PUBLIC HEARING : SITE PLAN REVIEW FOR MINOR EXTENSION TO THE FORMER
BEAUJOLAIS RESTAURANT , 602 ELMIRA ROAD , TOWN OF ITHACA TAX PARCEL NO .
6 - 31 - 3 - 4 .
Vice - Chairman Aron declared the Public Hearing in the above - noted
matter duly opened at 7 : 38 p . m . , and accepted for the record the
Clerk ' s Affidavit of Posting and Publication of the Notice of Public
Hearing in Town Hall and the Ithaca Journal on November 14 , 1978 , and
November 16 , 1978 , respectively .
Mr . Tom .McCarthy appeared before the Board with Mr . Michael Pan
who has purchased the former Beaujolais Cafe on Elmira Road and is
going to be operating it as a Chinese restaurant known as the Chinese
Garden . Mr . McCarthy said that the proposed addition meets the
specifications of the State of New York and he is requesting a permit
for a kitchen .
Mr . Fabbroni asked that Mr . McCarthy describe how much this
addition expands the building from what it was before . Mr . McCarthy
described the addition as adding 60 square feet to what the original
kitchen was . Mr . McCarthy said there would be no parking taken away - -
there will be 29 parking spaces and less tables and chairs , therefore ,
no reduction in parking . He said the expansion is to the s-ade. He

showed a floor plan view and described the 10 ' by 28 ' area along
the extension . He stated that they have torn out the old kitchen .
® Mr . Aron asked if there were any questions from the Board ? There
were none . Mr . Aron asked if there any questions from the public
present ? There were none .
Mr . Aron declared the Public Hearing closed at 7 : 42 p . m .
Mr . Aron asked again if there were any questions from the Board ?
There were none . Mr . Fabbroni stated that what the gentlemen are
asking for is approximately a 2 - 1 / 2 ' addition out farther than what
the porch was before to allow for a more modern - type kitchen than what
was there before . Mr . Fabbroni stated that from his own perspective ,
they are building a sufficient kitchen now , whereas before it was not
sufficient except for what it was used for when it was Beaujolais .
MOTION by Mrs . Carolyn Grigorov , seconded by Mr . Patrick Mackesey :
- - RESOLVED , that the Planning Board of the Town of Ithaca approve
and hereby does approve the site plan presented by Michael Pan for ,- an
addition to - - the China Garden - Restaurant at 602 Elmira Road , Tax Parcel
No . 6 - 31 - 3 - 4 , drawn by Robert A . Boehlecke , Jr . , Architect , and dated
November 14 , 1978 .
There being no further discussion , the Vice - Chairman called for a
vote .

PUBLIC HEARING : PRELIMINARY SUBDIVISION REVIEW FOR 13 LOT SUBDIVISION
BACKLOT OF TEXAS LANE AND SIENA DRIVE , TOWN OF ITHACA TAX PARCEL NO .
6 - 71 - 1 - 9 , IVAR JONSON ,
Vice - Chairman Aron declared the Public Hearing in the above - noted
matter duly opened at 7 : 47 p . m . , and accepted for the record the Clerk ' s
Affidavit of Posting and Publication of the Notice of Public Hearing in
Town Hall and the Ithaca Journal on November 14 , 1978 , and November 16 ,
1978 , respectively .
Mr . Ivar Jonson and Mr . Ralph Varn appeared before the Board to
present their plans for a 13 - lot subdivision for one - family homes , 9
lots in the Town of Ithaca . Mr . Jonson stated that he thought they
have everything they need , so he is here for preliminary subdivision
review . Mr . Jonson stated that their surveyor became sick so they do
not have the contour map ; they .have drainage plans . Mr . Jonson stated
that the Town Supervisor has walked the land and asked if any of the
Board has walked the land . The Board indicated that they were quite
familiar with the area .
Mr . Jonson presented his proposed subdivision plan , Town of Ithaca ,
showing the nine lots and the proposed park area for the Town and an
entrance off Texas Lane .
Mr . Varn presented the drainage plan as superimposed on the
subdivision plan . He noted that the " orange " section is the " knoll " .

