Supervisor Engman announced that Councilwoman Leary submitted a resolution requesting that the State Legislature and the Governor approve the Fair Share Tax Reform Act of 2009, and he asked the board members to approve placing this item on the agenda . TB RESOLUTION NO. 2009-052: Consider Adding "Fair Share Tax " Resolution to Acrenda RESOLVED, that the Board adds, "Consider Approval of Resolution Supporting the `Fair Share Tax Reform Act of 2009 ' in the New York State Legislature, to Improve Equity in Taxation for New Yorkers and Help Close the State 's Projected Budget Gap ': MOVED: Councilman Stein SECONDED: Councilman DePaolo VOTE: Supervisor Engman, aye; Councilwoman Leary, aye; Councilman Stein, aye; Councilman Levine, aye; Councilman DePaolo, aye; Councilwoman Hunter, aye. Agenda Item No . 3 - Report of Tompkins County Legislature Page 1 of 38 Town Board Minutes March 9 , 2009 FINAL Tompkins County Legislator Will Burbank reported on behalf of the County Legislature . He said that he was recently appointed to the Legislature ' s Planning and Human Resources Committees . Then he presented some up-to-date county budget statistics : Sales Tax gross revenues for February are down five percent from last year; room tax receipts are down 20 percent . He said that , according to County estimates , if the Governor's Budget passes the county will be down $2 . 7 million , of which $ 1 . 7 million would be for County Agencies ; the other million to local agencies . He went on to say that human needs are growing ; there is increased traffic through the local human service agencies whose mission is to deal with people in need ; the Red Cross has seen a huge increase in homeless ; more people are staying at the shelters ; more evictions ; a greater demand on Loaves and Fishes and Salvation Army and the Food Bank. He reflected that all of these needs are increasing at the same time as our (County) resources are going down . The County has increased its unemployment rate to 5 . 6% , which represents an increase of 2 . 5% from the same period last year. Will said that this is the highest January unemployment the county has seen in 1,7 years . The number of county households receiving food stamps rose by 17% from December 2007 , which is paralleling a state increase of about 14% ; in all likelihood , welfare case loads will increase later this year as unemployment levels reach the 33 week extended limit . The County fund balance will help to buttress the immediate problems , but he predicts that next year's budgeting will be difficult . He . said the Stimulus may help provide some relief because the county received the $5 million for Warren Road reconstruct ; the housing affordable study project is going forward . The joint project with the County, City , and Cornell will be putting $400 , 000 a year into affordable housing . This involves two separate projects : Planning plus a Trust Fund that will be used to create a bank of affordable housing that rolls over from owner to owner. The County will also be supporting the " Free Choice Act , " which is federal legislation that allows people to organiiz Will ended his report and asked the board members if they had any questions . Councilwoman Hunter asked what the $50 million for affordable housing will be spent on , and Will responded that he will find out and get back to her with an answer. She asked for more details about the Affordable Housing project that the county is working on with the city and Cornell . Responding for the city, Dan Cogan , City Councilor, joined in the conversation and said that it is for new construction . He said that the County, City , and Cornell would be contributing $200, 000 a year over five years in order to create a housing affordability fund , and then a committee would be making decisions on how and where to allocate the money for development . Supervisor Engman stated that developers would propose projects that would go to this funding source , and it would be a wide range of projects ( infill , rehabilitation , etc) . Supervisor Engman asked Jon Kanter if he had any comments , and he stated that there were a wide range of projects that would qualify for the funding , but there would be certain types of funding that entities would be looking at in terms of location and where services could handle them . Councilwoman Hunter asked how this would be controlled , who would authorize`the release of funds , and how will it coordinate with local government planning and zoning approvals . Supervisor Engman answered that the three partners will be naming people to a review board . Supervisor Engman stated that there will be a professional review group that will recommen to another board for final approval . All projects will have to undergo the reviews of the ea municipality . Page 2 of 38 Town Board Minutes March 9, 2009 FINAL Will Burbank stated that the goal is to create 4 , 000 units of new . housing within the next ten years . Councilwoman Hunter asked if we are stepping back from this goal in light of the current economic problems and looking at our existing housing stock and our soon to be vacated commercial real estate . She offered that it would behoove us to look at this before constructing new, built structures . Councilman Peter Stein asked if the stimulus is for additional spending . He stated it cannot be considered a source of income to the county to replace the cut backs of state governments . Burbank stated that the County did not budget for the stimulus and if it off sets a project that the County had budgeted for ( unintelligible) . Supervisor Engman added that some of the stimulus money that was given to the County for the Warren Road project will free up some other monies that were obligated ; providing revenues to fund other Town projects . Agenda Item No . 4 - Report of City of Ithaca Common Council — Dan Cogan , 5th Wd . Alderperson Dan Cogan talked about the pre -disaster mitigation plan for the Fire Department , which is the end of a seven year effort . The plan was dated September 2006 and sent to FEMA for approval , and the City just received that approval . He said by having an approved FEMA plan , we ' re now eligible for funds ; . this is on a five year approval cycle . The Ithaca Fire Department , in conjunction with the Ithaca Police Department , approved an increase to a capital project for a mobile command vehicle . This is a $450 , 000 capital item , and the City of Ithaca will be contributing $250 , 000 ; another $250 , 000 in donations were received from several offices (Triad Fdn , Sheriff 's Office , the DA's Office , and some assorted other. funds) . Next , Dan discussed the city's Youth Council by letting the board members know that the Common Council recently voted to appoint initial members to a newly reconstituted Youth Council . He described this as a student run/youth run organization that acts as a liaison between the city, the youth and the Ithaca City School District . The Youth Council ebbs & flows , gaining in the 1940 ' s , 1960 's , 1980 's and then periodically going defunct . The Council re -established it and appointed the first 11 members to the body. It' s designed to serve as an advisory body to the Common Council and provide an up close look at the democratic process ; many, of the people who have gone through Youth Council have become leaders within this community , such as Joanne Cornish . He said that two of the new members are from the Town of Ithaca : Cameron Younger and Emily Finkelstein . Dan then talked about Phase II of the Cayuga Waterfront Trail and the city' s plan to proceed . He cited controversy over the proposal to take over a lane of the Route 96 Bridge in order to make enough room to get over from the west side of the inlet to the east side of the inlet . , The New York State Department of Transportation will be taking over the effort in order to acquire the right-of-way for Phase II . He cited concerns about taking that lane off the bridge , but that the DOT concluded this is not an issue . Page 3 of 38 Town Board Minutes March 9, 2009 FINAL There was brief discussion about the Water plant . Further developments will be passed alo at a later date . The consultant is going through the 256 ( EIS ) comments raised about t environmental impact . He said that , hopefully , everything will be in place so that the Coun can make its decision by June . Supervisor Engman stated that the Commission from Bolton Point is willing to host a tour of the facility for the Common Council . The Commission is also looking at written criteria about how one becomes a partner in Bolton Point , Agenda Item No. 5 - 5 : 45 p . m . Persons to be Heard and Board Comments Councilman DePaolo stated that at the working meeting it was agreed to report on the experience in New York City . Since one of the board members is absent tonight , he asked to defer Item No . 