HomeMy WebLinkAboutPB Minutes 1974-09-03 • i • TOTATN OF ITHACA PLA14NING BOARD REGULAR MEETING SEPTEMBER 3 , 1974 A regular meeting of the Planning Board of the Town of Ithaca was held on September 3 , 1974 , at 7 : 30 p . m . in the Town Offices , 108 East Green St . , Ithaca , N . Y . PRESENT : Chairwoman Barbara Holcomb , Robert Scannell , Maurice Harris , Sam Slack , Jack Lowe , Daniel Baker , Lawrence Fabbroni ( Planning Engineer/ Zoning Officer ) , Reynolds Metz (Assistant Zoning Officer ) . ABSENT : Arnold Albrecht , Robert Christianson , ALSO PRESENT : Mr . Willis Hilker , Mr . Otto Schoenfeld , Mr . Stephen Brouwer , Mr . Scott Heyman , several citizens ( see attached list ) , members of the press and radio . The Chair opened the Meeting at 7 : 30 p . m . REPORT OF THE PLANNING ENGINEER 1 . Mr . Fabbroni reported that the Kennilworth Planting Strip job has been awarded to Bradley Landscaping Service , 305 Muriel St . They will be planting the plants early in October . The matter of the curbing wilt: be worked out as the job progresses . 2 . Mr . Fabbroni noted that the Consultant Report prepared by John �. MacNeil for the County Loop Road ( circumferential ) hit the newspapers much to everybody ' s surprise . The Town of Ithaca has not had an oppor - tunity to make any response to the plan , tie have seen preliminary drafts . Mr . Fabbroni pointed out some of the problem areas which are between Route 13 and Hanshaw Rd . - among others . He thought that we could express our preliminary reactions to Mr . Robert Bruce , the Town representative on the County Board of Representatives . Mr . Scannell felt that since the newspaper report was a leak we should wait until Bob Bruce or somebody really brings it to use Mrs . Holcomb stated that she was not sure if the concept of what this road is supposed to do is the same as what we have had in mind . She said that she had talked with Frank Liguori ( County Planning Commis - sioner ) this afternoon and he indicated that there will be 100 copies of the report ready by the 13th of September for distribution . REPORT OF THE ZONING OFFICER The Zoning Officer , Mr . Fabbroni , reported on the matters attended to by the Zoning Officer during the month of August . He stated that there have been a few investigations , but no- action taken because the people involved have agreed to bring the items into compliance . Mr . Reynolds Metz stated that there were 6 Building Permits issued in August 1974 -- 2 for single family homes , 1 for a garage , 1 for an extension to an existing home and 1 for an extension to the Church of the Latter Day Saints , Mr . Metz stated that the Eddydale Farms opera tion on the Elmira Road at the pull -off will be investigated . Mr . Fabbroni reported that Campbell Avenue is ready to go as soon ,a: h . .Town of Ithaca Planning Board - 2 ® September 3 , 1974 as the Town Attorney prepares the Deed . All other matters in connection with this project are taken care of . Mr . Fabbroni expressed hope that this project will be completed before the next regular meeting of the Planning Board . The Town will do the work and the road will be deeded to the Town . Williams Glen Road will be a spring project . Mr . Harris asked where the proposed zoning ordinance stands at the moment . Mr . Fabbroni stated that he was hopeful that the meeting after next will be devoted to the zoning ordinance . There followed a brief discussion of the work ahead over the next year for the Planning Board , i . e . , zoning ordinance , zoning map , sub- division regulations , park policy . 80* 00 P . M . PUBLIC HEARING : CONSIDERATION OF PROPOSAL BY WILLIS HILKER FOR CLUSTER HOUSING ON ONE -ACRE PARCEL OFF CODDINGTON ROAD The Public Hearing was declared open by the Chair and the Clerk ' s Affidavit of Posting and Publication , duly notarized , was presented for the record . Mr . Hilker presented a Letter of Intent to the Planning Board dated September 3 , 1974 , stating that the proposed 6 units are to be used as single family units for rent . ( See copy attached to the Official Minute of this Meeting ) . Mr . Hilker then presented a site plan showing the proposed two structures onhis triangular piece of land in the area of Penna . and Kendall Aves , off Coddington Rd . , containing a total of 6 two-bedroom units having 4 units in one structure and 2 units in the ® other . The units will contain 852 sq . ft . each , all on one level with no basement . The plan is dated September 3 , 1974 , and shows the Penna . Ave , right of way . There is an existing sewer line right through the proper- ty . Drainage from Ithaca College goes away from the proposed site . Mr . Scannell noted that the parking area and turnaround shown for the last structure is a bit tight . Mr . Hilker said that he could shift the building slightly . He stated that he will make any changes necessarN. to improve the turn - around situation . The right of way shown on the plan will be