The Planning Board of the Town of Ithaca met on Tuesday , October
18 , 1977 , at 7 : 30 p . m . in the Town of Ithaca Town Hall , 126 East Seneca
Street , Ithaca , N . Y .
PRESENT : Chairman Liese Bronfenbrenner , Jonathan Bradley , Eva

APPROVAL OF MINUTES
MOTION by Mr . James Baker , seconded by Patrick Mackesey :
RESOLVED , that the Planning Board of the Town of Ithaca approve and
hereby does approve the Planning Board Minutes of March 1 , 1977 , April 5 ,
1977 , May 17 , 1977 , and June 21 , 1977 , as written .
There being no further discussion , the Chair called for a vote .
Aye - Bronfenbrenner , Bradley , Hoffmann , Baker , May , Mackesey .
Abstain - Stanton .
Q� Nay - None .
The MOTION was declared to be carried unanimously .
CONSIDERATION OF SIGN APPLICATIONS
1 . Mr . Fabbroni presented an application for sign permit of Citizens `
Savings Bank located in the Fast Hill Plaza . Mr . Fabbroni stated
that the proposed sign contains 20 sq . ft . and is to be placed upon
a 20 lineal front - foot building and is in compliance with the Sign
Ordinance , Mr . Fabbroni noted that this approval process is some -
what different from the usual in that the sign permit application
together with the attached drawing of the proposed sign has already
received Town Board approval subject to Planning Board approval .
MOTION by Mr . Bernard Stanton , seconded by Mr . James Baker :
RESOLVED , that the Planning Board of the Town of Ithaca approve and
hereby does approve the application for sign permit of Citizens '
Savings Bank located in the East Hill Plaza .
There being no further discussion , the Chair called for a vote .
Aye - Bronfenbrenner , Bradley , Hoffmann , Baker , May , Mackesey ,
Stanton .
Nay - None .
The MOTION was declared to be carried unanimously .
Planning Board - 2 - October 18 , 1977
2 . Mr . Fabbroni presented an application for sign permit of " What ' s
Your Beef ? " and stated that Mr . Bonnell had determined that there
is almost 60 sq . ft , of signage at this location on a 40 lineal
foot building . Mr . Fabbroni noted that the sign application states
that the location has about 28 sq . ft , of signage .
MOTION by Mr . Jonathan Bradley , seconded by Mr . Bernard Stanton :
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board that the permit for
signs at the " What ' s Your Beef ? " restaurant be denied on the grounds
that the signage does not comply with the Town of Ithaca Sign
Ordinance .
There being no further discussion , the Chair called for a vote .

