HomeMy WebLinkAboutPB Minutes 1973-05-01 TOWN OF ITHACA PLANNING BOARD MAY 1 , 1973 A regular meeting and a Public Hearing of the Town 'of Ithaca Planning Board was held on Tuesday , May 1 , 1973 , in the Town Offices at 108 East Green Street , Ithaca , New York , at 7 : 30 p , m , PRESENT : Chairwoman Barbara Holcomb , Robert Christianson , Daniel Baker , Jack Lowe , Robert Scannell , Peter Francese ( Planning Consultant ) , iKen Kroohs ( Planning Engineer) , David Cowan (Zoning Officer) , Reynolds Metz (Assistant Zoning Officer) . ABSERE : Sam Slack , Maurice Harris , Arnold Albrecht . ALSO PRESENT : Herbert Mahr , Michael Suttoni , Ben Boynton , Mr . and Mrs . Montgomery May , Bev Livesay , Martin Liberatore , David Gersh , Ken Erdman , Ken Allen , Frank Grosso , Charles Schlough Walter J . Schwan (Town Supervisor) , Noel Desch (Town Councilman) , Richard Black , and members of the press and radio . The .weeting was opened at 7 : 45 p . m . by the Chair . There were no Minutes to be approved . In the way of routine business , the Planning Board spoke briefly concerning a . request for final approval from Mr . Arthur "Dutch" Prince , for his development on. St . ! Catherine Circle . There has been no substantial change in the plans previously presented , except that the three lots that had been in question and at one point were going to be put into one , are now finally being laid out as three separate lots . Mrs . :Holcomb stated that there would not be sufficient time to discuss this request at this meeting and it was agreed to place Mr . Prince first on the Agenda for the June 5th meeting . DISCUSSION OF :PROPOSED EXTENSION TO SAM PETER ' S TV STORE ON DANBY RD . At the last meeting of the Planning Board , Sam Peter , through Mr . Cowan , had made a request for permission to construct a storage building behind his existing appliance store in a commercial zone . That meeting was held April 24 , 1973s and a quorum was not present . Mr . Cowan stated that Mr . Peter ' s Deed shows that his lot has a 165 ' frontage and a 250 ' depth , however , the State has absorbed some of this property for the truck turn- off and weighing station at the top of the Route 96 Hill going down into the City . Mr . Cowan noted that there has to be a recommendation from the Planning Board before . he can take the request to the Town Board . MOVED by Mr . Robert Scannell ; SECONDED by Mr . Robert Christianson - - RESOLV.EDh t at the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board that the plan presented by Mr . Sam Peter for extension of his store be approved . There were no questions and the Chair called for a vote . Town of Ithaca Planning Board - 2- May 1 , 1973 All members present voted aye and the Motion carried . SCHEDULE OF MEETINGS . It was agreed that the 22nd of May , 1973 , will be the date of the next meeting of the Planning Board and the sole topic will be the proposed .Zoning Ordinance . Future meetings will be June 5 , and June 19 , 1973 „ PROPOSED ZONING ORDINANCE . Mr . Francese gave out copies of that part of the new Zoning Ordinance that: has been typed and stated that this is just a taste of what is to come . PUBLIC HEARING - - PROPOSED SITE PLAN FOR GROFF ASSOC . MULTIPLE RESIDENCE PROJECT ON ELLIS HOLLOW ROAD IMICH INCLUDES 100 UNITS OF HOUSING FOR THE ELDERLY . At 80600 p . m . Chairwoman Holcomb opened the Public Hearing , read the Legal Notice as published in the Ithaca Journal on April 27 , 28 , and 30 , 1973 , and presented the Town Clerk ' s !-Affidavit of Posting and Publication for the record . Mr . M %chael Suttoni , Architect for the proposed project , appeared before the Planning Board . He stated that there will be i 2502000 sq . ft . of land for the elderly . This is Just the front portion of the total area zoned for multiple residence . The rear portion will be shown only in a preliminary stage . The plans now represent the total development of the first phase . Some changes have been made as per the suggestions of the Planning Board made on April 3 , 1973 . There will be six inter- connected buildings with a , community building at one end with four apartments over the community building . The elevation along Ellis Hollow Road will be higher aid there will be a irm which will buffer the road . The community room contains about 2 , 000 sq. ft . A plan for the first floor of the community building was displayed , There will be washer and dryer accommodation. There will be bulk storage . Again referring to the site plan , Mr , Suttoni noted that there is now more parking allowed - - 1 . 