brought up to Town road specs by Mr . Hilker and if half the people bordering the road request it it could be deeded to the Town . Mr . Scannell stated that he could see no problem with the proposal . Mrs . Holcomb felt that each cluster proposal is a little different from the one before or the one to come . This project is intended to be held by a single company for rental . As long as it is in that status , there is no problem . If Mr . Hilker should at some time decide to sell his units then he would have to come in for an approval of his home- owners ' agreement . Mr . Scannell stated that the Planning Board should request a letter of intent to that end from Mr . Hilker , Mrs . Holcomb said that we have used some of the guidelines set up in the new proposed zoning ordinance and the plan does fall within them also . Mrs . Holcomb requested that Mr . Hilker present a contour map and landscaping plan . Mrs . Holcomb asked if there were any questions or comments from the public . There were none . MOTION by Mr . Robert Sca-nell , seconded by Mr . Maurice Harris : RESOLVED , that the Planning Board of the Town of Ithaca grant and hereby does grant preliminary approval to a cluster housing proposal presented by Hilker Construction Company , Inc . , of six ( 6 ) units on ' Town of Ithaca Planning Board m3 � September 30 1974 approximately one acre of land off Pennsylvania Avenue right of way on plan dated September 3 , 1974 . The submission for final approval will include contours , water and sewer lines , and landscaping plan . ® A brief discussion followed and Mr . Hilker asked if the final plan has to be drawn by an engineer . Mr . Fabbroni stated that it did not because Mr . Hilker could present his surveyor ' s map . There being no further discussion , the Chair called for a vote . Aye P Holcomb , Scannell , Harris , Slack , Lowe , Baker . Nay ® None . The MOTION was declared to be carried unanimously . Mr . Hilker mentioned that there could be a problem with the street name since it is the Penna . Ave . right of way . Mr . Slack stated that he would be in favor of renaming it since it will not actually connect to present Penna . Ave . The Planning Board requested that Mr . Hilker have a letter from Fire Chief Weaver stating whether or not a fire hydrant is necessary . Mr . Hilker stated that he would . 8 : 30 P . M . PUBLIC HEARING ** CONSIDERATION OF PRELIMINARY SUBDIVISION PLAN FOR OTTO SCHOENFELD IN NORTHEAST WITH TWO ALTERNATES FOR ROAD DEVELOPMENT The Public Hearing was declared open by the Chair and the Clerk ' s ® Affidavit of Posting and Publication , duly notarized , was presented for the record . Mr . Schoenfeld submitted a letter of transmittal to the Planning Board dated September 3 , 1974 . Mrs . Holcomb read the letter to the public and the Planning Board . ( See attached copy . in the Official Minutes of this Meeting ) . Mr . Schoenfeld stated that Plan " A" is essen- tially the same road alignment that appeared on the Town Road Map at the time of the Schoenfeld proposal for the Burleigh Drive Subdivision . Plan " B " is a change from what is shown on the present Official Town Map . There are the same number of lots in each one ® Mr . Schoenfeld stated that the proposed subdivision is designed to be residential in conformity with the past development of Williamsburg Park . The lots all meet the minimum requirements of the Town zoning ordinance . Mr . Schoen- feld stated that the only thing now is to be assured that the Plan that is approved will be firm so that there would be no chance of rejection if money were spent to improve the roads as decided . He also noted that no variances are needed . It is the same form of development that has previously been considered . Mrs . Holcomb asked for questions or comments from the public . Stuart Lewis , 105 WinthropDr . ** How do you proposed to have people ingress and egress into this area using these roads as far as Winthrop Dr . is concerned ? Mr . Schoenfeld : Burleigh Dr . is now being developed and a long time ago residents o Winthrop Dr . put up a lot of pressure to develop another road which is now Burliegh Dr . Also at the request of people I have lost 8 lots . I put in Uptown Dr . Now the extension of Sandra Place has been rescinded and I have to live with this problem . ' :Town of Ithaca Planning Board - 4 - September 3 , 1974 Mr . Lewis : No recommendation should be put through by this Planning Boar+lVithout a master plan for this area . This should involve the Village of Cayuga Heights , the Town of Lansing , and the Town of Ithaca . I would suggest extending Sheraton Drive , Mr . Schoenfeld : I know the appearance of a hodge-podge is a result of my having to change my plans over the years because of those very influences . Mrs . Holcomb : We are talking about the addition of 37 lots to the existing situation . The traffic problems on Winthrop exist and we are talking about 37 additional units . The present traffic