HomeMy WebLinkAboutPB Minutes 1973-01-16 TOWN OF ITI-1ACA PLANNING BOARD January 16 , 1973 A regular meeting of the Town of Ithaca Planning Board was held on Tuesday , January 19 , 1973 , in the Town Offices at 100 East Green Street , Ithaca. ., New York , at 7030 p . m . PRESENT : Chairwoman Barbara Holcomb , Sam Slack , Daniel Baker , Robert Scannell Robert Christianson Maurice Harris Peter Francese ( Planning Consultant ) , Ken Kroohs ( Planning Consultant ), David Cowan ( Zoning Officer) . ABSENT : Jack Lowe , Arnold Albrecht . ALSO PRESENT , Mr . Suttoni Mr . Norbert Schickel Mr . John MacDonald ( attorney for Mr . Schickel ) , Mr . Philip .Whtte , Mr . May , Mr4 Herbert Ma.hr , and several interested citizens . REPORT OF ZONING OFFICER Mr • Cowan spoke unofficially to the Planning Board about some problems concerning the large lighted sign and revolving beacon at the Odd Fellows Home , on Trumansburg Road . He stated that there has been no permit: issued by the Zoning Officer for such sign and beacon and according to a letter received from Mr . Armand Adams , attorney , the Odd Fellows were not aware that , a permit was required . Mr . Cowan stated that under the existing Zoning Ordinance for the Town according to Section 19 there are no signs permitted in an R=630 District which is the categolryoof district that the Odd Fellows Home is in . Further , under the new sign law , and Section 5 , page 3 ; flashing signs are not permitted anywhere , and under Section 6 no signs a the type at the Odd Fellows are permitted . And ; 20 sq . ft is the ,maxzmum for any sign in the . Tc+wn and this particular sign is much larger . Mr . Cowan stated that under Section 16 of the new sign law which deals with non conforming signsi any sign not permitted shall be removed within three years : Mr . Cowan pointed out that the sign and flashing beacon were installer! with gift funds and more particularly the beacon is a memorial ; After discussion , the consensus of the Planning Board was that the entire question be turned over to Mr . Beyoucos , the Town Attorney , by the Zoning Officer , Now , Mr . Cowan wished to discussa zoning problem arising from the proposed splitting of one lot by Mr . and Mrs . Edgar Bredbenner at 141 Honness Leine . The existing lot is 2.51 ' by 336 ' in an R- 15 zone with an existing house and garage . The Bredbenners would like to have two lots , however , the garage is 133 ' from the street and 35 ' from the house: and only 103 ' from a lot line . In order to subdivide this lot and still have room for the house with a garage , they would be establishirLS a line that is only 3 ' from the lot line . According to the zoning ordinance the line should be no less than 10 ' from the lot line in arL R- 15 zone . Mr . Scannell suggested that the Bredbenners take this matter to the Zoning Board of Appeals and ask for a variance on one lot thc�Lt would be less than 1001 . This was agreed to by the members of the: planning board and Mr . Cowan .. Finally , Mr . Cowan wished to discuss briefly the Snyder Hill ' Road Town . of Ithaca Planning Board 0= 2 � January 16 , 1973 • speed limit signs . He wished to know who puts up the signs and also if it would be possible at the same time the speed limit signs go up to put up "no parking signs . Mrs . Holcomb stated that the Town gets the signs from the County but that the Town puts them up . She also recalled that there has been at some prior date a Parking Ordinance adopted by the Town . Mrs . Holcomb will find that Ordinance in the Minutes and make a report on It * She stated further that from now on there will be a problem about parking on Snyder Hill Rd . The Planning Board will make a recommenda - tion to the Town Board on the 12th of February , 1973 , re Parking , REPORT OF THE PLANNING CONSULTANT C Mr . Francese stated that Mr . Suttoni , architect from Syracuse , is present at this meeting to speak about the proposed housing for the elderly on Judd Falls Road ( Groff Assoc . ) . They are preparing to go to the County and the School District and are operating on the assump - tion that they will obtain the tax abatement that they are requesting from those bodies , in addition to the one already received from the Town . Groff Assoc . are also assuming that they will not get any cut in HUD funds , as a result of the Presidential freeze on HUD funds . Mr . Scannell asked Mr . Francese what is happening presently on Coy Glen ( Parks ) ; Mrs : Holcomb stated that this proposal is temporar - • ily at a halt . Mr . Francese stated that Cass Park Pink is running way over in expenses what had been anticipated in spite of the fact that the facility is extremely popular . He said that the Youth Bureau Direc - tor , Mr . Cutia , is talking about going to the County for funding and further that he might have to go to the Town of Ithaca . EASTWOOD COMMONS o SCHICKEL ENVIRONMENTAL DEVELOPMENT COMPANY SUB DIVISION OFF HONNESS LANE Mr . Norbert Schickel presented a new site plan to the members of the Planning Board dated January 11 , 1973 . He stated that he thought that this plan will cover all the