3 per dwelling unit . Mr . Herbert Mahr asked who owns this project and he was told Groff dissociates now known as Full Services , Inc . This includes Mr . Trammel of Buffalo , . Mr . Ben Boynton of Ithaca and Mr . Groff of Horseheads . Mr . Mahr asked if there were any provision for the public and upon being told "noQ ° he asked if this project was private property. He was told ° ° yes ° 0 Mr . Francese asked to check the scale and Mrs , Holcomb asked how high is the building and she was told two stories . She asked what that meant in feet and was told 161 to the eave and 241 to the ridge , Mrs . Holcomb stated that the rear yard must not be less than twice the height cf the closest structure -- which means that it must be approximately 401 and it is only 2010 Mrs . Holcomb asked how many parking spaces are designated and she was told 131 . She stated that they need 133 and 1 / 3 . 4 1 Town of Ithaca Planning Board - 3 - May 1 , 1973 Mr . Kroohs asked Mr . Suttoni if he had checked with the City about their bus going on to a private road . He said he had and that they will come on the land if there is sufficient demand . Mr . Francese asked if the trash question had been taken care of by having it collected in a screened area and will there be private collection? Mr . Suttoni stated that he could not answer that question at the moment . Mrs . Holcomb noted that the entrance on the proposed loop road is the one that the Planning Board wanted removed . Mr . Suttoni said that he -was under the impression that the Planning Board was not satisfied with the " turn around" previously proposed , He stated that the road will be one way . Mrs . . Holcomb said that she thought the problem was that the loop road should not have three driveways in such a short distance . Mrs . Holcomb stated that the proposed area of 584 sq . ft . for each apartment is acceptable . Mr . Suttoni now turned to the Courtyard . Mrs . Holcomb stated that she knows that the Senior Citizens want it and it was her opinion that 1:he application for _ approval will have to be amended to include a request for a variance . The Courty rd is 681 by 3001 . Mr . Cowan : thought that one possibility would be to consider the Courtyard as being a part of three buildings so that each could conceivably have its own court , but since there is the community building at the end , this would not work . Mr . Suttoni felt that there is no question but that the Courtyard is a violation . Mr . Kroohs asked if there were ramps next to the stairs inside and he was told " yesP ° . There are ramps , chair riders , and stairs in case of fire . Mr . Francese asked if the building were masonry and he was told that it is wood and that there are fire walls employing steel studs , fire doors with Underwriters ' approval . The walls have a two-hour rating . Mr . Kroohs asked if there were utility and drainage plans .. Mr . Suttoni pointed out that on the site plan drainage was shown on the parking lot , catch basins at the West end of the parking lot and a pipe will carry the water under the community building to a drainage Swale . Mr . Kroohs stated that the Planning Board must have a drainage plan as a separate plan with catch basins , etc . , marked on it . Mr . Francese asked if an elevation plan were ready . Mr . Suttoni displa; ed the plan showing the elevations , cedar panelling on the outside , . . slidin.g windows , and the shadow effect on the face of the building , There is a shed roof on the community building . Mr . Suttoni fealt that the project was very residential in effect • with a peaked roof and the cedar siding . Mr . Montgomery May asked what will be in the Courtyard . Mr . Suttoni stated that they have at the present time merely shown a basic plan and the final touches will be worked out with the Elderly and the: Management , however , there will be a real attempt I Town of Ithaca Planning Board - 4- May 1 , 1973 to keep the circulation easy . Mrs . Holcomb went over some items that the Senior Citizens had desired be included . ( 1 ) Air conditioning sleeves in the walls . Mr . Suttoni said that they - are in there . The air conditioner is an optional piece of equipment , ( 2) Six washers and dryers . Mr . Suttoni said that there are fivevof each , and that sorting space has been provided for . One possibility could be to have six washers and four dryers if this is acceptable to the Senior Citizens . ( 3 ) 60 to 75 cu , ft , of dry bulk storage per unit , Mr . Suttoni said that they have provided more storage than required by F . H . A . within the units themselves and further , that the occupants will have more space in the bulk storage areas , ( 4) . Fire protection . Mr . Suttoni said that there is a fire separation wall for each four units . (5 ) Community room to be 2 , 000 sq . ft , or over . Mr . Suttoni said - that the community room is 30 ' by 63 ' or 1 , 950 sq , ft Mrs . Livesay asked if the public had seen all 100 units . Mrs . Holcomb stated that there will be 16 per building and 4 on the second floor . of