Call to Order : Supervisor Engman called the meeting to order at 5 : 34 p . m . , and led the
assemblage in the pledge of allegiance .
Agenda Item No. 3 = Report of Tompkins County Legislature — Mike Koplinka- Loehr
County Legislature Chairman Mike Koplinka- Loehr addressed the Town Board about issues .before
the County Legislature . He spoke about the process the county legislature is going through with
regard to the 2010 Tompkins County budget . He said that revenues in the county are down and
the legislature is looking at ways to save . He said that capital plans are being updated as well .
Agenda Item No . 4= 5 : 45 p. m . Persons to be heard and Board Comments
Board Comments = Supervisor Engman discussed the Community Garden project and noted that
an article about the Community Garden Project , with a photograph of Councilwoman Hunter,
appeared in the recent issue of the Tompkins County Weekly ( May 11 - 17 , 2009 issue , page 3) .
Supervisor Engman also announced that 25 persons have signed up for garden plots . The
Community Garden has 80 ; 20'x20 ' plots with a few 10 'x10 ' plots . Councilwoman Hunter
mentioned that the fence (deer fence with smaller holes at the bottom to deter woodchuck and
rabbit) was installed today and that planting may start by next week .
Supervisor Engman announced that all of the Ethics Disclosure forms have been filed with the
Town Clerk and they are available for public inspection in the Town Clerk' s office during business
hours .
Persons to be heard — Bill Sonnenstuhl of 206 Winston Drive and President of the Northeast
Ithaca Neighborhood Association addressed the board members about the Northeast Ithaca
Neighborhood Association saying that this organization is a new group . The first meeting held in
March had about 50 neighborhood people in attendance ; May 31St is the next scheduled meeting .
At the May 31 st meeting a variety of issues will be covered , particularly with regard to assisting
neighbors and working on ways to help some of the more senior neighbors . They are also
concerned about land use issues . They have a comprehensive plan group and they are
concerned about the "moratorium " . He said that the group wants to be part of the process and
would like its concerns addressed . They are concerned about the drainage , particularly because
the ecology in the area makes drainage difficult . Mr. Sonnenstuhl has a copy of the 1965 US
Geologic Survey and will be happy to make it available to board members . With regard to plans for

Briarwood II , the Northeast Ithaca Neighborhood Association wants to be ' part of that dialogue , in a
constructive manner, and to be considered as part of the solution . He said that the group filed a
Freedom of Information Law request last Friday in order to obtain information that should be

available to the group .
Agenda Item No . 5= Report of Fire Commissioners — written report Attachment #1
Supervisor Engman commented about the data sheets Fire Commissioner's report ; noting that
almost of half of what the Ithaca Fire Department does is not fire fighting ; they are emergency
calls . Councilwoman Hunter asked for more information about state mandated fire regulations
( EMS , etc . ) and asked for a presentation so that board members can better understand this .
Bruce Bates responded that the town is not required by any law to provide emergency medical
services . He said that a town is not directly responsible but that they can contract with a city or
village . Councilman Stein asked whether or not we should supply this service , stating that if a poll
were done the result would be that we should . Councilwoman Hunter wondered if individuals are
paying for the service and Supervisor Engman responded that it is not free to ride in an
ambulance . Councilman Stein remarked that certain communities are starting to charge for the
emergency medical services ; firefighting , etc .
Agenda Item No . 6 — 6 : 00 p . m . Public Hearing regarding a local law revising the fees for doq
licenses in Chapter 112 , titled "animals, " of the Town of Ithaca Code
Supervisor Engman opened the public hearing at 6 : 05 p . m .
With no one wishing to speak , Supervisor Engman closed the public hearing .
Agenda Item No . 6a — Consider adoption of a local law increasing dog license fees in
Chapter 112 of the Town of Ithaca Code
Upon a motion by Councilwoman Hunter and seconded by Councilman Levine , Supervisor
Engman called for a vote on the resolution .
TB RESOLUTION NO . 2009-087 : CONSIDER A LOCAL LAW REVISING THE FEES FOR DOG
LICENSES IN CHAPTER 112 , TITLED " ANIMALS , " OF THE TOWN OF ITHACA CODE
WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca fora public
hearing to be held by said Town on May 11 , 2009 -at 6 : 00 p . m . to hear all interested parties on the
proposed local law entitled "A LOCAL LAW REVISING THE FEES FOR DOG LICENSES IN
CHAPTER 112 , TITLED "ANIMALS , " OF THE TOWN OF ITHACA CODE ; " and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and
WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town
of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law , or any part thereof ;
NOW THEREFORE BE IT
RESOLVED , that the Town Board of the Town of Ithaca hereby adopts said local law entitled "A
LOCAL LAW REVISING THE FEES FOR DOG LICENSES IN CHAPTER 112 , TITLED
"ANIMALS , " a copy of which is attached hereto and made a part of this resolution ; and it is further
RESOLVED , that the Town Clerk is hereby authorized and directed to file said local law with the
Secretary of State as required by law.

Supervisor Engman closed the public hearing .
Agenda Item 7a = Consider Approval of Ithacare' s request to waive Temporary Certificate of

Construction and Fire Prevention , Sec . 125=7 (9) [21 fa-el , in order to restore the
intergenerational child care program at Longview
Supervisor Engman introduced the agenda item and. asked for a motion . Supervisor Engman
moved the agenda item and Councilman DePaolo seconded ; Supervisor Engman asked for board
comments . There followed some discussion about the nature of the issue and waiving the fees for
the TCO . Bruce Bates commented that the total permit fee was $4000 and with the TCO waiver it
would result in lost revenue of $2000 ; the TCO will expire i.n September. Bruce said that he was
hoping that someone from Longview would be at tonight's meeting to clarify this issue for the board
and could provide answers to some of his questions . He said that he is concerned about the
length of time on the permit and whether or not the owner will need another extension .
Councilman Goodman commented about Steve Williams ' (Attachment #2 ) recommendations ,
whereby he recommended that the owner apply for an extension . Susan Brock read aloud
Chapter 125 of the Town of Ithaca Code, covering what has to be done by public hearing and
stated that for this meeting the board can only waive the TCO fees . Councilman Stein mentioned
that he is uncomfortable with waiving fees , but said that he does not want to hurt a Head Start
program . Bruce Bates added that as of the 6th of this month they have their TCO and they paid the
$2000 fee . Councilman DePaolo asked if it will have to be re inspected and Bruce answered "yes . "
Councilwoman Leary commented that she does not have a problem reimbursing the $2000 and
Bruce responded that Codes will have to re inspect before they do anything and charge again for
the TCO . Susan Brock discussed criteria and read the law aloud .
Supervisor Engman referred to Steve 's original memo and his conversations with the people at
Longview. Councilman Stein said that he is inclined to vote yes , but requested that in the future a
timeline be put in place . Councilwoman Leary asked if this meets. the test of covering the cost
borne by the town , and Susan Brock responded that "you have to meet all of the criteria . " Bruce
said that he is concerned about the town 's cost (s) . Going forward , Bruce suggested that we will
now have a way to track all of this . He said that Steve has spent a lot of time with this project , not
just the temp , but the project overall . He said that he would recommend waiving the $2000 , but
tack on a fee at some point because he sees a trend here . Susan responded that you (the town
board ) can reduce the fee , and said " I recommend that you simply reduce the fee ; not waive it . "
Bruce recommended a $500 fee . Supervisor Engman responded that he does not agree that this

