A regular meeting of the Town of Ithaca Planning Board was
held on Tuesday , May 29 , 1973 , in the Town Offices at 103 East Green
Street , Ithaca. , New York , at 7 : 30 p . m .
PRESENT : Chairwoman Barbara Holcomb , Sam Slack Robert
Scannell , Jack Lowe , Daniel Baker , Reynolds Metz (Assistant Zoning
Officer) Peter Francese ( Planning Consultant ) . Ken Kroohs ( Planning
Engineer .
ABSENr : Maurice Harris , Arnold Albrecht , Robert Christianson ,
Chairnaoman Holcomb opened the meeting at 7 : 40 p . m .
WALTER WIGGINS " APPEAL FOR PERMISSION TO CONVERT BARN AT 1152 DANBY
ROAD TO A MULT :{PLE RESIDENCE WHICH INCLUDES SIX APARTMENT UNITS ,
Mrs . Holcomb read a Memo written by her to the Zoning Board
of Appeals relative to Mr . Wiggins ' Appeal .. After a brief discussion
the Board agreed that the Memo was the. correct procedure . A copy of
the Memo is attached to these Minutes and filed with the Official
Minutes of the Planning Board housed in the Office of the Town .Clerk.
KENILWORTH PLANTINGS .

Mrs . Holcomb reported that she had contacted Mr . Edward King ,
Attorney for Kenilworth Associates , relative to the plantings on Judd
Falls Road at the East Hill Plaza shopping centre . Mr . King wrote to
Kenilworth but has not yet received a reply to his letter . An escrow
account of $3 , 000 . 00 exists for the Town to do the plantings if
Kenilworth does not : It was noted that the parking lot pavement
extends up to the property line and therefore must be removed . The
question now involves the legal procedure to be followed . It was
suggested that a letter be bent by the Town Attorney to Kenilworth
requesting action by a certain date and stating that if no action is
taken , the Town will use the escrow account . This . step was agreed to
by the Board .
Mr . Scannell suggested using hemlocks at 10 ' spacing with
hixsi at 4 ' spacing . Mr . Lowe noted that salt from the road and
parking lot may run into the planting strip . Mr . Scannell agreed
and concluded that hemlocks should not be used .
Mrs . Holcomb requested that the Board look at the site
tomorrow night before the meeting at the Marine Midland Bank .
EASTWOOD COMMONS .,
Mrs . Holcomb reported that she and Mr . Kroohs spent Wednes -
day , May 23 , 1973 , with Mr . Dixon from the New York State Department
of Housing , discussing the building plans for Eastwood Commons . It
appears that because of an internal ruling in that Department , if
the land under a multi� unit . bui. lding is sold with the building ,
that building should conform to the multi - residence code . If the
land is not so sold , the building must conform to the single- residence
code . After several telephone calls to Mr . Dixon ' s superiors in New

York City , it was decided that the field inspector , in this case
Mr , Dixon , could make his own determination . about which code to
- utilize . Mr . Dixon then approved the plans with some recommendations .,
BEACON HILLS ,
Mrs . Holcomb reviewed recent events relative to water taps
for Beacon Hills . The land to be developed was nct in one of the
original water districts and Mr . Vincent Mannan , City of Ithaca
Assistant Superintendent of Public Works has not issued the permits
to this time for that reason . The Toirz was contended that since
the water districts have been dissolved this should not be important :
Mr . Carey on Coddington Road is in a similar situation . The Town
Attorney , Beacon Hill ° s Attorney and the City Attorney are attempting
to correct this problem .
PROPOSED ZONING ORDIMME ,
The R•ml Section of the proposed Zoning Ordinance was
discussed , Including the prcvi. sions involving apartment size ,
clustering , plannedresidential • development , planned unit development ,
subdivisions , <<nd minimum District sa. zes sn the R- 1 Zone .

After being informed by Mi . David Cowan of the
Appeal of Mi, Wiggins and the -situation surrounding said
Appeal , it is our opinion that the correct procedure for
Mr . Wiggins to follow would. be to apply to the Planning
Board for rezoning of his land to multiple residencel.
Article V , pec wiaa 1 9 of - tato Zoning Ordinance of
the Togs of Ithaca very clearly states that dwellings for
only one or two families are - allowed . A an R%* 30 zone. .
The Planning Board would hear Mr . Wiggins at their
earliest convenience after being requested to do so .
If the Plamning Board denies Mr . Wiggin? a request. for
rezon�.ng , . it would then appear to be the time for him
to come before the Board ' of Appeals . Mr , Cocas could '
then provide the _Zoning Board mem*iers' with: tl�e reasoning
