HomeMy WebLinkAboutPB Minutes 1977-06-07 A ' TOWN OF ITHACA PLANNING BOARD JUNE 7 , 1977 The Planning Board of the Town of Ithaca met in regular session on Tuesday , June 7 , 1977 , in the Town Hall , 126 East Seneca Street , ( second floor ) , Ithaca , N . Y . . , at 7 : 30 p . m . PRESENT : Chairman Liese Bronfenbrenner , Henry Aron , Montgomery May , Eva Hoffmann , James Baker , J . W . Reece , Lawrence Fabbroni ( Planning Engineer/Building Inspector ) . ALSO PRESENT : Henry Hilker , Willis Hilker , Catherine Valentino , Kathy Kaplan ( WHCU ) , John Jarrett ( WTKO ) . Chairman Bronfenbrenner opened the Meeting at 7 : 33 p . m . REPORT OF THE BUILDING INSPECTOR Mr . Fabbroni reported that in the month of May three permits for one - family homes were issued , one permit for a two - family home and permits for three additions or accessory buildings for a total of $ 175 , 500 . 00 , as compared with two one - family , one multi - family , and eight additions for a total of $ 175 , 650 . 00 in May 1976 , Mr . Fabbroni noted that activity seems to be picking back up with regard to home construction . With regard to violations , Mr . Fabbroni stated that they are continuing their efforts to bring all the signs in the Town into compliance . He reported that Mr . Bonnell , Assistant to the Engineer , is pursuing occupancy violations throughout the Town . He commented that they are making some progress in this area , if the load on the Zoning Board of Appeals is any indication . REPORT OF THE PLANNING ENGINEER Mr . Fabbroni reported that the new Town Barn is virtually complete . The men and equipment have moved in as of the 1st of June , 1977 . The new address is 106 Seven Mile Drive . With regard to parks , Mr . Fabbroni reported that the proposed DeWitt Junior High School Park has gone through the Town Board and they have given their approval to allocating $ 30 , 000 . 00 out of the Capital Reserve Fund . He noted that there is a maintenance agreement to be worked out with the City School District . He stated that the City School District has given general approval for payment of $ 30 , 000 . 00 . He said that approval from the Village of Cayuga Heights and the Village of Lansing is being pursued . He noted that the most favorable response has been from the Village of Cayuga Heights . Mr . Fabbroni reported that the Town has hired Mrs . Barbara Zimmerman Restaino for summer _ planning work . Mrs . Restaino has worked on the DeWitt Junior High School Park , The Town is also participating in a work- study arrangement with Cornell University and has hired Mr . Stephen Ossias for summer planning work . Cornell University pays for 80 % of Mr . Ossias ° salary and the Town for 20 % . It amounts to a $ 200 . 00 expen- diture for the Town of Ithaca over a ten week period . e Planning Board - 2 - June 7 , 1977 Mr . Fabbroni stated that one of the primary concerns with parks now will be the preparation of an appendix to the Comprehensive Open Space Plan that was developed by Ms . Susan Blumenthal . He said that it is their hope to develop it into a format that is a little more compre - hensible to the public . Mr . Fabbroni noted that the Coy Glen Park proposal is a presentable package at this time . He said that the Town Board is at the stage where they are able to approach residents to consider how they can carry out the study ' s objectives . Mr . Fabbroni also stated that they will be working on taking the park plans that have now developed and in terms of cost and planning come up with an implementation scheme . Mr . Fabbroni stated that they also will be working on developing the same type of study for Lick Brook that was developed by Dennis Colliton for Coy Glen . Referring to the proposed Route 96 improvement project by the State D . O . T . , Mr . Fabbroni stated that the recommendations endorsed by the Town Planning Board and the Town Board , i . e . , the combination of Alternates # 2 and # 3 as proposed by the D . O . T . , have been okayed by the Paleoentological Institute and the Hospital . He noted that the Planning and Public Works Committee of the County endorsed the Town ' s recommenda - tion today . He said that petitions of support were received from the Townspeople north of the hospital . He noted that the Board of Represen- tatives is the