is the start of something that will create a cascade of " requests for waiver of fees , and he said this is
not an issue that will be repetitive because there are not many intergenerational child care centers
in the area ; he said that we should be able to waive the entire $2000 . Councilman DePaolo asked
if we can do this retroactively . Susan Brock responded that the law does not speak to this , but we
can interpret this as a reduction in the fee . She went on to say that the board can reduce the fee
to whatever it thinks is appropriate . Jon Kanter offered that the board can require performance
bonds , etc . , and outlined the importance of the TCO . Councilman DePaolo moved an amendment
to the original resolution , " under the code enforcement director's direction we reduce the fee to
$500 ; " and Councilman Stein seconded .
TB RESOLUTION NO . 2009=088a : AMEND RESOLUTION TO WAIVE TEMPORARY
CERTIFICATE OF OCCUPANCY FEES PURSUANT TO TOWN OF ITHACA CODE , CHAPTER
125 , TITLED, BUILDING CONSTRUCTION AND FIRE PREVENTION , SEC. 125=7 (9) f21 fa-el ,
IN ORDER TO RESTORE THE INTERGENERATIONAL CHILD CARE PROGRAM AT
LONGVIEW TO A REDUCTION IN TEMPORARY CERTIFICATE OF OCCUPANCY FEES
RESOLVED , that the governing body of the Town of Ithaca moves to amend the resolution to
waive the temporary certificate of occupancy fees in order to restore the intergenerational child
care program at. Longview ; and
FURTHER RESOLVED , that the governing body of the Town of Ithaca hereby motions to reduce
the temporary certificate of occupancy fees by $ 1 , 500 , with a net fee of $500 , pursuantJo Town of
Ithaca Code , Chapter 125 , Titled , Building Construction and Fire Prevention , Sec . 125 -7 (9 ) [2 ] [a-
e] , in order to issue a Temporary Certificate of Occupancy, which would ultimately allow the
restoration of the Intergenerational Child Care Program at Longview.

OF OCCUPANCY FEES PURSUANT TO TOWN OF ITHACA CODE , CHAPTER 125 , TITLED ,
BUILDING CONSTRUCTION AND FIRE PREVENTION , SEC. 125=7 (9) f21 fa-el , IN ORDER TO
RESTORE THE INTERGENERATIONAL CHILD CARE PROGRAM AT LONGVIEW
WHEREAS , a resolution was duly adopted by the Town Board " of the Town of Ithaca for a public
hearing to be held by said Town on May 11 , 2009 at 6 : 05 p . m . to hear all interested parties on the
proposed waiver of Temporary. Certificate of Occupancy fees pursuant to Town of Ithaca Code ,
Chapter 125 , Titled , Building Construction and Fire Prevention , Sec . 125 -7 (9 ) [2] [a-e] , in order to
restore the intergene rational child care program at Longview ; and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and

Supervisor Engman opened the public hearing and asked if any person would like to speak for or
against the proposed local law; hearing none , Supervisor Engman closed the public hearing .
Agenda Item No. 8 = a. Consider adoption of a local law Revising Functions, Responsibilities
and Administrative Head Provisions in Chapter 59, Titled " Public Works Department, " of the
Town of Ithaca Code
Supervisor Engman introduced the resolution and asked for someone to move the item.
Councilman Stein moved the item and Councilwoman Leary seconded . Supervisor Engman asked
if board members would like to discuss this item ; hearing none , Supervisor Engman called for a
vote ; motion approved .
TB RESOLUTION NO . 2009-089 : RESOLUTION ADOPTING " A LOCAL LAW REVISING
FUNCTIONS , RESPONSIBILITIES AND ADMINISTRATIVE HEAD PROVISIONS IN CHAPTER
59 , TITLED , " PUBLIC WORKS DEPARTMENT, " OF THE TOWN OF ITHACA CODE "
WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public
hearing to be held by said Town Board on May 11 , 2009 at 6 : 15 p . m . to hear all interested parties
on a proposed local law entitled "A LOCAL LAW REVISING FUNCTIONS , RESPONSIBILITIES
and ADMINISTRATIVE HEAD PROVISIONS IN CHAPTER 59 , TITLED , " PUBLIC WORKS
DEPARTMENT , " OF THE TOWN OF ITHACA CODE" ; and
WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and

WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town
of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law , or any part thereof ; and
WHEREAS , pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617 , it has been determined by the Town Board that
adoption of the proposed local law is a Type II action because it constitutes " routine or continuing
agency administration and management , not including new programs or major reordering of
priorities that may affect the environment , " and thus this action is not subject to review under,
SEQRA ;
NOW , THEREFORE , be it
RESOLVED , that the Town Board of the Town of Ithaca hereby adopts said local law entitled "A
LOCAL LAW REVISING FUNCTIONS , RESPONSIBILITIES and ADMINISTRATIVE HEAD
PROVISIONS IN CHAPTER 59 , TITLED , " PUBLIC WORKS DEPARTMENT , " OF THE TOWN OF
ITHACA CODE copy of which was duly submitted to this Board and is annexed hereto ; and it is
further
RESOLVED , that the Town Clerk is hereby authorized and directed to file said local law with the
Secretary of State as required by law.

Agenda Item No . 9 - Consider setting a public hearing for June 8 , 2009 regarding a
proposed Local Law extending the Northeast Moratorium
Supervisor Engman introduced the agenda item and asked for someone to move the item .
Councilman Stein moved and Councilman DePaolo seconded . Supervisor Engman invited
discussion . Board members asked questions of counsel regarding the wording of the resolution ;
board purview of certain actions , such as site plan ; and whether or not enough time was being
allocated for the extension . The following discussion took place :
Jon Kanter said that the local law as required by GML , was forwarded to the Tompkins County
Planning Dept as required , and he noted that the town has more than met the 30 day minimum
notification requirement .
Councilman DePaolo asked a question about wording in the resolution . He referred to page 2 of
the resolution under the third whereas , and then read parts of the statement . . . areas affected by the
moratorium . . . properly adopted . He explained to counsel that this is a weighty burden (on the
board ) to adopt any revisions and asked if the word "adopted" could be replaced with the word
"considered" . Susan recommended keeping the word "adopted" in the resolution . Councilman
DePaolo clarified his question by asking whether or not six months is long enough for the
extension . Supervisor Engman explained that we have had in excess of a year and a half ; he and

, Councilman Stein agreed that the time period will place some pressure on the board to get its work
done . Councilwoman Hunter asked about the word "plan" and what precisely is included in the
word , and asked if we are contemplating zoning . Susan Brock responded that. the word
"legislation" was contemplating zoning ; plans could be any type of town plan , such as open space
plans , whatever type of town plans might be deemed to be appropriate to be applied to this area .
Councilwoman Hunter expressed concerns about zoning changes and Susan responded that there
may or may not be a zoning change that would come out of it ; there could be other types of
actions . . . Councilwoman Hunter asked if such actions would require this board ' s approval and
Susan responded , " Possibly" ; she gave an example , if this board determines that conservation
easements were the best way to go and it wanted to facilitate acquisition and implementation of
those - that would be one possibility . Susan went on to say that she cannot predict what will
happen in the future , but that this local law and resolution should be sufficiently broad to cover
future actions .
Supervisor Engman called for a vote . Motion carried .
TB RESOLUTION NO . 2009-090 : CONSIDER SETTING A PUBLIC HEARING REGARDING A
LOCAL LAW EXTENDING THE MORATORIUM ON DEVELOPMENT IN THE NORTHEAST
CORNER OF THE TOWN THROUGH DECEMBER 20 . 2009
WHEREAS , the Town Board of the Town of Ithaca adopted Local Law No . 9 of the Year 2007 ,
entitled "A Local Law Providing for a Moratorium on Development in the Northeast Corner of the
Town for a Period of Two Hundred Seventy (270) Days , " which local law became effective on
September 19 , 2007 , and was due to expire on or about June 14 , 2008 ; and
WHEREAS , the Town Board thereafter adopted Local Law No . 8 of. the Year 2008 , entitled "A
Local Law Extending the Moratorium on Development in the Northeast Corner of the Town
Through December 20 , 2008 , " which local law became effective on April 17 , 2008 , and was due to
expire on December 20 , 2008 ; and
WHEREAS , the Town Board thereafter adopted Local Law No . 19 of the Year 2008 , entitled "A
Local Law Extending the Moratorium on Development in the Northeast Corner of the Town
Through June 20 , 2009, " which local law became effective on December 20 , 2008 and is due to
expire on June 20 , 2009 ; and
WHEREAS , The Town Board has undertaken the study referenced in paragraph P of Local Law
No . 9 of the Year 2007 through its consultant , LeCain Environmental Services , Inc . ("LeCain ") ; and
WHEREAS , LeCain submitted an interim report dated November 29 , 2007 , and made a
presentation on the interim report to the Town Board on December 10 , 2007 ; and
WHEREAS , LeCain has completed its study and has submitted the following three documents , all
dated September 30 , 2008 , to the Town : " Executive Summary of an Environmental Assessment of
Lands Adjacent to Sapsucker Woods , " " Final Report of an Ecological Communities Survey and
Assessment of Lands Adjacent to Sapsucker Woods , " and " Report of a Spring Survey of Birds and
Other Faunal Resources on Lands Adjacent to Sapsucker Woods ; " and
WHEREAS , LeCain discussed these written reports at the Town Board ' s October 20 , 2008
meeting . The Ecological Communities Survey report recommends the Town prioritize for
conservation the entire study area . If that is not feasible , the report recommends the areas

