A regular meeting of the Town of Ithaca Planning Board was held on
:10' Tuesday , May 16 , 1978 , in Town Hall , 126 East Seneca Street ( second floor ) ,
Ithaca , New York , at 7 : 00 p . m .
PRESENT : Chairman Liese Bronfenbrenner , Bernard Stanton , Montgomery
May , Carolyn Grigorov ., James Baker , Henry Aron . ( Secretary ' s Note : Mr .
Stanton had to leave the meeting at 7 : 40 p . m . ; Mr . Aron arrived at 7 : 40 p . m . )

Chairman Bronfenbrenner called the meeting to order at 7 : 06 p . m .
PUBLIC HEARING : TAX PARCEL 6 - 66 - 3 - 3 , A PORTION THEREOF , 127 WARREN ROAD ,
PRELIMINARY SUBDIVISION HEARING TO SUBDIVIDE A 2 . 47 ACRE PARCEL INTO TWO
LOTS , L . FABBRONI .
Chairman Bronfenbrenner declared the Public Hearing in the above - noted
matter duly opened at 7 : 06 p . m . and presented for the record the Clerk ' s
Affidavit of Posting and Publication - of - the Notice - of Public Hearings in
Town Hall and the Ithaca Journal on May 9 , 1978 , and May 11 , 1978 , respec -
tively , as required .
Mr . Fabbroni presented his proposal for the subdivision into two lots
of a portion of Parcel No . 6 - 66 - 3 - 3 , 127 Warren Road , together with a plan
therefor dated May 15 , 1978 , and titled 112 - Lot Subdivision , 127 Warren Road ,
Town - -of Ithaca " , drawn by L . Fabbroni , NYSPE # 5.1734 , with - Survey Information
taken from Map prepared by T .- G . - Miller ,- - date : - 9 / 23 / 770
Mr . - Fabbroni stated that --he - is in the process -of-- purchasing -property --
from- -John Hertel measuring approximately 387 '-- along - Warren---Road .and --.back =—
approximately 295 ' : - He noted that this - is the - original- farmstead for - the - -
whole-.Hertel farm . Mr . Fabbroni -noted that there is a large barn- - and
chicken coop to the rear on the same large parcel . Mr . Fabbroni is pro -
posing to split off one lot to the south of the house and to the north of
properties of Tyler , Henderson and Likens . The proposed lot would be
100 ' wide and approximately 270 ' deep from the roadway , which is almost
twice the size of the standard lot allowed . Mr . Fabbroni stated that the
proposed access to the lot would be through a purchase agreement that he
has with the prospective buyer and would also be by the existing access
driveway to the house . Mr . Fabbroni stated that he will live in the house
next -door to the proposed lot . Mr . - Fabbroni said that his plan will leave
the - same number of driveways that now - existing on -Warren Road , i . e . , the
flat part of Warren Road : Mr . Fabbroni noted that he is purchasing two and
one - half acres of land with the house . He stated that a water line exists
past the house and the sewer line is the one to be constructed as far north
as the Moakley ' House . He said that the drainage wili,. remain exactly as it
is . Mr . Fabbroni stated that Mr . Hertel has torn down most of the barn
and so it is a trade - off between what was there and what will be there
with the new house to be built . Mr . Fabbroni pointed out that the proposed
owner plans to leave the grape vines and the garden that are now there and
also plans to build the house behind the grape vines . Mr . Fabbroni stated
that the purchase agreement specifies that the grape vines will not be
removed . Mr . Fabbroni pointed out that Mr . Hertel could sell his land to
him ( Fabbroni ) without subdivision approval , but since he ( Fabbroni ) wishes

to split off one lot he is requesting subdivision approval because that
would be the third lot in the acreage :. Mr . Fabbroni also pointed.; out that
® in the process of selling the - 2 - 1 / 2 acres to him , Mr . ' Hertel is leaving a
® 60 ' right of way4to the remaining . 13 acres ( including this right of way )
which would provide access to the land .
Chairman Bronfenbrenner asked if there were any questions from the
Board ' and noted thatk the land in question is the " old Warren Farm " . There
were none .
Chairman Bronfenbrenner asked if there were any questions from the
public . Mr . Gene Likens asked about . the possibility of further divisions of
land stating that the new lot ( the 100 - foot lot ) would be big enough for
two houses to go on it . Mr . .Fabbroni stated that the proposed 100- foot
lot does not allow for enough square footage for two lots , 15 , 000 sq . ft .
being required for a lot , and furthermore it does not meet the requirements
for a second lot therein fronting on a Town road . In other words , the new
lot could not be divided into two lots . -
Mrs . Bronfenbrenner also . pointed out that this Board cannot speak to
what Mr . John Hertel will do with the rest of his land .
There being no further questions from either the Board or the public ,
Chairman- Bronfenbrenner declared the - Public Hearing closed -at 7 -: 15 p . m .
Mr . Stanton stated that he . felt . that it was a good idea- - to - have only
the one access to the new lot . Mr . . Fabbroni agreed and noted that access
® is restricted to the buyer .
Mrs . Bronfenbrenner reminded the Board that : this is a preliminary
subdivision approval - hearing .

