TOWN OF ITHACA PLANNING BOARD MAY 152 1973 A Public Hearing was held by the Planning Board of the Town of Ithaca in the Town Offices at 10.5 East Green Street , Ithaca , New York , at 7 o 3(I p . m . PRESENT : Deputy Chairman Robert Christianson , Sam Slack , Jack Lowe , Danlel Baker , Robert Scannell Maurice Harris , Peter Francese ( P1a.nning Consultant ) Kenneth Scannell , ( Planning Engineer) , Reynolds Metz. (Assistant Zoning Officer). ABSENT : Barbara Holcomb , Arnold Albrecht . ALSO PRESENT : Attorney David Gersh , Ken ErdmanPaul Erdman , Ellis Erdman , Frank Grosso (Architect ) , Ken Allen (Drainage Engineer) , Peter Brussard , Milo Richmond Robert Clausen , David Bates ( of Cornell University) , members of the press and radio and approximately 6 'Interested citizens . Also , Charles Schlough , Vice - President . PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING THE PRELIMINARY SITE PLAN FOR STAGE 1 OF PHASE 1 , OF THE BEACON HILLS DEVELOPMENT ON TROY ROAD , WHICH INCLUDES 60 DWELLING UNITS CLUSTERED IN 21 BUILDINGS AND A 1 " 3 / 4 ACRE ;POND . The Public Hearing was officially opened by Mr . Christianson o at 7045 p . m . Mr . Christianson began by noting for the record that this Public Hearin; has been duly published and posted ; he is in receipt of an Affidavit of Service by Mail of the Notice of this Hearing mailed by the Attorney for theProjectMr . Gersh , to those people that were required to be notified * and also that he is in receipt of an Affidavit by the Town Clerk attesting to the posting and publica� tion of the Legal Notice of this Hearing . He noted also that a Quorum was present . He further stated that this is a special meeting with the sole purpose of holding a Public Hearing on the Beacon Hills development . As a preface , Mr . Christianson pointed out that there are several alternatives open to the Planning Board at this Hearing . ( 1 ) Grant approval of Stage 1 of Phase 1 . ( 2) Grant approval with conditions . ( 3 ) Recommend that the Town Board does not approve Stage 1 of Phase 1 . Mr . Christianson stated that there are some things that must be complied with , and the Developer has been notified of the require - ments . There I: s a list two pages long of these requirements which will be covered during the course of the Hearing , He stated that if it is the feeling of the Board that Stage 1 of Phase 1 is acceptable , approval can be stated even with a few modifications required . If there are no substantive changes , and the Board should decide whether any changes are substantive or not , they may consider the preliminary site plan and gave it approval as a final site plan and waive the necessity of an additional Public Hearing . The Planning Board cannot give approval without Health Department approval and this was applied for today so any recommendations must be made with ' . r Town of Ithaca Planning Board � 2- May 15 , 1973 that in mind . The Chairman now turned the discussion over to Mr . . Gersh . Mr . Gersh thanked the Board for calling for this Public Hear ing . He stated that the Developers have attempted to satisfy the requirements of the Planning Board . In the matter of the Homeowner ' s Association which is of concern to Mrs . Holcomb Mr , Gersh stated that the Resolution , as adopted by the Town Board , provides for other assurances . He stated that the first 60 units are to be rentals , and that he has had many discussion with Mr. John Barney , the Town Attorney , and an agreement has been worked out which he Mr . Gersh feels protects the Town and which the Developer feels is acceptable . Mr . Barney will be making his report to the Town Board at its meeting on the 21st of May . Mr . Gersh stated that if the Planning Board should recommend to the Town Board that a replacement to a Homeowner ' s Agreement is acceptable , . the Town Board would be in a position to adopt the new agreement . Mr . Francese asked Mr Gersh to outline briefly the proposed replacement to a homeowner ' s agreement . Mr , Gersh stated that the Developer will assume the responsibility for maintenance and use of the open areas . The Developer expressly accepts the ' eonsequences if they should fail to do so . That temporary arrangement will continue for a period of 18 months or until the first unit will be sold ] whichever comes first and then the homeownerts association will come into being . • Mr . Gersh stated that present at this Hearing are the Engineer for the project , Mr . Paul Erdman , the Architect , Mr . Frank Grosso , and the Drainage Engineer , Mr , Ken Allen . Mr . Christianson requested that the site plan be presented firsts He listed the requirements and asked for answers , 1 . Buildings to be numbered and assurances from the Post Office on how buildings named and the numbering of the houses . Mr . Paul Erdman stated that the buildings have been located , streets named , and buildings numbered . Mr . Schlough has checked with the pest Office 2 . Have contours been numbered ? Mr . Erdman said that the contours are shown by the elevations . There is now present a Bloc: on the plans showing the Architect , scale , North arrow , and Stage 1 , Phase 1 have been outlined . 