Stanton .
Nay - None .
The MOTION was declared to be carried unanimously .
DISCUSSION OF PROPOSED 10 -YEAR PARK PLAN .
Mr . Fabbroni distributed to the Board the proposed 10 - year Plan
for Priorities , Programming and Costs for Parks in the Town broken down
into two separate 5 -year sections . ( See attachment to Official Minutes
of the Planning Board filed in the Town Clerk ' s Office . )
Mr . Fabbroni stated that this matter will be discussed by the
Town Board on October 24th , 1977 , at noon . Mrs . Bronfenbrenner will be
out of town on that date and it was decided that Mr . Bradley would attend
this noon meeting in her stead , or , in the event he cannot , Mrs . Hoffmann
will attend .
Mr . Fabbroni stated that this plan is basically the outgrowth of a
lot of little plans that this Board has discussed . Mr . Fabbroni noted ,
for example , that in the 10 - year plan he has projected the activities
over the whole East Ithaca area , and , as another example , it indicates
the acquisition of parks in different areas of the Town .
PUBLIC HEARING : CONSIDERATION OF FINAL SUBDIVISION PLAN OF DEFOREST
PARK OF RUMSEY- ITHACA CORP . FOR LAND BACK LOT OF DUBOIS AND INDIAN CREEK
ROADS AND BEING A PART OF TAX PARCEL 6 - 22 -2 -2 . 2 , TOWN OF ITHACA ,
Mrs . Bronfenbrenner announced that , at the request of the applicant ,
the Public Hearing in the above= noted matter has been cancelled .
PUBLIC HEARING : CONSIDERATION OF THE PUBLIC AND PRIVATE ALTERNATIVES TO
PROVIDING ACCESS TO INDIVIDUAL LOTS ALONG UNDEVELOPED PORTIONS OF KENDALL
AVENUE AND PENNSYLVANIA AVENUE . ( ADJOURNED FROM OCTOBER 41 1977 )
At 7 : 45 p . m . Chairman Bronfenbrenner declared the adjourned Public
Hearing in the above - noted matter duly opened and read the Notice of
Public Hearing as published in the Ithaca Journal and presented the
Clerk ' s Affidavit of Posting and" `Publication .
Mrs . Bronfenbrenner read a letter directed to the Town of Ithaca
Planning Board - 3 - October 18 , 1977
Town Board , c /o Walter J . Schwan , Supervisor , and dated September 21 ,
1977 , from Robert H . Martin , 180 I:endall Avenue , and owner of several
properties in the area , as follows :
" We are totally against opening up Pennsylvania Avenue
to through traffic and will fight this by all legal means
possible .
If this road is built it would only be 7 to 15 feet
from established homes . This would cause a real safety
hazard to children that live in these houses .
This is also an ideal location for Ithaca College stu-
dents . Many homes in the area already have student apartments
to help them with the rising costs of owning a home . If
Kendall and Pennsylvania Avenue are connected this would open
the entire area not only to the local residents but to student
traffic population . Again a serious safety hazard to children .
There are other reasons why we are against this request
which I would be happy to explain to the board at their next
meeting .

Mr . Fabbroni described one possible approach to a solution of the
® Kendall/Pennsylvania road problem . This would be the construction of a
" hammerhead " at the end of the improvement of Kendall Avenue , i . e . ,
extend Kendall Avenue to the point where it would meet with Pennsylvania
Avenue if it ( Pennsylvania ) were extended and create a turn- around effect
by use of a road construction technique known as a hammerhead or " T "
effect . Pennsylvania Avenue would remain unimproved , except for that
portion at its end where the head of the hammer , so to speak , would lie .
Mr . Willis Hilker asked if this were to be the proposal ? Mrs .
Bronfenbrenner stated that it was not necessarily the proposal ; it is
one of the alternatives to resolving the whole question .
Mr . Hilker expressed his concern about access to his properties
on Pennsylvania Avenue . He asked if that road would be opened but not
pavable ?
Mr . Fabbroni stated that under this proposal it would be the same
as it exists now , but if the owners of 50 % of the front footage on
Pennsylvania want it opened it would be at their expense .
Mr . Louis Bonanni , Jr . stated that he thought the Board had already
heard from 50 % who are in favor of improving the road . Mr . Fabbroni
stated that he did not think that this is so , but if it is under Section
200 of Town Law which relates to road improvement and dedication the
requirement is that the -owners of more than 500 of the front footage
on a proposed road may petition for a Town road , not merely 500 of the
owners of property on such " road " . Mr . Fabbroni stated that with the
exception of Mr . Hilker , all the people who have appeared in person
or first hand basically are down in the end where Mr . Bonanni owns
land , any interest has been virtually second hand down toward the other
land .