The MOTION was declared - -to be -carried unanimously .
DISCUSSION OF SIGN ORDINANCE REVISIONS AND TIMETABLE :
Mrs . Bronfenbrenner stated that the Sign Ordinance Committee has not
, met because - of - time and , work pressures . She stated that the Sign Ordinance
will "- come up on June 27th ( as the second - regular meeting of the Planning
Board ) . Mr . May will not be present either June 20th or June 27th .
POSSIBILITY . OF MR . MACKESEY LEAVING THE PLANNING BOARD .
Mrs . Bronfenbrenner noted that there is a possibility of Mr . Mackesey
having to resign from the Planning Board because he is moving into the City
of Ithaca . This matter should be resolved in the near future . r

Chairman Bronfenbrenner declared the Public Hearing in the above -
noted matter duly opened at 7 : 20 p . m . and presented for the record the
Clerk ' s Affidavit of Posting and Publication of the Notice of Public
Hearings on May 9 , 1978 , and May 11 , 1978 , respectively , as required .
Mr . Richard Leonardo . appeared before the Board . He ' stated that at
the last meeting they did not know exactly how to get final approval . He
noted that at that time they had been given Preliminary Approval , December
7 , 1976 , for lots #4 , # 5 , and #6 , subject . to the approval of the Tompkins
County Health Department . He stated that such approval from the Health
Department has now been received and a copy of their letter dated May 16 ,
1978 , signed by Mr . John M . Andersson , Public Health Engineer , approving
lots #4 , # 5 , and # 6 has been forwarded to Mr . Fabbroni and to Mr . Bergen ,
the Town Clerk .
Mr . Leonardo commented thatfthe has people interested in Lot . .#10 and
Lot #4 at this time .
Mr . Fabbroni asked about - the future water main - - when it would be .
installed . Mr . Leonardo stated that they ' would . go in as the lots are
constructed . He said that they have a " T '.' in the water main which they
have already - constructed -- = part of the sewer and water main - . for the . '
entire subdivision are already constructed .
Chairman Bronfenbrenner asked about . parkland for this subdivision .
She noted - that -- the matter of parkland comes under the aegis of the Planning
Board = and-= up- ,to = -10% of-.. . the - subdivision land may be required-- -to - be - set
aside -- for --parkland- -or-- open - space..=-= -
-- Mr .. -Leonar-do =-stated - -that ---hislather ---3r:� Anthon-y-Leonardo has - already_
donated =- t=hree acres of land = -behind this subd-iv. s-ion-;as- parkland :--==_3t -= was
noted: _ that - -the - subdivision - contains= -- about = -three- to - four - acres . =
Mr . -. Fabbron-i pointed out _ _that - the matter : of parkland has been dis --- - - .
cussed by this Board but - none of the present members were on the Board at
that time . ( See Planning Board Minutes - August 14 , August 28 , September
4 , 1973 ) .
Mr . May commented that the roadways are suitable as to slope and
noted that they are flat . He wondered about the water lines and Mr .
Leonardo- stated- that -there - is a - 6 " line running - up Danby-.-Road_ , there =- is
an 8 " - line _ on° Sesame Street- rand then back - -into a 611 - main . -
Chairman Bronfenbrenner asked if there were any questions from ' the
public . There were none . Chairman Bronfenbrenner asked if there were any
further ---questions - from the Planning Board . There were none . The Chair de -
clared the Public Hearing duly closed at 7 : 30 p . m .

proposed for medical offices . He stated that no more parking is required
by this proposal , and , in fact , they are proposing to remove four spaces
from that area . He stated that they may add additional space if they need
it , but they are not planning ' on it . He stated that the roof line - would-. . -
remain the same - - the exterior view would . not ' change at all . He commented
that there - will . . be - a - sidewalk - - around -..the addition and the store window - will
be eliminated .
Chairman Bronfenbrenner asked if there were any questions from the
public . There were none . Chairman Bronfenbrenner asked if there were
any questions from the Board . There were none . Mr . Fabbroni felt that the
plan . was presented in good order .