24 until the next board meeting . The Board was in agreement with this . Councilwoman Hunter asked the Director of Planning , Jonathan Kanter, if there are certain proposed developments on West Hill where he has information that may assist the City and State . She said , as a resident of West Hill , there are issues on Route 96 ; if the Town knows something that the City does not know at this point , the Town should supply that information to be factored into any plans that the State will be working on . Director of Planning Kanter stated that there is an environmental impact statement bein prepared by the developers . When the Town receives the traffic study they can relay tl numbers to the City and any other information gathered . The City is certainly participating the Route 96 Corridor Study , but the study did not look at the down town study . It looked in t area coming down Cliff Street , but not the specific area of the bridge setup . Councilwoman Hunter asked if the Town anticipates traffic impacts overlapping onto Route 96 from the Carrowmoor Project . Director of Planning Kanter stated that there would be some overlap and that study \would need to be looked at as well . It would more directly impact Mecklenburg Road and Elm Street , but some will spill over into Route 96 as well . Councilwoman Hunter stated that the Town should share its information with the City . Agenda Item No. 7 - 6 : 00 p . m . Public Hearing regarding a Noise Permit application received from Hillel at Ithaca College for an event to be held on Wednesday, April 29 , 2009 Supervisor Engman opened the public hearing , and invited the public to address the board . Michael Faber introduced himself to the Board and stated that he is the applicant. There was a brief discussion with the board on the sound effects and how the neighbors will notified of this event . Page 4 of 38 b Town Board Minutes March 9 2009 FINAL Councilman DePaolo provided some technical advice about frequencies . Councilman DePaolo also asked if this event would be open to the entire campus . . Mr. Faber stated that it is open to the entire campus . Discussion took place with the . Board about neighborhood notification and Attorney for the Town Susan Brock stated that the notification requirements in the Town Code pertain to the notification of those who might reasonably be expected to be affected by the noise . Such persons would need to be notified of the application , so they would know that they can come and speak at the public hearing . Individual notification is needed Mr. Forbey if the event is community-wide or is a public event . Attorney for the Town Brock asked if they would be turning people away or would they let anyone who appears enter the event . Mr. Faber stated that everyone is welcome to the event . With no other persons wishing to speak , Supervisor Engman closed the public hearing . 7 a . Consider approval of application received from Hillel at Ithaca College for an event to be held on Wednesday, April 29, 2009 Councilwoman Leary offered that his event is only scheduled until 7 : 00 p . m . , thus it does not go very late . TB RESOLUTION NO. 2009-053: Resolution to approve a Noise Permit application received from Hillel at Ithaca College for an event to be held on the Ithaca College Campus on Wednesday, April 29, 2009 WHEREAS, a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held. by said Town on March 9, 2009 at 6:00 p. m. to hear all interested parties on the proposed application from Hillel at Ithaca College for a Noise Permit to allow for an event on Wednesday, April 29, 2009 from 4 p. m. to 7 p. m. to take place on the Ithaca College Quad, between the Fitness Center and the Campus Center allowing several hundred persons to participate in what the application states is, an outdoor end-of--year event for the campus and total Jewish Community to celebrate Israel Independence Day; and WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal, and WHEREAS, said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof; NOW THEREFORE BE IT RESOLVED, the governing body of the Town of Ithaca hereby approves the aforementioned application received from Hillel at Ithaca College for an event to be held on April 29, 2009 on the Ithaca College Quad. Agenda Item No . 8 - Presentation re : Stormwater Resources by Tompkins County Soil and Water District Jessica Brittany stated that she works for Tompkins County Soil & Water, and she is here on behalf of the Tompkins County Stormwater Coalition to deliver to the Town of Ithaca its official stormwater tool box . She described the tool box as educational materials to help the public get through the DEC permit process and understand stormwater. She explained that stormwater is rain water or melting snow that does not soak into the ground ; the excess water runs off into the waterways . Stormwater is a natural part of the hydrologic . cycle , when you start developing and changing the landscape you can increase the amount of stormwater run -off that occurs there to 45 percent depending on the land use . It is a water quality concern because stormwater can actually pick up toxic chemicals from vehicles (salt , animal waste , sediments , etc) , and carry it to lake streams and other natural areas . She provided background regarding the history of the federal and state regulations that lead to the Clean Water Act . Ms . Brittan explained that under the Clean Water Act , there were many studies showing that urban run was actually toxic to the environment . She went on to say that if the public has questions on filing for a permit , they can come use the tool box for information , and everything they need to know about the program is in the box . The New York State Standards for Erosion and Sediment Control is in the box and describes the standards for control . The Town of Ithaca checklist is also included in this box for . the public to tell what the requirements are . There would be someone in charge of the box , and in the box is packet for notice of intent that a landowner would need to fill out . There is also an instructional manual to help them know what they would need to do to meet the requirements of the permit . This provides one stop shopping for a single family home . When you get into the subdivisions , they would have to work with the engineering department on further plans . This box also has other educational information on stormwater and highway drainage with a copy of the DEC requirements in there . Supervisor Engman stated that the Town is in an EPA Board District and we need to do other things regarding stormwater run off . He asked if the Town needs to do anything with the Soil and Water Conservation District . Ms . Brittany stated that any time the Town has questions they can call for further information . There is more expertise in the office . Agenda Item No . 9 - Consider resolution dedicating the Eastern Heights Pa Playground as the Donald J . Ten Kate Memorial Page 6 of 38 Town Board Minutes March 9 , 2009 FINAL TB RESOLUTION NO. 2009-054: RESOLUTION TO NAME THE PLAY AREA AT EASTERN HEIGHTS PARKAS THE "DONALD J. TEN KATE MEMORIAL PLAYGROUND " WHEREAS, Donald Ten Kate started his career with the Town of Ithaca as a Parks and Open Space Foreman for the Parks Department on July 7, 1986, where he provided his expertise and talents to the Town continuously until he passed away on January 6, 2009, and WHEREAS, during Don 's over twenty-two years of service with the Town he saw changes such as Parks becoming part of the Public Works Department, which gave Don, as a Working Supervisor, the opportunity to provide oversight to a crew of employees working on a variety of highway, water, sewer, or parks projects; . and WHEREAS, Don led crews in building and maintaining many of the parks, trails, and play structures available to residents; and WHEREAS, Don showed his professionalism, courteousness and helpful nature while talking with the Town residents and working with his fellow employees; and WHEREAS, Don 's years of devotion and dedication to the Town will be remembered for years by the Town and staff; and WHEREAS, the Town of Ithaca has greatly benefited from Don 's contributions and desire to serve our community for the benefit of the Town and its citizens; and WHEREAS, Don 's family, friends and co- workers established a memorial fund with the Town to commemorate Don; and WHEREAS, the Operations Committee reviewed a plan to create a garden and seating area at the location of the newly installed play area at Eastern Heights Park and recommends the naming of this installation as the " Donald J. Ten Kate Memorial Playground';• NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Ithaca hereby names the play area at Eastern Heights Park the, "Donald J. Ten Kate Memorial Playground. Agenda Item No. 10 - Consider Appointment of two Local Advisory Board of Assessment Review members and alternate member Page 7 of 38 Town Board Minutes March 9 , 2009 FINAL TB RESOLUTION NO. 2009-055: Appointments to Local AdvisorV Board of Assessme Review WHEREAS, the Town of Ithaca Local Advisory Board of Assessment Review will hold their review proceedings in May 2009, date TBA, at Ithaca Town Hall, 215 North Tioga Street, Ithaca, New York; and WHEREAS; it is necessary that the Town Board of the Town of Ithaca appoint two representatives to attend the said proceedings; NOW THEREFORE BE IT RESOLVED, the Town Board of the Town of Ithaca hereby appoints Patricia. Leary and Eric Levine to serve on the Local Advisory Board of Assessment Review; and FURTHER RESOLVED, the Town Board of the Town of Ithaca appoints Bill Goodman to serve as Alternate Representative; and FURTHER RESOLVED, the Town Clerk is hereby authorized and directed to forward a certified copy of this resolution to the Tompkins County Assessment Department. Agenda Item No . 11 - Consider setting a Public Hearing for Monday, April 13 , 2009 at p. m . , re : a proposed Local Law Amending Lakefront Residential Zoning Requirements and Adding Related Definitions in Chapter 270 of the Town of Ithaca Code proposed Lakefront Residential Zone amendments TB RESOLUTION NO , 2009-056 : Consider Setting Public Hearing Regarding Proposed Local Law Amending Lakefront Residential Zoning Requirements and Adding Related Definitions in Chapter 270 of the Town of Ithaca Code *''Note: This resolution was changed through TB Resolution No. 2009-060 BE IT RESOLVED that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall, 215 North Tioga Street, Ithaca, New York on the 13th day of April 2009, at 6.00 p. m. for the purpose of considering a proposed local law amending Lakefront Residenti Zoning requirements and adding related definitions in Chapter 270 of the Town of Ithaca Co and it is further Page 8 of 38 Town Board Minutes March 9 , 2009 FINAL RESOLVED, that at such time and place all persons interested in the proposed local law may be heard concerning the same; and it is further RESOLVED, that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal published in the City of Ithaca, Ithaca, New York, and to post a copy of same on the signboard of the Town of Ithaca, said publication and posting to occur not less than ten days before the day designated above for the public hearing. Agenda Item No . 