Mr . Bradley stated that Mr . Hilker is going to get the short end
of the stick if we go along with the hammerhead .
Mrs . Hoffmann asked how it is possible that if this road is
constructed that it will come within 7 to 15 feet of a building . Mr .
Fabbroni stated that this is not the case at all . He said that in all
actuality if the road were constructed it would be as much as 22 ' from
Perry and Schultz ; there is about 100 ' between the two houses . He
stated that the right of way itself is 50 ' but the road would be 20 '
with 4 ' shoulders .
Mr . Bradley said , " But , the road is on the map . Why not put it
in by extending the one edge of the hammerhead ? The basic objection is
the thoroughfare . "
Mrs . Hoffmann asked if you have the loop , that is join Kendall and
Pennsylvania , will you have much more traffic on Kendall ?
Mr . Fabbroni stated that he cannot believe that you are going to
create more traffic by making a loop .
Mrs . Hoffmann stated that she agreed it is better than two dead
ends . Mrs . Hoffmann raised the question of economics . Mr . Fabbroni
stated that if Mr . Hilker constructs the road as he has offered to do ,
it costs the taxpayer nothing .
Mr . Hilker wanted to make it clear that he is considering only the
® one road that is the loop , i . e . , the joining of Kendall and Pennsylvania .
Mrs . Bronfenbrenner felt that no one has the right to prevent a
property owner from having access to his property .
Mr . Tony Schultz asked if the Board had talked about the possibility
of the " loop " being a thoroughfare ? Mrs . Bronfenbrenner stated , " Yes ,
that is the reason for the discussion of the hammerhead . "
Mr . Hilker indicated that one of his thoughts had been to construct
the road with the assistance of those property owners who were interested
in it . Mrs . Bronfenbrenner asked for some clarification of this . Mr .
Hilker stated that he would bear most of the expenses and have a private
agreement if there were property owners interested in such an agreement .
Mr . Schultz stated that this is bribery to the Town - - " you say
you will give hiM - a road if he builds it " .
Mr . Hilker said that the road would be put in at no expense to the
Town .
Mr . Schultz said that Mr . Hilker is willing to build the road with
the assistance of those who want the road , but what about the people who
have to bear the cost of the equipment being there ? Mr . Schultz stated
that he thinks the residents are resigned to the fact that ultimately
that road will go through , but we want it done in a manner that is
totally responsible . If these people should become unwilling to bear
this expense , where does this leave the residents who oppose it ? Would
the road be built in sections meaning that construction equipment and
noise and dust will go on for years ?

Mr . Bonanni asked if the Board knows what would be the most
equitable way to resolve this problem - - by contractor or by the
citizens ? Mr . Bonanni stated that this road will benefit everybody in
that area .
Mr . Fabbroni stated for clarification that the road
would not be accepted by the Town
unless it meets Town specifications , nor will any certificate of com-
pliance be issued until it does .
Mrs . Hoffmann stated that these roads have been on the map for
almost a 100 years and water and sewer have been placed in there .
A discussion followed as to where the water and sewer lines are .
The Chair asked if there any further comments .
Mr . Tammo Steenhuis stated that most of the people on the end of
Pennsylvania Avenue do not want the road . Mr . Steenhuis stated that he
does not own property on that part of the road ; he on the other end , but
he would like to suggest that if Mr . Hilker is the only one who wants
the road he ( Hilker ) should be reimbursed for the cost of his property .
Mr . Wilbur Baker stated that Kendall and Pennsylvania are roads
that are now being used - - if this loop goes in so that there is one
circle , is the Town going to bring the existing Kendall and Pennsylvania
up to Town specifications . Mr . Baker stated that he is talking about
® condition . Mr . Baker stated emphatically that these roads are ruined .
If this goes - - is the Town going to fix these roads ?
Mr . Fabbroni stated that roads in the Town are maintained on a
five-year cycle ; if they have not , they are due . The residents in
attendance stated en masse that these roads have been allowed to deteriorate
for twenty years and have not been repaired at all .
There followed a lengthy discussion of why the City Reservoir should
be banned from swimming .
At 8 : 31 p . m . the Chair closed the Public Hearing , and asked for
comments from the members of the Board . Mrs . Bronfenbrenner stated that
the Board should understand that the Planning Board may only make
recommendations to the Town Board ; theirs is the final decision .
Mr . May , looking at the map , stated that all these lots certainly
cannot be developed without this road being there .
Mr . Stanton stated that very often , if there is a number of people
who are not interested , a long - term solution becomes too much and it is
perhaps better to look to a short - term solution such as the hammerhead .
Mrs . Hoffmann stated that she felt that all the people on the roads
should be asked for their opinion . Mrs . Bronfenbrenner referred to
Supervisor Schwan ' s letter to those on the unimproved portions to which
some replies were received . Mrs . Hoffmann said she meant ALL the people
on the roads .
Mr . Bradley stated that the people who are interested in building