requests of the Planning Board . It shows the driveway to Archie Robertson ; more parking on a 2 to 1 basis ; and other meaningful changes , including parking on the street beyond the shoulder ; storage building for maintenance and parking area for boats and trailers ; covered drainage , some into the creek and the rest down towards lionness Lane which means that water will not go over the west property line ; units # 142 has been tilted to give more space between buildings and units # 14g and 149 might have to be tilted again . Mrs . Holcomb stated that she had two requests from the Town water engineer and the Town Board as follows , 1 . They would request that Mr . MacDonald , Mr . Schickel ' s attorney draw up a 20 ' permanent water easement along the south property line With the understanding that at the time of construction they will ask for a temporary easement that is wider than that . This request is made to provide for the proposed transmission main from Bolton Point . 2 . They would request a general utility easement for the Town l Town of Ithaca Planning Board - 300 January 16 , 1973 • from the North property line to the loop road right of way through the boat and trailer parking area . Mr . MacDonald noted these requests and stated that he would attend to them . Mr . MacDonald then referred to some slight problem with the road right of way easement through the Orcutt property . There is a reservation of title involved her to Pyle which is complete , i . e . , in entirety . ThICs means that Pyle owns the right of way . Mr . Pyle reserved the title for highway purposes . Mr . MacDonald outlined a simple solution to this question- when Pyle conveys the title to Schickel he ( Pyle ) will give it completely , or with title to the three property owners through whose land the right of way runs . Mr . Schickel stated that they will also reserve the drainage right if it is convenient „ Mrs . Holcomb now referred to Mr . Montgomery May , 1360 Slaterville Road . Mr . Schickel will deed 2.5 ' of land to Mr . May along the South Schickel property line which borders Mr . May ' s property . There is a request from the Town to have Mr . May deed an easement to the Town for water transmission line and possible future dra ?nage down to Slaterville Poad Mr . May said that there is a cluster of trees involved . Mrs . Holcomb suggested that Mr . May and Mr . Schickel make an appointment with Mr . Schwan , the Town Supervisor , to solve the two problems concurrently . Mrs . Holcomb stated that the major problem now facing the planning board is parking along the road right of way . The Supervisor has stated that this will not be permitted by the Town . With a 20 ' pave _ trent and fit ' s1ioulders you have a road of 28 ' and when the snow plow comes through with its 14 ' blade there is an immediate danger of burying any car parked on the shoulder , damaging it even slightly or bury hitting it directly . Mrs . Holcomb stated further that any roads constructed by Mr : Schickel and not deeded to the Town do not have to be 20 ' wider There can be no parking on the TOwn road shoulder , but there can be on Mr . Schickel ' s roads . Mr . Schickel stated that lie will produce a plan which will encom- pass what the planning board is saying . He stated further that he did not wish to make the centre road a private road . He did not feel that this is a major problem , and he asked if the board would rely on him to solve this question or do they want him to come back to the planning board . Mrs . Holcomb said no he need not come back to the Planning Board before going to the Town Board , Mr . Francese said that he simply could not see any other solution to the centre road being a Town road and remaining so . He stated that he was not that happy with it , but that he could not see any other way . Mr . Scannell asked about the possibility of creating a culoade � sac as a solution . Mr . Francese dial not think that this was in order since it would create a very bad situation in the entrance to the development . Mr . Scannell remained firm in his opinion that a cul - de - sac could provide a good solution . Mr . Schickel referred to some previous discussions about the large amount of road in his plan and stated that he felt that 14 ' of Town of Ithaca Planning Board " 4� January 16 , 1973 • road per dwelling unit in his opinion is not excessive . He also referred to the question of the use of a cul � de " sac and stated that at this juncture the planning board was getting into a question of design , Visual considerations are very important to the Schickel Environmental Development Co . , he stated . Cul = de - sacs were considered very closely but it was felt that the entering road is the major street scape and then there is the question of fire ( entrance and egress for fire trucks ) and drainage and drainage slope also . Mr . Kroohs asked if phasing would come at a later date and Mrs . Holcomb said that it would be shown later on the final site plan . Mr . Scannell stated that he would not object to keeping the center road in . Mr . May asked where we stand