the community building - - the 16 being made ,up of two floors of €3 units each . Mr . Herbert Mahr wished to discuss the entrance on the proposed loop road . He would like to see any entrance or exit on the proposed road eliminated . It was .his opinion that the cars should exit onto Ellis Hollow Road . He also felt that the elderly were being confined to the Courtyyard and surrounded by the buildings like a fortress, Mr . Suttoni felt thdt the entrances on the proposed road were acceptable since it is a proposed limited access road . There was a lengthy discussion between Mrs Mahr and Mr . Suttoni on the merits of entrances and exits . Mr.. Kroohs noted that the bus stopping .,. on one . side of the road was a hazard and there should be an island . Mr . Suttoni agreed . It was also suggested that there be no turn around at all and merely have the bus go right through the entire project . This suggestion was also accepted by Mr . Suttoni , Mrs . Livesay suggested moving the whole development back from the proposed road more than the proposed 50 ' . Mr . Suttoni agreed that that could be done . Mrs . Holcomb referred to one unresolved problem - - that of the Courtyard . Since it may involve a request for a variance the developer will have to go to the Zoning Board of Appeals and make a request for a variance or a special permit , or special approval . Mrs . Holcomb stated further that on the drainage plan to be submitted should be shown whether there is a culvert under the road into the shopping centre . There must be a water and sewer plan shown . County Health Department approval is needed. The utilities must be under- ground . There must be landscaping shown including the Courtyard . Move the building . Bus collection . Garbage disposal . Mrs . Holcomb suggested that Mr . Suttoni return to the Planning Board on the 5th of June . The Planning Board will recommend that the Town Board call for a Public Hearing on June 11 , 1973 , at I Tmrn of Ithaca Planning Board -5 - May 1 , 1973 • their next meeting which is scheduled for May 7th , 1973 , Mr . Scannell noted that drainage is running the wrong way between the parking lot and the building . Mr . Suttoni noted that fact . Mr „ Francese stated that he was also very concerned about the rear lot line . Mr . Scannell stated that it appeared to him that the building 31: s fronting on the proposed road so the 20 ' between the building and the north property line could be considered a 20 ' side yard . He felt: that the building can be moved to the east about ' 60 ' and then it will have . a 40 ' rear yard . Mrs . Montgomery May stated that she was concerned with esthetics , since the shopping centre is so ghastly . Mr . Francese suggested planting fir trees on the birm . Mr . Scannell disapproved of the use of .fir trees . He suggested using something else . There being no further questions , Mrs . Holcomb officially closed the Public Hearing at 9010 pm . MOTION by Mrs . Holcomb , seconded by Mr , Robert Christianson : RESOLVED that the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board of the Town of Ithaca that they hold a Public Hearing on June 11th 1973 to consider the proposed site plan for Groff Associates housing for the elderly on Ellis Hollow Road . There was no further discussion and the Chair called for a vote , All members present voted aye , The Motion was carried . _ M CORNELL UNIVERS 61TY CHILLED WATER PLANT PROPOSAL , Mr Mart * Liberatore of Cornell University presented a plan for a proposed chilled water plant to be constructed on the Campus . He staged that it was merely a box to house the machinery required , situated near Route 366 , Mr . Kroohs noted that the eleva- tions were shown. , the drainage was adequate , the height was indicated and that the tower involved would be completely hidden . by existing trees , indeed , the entire building would be hidden from the road . Mrs . Holcomb stated that she was mainly concerned with how the proposed plant related to what is already there , effect of traffic generated , and drainage as it effects any existing properties . Mr . Kroohs stated that he could see no problems with the proposal in those areas . The members of the Planning Board agreed in concept with the proposed plant and thanked Mr . Liberatore for coming in to this Board with their plan . • PRESENTATION OF PRELIMIU01-Y DRAINAGE PLAN FOR BEACON HILLS . 