Mr . Varn stated that the area that is treed is to be donated to the Town
for a Park and is shown in the center of the orange area . Mr . Varn stated
that the thick blue line indicates ditching or graded flat land . He said
they will bring the water around from the hill to the creek . He said that
the back portion slopes back to the south all of which goes naturally to
the creek . He said that the critical area is on the first lot ; basically
three lots water will go to the north .
Mrs . Anna Teichthesen , 2109 North Triphammer Road , asked what creek
Mr . Varn was talking about ? Mr . Varn described it as the creek south of
the property ; the one that goes under Triphammer Road . Mrs . Teichthesen
asked if the developer has considered the culvert on Triphammer Road ?
Mr . Varn replied in the negative .
Mr . Charles Donald Gates , 104 Texas Lane , asked in looking at the
arrows on the displayed drainage plan , if Mr . Varn could please rough in
the location of Siena Drive ? Mr . Varn pointed it out . Mr . Gates asked
where Hanshaw Road would be . Mr . Varn indicated Hanshaw Road . Mr . Gates
asked if Mr . Varn felt that water that is generated is a problem of the
Town and not the developer ? Mr . Varn asked when does the culvert over -
flow ? Many voices from the floor said it backs up in severe downpours .
Mrs . Teichthesen spoke of the 1976 flood .
Mr . Gates said that there will be more water flowing because whenever
you develop land you increase runoff . He said that it may well be the
responsibility of the Town to protect persons located near the creeks
from problems they can be exposed to .
® Mr . Varn stated that that problem should have been calculated for
when they put in the culvert .
Mr . Shailer Philbrick , 117 Texas Lane , stated that he was a Trustee
of the Village of Cayuga Heights and a Geological Engineer with expertise
gained from many years with the Corps of Engineers in several parts of
the world . Mr . Philbrick stated that he would speak to the matter of
drainage among other matters . He said that he located drainage basins on
the maps and sketched them on the maps for many areas across the country .
Mr . Philbrick stated that he saw no indication on Mr . Jonson ' s drawing of
the existing alignments of the creeks . He said there were no elevations ,
no contours .
Mr . Philbrick continued and noted that the drawing shows running
across it a dashed line which he assumed is the boundary line between the
Town of Ithaca and the Village of Cayuga Heights . He said that what Mr .
Jonson is proposing is a subdivision that overlaps both municipalities .
Mr . Philbrick stated that they , the Village , expect to see Mr .
Jonson ' s drawings showing factual information presented to the Village
Board . He stated that if this is a joint situation as it seems to be ,
the Village of Cayuga Heights raises an objection to this proposal right
now .
Mr . Harry Keller , 213 Texas Lane , said that as the gentleman said the
® Board was all here at the last meeting . He stated that he read from the
zoning ordinance and he asked if all the Board members had a copy of the
zoning ordinance in front of them ? He repeated his question asking if
each member of the Planning Board had a copy of the zoning ordinance
directly in front of them .

Mr . Fabbroni stated that he is the Building Inspector and he has one
before him .
® Mr . Keller read from the present and effective zoning ordinance as
adopted in 1968 , the Preamble thereto , as follows :
" For the purpose of promoting the health , safety , morals or the
general welfare of the community , and to lessen congestion in the streets ,
to secure safety from fire , panic and other dangers , to provide adequate
light and air , to prevent the overcrowding of land , to avoid undue con -
centration of population , to facilitate the adequate provision of trans -
portation , water , sewerage , schools , parks and other public requirements ,
under and pursuant to the Laws of the State of New York , the size of
buildings and other structures , the percentage of lot that may be occupied ,
the size of yards , the density of population , and the location and use of
buildings , structures and land for trade , industry , residence or other
purposes , are hereby restricted and regulated as hereinafter provided . "
Mr . Keller stated that he was sure that this is what this Planning
Board is designated to enforce . Mr . Keller read a statement to the Board
as follows :
_ - " Two weeks ago we listened to a developer propose construction on
property adjacent to our neighborhood . I would like to go on record in
objection to the Preliminary Subdivision Review for 13 lot Subdivision
Backlot of Texas Lane and Siena Drive , Town of Ithaca Tax Parcel No .
6 - 71 - 1 - 9 , I . Jonson .
® We understand that Mr . Jonson has modified his plans since two weeks
ago . However , we feel that the details of his development are not in
conformity with the Zoning Ordinance for the Town of Ithaca , -. which was
re - adopted , amended and revised as of February 12 , 1968 , and effective
February 26 , 1968 , for the purpose of promoting the health , safety ,
morals or the general welfare of the community , and to lessen congestion
in the streets , to secure safety from fire , panic and other dangers , to
provide adequate light and air , to prevent the overcrowding of land , to
avoid undue concentration of population , to facilitate the adequate pro -
vision of transportation , water , sewerage , schools , parks . and other
public requirements , under and pursuant to the Laws of the State of New
York , the size of buildings and other structures , the percentage of lot
that may be occupied , the size of yards , the density of population , and
the location and use of buildings , structures and land for trade , industry ,
residence or other purposes , are hereby restricted and regulated as here -
inafter provided .
We who will be affected by the proposed development have petitioned
you the Town of Ithaca Planning Board members , the Supervisor of the Town
of Ithaca and officials of the Village of Cayuga Heights . Have you read
the Petitions ? Have you understood the Petitions ? As an aggrieved home -
owner I would like to call to your attention that under provision of
Article 14 Section 75 which we have on record in the Town a building
permit by Ivar Jonson to construct . a single residence using the land he
owns on a strip from Texas Lane .
® Calling your attention to the Zoning Ordinance of the Town of Ithaca
I will again direct your attention to Article 13 Section 62 which states
that side yard on corner lot states that yard width on side street shall
be at least 1 / 2 the required front yard for adjoining properties on side
street but no less than 10 feet .