that is coming from Lansing is , of necessity , using Burleigh Drive . The addition of either two or three other intersections is going to relieve the pressure on portions of Burleigh Dr . , but that in no way answers Mr . Lewis ' ques - tion because ultimately all this traffic will come into Winthrop in the Village of Cayuga Heights , Mr . Fabbroni : The approach was made to get the Village and the Towns of Lansing and Ithaca and the County to get together to develop the missing length of road to connect Uptown Rd . and Sheraton Dr . . At this time the 'pillage is not willing to concur with this proposal . David Allee , Trustde , Village of Cayuga Heights : If you can visualize a couple of things - - l . What is going to happen if you dump traffic onto Triphammer as a result of the construction at Route 13 overpass and changes of road access onto Triphammer . 2 . We have been talking with Lansing re Graham Road but I have not seer. ® any feasibility study . 3 . What is going to happen with the ring road ( circumferential ) concept 4 . The location of Chateau Claire apartments also add some questions . Until we get answers to some of these questions we are going to stand pat . Mr . Schoenfeld : A road exists already which is Uptown Dr . A point of interest is the Cinema Theatre . The distance would be the same going clockwise instead of counter-clockwise . I think what we have to decide tonight is either Plan " A " or " B " will be it . There is no difference in cost of either . I see some advantages to Plan " A " in view of the fact that the road is not going to go to the shopping center and Plan " A " relieves some of the traffic that now use the full length of Burleigh Dr . Plan " A " was thoroughly studied out over several years by the Planning Board , Roger Payne , 4 Sandra Place : I prefer Plan " B " . Road development will occur from Hanshaw Rd . past St . Catherine Church across Blackstone to Christopher Lane to Brandywine and over to Triphammer . This will en- courage a lot of non-resident traffic through Sandra P1 . and so on . Norm Scott , 144 Burleigh Dr . . The main question to me is the connection of Sandra P1 . to Burleigh Dr . Mrs . Holcomb : The only answer is that the original plan and subdivision approvaltwat was given by this Planning Board shows Sandra P1 . going through . Construction was delayed by action of the Town Board and they have not indicated whether Sandra P1 . will or will not be opened . William Scott , 145 Burleigh Dr . : We came here to discuss pros and cons Tlwn of Ithaca Planning Board - 5- September 3 , 1974 of different things . We must agree that Mr . Schoenfeld has a problem and something has to be done to make it possible for this development to go ahead . It appears to me at this point we have a future problem down on Winthrop . We have a problem of not being able to connect Uptown to Cinema Dr . I am in favor of the adoption of Plan " B " and moving ahead . Harr _Missirian , 139 Simsbury Dr . : There is one dead end street over in the Village . Why not have a dead end in the Town of Ithaca . I am concerned with the safety of the children . There may be some possibilit of channelling traffic from Lansing to the new traffic light at Trip- hammer . I would suggest that the Planning Board delay this just a little bit more in order to see what the State and County will do . Because the County and the State are working together on the traffic signalization to and from the Triphammer Shopping Center and because of the use of Sheraton Dr . I think you should wait , Mr . Fabbronie, We have not gone into this with a tunnel vision . As far as more Maginative design , I would like to hear from Mr . Schoenfeld as to the past history of this development . Mr . Schoenfelde, I operated that area as a farm for 15 years and then the government told me I could not do that - I could not put in crops , Professor Parsons on the faculty at Cornell helped me develop a fine plan . I wanted to put in a main road from Triphammer Rd . to Warren Rd . using the Gas and Electric power line . Cornell and Lansing turned us down . These imaginative plans were produced . They were very expensive . I had easements and right of ways . This was as far back as 1954 - 56 . Mrs . Holcombe, I have a statement of fact , By Law we have 45 days from this date to approve , approve with modifications , or disapprove this presentation by Mr . Schoenfeld , Mrs . Holcomb directed the following to Mr . Missiriane, Within this 45 days and with possible alternates , what do you see as the impact on present Burleigh Dr . if these additional roads are not put through? Mr . Missirian responded - Do what is done in the Village of Cayuga Heights , Mrs , Holcomb pointed out that the Town has a legal limit on the length of cul de sacs . Mr . Fabbronie, Speaking to Mr . Missirian - If the light at Triphammer is worked out ow will that affect the two plans presented here tonight ? I think it will have a