' TOWN OF ITHACA PLANNING BOARD TUESDAY , JUNE 6 , 1978 The Town of Ithaca Planning Board held its regular - meeting on Tuesday , June 6 , 1978 , in Town Hall , 126 East Seneca Street ( second floor ) , Ithaca , New York , at 7 : 30 p . m . PRESENT : Chairman Liese Bronfenbrenner , Montgomery May , Carolyn Grigorov , Patrick Mackesey , Henry Aron , Lawrence Fabbroni ( Town Engineer ) . ALSO PRESENT : Joe Gentili ( County Planning Department ) , Arnold Albrecht , Richard and Anthony Leonardo , Thomas Niederkorn , David Jennings , 593 Sheffield Road , Linda Watt , 286 Hayts Road , Marion Kobre , 290 Hayts Road , John D . Robert Comstock , 284 Hayts Road , Ruth Dipace , 292 Hayts Road , Len Dipace , 292 Hayts Road . Chairman Bronfenbrenner declared the meeting duly opened at 7 : 35 p . m . REPORT OF THE BUILDING INSPECTOR Mr . Fabbroni had no report at this time . REPORT OF : THE TOWN ENGINEER Mr . Fabbroni reported , enthusiastically , that sewer contracts - for the long - awaited sewer extensions were signed on May 24th . The pre - construction conference meeting was held June 1st . The work will probably be starting Monday of next week - - June 12th . The proposed schedule is as follows : 1 . Starting on Coddington Road 17001 , south of Troy Road on the west side : 20 At - the same time,= start :ing _--on-Elm- =Street- = Ex-tension , 411: = the way .up --- Elm- - to the -top . of the - hill starting - at - - the -City line . In all cases we - are - - hooking -into the City lines . 3 . Next - Glenside . 4 : Next -- Slaterville Road starts just on the other side of the reservoir land . 5 . After he has finished either or both of ( 1 ) and ( 2 ) he will have one or two crews in ' Forest Home . He hopes he will hit Forest Home in August . In Forest Home there will always be a way across the creek from the north to the south . Mr . Fabbroni reported that a line has been put in on Coddington Road extending the sewer about 200 ' . Mr . Fabbroni reported that bids are being taken on June 15th for the Christopher Circle Tank repainting . He will be inspecting the tank with others this month . Mr . Fabbroni commented that we will probably do the Sapsucker Woods tank very soon . Mr . Fabbroni reported that the staff has done a traffic study - speed study on Hanshaw Road , Judd Falls Road , Pine Tree Road , Snyder Hill Road , and a report thereon will be forthcoming . Mr . Fabbroni reported that in the area of parks , the Town has had a lot , of input on the Coy Glen Park proposal . 'Planning Board - 2 - June 6 , 1978 REPORT OF PLANNING BOARD CHAIRMAN Mrs . Bronfenbrenner reported that it may be in order that Mr . ® Mackesey remain as a member of the Planning Board , but he has to check the matter out with the Town Attorney . It would - - appear that it is in order . Mrs . Bronfenbrenner reported that the Zoning Ordinance Committee is meeting . - - it looks like it will be quite a while yet . Mrs . Bronfenbrenner reported that the Sign Ordinance Committee has been unable to meet and nothing is happening at the moment . Mr . May stated that after July they will get going again . PUBLIC HEARING : TAX PARCEL 6 - 66 - 3 - 32 A PORTION THEREOF , - 127 WARREN ROAD , FINAL SUBDIVISION HEARING TO SUBDIVIDE A 2 . 47 ACRE PARCEL INTO TWO LOTS , L . . FABBRONI . Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter duly open at 7 : 45 p . m . , read the Notice of Public Hearing as stated- -above , and - -presented --for t-he - record - -the -- Clerk' s Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on May 30 , - 1978 , and June 1 , 1978 , respectively , as re - quired . - Chairman asked if there were any changes in the proposal since the time of the granting of preliminary approval on May 16 , 1978 , Mr . Fabbroni stated that there were none . ® Mr . Fabbroni described for the Board once again his proposal , stating that the lot he is purchasing is 387 ' by 295 ' on one end and 311 ' on the other and that he : is proposing to sell off one " lot " of 100 ' frontage . He indicated. on -the-- plan - present-ed---t-h-e- access--driveway .. The- =plan presented - was identical- - to the=-one ---present-ed-to -the . Board--on May . . 16 , - 1978 - ent-itled " 2 -Lot--Subdivision .-,-127-- W:arren---Road;==Town-of- --Ithaca ' ' ;= dated-May 15 , -- 1978 - drawn by L . Fabbroni NYSPE # 51734 . Mr . Fabbroni commented that there were buildings torn down so the new home on the proposed lot would offset the drainage . He also commented that the public sewer is as certain as it can be without being in the ground . Mrs . Grigorov asked what the slope is ? Mr . Fabbroni stated that the house and the barn sit up on a rise - the slope is from the north boundary to the south - there is a culvert on Warren Road . Mrs . Bronfenbrenner recalled that at the preliminary hearing one couple appeared from the neighborhood - the Likens - and they were con - cerned - about two houses perhaps being constructed on the proposed 100 ' lot and the Board informed them that that is not possible under the Zoning Ordinance and they were satisfied . Chairman Bronfenbrenner asked if there were any further questions from the Board . There were none . Chairman Bronfenbrenner asked if there were any questions from the public . There were none , no one having appeared in support of or objecting to this - proposal . Chairman Bronfenbrenner declared the Public Hearing duly closed at 7 : 54 p . m . MOTION by Mr . Henry Aron , seconded by Mr . Patrick Mackesey . RESOLVED , that the Planning Board of the Town of Ithaca grant and hereby does grant Final Subdivision Approval to the Lawrence P . Fabbroni Planning Board - 3 - June 6 , 1978 request for . the .subdivision of a 2 . 