APRIL 17 , 1.979
A regular meeting of the Town of Ithaca Planning Board was held on
Tuesday , April 17 , 1979 , in Town Hall , 126 East Seneca Street ( second
floor ) , Ithaca , NY , at 7 : 30 p . m .
PRESENT : Chairman Henry Aron , Montgomery May , Edward Mazza , Liese

Chairman Aron declared the meeting duly . open at 7 : 34 p . m . and
noted that a quorum was present .
PUBLIC HEARING : CONSIDERATION OF PRELIMINARY APPROVAL OF PROPOSED
SUBDIVISION OFF HAYTS ROAD , TOWN OF ITHACA TAX PARCEL N0 , 6 - 24 - 1 - 41 . 2 .

Chairman Aron declared the Public Hearing in the above - noted matter
duly opened at 7 : 34 p . m . and presented for the record the Town Clerk ' s
Affidavit of Posting and Publication of the Notice of Public Hearing in
the Ithaca Journal on April 12 , 1979 .
® Mr . Howard Schlieder , Engineer and Surveyor , spoke on behalf of Mr .
MacLean and presented to the Board a Map entitled " Subdivision Map of
Lands of John MacLean on Hayts Rd . , Town of Ithaca , Tompkins County ,
New York , dated February 27 , 1979 , revised April 17 , 1979 " .
Mr . Schlieder read his Report on Drainage for Proposed MacLean
Circle Subdivision , as follows :
" The area , whose runoff contributes to the drainage ditch between
the houses on Hayts Road and the proposed subdivision , is .- roughly - 17
acres ; being only those lands east of Sheffield Road and north of Hayts
Road .
The original course of Indian Creek was and still is diverted at
the intersection of Sheffield Road and Hayts Road . Those waters travel
three tenths ( 0 . 3 ) of mile northward in a roadside ditch before going
eastward into another stream .
The westernmost five acres of the drainage area is a cultivated
field bounded on the eastern side by a hedgerow which tends to direct
overland flows in this parcel to that northerly stream .
The culvert through which the drainage must flow under the Pro -
posed MacLean Circle is 18 " in diameter with a slope of 0 . 47% . From
the Nomograph for a Corrugated Metal Pipe with an " N " ( co - efficient of
friction ) of 0 . 015 , the capacity is 6 cubic feet per second at a velo -
city of 3 - 1 / 2 feet per second . The culvert is situated about three
hundred feet upstream from the easterly side of this subdivision
effectively removing about three and a half acres , leaving approximately
nine acres to drain through this culvert . Without figures to sub -
stantiate my conclusion , I judge that no alteration or addition is

needed to protect properties on both sides and downstream from this
_ culvert .