further positive effect . Mr . Missirian agreed and said that yes , it will have a positive effect on the traffic situation in the area . Mr . Fabbroni continued : A traffic count was made at the first question about Burleigh Dr . and Uptown Rd . to see what the volumes were . The peak volumes were 125 cars using Burleigh Dr . coming home from work . Mr . Missirian said that these counts are not realistic because you will have a different set of habits in the future . Mrs . Holcomb showed on the map the present development in the area including Lansing with the apartments which are pretty well full . Mr . Fabbroni also indicated the through traffic as it may be accomplished . He said that with the two alternates presented Plan " B " discourages through traffic . Stuart Lewis : You people should be talking with the other municipalitie Mrs . Holcomb said that we have upon several occasions met with them , There has been no progress to date , however , we are continuing to meet , Harlin R . McEwen , Fire Chief , Village of Cayuga Heights : I live on Winthrop Dr . on the upper en towards Warren Rd . It Sandra .P1 . is opened and we encourage traffic through there I think it will be a very Town of Ithaca Planning Board6 ® September 3 , 1974 bad situation . I would support Plan " B " . Harriet Peters , 125 Burleigh Dr . : We had an apartment in Uptown Village . ® We left Uptown Village and traveled over Burleigh Dr . Uptown Rd . is in very bad condition . It should be improved which would solve a big problem . Mrs . Holcomb commented that a request was submitted by the Town to the State last November for an area speed limit between Trip- hammer and Warren north of Hanshaw . We are still waiting for an answer from the State DOT . Person from the floors The real concern is in the 37 lots and what the access and egress points would be at the top of Uptown Rd . Could we not have the roads dead end before Uptown ? It would not injure the plan .t for the development of the 37 units but it would be too long for a cul de sac . Lady from the floors you can put up all the speed limit signs you want but there is no one to enforce the laws in the Town of Ithaca . Joseph Be Perine , 328 WinthLrop Dr . s If Sandra Place is opened up I woul� move out . I thin it is encumbent upon the developer to achieve the safety of the people who will live in the development . Stuart Lewis : Would there be a possibility of a park in the area ? For bike ---Fraffic�j etc . ? Roger Payne : Sandra Place Extension is used as a bike area . If it is opened up this would be gone , Pat Ostrander , 1460 Hanshaw Rd . : The Town of Ithaca does not have an constab e . What good are speed limits , stop signs , etc . ? y Mr . Perine : Since there is no enforcement then safety is encumbent upon the developer . Harlin McEwen : There has been some discussion about law enforcement in the Town of Ithaca . The Town of Ithaca has such a difficult area to service with law enforcement . There have been discussions with the Village of Cayuga Heights . But what about the other areas such as west Hill , Honness Lane ? Mrs . Holcomb : The Northeast is essentially an entity . Then we have a pocket in Slaterville , Eastern Heights , Honness Lane . South Hill is als : another separate problem . Elmira Road and Coy Glen . Then we have West Hill . Lara K . Stanton , 2 Sandra P1 . : One traffic officer would certainly helps Even lust one . Harry Missirian0 I suggest the Town send a letter several times a year to the - residents asking them to adhere to the road signs . Mr . Scannell commented that if that is such a good idea , why doesn ' t the County do it ! . Mrs . Holcomb : As a summary I will say that there is general about the whole matter of traffic in the Northeast . There willnbera continuing effort to solve it . As for the two plans , I have heard no one opt for Plan " A " . All who have spoken have been in favor of Plan " B " . Mr . Missirian has spoken for a delay . Town of Ithaca Planning Board - 7 - September 3 , 1974 Mrs . Holcomb declared the Public Hearing closed at 10 .000 P . M . 100001 P . M . PUBLIC HEARING : CONSIDERATION OF PRELIMINARY PLAN FOR CLUS - ® TER DEVELOPMENT OF 12 UNITS ON ELM STREET EXTENSION BY BROUWER Mr . Stephen Brouwer presented a Letter of Intent to the Planning Board dated 8 / 29/ 74 and information in written form on the Longhouse Cooperative , Inc . ( See copies attached to official minutes of this meeting ) . Mr . Fabbroni stated that Longhouse Cooperative , Inc . have provided the Planning Board with all of the information we requested at the pre -i vi meeting . Their proposal complies with the present zoning ordin - ance and also the proposed zoning ordinance . Mr . Fabbroni stated that he could see no problems with the proposal . Mr . Fabbroni requested that Mr . Brouwer submit the full articles of incorporation and the by- laws . Mrs . Holcomb added that provision for payment of taxes and specia benefits