The Planning Board of the Town of Ithaca met on Tuesday , August
16 , 1977 , in Town Hall , 126 East Seneca Street ( second floor ) , Ithaca ,
N . Y . , at 7 : 30 p . m .
PRESENT : Chairman Liese Bronfenbrenner , Henry Aron , James Baker ,

Chairman Bronfenbrenner opened the meeting at 7 : 30 p . m .
REPORT OF THE BUILDING INSPECTOR
Mr . Fabbroni reported that permits had been issued in July for
three one - family homes for $ 147 , 000 ; one two - family home for $ 23 , 200 ;
and five alterations or additions for $ 15 , 450 , for a total of $ 185 , 650 ,
as compared to permits for seven one - family homes for $ 201 , 500 and one
addition for $ 3 , 000 , for a total of $ 204 , 500 in July of 1976 .
REPORT OF PLANNING ENGINEER
No report . other than the sewer funding looks favorable .
® REPORT OF COUNTY PLANNING BOARD REPRESENTATIVE
Mrs . Hoffman stated that the County Board had not met and so she
had no report . Mrs . Hoffmann informed the Board that she would be
away for the September 14 , 1977 , meeting of the County Board but she
will arrange for someone else to attend on her behalf .
REPORT OF THE PLANNING BOARD CHAIRMAN
Mrs . Bronfenbrenner reported that Mr . Desch had been contacted by
Barbara Caldwell of the Town of Dryden Planning Board in re the proposals
of Developer Rocco Lucente for additional houses in the Sapsucker Woods
area . The Dryden Board members would like assistance from the Town of
Ithaca in solving the traffic problems at the intersection of Sapsucker
and Hanshaw road . Sewer does not seem to be a problem . The area in
question takes in Meadowlark and Cardinal Drives . Lucente may go to
cluster . The drainage on Cardinal Drive does not appear to be a problem .
There was a discussion of benefit rates to Dryden for transmission in
the Town of Ithaca . The meeting will be held on August 18 , 1977 , ( two
days from now ) , and Montgomery May , Henry Aron , and either Eva Hoffmann
or Liese Bronfenbrenner will attend .
APPROVAL . OF MINUTES
Upon M'OTION of Mr . Henry Aron , duly seconded by Mr . Jonathan
Bradley , and a unanimous vote in favor , the Planning Board Minutes of
March 15 , 1977 , June 7 , 1977 , and July 5 , 1977 , were approved as
written .

INFORMAL DISCUSSION OF DEFOREST SUBDIVISION ON . DUBOIS ROAD , TOM
NIEDERKORN
® The Planning Board held an informal discussion with the designer
for the proposed DeForest Subdivision on land owned by Mr . George VanEpps
on DuBois Road - Mr . Thomas Niederkorn . rMro Niederkorn brought the
new members up to date on the proposal , which will be presented at a
public hearing in September . This is an estate - type development with
minimum lots of 2 . 4 acres . The topography and gradient of the proposed
subdivision road were discussed . The steep grade of the proposed road
and possible excessive drainage to Taughannock Blvd . will need further
study since it appears to be running around 147o - 167o grade .
Mr . Niederkorn informed the Board that the first stage of the
subdivision will be on the west end . The total will be about 22 to
24 very large lots running from 2 . 4 acres to over 6 acres . He agreed
that the topo and gradient of the roadway is a problem . He will also
pursue the matter of an easement along the drainageways .
Mr . Aron was concerned about the velocity of the water in the
waterway and where it goes . Mr . Niederkorn will check the culvert size
and terminus . Mr . Aron wondered if he was only concerned at this time
with the first stage and consideration of approval for it . Mr .
Niederkorn replied that they are concerned with the first stage but felt
that the proposal must be viewed as a whole .
Mr . Fabbroni requested that Mr . Niederkorn explore the inclusion of
® a secondary access from Happy Lane .
It was the consensus of the Board that the proposal for the DeForest
Subdivision was coming along nicely .