Section 78 of the Ordinance , in making recommendations to the Town
Board and Board of Appeals , the Planning Board shall determine under
Article 1 that there is a need for the proposed use in the proposed loca-
tion and under Article 2 most emphatically that the existing and probable
future character of the neighborhood in which use is to be located will not
be adversely affected .
As a property owner directly affected by this proposal in creating a
right of way for access and egress I would ask the Planning Board to
insist on a study of drainage , traffic and possible environmental effects .
Under Article 14 Section 77 which concerns an appeal which I feel I
must make I would like to call your attention to paragraph 7D which states
proposed use shall not be detrimental to the general amenity or neighbor -
hood character in amount sufficient to devaluate neighboring property or
seriously inconvenience neighborhing inhabitants . You have two Petitions
with 72 signatures . Do you have copies of the Petitions ? You have 72
signatures versus one contractor .
I request the Town Planning Board to consider effects of paragraph
F of the same Article 14 Section 77 which states that the general effect
upon the community as a whole including such items as traffic load upon
public streets and load upon water and sewerage systems is not detrimental
to health , safety and general welfare of the community .
In summary , as a taxpayer living in a home in an established neighbor -
hood I ask the Planning Board very respectfully to consider the ramifica-
tions of this development which we have described in our petitions with
72 signatures .
® It is unfortunate that the developer had purchased this acreage with
an eye to a profit motive , without the approval of the Town Planning Board .
The property values of the households surrounding this area must be
considered . Consider the ratio of the property owners investment in com=
parison with the developer ' s .
I am asking you as citizens , taxpayers and representatives of our
Town to enforce our Town of Ithaca Zoning Ordinance in the best interests
of existing homeowners surrounding this proposed development . "
Mr . Keller continued and stated that there may be some conflict of
interest here . He asked the Board if they knew Mr . Jonson . He said that
the engineer is here and asked him if he knew Mr . Jonson , Mr . Keller
repeated his previous question as to whether the Board had read the peti -
tions . The Planning Board indicated that they were acquainted with the
= petitions . Mr . Baker indicated that the secretary had noted the petitions
on the Board ' s agendae at the last meeting .

The signatures on the attached petition were obtained from Texas Lane
residents last evening and this morning . All of the households con -
tacted had a representative sign the petition and many felt the peti -
tion was worded too " softly " . Others raised items in objection which
were not covered in the petition . The households on Texas Lane not
represented had no one at home .
We hope that you will seriously consider our request for a hearing and
that you will work with Cayuga Heights authorities in this effort .

We , the undersigned , reside in the Town of Ithaca and the Village of
Cayuga Heights adjacent to Tax Parcel # 6 - 71 - 1 - 9 which has a right of
way access to Texas Lane . We are concerned since recent activity
indicates possible development and opening of the right of way which
might cause Texas Lane to become a thru street to Catherine of
Sienna Drive . I -
Texas Lane is an established neighborhood of single dwelling homes and
we are concerned that if Texas Lane becomes a thru street , the traffic
density will be increased to an unsatisfactory and dangerous level .
Homes in this neighborhood have a history of flooded basements and
associated drainage problems which have resulted from past land , develop -
ment in this neighborhood .
We , the undersigned , wish to petition the Town of Ithaca to grant us a
hearing prior to approval of any building permits in the aforesaid
named tax parcel . We are also concerned that traffic and drainage
problems should warrant an environmental impact study prior to any
development of the parcel and right of ways .

The signatures on the attached petition were obtained from Siena
Drive residents on October 29 . Virtually all of the neighbors whom
we contacted were angered and alarmed at the proposed construction pro -
ject that is contemplated for the wooded area in an around our back
�® yards . We all hope that you will hlep us in arranging a hearing on
this issue and preventing irresponsible and unwanted " development "
in our neighborhood .

PETITION to the Chairman of the Planning Board , Town of Ithaca , N . Y . ,
14850 . Copies also to the Mayor , Supervisor , Engineer and
Clerk of the Town of Ithaca , N . Y . 14850 .
We , the undersigned , reside on Siena Drive in the Town of Ithaca ,
which borders on Tax Parcels # 6 - 71 - 1 - 9 and 71 - 1 - 8 ( part of VCH 5 - 3 - 15 . 2 )
now being considered for development . We are upset that further con -
struction work , including the potential digging of new roads and access
® routes , is contemplated for land that is now full enclosed by residential
dwellings on Hanshaw Road , Texas Lane and Siena Drive . We are concerned
that what is now a quiet street adjacent to the St . Catherine of Siena
Church will experience a disturbing and unsafe increase in traffic
density if new access routes are indeed developed . We are worried also
that the construction of more hard - packed surfaces and housing units in
this wet area will , as in the past , further aggravate the drainage and
flooding problems familiar to this neighborhood . Our concern is
heightened by the knowledge that other builders , previously active in
our neighborhood , declined to develop the above land tracts after
receiving detailed engineering data outlining extensive and costly
requirements for proper construction on these parcels .
Finally , we , the undersigned , like other citizens of Ithaca , feel
strongly that further construction on every last square inch of land ,
digging and paving of additional roads and the destruction of whole
tracts of trees , bushes , nests , etc . is no longer justified by the fact
that, a few individuals can make money . We have settled in this area in
part because of the beauty of its natural environment . The unspoiled ,
wooded land tracts described above , though small , are part of this
environment and should be preserved and enjoyed as such .
We , the undersigned , wish to petition the Town of Ithaca to dis -
cuss these matters in an open and public forum before any construction
is initiated on the above land . We hope that our elected officials will
® join us in our effort to preserve and protect the quality of life and
environment which we now find in our community .