Mr . Aron noted that the developer is proposing a development here
on four lots , backlot of existing lots fronting on Hayts Road and con -
taining 1 . 48 acres each . Mr . Schlieder concurred , but noted that there
is one existing house already on one of the four lots . Mr . Schlieder
stated that they are requesting subdivision approval for a four - lot
subdivision ( including the one lot upon which the existing house sits )
at this time . He stated that they will probably ask for subdivision
approval for the next six lots backlot of the present proposal next
year . He noted that a four - lot subdivision does not fall under the
Health Department requirements for a major subdivision . The future
subdivision proposals will have to meet all the requirements for such
" major " subdivision at that time . He pointed out that Mr . MacLean is
not a wealthy man and wishes to develop his land slowly .
Mr . Aron noted that the developer has shown a 50 ' road on the
plan presented , and asked if that is acceptable . Mr . Fabbroni stated
that insofar as the 50 ' right of way that presently exists coming off
Hayts Road , it has been the practice of the Town Board to accept the
50 ' where it is a flat terrain and where the 50 ' is sufficient for
the roads and ditches . He noted that 60 ' is the required right of way
where one does not exist or meets those criteria .
Mr . Aron asked if the proposed turn around is appropriate for snow
plows and fire engines to maneuver in . Mr . Fabbroni stated that the
Town would prefer to have this type of turn around over a circle . Mr .
Fabbroni noted that this proposal meets what he asked for at the last
meeting .
Mr . Fabbroni said that he should state for the record that there
will be a swale or some kind of cut off for drainage of the lots .
Mr . Fabbroni wondered how the developer was going to treat the drainage
that would normally sheet down .
Mr . Schlieder stated that he thinks a swale would be the answer
and added that all these proposed four lots could drain into Indian
Creek .
Mrs . Bronfenbrenner asked if she were right in thinking that eventually
this road would be a cul de sac ? Mr . Fabbroni stated that the road would
eventually go back to Sheffied Road , Mrs . Bronfenbrenner asked if it is
okay for the cul de sac to be more than 500 ' - - about 700 ' - - from
Hayts Road and added that it seems like a terribly long cul de sac even
for a short term . Mr . Fabbroni stated that it was not for the number
of homes on it .
Mr . Aron asked if there were any questions from the public . There
were none .
Mr . Mazza asked if 18 " - were okay for the culvert for all that
drainage ? Mr . Fabbroni stated that Mr . Schlieder has said that he has
no doubt in his mind that it is sufficient . Mr . Fabbroni . stated that
he would like to be convinced with that slope because it flattens out
so much and added that they are down to about a 1 / 270 slope . Mr .
Fabbroni stated that it was his opinion that the Board , maybe as a

contingency , should be convinced by a sample calculation for , say , a
_
25 - year - storm . Mr . Fabbroni said that he is not really bothered about
® the four lots here proposed , but where it becomes a concern is what
happens in the future up farther when you had further parking areas and
other impervious buildings . Mr . Fabbroni stated that he did not think
it unfair to ask for at least a sample peak storm .
Mr . Aron asked if Mr . Fabbroni would feel better if that slope ,
instead of . 47 , were . 70 ? Mr . Fabbroni replied that if that cannot be
improved upon , he wants to know if that pipe is . going to take it for a
big storm .

Mr . Baker wondered if he goes bigger , how can the pipe be below the /
Mr . Schlieder stated that for the four lots proposed there is
adequate drainage - two lots to go through that particular culvert . He
said that for the remaining lots to be built later his drainage will
go in the other direction . Mr . Schlieder stated that this culvert
probably handles . four acres at the most .
Mr . Fabbroni , speaking to the Board members , stated that it is not
the kind of thing that should make them approve or disapprove . He said
that we can certainly ask for a peak flow calculation . If those
calculations substantiate Mr . Schlieder , then that is that .
Mrs . Bronfenbrenner asked if the Board wishes to consider park land
for the four lots now , at this point , or when the full subdivision is
considered for approval ?
Mr . Schlieder said when they go to the Health Department for the
full subdivision which is five lots or more .
Mr . Aron stated that Mrs . Bronfenbrenner is asking whether the Board
should be asking for 10% of the area for parkland at this time or not .
Mr . Aron asked where they intend to provide this ?
Mr . Schlieder replied probably in Stage 3 in the upper corner . Mr .
Schlieder commented that in developing land , there are two ways to do it .
One is to level the land and develop two hundred houses , or , you can do
it piecemeal . Mr . Schlieder noted that Mr . MacLean is a small builder ,
he does 10 to 12 houses a year . He stated that Mr . MacLean wants to
build four or five houses this year and have it grow . He noted that
there is the economic factor also .
Mr . MacLean stated that as far as designating park land , he just
cannot afford it .
Mrs . Bronfenbrenner pointed out that there are also alternative
choices .
Mr . MacLean pointed out to the Board that there is almost a park
area for each lot , the proposed lots being 1 . 48 acres each .
Mrs . Bronfenbrenner stated that that is certainly something to
consider :.
There being no further discussion from the floor , Chairman Aron