12 = Consider 2008 Budget Transfers and Amendments Supervisor Engman introduced this item and stated that Al Carvill , the Town Budget Officer, has the documents available in his office for review. Councilwoman Hunter said that in the future she would like to see these budget modifications and have them attached and not have to come into the office to look at them . Supervisor Engman responded that he had a conversation with Mr. Carvill and he said that it would be a big copy project . They are available and people can come in to look at them , but they are gigantic in terms of the amount of paper. The year end report is filed with the Town Clerk' s office . Councilman Stein asked if this was for discretionary or is a bookkeeping matter. Supervisor Engman stated that this is a bookkeeping matter. With no further comments he called for a vote . TB RESOLUTION NO. 2009=057. CLOSED 2008 ACCOUNTING AND FINANCIAL RECORDS CLOSED FOR THE YEAR ENDING DECEMBER 31 , 200 WHEREAS, The Town Budget Officer is reporting to the Town Board that the accounting and financial records for the Town of Ithaca have been successfully closed for the year ending December 31 , 2008; and WHEREAS, As part of the year end financial record closing process the Town Budget Officer recorded any necessary under and over budgeted revenue and appropriations for the total operating year ending December 31 , 2008; and Page 9 of 38 Town Board Minutes March 9, 2009 FINAL WHEREAS, The Town Budget Officer is acknowledging with the Town Board that the 20 financial records are officially closed and the 2009 budgetary, accounting and financial recor of the Town are open for the fiscal year beginning January 1 , 2009; and WHEREAS, All year end accounting and financial records are available for review; NOW THEREFORE BE IT RESOLVED, The Town Board acknowledges that the Town Budget Officer has reported that the financial records of the Town of Ithaca are officially closed for the fiscal year ending December 31 , 2008, MOVED: Councilman Stein SECONDED: Councilman Levine VOTE. Agenda Item No . 13 - Consider setting a public hearing for Monday, April 13 , 2009 at . m . to hear public comment relative to a Noise Permit application submitted b Ithaca College for approval to hold six 6 separate events occurrin between April 1 2009 and May 17, 2009 on the Ithaca College Campus Supervisor Engman stated that this is the first application received of the Town ' s new system of batching 6 applications . This will save Ithaca College money as well as anyone else that does multiple events . It will also save the Town money. Councilwoman Leary stated that the applicants are notifying the neighborhood associations in the area for the times , which is a good idea . Councilman Stein asked if these events are open to the public . Supervisor Engman replied that some are for the senior class , and he suspects that the general public would not be interested . Councilman Stein stated that the neighbors will need to be notified . Councilman DePaolo asked if the Board should ask the applicants ahead of time of the number of people attending or wait until the applicants come in next month for the public hearing . He noted that the night time event from 8 to midnight , with an estimated number of persons attending 200 for an outdoor carnival event for graduating seniors , seems kind of low. Councilwoman Leary agreed , particularly since the other event that goes from 2 p . m . to 6 p . lists 2300 estimated attendance . TB RESOLUTION NO. 2009-058: RESOLUTION TO SET A PUBLIC HEARING REGARDING A GROUP OF SIX NOISE PERMIT APPLICATIONS RECEIVED FROM ITHACA COLLEGE FOR SIX SEPARATE EVENTS TO BE HELD ON THE ITHACA COLLEGE CAMPUS BETWEEN APRIL 17, 2009 AND MAY 179 2009 WHEREAS, Town of Ithaca Local Laws number 4 and 5 of 2009 amended Chapters 153 and 184 of the Town of Ithaca Code by allowing for and the setting of fees for Multiple Noise Permit Applications submitted simultaneously by a single entity, representative or agent for events occurring at a single address within a consecutive six month period; and WHEREAS, according to the revised Code, applications submitted simultaneously shall be reviewed, and determinations shall be rendered on an individual basis; and WHEREAS, the Town Clerk's office received a set of six (6) Noise Permit applications, along with a $ 100 payment from Ithaca College requesting permission to hold six (6) separate events on the Ithaca College Campus during the months of April and May 2009: 1 , Friday, April 17, 2009 from 2 p. m. to 4 p. m. — Inauguration of President Rochon in the Hill Center; 2, Friday, May 1 , 2009 from 2 p. m. to 6 p. m. — ` IC Kicks. Back, " a carnival to commemorate the end of the academic year and concert, 31 Tuesday, May 12, 2009 from 8 p. m. to 12 Midnight — Outdoor carnival event with amplified music, for graduating seniors; 4. Wednesday, May 13, 2009 from Noon to 4 p. m. — Outdoor barbeque for graduating seniors with amplified music; 5. Saturday, May 16, 2009 from 9:30 p. m. to 10 p. m. - a concert with amplified music in conjunction with a fireworks display; 6. Agenda Item No . 14 - Consider setting a public hearing for Monday, April 13 , 2009 at p . m . to hear public comment relative to Southern Cayuga Lake Intermunicipal Water Commission 's Burdick Hill Water Tank Proiect Supervisor Engman stated that the Commission Members at Bolton Point made a change . Instead of taking the. tank that is there now, building another tank , and then refurbishing the current metal tank , the Commissioner' s decided to build a second tank , tear down the first one , and rebuild it in the same place . The reason for this is that there is a fifteen year pay back period . The second new tank will pay for itself after fifteen years because it is a concrete tank , . and will not require painting every fifteen years like the current one does . The idea is to have two concrete tanks rather than one concrete tank . The revision for agenda item no 14 , would be to set the public hearing to consider two new tanks at Burdick Hill , Councilwoman Hunter asked if this requires a public interest order. Supervisor Engman stated that the Town would need to do a public interest order. Town Clerk Billings stated that the Town would need to have the public hearing and then t public interest order follows that for 30 days . Councilwoman Hunter asked if at the public hearing with the Town would be adopting the public interest order. Town Clerk Billings stated that is correct and the Town Board will be setting the 30 day time period . Councilwoman Hunter stated that the public interest order is a statement that this project is in the public interest . She asked when the Town Board makes this statement , after this permissive referendum period is started off . She further stated that is not correct , the Town Board needs to make this statement at some point , then that starts the clock for the permissive referendum . Supervisor Engman stated that the Town did the same , thing for the East Hill Water tank , and the Town will use that a model . This can be addressed at the second meeting of the month or next month for clarification . He also stated that he knew the Town needed to do this since we are the administrator for Bolton Point . Councilwoman Hunter stated that it needs to be clarified . Councilman DePaolo responded that there was not a quorum at the Planning Committee meeting so they did not recommend anything . They discussed the proposal , but did not take any action to recommend anything to the Board . TB RESOLUTION NO. 2009-062: ACCEPTANCE OF CONCEPT AND LOCATION OF PROPOSED CONSERVATION EASEMENT WITH ITHACA COLLEGE AND FINGER LAKES LAND TRUST REGARDING THE ATHLETIC AND EVENTS CENTER WETLAND MITIGATION PLAN, ITHACA COLLEGE CAMPUS OFF OF CODDINGTON ROAD WHEREAS, the Town of Ithaca Planning Board is considering a supplemental Environmental Impact Statement (S/EIS) and Site Plan Approval for the proposed Ithaca College Wetland Mitigation Plan as part of the Athletics and Events Center project, located off Coddington Road near Rich Road, W. Northview Road, and the Water Tank Road, Town of Ithaca Tax Parcel No. 's 42- 1 -9. 2 and 43- 1 -4, Medium Density Residential Zone. The proposal involves the construction of approximately 4. 5 acres of wetland in two locations on the Ithaca College lands to compensate for approximately 2. 77 acres of wetland being lost as part of the Athletics and Events Center project. Ithaca College, Owner/Applicant; Richard Couture Associate Vice-President of Facilities, Agent, and Page 16 of 38 Town Board Minutes March 9 , 2009 FINAL WHEREAS, Ithaca College as the applicant for the above-referenced project has proposed to convey a perpetual conservation easement on these two wetland mitigation sites as well as on adjacent areas, including existing wetland and upland buffer, encompassing 11 . 8 +/- acres located just west of Rich Road and 12. 