PUBLIC HEARING : CONSIDERATION OF REQUEST OF JOHANN GEBAUER , ET AL , TO
REZONE FROM RESIDENCE DISTRICT R- 9 TO MULTIPLE RESIDENCE DISTRICT THAT
PORTION OF THE TOWN OF ITHACA GENERALLY BOUNDED BY THE CITY OF ITHACA ,
ITHACA COLLEGE , OLD RAILROAD RIGHT OF WAY BACKLOT EAST OF CODDINGTON
ROAD , AND CODDINGTON ROAD ENTRANCE TO ITHACA COLLEGE ,
Chairman Bronfenbrenner declared the Public Hearing in the above -
noted matter duly opened at 7 : 52 p . m . , and presented for the record
the Clerk ' s Affidavit of Posting and Publication of the Notice of Public
Hearing in Town Hall and the Ithaca Journal on August 5 , 1977 , and
August 11 , 1977 , respectively , together with the Secretary ' s Affidavit
of Service by Mail of said Notice upon 41 property owners and the City
of Ithaca and the Commissioner of Public Works of Tompkins County .
Chairman Bronfenbrenner asked if Mr . Fabbroni would comment on this
proposal with . Mr . Fabbroni declining to do so .
Mrs . Bronfenbrenner read a letter dated August 16 , 1977 , to the
Planning Board from H . Matthys Van Cort , Director , Department of Planning
and Development , City of Ithaca , as follows :
" Concerning the request for rezoning properties along Coddington
Road , to be considered at a public hearing August 16th , I would like to
bring the following to your attention :
Although the area involved is limited , and abuts the City for only
a short distance , the potential effects if fully developed in Multiple
Residence use could be out of proportion with its size . Within the City ,
Planning Board - 3 - August 16 , 1977
an adjacent area stretching down Hudson Street has recently been rezoned
R- 1 ( Single - Family ) , while the area abutting the Town is R2 ( Two - Family ) .
® Both these areas , and particularly the R- 1 along Hudson Street , could be
negatively affected if the Town ' s area were rezoned for denser use , with
accompanying increased traffic .
Perhaps of more concern that the environmental effects of increased
traffic are issues of circulation and safety . Because of the Coddington -
Danby intersection and the inadequacy of the South Hill street network ,
Hudson Street would be the main artery serving that area of the Town .
Despite recent improvements , Hudson remains treacherous because of the
slope , horizontal and vertical alinement , and oblique crossings . It
passes in front of South Hill School , and joins Aurora at another
difficult intersection just before entering the . most congested area in
the City .
We are also somewhat apprehensive that the remainder of this R - 9
district would follow the area presently being considered in seeking
rezoning . Such a development could have serious consequences far
exceeding those referred to above , as well as having some potential for
serious impact on the City ' s watershed area downhill along 6 - Mile Creek .
In the event that such a request arises , we would hope to be informed
far enough in advance of a hearing that we could study the impacts in
detail with the Town Planning Department .
In addition to the above concerns , it would seem that from the
point of view of the Town , more intense development at this point on
Coddington , with uncontrolled access from the road to each property ,
® would be undesirable . In addition to the imediate safety hazards , the
bottleneck that could develop might have undesirable effects on land use
further out Coddington .
In conclusion , it is the opinion of this department that the
requested rezoning could , in the medium - to long range , have more negative
effects than the short - run benefits to a few property owners in a locali -
zed area which seems to have reached its optimum level of growth . While
time has not permitted a thorough evaluation of this matter , it is our
impression that the area in question is not appropriate for multiple
residence , and its rezoning to that use would work to the detriment of
both Town and City . "
Mrs . Bronfenbrenner now read a letter from Mr . Robert 0 . Dingman ,
Superintendent of Public Works , City of Ithaca , to the Planning Board ,
dated August 16 , 1977 , as follows :
" The City of Ithaca Department of Public Works takes exception to
the above captioned rezoning proposal because the area proposed to be
rezoned drains into drainage systems within the city which are already
inadequate . Any greater density of usage , such as would occur in
changing from R- 9 Residential to Multiple Residential , would increase the
run - off coefficient for the area and cause drainage problems for which
no adequate provision has been made . It is also important to note that
at least a portion of the area proposed to be rezoned drains into a public
water supply area . Again the greater density would increase the problem
of such drainage .