the road should petition to have it built for the distance they want
it built .
® Mr . Fabbroni commented that as far as the Town Master Plan goes ,
the roads have always been recognized as future roads .
Mrs . Bronfenbrenner asked if the Board had any further comments .
There being none forthcoming , Mrs . Bronfenbrenner asked if the Board
were ready to make a recommendation to the Town Board ,
Mrs . Hoffmann referred back to the distance that some of the
houses would be from the road , and asked if it is only Schultz and
Perry that would be close to it ? Mr . Fabbroni said yes Martin is
close but not as close .
Mrs . Bronfenbrenner asked the Board if they felt that they. . need
additional information , and , if so , what kind of information , in order
to make a decision ?
MOTION by Mr . Jonathan Bradley , seconded by Mrs . Liese Bronfenbrenner :
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board that the extension of
Kendall Avenue and Pennsylvania Avenue be governed under the Section 200
provisions in the Town Law .
By way of discussion , Mr . May queried , " Is the validity of the
motion since that is Town Law? "
® Mr . Bradley stated that it is a recommendation to the Town Board
that this be the procedure used for opening the road .
Mr . Stanton asked Mr . Bradley what the intent of his motion is ?
Mr . Bradley stated that the intent is that the road can be opened to
whatever extent it is desired .
Mr . Hilker stated to the Board that if the road , -Would be passed on
that basis , it would have to be a front - footage assessment to the pro -
perty owners . The Board indicated that they understood the meaning of
Section 200 ,
Mrs . Hoffmann stated that if all the property owners were involved
at this point as suggested by Mr . Bradley , it would be unlikely it would
be developed .
Mr . May stated that it is in the best interests of the Town and
the future to have the total loop built , both from a maintenance angle
and from the angle of future property owners . There is a developer who
is willing to construct this road . Roads are built to get people
around and we each must look after our own children .
Mrs . Bronfenbrenner said that at least there could be a time limit
as far as construction in order to minimize dust , trucks , etc .
Mr . May stated that he was having difficulty in seeing the
wrongness of this road , aside from the specific interests of a very
few ,

Mr . Mackesey stated that these roads are noted on the deeds and
these people are entitled to the roads as noted .
Mr . Anthony Schultz stated to the Board that he is not opposed
to the development of that road if the road is put in properly and to
the benefit of the people , but at this point in time there are not
people ready to build .
There being no further discussion , the Chair called for a vote :

The Chair declared to MOTION to be defeated , six to one .
MOTION by Mr . Montgomery May , seconded by Mr . Patrick Mackesey :
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board that Pennsylvania Avenue and
Kendall Avenue be continued to make a continuous loop as per the original
plat map from the Ithaca Land Company dated 1895 , duly recorded , and
according to the land use maps of the Tompkins County Assessment Office .
By way of discussion , Mr . Mackesey stated that his feelings are
that when you have roads laid out and you have people purchase land in
good faith that they will be built , those people are holding a dead
investment if the road is not opened for them to use their land .
® Mr . Bradley stated that it is obvious here that the road is not
needed all the way through .
Mr . May said that he did not know that Mr . Bradley can say that .
Mr . Mackesey said that some are actually in favor .
Mr . Bradley said , " Then build the road in sections . "
Mr . Stanton stated that the question is " when " . He said that there
are an important number of people who are opposed , and yet , there is no
question as to it being logical in the first place .
There being no further discussion , the Chair called for a vote .
Aye - May , Baker , Hoffmann , Mackesey .
Nay - Bradley , Bronfenbrenner , Stanton .
The MOTION was declared to be passed , four to three .