47 acre parcel into two lots , being a portion of Town of Ithaca " Tax Parcel 6 - 66 - 3 - 31 all as described on Subdivi = _ - . sion Map dated May 15 , 1978 , drawn by L . NEXT PLANNING BOARD ' MEETING The Board members agreed that the next regular meeting of the Board would be held as usual on the 3rd Tuesday of the month - June 20th . It was also agreed that there would be no meeting on the first Tuesday of the month which falls on July 4th this year . PUBLIC HEARING : TAX PARCEL 6 - 22 - 2 - 2 . 2 , MODIFICATION TO FINAL SUBDIVISION PLAN FOR DEFOREST PARK SUBDIVISION ON DUBOIS ROAD , . RUMSEY - ITHACA CORP : Chairman-= Bronfenbrenner ---declared the Public Hearing-._in . the above - noted matter' -duly open at 8 :15 p . m . , read the - Not-ice - of Public Hearing as stated above , and presented for the record the Clerk ' s Affidavit of Posting and - Publ-ication - of - the Notice - of Public Hearings in Town Hall and the Ithaca Journal on May 30 , 1978 , and June 1 , 1978 , respectively , as re - quired . Mr . Niederkorn stated that he was present to offer for the Board ' s ® consideration a modification to the Final Subdivision Plan that had received Planning Board Final Approval on March 21 , 1978 . He stated that the Health _ Department ---approval and - DEC .-­approval- - are in and-the.. check - dams-- required - by -_th-e=:-Board---are -.- a - part - of---the -plan Mr -ed - - t�hat=a -cond=ition of-- -the -- zon_ing_speca-l—approval was-that- -a -road Chandi=ter--==Road _- would-be-bu -lt . Mr . - Niederkorn--informed- - the Board that the doctors who had been planning to bui -ld. on --the - - corner have decided not to build there after having gone through several Court actions upholding their right to build . He . stated that in light of this development , Rumsey - Ithaca Corp . , thinks the land that the doctors were . going to purchase would be better as a residential lot . Mr . Niederkorn stated , therefore , that they are proposing a realignment of lots and the elimination of that road . Mr . Niederkorn stated that he has gone over the details of such a change with Mr . Fabbroni and has indicated the change on the - subdivision map and is -presenting same to the Board at --this time . The land in the subdivision is a part of the whole parcel #6 - 22 - 2 - 2 . 2 . Chairman Bronfenbrenner asked -- if . there were any questions - .from the public . There were none , no - one having appeared in - support of - or - in - objection to this proposal . Chairman Bronfenbrenner asked if there were any questions from the Board . There were none . Chairman Bronfenbrenner declared the Public Hearing duly closed at 8 : 20 p . m . MOTION = by Mrs . Henry Aron : RESOLVED , that the Planning Board of the Town of Ithaca approve and hereby does approve a modification to the Final Subdivision ' Plan as approved . March 21 , 1978 , removing Chandler Road as proposed and presented to said Planning Board this date , and dividing the land comprising the subdivision among the adjacent lots ; all- as delineated on map entitled Planning Board - 5 - June 6 , 1978 " Subdivision Plat , DeForest Park , Rumsey - Ithaca Corp. Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter duly open at 8 : 30 p . .m . , read the Notice of Public Hearing as stated above , and presented for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on May --30 , -- - 1978 , and June 1 , 1978 , respectively , as . re - quired . Mr .-* Arnold '=Albrecht -:=-appeared . before- - the-- Board =as -- representative -- .of Therm , Inc . and presented a site plan dated 3 / 30 / 75 which indicated the - - Therm -==boundari-es - and they l4ocation-. of- =the - -- proposed-: = addition -in .red . - He . stated that the request -- is --for an -801 square addition of cement_ block and steel with a flat roof . He - noted that the area is zoned light industrial . ® Mrs . Bronfenbrenner asked if the proposed addition: complies with the - lot - line regulations . Mr . Fabbroni stated that it does . The -- Board members - asked if - Mr . Planning Board - 6 - June 6 , 1978 PUBLIC HEARING : TAX PARCEL 6 - 24 - 1 - 41 . 2 , A PORTION THEREOF , HAYTS ROAD , PROPOSED REZONING FROM AGRICULTURAL TO MULTI - FAMILY AND SITE PLAN REVIEW OF APPROXIMATELY 5 . 4 ACRES FOR A 10 - UNIT APARTMENT BUILDING . JOHN D . MacLEAN . Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter duly open at 8 : 50 p . m . , read the Notice of Public Hearing as stated above , and presented for the record the Clerk ' s Affidavit . of Posting and Publication of the Notice of Public Hearings in Town Hall . _ and the Ithaca Journal on May 30 , 1978 , and June 1 , 1978 , respectively , as re - quired , together with the Secretary ' s Affidavit of Service by Mail of the Notice of Public Hearings upon the various neighbors of Mr . MacLean and upon Mr . MacLean as party to the action . Mr . MacLean presented a Plot Plan for a . 