The department earnestly requests that you withhold approval of any
rezoning of this area until the petitioner has provided drainage data
and plans showing how he will adequately handle the drainage from this
area . "
Planning Board - 4 - August 16 , 1977
Mr . Gerald Sanford , 221 Coddington Road , presented a Petition in
opposition to the proposal for rezoning signed by 21 property owners .
He said they did not wish to see the area rezoned from R - 9 to Multiple .
He noted that every single resident in the adjoining area signed the
Petition . Mr . Sanford pointed out that one and one - half months ago
Mr . Gebauer petitioned the Town Board for this rezoning change . as a
result of the use of his property ( Gebauer ) . Mr . Sanford said that he
took exception to the Multiple Family rezoning and he read from the
Petion as follows :
" We , the undersigned , do not wish to have the area in that portion
of the Town of Ithaca generally bounded by the City of Ithaca , Ithaca
College , old Railroad Right of Way back lot east of Coddington Road ,
and Coddington Road entrance to Ithaca College rezoned from R - 9 to
Multiple Residence : signed by : Frank Sczepanski , 224 Coddington ;

Mrs . Olympia McFall stated that she owns 235 Coddington Road and
® they had 5 roomers which they did not know was illegal . Now that they
know about the ordinance requirements they have asked for the rezoning .
They were in . . violation . by two persons . They rented to only 4 in the
apartment and the lease extends . for another year . They originally asked
for a one year special permit .
Mrs . Bronfenbrenner asked about the lot size . Mrs . McFall described
the lot as 125 ' x 170 ' and containing a 10 room house which is limited
to 3 unrelated person . She noted that when they lives there it was
a family of 6 with 3 upstairs , so now there are five less persons .
She said there is actually less water and sewer usage than when they were
there as a family .
Attorney Laura Holmberge stated that she was representing Mr .
Gebaurer who owns 225 Coddington Road and that there is a violation .
She noted that 225 Coddington was in violation and that Mr . Gebauer
knew he was in volation when he constructed additional units . She
said that 225 was built as a duplex . She noted that Mr . Gebauer ' s other
house at 229 Coddington has received a special permit for 3 units and
that he purchased it that way .
Mr . Fabbroni presented a record of lot ownership in the area and
a history of violations . A cover letter from Mr. . Fabbroni to the
Planning Board set forth Mr . Fabbroni ' s recommendations and will - be . .- filed
with these Minutes in the Official Minute Book of the Planning Board ,
Mrs . Bronfenbrenner noted that on the west side of Coddington Road
3 of the 12 parcels denoted are owned by Ithaca College ; there is one
life - time lease formerly owner - occupied .
Mrs . Holmberg said she was putting forth absolutely no falsehoods ,
in reference to violations . Mrs . McFall referred to lots owned by
some professors .

Mr . John Kaminski , 222 Coddington Road , expressed his complaints
about the noise from the Gebauer property . He complained that there
® does not seem to be any solution to the noise . He stated that he does
not want to see another Collegetown area emerge .
Mr . Gary Woollard , 210 Pennsylvania Avenue , also complained about
the noise . He said that he wanted . - to keep the woods instead of two -
story apartment buildings .
Mr . Alvin Nelson , 223 Coddington Road , said he lives next to
Gebauer ', s property . He said that there are by his count eight to ten
people in the building . He complained about the noise . He said he
signed the petition willingly . He commented that it did not bother
him as to building in the area , - . noting that there have been a . lot of
changes with the College developing . He said that he was very concerned
that if the Town keeps handing out permitsthen this zoning change makes
no difference . He pointed out that if the area is rezoned the single
family property values will be purged .
