Public : Syl Kacapyr Meeting Notes : Supervisor Engman called the meeting to order at 4 : 18 p . m. and opened discussion of the Town Board Agenda for the June 8th Regularly Scheduled Town Board Meeting 05/ 18/2009 Page 1 of 10 FINAL Councilman Levine asked to add information about the Recreation Partnership and what it is doing for town residents to the Town Board agenda. He said that he would forward information about this topic to the Town Clerk for inclusion in the board packet. Councilwoman Leary said that she is working on a couple of resolutions ; one would be to urge the NYS Senate to pass a marriage equality bill , as the NYS Assembly already did. Because June is Pride month, Councilwoman Leary said that she has drafted a resolution and wants to get it included in the June 8`h agenda. Councilman Stein mentioned that he is chair of an organization, the Reform Caucus , and offered to pass along a copy of its Equal Marriage Rights Resolution to Councilwoman Leary. Councilwoman Leary then discussed another resolution that she would like to have ready for the June 8`h meeting ; it concerns the US Military policy of "don ' t ask; don ' t tell ," and a soldier who was discharged because he told . She said that President Obama can issue an Executive Order to discontinue this practice, and the resolution she is crafting deals with this issue. Judy Drake asked to move item 14e, Consider approval of creation of two (2) Senior Civil Engineer positions , from the Consent Agenda to the Regular Agenda, Agenda Item No. 3 - Discuss setting a Public Hearing regarding a proposed Local Law amending Lakefront Residential Zoning Requirements and adding related definitions in Chapter 270 of the Town of Ithaca Code proposed Lakefront Residential Zone amendments. Councilman Goodman opened the discussion by saying that the board can set the dock length at 40 ' or 50 ' with compromises ; he asked board members whether or not they agree with the revisions suggested by Councilman Stein, as proposed in the handout entitled, Docks , 2/ 19/09 . He asked if the board should consider tying the dock length to a particular piece of property. Ultimately, Councilman Goodman stated that he is looking for consensus among the board members ; as this has been discussed for a very long time and it' s time to bring it to closure . Councilwoman Leary passed out information that she researched on the Web concerning draft, types of boats and sizes of boats . She said that she also spoke with an impartial expert about drafts and keels and things found on a sailboat, in order to get more educated about this issue . In her research she found that the keel provides under water stability for the sailboat and she is trying to get more allowance for depth beyond the 40 ' dock length . Councilman Levine cited docks as a convenience factor, because people would rather dock up to a dock than a mooring. He asked that board members please consider 50 ' dock length , citing that docks are not only for boats , but people who swim use them, etc ; to say that someone can only have a 50 ' dock if they have a boat is unfair. Lastly, Councilman Levine said the lake is already all built out, and asked board members to please consider a 50 ' dock length because the lake is already built up. Councilman DePaolo said that a depth provision is the way to go versus the ownership that ' s tied to the boat; have a minimum depth of 5 ' and don ' t have it contingent upon the ownership of a boat. 05/ 18/2009 Page 2 of 10 FINAL Supervisor Engman said that he favors a set length and the compromise is 40' because it is already set for 30 ' . He added that drafts range in depth from 2 . 5 ' to 7 ' ; there are also changing conditions on the lake, which alter the shore line over the course of time. Councilman Stein stated that he agrees with Councilman Levine and he does not think this compromise. will make any difference because homeowners can still go to the Zoning Board to get a variance. He added that any structure is sight pollution and that board members should be protecting the visual view of the lake . Councilwoman Hunter stated that board members represent all of the residents of the Town and they all have a right to the lake, not just lakefront residents ; the Board has not addressed that. She cited the five criteria the ZBA uses to make its decision on a variance (Summary of Area Variance Criteria from the NY Planning Federation) : 1 . whether benefit can be achieved by other means feasible to applicant ; 2 . undesirable change in neighborhood character or to nearby properties ; 3 , whether the request is substantial ; 4 . whether request will have adverse physical or environmental effects ; 5 . whether alleged difficult is self-created . Councilwoman Hunter said that she checked with the state and nothing has been appealed at the state level , except a metal dock because it was too noisy. Councilman Goodman reiterated that he is seeking consensus among board members . He said that no one can change any person ' s mind on this because everyone ' s mind is pretty much made up at this point. He asked board members to agree on doing a resolution for 40 ' , or if need be to get to the 5 ' depth for the June 81h Town Board meeting . Bruce Bates asked board members to make a decision and then determine how this will be enforced. He asked for a determination