last step . He stated that they hope to get their approval next Monday , June 13th , and then send the recommendation on to the State . Mr . Fabbroni reported that the County Health Department has adopted changes in health regulations . He noted that the Planning Board members might want to have certain sections of that new code so that they would be aware of what the changes are . Mr . Fabbroni outlined that new code which entails extensive changes in required lot sizes , fire hydrant requirements plus much more . The most noteworthy change is the requirement for a 200 ' circle to be superimposed upon a proposed lot before it may be approved as a lot . This , of course , would mean that 100 ' frontage lots are no longer legal for a new subdivision . Mr . Aron asked if this new 200 ' circle requirement does indeed apply to both old and new construction . Mr . Fabbroni stated that this new requirement applies solely to new construction on new lots . Mr . Fabbroni stated that both he and Mr . Schwan agree with the County Health Department ' s objectives but their methods are questionable , e . g . , they would question the standards adopted as to required lot size . There continued a lengthy discussion of the new adopted Code of the Health Department , its requirements and its effect on the County and the Town of Ithaca . It was agreed that the Planning Board would like to have as much information as may be available on this new Code . ® REPORT OF COUNTY PLANNING BOARD REPRESENTATIVE Mrs . Hoffmann reported that the Minutes of the last County Planning Board meeting as mailed to the Planning Board members by Mrs . Fuller Planning Board - 3 - June 7 , 1977 cover what would be her report . She added that she feels that the Historic Preservation Inventory as proposed by that body is a pretty good idea . She thought that the Planning Board should have that kind of knowledge as to what sites may be termed " historic " when they are considering various approvals . REPORT OF THE PLANNING BOARD CHAIRMAN Mrs . Bronfenbrenner reported that the Town Board at its Special Meeting on May 23 , 1977 , approved the Ivar Jonson multi - family develop ® ment on Ellis Hollow Road behind the Elderly Housing project . PUBLIC HEARING : CONSIDERATION OF PROPOSED REZONING OF 22 . 22 ACRES FROM RESIDENCE DISTRICT R- 30 TO RESIDENCE DISTRICT R- 15 ( TAX PARCEL NO . 6 - 61 - 1 - 8 . 1 ) , SUCH LAND BEING BOUNDED ON THE WEST AND NORTH BY CORNELL UNIVERSITY LANDS , ON THE EAST BY THE TOWN OF DRYDEN , AND ON THE SOUTH BY SNYDER HILL ROAD , Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter duly opened at 7 : 56 p . m . Mrs . Bronfenbrenner read the Notice of Public Hearing as published in the Ithaca Journal on June 2 , 1977 , and presented the Clerk ' s Affidavit of Posting and Publication and the Secretary ' s Affidavit of Service by Mail of said Notice of Public Hearing upon the adjacent neighbors . Mrs . Bronfenbrenner noted that the 22 . 22 acres to be rezoned is the Hilker Subdivision on Snyder Hill Road and is served by water and sewer . The Planning Board gave final subdivision approval to this development on May 4 , 1976 , but neglected to formally institute the rezoning process , as did the Town Board at the time of such subdivision approval . Mr . Fabbroni stated that this was an oversight on the part of the Planning Board and himself at the time that this land was subdivided . At the time of the request for subdivision approval and prior to such approval the land should have gone through the rezoning process at the Planning Board level and at the Town Board level for rezoning from R- 30 to R- 15 . Mr . Fabbroni noted that it has been a long standing policy of the Town Board that lands that can be served by water and sewer should be rezoned from R- 30 to R- 15 following , of course , the proper public hearings . Mr . Fabbroni stated that he had assumed at the time that this land had been a part of the Eastern Heights rezoning since the 22 . 22 acres had been a part of the Eastern Heights area at one time . He has since determined that this land was not part of the main re - zoning when Eastern Heights was created , though the land was in the hands of Eastern Heights before Mr . Hilker purchased it . He commented that the question came up at the time of closing on the first house in the Hilker Subdivision to be sold . He noted that the lots are set out and approved at R- 15 lots and there has been provided 2 . 