Mr . Aron asked Mr . Nelson to kindly clarify his statement about
building . Mr . Nelson replied that he was against the rezoning and
against building .
Mr . Gerald Sanford , 221 Coddington Road , speaking to Mrs . McFall ,
stated that their property would sell better as Multiple Family . Mrs .
McFall replied that there was no real difference to her ; they intended
no upgrading .
® Mr . John Kaminsky , 222 Coddington Road , commented that he was sure
that the houses would be razed and multiple family buildings built .
The Chairman felt that any recommendation by this Board should go
to both the Town Board and the Zoning Board of Appeals .
Mrs . McFall recounted the history of the tenant situation . Mr .
Aron asked for how long this history covered , Mrs . McFall replying since
1972 , with one tenant added in the course of that time .
Mrs . Bronfenbrenner asked about parking . Mrs . McFall said there is
parking off the street but that I . C . students park on the street without
permits . Mr . Fabbroni stated that there is no parking permitted on
either side of the road .
Mr . Sanford spoke of the limited access road to Ithaca College .
Mrs . Hoffmann spoke of the tenancy situation for five years . Mrs .
McFall described the tenant tree .
Mrs . Bronfenbrenner asked if there were any more questions from . the
public .
Mr . Nelson spoke again about the numbers of cars being parked .
® Mr . Willis Hilker , 275 Burns Road , stated that the comments from
the City of Ithaca were inconsistent in view of the multi - family develop -
ments in the City .
Mr . Aron was concerned about obligations to the City of Ithaca .
Mr . Hilker stated that he had three lots upon which he has planned

to build duplexes and added that if the area were to be rezoned he
would convert his plans to the higher density .
Mrs . McFall asked if it were possible to deal with one property
only .
There being no further questions or comments from the public , Mrs .
Bronfenbrenner declared the Public Hearing closed at 8 : 42 p . m .
MOTION by Mr . Montgomery May ,
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board that the request of Johann
Gebauer , et al , for the rezoning of that , Fportion . : of . the Town _ of Ithaca
generally bounded by . the City of Ithaca , Ithaca College , old Railroad
Right of Way back lot East of Coddington Road , and Coddington Road
entrance to Ithaca College from Residence District R - 9 to Multiple
Residence District be denied . and that said area - remain as Residence
District R- 9 .
Mr . Jonathan Bradley stated that he would agree .-- to - - such a :_ Moti. on , if
it were to read further that the Planning Board recommends that Spot
Zoning by Special Permit or Variance be discouraged . Mr . May agreed and
the MOTION was put on the floor as follows :
MOTION by Mr . Montgomery May , seconded by Mr . Henry Aron :
® RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend to the Town Board that the request of Johann
Gebauer , et al , for the rezoning of that portion of the Town of Ithaca
generally bounded by the City of Ithaca , Ithaca College , old Railroad
Right of Way back lot East of Coddington Road , and Coddington Road
entrance to Ithaca College from Residence District R- 9 to Multiple
Residence District be denied and that said area remain as Residence
District R- 9 , and further
RESOLVED , that said Planning Board recommend and hereby does
recommend that Spot Zoning by Special Permit or Variance be discouraged .
By way of discussion , Mrs . Hoffmann stated that the problem must be
dealt with .
Mrs . Bronfenbrenner stated that the McFall problem is different from
Gebauer in that Gebauer knew of the violations .
Mr . May agreed that there were two issues one of which was the re -
zoning request . He thought that maybe McFall would appeal again following
this meeting . He thought that in the case of Gebauer , the Town should
pursue court action .
Mr . Fabbroni said that the Motion seems to clarify the issues and
Mr . Aron agreed . Mrs . Hoffmann said that the area was quite small . Mr .
Bradley felt that the problem cannot be separated easily . He commented
® that there were families ', not one person per car .