MOTION by Mr . Henry Aron , seconded by Mrs . Liese Bronfenbrenner :
RESOLVED , that the Planning Board of the Town of Ithaca grant and
hereby does grant preliminary subdivision approval for a four - lot sub -
division off Hayts Road , Town of Ithaca Tax Parcel No . 6 - 24 - 1 - 41 . 2 ,
John D . MacLean , Developer , as shown on Subdivision Map presented this
date entitled " Subdivision Map of Lands of John D . MacLean on Hayts Road " ,
drawn February 27 , 1979 , revised April 17 , 1979 , by Howard R . Schlieder ,
N . Y . S . P . E . & L . S . , subject to approval by the Town Engineer , subject to
the approval of the Tompkins County Health Department , and contingent
upon the receipt of a drainage plan for a 25 - year storm .
By way . of . discussion , Mr . May stated that he , personally , does not
think that we have to set aside park land on four lots , but , he thinks
we should consider it for discussion at a later date .
Mr . Fabbroni stated that for consideration of a general policy , at
what point is the 10% requirement reduced - - the Health Department accepts
one acre lots .
Mr . Baker pointed out that there is a lot of land in this area which
will never be able to be developed .
Mr . May said that he thinks it is reasonable to set aside land for
park , and if it is undevelopable , that is alright too . Mr . May stated
that he cannot in good conscience , vote , because of his ( MacLean )
attitude .
Mr . Baker stated that Mr . MacLean feels very much like a lot of
people up our way do - - and they go into Enfield and build .
Mrs . Bronfenbrenner stated that this is a much better plan that
is here presented than the one before .
Mr . Baker stated that this is a lot different from East Hill where
we want park land .
Mr . Aron noted that we do need housing to be built , but we do not
want neighbors to suffer . Mr . Aron asked Mr . May if he would like to
amend the Motion to add the consideration of park land .
Mr . Gust Freeman , speaking as a resident and not as a Town Council
member , stated that if and when Route 96 ever does get completed , that
is going to open up West Hill for development . and the idea of park
land has to be thought about . He noted that some day we will have to
have water and sewer .
Mr . Mazza said that the Board has to consider it at some point .
Mr . Fabbroni . suggested considering land for open space . He noted
also that if the Board thinks the lots are large enough , it could
consider 5% .
MOTION TO AMEND MOTION by Mr . Montgomery May , seconded by Mr . Henry
Aron :
RESOLVED , that the Motion on the floor be amended to state that
prior to approval for Phase 2 of the MacLean Subdivision , the builder
will agree to set aside land for future park or to agree on payment in

The MOTION in its entirety was declared to be carried unanimously .
REPORT OF TOWN COUNCILWOMAN SHIRLEY RAFFENSPERGER , COUNTY PLANNING
BOARD REPRESENTATIVE AND VICE - CHAIRMAN .
Unfortunately Mrs . Raffensperger had a conflict of meetings between
the Town Planning Board and the Sewer4Planning Committee in Dryden and
was unable to attend . Mrs . Raffensperger had expressed her apologies
for not being able to be ' present and had asked that the Secretary read
her Report on the April 11 , 1979 , County Planning Board meeting , as
follows :
" County Planning Board Chairman , Gould Colman , suggested that the
County Planning Board should invite other County planning groups , e . g . ,
Environmental Management Council , Economic Advisory Board , Transporta -
tion Commission , and others , to make annual reports to the County
Planning Board so that it might better perform its functions as a
" Co - ordinator of Planning Functions " . A Resolution on this matter is
to be considered at the May meeting .
Shirley Raffensperger reported for the Lehigh Valley Railroad
Right of Way Committee . The Board discussed the concept of a Recrea -
tion Commission , a non - profit public corporation , as a possible manage -
ment tool for those portions of the Right of Way that may be developed