10 - unit apartment dated May 12 , 1978 , together with a picture of what his . proposal would look like and a floor plan . He stated that he is presenting a rezoning request from agricultural to multi - family . Mr . Aron asked permission to address the Chair and was granted same . Mr . Aron stated that he would like , as a member of the Board , to abstain from - discussing- --and/ or - voting -- on- this :- matter- -becaus.e_of -conflict of interest .- Mr . Aron was- . granted permission- -to withdraw -from -- participation - in this matter . Mrs . Bronfenbrenner stated that in light of this development , the Planning Board does not have a quorum and cannot continue -the - - Public Hearing . She stated that all these neighbors have made the effort to come and yet it is no longer an . official public hearing , - but discussion may continue for information only . She stated that the matter will have to be taken up all over again -.when a . quorum . is present . . . Mr . David Jennings , 593 Sheffield Road , spoke to the Board and stated that there are problems with - drainage down Sheffield Road . He noted that two square miles in the Town of Enfield -drains into this - land . Mr . . Jennings stated that the " Breeders " ( E . A . I . Co -Op ) had a pond which helped a lot but it has broken its seal and now it does not help . Mr . Jennings noted that Lot #40 is his lot and - his culvert runs 1 , 200 gallons a minute and it runs full . Mr . . ... Gerald Hall , 296 Hayts Road , stated that in the Spring of > 1976 he - had -- -38 " of water in his basement . . . Mr ', - Jennings stated that drainage is really -bad in this - area . He pointed out that the land has been filled , but it is quite swampy . Mr . Jennings also pointed out that sewage disposal is a problem also and stated "' that the Town Board has been trying to do something about drainage . Mr . Jennings-.- expressed the - opinion that . bigh - density development . will- - increase the- prob=lems . He - :- stated that-.- all the - --landowners - .up - there--- have- sha-llow - ells , ' as well as problems with sewage . Mr . MacLean pointed out that any such development would have to be approved by the Tompkins County Board of Health . He also noted that the sub - surface of the road has - been rebuilt since he has been there twelve years . Planning Board - 7 - June 6 , 1978 Mrs . Bronfenbrenner asked Mr . Fabbroni what the Health Department requirement is for multi - family residence in a non -watered and non - sewered ® area . Mr . Fabbroni described them without benefit of the manual in front of him . Mr . Fabbroni continued stating to the public that he can concur. with most of what they have said except that just as a point of fact , he has a problem seeing where their sewage problem would relate to Mr . MacLean ' s wanting to develop herewith the total acreage being around 70 acres . A voice remarked that there is a pool there which is never dry . Mrs . Carol Dickinson stated that the neighborhood had a group home come in there and its presence changed the water they get - the amount , that is . Mr . MacLean stated that the Health Department wants him to have two .wells and a 2 , 000 gallon storage tank for the project and also three . . septic systems and sand filters . The slope of the land was discussed extensively . Mr . - Jennings stated that - if the Town starts to rezone this --land , it will probably rezone _ more and - he - did _ -not_ .s.ee how .the . land - .can - support high density development . " A letter from Nancy Pokorney and Douglas Pokorney , Hayts Road , dated June b 1978 , to -the Planning Board was - entered into the record. as -follows :. "We ; -- -.the undersigned , wish -- to make known . our opposition to the proposed zoning variance changing a sect-ion of property on the- Hayts .. Rd .. owned -- by = John -­ McLain - from agricultural use . We _.f eel - that any -rezo'ning from agriculture would be of a . detrimental nature to the rural atmosphere now enjoyed by the residents . The- - traffic on the _ Hay-s -Rd :.- _.is: _ already considerable - and - would . of course--increase even more with an -- apartment situation . We - . do not . wish to see large apartment complexes in our - now pleasant neighborhood . " Mr . William Ryan stated that the water supply is sporadic - - the wells are mostly shallow . He noted also that - -there is a problem with rock . " Planning Board - 8 - June 6 , 1978 Mr . Fabbroni indicated what plans and drawings are necessary as required in Section 29 of the zoning ordinance . ® Mrs . Grigorov asked if any of the land is being used for agricultural purposes . It was not clear what the answer was . With the concurrence of the Board , Chairman Bronfenbrenner stated the the Public Hearing stands adjourned until June 20 , 1978 , at 7 : 45 p . m . - and that this announcement serves at the official notice of such adjourned meeting .