of where the stable point exists in order to determine how to measure . Councilman Goodman said that he will draft a resolution based on a maximum, 40 ' length, unless it is necessary to get to a 5 ' depth ; then go up. to a maximum of 50 ' length . He asked if this would be acceptable to the majority. Councilman Goodman ; Councilman Levine ; Councilwoman Hunter; Councilman Stein ; and Councilman DePaolo agreed with this . No changes recommended for the square footage . Councilman Goodman said that if anyone decides on another change, then it can be sent back to committee . Supervisor Engman cautioned that the board needs to be firm with its policy regarding variances ; otherwise we are going to let other boards set our policy. Additionally, because the Town of Ulysses is planning to draft its legislation based on the Town of Ithaca ' s , Supervisor Engman cautioned the board to be mindful of the effects of its decisions . Councilman Levine suggested adding a provision to the law that ties the square footage to the length of the dock. He offered the following language : going over 40 ' add "x" square feet per foot of length ; saying this offers uniform length . Councilman Levine also suggested that this way one does not have a thinner dock than the neighbor. Councilwoman Leary said that she liked that ; Councilman DePaolo agreed, based on keeping uniformity ; Councilman Goodman also agreed with the new language . With a majority in favor of this addition , 05/ 18/2009 Page 3 of 10 FINAL Supervisor Engman closed discussion on this issue and Councilman Goodman said he would draft the law . Agenda Item No. 4 = Discuss the Report of the Joint City/Town Study Group on Shared Services and Consolidation Supervisor Engman introduced this item as a very big topic , one that will require hours of discussion . He suggested opening the discussion by talking about how the board would like to discuss this . Councilman Stein stated that without a motion on the table there is nothing to decide at the moment. Supervisor Engman suggested that the board discuss this before meeting with the joint group ; Councilman Stein suggested an e-mail discussion [among board members] , recommending that the joint group meet in open session to discuss the study. Supervisor Engman posed the question again, asking board members if they want to talk more about this internally and if so Supervisor Engman advised a separate meeting just to discuss the Report . Councilman Stein asked Supervisor Engman if he wanted to schedule a meeting and Supervisor Engman responded that he had considered doing so , but people were negative to it. Councilwoman Leary stated that she objected strongly to a joint meeting. Councilman Levine suggested that if a meeting is scheduled with the city then the Town Board Members should draft an agenda. Councilman Goodman said that he does not have a problem meeting with the city and if people on this board need to meet internally, he would agree to that. He said that he presumes that this board would be asking some questions of the committee that drafted this document. Councilman Stein agreed that was the intent. Councilwoman Hunter stated that she is comfortable, whichever way . She agrees with coming together at the same time for a presentation so that everyone is receiving the information at the same time . With the time getting late , Councilman DePaolomreminded board members that he has to leave . Supervisor Engman asked board members to advance to agenda items 5 and 6 , which require a vote of the board Agenda Item No. 5 - Consider acceptance of a $ 1700 grant from Tompkins County and authorization for the Town Supervisor to enter into an agreement with Tompkins County for a project entitled , 2009 Celebrating Community on Cayuga Lake for a period "beginning April 22, 2009 and ending 30 days from the date the event has been completed, or April 22, 2010" ' Supervisor Engman introduced this item ; Councilman Stein moved and Councilman Levine seconded . Motion approved, unanimous . TB RESOLUTION NO. 2009 — 097 : ACCEPT A $ 1700 GRANT FROM TOMPKINS COUNTY AND AUTHORIZE THE TOWN SUPERVISOR TO ENTER INTO AN AGREEMENT WITH TOMPKINS COUNTY FOR A PROJECT ENTITLED, 2009 CELEBRATING COMMUNITY ON CAYUGA LAKE 05/ 18/2009 Page 4 of 10 FINAL RESOLVED , that the governing body of the Town of Ithaca hereby accepts a $ 1700 grant from Tompkins county; and FURTHER RESOLVED , the town board authorizes the Town Supervisor to enter in to an agreement with Tompkins County for a project entitled, 2009 Celebrating Community on Cayuga Lake, for a time period that begins April 22, 2009 and ends 30 days from the date the event is completed, or April 22 , 2010. Motion Carried - Unanimous . Agenda Item No. 6. Consider setting a Public Hearing regarding Safe Routes to School Supervisor Engman introduced this item. Upon a motion by Councilman Stein and seconded by Councilwoman Hunter, the item was approved unanimously . TB RESOLUTION NO. 2009= 098 : ORDER FOR PUBLIC HEARING IN THE MATTER OF THE WARREN ROAD WALKWAY CAPITAL PROJECT IN THE MATTER OF THE PROVIDING OF A PROPOSED PUBLIC IMPROVEMENT TO BE KNOWN AS THE TOWN OF ITHACA WARREN ROAD WALKWAY IN THE TOWN OF ITHACA , TOMPKINS COUNTY , NEW YORK PURSUANT TO TOWN LAW . At a Study Session Meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, held at 215 North Tioga Street, in