Board for consideration of approval . The Board members concurred with Mr . - May ' s statement . ADJOURNED PUBLIC HEARING : PRELIMINARY SUBDIVISION HEARING , COY GLEN ROAD AND ELM STREET EXTENSION , TOWN OF ITHACA TAX PARCEL N0 . 6 - 29 - 8 - 5 . JAMES P . CRONE . . . . . . . . . . . . . . . . . . . Chairman Aron declared the adjourned Public Hearing duly opened in the above - noted matter . Mr . John Bodine of Dick Wilsen Real Estate , appeared before the Board on behalf of Mr . Richard Mellen , who had represented Mr . Crone at the June 12 , 1979 , . meeting of the Board . Mr . Bodine described. the property again for the Board noting that it contains approximately 16 acres and is owned by Mr . James P . Crone , the son of Mr . James M . Crone , P . E . , now deceased . Mr . Crone lives in Richmond , Virginia . Mr . Bodine stated that the land has been listed for sale for some time . He stated that the proposal is for four lots , one of which fronts on Elm Street and is 150 ' x 200 ' served by municipal sewer but no water . The other three have frontage on Coy Glen Road and access therefrom and contain approximately 5 acres each . He noted that lot #2 has two � access . :. lanes to Elm Street , as well as the frontage on Coy Glen Road .. . He stated that Mr . McGuire , present this evening , has tendered a purchase offer for lot #2 . Mr . Aron asked that the Committee appointed at the last meeting report on its findings . Mr . Baker stated that the Committee , Mrs . Schultz , Mrs . Grigorov , and himself , met with Mr . Mellen on site on June 18th . They walked along the roads - Coy Glen Road and Elm Street Extension . They entered the site to some extent . Mr . Baker reported that the area has grown up very much since he last saw it in terms of vegetation . He stated that the Committee saw the size of the lots proposed . Mrs . Grigorov stated that it is a beautiful place certainly , and would be very nice for homesites . Mr . Baker stated that the size of the ditch there is a problem . He noted that lot # 3 has an existing culvert . He stated that lot #4 has a problem with the existing access . Mr . Baker pointed out that the problem looks much ,: more serious than it is really because of the road ditch . He stated that the drainage goes toward Coy Glen Road . Mr . Baker said that the Committee found that the access to lot #2 is good from Elm Street , • it having two accesses . All in all , the proposal looks good for four home - sites since the land could well be used with certain improvements in ditching . Mr . Aron questioned the matter of surface drainage and where to catch it . Mr . Bodine stated that that would be up to the person who builds on Planning Board - 4 - June 26 , 1979 the lots but that only the overgrown vegetation would be removed . ® Mr . Baker stated that there should be only one house per lot absolutely . He added that anything that is done in terms of developing would improve the drainage . Mr . Baker reiterated that the size of the ditch , which is eroded and in some places almost ten feet deep puts things out of perspective and makes it look like access is a problem which it really is not . He added that it might look like the grade would be a problem with bringing a drive straight in , but this is not so . Mr . Mazza wondered if someone might not want to subdivide each 5 acre lot - - what would happen in that case ? Mr . Bodine stated that approval from the Health Department would be difficult to achieve and also the Planning Board would have to approve any further subdivision . Mrs . Bronfenbrenner noted also the access problems for lots # 3 and #4 . Mr . Aron asked if there were any comments from the public . At that point , there were none . Mr . Stanton , speaking to Mr . McGuire , stated that it was :his under - standing the Mr . McGuire ' s intention was to keep lot # 2 as one lot . Mr . McGuire stated that it was . Mrs . Grigorov asked if the Environmental Assessment Form had been • submitted . The Secretary presented the form as completed by Mr . Richard Mellen , Chairman Aron read the form in its entirety to the Board and the public . Certain amendments were made :- with the concurrence of Mr . Bodine , e . g . , the form submitted indicated no information on predominant: soil type and after Mr . McGuire indicated that in the early 1950s Mr .. Crone certified . the .. land as being clay / loam , that line was corrected to read clay / loam , and , further , where no information was indicated for the depth to bedrock and after Mr . McGuire indicating that two or three water wells drilled in the early 1950s also and those results are not available , that line remained to read " no information " . A lengthy discussion of the EAF ensued and further amendments were made with the concurrence of Mr . Bodine , e . g . , the approximate percentage of proposed project site . with slopes was changed from 10 - 157o to 15% or greater , and , the ravine as noted on the map presented was delineated on the item asking if . there were