JANUARY 20 , 1976
The Town of Ithaca Planning Board met in the Town Offices , 126
East Seneca Street ( second floor ) , Ithaca, New York , on Tuesday ,
January 20 , 1976 , at 7 : 30 p . m .
PRESENT : Chairman Barbara Holcomb , Sam Slack , David Martin ,
Liese Bronfenbrenner , Richard Black , Lawrence Fabbroni ( Planning
Engineer/Building Inspector ) .
ALSO PRESENT : Leonard Liberman .
The Meeting was called to order by the Chair at 8 : 05 p . m .
PUBLIC HEARING : CONSIDERATION OF PRELIMINARY APPROVAL OF SITE PLAN
FOR PROPOSED BOAT CLUB FOR EAST SHORE MARINA , PARCEL NO . 6 - 19 - 2 - 291
EAST SHORE DRIVE , ( ROUTE _34 ) jOTINED BY LIBERMAN ,
The Public Hearing was declared officially open by the Chair at
8 : 05 p . m .
Mr . Fabbroni presented the Torun Clerk ' s Affidavit of Posting and
Publication of the above - noted Public Hearing in Town Hall on January
13 , 1976 , and in the Ithaca Journal on January 15 , 1976 , respectively .
Mr . Fabbroni presented the Secretary ' s Affidavit of Service by Mail
of Notice of Public Hearing to adjacent property owners , on January
13 , 1976 .
It was noted that no one appeared either in opposition to or in
support of this proposal ,
Mrs . Holcomb stated that the parcel , noted above , is in a Busi �
ness District " E " , and is a proposal to construct a Boat Club on East
Shore - Drive ,
Mr . Liberman presented a Schematic Drawing of the proposed Boat
Club drawn by Douglas Keep and dated November 1975 , The building will
be located close to the Lake edge on the East Shore Marina property .
Mrs . Bronfenbrenner asked what the function of the building will
be . Mr . Liberman stated that there is proposed a restaurant , a bar
and possibly a gift shop . Mrs . Bronfenbrenner asked where the boats
tie up . Mr . Liberman indicated on a tax map that they tie up farther
dorm towards the City end of his land . Mrs . Bronfenbrenner asked if
the proposed Boat Club will be for public use or. for club members only .
Mr . Liberman stated that he really did not know yet , whether it will be
membership plus public or all public .
Mr . Slack asked what the capacity of the slips is . Mr . Liberman
stated that there are about 80 slips now , Mr . Slack asked if there is
a launch ramp . Mr . Liberman stated that there is . Mr . Slack asked
about the facilities for sewage disposal . Mr . Liberman stated that
there will be a septic system as shown on the drawing . Mrs . Holcomb
asked what kind of land Mr . Liberman has there and if it drains well .
Liberman stated that it drains well , He said that below the clay
is gravel . The Health Department told him to dig a hole about a foot
rAep and pour water into it . He said that he dial that and at that
pont it is clay and the water stayed right in the hole . Mr . Liberman