should be included . Mr . Fabbroni noted that Lonqhouse has situated the proposed build - ings on wooded land . He also noted that the land is much flatter than the USGS maps show . Mr . Brouwer stated that there will be 12 units in 4 separate buildings . Each will be a separate stage of development . Mr . Fabbroni stated that this type of development is ideally suited for West Hill . Mr . Brouwer and Mr . Heyman noted that generally the occupant will be members of the corporation and pay rent to the corporation , However , the corporation could sub- let . Qestion from the floor - what about West Hill School and the over- crowding there already . Mrs . Holcomb pointed out that this proposal involves only a total of 12 units and it can never go beyond that number Availability of water on West Hill was discussed . Mrs . Holcomb pointed out that the plans are to stop Bolton Point water at South Hill , but perhaps in the future water could come from the City system which will then have enough water to serve West Hill . MOTION by Mr . Sam Slack , seconded by Mr . Robert Scannell ; RESOLVED , that the Planning Board of the Town of Ithaca grant and , hereby does grant preliminary approval to Longhouse Cooperative , Inc . of Plan dated August 25 , 1974 , for 11 , 6 acres of land off Elm Street Extension , tax parcel # 28 - 1 - 28 . 4 , for a maximum of 12 units in 4 buil - dings of 3 units each . The request for preliminary approval is on the entire site . Final approval will be requested for Site 1 which includes one building of 3 units as indicated on said plan of August 25 , 1974 , There being no further discussion , the Chair called for a vote . Aye - Holcomb , Scannell , Harris , Slack , Lowe , Baker , Nay - None , The MOTION was declared to be carried unanimously , Mr . Fabbroni indicated that the following items will be required for presentation at the time of request for final approval : 1 . Health Dept . approval for well and septic field for Site 1 . 2 . Articles of Incorporation . 3 . By-Laws of the Cooperative . 4 . Letter of Intent be modified to include the statement that you are requesting approval of this development under Article 281 of Town Law . Town of Ithaca Planning Board - 8 � September 3 , 1974 Mrs . Holcomb closed the Public Hearing at 10020 p . m . FURTHER DISCUSSION OF SCHOENFELD SUBDIVISION There was a brief discussion of a possible park area being reques ® ted from Mr . Schoenfeld out of the remaining area proposed to be deve ® loped . Mrs , Holcomb also briefly outlined the procedure ahead in this matter . If the Planning Board goes to Plan " B " , the matter must first go to the Town Board for a Public Hearing to remove the present road location of Sandra Place from the Official Map , It was agreed by all five members present that they prefer Plan " B " . MEETING DATES The next meeting of the Planning Board will be September 17 , 1974 . After that the Planning Board will probably meet next on October 8th and the 22nd . Mrs . Holcomb will make the request from the Planning Board that the Town Board at their next meeting on September 9 , 1974 , schedule a Public Hearing to discuss proposed changes on the Official Highway Map , ADJOURNMENT The Meeting was adjourned at 10035 p . m . Subject to final approval , all of the necessary rights - of - ways will be conveyed to the Town of Ithaca . At present , the sixty foot wide strip in the Town of Ithaca adjacent to the Town of Lansing is committed to public use only. Owners of the segments involved are bound by these commitments and ready to convey when required . Plan " B " is designed to discourage thru traffic to Sandra Place via an extension thru the Village of Cayuga Heights to Cinema and Sheraton Drives . However , the Village of Cayuga Heights resolved to abandon this plan thereby negating the value of Plan " B " . By owning land in common and by corporate ownership of our dwelling units which will be rented to stockholders , we plan to achieve economy in construction and maintenance as well as to create a friendly , cooperative atmosphere in which we and our children can live and work . Goldsen , Scott Heyman , and Sarah Wessels , incorporators of and share - holders of Longhouse Cooperative , Inc . , intend to build housing on 11 . 6 acres of land on Elm Street Extension in the Town of Ithaca . We intend to build 12 units of housing - - four buildings of three units each as shown in our preliminary site plane Development will occur in four stages , each build - ing of three units being one stage . Therefore , if we are granted approval of our preliminary plans , we will submit ® for final approval the plans for stage one - - the three unit building indicated at site one in the preliminary site plan . The entire development - - 11 . 6 acres of land and all buildings and facilities - - will be owned and operated by the Longhouse Cooperative , Inc . Units of housing will be leased to the members of the corporation .