Mr . Keller asked for an answer to this question : " Do we get a
hearing prior to the granting of a building permit ? "
® Mr . Fabbroni stated that they had a meeting on November 7 , 1978 . Mr .
Fabbroni stated that by law there is no public hearing required for the
granting of a building permit .
Mr . Keller pointed out that all these residents petitioned for a
hearing ; asked the Board if they remembered the petitions , before any
building permit was issued and they have not abided by that petition .
Mr . Keller stated that this road is going to be 10 ' from his bedroom
window .
Mr . Keller cited once again Sections 62 , 78 and 77d . Mr . Keller
stated that a 60 ' right of way is necessary for a road ; Mr . Jonson owns
50 ' . Mr . Keller stated that he was requesting the Town , the Planning
Board to enforce Section 77 ( f ) of the Ordinance which he read :
" SECTION 77 . Board of Appeals .
7 . ( f ) The general effect of the proposed upon the community as a
whole , including such items as traffic load upon public streets and load
upon water and sewerage systems is not detrimental to the health , safety
and general welfare of the community . "
Mr . Keller cited the Petitions and stated that 77 homeowners had
signed them .
Mr . Keller stated that Mr . Jonson bought the land without the
approval of the Planning Board .
Mr . Keller stated that we are having a hearing here tonight ; we
expect a dialogue ; we expect each of you , individually , to get up and
discuss the matter of devaluation - - each one of you . Mr . Keller said
we have no drawings ; we need time ; we need a lawyer ; we need an environ -
mentalist ; we have lived there over 20 years .
The discussion continued for some time .
Mr . Fabbroni asked for the floor and stated that he would like to
clarify the dispute over Section 62 of the Ordinance . He stated that the
required front yard on Texas Lane is 25 ' ; the required side yard is
12 - 1 / 2 ' for that house , and no less than 10 ' . Mr . Fabbroni continued by
way of clarification and stated that the access way proposed is a 50 foot
strip . Normally a road is 20 feet in pavement with 4 feet of gravelled
shoulders - - 28 ' plus ditches , normally centered on the right of way .
Mr . Fabbroni clarified the Town of Ithaca Highway specifications as
follows : A 60 foot minimum is required but the policy of allowing 50
feet , the minimum required by Town Law , where it predates the change to
60 feet has been acceptable to Town Planning Board and Town Board since
the change was made about 1972 . Mr . Fabbroni said that to answer Mr .
Keller ' s question of whether a road has to be 10 feet from somebody ' s
bedroom - - by no means should it be .
Mr . Keller now referred to the devaluation of property . He said
® that he plans to call in an appraiser ; if the appraiser says you are
going to lose money on your house and then Ms . Schmitt does that too ;
how many dollars does this proposal have to show we are going to lose
before we get the Planning Board to enforce the Zoning Ordinance of the
Town of Ithaca ? He repeated his statement , " I am going to lose money. "

He said , " If you have looked at the petition , of course , you have not
read the petition . "
Mrs . Grigorov stated , " We have read the petitions . "
® Mr . Fabbroni pointed out that Section 77 , of which paragraph 7 has
been cited , refers to Special Approvals of the Board of Appeals . He
stated that Section 77 only concerns those sections in the Ordinance that
are handled by special approval of the Board of Appeals , for example ,
nursing homes . He said that the criteria in there are much along the line
of a site plan approval ; they would have nothing to do with Mr . Keller ' s
appeal . Mr . Fabbroni referred to the preamble of the Ordinance and
commented that obviously there is a difference of opinion as to what these
things mean , that is why there is a Zoning Board of Appeals .
Mr . Aron mentioned an Article 78 proceeding under the law .
Mr . Harry Cornwall , 830 Hanshaw Road , asked again about the Petitions ,
stating whatever happened to them ; 72 people signed a petition and nobody
remembers ; nobody followed what they petitioned be done . Mr . Cornwall
stated that the Board has no topographical map and asked if the Board is
going to make a decision without it ?
Mr . Aron stated that the Board is not making any decision here while
this public hearing is open .
Mr . Cornwall asked when the Board will make a decision ? Mr . Aron
said with complete maps .
Mr . Jonson wondered how many people understand these maps . Mr .
Philbrick stated that he has functioned as a geological engineer all over
the United States and that he firmly states that these maps are not com-
plete . He stated that there is no indication of how this will affect the
land in the Village of Cayuga Heights ; nothing is established ; Mr .
Jonson ' s factual data is not complete .
Mr . Jonson stated that it is in his interest to make this clear to
everyone ; he tried to make the drawings clear ; at the next Board meeting
he will have all the maps since his surveyor should be better by then .
Mrs . Charlene Miller , 205 Texas Lane , stated that she did not under -
stand the makeup of this Planning Board . She said that Mr . ,Jonson seems
to be a participant of the Board and it looks rather peculiar . She said
that there is an adversary positioning here , Mr . Jonson and the Planning
Board against the citizens .
Mr . Aron stated that the Planning Board is completely neutral ; it
wants to hear both sides of the story ; we must ask questions either to
you , the residents , or to Mr . Jonson . Mr . Aron stated that he happened
to be standing here because the map is here .
Mrs . Enid Ruoff , 216 Texas Lane , speaking to Mr . Fabbroni , asked if
he awards his approval to this subdivision on the basis of certain re -
quirements that he . .wants Mr . Jonson to do , who is going to enforce these
requirements and see that he does them ?
Mr . Fabbroni replied that first of all he does not award approval
of subdivisions , he issues building permits . He stated that it is a
matter of procedure - - there are checkpoints during construction .
Mrs . Ruoff asked Mr . Fabbroni if he remembered when he visited her