adjacent to Sapsucker Woods Sanctuary and areas that have moderate or higher ecological value
be prioritized for conservation . The Spring Survey of Birds and Other Faunal Resources report
recommends that the Town not permit development in the entire study area ; and
WHEREAS , after the LeCain presentation , the owner of two parcels in the study area , and a
number of residents who live near the study area , provided comments on the LeCain reports to the
Town Board at its October 20 , 2008 meeting ; and
WHEREAS , also in response to the LeCain reports , the above -described landowner in the study
area provided the Town a letter dated October 9 , 2008 , in which the representative of said
landowner disagrees with the LeCain recommendations . At the same time , the landowner
submitted numerous additional documents to the Town to consider; and
WHEREAS , on November 5 , 2008 , the above -described landowner's attorney provided the Town
with analyses of the LeCain reports from Terrestrial Environmental Specialists , Inc . and Stearns &
Wheler, LLC . The analyses by these consultants state they do not agree with the LeCain reports '
recommendations ; and
WHEREAS , the Town Board has been reviewing and analyzing , and will need additional time to
review and analyze , the LeCain reports , study area landowner analyses and other documentation ,
and comments and documentation from residents . The Town Board anticipates that its review ,
study and consideration of the LeCain reports , the analyses and other documentation from the
above -described landowner, the comments and documentation from residents , and the other
reports , plans , documents and information related to the areas affected by the moratorium can be
completed , and legislation and revisions to plans , if needed , can be drafted and properly adopted
by December 20 , 2009 ; and
WHEREAS , the Town Board is concerned that any new legislation and plan revisions would. be
significantly subverted if development proposals were to be entertained and possibly approved
before the Town Board completes1he review and study process and considers legislation and plan
revisions ; and
WHEREAS , Extension of the moratorium until December 20 , 2009 , will protect the public health ,
safety. and welfare and further the goals of the moratorium by preventing the consideration and
approval of certain types of development during the limited time the Town needs to complete such
review and study and adopt such legislation and plan revisions ;
NOW THEREFORE BE IT
. RESOLVED , that the governing body of the Town of Ithaca does hereby . set a public hearing to be
held on Monday , June 8 , 2009 at 6 : 00 p . m . , for the purpose of hearing public comment
REGARDING A LOCAL LAW EXTENDING THE MORATORIUM ON DEVELOPMENT IN THE
NORTHEAST CORNER OF THE TOWN THROUGH DECEMBER 20 , 2009 ; and
FURTHER RESOLVED , that the Town Clerk of the Town of Ithaca is hereby authorized and
directed to publish a notice of such public hearing in the Ithaca Journal published in the City of
Ithaca , Ithaca , New York , and to post a copy of same on the signboard of the Town of Ithaca , said

proposed Lakefront Residential Zone amendments — Deferred until May 18 , 2009 .
Supervisor Engman called for discussion . Councilman Goodman explained that the Codes and
Ordinances Committee discussed the proposal the Councilman Stein drafted . Ultimately, the
Codes and Ordinance Committee could not reach agreement . Councilman Goodman
recommended that a public hearing be set at the next Town Board Study Session . Discussion
ensued with regard to when the next Study Session should take place because the traditional third
Monday after the first Tuesday of the month , May 26th , is Memorial Day (observed ) and no Study
Session is scheduled for May . It was determined that the next study session will take place on
Monday , May 18th at 4 : 15 p . m . , and this item will be addressed at that meeting .

WHEREAS , this action is the revision of the capital project budget for construction of the Warren
Road Walkway primarily along the east side of Warren Road between Hanshaw and Uptown
Roads (approximately 4 , 400 feet long ) , as part of the Federal Safe Routes to Schools Grant , and
WHEREAS , the project budget has been increased since the original approval by the Town Board
on February 9 , 2009 , and
WHEREAS , the new walkway will be 6 feet wide Porous Pavement and will include the installation
of new granite curbs , the relocation of several utility poles , and the installation of a new storm
sewer system in the County road right-of-way , and is classified as an Unlisted Action for which the
Town of Ithaca Town Board is legislatively determined to act as Lead Agency in environmental
review with respect to the construction of the new walkway, and
WHEREAS , the Town Board , on , May 11 , 2009 , reviewed and accepted as adequate the Short
Environmental Assessment Form , Parts I and II for this action ;
RESOLVED , that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with the New York State Environmental Quality Review

Supervisor Engman introduced the agenda item . Councilman Stein moved and Councilman
Goodman seconded . Discussion : Supervisor Engman stated that the increase of $ 125 , 924 brings
the total project cost to $623 , 934 that the town will be reimbursed $323 , 000 of that amount from
the federal government ; $83 , 000. is the town ' s cash . Supervisor Engman went on to say that the
town will borrow the entire amount ; if we get the money back from the federal government in time ,
then we can pay ourselves back and not go out for bonding . Councilwoman Hunter asked what we
will do if we do not get the money back from the federal government . Supervisor Engman
responded that we will either do a longer term bonding or take some other action . Councilman
Stein remarked that this project has increased a lot , and said this is of concern, to him but is
balanced by doing something original and exciting . He went on to say that pervious sidewalks
have been problematic , creating problems and costs , and this measure has an up front cost that
should be balanced over time through less labor and upkeep costs . Supervisor Engman said the
payback period is fifteen ( 15 ) years , because it is more durable . With no further discussion ,
Supervisor Engman called for a vote . Motion carried .
TB RESOLUTION NO . 2009- 091b : BUDGET AMENDMENT INCREASING THE CAPITAL
PROJECT COSTS AND ESTABLISHING THE WARREN ROAD WALKWAY CAPITAL
PROJECT
WHEREAS , at the February 9 , 2009 Town Board meeting under Resolution No . 2009-048 the
Board approved and authorized the Warren Road Walkway project for the sum of $498 , 010 ; and
WHEREAS , when reviewing and designing this walkway project , the Town Engineer and Town
Highway Superintendent determined that the project will cost an additional $ 125 , 924 ; and
WHEREAS , this additional cost increase brings the total cost of the walkway project to $623 , 934
($498 ;010 plus $ 125 , 924) ; and
WHEREAS , the Town Engineer and Town Highway Superintendent directly attribute this cost
increase to ( 1 ) the use of porous pavement for the walkway is the most sustainable for the
environment , (2 ) the procurement of such porous pavement is not available under NYS contract ,
(3) in lieu of more costly drainage improvements additional drainage improvements have been
added in the final design , and (4) legal cost estimates have increased due to bond financing ; and
WHEREAS , a detail worksheet prepared by the Town Engineer is attached for the Board 's review
and discussion ; and