said that he then dug deeper and at about 6 ' he hit gravel and the
water drained very well .
Mr . Slack asked if Mr . Liberman ' s land is filled land , Mr . Liber
man said that it was not . He said that it has always been there since
the Remington Salt Company was located there . He has raised it about
3 feet .
Mr . Fabbroni asked if the Health Department has given approval
for the septic field . Mr . Liberman stated that it has and presented
an approval from the Health Department for a sewage disposal system
dated June 26 , 1970 .
Mrs . Holcomb cited Section 35A of the Zoning Ordinance as followv:: o
" . . . 3 . Club House or Lodge , provided that no buildings so used
shall be within 100 feet of any street , or within 150 feet of the lot
line of an adjoining owner and only on the approval of the Board of
Appeals . "
Mr . Black asked about the water level of the Lake in that area .
Mr . Liberman stated that at the time of the flood in 1972 ( Agnes ) the
water level did not cover this proposed site . He said that the water
came about half way up the south peninsula . He noted that his was the
only Marina that was operational at that time .
Mr . Black asked how much of the land is fill . Mr . Liberman said
that this location is basically the way that it has always been , but
® that he has raised it about 3 ' in places .
Mr . Fabbroni Presented an application for sign permit from Mr .
Liberman dated January 20 , 1976 , together with a fee of $ 25 . 00 . The
requested sign reads " 1Toah ' s Boat Club " .
Mrs . Holcomb noted that a 6on gallon septic tank system was
approved by the Health Department in 1970 as noted above . Mrs . Holcomb
stated that she questioned the validity of this approval now . She saiu
that all of the D . F . C . rules have changed since then . Referring to
the area shown on the drawing named septic system , Mr . Black asked Mr .
Liberman what his plans for that area are -. Mr . Liberman stated that it
is presently to be a grassed area . Mr . Black noted that other people
who have been before this Board have found that parking is not allowed
over a septic system .
At this Point Mrs . Holcomb noted with unanimous agreement that
the Zoning Ordinance requires Business " F " approval by the Zoning Board.

a site analysis at this Public Hearing and a formal review of the sign

A discussion of the 66 ' Railroad right of way running along Route
34 followed . Mrs . Holcomb asked if part of the proposed parking lot
is in the railroad right of way . Mr . Liberman stated that it is not
® but it is within 2 ' . Mr . Liberman pointed out that he owns the fee
title to the railroad right of way .

would suggest that the Planning Board consider the proposal as a

restaurant . She notes; that 35 spaces are shown on the drawing so that
would allow for a restaurant with a capacity of 175 .
Mr . Liberman noted that there will be no new launching facilities
to speak of .
Mrs . Holcomb stated that the railroad right of way should be show:..
on the site plan ; the Health Department approval should be updated ,
Mrs . Holcomb referred now to the sign application . Mr . Liberman
stated that the requested sign is to be 20 ' x 1 ' and is to be placed
on the upper half of the proposed building . The proposed building is
64 ' long . Since the request is for only 20 sq . ft . and 64 sq . ft . would
be allowed , the sign appears to be permissible . Mr . Black asked about:
lighting for the sign . Mr . Liberman stated that there will be flood
lights shining against the building , but that he did not believe that
the sign itself will be lighted . Mr . Black asked if there will be a
sign towards the Lake . Mr . Liberman said that he did not think so .
He said that he may have a nautical flag on a mast that is colorful .
Mr . Liberman commented that with the improvement of Route 34 , the
driveway into the Marina has been improved considerably . He said
that thethroat is bigger . Mr . Pabbroni referred to the visibility on
egress from the driveways and stated that he would suggest that the
south driveway be just an entrance .
Mrs . Holcomb stated that the Planning Board report to the Zoning
Board of Appeals will include the following &
® 1 . The Railroad Right of Way should appear on the site Alan presented
by Mr . Liberman ,
2 . The Health Department approval which is dated 1970 should be
checked as to whether it is still valid .
3 . The location of the building meets the requirements of set back
rom the road and from adjacent property lines .
4 . The parking is adequate for a 175 seat restaurant and apparently is
not in the Railroad Right of Way .
5 . The service roads as shown seen to be adequate in width at the
point where they enter Route 34 .
6 . It was the suggestion of the Town Engineer because of sight dis -
tance problems that the southernmost road of the two be only an
entrance road , except in case of emergencv .
MOTION by Mr . Sam Slack , seconded by Mr . David Martino
RESOLVED , that the Planning Board of the Town of Ithaca recommend
and hereby does recommend approval by the Town Board of the sign pro-
posed for " Noah ' s Boat Club " , it being well within the limits in size
for the building on which it will be placed , i . e . , the building is
64 ' long and the sign proposed is 20 ' x 11 or 20 sq . ft .
There being no further discussion , the Chair called for a vote .

There being no further discussion , the Chair called for a vote ,

Nay - None .
The MOTION was declared to be carried unanimously .