house after the flood and they discussed the " lake " that evolved behind
her house ? She said that two persons put in landscaping and ditching
different from what Mr . Fabbroni told them to do .
® Mr . Fabbroni stated that he talked to " millions " of people after the
1976 flood . He stated that the drainage problem definitely has been
traced to the development of the three schools , Northeast , DeWitt , and
BOCES . He said he would like to talk to the general point ; there are
several check points - - review streets , certificates of compliance , final
review . Mr . Fabbroni stated that for over 5070 of the lots in the Town
we have certificate of compliance final review control ; there is monitor -
ing beyond Planning Board approval .
Mr . Fabbroni , speaking to Mrs . Ruoff , stated that her problem is the
drainage stream that comes sidelot north of her property from the three
schools . Mrs . Ruoff discussed with Mr . Fabbroni a sidewalk which Mr .
Fabbroni questioned as to location . Mrs . Ruoff asked Mr . Fabbroni why
he did not know that it is there ? Mr . Fabbroni pointed out that it is
not owned by the Town of Ithaca .
Mr . Varn stated that they do not have the topos ; they have them
underway , but the surveyor became ill . Mr . Varn stated that according
to his preliminary measurements they can do it the way it was discussed .
Mr . Varn said that they are assuming that it will go the way that they
believe , at this point , it will .
Mr . Ronald Anderson , 116 Texas Lane , stated that he also is a Trustee
of the Village of Cayuga Heights and was asked to come by the Mayor of the
Village of Cayuga Heights . He stated that he has been in the area since
1955 and that he has a degree in engineering . Mr . Anderson stated that in
the preamble to the meeting the proposal was introduced as a 13 - lot
subdivision of which 4 lots are in the Village of Cayuga Heights , Mr .
Anderson stated that the Village should have been more intimately involved
than they have so far . He asked , referring to the drainage map on the
wall , if in the area that is to be given to the Town , will that divert some
water from land that now goes elsewhere ?
Mr . Varn replied in the affirmative . Mr . Anderson asked if he had
any estimate of how much ? Mr . Varn replied that he did not .
Somebody displayed a 1949 Geological Survey map . Mr . Anderson stated
that there is a definite difference in the drainage pattern from that map .
He stated that obviously there is more water coming and more of it is in
different streams than was originally . Mr . Anderson said that he talked
to farmers who operated the Cornell Taylor Farm . He stated that their
discussion will have to be discussed further .
Mrs . Sondra Kuntz , 211 Texas Lane , stated that she is very concerned
about all the properties . She asked if any of the Board has ever been
up to her land , which is back of this subdivision , in the winter when a
lake is there ?
Mr . Jonson discussed the 6 " pipe in place which will be used to
drain some lots to the north . Mr . Jonson stated that he will make less
® water runoff there than presently .
Mrs . Lorraine Chase , 210 Texas Lane , asked if the knoll contributes
to Mrs . Kuntz ' s water problem ? Mr . Jonson replied , not really . Mrs .
Chase asked if he were going to leave the hill there ? Mr . Jonson replied ,
yes .