Board that the Warren Road Walkway capital project be increased by $ 125 , 924 ; and

Tompkins County to provide data and guidance for the development of the Agricultural and
Farmland Protection Plan ; and
Whereas , the Cornell Cooperative Extension of Tompkins County are very familiar with farming in
the Town of Ithaca , are well qualified and capable of providing the necessary assistance to the
Town of Ithaca , and they are working on similar plans for other Towns in Tompkins County; now

TB RESOLUTION NO . 2009-093 : Recognition of Significant Scenic Views and Support for
Follow- up Scenic Resources Inventory and Analysis
WHEREAS , the Scenic Resources Committee of the Town of Ithaca Conservation Board has
worked for a number of years on a study of scenic resources in the Town of Ithaca , and prepared a
report , entitled "Saving Ithaca's Views" , which identifies views that have been identified as
important in the Town of Ithaca and outlines possible strategies to protect those views ; and
WHEREAS , "Saving Ithaca ' s Views" was presented to and discussed by the Town of Ithaca Town
Board on January 7 , 2008 , and the Town Board referred said report to the Town of Ithaca Planning
Committee for its review and recommendations ; and

WHEREAS , the, Planning Committee has reviewed "Saving Ithaca's Views" , and has found this .
report to be a valuable resource to - assist the Town in developing specific scenic resource
protection strategies ; and
WHEREAS , the Planning Committee has discussed the next steps in an overall scenic resources
preservation strategy, and has recommended in a resolution dated April 9 , 2009 that the Town
Board acknowledge that the views identified in "Saving Ithaca 's Views" are among the significant
resources in the Town of Ithaca , that a more detailed inventory and analysis of scenic resources in
the Town of Ithaca be conducted by Planning staff , and that the results of the detailed inventory
and analysis of scenic resources be considered for incorporation into the Comprehensive Plan
update ; now, therefore ,
BE IT RESOLVED , that the Town of Ithaca Town Board hereby finds the following :
1 ) That the Town Board acknowledges that the views identified in "Saving Ithaca ' s Views" are
among the significant scenic resources in the Town of Ithaca , which warrant the special attention
of the Town Board , Planning Board , Zoning Board of Appeals , and other Town committees in any
decisions or actions by those boards or committees that could impact the identified views ; and
2 ) That a more detailed inventory and analysis of significant scenic views and resources in the
Town of Ithaca be conducted by the Planning staff in order to develop specific standards and
strategies for protecting the identified scenic views and resources ; and
3) That upon its completion , the detailed inventory and analysis of significant views and
resources should be considered for incorporation into the Comprehensive Plan update that is
underway , along with recommendations and specific strategies for preserving those significant
scenic views and resources .

Agenda item No. 15 — Discuss Open Meetings Law and how it pertains to Committees and
Subcommittees
Supervisor Engman stated that the Board has discussed the item in the past and the Board came
up against the issue of the Open Meetings Law and how it relates to the Board ' s Protocol and
Procedures Manual . He recalled that the Board had decided that any meeting of two or more
members of the Town Board would be considered a meeting under the Open Meetings Law and
that might then have some impact on what the Board wants to the do with the Protocol and
Procedures Manual . - Attorney Brock clarified that the Open Meetings Law applies when a quorum
of . a committee/board is present .
Councilman Stein stated that he has had extensive conversations with Attorney Brock about the
topic and commented that if what she says is true , it makes the committee system almost not
workable . He understood that as a member of the Public Works Committee he cannot have a

private conversation with a colleague who is also on the Public Works Committee . Councilman
Stein had suggested to Attorney Brock that a quorum of a committee be considered 3 members ,
but Attorney Brock assured him it was contrary to State law .
Councilman Stein then had asked Attorney Brock if he could call a fellow member of the Public
Works Committee and discuss impervious surfaces , but Attorney Brock said that he was not able
to . His concern was not one of secrecy , but one of overhead , of scheduling meetings and
advertising them .
Supervisor Engman recalled asking Mr. Freeman a question about a board member's ability to
discuss .business before the Board with another board member and Mr. Freeman said that they ,
could . Supervisor Engman was not clear why Mr. Freeman said that under that interpretation .
Attorney Brock explained that if board members are discussing business of a committee then it is
subject to Open Meetings Law. She said that Councilman Stein asked her to call Mr. Freeman and
she spoke with Mr. Freeman about the specific issues before the Board . Supervisor Engman
concluded that committees either need to ignore it and get the work done or board members . twist
themselves into knots trying to obey the law, because the law seems unworkable .
Councilwoman Leary added that Robert Freeman is not the law. He gives opinions and
Councilwoman Leary felt that his opinion shifts depending upon the moment . Attorney Brock
offered to read the Open Meetings Law to the Board . She stated that committees are considered
public bodies and wherever there is a quorum , the discussions of public business need to be done
through the procedures in the Open Meetings Law , Councilwoman Leary went on to say that
meetings are defined and she could not believe that the law was written in such a way to prohibit
public officials from even talking about something amongst themselves . She recalled Robert
Freeman saying that the law was not designed to interfere with the deliberative process .
Councilwoman Leary stated that the language in the Protocols and Procedures Manual was trying
to ensure that the full committee was updated on the progress of work between meetings . She
said that the issue that they've stumbled upon is not being able to talk to another committee
member without posting a meeting notice ; she thought this was absurd .
Attorney Brock stated that the NYS Court of Appeals has made the determination . She went on to
say that if two committee members happen to be in the same room and start talking about an issue
then the committee is holding an illegal meeting because it is not in compliance with the Open
Meetings Law. The Court of Appeals has determined that it is the entire decision making process
that the legislature intended to affect by the enactment of the statue , not the mere formal act of
voting or the formal execution of an official document .
Councilman Stein stated that he was not in a position to dispute Mr. Freeman 's reading of the
Open Meetings Law and the Court of Appeals , but it seemed to him in light of that ruling , he could
not imagine ever constituting a subcommittee . He thought the whole issue of a subcommittee to a
three person committee was moot and did not make a lot of sense to him . He suggested that the
" business about the subcommittee" was more trouble than its worth and that it should be taken out
of the Procedures Manual . Councilwoman Leary agreed and stated that the most practicable
solution would be to refer items to informal work groups . She did not intend for it to be a
description of the Board ' s obligations under the Open Meetings Law or FOIL . She said that the
point of the proposed language change was to make sure committees were updated at each
meeting regarding work done by committee members . Councilman Stein suggested that the
manual could include language stating committee members should update each other.