11 Mr , David Gersh , Attorney for Beacon Hills Village , addressed the Planning Board and introduced the gentlemen who are associated with the development . Those present were ° Charles Schlough , Vice - President ; Ken Erdman , Developer ; Ken Allen , Drainage Town of Ithaca Planning Board - 6m May 1; 1973. Engineer ; Frank Grosso , Architect with the firm of Handler and Grosso . They presented the site plan showing Phase 1 of the project in detail and showing the other phases in general as well . Mr ,, Grosso presented the architectural aspects of the design , and the master plan for Phases 10% 2 , and 3 . He indicated that Stage 1 of Phase 1 consists of 60 units being contained in 6 clusters with a pond . He pointed out the building locations , roads , garages , etc . , for Phase 1 , Stage 2 , stating that there had really been only trivial changes made . The clusters and the roads are the same as previously presented and the density is the same . Quiet places have been added , there are now small kiddy areas for play and a large recreation space for active sports , The pond has been reduced in size . The golf course is large but it is not a pro course . Total Phase I will include the first hole and a putting green . Mri Francese noted that there is a multiple area reserved but noted that approval for multiple residence has not been given . Mr. Christianson asked how does one get to the ball field but this was not answered . The architectural drawings for the buildings include fences , mail boxes , and all the building elements . Mr . Grosso went through the whole set of plans discussing the elevations , one " story units , town house units , cedar siding , construction sections ; four plex units , duplex elevations , fireplaces , construction• details ,garages being clustered . There is a garage for each unit plus t least one = half space per unit for guest parking which is better than 1 . 5 spaces per unit . He showed where the garbage will be stored in a covered element by the garage . There was shown a minimpark for each cluster which will have two benches . He showed a sign detail for the mail boxes and a mail box detail . Mr .. Kroohs asked about the clubhouse for the golf course and he was told that it will be part of Phase 1 , Stage 2 and .will include a swimming pool . Mr . Kroohs also asked about the maximum I ength of the cul de sacs and the public road . He was told that that would probably have to be in Phase 1 , Stage 2 . Mr . Ken Allen , the Engineer in charge of drainage , presented the drainage plans . He stated that the scale is 1 equals 10018 He indicated on the plan the drainage contours and how the project will be connected to the existing sanitary sewer line by gravity , He noted that there is an existing water main along King Road which they would connect to . He discussed the storm drainage and how it connects to the existing culverts and presented a Drainage Report , The Drainage Report contains tables , indicates drainage area , and the quantity of water - to flow through each culvert . It takes into consideration the 10 - year storm and includes recommendations for culverts to be built or agreements where the County has agreed to improve culverts under County roads . The pond is an integral part of the drainage plan serving as a retention pond, It was stated that the County has a;;reed to expand the culverts on Coddington Road and Troy Road . Mr . Kroohs noted that the Developer is going to excavate Town of Ithaca Planning Board - 7 May 1 , 1973 to rock for the pond , rill in the cracks and truck in fill to build • the embankment . Mr „ Allen noted that the Developer has allowed for two and , one half time :; the 100 - year storm and this is in accordance with standards set by New York State . He presented a detail of the earth dam . He also indicated that there would be wooden fencing around the pond. Mr . Black asked what the level of the water would be in the pond and Mr . Allen said it would be about one foot at the shallow end . The pond encompasses one and three-quarter acres : Mr . Allen also showed the drainage out of each cluster unit . The existing drainage pattern is maintained . There are four culverts along Troy Road and one down by Troy Road . Supervisor Schwan asked where on the plan is the power line indicated . Mr „ Allen pointed out the line and Mr . Francese noted that the Developer is putting the road over the power line , Mr . Allen indicated that they have an okay to do so . Mrs Francese stated that they should have that in writing . Mr . Francese asked if they are going to remove the farm house and he was told that they are . Councilman Desch asked how the Developer plans to prevent the sheet run- off that happens every spring unless hey intercept the water by cutting into the rock . It was indicated that the houses will be built on slabs . Mr . Desch stated that it is important to get the • water before it gets to the rock . Mr . Allen stated that there will be farm drains around each slab or footings . Mr + Desch requested that all this is shown on the drawings . In connection with the pond situation , Mr . Kroohs stated that the Department of Environmental Conservation seems to be saying , in his opinion , that the pond is too small for their jurisdiction . However , plans must be submitted to DEC when you are in a classified stream area . Mrs . Holcomb stated that the Planning Board will take the drainage . plan under advisement and read the report . If there are any questions , the Planning Board will contact the Developer before the . 