3 . Walkways scaled between the buildings . 4 . Water easement should not be under garage pavement . This has been attended to according to Mrs Erdman , 5 . Concern about where the water lines fit between the Town easement . It lovas stated that the lines are now within the Town right of way , 616 Some buildings to be removed and some to stay and to be so labelled . They are noted as such now . 7 . � Spacing between the garages minimum of 28 ' and preferably 30 There are now 30 ' between the garages . Town of Ithaca Planning Board - 31wi May 15 , 1973 80 Open parking lots .. Concern about the one on Bedford Court as to the amount of turn- around area . This has been expanded . 90 1 , 8 parking spaces is desired for each unit , There are now 1 . 8 and 1 ,- 9 ,- 104 . 9 .10 Recreation buildings - « have they been identified and when will they be built ? This is shown and narked as future . 11 . Snow removal in the garage areas . The fence will be moved back and then there will be a place for the snow. 12 . Mini- Parks . Are they labelled ? No . The details are in the set of plans that the Planning Board has . Mr. Christianson asked if there were any problems with those not being labelled . There were none , the detail is sufficient , 13 . Garbage disposal is behind the garage and there might be , snow slides there down from the roof '. The Architect said that he had not really thought: about that , but noted that they do have access to that area and it can be shovelled ; It was eventually noted that the garbage disposal is inside an extension to the garages , as shown on the details . 14 . . Do the culde - sacs have Fire Department approval , Mr , Schlough presented a letter addressed to him c / o Beacon Hills Village , Inc . , • dated April. 25 , 1973 , signed by Fire Chief Charles M Weaver , approv- ing the depth of , the cul - de " sa.cs and the placement of the fire hydrants on the approach side of the garage . units . This letter is attached to th.e official copy of these Minutes and may be found in the Official Minute Book of the Planning Board in the Town Clerk ' s Office : 15i Detail of the road profile and for the right of ,_way that will be deeded to the . Town These are included in the plans . 16i Do you have a new and complete drainage plan? Yes .' 170 Have you taken care of the additional sewer easement ? Yes . In the next sta a the sewer will connect to the private homes on East King , .Road these are West of this Development) and tie into the Clubhouse .. 18 . Lighting , " The Town has asked that the Developer leave openings to tie into . Lighting . in the Development will be custom designed to fit the Developmentj . tt is not complete at this time . The Developer has met with the NYSEG . 190 Mail bores ; The signs on the nail boxes can be considered street signs or signs . It is up to the discretion of the Developer • to see if they fit the Town Sign Ordinance or County street signs . Mr . Francese asked if the street names have been checked with the Post Office . Mr . Schlough reported that they had been . He pointed out that the Post Office does not require street name approval , but that the Developer has checked with then for duplication , J ' Town of Ithaca Planning Board - 4 May 15 , 1973 . 20 . Drainage plan has been submitted . 21 . The water and sanitary sewer detail have been submitted to Mr . Steve Herman of the County Health Department for his approval on this elate , Mr . Christianson noted at this moment that the interim plan for the Homeowner' s Association is OK with the Assessment Department , 22 . Mr , Gersh stated that a letter from him to Mrs , Holcomb dated May 14 , 1973 , has been mailed making formal application on behalf of Beacon Hills Village of Ithaca , Inc , , for consideration of their proposed development under the provisions of Section 281 of the Town Law of the State of New York , This letter is a part of the Official Minutes of this Hearing . Mr , Ch3:3. stianson asked if there were any questions from the members of - the Planning Board . There were none at this point , so he requested questions from the floor , Mr . Milo Richmond asked the Planning Board just what it is they are thinking about approving here tonight . The Chairman stated that it was conditional approval of Stage 1 of Phase 1 , which the Planning Board feels is a great opportunity for them because if Stage 1 does riot come off the way they want , they could take a long time for Stage 2 to come along , The Architect showed the plan to Mr . Richoond , There was a question as to how long it would take to complete the 60 units . The time schedule is 6 months . Mr . Kroohs noted that the walkways go from the . garage to the buildings and no where else . He noted also that one cannot get from cluster to cluster unless one goes on the grass . This would present a problem with. visiting . The Architect stated that they had decided not to have any paths . Mrs Kroohs questioned that there are no walk ways to the pond . The Architect pointed out that one could walk on the _ pond perimeter , Mr . Lowe asked how sharply does the pond drop off . He was told that the embankment had an interior slope of one on three , Mr Kxoohs referred to the landscape plan and asked about the fence line , He thought it was a right of way . Mr . Erdman said that they will be getting a letter from the NYSEG to use their easement for right of way purposes for Beacon Hills Drive , There were no further questions . Mr . Christianson noted four conditions that have appeared .- is ppeared ,1 , Town Board OK homeowner ' s agreement , 2 . Health ]Department OK, 30 Lighting Plan OK by NYSEG . 4 , Water and sanitary approval from Steve Herman .- Mr . erman .Mr Kroohs wondered if the Planning Board should make a Town of Ithaca Planning Board = 5 - May 15 , 1973 recommendation as to the concept of the homeowner ' s association . It • was agreed they should . Mr . Christianson asked now that the Board move on to the Drainage plan . Mr . Ken Allen addressed the Board and stated that there had been previously submitted a 100 scale drainage plan along with a drainage report . This present plan now being shown is very similar to that previously submitted , except that there is now a 50 scale detail of the ,3tage 1 of Phase 1 . He stated that they are meeting with the NYS Department of Environmental Conservation next Monday and the results will be forwarded to the Town as an Appendix to the original drainage report . He outlined the retention capabilities of the pond . The pond will limit run- off approximately to its existing flow. A . copy of the Drainage - Report is on file at the Town Planning Engineer ' s Office , The legend is shown on the plans . Mr . Richmond referred to the Cornell Bog that is adjacent to the proposed Development and stated that the Bog cannot stand any less drainage at alli Mr, Allen stated that there are two foot contours here , and there. is no drainage into the Bog it goes down the hill . There will in no way be any drainage taken away from the Bog . Mr . Richmond asked how was the Survey taken and he was told by aerial photo methods , • Professor Robert Clausen of Slaterville Road speaking on behalf of the Bog stated that he was puzzled by the apparent difference between the contours shown on the plan and what you actually see up on the hill . He thought that the little basins should be shown , Mr . Paul Erdman pointed out that there are two foot intervals . Mr . Christianson was of the opinion that it is almost impossible to do it by eye . Mr . Allen stated that the accuracy is of a much higher calibre than you can get by field method . Mr . David Bates of Forest Home explained the importance of the Bog : He stated that it could stand a little more water d a very little o but not: any less . This Bog , he stated , is very unique . Their major concern is not to block development but to assure that it will not impair the Bog . There are , it seemed to him , several adjustments that: can be made . Professor Clausen outlined the uniqueness of the Bog , It is known all over the world since 1880 when Professor Dudley found coastal plants there that generally only grow in the southern coastal area of the U . S . There is oak - pine association , dwarf cherry , the heath male -berry and two perennial sedges . No one has yet come up with why they grow in this spot , Cornell University bought the land from Mr . Wrisley . It is heavily used by students for research and for classes . He noted that parking has not been a problem for students but wondered what would happen along that line if the land were developed , The Bog is plus or minus six acres , Mr . Lowe wondered what would happen if a mistake were made , A quantitative answer came from Mr . Clausen when he stated that roughly in one year you would lose a few things and in two years you would lose more and for ten years you might lose most of what you have , Town of Ithaca Planning Doard "6 - May 15 , 1973 • Mr . Francese asked if the road would be detrimental ? Mr . Bates stated that it would depend on how it is done . Not having a ditch on the back side is iuportant , If the road were raised a little and without a ditch it would have minimal