Councilwoman Leary volunteered to re -work the subcommittee language of the manual and bring it.-
to the study session for discussion .
Councilman DePaolo thought that it was a bigger issue because it does not absolve the Board of
its responsibility under the interpretation of the Open Meetings Law. He asked how it changed the
way the Board does business moving forward . Supervisor Engman stated that committees will
continue to post meeting dates and times ; the Board had thought that there might be an advantage
to creating subcommittees so that individual committees could get more work done , but it seemed
to be a barrier. Councilman DePaolo understood that , but the Board still had not resolved the
question of individual communication between committee members regarding committee business .
He felt it was an outstanding question needing to be addressed . Supervisor Engman responded
that exceedingly strict interpretations is what drives government to political caucuses because it is
difficult to get by without talking with other people about what the Board is trying to accomplish for
the Town .
Councilwoman Leary thought that with the safeguards were in place , such as FOIL requests . She
noted that the penalties for going against the Open Meetings Law are very loose . Attorney Brock
explained that the laws were recently tightened up—actions can be nullified and fees ( including ,
attorney fees) are recovered easier. Councilwoman Leary commented that if the aim of the Open
Meetings Law is for transparency in government and for decisions not to be made before
meetings . She said if the Board comes to meetings and holds its debates at meetings , and it
knows that final agency actions are FOILable , then that is the protection the public has . She did
not think , practically speaking , that everyone was going to refuse to talk to one another between
meetings . Supervisor Engman said he did not think that government could be done without peopl
talking with one another.
Attorney Brock explained that Board Members could email each other as long as they are not
participating in a chat room , which occurs simultaneously . She stated that there is no case law
regarding email communication , but Robert Freeman has an opinion saying that it is fine . She
clarified that the problem occurs when everyone is physically present at the same time or everyone
is on the phone together and there is a quorum . Councilman DePaolo confirmed that Board
Members could email one another, but could not correspond real -time over the Internet together.
Attorney Brock explained that corresponding by email is not considered a meeting ; she equated
emails to sending memos .
Supervisor Engman suggested that the Board ease into the email management system discussion .
Agenda Item No . 16 = Discussion of email management
Supervisor Engman stated that the Town receives email from legal counsel and he thought that
there were exemptions in the law for intra-agency communication for a certain period of time . He
asked at what point are emails made available . He noted that everyone in the State is struggling
with the issue .
Councilwoman Hunter stated that she asked for this item to be put on the agenda and explained
that her concern with email communication has nothing to do with its FOILability—it has to do wit
adhering to NYS Retention and Disposition Schedule . She said the Town has resolved to abide
this schedule so that it can avail itself to grant funding . Councilwoman Hunter noted that Board
Members receive a number of emails and the Records Management Advisory Board is discussing
the purchase of electronic records management software that would help manage email

communication . She stated that many legal communications may not be subject to FOIL , but they
do require permanent retention . Routine correspondence can require between one year and six
year retention . Councilwoman Hunter explained that the system would manage the retention of
the Town 's electronic records received via email . The Records Management Advisory Board tried
to implement an in - house system and ran into the problem of email attachments not going with the
email . She would like to be able to look at systems and she knows that the City of Ithaca and
Broome County have systems ; Tioga County is implementing a system and Tompkins County is
budgeting for a system in 2010 . Councilwoman Hunter thought that the cost of an email system
would be between $ 10 , 000 and $ 15 , 000 . She felt that it might relieve staff of a lot of email
management .
Councilman Stein did not understand what "system " meant . He explained that he has every email
that he ever wrote with his Cornell . email address ; he transfers all his email messages to a disc
annually . He asked if this is what Councilwoman Hunter meant by a system .
Ms . Carrier-Titti explained that Councilwoman Hunter was talking about an automated system .
She described it as a piece of hardware that comes with software and sits between the outside
world and the Town 's internal server; any email that comes to a Town email address would go
through the appliance . The Town can apply rules based upon the NYS Retention Schedule . She
gave the example of telling the email system to retain an email containing a specific word or
phrase for a specific period of time. Ms . Carrier-Titti added that the email system would also make
it easier to respond to a FOIL request .
Councilman Stein asked if the server was backed up all the time so that all emails were backed up .
Ms . Carrier-Titti explained that the Town uses a Microsoft Exchange Server. Email inboxes are
backed up at Midnight , but emails that are deleted between the backups cannot be restored . Ms .
Carrier-Titti would have to restore the entire mailbox . She went on to say that with the email
management system , the Town could apply rules based upon the Retention Schedule . Email
system users are not able to override how the system is setup .
Supervisor Engman stated that he was concerned about being able to use discretion . He wanted
to be able to mark emails that should not be released and stated that email is a fundamentally
different way of handling information because of the searchable function . He stated that there are
certain items that should be retained for "X" number of years at a certain point , but he wondered
how the point was determined at which the email should initially be made available for general
usage . Councilwoman Hunter did not think it was a general usage issue , but rather a requirement
for retaining documents . Staff and Town Officials come and go and the system would alleviate the
responsibility of individuals having to go through all their emails and determining the retention
schedule . She reiterated that the system should not be confused with responding for a FOIL
request .
Councilman Levine pointed out that Town Board emails are not on the Town 's server and he
wondered if that would change . Ms . Carrier-Titti explained that it would change .
Supervisor Engman asked how blunt an instrument the system was and wondered where
discretion comes into play if the system catches everything . He suggested that folders be setup
that would cause another level of review before something was made available or released .
Councilman Stein did not understand Supervisor Engman 's concern . Supervisor Engman
explained that there are certain legal matters that should not be released right a way because the

Town is still dealing with the legal issue . The system would be searchable and an email might be
shared without further review .
Ms . Carrier-Titti explained that if Susan Brock sends an email to- Supervisor Engman and Sue
Ritter, there would be two emails . However if the emails came through the email management
system , it would still be forwarded to Supervisor Engman and Ms . Ritter. Ms . Ritter could still
release the email ; the email management system does not prevent anyone from releasing
information .
Councilman Stein did not think that was the question . He gave the example of the Town receiving
a FOIL request from Adrian Williams regarding the Sapsucker Woods project and the FOIL
contained key words . The key words could have brought up other documents , in addition to the
documents being looked for in email from Councilman Stein to Attorney Brock , asking for legal
advice . He wondered if that email would automatically be dumped . into the hands of Mr. Williams .
Ms . Carrier-Titti stated that only the Records Management Officer and she would have the ability to
conduct a search . Councilwoman Hunter added that the , cautions are in place ; when Ms . Billings
receives a FOIL request she reviews any documents before they are released . Supervisor
Engman stated that he did not have a problem with the Town Clerk holding all the records ;
however he did not think. the Town Clerk had a way of knowing what negotiations were under way
that are sensitive because they have not been completed .
Councilman Goodman asked if emails could be reviewed by the person who received or wrote it to
make sure sensitive information was not included . Ms . Billings commented that she reviews the
law with regard to the list of what can and cannot be released , when she fulfills FOIL requests .
Ms . Carrier-Titti added that the emails could still be reviewed and sorted ; she emphasized that th
system stores and sorts email . It does not release email because it is done through the Records
Management Officer,
Councilman Stein expressed support for looking into an email management system and
researching the concerns expressed at the meeting . Ms . Carrier-Titti added that Ms . Billings wrote
a State Grant requesting funding to hire a consultant to conduct an overall e - records management
system .
Supervisor Engman stated that the Records Management Advisory Board was continuing to
discuss the issue and he was hopeful that there would be a recommendation from the Board as to
what should be done .
Agenda Item No . 17 - Discussion of TCCOG (Tompkins County Council of Governments)
Health Consortium Plan — Attachment #5
Supervisor Engman directed the Board 's attention to the resolution provided in the board packets .
The resolution authorizes the Town Supervisor to vote in favor of the Town 's support of the
TCCOG Health Benefits Consortium Shared Services Program .
He explained that the resolution authorizes him to vote in support of the continued planning of the
Health Benefits Consortium . Then the Town Board has to decide by July 1 st whether or not to joi
the Consortium .
Ms . Drake then provided the Board with information about the Health Consortium Plan . She stated
that the Town would save approximately $44 , 000 . Supervisor Engman said more information

would be forthcoming in June . Councilman Stein asked if there are any arguments against joining
the consortium . Supervisor Engman explained that the Town will have to negotiate with the Union
and the other municipalities will have to check with their Unions to make sure or see if there is
going to be buy- in from them .
Supervisor Engman moved and Councilman Stein seconded the proposed resolution . Attorney
Brock pointed out that the proposed resolution authorizes the Supervisor to vote on the agreement ,
but it should be authorizing the Supervisor to vote in favor of the TCCOG proposed resolution .
Supervisor Engman and Councilman Stein agreed to the change .