any unique or unusual land forms on the project site . Mrs . Bronfenbrenner stated that for final approval the Board will need to have information on the depth to bedrock and depth to the water table as well as a statement from the Town Engineer setting forth any requirements he may have . Richard Mellen and John Bodine , at a Public Hearing held on June 12 , 1979 , and adjourned to June 26 , 1979 , and as shown on plan presented entitled " Cedarhurst " , Elm St . & Coy Glen Rd . , Ithaca , N . Subject to a recommendation for approval by the Town Engineer as far as drainage on all four lots , road cuts , and access . By way of discussion , the Board discussed its condit on: ,. referring to road cuts . Mr . May stated that if the Town Engineer determines that road cuts are not necessary at this time , then it would be fine with him , but that it should be in the resolution so that he can make a determination on such a matter . There being no further discussion , the Chair called for a vote . Aye - Aron , Bronfenbrenner , Baker , Stanton , May , Grigorov , Schultz , Mazza . Nay - None . ® The MOTION was declared to be carried unanimously . The Chair declared the Public Hearing duly closed at 8 : 45 p . m . RESOLUTION ON DOCUMENT SUBMISSION TO PLANNING BOARD MOTION by Mr . Henry Aron , seconded by Mrs . Liese Bronfenbrenner : RESOLVED , that in matters of applications for subdivision approval , prior to Public Hearing , developers shall provide the Planning Board with ten copies of the subdivision map and ten copies of the completed Environ - mental Assessment Form and be prepared to accompany a designated committee of the Planning Board on a tour of the proposed site with any other separate documents such developer deems necessary or appropriate . There being no further discussion , the Chair called for a vote . Aye - Aron , Bronfenbrenner , Baker , Stanton , May , Grigorov , Schultz , Mazza . Nay - None . The MOTION was declared to be carried unanimously . REPORT OF PLANNING BOARD PROCEDURES COMMITTEE Mr . Mazza reported that the Planning Board Procedures Committee met on June 20th , with Mr . Aron , Mrs . Fuller , and himself present , and drafted four pages of proposed procedures - - about half way through . He :indicated that the thrust is more -,.- toward the actual legal processes and less toward more particularized requirements . ADJOURNMENT Upon Motion , the meeting was adjourned at 9 : 05 p . m . Tier East , Regional Planning Development Boare, C . Cox reported that he has met with Joe Frey , staff member of the STERPDB . He • and other Board members plan to visit the Groton Health Center and get informed about human service activities . At present they are reviewing the Learning Web ' s requests for funding . Update on Rt . , 13 Corridor F . Liguori reported that since the last meeting, copies of the Rt . 13 map showing the B -1 and other alternatives have been distributed . This was for the purpose of conducting a workshop session to be held on June 18 at the Village of Dryden Hall . He said that the workshop will be followed . by a public hearing . H . Missirian distributed a handout showing the various "B " alternatives . He des - cribed features of B-5 and compared them with B-1 . A copy of the handout is attached together with a supporting map which shows soil capabilities . Update on Railroad . ROW Recreational Trails T . Brown reported that his committee had met and discussed future plans relating to the Lehigh Valley railroad ROW use . The Committee has prepared a resolution which he presented for the Board ' s consideration as follows : RESOLUTION - RAILROAD ROW RECREATION PLAN WHEREAS , the Towns of Dryden , Groton , and Ithaca , and the Villages of Freeville , Groton and Dryden have expressed interest in negotiating for the purchase of the Lehigh Valley Railroad rights-of-way from East Ithaca to Freeville and Dryden to Groton , and WHEREAS , plans for management , . research on liability , and costs are being • developed cooperatively by the Tompkins County Planning Department , Tompkins , County Planning Board , and the Tompkins County Environmental Management Council , and WHEREAS , it may be some time before the . most acceptable plan for management will evolve through a community consensus , therefore be it RESOLVED , that the Tompkins County Planning Board recommends that in the interim period of time the above municipalities continue . to pursue acquisition and hold the rights -of-way intact for a year . or two during which time the con- cerned agencies , Boards , Councils and groups might work with the municipalities to determine the best use and management of the rights-of -way , and RESOLVED , further , that the representatives of the above municipalities serving on the County Planning Board are requested to serve as a liaison to the Committee studying the recreational use of the rights-of-way and to solicit from the . local Planning Boards and Legislative Boards of the above municipals- ties the current status of negotiations