effect , There would be , however , a danger of salt in the winter should it run off into the Bog , He suggested having the road tilt ever so slightly to the East., Mro Christianson asked how the Developer can work with the Cornell people to work out a good plan . Mr , Paul Erdman noted that there is rock within feet , but that the Developer would be more than happy to work with the Bog people on the grades . Mr . Peter Brussard of Brooktondale stated that the Cornell people see no objection to Stage 1 of Phase 1 There was a discussion of the drainage and swalesogoing right through the clusters , The Engineer stated that some of at will , but it was done so consciously . One suggestion was to move the road over and put the clusters on the south side of it . The Architect stated that they put the road through to eliminate crossing roads so that housing IS on a pedestrian green belt . The consensus of the delegation from the Cornell Bog is that a good and proper solution can be worked out in the later stages .. • Mr . Kroohs referred to the sub - slab drainage , drain tile below each concrete . slab , no roof drains , and no gutters . Mr . Christianson asked Mr . Kroohs if he had all of his questions answered on drainage , . Mac , Kroohs stated that he had no more questions at this time , the: Engineers have done a pretty good job with this stage and there will: be very little drainage going outside ofthat particu� lar area , Mrs Fra.ncese asked if it were acceptable to the Town Board to approve only the drainage for Stage 1 of Phase 1 . The Chairman stated that it is acceptable the Town Board is not accepting a complete drainage plan , but that the Planning Board is looking at the overall picture too , Mr . Allen went over in general teras the overall picture of the drainage . Mr . Kroohs wished that the record show that a copy of the 100 scale plan of the entire Development , including drainage , has been given to Professor Clausen and a request has been made for his written comments . Mr . Christianson suggested that the Planning Board look at the landscaping plans at . this point and turned this portion of the Hearing over to Mr , Scannell , Mr . Frank Grosso , Architect , presented a preliminary landscape • plan for Stage 1 of Phase 1 , It is preliminary because they plan to use _ some of the trees that are in the wooded areas and transplant a the , Mr . Scannell stated that it has been suggested that a very few of the trees are transplantable . Mr . Erdman stated that the Developer Town of Ithaca Planning Board - 7 - May 15 , 1973 has talked to Mr . Howard Stevenson of the County Highway Department . with reference to the entrances and roads and the trees that they will be planting . There will be a mixture of deciduous and evergreen trees , large and small scale plantings , and flower beds in each of the mini- park areas . Mr . Scannell stated that he could see nothing basically wrong with their using mugho pines . However , they should be aware that this type of pirle will require a lot of spraying . He would suggest their using taxis hixsi . He also pointed out that Mountain Ash is Sorbus and not the term used on the plan . He would further suggest that the Developer have a Landscape Architect on the job . The Architect stated that they will have one . Mro Christianson asked if there were any further comments on the landscape plan, There were none . Mr . Christianson asked if there had been any other requests that might have come up in the last day or so . Mr . Harris asked about hydrants and Mr . Kroohs stated that they are shown on the 50 scale . There followed some discussion of the distances of the garages to the dwelling units . It was suggested that they be moved into 20010 The Chairman asked again if there were any further questions or comments . There were none and so he listed the items to be considered as part of a possible resolution . 1 . The Town Board must approve the homeowner ' s association agreement .. 20 Lighting Plan 36 Water dnd sanitary sewer detail . 4 . Assurances of further discussion of the handling of the Bog with Cornell University . Mri Kroohs stated also that he has to check the road profiles and cross - sections . Mri Christianson stated that it was his assumption that we have no substantive changes - - this was agreed by the members of the Planning Board ; This being the case , it was stated by the Chair that the Planning Board has waived the necessity of a Public Hearing on the final plan . MOTION by Mr . Robert Scannell , seconded by Dr John Lowe & WHEP.EAS there are no further substantive changes in the proposals that have heretofore been presented to the Planning Board by Beacon Hills Village for Stage 1 of Phase 1 of said Development and those being presented at this Public Hearing , BE