® Mr . May commented that the McFalls were illegal by ignorance and
maybe a different approach should be taken there ; Gebauer seemed to have
no regard for the law . Mr . Aron noted that the McFalls said they will
comply and that finance was not a concern .

Mr . May commented that there must be attention to hardship but
maybe not here at this Board . Mr . Aron said that he supported the
Motion fully . Mr . Bradley agreed now that the part on special permit
was .- included with reference to spot zoning even though it does not
resolve the issue of special permits . . Mr . May also noted that the
Motion recomenrds the area remaining R- 9 .
There being no further discussion , the Chair called for a vote .
Aye - Bronfenbrenner , Aron , Baker , Hoffmann , Bradley , May .
Nay - None .
The MOTION was declared to be carried unanimously .
DISCUSSION OF TOWN OF ITHACA SIGN ORDINANCE AND PROPOSED AMENDMENTS ,
Mr . May said that there certainly are problems with the Sign
Ordinance and the Planning Board has made recommendations for amend -
ments since as long ago as 1975 .
Mr . May asked , " What is the purpose of the Town of Ithaca Sign
Ordinance ? " He said he felt it was to maintain and develop the character
of the Town but not go against the very nature of good things . He
asked , " What do we want ? " " There must be logical guidelines for
enforcement . "
Mr . Aron said he had the same impression .
Mr . May said he wanted to keep in . .mind the rural atmosphere of the
Town . He thought one of the first steps would be to categorize the
signs ; delineate those that just do not need a permit and those that
the Building Inspector could approve without all this Board approval .
Mrs . Bronfenbrenner appointed a Committee to study the matter of
signs and the Ordinance as follows : Montgomery May , Henry Aron , Robert
W . Bonnell ( staff ) . She requested that the existing Ordinance be,
copied again and given to the Board members once more and that the
copies for the Committee be marked up .
It was agreed that the Town Board should be notified that the
Planning Board would appreciate comments from its members as to any
ideas or suggestions .
EXECUTIVE SESSION
In Executive Session the Board discussed its recommendations to
the Town Board as to the vacancy on the Planning Board .
ADJOURNMENT
Upon Motion , the August 16 , 1977 , meeting of the Planning Board
was duly adjourned at 10 : 00 p . m .

Re : Proposed Rezoning of 20 Lots Along Coddington Road
The area proposed to be rezoned from a Residence District
R9 to a Multiple Residence District is bounded by Ithaca College
on the west , the City of Ithaca corporation limit on the north ,
the old railroad right of way backlot of homes fronting on Cod -
dington Road on the east , and the Coddington Road entrance to
Ithaca College on the south .
While the area is buffered in a way on all sides by
institutional use , abandoned railroad right of way , open land ,
or existing multi - family land in the City , the present use of
the homes within this area by families does not portray the
® petitioner ' s viewpoint of a declining neighborhood only suited
for student rental . The survey conducted by Bob Bonnell and other
staff members is summarized by the attached map which shows single
family homes in blue which are being legally used and single and
two - family homes in orange which are being illegally used . So ,
there does not appear to be an overriding need to rezone based
on existing use .
Aside from existing use from a pure planning point of
view , there is a great potential for problems in rezoning exist -
ing single family homes to allow multiple family use . A survey
done as part of an assessment of housing stock in this area showed
that many homes had less than 1 , 000 square feet of building space .
The fire and safety hazards resulting from large occupancy of small
living areas with awkward exitways and improper exits in expanded
domino - like buildings are intolerable .
Furthermore , the existing lots are the smallest residen -
tial lots allowed in the Town and a switch to multiple density
without adequate open space , area for parking , safe driveway access ,
drainage structures , pedestrian access , etc . would not appear to be
consistent with land use planning for the Town or proper site plan -
ning for the case at hand .

While there is a need for a Town policy on the need for
student housing , this proposal seems to have merit only as a way
to rectify four violations brought on by the desire for additional
financial benefit of four property owners which hardly seems the
proper basis for a rezoning .