and to keep the Committee informed on the progress , concerns and needs of the municipalities so that we may assist as appropriate . Mr . Brown said the Committee will be active during the summer and follow developments with municipalities in order to know where we stand come September . P . Finger , EMC . Coordinator , reported that insurance premiums for land banking of the ROW as reported by Carey-McKinney are $ 45 per mile for $ 500 , 000 liability . • R . Stevenson reported that the Village of Groton has made an offer to Lehigh Valley but has not received a reply . The Village is opposing recreation along its ROW because it will need policing 24 hours and they don ' t have that kind of police power . E . Bayley also reported that the Village of Freeville has similarly not received any reply from Lehigh Valley . She said that George Junior Republic has blocked off the ROW because it provides a direct access to their lands and they want to protect themselves . G . Freeman asked what the problem with Cornell University is ? S . Raffensperger said that the Town of Ithaca has preferential rights to exercise on ROW acquisition . G . Colman pointed out that the resolution presented by the Committee is a sequal to the resolutions approved at the previous meeting and provides continuity . T . Brown Moved that the resolution be considered , seconded by S . Raffeinsperger , the Motion was approved with 11 in favor , 4 opposed , 1 abstention . Planning Department Report A-95 Reviews F . Liguori read applications from Southern Tier East Regional Planning Development Board requesting funding . G . Colman asked if these projects were reviewed already at the regional level and also why the State goes to the region for approval where federal funding is involved . F . Liguori replied that the State A-95 Clearing House has designated appropriate regional agencies with review power . The STERPDB has an option to commer.:t , and all those agencies who have an involvement have an opportunity to comment . He said that the County Planning Board may comment and if so , he will convey the comments to STERPDB . ® German Cross . Road : Bridge F . Liguori reported that when bridges in Tompkins County are longer than 25 feet on Town roads , the county assumes responsibility for maintenance . He said that the bridge under consideration is 76 feet long . The improvements planned for the bridge have raised some local concerns , especially fears of increasedtraffic and flooding . The approaches to the bridge are hazardous and need attention . He said there will be a meeting of the Planning and Public Works Committee on June 22nd to further discuss this matter . E . Bayley pointed out that since the community pays county officials . that their com- ments ought to be honored . V . Miller reported that NYSEG had presented a fine but . costly plan at the Town of Lansing Planning Board meeting , to rehabilitate the proposed new power plant site . P . Komar reported that NYSEG has come up with a . program to revegetate the whole site to bring it to the condition desired . R . Stevenson reported that calls to Groton are no longer long distance . T . Schultz said he had enjoyed his association with the Board . The Board thanked him for his services and wished him well . L . Miscall said it is customary at this time not only to adjourn the meeting but also take a break during the summer months and meet again in September . Since my last report to you on June 11th , 1979 , the Planning Board has met three times , June 12th , June 14th , and June 26th . In addition , three committees of . the Board met. as follows : .1 �� r� t. ► Er/� , a . ad hoc Committee , ,lchaired by Mr . James Baker , with Mesdames Schultz and Grigorov as members , walked the land proposed for subdivision into four lots , by James M . Crone , at Coy Glen Road and Elm Street Extension . b . The Planning Board Procedures Committee met on June 20th and drafted four pages of proposed procedures . Mr . . Edward Mazza chairs that Committee with Members Aron and Fuller being present . Jvly 7.rh ce ad hoc Committee , , chaired by Mr . Henry Aron , with Mesdames Schultz and Bronfenbrenner as members , walked the land proposed .for sub - division into 10 lots , by Lagrand Chase , backlot of Ridgy. crest Road , 30 acres with 70 ' access . 1 . On June 12 , 1979 , the Planning Board met in regular session with all members present . Two sets of Minutes were approved and reports were heard from the Building Inspector , the Town Engineer and the rFown Planner . A Public Hearing was held at 7 : 45 p . m . to consider preliminary subdivision approval of a 4 - lot subdivision on 16 acres of land , James M . Crone , owner , with no decision being reached . The Chair appointed art ad hoc Committee to walk the land as mentioned a few moments ago . The Public Hearing was adjourned to 7 : 45 p . m . on June 26th . Town Attorney Buyoucos spoke to the Board at length and in detail about the status of the Ivar Jonson subdivision matter . Mr .