2 acres of parkland . Thirteen acres of parkland was given to the Town of Ithaca by Eastern Heights , Inc . thus settling the issue of the 5 acres required as part of the Eastern Heights Subdivision sections 1 and 2 and freeing this same requirement from the Hilker lands in question . Mr . Hilker then set aside 2 . 2 acres as his 10 % requirement for the 22 . 22 acres he wished to subdivide . , Planning Board - 4 - June 7 , 1977 Mr . Aron asked if this land is near Mr . Marion ' s property . Mr . Fabbroni stated that it was not near Marion ' s land at all . Mr . Fabbroni stated that the acreage in question is the last piece of land on Snyder Hill Road in the Town of Ithaca . Mr . Aron stated that he could see no reason why this land should not be rezoned . Mrs . Bronfenbrenner asked if there were any persons in the audience who wished to speak either for or against this proposed rezoning . There were none . Mrs . Bronfenbrenner stated that the Planning Board can only recom- mend on a rezoning to the Town Board . MOTION by Mr . Henry Aron , seconded by Mrs . Liese Bronfenbrenner : RESOLVED , that the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board of the Town of Ithaca approval of the rezoning of 22 . 22 acres from Residence District R- 30 to Residence District R- 15 , Tax Parcel No . 6 - 61 - 1 - 8 . 1 , such land being bounded on the West and North by Cornell University lands , on the East by the Town of Dryden , and on the South by Snyder Hill Road . There being no further discussion , the Chair called for a vote . Aye - Bronfenbrenner , Aron , May , Hoffmann , Baker , Reece . Nay - None . The MOTION was declared to be carried unanimously . Chairman Bronfenbrenner declared the Public Hearing in the Hilker Subdivision rezoning matter duly closed at 8 : 08 p . m . NEXT PLANNING BOARD MEETING It was agreed that the Planning Board will meet on June 21 , 1977 , at 7 : 30 p . m . PRESENTATION BY PLANNING BOARD MEMBER J . W . REECE Mr . Reece stated that he would still like to see the Town Planning Board get together with the County Planning Department on the proposed " beltway " , or " circumferential " , or " by-pass " , or " loop " , or whatever it may be currently called . Mrs . Bronfenbrenner stated that a Planning Board Committee should be set up to pursue that matter . Mr . Reece , Mrs . Hoffmann and Mrs . Bronfenbrenner stated that they would be happy to serve as a Committee to consult with the County Planning Department . MOTION by Mr . J . W . Reece , seconded by Mr . James Baker : • RESOLVED , that a Committee of the Town of Ithaca Planning Board to be comprised of J . W . Reece , Eva Hoffmann and Liese Bronfenbrenner set up a meeting with the County Planning Department to establish the following : Planning Board - 5 - June 7 , 1977 1 . Preferred routing of the by-pass . • 2 . Order of priority of development by segments . 3 . Joint approach to Cornell University to discuss design , location and implementation of bridge over Fall Creek . 4 . Timing of contact with the City of Ithaca to discuss the relation of the by-pass extension ' s alleviation of Route 96B ( South Aurora Street ) traffic load . By way of discussion , it was noted that South Aurora Street continues to be a very bad traffic artery . It was also noted that any wind-down around Morse Chain and on to Route 13 seems to pose very difficult problems . Mr . Reece was hopeful that there could be a way to get traffic over to Route 79 , perhaps by diverting over Columbia Street and fixing up the bridge over Giles Street . There being no further discussion , the Chair called for a vote . Aye - Bronfenbrenner , Aron , May , Hoffmann , Baker , Reece . Nay - None . The MOTION was declared to be carried unanimously . It was agreed that the " By-Pass Committee " will meet on Tuesday , • June 14 , 1977 , at 7 : 30 p . m . at Mrs . REP69T OF THE $dILDING INSPECTOR Mr ► Fabbroni reported that in the month of April he issued 16 building permits , 9 for new homes and 7 for accessory type structures , swimn►ing pools , etc . , for a total of $ 311 , 500 . 00 . This was compared to last year when 6 permits were issued for a total of $ 117 , 250 . 