Update : on- line payments
Supervisor Engman announced that the Town will be accepting on - line payments for water and
sewer bills beginning in June . He explained that the customer will have to pay a 3% service

charge for using the service . Councilwoman Hunter requested a larger discussion regarding
allowing people to charge their property tax bill on credit cards .
Councilwoman Leary asked if the notices to residents had already been printed because it would
have been helpful to have the Accounting Department' s phone number and information regarding
the 3% service fee included in the notice .
Councilman DePaolo asked why the information could not have been provided with the Town
Newsletter. Supervisor Engman explained that it was a timing issue since the next newsletter is
not mailed until October ,and the on - line payment service starts in June . Councilman DePaolo
followed up by asking how much it was going to cost to mail the notices and Supervisor Engman
did not know the cost of 'mailing .
Councilman Stein asked if people could pay over the phone with a credit card . Councilwoman
Hunter responded no and Councilman Stein wondered why . Councilwoman Hunter responded
that the system was never implemented . Councilwoman Leary added that it would be beneficial
for residents to be able to make payments over the phone .
Update : Codes Reporting System

Mr. Bates directed the Board 's attention to his monthly report and explained that it contains more
information than it previously did . It provides a summary of department activities and provides a
better view of what is being done in the department . The current system limits what they can
include in the report and when looking into other systems , Mr. Bates noted that he had to be
mindful to make sure it fits into the current system .
Supervisor Engman asked if fire safety inspections and operating permit inspections could be
separated . Mr. Bates stated that it is difficult to separate fire safety and operating permit
inspections because they are somewhat the same , but two different topics . He has grouped items
together because the Palm Pilots are limited to tracking 15 categories .
Mr. Kanter updated the Town Board saying that the Planning Board hired a consultant to review
the Verizon Cell Tower application . The consultant has worked exclusively with municipalities in
reviewing applications . He noted that his report includes a description of the Bluegrass Lane
Bicycle Pedestrian Path grant application that the Planning Department recently submitted . Mr.
Kanter explained that the trail is listed in the Transportation Plan and the Park and Open Space
Plan . If the Town receives the grant , Cornell University will provide 50% of the local match
required for the grant .
Mr. Kanter explained that the County received $3 . 5 million in Stimulus Aid for the Warren Rdt
Construction project . The stimulus money frees up money for other projects to get funding through
the Transportation Improvement Program . The Transportation Council has been meeting to look
at and discuss projects that could be funded . He thought that a lot of the money would go towards
funding buses for TCAT , but it will also enable the Forest Home Traffic Calming Phase I traffic
program and the. Hanshaw Rd Walkway extension .
Councilman Stein asked how funding decisions are made . Supervisor Engman responded that th
Transportation Council makes recommendations to the State and the State determines what
projects to fund . Mr. Kanter added that the projects have to meet various state criteria .

The following is the Fire Marshal ' s report for March 2009 ,
Code Enforcement Division :
The Codes Enforcement Division received 23 complaints in the month March . "There
were 23 complaints closed out, and 25 complaints remain open for March and previous
months .
The Code Enforcement Division performed 169 inspections or re- inspections . There were
315 violations cited and 126 violations abated .
The Code Enforcement Division issued : 2 operating permits for assembly occupancies ; 8
certificates of compliance for fire and property maintenance inspections ; 2 certificates of
compliance for alternative suppression system installations ; 3 certificates of compliance
for fire alarm system installations ; and 1 certificate of compliance for sprinkler system
installation .
Fire Investigation Unit :
There were three fire investigations performed by the Fire Investigation Unit for fires that
occurred at 330 Pine Tree Red in the Town of Ithaca; 430 North Aurora St; and 228
Renwick Drive in the City of Ithaca.
Public Education :
There was on 2 Public Education events performed and 2 fire drills witnessed by the
department in March .

Thank you for taking my telephone -call and discussing Ithacare ' s desire to obtain a
partial and temporary building occupancy permit that will allow us , and Tompkins
Community Action , to restore our intergenerational child care program at Longview .
Earlier this year , in February , Longview and Tompkins Community Action discontinued
operation of our on - site childcare program to facilitate remodeling and expansion of
the childcare space as a part of Longview ' s new building expansion /addition . while
the overall building expansion project , approved by the Town , is not scheduled for
completion until October of this year , the childcare space is ready for
( re - ) occupancy and operation at the end of this month , pending a final Town codes
department inspection , approval and issuance of a partial and temporary certificate
of occupancy .
It appears that we are facing a " problem " and would appreciate your interest and
assistance , and the Town ' s flexibility , in resolving .
under Chapters 125 - 7 and 153 - 10 of the Town ' s code , in the case of our project , a
$ 2 , 000 . 00 fee is required to be paid the Town for issuance of a partial and
temporary certificate of occupancy . what ' s more , it is my understanding that this
fee would not be required if we were to wait and request an inspection and issuance
of a certificate of occupancy be granted at the conclusion of the building project .
In recognition of the many , good and charitable services offered by Ithacare and
Tompkins Community Action , among which is the significant child care service ( s ) made
available to vulnerable and low income families / residents of our community , would it
be possible for the Town to waive or excuse Longview and Tompkins Community Action
from having to pay this fee for " early occupancy " ? In so doing , the .Town would
permit us to use our limited financial resources to cover the actual human
service ( s ) needs of our clients and our community ' s residents . what ' s more , we make
this request based upon my understanding that our request , while not common place ,
does not set a new precedent . it is also my understanding that the Town has seen
fit in the past to grant this kind of relief to community organizations under
similar circumstances .

This email is to follow up on our discussion this morning regarding the TCO for the
Day Care area . Based on the inspection the following items must be addressed before
the space is ready for a TCO .
1 ) All exposed wiring , electrical and alarm system must be protected by a
junction box cover or an appropriate fixture .
2 ) The estimated occupant load is less that 50 people and the travel distance
to a grade level means of egress is less than 250 - feet , therefore a single means of
egress is adequate for this occupancy . All doors leading into unfinished construction
areas must be secured such as the opening into the corridor with the open elevator
shaft and opening onto the unfinished balcony . Access to the construction areas must
be limited to construction staff and emergency personnel .
3 ) A final electrical inspection and final plumbing inspection certificate must
be received .
4 ) The reports from the engineers monitoring compliance with the Town
stnrmrArater T ATAT have indicated that the constructi ^ n site has consistently been non -

compliant with the law . All items noted as " Needs Attention " must be addressed and
approved by your inspector and verified by the Town Engineer .
I must complete a re - inspection of the site to verify compliance with items 1 and 2
above .
With regard to the required fee for the Temporary Certificate of Occupancy , I have
reviewed Chapters 125 - 7 and 153 - 10 of the Town of Ithaca Code and confirmed that
the Town Board is the only body empowered to waive required fees . I agree that the
area to be occupied is very small in comparison with the fee that applies . I also

think that the . six -month period to complete the project attached to the issuing of a
Temporary Certificate of Occupancy is not practical on this project . Based on the
" discretionary actions " section in Chapter 125 - 7 of the Town of Ithaca Code I
recommended that the Property owner ' s make application to the Town Board to extend
the period of the TCO and to reduce or waive the required fee of $ 2 , 000 .