2 +/- acres located west of the College 's water tower road (the Raponi site); and WHEREAS, Ithaca College has also agreed to convey a perpetual conservation easement to the Finger Lakes Land Trust on approximately 77 acres of woodlands located in and adjacent to Van Buskirk Glen, which is a Tompkins County designated Unique Natural Area located in the Town of Newfield; and WHEREAS, the Finger Lakes Land Trust has agreed to coordinate the conservation easement for the Ithaca College Wetland Mitigation Plan, and proposes to work together with Ithaca College and the Town of Ithaca to ensure the permanent protection of the above- referenced areas; and WHEREAS, the Finger Lakes Land Trust has agreed to co-hold the conservation easement on the Ithaca College Campus with the Town of Ithaca for an initial five-year period, during which time it would assist the Town in developing and implementing a long-term monitoring program for the wetland mitigation sites; and WHEREAS, all of the above-referenced actions are subject to review and approval by the U. S. Army Corps of Engineers (USACOE) to ensure that they meet the wetland mitigation requirements associated with the proposed construction of facilities in the Athletic and Events Center.project; and WHEREAS, the Finger Lakes Land Trust has agreed to draft a conservation easement agreement for the two wetland mitigation sites and will also complete a baseline documentation study of the two sites for future use in monitoring and enforcement of the easement agreement; and WHEREAS, the proposed conservation easement for the wetland mitigation areas would include, but not necessarily be limited to, the following limitations on use: outside of the proposed wetland restoration projects, no significant alterations of lands and waters shall be allowed; motor vehicle use on the property in question is prohibited except as necessary to undertake the wetland restoration projects; the erection of permanent structures is prohibited excepting the installation of interpretive signs, kiosks, and improvements to hiking trails, all subject to the approval of the easement holder(s); dumping, disposal, storage or treatment of waste is prohibited; and except for the proposed wetland mitigation projects, the cutting of vegetation without the prior approval of the easement holder(s) shall be prohibited, and WHEREAS, the Town of Ithaca Planning Committee discussed the above described proposed conservation easement agreement at its meeting on February 12, 2009; now therefore, be it Page 17 of 38 Town Board Minutes March 9 , 2009 FINAL RESOLVED, that the Town Board of the Town of Ithaca hereby supports the concept the Town of Ithaca entering into the above=described conservation easement agreement Ithaca Ithaca College and the Finger Lakes Land Trust, and accepts the concept and the abo described location of the 24 +/- acres proposed for the conservation easement on the Ithaca College Campus, subject to the following conditions, prior to Town Board authorization to enter into the conservation easement agreement: 1 . That the specific surveyed locations and final conservation easement document for the proposed conservation easements on the Ithaca College Campus be subject to the review and recommendation of the Attorney for the Town of Ithaca and the Director of Planning for the Town of Ithaca, and the approval of representative of Ithaca College, and the USACOE; and 2. That Final Site Plan Approval for the Ithaca College Athletic and Events Center Wetland Mitigation Plan be granted by the Town of Ithaca Planning Board, and 3. That the Finger Lakes Land Trust agree to be a co-holder with the Town of Ithaca of the conservation easement on the Ithaca College Campus for at least an initial five-year period, after which the Town of Ithaca would agree to become the sole holder of the conservation easement. Agenda Item No . 16 - Consider one-year appointment of Kristine Shaw to the Town of Ithaca Conservation Board — See Attachment #2 Councilman DePaolo asked how many members are on the Conservation Board . Director of Planning Kanter stated that there are approximately nine , a potential maximum , but they have not had full membership for some time . Councilman DePaolo asked why the potential newest member of the Conservation Board would also be asked to represent the Town on the EMC . Supervisor Engman stated that position has been empty for months and months . The . Conservation Board . could not find anyone that wanted to do double duty . It is one of those things where it is a big commitment to sit on the Conservation Board , and then to ask them to , sit on the Environmental Management Council , it becomes a major time commitment Supervisor Engman stated that he sat on the EMC until the end of last year, and the Town Ithaca did not have a representative for most of the year. The Conservation Board foun Page 18 of 38 Town Board Minutes March 9, 2009 FINAL someone that was willing to do it , and it happens to be the newest Conservation Board Member. The EMC is a County Board , and all the municipalities are invited to recommend people from their municipalities to the County legislature . The County legislature does the actual appointing , so the Town only makes a recommendation . Agenda Item No . 17 - Consider recommendinq one-year appointment of Kristine Shaw to the Tompkins County Environmental Management Council Councilman DePaolo asked if there is a liability to the EMC for that seat to be open , and is the Town afraid that if this individual would decline our suggestion to serve on that board once she is deemed to have the right experience . Supervisor Engman stated that since the Town has had the seat empty for so long , it is a little embarrassing . Municipalities usually make an attempt to fill their seats . The Town of Ithaca has been very active over the years , so it would be better to have someone in the seat . The EMC relies on the quorum like any other body, and if there is no body in the seats then it is difficult to get a quorum . Councilman DePaolo asked if the representative of the Town typically follows the recommendations of the Town ' s Conservation Board or other Town Boards . Supervisor Engman stated that the representative makes a report twice a year to the EMC on what is happening in the Town in terms of environmental matters , and then brings back to the Conservation Board and Town Board any matters that the EMC needs contact with municipalities on . It is a liaison role , but once on the EMC the person basically votes according to what the Conservation Board wants them to do . Agenda Item No . 19 - Consider Recommendation of the Personnel Committee regarding restructuring the Public Works Department to include Engineering — See Attachment #4 Councilman DePaolo asked a question about the last resolved clause where it says , "the Town Board approves the abolishment of the Engineering Department , transferring the employees to the Public Works Department under the direction of the Highway Superintendent . " He asked if that would be the physical transferring or the organizational transferring . Ms . Drake stated that it is an organizational transfer. Councilman Stein asked if this would be happening now. Page 20 of 38 Town Board Minutes March 9, 2009 FINAL Supervisor Engman stated that the Town Board would approve the concept of the practicality of it and it would happen as soon as it could be worked out . Drake stated that this would have to happen for a transitional period before coming into play . Councilwoman Hunter stated that issue was not discussed at the Personnel Committee—that this would happen prior to the hiring of the new person . Councilwoman Leary asked if this would need to be done before advertising the new position . Supervisor Engman stated that the Town can not advertise for the position until they know the structure of it . Otherwise the Town will be hiring a person that would not be supervisory over the Engineering Department , Councilman Stein said that there is no time period stated in the resolution , and that there is nothing that says that it happens as soon as the Board passes it . This would remain flexible . Councilwoman Leary stated that she would deem it is true as soon it is passed . She interprets that the abolishment of the Engineering Department occurs as soon as the resolution is passed , as does the transfer of the employees to the Public Works Department , Supervisor Engman stated that the functionality of it is not a big deal . He stated that . he supervises the head engineer now, but then engineering will be supervised by the Highway Superintendent/Director of Public Works when the new hire starts . Councilman Stein stated that this was discussed in the Personnel Committee and that it was his general understanding that this would be affected the moment that the new Director of the Public Works took office . He said he would prefer something that said that . It was in the spirit of the Personnel Committee that this transfer not take place until the new Director is in place . The Town Board needs to be careful about making important changes to the Engineering Department before the new Superintendent/Director is in place . Councilwoman Hunter stated that she was under the impression that this transfer would not take place until someone was on board who would assume this newly created position . She agreed with Councilman Stein and said she would like to have some language in the resolution that indicates this as a thought of the Board . She stated that she was not aware that Mr. Noteboom would be in charge of the engineering staff . Mr. Noteboom stated that he was aware of this , and that he and Mr. Walker have had conversations about it . They both decided that whatever the Town Board wishes they would do their best to accommodate . Page 21 of 38 Town Board Minutes . March 9 , 2009 FINAL Supervisor Engman stated that the Town should not wait until the new person arrives and th turn everything over to that person , and ask them to work on a new structure . This structu should be done as much as possible , in advance , to delineate the working arrangements