IT RESOLVED , and it is hereby resolved that the Planning Board waives the necessity for a Public Hearing on the final site plan and considers the preliminary site plan presented at this Public Town of Ithaca Planning Board - 8- May 15 , 1973 Hearing on this day , May 15 , 1973 , to be the final site plan , and • further THAT said final site plan shall be numbered Map No 335 and shall be filed in the Town Office : There was no further discussion and a vote was called for by the Chair . Ayes - Sam Slack , Jack Lowe , Daniel Baker , Robert Scannell , Maurice Harris , Robert Christianson, Nays - None . Carried unanimously . MOTION 'by Mr . Daniel Baker , seconded by Mri Sam Slack : RESOLVED that the final site plan for Stage 1 of Phase 1 of Beacon Hills Village be approved and hereby is approved by the Planning Board of the Town of ' Ithaca , with the following conditions : 1 That said plan be approved by the Tompkins County Health Department , 20 That: the Street Lighting Plan be agreed to by the New York Stage Gas and Electric Company ; 3 . Thatethere be agreement with and approval of the water and sanitary sewer detail drawing by the Tompkins County- Health Department , 4i That: there be assurances that further discussion will be held between the Developer , Beacon Hills Village , and Cornell University concerning continuity of the character of the area adjacent to the proposed Developmentknown as the Cornell Bog ; and 50 The the appropriate road profile be approved by Kenneth Kroohs , Planning Engineer of the Town of Ithaca , There was no further discussion and a vote was called for by the Chair . Ayes - Sam Slack , Jack Lowe , Daniel Baker , Robert Scannell , Maurice Harris , 'Robert Chri istianson, Nays - None . Carried unanimously . MOTION by Mr , Maurice Harris , seconded by Mr Daniel Bakero • RESOLVED that Nancy M. Fuller , Secretary to the Planning Board of the Town of Ithaca , be appointed to receive at the Town Office information and/ or plans and/ or agreements pertinent to the proposed Development , Beacon Hills Village , on or before May 21 , 1973 , Town of Ithaca Planning Board - 9 - May 15 , 1973 There was no further discussion and a vote was called for by the Chair . Ayes - Sam Slack , Jack Lowe , Daniel Baker ' Robert Scannell , Maurice Harris ,, Robert Christianson . Nays - None . Carried unanimously . MOTION by Mr Maurice Harris , seconded by Mr Robert Scannell * RESOLVED that the Planning Board of the Town of Ithaca recommend and hereby does recommend that the Drainage Plan as presented to said Planning Board for Stage 1 of Phase 1 of Beacon Hills Village at the Public Hearing held . in the Town Office on May 152 1973 , be presented to the Town Board of the Town of Ithaca on the 21st day of May , 1973 , for their approval . There was no further discussion and a vote was called for by the Chair , Ayes a Sam Slack , Jack Lowe Daniel Baker ' Robert Scannell , Maurice Harris , Rbert Christianson , Nays - None , • Carried unanimously . MOTION by Mr . Robert Scannell , seconded by Mr . Maurice Harris : WHEREAS it has been stated by the Developer of Beacon Hills Village that there will be an interim plan for maintenance of grounds and properties 'by said Developer within the proposed Development prior to the formation of a Homeowner ' s Association , therefore BE IT RESOLVED that the Planning Board of the Town of Ithaca approve of and hereby does approve the concept of such an interim plan during such time as Stage 1 of Phase 1 is considered to be a rental property with a time limit of a suggested 18 months and .that during such interim the Developer will be responsibleformaintenance and upkeep as outlined in the Agreement to be formulated between the Town Attorney and the Attorney for Beacon Hills Village , There was no further discussion and a vote was called for by the Chair . Ayes o Sam Slack , Jack Lowe ; Daniel Baker , Robert Scannell , Maurice Harris , Robert Christianson . Nays - None . Carried unanimously , 0 i Town of Ithaca Planning Board - 10 - May 15 , 1973 As an after- thought , there was a discussion of the mail boxes and whether they are to be thought of as signs or street signs . � Several recommendations were made by the members of the Planning Board for changes . Mr . Christiansonasked if the Planning Board interprets them as street signs or as an advertising sign . It was the consensus of the Planning Board that it is a street sign situa- tion . Mr . Schlough stated that Beacon Hills Village has met with the Postmaster and that he ( Mr . Schlough) will present their plans at the Town Board meeting on the 21st of May . A Motion to adjourn was presented by Mr . Sam Slack and seconded by Mr . Harris . The vote was unanimous and the motion carried . The Chairman closed the Public Hearing at 9olO p . m .