drainage or flooding problems?
No significant adverse effects are anticipated relating to air quality, water quality or
quantity, noise levels, traffic, solid waste, or potential for erosion, drainage, or flooding
as a result of the proposed action.
The proposed walkway installation will involve modifications to the existing stormwater
system. Currently along the road are open ditches and stormwater is allowed to sheet
flow across the grass lawns and existing pavement. As part of the walkway project,
piping will be installed (approximately 3 ,500 feet) and the open ditches will be covered
allowing the walkway to be placed on top adjacent to the road. Curbing (approximately
4,200 feet) and catch basins will also be installed along the walkway to allow the desired
placement of the walkway. within the right-of-way and to help collect stormwater. The
Town is considering using a type of porous pavement for the walkway surface and may
be installing infiltration trenches , if needed, to help. mitigate stormwater runoff. The
Town of Ithaca Engineering Department will be designing the project and will prepare a
Full Stormwater Pollution Prevention Plan (S WPPP) .
The proposed walkway will allow the pedestrians who currently use the shoulder of
Warren Road to use a safer separated walkway. The existing road shoulder will remain
as a dedicated bikeway. There are no changes planned to the existing traffic lanes . The
construction of the project will involve construction traffic involving both exporting
excavation materials and importing various construction materials . This is anticipated to
be a short term impact occurring only during the construction of the walkway.
C2 . Aesthetic, agriculture, archeological, historic, or other natural or cultural
resources , or community�ghborhood character?
None Anticipated . The development of a walkway along Warren Road is anticipated to
be a positive addition to the residential neighborhood. Warren Road in this area is
heavily used by vehicles , bicycles , and pedestrians , All three uses share the existing
pavement and is not a safe pedestrian environment, especially for the children that use

that route to school . This proposal would create a separate pedestrian walkway and allow
the shoulder of Warren to be used by the bicycles .
The project has been reviewed by the Field Services Bureau of the Office of Parks ,
Recreation and Historic Preservation (OPRHP) in accordance with the New York State
Historic Preservation Act of 1980 . Based on the review, it is OPRHP' s opinion that the
project "will have No Impact upon cultural resources in or eligible for inclusion in the
State and National Register of Historic Places" .

threatened or endangered species ?
None Anticipated. The proposed walkway would be constructed within the existing
Tompkins County road right-of-way on previously disturbed lands in an already
developed portion of the Town. The area proposed for the walkway consists primarily of
grass lawn along the shoulder of the road.

or intensity of land or other natural resources?
None Anticipated. This section of Warren Road is zoned primarily Medium Density
Residential with a small section zoned Multiple Residence at the north edge of the
project.
The Town of Ithaca Transportation Plan (adopted July 9, 2007) includes Map 11 titled
"Prioritized Pedestrian Corridor Needs" which shows Warren Road between Hanshaw
Road and the Village of Lansing boundary with the following recommendation: "Warren
Road has a shoulder that is marked for shared use by bicycles and pedestrians . If the
opportunity arises , separate bike and pedestrian facilities are warranted" .

Enforcement activity is continuing on tax parcels 26.4-2, and 26 .4 . 3 . Enforcement will proceed with a .letter
requesting compliance.
SAFE ROUTES TO SCHOOLS=WARREN ROAD WALKWAY
The Engineering staff is completing the design for the Warren Road Walkway for which the Town of Ithaca
has received a grant from the Safe Routes to Schools Program. The public information meeting on April 22,
2009 at the Northeast Elementary school was attended by about 20 residents and their questions were answered
by the staff. The consensus was positive for the. project.
HONESS LANE WALKWAY
The project was not approved for a grant under the economic stimulus program. The project design is being

BOLTON ESTATE SUBDIVISION ROAD CONSTRUCTION
The Town Engineer is providing construction management services to the Commission for the project. The
Town is being reimbursed by Bolton Point for the costs of the engineering services . Water main installation
has been completed and most of the Storm Water facilities have been installed. Construction of the Road base
is scheduled to begin in May.
WATER PROJECTS
East Shore Drive Water Main Replacement
Final Design is being completed for the replacement in the Town of Ithaca and a section of water main on
East Shore Drive in Lansing. Applications for the Highway Work Permit from NYSDOT and for work in
the Railroad ROW being completed.
SEWER PROJECTS
King Rd Sewer
DPH Transportation and Excavating has completed installation of the sewer main . Site restoration will
completed shortly.
Joint Interceptor Sewer Projects
The Town Engineering staff is continuing to work with the City of Ithaca DPW Water and Sewer Division staff
to model the sanitary sewer system and develop a detailed improvement plan. Mapping of the Town Sewers is
continuing with the assistance of the Engineering Interns .

JOINT SEWER PLANT PROJECTS
Tertiary Phosphorus Removal Upgrade
The engineer and Staff are re-considering claims made by the contractor after the meeting with the
Contractor on April 91h resulted in some questions that required input form Stearns and Wheler Engineers .
Maximum Allowable Headworks Loading Study
The Maximum Allowable Headworks Loading study agreement has been authorized the SJC and the background
chemical sampling portion of the project is underway. The study is an evaluation of the constituents of the sewagf
flow into the plant and estimate the maximum load on the plant. This information is used to evaluate the processe
of treatment at the plant and the need for pretreatment from industrial users . The study is required by DEC and is
information used in developing the criteria for the plant discharge permit.
Septage Receiving Station Improvement project
The SJC is proceeding with the engineering design for improvements and expansion of the Septage receiving
station at the IAWWTF. The plant accepts Septage for a fee from haulers that 'clean septic tanks in the County an(
some surrounding areas . Improvements in the station were included in the facility improvement plan developed b;
Stearns and Wheler.
The SJC is considering a Resolution Authorizing a Permit to Accept Hydrolysate Waste Water from Cornel
College of Veterinary Medicine to the Ithaca Area Wastewater Treatment Facility.
STORM WATER MANAGEMENT
Implementation of Stormwater Management Laws
Work on the development of a tracking report for implementation and enforcement activities required by the
new Stormwater Management Law is continuing and a detailed report will be presented to the Public Works
Committee and then the Town Board regarding administration of this program and how it impacts the
Engineering Department work load.
Northeast Ithaca Stormwater Management Plan
Public Works Department is continuing work on a comprehensive solution to the drainage problems
experiences in the Northeast area of the Town of Ithaca. The Town will be presenting a range of possible
solutions to residents of the area at a Public Meeting that will be scheduled this spring.

WESTVIEW SUBDIVISION
The Engineering staff is monitoring the sediment and erosion control program (full SWPPP) for the site .
The Phase H additional erosion control measures have been installed and are functioning .

April 21 , 2009 Planning Board Meeting:
Ithaca College Temporary Modular Offices, 320 Main Campus Road : The Planning Board
granted a request to allow a time extension to maintain the existing 10, 890 square foot modular
office facility located to the east of the Park School building on the Ithaca College campus , 320
Main Campus Road, Town of Ithaca Tax Parcel No . 41 - 1 -30. 2 , Medium Density Residential
Zone. The request is for a 9 year extension, until September 15 , 2018 , to accommodate offices
temporarily during upcoming renovations to existing buildings and construction of new facilities .
The 2004 site plan approval and special permit will expire on September 15 , 2009 . Ithaca

Route 96 Corridor Management Study : The Planning Board heard a presentation regarding
the Route 96 Corridor Management Study.
Discussion Regarding Hiring of a Consultant to Review the Verizon Application : The
Planning Board set up a selection committee (two Board members and staff) to review the
responses to the RFQ (Request for Qualifications) sent out to potential consultants .
[Subsequently, the selection committee met and will be recommending the hiring of a consultant
at the May 5 , 2009 meeting. Funds to pay the consultant are provided by the applicant pursuant
to Section 270-219 . K (4) and (5 ) of the Town of Ithaca Code. ]
Verizon Wireless Telecommunications Facility, 651 Five Mile Drive : The Planning Board
continued the public hearing regarding the proposed Verizon Wireless Telecommunications
Facility located at 651 Five Mile Drive, Town of Ithaca Tax Parcel No . 31 -2-25 .2 , Low Density
Residential Zone. The public hearing was again kept open pending the submission of additional
information requested by the Planning Board and the review of submitted materials by a
consultant (to be hired).
CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS
The following have been accomplished over the past month.
Codes and Ordinances Committee (COC) : The Committee met on April 15 , 2009 and discussed
possible further revisions to the proposed Lakefront Residential Zone amendments regarding
length of docks and a summary of public comments received on the draft Stream Setback Law.
The Committee could not agree on revisions regarding dock length and referred the matter back
to the Town Board to resolve the matter. Staff reported on the numerous comments received
regarding the Stream Setback Law, and outlined possible approaches to addressing these
comments . The next COC meeting is scheduled for May 20, 2009 . Tentative agenda items
include further review of comments received regarding the Stream Setback Law and continuation
of review of amendments to the Zoning provisions regarding fence height and setback.