00 . • PUBLIC HEARING * CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR SNYDER HILL ROAD SUBDIVISION - WILLIS S . HILKER . Mrs . Holcomb declared the Public Hearing in the above-noted matter duly opened at 7 : 50 p . m . and presented the Town Clerk ' s Affida- vit of Posting and Publication . Mr . Hilker presented Engineer ' s Survey Map titled Subdivision Plat Plan , scaled and closed , of lands of Hilker Construction Co . on Snyder Hill Road , dated May 3 , 1976 , and signed by Howard R . Schlieder , RLS , Mr . Hilker stated that tax map numbers have been assigned and the square footages of each lot has been calculated . Mr . Hilker noted that Tompkins County Health Department approval has not as yet been received on the first phase - 21 lots . The total plan calls for 43 lots to be developed . Mrs . Holcomb noted that there was some discussion at the prelimi- nary hearing about drainage , specifically sub- surface drains along the Dryden Town line . Mr . Hilker stated that the sub- surface drain will be put in in phases before the lots are sold . Mr . Fabbroni stated that if this subdivision plan is to receive final approval there 'should be a stipulation that the drainage area is going to be cut off at the drainage ditch in front of homes bordering the Town of Dryden Line , Mr . Hilker commented that there may be a pro- blem because of grade . He said that he may have to cut the drainage area off across the road . He stated that he will have to discuss the matter further with Mr . Fabbroni , but there will be a balanced flow achieved . He said to the Board that it was his opinion that they will rind that a lot of water presently draining down from Dryden will be cut off . ;own of Ithaca Planning Board - 2 - May 4 , 1976 i Mr . Hilker commented further that when he constructs the rear ditch along the Town line it will stop the water from flowing through • the ground , Mr . Fabbroni stated in the final grading , they will just follow what are self -evident practices to have the water flow away from the houses . Basically , this will mean having the drainage run along the lot lines or the street . Mr . Slack asked what the Town is envisioning as the future for Snyder Hill Road . He stated that the Town better start thinking about doing something on that road in terms of condition , traffic , improve - ment , and what-have-you . He noted that there is development in the Town of Dryden also . He said that something has to be done about what goes on that hill . Mr . Christianson stated that it was his opinion that this whole question has to relate to a county-wide plan . Mr . Slack commented tha•� we have all the Towns acting independently in the meantime and so some - body has to start the ball rolling . Mr . Fabbroni spoke in terms of long-range planning . There are some severe safety hazards in the Town of Ithaca . This project could be included in a five-yeas timetable . Mr . Black commented that you get the people up there and then you finally solve the problems . Mr . Fabbroni noted that this is what has happened to Forest Home , Mrs . Eva Hoffmann asked for clarification of the subdivision plan being discussed at this Public Hearing , Mrs . Holcomb stated that this hearing is a consideration of final subdivision approval for Mr . Hilker ' s subdivision on land located in the Eastern Heights Subdivision to be developed at 43 single or two family residences . The present proposal is for Phase 1 consisting of 21 lots . Mr . Hilker noted that about 30 lots have been deleted from the original subdivision plan for Eastern Heights , Mr . Fabbroni stated that from a traffic point of view , the hazards that are attendant- to Snyder -Hill Road that we- are all familiar with are geometric problems , deep ditches , crown of road , etc . , and to a certain degree affect the traffic load that the road can take . He commented , however , that when you talk about 21 lots , you talk about minimally increasing the traffic load around 120 cars a day and in the long run ( 43 lots ) about 240 a day . i 'I Mr . Slack pointed out that nothing has been done by the Town to help out on this road yet and it has been at least five years . Mrs . Holcomb asked if there might be a motion from Mr . Slack in this regard . MOTION by Mr . Sam Slack , RESOLVED , that the Planning Board of the Town of Ithaca propose • Lnd hereby does propose that the Town Board of the Town of Ithaca seriously consider what improvements said Town of Ithaca is going to make in Snyder Hill Road before granting approval to future and further development in the - Town of Ithaca in the Snyder Hill Road ^evelopment area . Town of Ithaca Planning Board - 3 - May 4 , 1976 1 Mrs . Holcomb asked if Mr . Slack meant by this Motion that there should be no approval of this subdivision presently being heard or no further approvals after this particular development . Mr . Slack stated that he did not want to hold up a development prior to anything being done by the Town , but that he would like to see the Town do something about the Road simultaneously with this development . Mr . Black. cominented that actually what Mr . Slack wanted to see was Snyder Hill Road on the Town Board AGenda , Mr . Slack stated that he has seen many people in the ditch up there . He said that he does not think that this is a way for a Planning Board to operate . He said the Town must help people get up and down this road . Mrs . Holcomb stated that she would like Mr . Slack to tell her very specifically , prior to any resolution from this Board on Mr . Hilker ' s Subdivision , what dir- ection he is propounding , or , does he wish the Planning Board to make a strong resolution to the Town Board to improve Snyder Hill Road , Mr . Christianson stated that he thought that they are two separate issues . Mrs . Holcomb said that they are related though . Mr . Christian- son said that he agreed with Mr . Slack that something has got to be done soon with the conditions on Snyder Hill Road . He stated that a strong resolution that he would be most happy to endorse would be that prime consideration be given to the possibility of overburdening of this area . Let us consider the . Road as a prime Town function and then consider the subdivision as a natural extension of the development of the area in. order . that ( 1 ) there is no inhibiting of a sound proposal for development and ( 2 ) that there is no letting that proposal for development further compound the problem . He said that it is thus a prime consideration to consider the Road and itsimprovement . Mr . Slack stated that he must see some concurrent consideration by the Town as to development and roads ; he does not think we can justify any other sort of planning . Mrs . Brorifenbrenner commented that perhaps Mr . Slack would make his -proposal even - without - the subdivision proposal before the Board . Mr . Slack said that he certainly would . Mrs . Eva Hoffmann stated that she lives on Sugar Bush Lane and noted that there will be many more problems with increased traffic . Mrs . Holcomb stated that she would like to amend Mr . Slack ' s Motion to add a timetable for the improvement of Snyder Hill Road to guide the Planning Board in future consideration of approvals for residential areas in this neighborhood . The amended Motion was seconded by Mrs . Liese Bronfenbrenner . Mr . Pabbroni noted that this question has come up at the Town Board and at this point it is pretty much up to him ( Mr . . Fabbroni ) to come up with an over-abl picture for Town road improvements . From his own time constraints , it will be about August before there will even be a list . Hilker . Such conditional final subdivision approval is for 21 lots to be developed as Phase 1 of a total of 43 lots . The condi - E tions of this approval are : 1 . That the water and sewer system for said 21 lots shall be approved by the Tompkins County Health Department . 2 . Holcomb presented for the record the Town Clerk ' s Affidavit of Posting and Publication of said Public Hearing . f Mr . Stephen Brouwer presented a revised site plan for Longhouse Cooperative , Inc . dated April 27 , 1976 , and drawn by T . G . Miller . He noted that there is a slight plan change in that Mr . Joseph Visalli of the Tompkins County Health Dept , has required a community water supply rather than separate wells for each building as previously indicated . Mr . Brouwer stated that from their first well they will be pumping to a storage tank , and that when all the buildings ( 4 in all ) are up the Health Department would then want Longhouse to drill a second well as back-up .