Ithaca, New York, on the 18th day of May, 2009 , at 4 : 15 o'clock P .M . Prevailing Time. PRESENT : Supervisor Engman Councilwoman Leary Councilman Stein Councilwoman Goodman Councilman Levine Councilwoman Hunter Councilman DePaolo ABSENT : None WHEREAS , a plan, report and map has been duly prepared in such manner and in such detail as heretofore has been determined by the Town Board of the Town of Ithaca, Tompkins County, New York, relating to the creation and construction , pursuant to the Town Law of public improvements , to be known and identified as the Town of Ithaca Warren Road 05/ 18/2009 Page 5 of l0 FINAL Walkway Public Improvement, and hereinafter also referred to as " improvement" , to provide such walkway improvement to the present Town transportation system, with such walkway system improvement to be constructed and owned by the Town of Ithaca; and WHEREAS , said plan , report and map have been prepared by Daniel Walker, P.E . , the Town Engineer, a competent engineer duly licensed by the State of New York and have been filed in the office of the Town Clerk where they are available for public inspection ; and WHEREAS , the Town of Ithaca is benefitted by the said Town of Ithaca Warren Road Walkway Improvement because implementation of the Walkway is consistent with Safe Routes to School programming through the increase of bicycle, pedestrian and traffic safety throughout the Town ; walking and bicycling enhancements along Warren Road from Hanshaw Road to the Dewitt Middle School and the Northeast Elementary School are part of a long-term effort by the Town of Ithaca to provide more sustainable methods of transportation for the entire community ; and WHEREAS , the proposed Town of Ithaca Warren Road Walkway consists of improvements set forth below , and in the areas of the Town as set forth below , and as more particularly shown and described in said map, plan and report presently on file in the Office of the Town Clerk: The proposed four thousand (4 ,000+) foot walkway will be constructed of a six (6) foot wide porous pavement on a 12" gravel sub base and 6" run of crushed stone base with Granite curbing. The project also includes drainage improvements for storm water quality and flow capacity . WHEREAS , the maximum proposed cost for the walkway installation is estimated to be $624,000 ; and WHEREAS , the local amount to be expended by the Town of Ithaca for the aforesaid improvement is $ 301 ,000 with the additional $ 323 ,000 to be provided from a grant under the Federal Safe Routes to School Program. Short term capital financing (financing proposed for no longer than one year) is to be provided by the proposed issuance of a Bond Anticipation Note ("BAN") under the New York State Local Finance Law Section 23 by the Town of Ithaca for temporary financing during construction . Upon the completion of the improvement, serial bonds for the permanent financing may be authorized and issued, and the BAN will be paid off. Such financing is subject to a separate public hearing in accordance with Town Law and the New York State Local Finance Law . WHEREAS , it is now desired to call a public hearing for the purpose of considering said plan , report and map and the providing of said Town of Ithaca Warren Road Walkway Improvement, and to hear all persons interested in the subject thereof, all in accordance with the provisions of Town Law ; NOW , THEREFORE, IT IS HEREBY ORDERED , by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows : 05/ 18/2009 Page 6 of 10 FINAL Section 1 . A public hearing will be held at 215 North Tioga Street, in said Town , on the 8th day of June 2009 , at 7 : 00 o 'clock p . m. , to consider the aforesaid plan, report and map and the question of providing of said Town of Ithaca Warren Road Walkway Improvement and to hear all persons interested in the subject thereof and concerning the same and to take such action thereon as is required by law . Section 2 . The Town Clerk of the Town of Ithaca, Tompkins County, New York, is hereby authorized and directed to cause a copy of this order to be published once in The Ithaca Journal , and also to post a copy thereof on the Town signboard maintained by the Clerk, not less than ten nor more than twenty days before the day designated for the hearing as aforesaid. Section 3 . This order shall take effect immediately . The question of the adoption of the foregoing order was upon motion of Councilman Stein , seconded by Councilwoman Hunter, duly put to a vote : Supervisor Engman, aye ; Councilwoman Leary, aye ; Councilman Stein, aye ; Councilman Goodman, aye ; Councilman Levine, aye ; Councilwoman Hunter, aye ; Councilman DePaolo , aye . Motion Carried - Unanimous . The -order was thereupon duly adopted. Continued discussion — Agenda Item No. 4 Councilman Stein moved to have Supervisor Engman set up a joint committee meeting and Councilman Goodman seconded . Discussion : Councilwoman Leary said that this is premature because a joint meeting sets a framework that appears to be implementation . Councilman . DePaolo proposed an amendment to the motion , schedule a joint meeting after we have an internal meeting (contingent upon a meeting of the town board) ; Councilwoman Hunter seconded . Discussion : Councilman Stein asked for clarification ; Councilman DePaolo stated that the board can go ahead and schedule a joint meeting, but