Planning Committee: The Committee met on April 8 , 2009 and continued discussion regarding
possible options for the lands in the Northeast area adjacent to Sapsucker Woods as a follow-up
to the LeCain Environmental Assessment, and followed up regarding the scenic resources report
("Saving Ithaca' s Views") . The next meeting of the Committee is scheduled for Thursday, May
14, 2009 at 4 : 30 p .m. Tentative agenda items include continuation of discussion regarding the
Northeast environmental study (including the possibility of extending the moratorium),
discussion regarding a letter submitted to the Town Board from the Ithaca West Hill Community
Group (referred to the Planning Committee for discussion) , and discussion regarding Draft
Technical Report #4 of the Route 96 Corridor Management Study.
Comprehensive Plan Committee : The Committee met on April 23 , 2009 and discussed the results
of the residents ' survey, was updated on the status of the focus group meetings , and began
discussion about the process for updating the goals and objectives in the 1993 Plan. The next
meeting of the Committee is tentatively scheduled for Wednesday, May 27 , 2009 at 7 : 00 p.m.
(date of the regular meeting was changed from Thursday, May 28th) to hear a presentation by
Cornell University regarding the Campus Master Plan, East Ithaca Village studies that have been
conducted by Cornell and Cornell growth issues in general (this is tentative pending available of
Cornell representatives to attend) , continue discussion regarding results of the Residents ' Survey,
and begin review of the 1993 Plan Goals and Objectives .
Conservation Board: The next meeting of the Conservation Board is scheduled for May 7, 2009 .
The agenda includes discussion regarding Tompkins County Conservation Plan, committee reports
and updates, scheduling of a field trip regarding Swallow-wort (invasive plant), and review of 2009
Conservation Board brochure.
Route 96 Corridor Management Study: The Technical Review Committee met on April 21 , 2009
with representatives of NYS Department of Transportation (DOT) to discuss Draft Technical
Report #4. DOT supported the Study and indicated willingness to assist with implementation
strategies in the Corridor. •
ITCTC Planning Committee: The Ithaca-Tompkins County Transportation Council (ITCTC)
Planning Committee met on April 21 , 2009. The Committee approved several minor TIP
administrative actions , heard an update on projects that have been approved for Federal Stimulus
funding (Warren Road reconstruction by Tompkins County, NYS re-paving of Route 79, and the
City' s Columbia Street Pedestrian Bridge). The Town' s submission for the Honness Lane
Walkway extension did not receive Stimulus funding. Because funding of the Warren Road project
will free up approximately $3 . 5 million in the ITCTC TIP, the Planning Committee set up a sub-
committee to recommend projects (e. g. , from the long-term Stimulus funding list) that would be
priorities to receive the funds that have been freed up in the TIP. The committee also heard an
update on TCAT' s route reconfigurations . The Planning Committee will meet again on May 12,
2009 to make recommendations regarding TIP funding priorities .
Trail Committee : The Trail Committee met on April 23 , 2009 . The Committee finalized a
survey to be conducted of residents who live near existing trails to gauge perceptions and needs
regarding the trail system. The Committee also went on a field trip to walk portions of the
proposed Gateway Trail . The next meeting of the Trail Committee is tentatively scheduled for
Thursday, May 28, 2009 at 11 :00 a. m.

Blue Grass Lane Bicycle/Pedestrian Path - Grant Application: We were notified by the Ithaca-
Tompkins County Transportation Council (ITCTC) that Congressman Hinchey' s office is
accepting applications for High Priority Projects (HPP) as part of the new surface transportation
authorization legislation being considered by Congress . Upon reviewing a list of possible
transportation projects submitted by the Director of ITCTC , Congressman Hinchey ' s office
requested that the Town of Ithaca submit an application for the Blue Grass Lane
Bicycle/Pedestrian Path for this Federal funding. This proposed path would traverse Cornell
property from Hanshaw Road on the north crossing Warren Road to Pleasant Grove Road
connecting into Cornell ' s North Campus . This path is part of the proposed "Sapsucker Woods to
Cornell University Path" designated in the Town of Ithaca Park, Recreation & Open Space Plan
and is also shown as a priority path in the Town of Ithaca Transportation Plan. The project had
been submitted as a long range proposal in the Federal Stimulus funding list submitted to NYS
Department of Transportation and is also on the Cornell/Community Transportation Initiative
Program list of projects for which Cornell University has committed funding. The Planning
Department assembled an application for the HPP grant and submitted the application to
Congressman Hinchey' s office on May 1 , 2009 . The total estimated project cost is $600,000, of
which 80 percent ($480,000) would be covered by the Federal grant if awarded. The remaining
20 percent of the cost would be shared by the Town of Ithaca and Cornell University ($60,000
each), and Cornell has committed to working with the Town to provide the necessary right-of-
way for the path through Cornell property. Grant announcements will be announced upon the
authorization of the new surface transportation bill expected toward the end of 2009 (the current
transportation legislation — SAFETEA-LU — expires in September 2009) . If the Town is
successful in obtaining this grant, the necessary resolution committing to the local share will be
brought to the Town Board for approval .

Human Resources Report for April
Personnel and Employee Relations Committees :
The Personnel Committee continued discussion of the restructuring of Public Works . An
update was provided on vacant or temporary filled positions , including the search for the
Director of Public Works . Draft changes to the local law where discussed in preparation
for the April meeting . Committee also discussed the sick bank policy that came up from
ERC .
The Employee Relations committee spent most of the April meeting discussing items in
the suggestion box ( See attached notes . )
Safety Committee :
Committee reviewed another chapter of the safety manual for changes and updates .
Training and Development :
Bob Stezzi , TC3 . Biz will be providing the "Who Moved My Cheese" program from the .
book written by Spencer Johnson on two dates , Thursday, April 9th and Friday, August
7th The April 91h session was well received by the staff.
A workshop on performance management and civil service has been arranged for May
291h which is an all day program for managers and deputies , including Bolton Point. (see
attached description . )
Almost a dozen staff has signed up to take a Pre-Retirement Seminar at the Town of
Lansing on May 13th .
Personnel — Civil Service :
Seasonal positions for PWD have almost all filled . Two employees began April 131h
Most of the others will begin in May.
Highway Superintendent/Director of Public Works resumes were due in by April 201h
We received in a total of 80 resumes received . The committee selected 6 to interview,
but 1 withdrew due to the salary. Interviews were conducted April 30th and May 4th
Commercial Insurance ( Ithaca Agency — NYMIR Insurance Company) :
No new claims to report .
Workers ' Compensation ( Public Employers Risk Management Assoc — PERMA) •
No new claims to report .
Health and/or Dental Insurance :
I continue to attend the committee meeting of TCCOG on the Health Benefit
Consortium . Projected rates were received and are being evaluated and compared to
our current rates .
Disability Insurance :
No new claims to report .