Mr . Cornwall asked the Board if they would make a decision before
they get the topographical map ; would they make a decision before the
public sees the topo map ? Mr . Aron replied that they will not in either
case . Mr . Cornwall asked the Board when the final decision will be made ?
® Mr . Aron replied when the Planning Board is fully satisfied , or dissatis -
fied , the decision will be made .
Mrs . Teichthesen , 2109 North Triphammer Road , asked if the residents
could request that an Environmental Impact Statement be made before any
decision is made ?
Mr . Fabbroni stated that , under SEQR , the only thing that is specifi -. , . __
cally required now is that if a plot of more than 250 lots is proposed the
developer has to go through an Environmental Impact Study . He said that
for this subdivision an Environmental Assessment Form will have to be
received . Mrs . Teichthesen said that the land covered is 12 . 4 acres .
Mr . Fabbroni stated that that is only in the case of wetlands .
Mrs . Miriam Taietz , 204 Texas Lane , stated that she has been there
20 years . She said the water is two feet deep in her basement . She said
she called the Village of Cayuga Heights and they do nothing . She said
she called Otto Schoenfeld and he dug a ditch . She asked if that little
ditch is going to carry this water ? Mr . Jonson said he will be making
the ditch bigger .
Trustee Philbrick stated that he listens to this thing and he sees
that this . is a problem for the Village of Cayuga Heights ; this will
create a problem for the residents of the Village . Mr . Philbrick said
that what Mrs . Taietz has said is absolutely true and what other people
® have said is absolutely true ; this must be reviewed by . the Village Board
which acts as the Planning Board .
A lady from the floor stated that the Board must walk this land .
She asked if they have ? She said that the foot bridge at ( an unnamed
location ) is under water in the spring .
Mrs . Charlene Miller suggested that everybody walk this land . Mrs .
Miller said that she has three sons now ages 21 to 31 . She stated that
they all played on that land . She stated that the only season they could
ever play there is a little time in August .
Mr . Aron stated that as Chairman of this meeting he recommends the
Public Hearing be closed . He stated that we are all talking about the
same thing . The Board concurred . Vice - Chairman Aron declared the
Public Hearing in the matter of the preliminary subdivision review of
the Ivar Jonson proposal duly closed at 9 : 01 p . m .
Vice - Chairman Aron declared that he herewith appoints an ad hoc
committee to be comprised of Mrs . Carolyn Grigorov , Mr . James Baker , Mr .
Patrick Mackesey , and Mr . Jonathan Bradley of the Planning Board and Mr .
Lawrence Fabbroni , the Town Engineer , to , upon receipt of the topographi -
cal map , do the following with three or four volunteers from Texas Lane
if they so wish : The members of the Planning Board will take it upon
themselves with the engineer and with the topographical map in their
F hands to walk and study the situation very carefully and each will report
back with a written report as to drainage , feasibility , etc . , to the
Planning Board prior to its next meeting on this proposal ; the engineer
will make his own report also . Each member of the Planning Board will
have in hand the reports of those persons I have just appointed .
Mr . Cornwall , 830 Hanshaw Road , volunteered to join the committee .
Planning Board - 12 - November 21 , 1978
Mr . Philbrick stated that when this has been presented formally to
the Village of Cayuga Heights they will participate .
® Mr . Keller stated that he also thinks this should be presented to the
Village of Cayuga Heights formally .
Mr . Aron stated that it seems he cannot reach agreement on whether a
citizen committee or committee through the Village Board is acceptable .
Mr . Gates , 104 Texas Lane , volunteered to join the committee and said
he could be reached at 257 - 1742 .
Mr . Cornwall stated that he would like Mayor Marcham of the Village
of Cayuga Heights to appoint four members to this group .
Mr . Philbrick stated that he wanted to see this officially presented
to the Village of Cayuga Heights . He said he did not want any ad hoc
participation .
Mr . Keller stated that he would like to join with the Planning Board
in walking the land . He asked the Board to consider the item of time .
He said the first thaw is when to consider this development . Mr . Keller
asked Mr . Aron what his feeling on his proposal was . Mr . Aron replied
that he had made a recommendation and appointed a committee .
Mr . Aron instructed Mr . Jonson to bring in the topographical map .
Mr . Jonson agreed .
There was no further discussion and the Board turned to the next
hearing at 9 : 23 p . m .

Vice - Chairman Aron declared the Public Hearing in the above - noted
matter duly opened at 9 : 23 p . m . and accepted for the record the Clerk ' s
Affidavit of Posting and Publication of the Notice of Public Hearing in
Town Hall and the Ithaca Journal on November 14 , 1978 , and November 16 ,
1978 , respectively . He apologized for the hearing running almost an
hour late . Mr . Chase said that it was no problem to him since the pre -
vious hearing was quite interesting .
Mr . Lagrand Chase stated that they are here to discuss the develop -
ment of a portion of property they own west of Ridgecrest Road and the
intersection of East King Road . Mr . Chase stated that the property which
they have starts down close to , but not directly on , Ridgecrest Road . The
Tax Maps were displayed . Mr . Chase stated that they are here to discuss
tonight the development of the southerly portion of their land , approxima -
tely 30 acres . , under the Cluster provision , Section 281 of Town Law and
as requested in his letter to the Planning Board dated November 9 , 1978 .
Using the Tax Map , Mr . Chase stated that the access is right here at a
70 ' right of way .
Mr . Chase presented a drawing entitled , " L . E . Chase Subdivision ,