for recreational use . The County Planning Board passed two resolutions ,
as follows :
® 1 ) Directing that the draft document describing the possible structure
and responsibilities of such a Commission be transmitted to all of the
involved municipalities and other interested organizations for their
comments .
2 ) A resolution to the County Board of Representatives urging the
County Board , its committees and staff , to assist the various munici -
palities and interested organizations to develop a management plan for
the entire corridor .
Town of Ithaca Councilman Gust Freeman , of the Transportation
Commission , reported on the Northeast Area Transit Study Committee ' s
Report , and there followed a discussion of a recommendation to extend
service as of September 1979 for a nine - month trial period . The
allocation of a subsidy has not been agreed upon . A resolution on this
matter is . to be presented to the County Planning Board at its May
meeting .
The Route 13 corridor has been agreed upon by the municipalities
and is " County ' B '" route .
The County Planning Board will co - sponsor with the State Energy
Office an Energy Code Workshop on May 1 , 1979 , at 7 : 30 p . m . at Tompkins
Cortland Community College .
The County Planning Department reported on the Solid Waste Study .
The next step is a preliminary Environmental Impact Statement , to be
available in June of 1979 . ( This EIS should answer some of the Town
of Ithaca ' s concerns . The plant would handle waste from Tompkins ,-
Cortland , Cayuga and Tioga County , would look to Cornell as buyer of
power , location of plant - - possibly in the orchard area , Route 366 .
The Town ' s concerns are , among others : location of the plant , air
quality , trucks bringing in waste , taking out residue and impact on
Town streets and residential areas , storage of solid waste , large
capital costs , etc . , etc . I am sure we will want to keep up to date
on any developments concerning this project . ) "
Mr . Gust Freeman noted that NYSEG is also considered to be a buyer
of the station . He added that the residue would be less than loo - -
less than Milliken Station fly ash .
DISCUSSION OF PROPOSED PLANNING BOARD RESOLUTION IN RE PROPOSAL FOR
TOWN / COUNTY , COUNTY / TOWN ROAD SWAPS .
Chairman Aron read a proposed resolution on the above - noted matter
as follows :
RESOLVED , that the Planning Board of the Town of Ithaca support
and hereby does support the resolution adopted December 11 , 1978 , by
Ah the Town Board of the Town of Ithaca with respect to the exchange of
the Town portion of Sheffield Road from Hayts Road to Townline ( Iradell
Road ) , ( approximately . 86 miles ) for the County portion of Renwick
Heights Road ( approximately . 50 miles ) and the County portion of Judd
Falls Road from . Forest Home Drive to Route 366 .
Mr . Aron asked Mr . Fabbroni to describe some background on this
Planning Board - 7 - April 17 , 1979
matter . Mr . Fabbroni reviewed this proposal of road swaps and described
the benefits of each . He noted that the portion of Sheffield Road
proposed for swapping is the only portion of this County Road that is a
Town road ; and , that the portion of Renwick Heights Road is an ancient
portion of a County Road that is in the Town . He noted that some
problem occurred in that the County Commissioner wanted Cornell to
take over part of Judd Falls Road . He stated
that the latest Town Board resolution is to have the Town take all of
the County portion of Judd Falls Road from Forest Home Drive to Route
366 since Cornell has not acted .
Mr . May commented that the Town would be incurring some additional
costs , e . g . , plowing and maintaining .
Mr . Fabbroni agreed that it is not a one - to - one swap , but there is
more repair needed on the Sheffield Road .
Mr . Aron stated that the Planning Board should re - assert this
proposition so that it moves along .
MOTION by Mrs . Liese Bronfenbrenner , seconded by Mr . James Baker :
RESOLVED , that the Planning Board of the Town of Ithaca support and
hereby does support the resolution adopted December 11 , 1978 , by the
Town Board of the Town of Ithaca with respect to the exchange of the
Town portion of Sheffield Road from Hayts Road to Townline ( Iradell