on the drainage plan . Mrs . Holcomb read from the Planning Board Resolution of January 2. , 1973 , to the Town Board , It:erLi # 3 > That no final site plan approval will be given until there has been presented to the Town an acceptable drainage plan with appropriate scale drawings . It is recommended that this drainage plan shall be designed so that the majority of the drainage will be channelled into the creek on the Northwest corner of the property , and further , that the remaining drainage area shall be channelled in a satisfactory manner to enter the roadside ditch on Honness Lane or Slaterville Road . Mrs . Holcomb stated that landscaping will be on • the final site plan . Mr . Herbert Mahr asked which plans will be available for the Public Hearing at the Town Board meeting on February 12 , 1973 . It was stated that the drainage plan will not be available for the Public Hearing . Mr . :May stated that he had completely misunderstood what was supposed to take place . Mr . Schickel stated that the plan presently being viewed revised as of January 11 , 1973 , with adjustment to the parking will ble the one that will be presented to the Town Board on February 12 , 1973 . Mr . ICroohs noted . that the phasing plan should also include pro - vision for temporary drainage . The soil in this area is called Hodgins silt loam . Mr . Francese asked if Mr . Schickel were going to make test borings to see how deep that soil runs . Mr . . Schickel stated that they have already done so . The discussion with Mr . Schickel was concluded at 302.0 p . m . DISCUSSION OF PROPOSAL BY 14AAG AND WHITE FOR. COMMERCIAL AREA ON FIVE MILE DRIVE ( MP,II) ISON ELECTRIC AND APARITMENT CONSTRUCTION Mr . Philip White appeared again before the Planning Board with his proposal for a commercial land use in land zoned for multiple residence use . Messrs . Haag and White have purchased land from Arthur Prince which had been previously presented to the Town Planning • Board by Mr . Rolfe . This land was rezoned to multiple with a specific plan attached to such rezoning . However , this rezoning was not to be considered completed until four copies of the official map of the rezoned property were submitted to the Town Board and to this date said plans have not been received . Town of Ithaca Planning Board M5 � January 16 , 1973 • Mr . Francese suggested that the Planning Board submit a resolution to the Town Board stating that it is their opinion that this land should be reverted to the type of zoning existant at the time of the Rolfe proposal . Mr . Kroohs described in sone detail the land surrounding the proposed commercial use . It is within the boundaries of Route 13 , Route 13A , more specifically Five - Mile Drive and Fidler Road) . Mr . Kroohs presented over- lays of the area as it is zoned now . R- 9 zoning exists for 300 feet on each side of 13A and Ro 30 zoning on the interior . On the East side of 13A there is an area of light industrial and another light industrial area along Route 13 . Mr . Kroohs suboitted another over- lay showing the proposed new zoning of R: l which will incorporate Manion Electric which will then become a non_ conforming use . Mrs . Holcomb summarized as follows : The proposal which Messrs . Haag and White have made is that the parcel on the left and on the right of Fidler Road be rezoned to Commercial . Additionally , they have a proposal for construction of apartments on a portion of the land they have purchased from Prince , although this appears to be their secondary plan . These proposals were presented at the last Planning Board meeting on January 2 , 1973 , and was left with the Planning Board so that they could see where it is and so that they could see what exactly is being talked about .- 0 bout .0 Mri White now showed the members of the Planning Board elevation drax.Angs for ti:Le proposed apartment . There would be one and three4 bedroom units . Mr . White stated that he and his partner had talked with the Health Department and they think the project will be okay with . the Health. Dept , since there is a general feeling that the land should support the apartment project . Mrs . Holcomb felt that it was necessary to separate the Commer� tial Zone and the Multiple Zone . She asked if it made sense to extend the commercial zone or light industrial zone around the corner onto Five - Mile Drive when these zones already exist there on Route 13 . Mr . Francese stated that from a legal point of view the Town Board cannot rezone the land because there is not a plan for the whole site . Mrs . Holcoob led further discussion of whether it makes sense to have a Commercial area here . Mr . Harris asked if this proposal for Madison Electric is commercial or light industry . Mr . Francese said that it could be either . Mr . Baker said that in view of the residential homes in the area , he did not think the land should be rezoned commercial or business . Mrs . Holcomb said that in view of the long- term proposal for relocating Route 13 , we talked a long time ago about leaving the area on Route 13 alone until we see what is happening . