TOWN OF ITHACA PLANNING BOARD
NOVEMBER 16 , 1976
A Meeting of the Town of Ithaca Planning Board was held in Town
Hall , 126 East Seneca Street , ( second floor ) , Ithaca , N . Y . , at 7 : 30 p . m . ,
on Tuesday , November 16 , 1976 .
PRESENT : Chairman Barbara Holcomb , Richard Black , Liese
Bronfenbrenner , Lawrence P . Fabbroni ( Planning Engineer/ Building
Inspector ) .
ALSO PRESENT : Richard Leonardo , Mr . and Mrs . Thomas Bell , . Tom
Niederkorn .
At 7 : 45 Mrs . Holcomb declared that no quorum was present , therefore ,
the two Public Hearings scheduled could not be legally held .
INFORMAL DISCUSSION OF PROPOSED MODIFICATION OF LEONARDO SUBDIVISION ,
DANBY ROAD ,
Mr . Richard Leonardo was present and discussed the proposed
modification of the subdivision plan that the Planning Board approved
about four years ago . lie showed the original plan and presented the
new modified plan . He noted that all of the lots have been enlarged .
A road has been moved 60 ' to the West and two more lots have been
added between Leonardo residence and Leona Street . He said that lot
# 9 is impossible for building purposes and should be combined with lot
# 8 to make one big lot , Lots # 1 , 2 , and 3 remain the same and lots
# 4 , 5 , 6 , and 7 are changed . Leona Street has been changed and so
there is no access to the back lands . Lots # 10 and 11 have been added .
Mr . Black felt that there may be a problem with lots # 4 , 5 , 6 , and
7 with sewer . The elevation drops 10 feet . He suggested that if the
house is set high enough , it should allow for gravity flow . Mr . Leonardo
appreciated the suggestion . Mr . Leonardo said that the back lands are
really undevelopable - they run right down into the Park .
Mr . Black said that he did , not see any problems with the lots , but
was curious about the frontage on Lots # 6 and 7 . It was determined
that being on a corner , the lots would conform .
Mrs . Holcomb stated that the consensus is that Mr . Leonardo will
come back to the Board for a legal Public Hearing and that in the
meantime he will look again at lots # 8 and 9 . She noted that Mr .
Fabbroni has indicated that there is no problem with a single access
to the back land .
The Public Hearing was set for December 7 , 1976 .
INFORMAL DISCUSSION OF THOMAS G . BELL PROPOSAL FOR SELF - SERVICE GASOLINE
ISLAND AT BELL ' S CONVENIENCE FOODS , ELMIRA ROAD ,
Mr . and Mrs . Bell were present and stated that they would like to
install a two -pump self - service gasoline island at their store on Route
13 . Their plan was presented with their application for a building
permit . He said that the summer months comprise the majority of his
business . He said that they would realize a percentage of the product
sold from the oil company . He said it would be run on an inter - com
set up . He said that there will be a canopy over the top of the island

for weather . He said that there is easy access .
Mrs . Holcomb asked how many cars were originally approved for
parking ? Mr . Bell said he thought 25 , Mrs . Holcomb asked if this
proposal would impact his parking area ? Mr . Bell said it would not - -
this is separate . Mrs . Holcomb requested that at the next Hearing when
there is a quorum Mr . Bell delineate the parking .
Mrs . Holcomb asked if there is a problem with zoning ? Mr . Fabbroni
said there was no problem unless the Board knows something that he does
not . Fie stated that he has been operating under the Zoning Board of
Appeals opinion that commercial is allowed in a light industrial zone .
Mr . Bell stated that it is anticipated that they would pump
50 , 000 gallons per month from November to April , and in the summer
78 , 000 gallons per month . He stated that they are in desperate of
outside money . He stated that there would be no big sign - just
" GAS " . He commented that it will be Gulf gas .
Mrs . Holcomb requested that an opinion be sought again from the
Zoning Board of Appeals .
Mr . Black stated that he personally did not have any objection to
this proposal at all .
The Public Hearing was set for December 7 , 1976 .
INFORMAL DISCUSSION OF PROPOSED SUBDIVISION TO BE KNOWN AS DEFOREST PARK
DUBOIS ROAD ,
Mr . Tom Niederkorn was present and offered the Board a site plan
( preliminary ) for DeForest Park dated October 28 , 1976 . Mr . Niederkorn
stated that no sewer or water lines serve the area . It is zoned R- 30
residential . He noted that conventional planning just would not work
on the 97 acres of land . He said that they are proposing
it lots
of 2 - 1 / 4 acres up to 5 acres , the average being 3 - 1 / 2 acres . He
indicated a looped road which has a steep grade of about 15 % . The
project would be developed in stages . Lots 1 , 21 3 , 4 , 18 , 17 , 16 would
be on a temporary hammerhead type road ,
Mr . Black commented that it looks very nice . There followed a
lengthy discussion with the three Planning Board members and Mr . Fabbroni
making several suggestions which were very helpful to Mr . Niederkorn .
Mr . Niederkorn discussed an easement into the circle which would pro -
vide a second egress to the Niemi property for the distant future . Mr .
Niederkorn discussed an access permit for drainage ways and access to
streams .
Mr . Fabbroni wondered if in Phase 2 there would be an possibility
of coming in from Happy Lane which ends about 80 ' to 100 ' from the
boundary of Mr . VanEpps ' land . Mr . Fabbroni commented that the lower
wooded part would make a nice park area . He noted that 100 of the
total land area is about 8 acres .
• Mr . Niederkorn and the members of the Planning Board exchanged ideas
at some length and Mr . Niederkorn said he would work on these suggestions
and ideas and return to the Board in a more formal manner at a later
date .
ADJOURNMENT - - the Meeting was adjourned at 9 : 55 p . m .

Dear Barbara :
Attached hereto is a Sketch Plan for a proposed subdivision known
as DeForest Park . It is proposed that this be a large- lot sub-
division to be built in stages with the first stage being at the
western end of the parcel .
In accordance with the suggestion of the Town subdivision regulations
I would like to arrange for an informal meeting , as agent for Mr .
George VanEpps , to discuss the strengths and weaknesses of this
Sketch Plan . I will not be able to attend the regular meeting of
the Planning Board on Monday , November 1 , but would be able to meet
with you , Larry Fabbroni , and members of the Board at any con-
venient time thereafter ,
I will call Larry next week to determine what arrangements can be
made .