The Chair directed the Secretary to transmit a certified copy of
the above - noted Resolution to the Hon . Harris Dates , Chairman of the
Tompkins County Board of Representatives , with a copy to Mr . Frank
Liguori , Tompkins County Commissioner of Planning , and Mr . Noel Desch ,
Town of Ithaca Supervisor .
DISCUSSION OF SEQR SHORT FORM ENVIRONMENTAL ASSESSMENT .
The Planning Board members had been mailed prior to this meeting
a copy of the Short Environmental Assessment Form for discussion this
date .
Mr . Aron stated that anyone building a new home will have to fill
this short form out before a building permit is issued .
Mr . Fabbroni concurred with Mr . Aron ' s statement .
Mrs . Bronfenbrenner wondered under Item # 14 , how one would define -
" community " ? Does it mean " Town " ? She noted that neighborhood is
used in the Zoning Ordinance .
Mr . Fabbroni stated that he would go even smaller - - whenever we

get into a larger scale project , the developer would fill out the long
form . Mr . Fabbroni stated that this is to meet the requirements of the
law and to protect the persons ' homes .
Mr . Mazza commented that using this form , everyone will answer " No " .
Mr . Fabbroni pointed out that the approval is judgmental on his
part and noted that as loosely as the SEQR law is written , this form is
taken . from the suggested form in the law itself .
Mr . Aron noted that the form here before the Board was duly adopted
by the Town Board on April 9 , 1979 .
It was the consensus of the Town of Ithaca Planning Board that it
concurs with the Town Board resolution of adoption of the Short Environ -
mental Assessment Form ; that the form is appropriate and it serves its
purpose .
STATUS REPORT , PLANNING BOARD PROCEDURES COMMITTEE . EDWARD MAZZA .
The Chairman of the Planning Board Procedures Committee , Mr . Mazza ,
reported that he is gathering material on various municipalities ' pro -
cedures , is working with the Secretary on background material of the Town
Planning Board , and will be calling a meeting of his Committee in the
very near future .
EXECUTIVE SESSION .
is Upon Motion , the Chair declared a brief execut. ive session of the
Board .
Mr . Fabbroni stated that the next meeting of the Planning Board is
May 1 , 1979 . He informed the Board that the Town Board would like the
Planning Board to once again look at the Monkemeyer Art Colony site plan .
He provided substantial background to the matter . He said that the Board
has also been asked to go through the rezoning recommendation and by
virtue of that , site plan approval . He stated that everybody is to make
some movement in that direction within 45 days of the pre - trial date .
He said that the Town Board will probably call a public hearing to review
the plan for their meeting on May 7 , 1979 .
Mr . Aron directed the Secretary to transmit the minutes of the
Planning Board meeting of October 4 , 1977 , to the Board members .
Mr . Fabbroni also informed the Board that Mr . Ivar Jonson has re -
quested to be put on the agenda for consideration of final subdivision
approval for his Texas Lane subdivision at their next meeting .
The Executive Session was declared closed at 9 : 39 p . m . and the
meeting reopened .

The Planning Board of the Town of Ithaca at its
regular meeting on April 17 , 1979 , unanimously resolved
its full support of the Town Board resolution of December
11 , 1978 , setting forth its agreement with the proposal
to exchange certain Town and County roads .
The Planning Board members have asked me to for -
ward to you a certified copy of its resolution , hereby
enclosed , and to urge that you and the County Board of
® Representatives take the steps necessary to effect this
exchange .

RESOLUTION :
MOVED by Mrs . Liese Bronfenbrenner , seconded by Mr . James Baker :
RESOLVED , that the Planning Board of the Town of Ithaca support
and hereby does support the resolution adopted December 11 , 1978 ,
by the Town Board of the Town of Ithaca with respect to the
exchange of the Town portion of Sheffield Road from Hayts Road
to Townline Road ( Iradell Road ) , ( approximately . 86 miles ) for
the County portion of Renwick Heights Road ( approximately . 50
miles ) and the County portion of Judd Falls Road from Forest Home
Drive to Route 366 .

Barbara Schultz , James Baker .