the town board members should have the opportunity to meet and discuss the Report first . Councilman Goodman asked if the board could discuss this at the June Study Session , and schedule the meeting with the city for a date in July. Councilwoman Leary said that she will be away for a week in July and also believes that setting up a meeting with the city, before a full discussion has taken place with the town board is premature . She said that the board needs to discuss this first and should progress one step at a time . Hearing no further discussion, Supervisor Engman called for a vote on the amendment. Amendment approved, unanimous . With all board members voting in favor of the motion , Supervisor Engman proceeded to the initial motion of setting up a joint meeting of the Town Board and the City of Ithaca to hear a 05/ 18/2009 Page 7 of 10 FINAL report of the Joint City/Town Study Group on Shared Services and Consolidation . The motion was approved with a vote of 4 ayes and 3 nays as follows : Supervisor Engman , no ; Councilwoman Leary, no ; Councilman Stein , aye ; Councilman Goodman , aye ; Councilman Levine, aye ; Councilwoman Hunter, no ; Councilman DePaolo , aye. Supervisor Engman announced that the board has thus far been meeting for an hour and a half and asked if the board members wished to continue with the agenda ; Councilwoman Leary announced that she had a handout with the new wording for the Board Protocol and Procedures Manual, and directed board members attention to the section heading, Section 2.07, Appointment of Boards and Committees, Subcommittees. Saying that her new language offers a compromise, Councilwoman Leary read aloud the new language she was proposing, "Subcommittees may be established by the chair, or proposed by any member of the committee and authorized by majority vote of the full committee . " Councilwoman Leary added that this compromise does not take away the prerogative of the chair to set up a subcommittee, but a subcommittee can also be set up with a majority vote of the committee . Councilwoman Leary continued reading her changes , " [T] he full committee will be briefed on any discussion by subcommittees no later than the next meeting of the full committee" Councilwoman Leary stated that this is what was already in place . Because of previous discussions about the Open Meetings Law , Councilwoman Leary stated that the board can either be silent on this or add the following paragraph : "Discussions by some or all members of a committee or other members of the Town Board whether in person or by telecommunications device, when not occurring at a regularly scheduled meeting, are not "officially convened" meetings as defined by the Open Meetings Law and are not subject to notification requirements . " Councilwoman Leary clarified this paragraph by stating that she went back and looked at the text of the Open Meetings Law , and in the definitions , meeting means the official convening of a public body . She went on to say that she thought that official convening was in there for a reason . They didn ' t mean just any old meeting, or a couple of people talking ; it has to be an official convening, and our committee structure, at the beginning of the year we draw up a regular schedule of meetings that • we adhere to , and that ' s published and posted . Councilwoman Leary went on to say, those are the regular, officially convened meetings of the Committee ; like anything else we do, in between Town Board meetings , between committee meetings , we may occasionally talk to each other, and in order to not get into the point of ridiculousness , as far as having to post any get together that we may happen to have if something comes up ; if some new development happens , this defines for us what an officially convened meeting is . Thus , if it' s on the regular schedule and it is set up , it ' s an official meeting, but if it ' s some other discussion . . . and it gets away from defining quorums and any of that kind of stuff, and it still gives us the freedom to talk to each other, but not have to worry about posting every other little thing we do . Councilwoman Leary went on to say that she thinks this is a practical definition, under the law ; it ' s not officially convened as a meeting. In summing up this additional paragraph , Councilwoman Leary said that she thinks the board should add this . Councilman Stein commented that Counsel Susan Brock would ` split a gut ' over this addition . More discussion and Supervisor Engman suggested that Councilwoman Leary offer her changes giving board members time to think about them, do their individual 05/ 18/200.9 Page 8 of 10 FINAL research and come back to the board for further discussion at another meeting. Councilwoman Leary stated that the rest of the language is the same, it is what has been talked about many times before and said this is her attempt to clarify and streamline the wording . There were too many caveats in the original manual and this is an attempt to inform the Committee about what has been happening. Councilman Stein commented that he objects to the paragraph because the town board is not in a position of interpreting the Open Meetings Law and we should not put that wording in . He said that he spoke with Susan Brock at great length about this subject, because he found it very difficult, and