a the responsibilities of individuals , and then the new person has some time to see how things are working , and to make decisions on li how to make changes later on . Supervisor Engman further stated that to dump this into the lap of a new person would be mind boggling and unfair. The Town needs to do as much on the transition team as possible to work out the details , get it functioning , get it working , and then take the challenge off the new person . Councilman Stein stated that the Personnel Committee did discuss this and there was more than one view. The Town should not make major changes until the new person is in place . He also stated that he would be content !, to leave it vague to work out with the Personnel Committee and the Town Board for whatever changes need to be made . He does not like the resolution that gives Mr. Noteboom the authority , at the moment , to make changes in the engineering department , without coming'', back to the Board . This is why he prefers something that does not transfer the authority so rapidly , and he was hoping there was a way to do that . Councilwoman Leary asked if it would help to put the creation of Director of Public Works position in one of the resolves , and the Town Board approve the structuring of the Public Works to incorporate the Engineering Department under the position of Director of Public Works , which would incorporate the Highway Superintendent . Supervisor Engman stated that the next resolution does change the Highway Superintende job description to include public works . II', This cannot be done all at once . The reorganizati needs to be done first in order to have other things fall into place behind . There are two mo resolutions after this one , and there is an appointment of Highway Superintendent and Public Works search committee . We cannot search for this person or change the job description until the program is restructured . Councilman DePaolo asked if it was anticipated that the new Director of Public Works would be hired before Mr. Noteboom retires , and would the Town have the benefit of Mr. Noteboom 's working knowledge of public works to assist in the transition with the new person on board . Supervisor Engman stated that would be ideal , but is determined on how the search goes , and how good the candidates are . Councilman DePaolo asked if the Town knew that would be the case would it be more comfortable to defer the abolishment of engineering at this moment , and wait for the new person to be part of the transition . Supervisor Engman stated that would not be a good idea because it would almost guarantee the new person to fail coming in to try and to do all that . Councilman DePaolo stated that would virtually leave the new person no authority t reorganize . S/he can do whatever s/he wants once s/he comes into office , with staff . In reality , the new Highway Superintendent could change it on day one if s/he did not like it , but if s/he is half way intelligent s/he would wait to see how it plays out for a little while , and then figure out how it needs to be tinkered with . Councilman DePaolo stated that it would be easier to wait and see if Mr. Noteboom was around to assist in the waiting and seeing . Mr. Noteboom stated that he would rather not commit to being here . He plans on being out of town . Councilman DePaolo stated that he was not asking for an open commitment but more of a prediction on how long the solicitation and hiring process might take . Ms . Drake stated that a lot of it depends on if the first recruit is satisfactory then it would go along faster than going out to advertise . She said she wants to give the Board members enough time to meet the candidates . Councilwoman Leary stated that the two resolutions are needed , and at the same time the Town needs to go forward with the advertising . She said she feels strongly that the Personnel Committee needs to establish guidelines on how the Town Board envisions the organizational structure , and not leave it up to a new person . The whole reason this was done was to streamline operations , and this new position fits into that . This would not be just hiring a new director of public works or giving that title to the new highway superintendent . The Personnel Committee looked at the actual structural needs of the two departments , and this was the best solution. Councilman Stein stated that he agrees with Councilwoman Leary, but there still remains a difference among people that were at the Personnel Committee on how much should be done in advance of the hiring of the new director of public works . He said there should be some flexibility, but there are others who think that things should be prepared by the time the new person starts . Councilman Stein went on to say that he would not like to make that decision at this particular time , and would like to have a more flexible resolution to have it say it is the intention of the Town Board of Ithaca to do what is written . He does not want it to be effective right now. Councilman Stein stated that the Town Board should think carefully about changing job titles and decide who will sit where before the new person starts , and maybe some decisions need to be made more quickly. Councilwoman Hunter stated that she is a little confused about the statement that the Town could go through the process of establishing what should be the set up and that the new Director of Public Works , as a Highway Superintendent , could just come in and do whatever they want because they have that authority. Councilwoman Hunter asked , what is to prevent Mr. Noteboom from doing whatever he wants as Highway Superintendent with his authority? The resolve should read , the Town Board approves the abolishment of the engineering department and transferring the employees to the Public Works Department under the Page 23 of 38 Town Board Minutes March 9 , 2009 FINAL direction of the Highway Superintendent/Director of Public Works upon his/her hl rin Councilwoman Hunter also stated that she would feel more comfortable if she had some sen of how it was , and that ' s what bothers her about this . There is no structure established f weighing the pros and cons of the scenarios , and there is no satisfaction with the input received to talk to people involved . She does not feel that the Town Board has all the information needed to establish a structure that would pass with a seal of approval to the new hire . Councilman Levine stated that it is clear once the Highway Superintendent/Director of Public Works is hired s/he would be the supervisor of the engineering department . He then asked who would supervise the engineering department until the hiring happens . Supervisor Engman stated that the Town Supervisor will continue to supervise the engineering staff . Councilwoman Leary stated that she disagrees with the lack of information . She thinks that the Personnel Committee has been working for a couple months , and a special meeting was set up to address this issue . The Committee gathered suggestions and surveyed information from staff , and she feels that . the Town Board has done a lot of preparation . She also stated that the Town Board could vote on the creation of the position first then add to the other resolution transferring employees under the direction of the Highway Superintendent/Director of Public Works when that person is hired. Councilman Stein stated that he would „' like . to make another suggestion that a third resolv state that this resolution takes effect when the position is filled. He further stated that he wou be happy with a third resolve stating that is when this resolution takes effect. Supervisor , Engman stated that if the Town Board adds Highway Superintendent/Director of Public Works upon their hiring , the Town Board would be still able to approve the restructuring of the first resolve , but then the supervision does not take effect until the new person is hired . Councilman Stein suggested that the resolved clause state , "That the above changes take place upon the new Highway Superintendent/Director of Public Works effective date of employment . Fair Share Tax Reform Supervisor Engman directed the Board 's attention to Councilwoman Leary's resolution of support for the Fair Share Tax Reform Act of 2009 . He explained that the proposed Act is currently in the New York State Legislature . Its purpose is to improve equity and taxation for New Yorkers and help close the projected budget gap . Councilwoman Leary stated that this has been taken up by the County Legislature . She explained that this was a tax on households making $250 , 000 or more , but it is also known as the millionaire tax . The tax on $250 , 000 is a 1 . 4 percent increase over what they (persons making over $250 , 000/year) are currently being taxed , so it is a small tax on that level . It goes up for households making $500 , 000 to 2 . 12% and then over a million it gets more significant (3 . 45 % tax) . Councilwoman Leary stated that this tax is not new , it is not revolutionary. It would close the budget gap by half . just through this measure alone . In the latest Governing Magazine , there is an article covering tax a phobia when the emphasis has been on spending cuts and no one dares talk about increasing taxes: It quotes Peter Orzack , the Director of Budget for President Obama , and as saying "tax increases would not in general be more harmful to the economy than spending reductions . In the near term tax increases on higher income families are the least damaging mechanisms for closing state fiscal deficient . " Councilwoman Leary said the Board 's resolution would give the sponsor in the state senate , Eric Schriderman , just one more vote of support from a local government . TB RESOLUTION NO. 2009-070: SUPPORTING THE "FAIR SHARE TAX REFORM ACT OF 2009 " IN THE NEW YORK STATE LEGISLATURE, TO IMPROVE EQUITY IN TAXATION FOR NEW YORKERS AND HELP CLOSE THE STATE'S PROJECTED BUDGET GAP WHEREAS, New York State faces a budget gap of at least $ 13 billion in the 2009-2010 fiscal year; and WHEREAS, the Executive Budget proposes billions of dollars in cuts to education, healthcare programs, and other essential services, which will impact communities and local government budgets throughout the state; and WHEREAS, the Governor has also proposed some 137 new taxes and fees, such as reinstating the state sales tax on clothing under $ 110 and increasing fees for license plates, which fall disproportionately on middle- and low-income New Yorkers; and Page 35 of 38 Town Board Minutes March 9 , 2009 . FINAL WHEREAS, Governor Paterson has described his budget proposals as necessary to "sha the pain " across the citizens of the state; and WHEREAS, during the last 30 years, New York has reduced income tax rates on the wealthiest New Yorkers by more than 50 % (from 15. 375 percent to 6. 85 percent) and eliminated high income tax brackets, so that working class families and the very rich pay the same tax rate: New Yorkers who make more than $40, 000 a year are subject to the same marginal tax rate as those who make $400, 000 or $40 million; and WHEREAS, New York has replaced this lost revenue over the years by implementing more regressive taxes and fees that disproportionately impact low- and moderate-income New Yorkers, including cost shifts to local governments that force increases in property taxes, as localities struggle to cover costs of essential and mandated. services; and WHEREAS, as a result, currently the richest 1 % of New Yorkers pay 6. 5 % of their total income in state and local taxes, while the poorest 20 % of New Yorkers pay 12. 6 % of their income in taxes; and WHEREAS, the Fair Share Tax Reform Act of 2009 (S. 2021 ; A5912 ) would raise more than $6 billion in revenue to nearly halve the projected budget shortfall, while reforming New York's tax code to make it fairer, more progressive, and in line with neighboring states; and WHEREAS, the Fair Share Tax Reform Act of 2009 would slightly increase tax rates for t top 3. 5 percent of New Yorkers, as follows: • by 1 . 4 percent for those with taxable income of more than $250, 000 (from 6. 85 perce to 8. 25 percent); • by 2. 12 percent for those with taxable income of more than $500, 000 (from 6. 85 percent to 8. 97 percent); and • by 3. 45 percent for those with taxable income of more than $ 1 million (from 6. 85 percent to 10. 3 percent); and WHEREAS, there is no evidence that moderate tax rate increases at the top levels - induce outmigration. In fact, after New York passed a temporary surcharge on higher-income taxpayers in 2003, the number of high -income returns grew by 30 % while the surcharge was in effect. Evidence from New Jersey shows that since 2004, when that state raised the tax rate on half-millionaires by 2. 6 %, the number of people earning at least $500, 000 has grown by 70 % and people have not left the state as a result; and WHEREAS, in December 2008, more than 100 New York State economists, including Nobel- prize winner Joseph Stiglitz, endorsed a proposal similar to Fair Share Tax Reform, expressing concern that steep state budget cuts will exacerbate the economic downturn and harm vulnerable low- and moderate-income New Yorkers, and noting that economic theory and historical experience unambiguously demonstrates that it is economically preferable to raise taxes - on those with high incomes than to cut state expenditures; and Page 36 of 38 i i Town Board Minutes March 9, 2009 FINAL WHEREAS, according to a Quinnipiac poll in December 2008, voters support, by 84 to 13 percent, raising the state income tax on people who make more than $ 1 million per year; NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Ithaca calls on the New York State Senate and Assembly to pass, and the Governor to sign, the Fair Share Tax Reform Act of 2009, as one of the actions needed to close the state 's budget shortfall, raising $6 billion by slightly raising income tax rates for the top 5 percent of New York taxpayers, and therefore eliminating the need for some of the devastating cuts to the most vulnerable of our citizens; and FURTHER RESOLVED, that copies of this resolution be sent to Governor David Paterson, New York State Senate Majority Leader Malcolm Smith, Senators Dean G. In addition, the College is willing to convey a perpetual conservation easement on these sites as well as adjacent areas including existing wetland as well as upland buffer. The areas to be subject to easement encompass 11 . 8 acres located just west of Rich Road and 12 .2 acres located west of the College' s water tower road (the Raponi site). The College has also agreed to convey a perpetual conservation easement on approximately 77 acres of woodlands located in and adjacent to Van Buskirk Glen — a county —designated Unique Natural Area located in the Town of Newfield. All of these actions are subject to review by the U. S . Army Corps of Engineers (USACE) to ensure that they meet the wetland mitigation requirements associated with the proposed construction of athletic facilities. The Finger Lakes Land Trust proposes to work together with all parties involved to ensure the permanent protection of these areas while allowing for the timely completion of both the College ' s construction project and its creation of the mitigation wetlands . Specifically, the Land Trust proposes the following: Raponi & Rich Road Sites: The Land Trust proposes to. work together with the Town and the College to draft a conservation easement agreement for these two restoration sites. Subject to USACE approval, this document would be recorded in the land records and binding on future use of the property. Once approved by the . easement holder, any hiking trails created may be maintained as needed by the landowner. • Subdivision of the property is prohibited except for conservation purposes — conveyance of the conservation area to a public conservation agency or non-profit organization is permissible. • Management. of the Protected Property shall be based on natural processes. Without the prior approval of the easement holder, the introduction of non-native plants or animals is prohibited, . • Any other uses considered to be inconsistent with the expressed purposes of the easement agreement shall be prohibited. The final easement document will be subject to review by counsel representing the Town of Ithaca, Ithaca College, and the U. S . Army Corps of Engineers. Van Buskirk Glen: The Land Trust seeks to negotiate and hold the perpetual conservation easement on this site. While easement terms are still under development, the document will be designed to ensure that the area is managed as a natural area that mill be available to the College a for research and educational purposes. Both of these conservation projects will be linked through the College' s wetland mitigation requirements. The Land Trust is ready to proceed to expedite both projects provide that all parties are in agreement and that its direct costs associated with these activities are covered by the College. Through its willingness to permanently protect 24 acres of wetlands and uplands on South Hill, as well as 77 acres at Van Buskirk Glen, the College is making a significant commitment to protecting and enhancing wetland and streamside habitats in our region. The last twenty were spent in various senior management positions for the United Way of Tri-State, Inc . (UWTS) located in New York City. UWTS was a unique United Way as it was created by and for large corporations in the Metropolitan New York area in 1978 to assist them in running a centralized annual campaign without having to work independently with the 38 local United Ways in the metro area. The funds raised through this effort were distributed by UWTS to the 38 United Ways by formula unless specifically directed to agencies by the donor. This regional effort evolved into national support for corporate campaigns including the development of online pledge processing systems and distribution of $ 150 — 200 million annually for many of the countries largest corporations. Because of the National implications of this effort, UWTS began merger discussions in 2003 with United Way of America and in 2005 , merged operations with UWA. We are ahead of the curve with our current practices. • We provided trucking for County Highway for hauling Jersey Barriers . • Removed old wall at Town Hall parking lot. Parks, Trails, and Preserves : ■ We got delivery of our new mower and new tractor for sidewalk and trail maintenance . ■ Weekly site inspections were performed . ■ Snow removal at Town Hall and our walkways was done as needed . ■ The proposed West Hill Community Garden site was laid out with the assistance of Marnie's interns. • Trees and brush were trimmed along trails. Water: ♦ Water main breaks were repaired at Forest Home Drive's upstream bridge and Summhill Lane and a valve repaired at Sanders Place and Winthrop Drive intersection. ♦ PRV tour on Stone Quarry Road was done with Bolton Point. ♦ Repairs to a hydrant on Pennsylvania Avenue were done . ♦ Design on the proposed PRV building on Remington Drive was worked on. ♦ Inspection of the water service installation for Cornell University's Merrill Family Sailing Center was done . Jet rodding sewer mains . ghk Town Engineer' s Report for March 9, 2009 Town Board Meeting EARTH FILL PERMITS There were no earth fill Permits applied for or Issued in January or February. Enforcement activity is continuing on tax parcels 26 . 4-2 , and 26 .4 . 3 . Enforcement will proceed with a letter requesting compliance. BOLTON ESTATE SUBDIVISION ROAD CONSTRUCTION The Town Engineer is providing construction management services to the Commission for the project. The Town is being reimbursed by Bolton Point for the costs of the engineering services . Work on the site is limited to some drainage and utility work. WATER PROJECTS East Shore Drive Water Main Replacement Final Design is being completed for the replacement in the Town of Ithaca and a section of water main on East Shore Drive in Lansing. An application for the Highway Work Permit from DOT is being prepared and permits for work in the Railroad ROW are being pursued. The City of Ithaca is proceeding on the Environmental Impact Statement regarding the decision for the City water supply. The Town Engineer has communicated with the City Public Works Department and indicated willingness to cooperate in a consolidated project regarding the east Shore Drive Water Main Project, and there has been no response to date. SEWER PROJECTS King Rd Sewer DPH Transportation and Excavating has completed installation of the sewer main. Site restoration will occur in the spring. Joint Interceptor Sewer Projects The Town Engineering staff is working with the City of Ithaca DPW engineering staff to model the sanitary sewer system and develop a detailed improvement plan. The sewer flow monitoring station access improvement project is complete and recalibration of the flow meters and improvements to the flow meters electronics are the next step on the monitoring program. v TOWN ENGINEERS REPORT 3/9/2009 JOINT SEWER PLANT PROJECTS Tertiary Phosphorus Removal Upgrade The project closeout is pending discussions with Crane-Hogan regarding resolution of the problems with the effluent control gate SG-2 . The engineer and Staff are considering claims made by the contractor. 7 Maximum Allowable Headworks Loading Study The Maximum Allowable Headworks Loading study agreement has been authorized the SJC and the backgrounc' chemical sampling portion of the project is underway. The study is an evaluation of the constituents of the sewa; flow into the plant and estimate the maximum load on the plant. This information is used to evaluate the process of treatment at the plant and the need for pretreatment from industrial users . The study is required by DEC and i; information used in developing the criteria for the plant discharge permit. Septage Receiving Station Improvement project The SJC is requesting approval for funding the engineering design for improvements and expansion of the Septa; receiving station at the IAWWTF . The plant accepts Septage for a fee from haulers that clean septic tanks in the County and some surrounding areas. Improvements in the station were included in the facility improvement plar developed by Stearns and Wheler. STORM WATER MANAGEMENT Implementation of Stormwater Management Laws Work on the development of a tracking report for implementation and enforcement activities required by the new Stormwater Management Law is continuing and a detailed report will be presented to the Public Works Committee and then the Town Board regarding administration of this program and how it impacts the Engineering Department work load. Northeast Ithaca Stormwater Management Plan Public Works Department is continuing work on a comprehensive solution to the drainage problems experiences in the Northeast area of the Town of Ithaca. As a first step, the Department assembled a complete database of all current Northeast drainage problems from the point of view of residents and property owners, including, but not necessarily limited to, wet basements, saturated lawns, dying trees, runoff from neighboring properties, excessive flow in ditches, and erosion of culverts, ditches or streams. The Department completed intensive field surveys in the Salem Drive area during the summer of 2008 and has used this information to formulate solutions to the drainage problems in the area. The Town will be presenting a range of possible solutions to residents of the area at a Public Meeting that will be scheduled for April . Town Engineers Report March 9, 2009 Daniel R. Northview Road, and the Water Tank Road, Town of Ithaca Tax Parcel No ' s 42 - 1 -9 .2 and 43 - 1 -4, Medium Density Residential Zone. The proposal involves the construction of approximately 4. 2 acres of wetland in two locations on the Ithaca College lands to compensate for approximately 2 . 77 acres of wetland being lost as part of the Athletics and Events Center project. Dates Drive, Town of Ithaca Tax Parcel No . 24-3 -2 . 1 , Office Park Commercial Zone. The proposal is to retain and possibly re-use the existing residential building located near the hospital entrance. Ithaca College Wetland Mitigation Plan, Athletic & Events Center, Located Off of Coddington Road, Northview West, and Rich Road : The Planning Board discussed a preliminary draft of the Final Supplemental Environmental Impact Statement (S/EIS) for the proposed Wetland Mitigation Plan as part of the Ithaca College Athletics and Events Center, which includes public comments received in regard to the Draft S/EIS and proposed responses to those comments determined to be substantive. 2008 Planning Department Annual Report : The Department of Planning presented and discussed its 2008 Annual Report and proposed work plan priorities for 2009 . CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following have been accomplished over the past two months (January and February, 2009) . Codes and Ordinances Committee (COC): The . Committee met on January 21St and February 11 th, 2009 . The Committee continued discussion of possible zoning amendments regarding fences and considered possible work plan priorities for 2009 . The next COC meeting is scheduled for March 18 , 2009 . Tentative agenda items include review of further revisions to the proposed Lakefront Residential Zone amendments regarding length of docks, continuation of review of amendments to the Zoning provisions regarding fence height and setback, and consideration of amendments to Chapter 221 of the Town of Ithaca Code regarding Signs . 3 Town of Ithaca Planning Director's Report March O, 2009 .Town Board Meeting Stream Setback law : Subsequent to COC ' s work on revising the proposed Stream Setback Law, Planning staff has scheduled a public information meeting regarding the proposed Stream Setback Law for Tuesday, March 10, 2009 at 7 : 00 p .m . Staff has been working on a presentation to explain the importance of stream corridor preservation and the elements of the proposed law. Staff is also seeking further review and input from the Conservation Board . Planning Committee: The Committee met on February 12 , 2009 (there was no January meeting) and discussed the proposed Ithaca College Wetland Mitigation Plan conservation easement being coordinated by the Finger Lakes Land Trust and the Carrowmoor Draft Scoping Document for the Environmental Impact Statement. The next meeting of the Committee is scheduled for Wednesday, March 11 , 2009 at 4 : 30 p.m . (this is a change of date from the regular meeting date) . Tentative agenda items may include follow-up discussion regarding the Northeast moratorium and environmental study, strategies to implement recommendations in the Conservation Board ' s report, "Saving Ithaca' s Views", and possible work plan priorities for 2009 . Comprehensive Plan Committee : The Committee met on January 22 , 2009 and heard an update on the progress of the residents ' survey, reviewed Town employee comments that had been requested on the draft Vision Statement for the Town, and continued discussion of the process for meeting with focus groups and neighborhood groups . The status of these work elements is further described below . Survey: The Cornell Survey Research Institute ( SRI) conducted the random-sample telephone survey of Town of Ithaca residents, including residents of Cayuga Heights, in January. Approximately 3 , 500 calls were made in order to complete 359 surveys . SRI completed the survey and has prepared and submitted a draft report that includes the results and analysis of the survey. Staff will be reviewing the results of the survey with the Committee. Press Conference: The Committee held a press conference on February 5 , 2009 to provide information on what the Committee has done so far on the Plan update, announce plans for the focus group meetings that are underway, and to discuss the next steps in the process . The press conference was attended by four representatives from the local media, and is resulting in good publicity for the Plan update. Focus Groups : Planning staff is coordinating the scheduling and organization of about ten focus group meetings as discussed by the Committee. This will also include some one- on-one interviews/meetings with stakeholders in some cases . Focus group subjects include neighborhoods, housing, agriculture, education, transportation, environment, energy, business/development, public . safety, recreation/museums, health, and inter- municipal cooperation. The neighborhood focus group meeting was held on February 26, 2009 and was attended by about 30 residents from neighborhoods all around the Town. The Agricultural Focus Group meeting was held on March 4, 2009, and included several farmers in the Town, including the Chair of the Town ' s Agriculture Committee, and representatives ' from organizations having agricultural interests, including Tompkins County Cooperative Extension, Tompkins County Planning Department, and others . 4 Town of.Itha a PlaDRpt g r March 9,2009 Town Board Meeting The next meeting of the Committee is tentatively scheduled for Thursday, March 26, 2009 at 7 : 00 p .m. I . Conservation Board: The Conservation Board met on January Bch and February 5th, 2009 . The Board discussed 2009 work plan priorities, committee reports, the revised draft of the Stream Setback Law, vice chair and committee assignments, and a review of the 1993 Comprehensive Plan goals and objectives. The next meeting of the Conservation Board is scheduled for March 5, 2009. Route 96 Corridor Management Study: The Technical Review Committee met on January 21 , 2009 to review and revise an outline for the fourth and final technical report that will be prepared by the Committee. The consultants ' work on Technical Reports # 1 , 2, and 3 is completed. Report #4 will draw on the findings and recommendations of the first three reports to develop an inter-municipal strategy for mitigating traffic impacts along the Route 96 Corridor through a number of mechanisms, including encouragement of a nodal development pattern. The final report focuses on land use strategies, infrastructure improvements, and transit enhancements. The Tompkins County Planning Department has prepared a draft of Report #4, and the Committee will be meeting on March 5 , 2009 to review the draft report. The tentative municipal review schedule anticipates that a revised draft report will be available to review with the Planning Committee and Planning Board in April, discuss and review with the Town Board at its study session in May, and finally have the Town Board consider a resolution of support for the final study recommendations and report at the June regular meeting. ` All of the completed reports can be found on the County Planning website (http ://www.tompkins- co .org/plannin transportation choices/Route96Ifno .htm) . ITCTC Planning and Policy Committees: The Ithaca-Tompkins County Transportation Council (ITCTC) Planning Committee met on February 17, 2009 . The Committee recommended approval of the 2009/2010 Unified Work Program and proposed Budget. The Committee also spent much of the meeting discussing a proposed list of transportation projects that could qualify for Federal Stimulus Funding that would be forwarded to NYS Department of Transportation. The Committee recommended a list of projects for short-term implementation (those that can be under construction by the end of June 2009 and a second illustrative list of projects for long-term implementation (expected to go to construction in 2010) . The Planning Committee ' s recommendation included a two-tiered ranking of short-term projects. The highest priority tier includes the Town of Ithaca' s proposed Honness Lane Walkway Extension. The second tier includes Phase I of the Forest Home Traffic Calming project. The Policy Committee held a special meeting on February 26, 2009 and approved the list of transportation projects as recommended by the Planning Committee. The next meeting of the Planning Committee is scheduled for April 21 , 2009 . Assistance to Zoning Board of Appeals : Planning staff continues to provide interim assistance to the Code Enforcement Department for Zoning Board of Appeals (ZBA) administration. 2008 Annual Report : The Planning Department prepared its 2008 Annual Report and proposed work plan priorities for 2009 and presented these reports to the Town Board and Planning Board . Federal Stimulus Projects : The Planning Department attended a number of meetings and assisted the Supervisor with preparing a list of Town projects that could qualify for immediate or longer range funding under the Federal Economic Stimulus program that was recently passed by Congress . 5 Town 'of I haca Pla'nnang Director's Report March .9, 2009 Town Board Meeting Agricultural Planning Grant : The grant contract for the agricultural planning project has been signed by New York State, and funds can now be drawn from the grant that the Town received. Trail Committee: The new Trail Committee has met twice and has had preliminary discussion regarding the Town ' s existing and potential trail system, possible trail connections from West Hill into the City, and the current Gateway Trail project (see below) . The next meeting of the Trail Committee is scheduled for Thursday, April 2 , 2009 at 11 : 00 a.m . Gateway Trail : Planning, Engineering and Public Works staff met with representatives from the City of Ithaca to coordinate the planning and design of the Gateway Trail project. This is funded under a Federal "earmark" grant received by the Town. Staff is preparing a Project Scoping report to submit to the NYS Department of Transportation, which administers the grant program. A contract for Phase I of the trail project has been signed by the Town and NYS , which includes a total of $ 84,000 for scoping, preliminary design, surveys, mapping and environmental review of the trail project ($67,200 Federal funds, $ 16, 800 Town share) . I completed a grant application to the Park Foundation after conversation with a trustee who expressed interest in supporting West Hill Community Garden at Linderman Creek. This garden will establish a place for members of the community, targeting Town residents with low incomes, to grow their own healthy food by providing needed resources and support. The garden is also recognized as a means for bringing the residents of the Town together and for establishing lace to build a sense of community g g a p Y for West Hill. Support of the garden by the Town of Ithaca acknowledges all the documented benefits of community gardens as goals of the Town. After a preliminary understanding about these funds I was later advised the original estimate I provided to the Foundation would only be about half of the actual fence. So while trying to assure compliance with the site plan review process to put up the fence I ' m leaving no stone unturned to fine additional money. On 2/27/08 I found the Town was not awarded an ACHIEVE community grant that would close the gap . Also only about $ 500 will awarded for the seed/ plant sets from the neighborhood mini-grant program. The "good" news is I intended to re-use and strengthen the language in these requests in appeals to other foundations (Howland and Rotary) . The project has been scaled back from the original concept with a shed and water due to cost and implementation schedules. At this point the goal is to have by May 1 , 2009 a .varmint protective fence installed around tilled soil demarcated by members of the Garden Team consisting of Tee-Ann Hunter, Nick Tessoni (I C intern) and Cornell work study students Marc Francis and Laura Komar so people may garden ! I can not praise the "Team" enough especially Nick and Tee-Ann. As I clearly had a 37. 5 hour per week job before this "project" began to take momentum I ' m definitely not accomplishing all this by my self. The process has been jagged as we didn't want to do site plan review without funding yet funders want assurance that space will remain garden. In any event the "team" has had to reel me in more than once the project is moving forward. It is our intent to create a real community gathering place in the garden and we are working on all kinds of program ideas to enhance the project . The Student Work Initiative Program last year had 8 youth by 2/25 ; this year by that date there were already been 31 contacts by youth. The "good news" on that front is more money to fund youth who qualify for state or federal jobs programs . We use a team approach to engage as many youth as possible in gainful employment opportunities . As if that wasn' t enough we welcomed Transportation & Mail Services of Cornell into the Adopt- a-Trail Program with its "Green Team" adoption of East Hill Recreation Way from Mitchell St . to Game Farm Road That ' s the highlights as the day to day action is dizzying here in Town of Ithaca recreation & youth! Regular Meeting of the Ithaca Town Board, March 9 , 2009 Human Resources Report for January and February Personnel and Employee Relations Committees : The Personnel Committee has been discussing the review of the Public Works Department, due to the anticipated retirement of the Highway Superintendent. This has been the main focus for the meetings including an additional meeting that was held in February. (see attached notes) The Employee Relations committee members have been getting input from the staff on many subjects. Suggestion boxes have been put into place , which will be opened and , responded to by the committee. (see attached notes . ) Safety Committee: The committee has not met yet in 2009 . Bolton Point: Time was spent working on recruiting , interviewing and hiring a Distribution Operator Trainee. The new employee started February 2 , 2009 . Project work for their Personnel Committee is also being done . Performance Reviews for the General Manager have been sent out to the Commissioners . Training and Development: Work on the morning training 'for the morning of the picnic has contracted . Bob Stezzi , TC3 . Biz will be providing the "Who Moved My . Cheese" program from the book written by Spencer Johnson . A training location site besides Public Works is still being researched . The Brainteasers series is being developed for 2009 . March's program will be on publicizing programs , April on developing yourself, and May is on customer service . We are also working on a joint venture for a grammar workshop . A training series for department heads is being developed , which will also include the 4 department heads at Bolton Point. We are working with the Town of Lansing on a Pre-Retirement Seminar for May. Personnel — Civil Service : Many personal matters and vacant positions have been worked on over the past two months . All the vacant positions have been filled at. this point. Evaluations of restructuring will take place over the next 30-90 days. Commercial Insurance ( Ithaca Agency - NYMIR Insurance Company) : No new claims to report. Workers' Compensation (Public Employers Risk Management Assoc — PERMA) : No new claims to report. Town has been reimbursed for sick days lost for 1 of 2 cases by Perma .