Planning Board - 13 - November 21 , 1978
Mr . Chase stated that his proposal is for 80 lots but with a total
density of the allowable density under Cluster of 105 units , which means
that somewhere in this group there would be , perhaps , a duplex , or even
® as much , perhaps , as a four - plex , which he understood is the maximum number
of units in one structure allowed .
Mr . Chase stated that at this meeting they would hope to get the
concept itself approved by the Planning Board and through its questions
and the discussions with residents . He stated that from that point they
would then proceed to the full topographical maps and proceed on to what
would be the preliminary approval .
Mr . Chase said that what they are attempting to do with this subdivi -
sion is provide some lots that will lend themselves to affordably priced
homes . He said they are talking about trying to provide a home and a lot
that somebody making $ 20 , 000 today could afford to buy - a family with
that income . Mr . Chase stated that he has been building homes in the
Ithaca area for over 25 years ; he has built several hundred homes all ,
just about , in the Town of Ithaca . He said that he knew just about as
well as anyone the costs and he knew how difficult it is . He said they
are attempting to meet a need that the community has . He commented that
we _ are not exactly flooded with people wanting to move into the area . He
said that the opinions of the industry leaders are that homes in this
price range are of a definite need .
Mr . Aron asked if there were any questions .
Mrs . Jean Brockway , 166 Ridgecrest Road , asked what kind of homes
Mr . Chase was planning to build - - modular or pre - fab ? Mr . Chase said
® that he did not want to go on record as to what exactly they would build .
He added that he has never built a modular house . Mr . Chase stated that a
lot of the people present are living in himes that they have built . He
said that they would hope to . build conventional homes , but they do not
want to preclude any other type .
Mrs . Brockway stated that somebody has mentioned " National Homes "
and she asked if that is a rumour ? Mr . Chase stated that his firm has
built some beautiful homes in the Village of Cayuga Heights and in the
Northeast that are National Homes . He said they may or may not go that
way .
Mr . Franklin Sharp , 162 Ridgecrest Road , asked if Mr . Fabbroni
planned to do an independent study of the drainage ? Mr . Fabbroni stated
that on a generalized level he will look at the drainage proposed . Mr .
Fabbroni stated that he will not do a specific topographic survey , the
Town accepts the word of the engineer and his professional seal . Mr .
Fabbroni stated that he will look at the feasibility of what Mr . Chase
has set forth ; the same way with traffic , it will be looked at on a
general planning level . Mr . Fabbroni stated that this proposal just on
a generalized level could very well double what is now the traffic level
on Ridgecrest Road after it is fully developed , approximately in a ten -
year time schedule . Mr . Fabbroni stated that that volume , although double
what now exists , and although it may involve some cars on Ridgecrest
Road , will not tax the capacity of Ridgecrest Road , Mr . Fabbroni stated
® that as an engineer , he did not see it as a problem .
Mr . Sharp stated that the main concern is this - - Mr . Chase has an
engineer but he is going into this as if it will work . Mr . Sharp asked ,
assuming this all goes on and next spring everybody has two feet of water
in their basements that they never had before , is there some way to hold

the builder responsible ? Mr . Fabbroni stated that as long as no water
courses were diverted into other water courses , it is very difficult to
establish whose liability it is .
Mr . Sharp asked if in terms of density , an Environmental Impact Study
is required ? Mr . Fabbroni stated that an Environmental Impact Statement
is required for 250 lots on public utilities or if the proposal is in
wetlands , which this is not ; so an E . I . S . is not specifically required but
he will require the developer to file an Environmental Assessment Form .
Mr . Sharp spoke about the proposal for quadriplexes and duplexes and
asked if they could be built as far back from the Ridgecrest Road proper -
ties as possible so that they do not end up right behind his house ?
Mr . Chase stated that they would be agreeable to working out , when
they present their final map , some provision as to where those would be .
Mr . Chase said he saw no reason , right here at the outset , that they would
wish to abutt them to the residents ' properties . He said that he did not
want to go on record for that until they have their topographical maps .
He said they will designate those areas when they have their complete
maps .
Mr . Sharp stated that this would certainly devalue their property .
Mr . Michael Gray , 158 Ridgecrest Road , stated that they realize ,
unlike the people at the previous hearing , that something is going to go
in ; everybody has problems - - traffic , people in backyards , water - -
perhaps , through an appropriate process we could come up with something
better . Mr . Gray stated that there is a water problem ; he does not have
® one himself , but there is a water problem .
Mr . Mackesey noted that the Board is being asked for an approval of
a concept prior to further in - depth presentations .
Mr . Chase stated that they will work out everything as best they can
to the best interests of the Planning Board and the people . He said that
they want a lot on which they have to put water and sewer , and still put
a house on ; they want to provide lots that people could afford .
Mr . Johann Gebauer , 117 Ridgecrest Road , stated to Mr . Chase that he
wished the residents could talk him into a second access - - perhaps on to
East King Road . Mr . Gebauer said that he foresaw 200 cars more on that
road .
Mr . Chase stated that he agreed that it is a very logical spot to
have a second access and they are looking into it , but at this moment it
is not possible ; they are trying to arrange for that .
Mr . Gebauer asked if it would be possible to , between Mr . Chase and
the residents and the Board , make it possible that Mr . Chase would have
this access ? Mr . Chase pointed out that he is asking to develop 80 lots
in ten years ' time .
Mr . Gebauer said that they all have children .
® Mr . Chase said that he did not really like to predicate this develop -
ment on having that second access . He stated that they need approval of
this number of lots to make it economically feasible .
Mr . Mackesey asked if Mr . Chase did not at this time own the land