5th of June . Mr . Kroohs stated that an easement for the extension of the sewer to the west property line for the purpose of serving the two houses on King Road west of this development was requested . Mr . Gersh stated that it is critical to this development that advantage be taken of the short building season in Ithaca and we are already into May . The expense of each week of delay is tremen- dous . He would urgently request that the Planning Board call for a Public Hearing tonight to be held two weeks hence and then hold a special meeting following the Public Hearing . • Mr . Schlough stated that the Developers had antic ' • p anticipated a building permit before this point in time . They have equipment at hand . He would also urge that the Planning Board give them every consideration in order. that they might get going as soon as possible . J Town of Ithaca Planning Board -8 - May 1 , 1973 • Mrs . Holcomb stated that the Planning Board has three separate problems to juggle . ( 1) The drainage is ultimately a Town Board problem , but in addition to the meetings that the Planning Board must have on this question , there are meetings scheduled already for the Town Board ,. ( 2.) Two weeks from tonight the Chair will be out of Town and will not return until the 21st of May . The Planning Board meeting of the 22nd of May is reserved for the Zoning Ordinance . Mrs . Holcomb pointed out that the Board had spent a great deal of time last summer with Beacon Hills at the expense of the Zoning Ordinance . ( 3 ) There is a problem of the legality of the Homeowner ' s Association as It relates to a condominium . This is a legal problem for the Town Attorney , Mr . Schlough stated that when the rezoning was granted there were certain conditions relative to the condominium approach . There is a basic problem with the intent to sell under a condominium basis . They are re -working that agreement . Subdivision of lots is inconsistent with condominium laws . The County Assessor says it is unreasonable to develop . this project as a subdivision . Mr . Gersh noted that the language of the resolution granting the re - zoning states that Beacon Hills will submit a homeowner ' s agreement for approval or other satisfactory assurances . Mrs . Holcomb requested the feelings of the members of the • Board . Mr . Francese suggested a meeting on the 8th of May . Mr . Kroohs felt that: that would not give him enough time to check the drainage plans and the site plans , A discussion of scheduling followed noting that there must be a resolution from the Planning Board re drainage to the Town Board , Mr . Gersh read from Section 281 and referred again to the alternate assurances . Mr . Scannell asked how much does the Planning Board need . Supervisor Schwan asked if the Deputy Chairman of the . Planning Board could hold a meeting on the 15th of May . This was agreeable to the Deputy Chairman , Mr . Robert Christianson , Assuming that a quorum is present , the members of the Planning Board agreed to hold a Public Hearing on the 15th day of May , 1973 , for site plan and drainage . Mr . Schwan suggested that the Town Board meeting being held on the 7th of May could be adjourned and re - opened on the 21st of May . Mr . Gersh expressed the deep appreciation of the Developers of Beacon Hills Village for the extraordinary considerations afforded to them . Scannell : MOTION by Chairwoman Barbara Holcomb , seconded by Mr . Robert RESOLVED that the Planning Board of the Town of Ithaca will hold a Public Hearing to consider the preliminary site plan for Stage 1 of Phase 1 of the Beacon Hills Development on Troy Road on the 15th day of May , 1973 , at 7 : 30 p . m . in the Town Offices . The Chair asked if there were any further questions... There was none and a vote was called for. All members present voted aye . The Motion was carried . J Town of Ithaca Planning Board - 9 - May 1 , 1973 Mrs . Holcomb noted that because of changes in the law • effective January 1 , 1973 , the preliminary Public Hearing on May 15 , 1973 , could , if no substantive changes were requested by the Board , be declared a final Public Hearing by resolution of the Board . Mrs ,. Holcomb requested that Beacon Hills Village notify all adjacent property owners and the County since it is on a County road . She further stated that any questions or comments that the Planning Board has will be transmitted through Mr . Schlough , The Meeting was adjourned at 11 ° 15 p . m .