Susan advised that there is no question with regards to the Open Meetings Law and Case Law . Councilman Stein said that he does not think that we should be putting something in that our counsel says is a violation of the Open Meetings Law (OML) . Councilman Stein also commented about the headings in the Resolution that Councilwoman Leary prepared, saying that it would be a little easier to read if there were indentations and the word, subcommittees , doesn ' t apply to the non-committee members (last paragraph on • the first page) , making it confusing . Councilman Stein said that he objects to the second paragraph and the whole subcommittees idea, because it' s not a useful concept and is confusing. There ' s no point to subcommittees . More discussion about subcommittees ensued. Councilwoman Hunter offered that she agrees with Councilman Stein, in that the whole second paragraph should be removed. She cautioned that formalization of this digs the board in deeper and deeper with regard to regulations , and she believes that we should keep things as simple as possible . Councilwoman Leary responded that de facto, every municipality, every legislative body, makes its own interpretation of the OML. Councilwoman Hunter responded that we don ' t need to formalize it in our own Protocol and Procedures Manual . Councilwoman Leary said that perhaps we want to add this in order to clarify and perhaps other municipalities may look at this and say, "Oh , that ' s a reasonable interpretation ," but for our own purposes . . . I mean after that last conversation we had, I mean, the whole thing sounded ridiculous . The interpretation that Susan Brock brought, it just sounded impossible. If you really want to be strict about it, you cannot get anything done . This is a way of conforming to the law and making some sense out of the definition of what the law says . The OML is very clear in that it ' s not any old get together; it ' s an officially convened meeting, is what they consider a meeting and you can call the public body anything you want, you can call it a subcommittee , a committee , it doesn ' t make any difference ; it doesn ' t make any difference about the quorum . The real crucial distinction is that it is officially convened, and that ' s how , by defining what we mean , it lets us operate under the law without pretending that it doesn ' t exist, but it does set some parameters . Councilwoman Hunter responded that she has already taken an oath of office to abide by state law , and state law dictates what she should be doing; not a policies and procedures manual . She said that she would rather abide by state •law rather than reinterpret state law . Supervisor Engman reminded the board of his earlier introduction of this item and restated that the board will probably not have time to get through this , and suggested that board members think about this , do some of their own research and decide how to proceed at the next meeting . Councilwoman Leary said that she just wanted to add a comment in response 05/ 18/2009 Page 9 of 10 FINAL . to Councilwoman Hunter ' s comment, and agreed that board members take an oath to follow state law , but there wouldn ' t be this ton of case law and interpretations by Robert Freeman if state law wasn ' t subject to interpretation . What this is trying to do is interpret it in a way that allows us to function . Supervisor Engman closed discussion by adding this item to the June 8`" Town Board Agenda, unless a special meeting is scheduled to discuss the Joint Study Group . Supervisor . Engman introduced the next agenda item. Agenda Item No. 8 — Report of Town Committees Councilman Goodman passed out copies of the Trails Committee meeting notes to town board members and said the Codes and Ordinances Committee is meeting this coming Wednesday, where signs will be discussed. Judy Drake discussed an idea put forth by the Employee Relations Committee to have a picnic table placed outside, where employees would have an opportunity to go outside and eat. It would be placed in the stair well , along the Buffalo Street side of the building and is more fully discussed in the ERC meeting notes . All labor and costs are in house. Supervisor Engman asked board members to analyze how the town committees are functioning . He explained that the system has been in place for a year and a half now , and he would like board members to advise him what they would like him. to do as the Town Supervisor. Supervisor Engman offered alternative methods of discussion about this , such as retreat, board meeting, caucus , etc . and asked board members to advise what format they would like for this discussion . With no further discussion, Supervisor Engman called for a motion to go in to Executive Session to discuss the acquisition of Real Property. Upon a motion of Councilman Stein and seconded by Councilman Levine, and a unanimous vote of the board members , the board went in to Executive Session at 6 : 07 p . m. Upon a motion by Councilman Stein and seconded by Councilman Levine, and a unanimous vote of the board, the board ended its Executive Session , Supervisor Engman called for a motion to adjourn the meeting . Upon a motion by Councilman Goodman and seconded by Councilwoman Leary, the board members unanimously voted to adjourn the Study Session Meeting of the Town Board at 6 : 16 p . m.