that provides access to East King Road ? Mr . Chase replied that he did not .
Mr . Aron commented that the land is landlocked . Mr . Chase said , yes ,
® it is landlocked , and they pay taxes as if it could be developed with water
and sewer available .
Mr . Michael Gray stated that 105 units is too many on that land .
Mr . Brockway asked if this is the first cluster development in the
Town ? Mr . Fabbroni replied that it was not . Mr . Fabbroni stated that
" cluster " allows a person to either own the land or under an agreement ,
a single unit .
Mr . Chase stated that he is trying to provide a home that one family
owns on his own lot .
Mr . Brockway stated that Mr . Chase did not want to commit himself to
what type of housing he will develop . He asked when Mr . Chase will . know
what his plans are ?
Mr . Chase said that they are not looking at modulars now .
Mr . Fabbroni noted that any house that is constructed must meet all
the requirements of the Building Code of the State of New York - - that is
their only guarantee .
Mr . Brockway stated that Mr . Chase knows that there is a terrific
drainage problem and he asked how much of an in - depth study has been
done ? Mr . Chase replied that they are aware of some of the problems and
® they will probably find others . He said that he will let Mr . Miller
answer Mr . Brockway ' s question .
Mr . Thomas G . Miller , P . E . , stated that at this point they are asking
for concept approval . He stated that his office has been authorized to
make a complete topographical survey of the area and from that they will
have a picture of the problems and what they need to solve . He stated
that the solutions will be presented at the preliminary review and at
another public hearing . He stated that there will be a drainage plan .
He said there will be detailed plans for water and sewer and other
utilities . Mr . Miller noted that several years ago Mr . Chase did have a
report from the Soil Conservation Service prepared .
Mr . Brockway asked about park area . Mr . Chase stated that he will use
10 % of the land , 3 acres , which will be deeded to the Town . He stated that
this area was picked very carefully ; when the next area is developed then
there could be a continuous park with that . He commented that perhaps a
retention pond could be there .
Mr . Brockway asked if there were any protection from Mr . Chase develo -
ping next year to the north ? Mr . Chase said that they would have to come
before the Planning Board again from scratch .
Mr . Jerry Grasso , 160 Ridgecrest Road , asked if the Board is saying - -
go ahead and look into it and we will come back again ?
Mr . Fabbroni described the approval process , stating that there is a
preliminary plan presented or sketch plan and then a preliminary plan
public hearing with a final plan public hearing ; sometimes these are
combined into two rather than three meetings .
Planning Board - 16 - November 21 , 1978
. Mr . Richard Brown , 139 Ridgecrest Road , spoke of traffic . He asked
if Mr . Chase is going to do a traffic study also ? Mr . Brown asked if the
Town does a survey as to how many cars this road will hold , or does Mr .
Chase ? He stated that the residents do not have any protection except
engineering studies as to how many cars go down that road .
Mr . Fabbr• oni stated that from an engineering perspective - -
1 . There is very little question on this point that warrants a very
detailed traffic study that the road cannot take the traffic .
2 . This is a little different from the quality of life aspect applying on
the road .
Mr . Brockway asked what type of pattern would constitute a problem
because from East King Road on to Route 96B ( Danby Road ) is bad ? Mr .
Fabbroni replied that from 8 , 000 to 9 , 000 cars a day on Ridgecrest Road
is a danger signal and a call for more improvement as to shoulders .
Mr . Chase commented that Ridgecrest Road can be developed in the
Town of Danby .
There being no further questions from the public , Vice - Chairman Aron
declared the Public Hearing duly closed at 10 : 15 p . m . , and asked if there
were any questions from the Board .
Mr . May stated that , looking at Mr . Chase ' s map , we are talking
about the entrance road and making it a boulevard . He asked what Mr .
Chase would propose ?
Mr . Chase stated that they talked to Mr . Fabbroni and he suggested
® an actual 14 ' width of the pavement on each side . Mr . Chase said that
there could be a divider and there could be essentially two roads ; two
areas each side and there would be a traffic pattern with an in and an
out .
Mr . May stated that he would certainly like to see anything that
the Board does contingent upon that being a boulevard .
Mr . Bradley said that he thought that the main concern that everyone
is stating is traffic with that many lots and you only have one access .
Mrs . Grigorov wondered how long a road would be into King Road ?
Mr . Chase thought it would be over a third of a mile .

RESOLVED , that the Planning Board of the Town of Ithaca grant and
hereby does grant approval in concept only for an 80 lot Cluster Sub -
division backlot of Ridgecrest Road , Town of Ithaca Tax Parcel No . 6 - 45 -
1 - 2 . 2 , as presented by Mr . Lagrand E . Chase .

® ��' e , the undersigned , reside on Siena Drive in the Town of
Ithaca , which borders on Tax Parcels # 5 - 71 - 1 - 9 and 71 - 1 - 3
( p . rt of VCH 5 - 3 - 15 . 2 ) now being considered for development .
We are unset that further construction work , including the potential
digging of new roads and access routes , is contemplated for land
that is now fully enclosed by residential dwellings on Hanshaw
Road , Texas Lane and Siena Drive . We are concerned that what is
now a quiet street adjacent to the St . Catherine of Siena Church
will experience a disturbing and unsafe increase in traffic density
if new access routes are indeed developed . IA; e are worried also that
the construction of more hard - packed surfaces and housing units
in this wet area will , as in the past , further aggravate the
_ drainage and flooding problems familiar to this neighborhood . Our
concern is heightened by the knowledge that other builders ,
previously active in our neighborhood , declined to develop the
above land tracts after receiving detailed engineering data outlining
extensive and costly reouire :Hents for proper construction on these
parcels .
Finally , we , the undersigned , like other citizens of Ithaca ,
` eel strongly that further construction on every last square inch
of land , digging and paving of additional reads and the destruction
of whole tracts of trees , bushes , nests , etc . is no longer justified
by thefact that a few individuals can make :Honey . We have settled
in this area in part because of the beauty of its natural environment .
The unspoiled , wooded land tracts described above , though small ,
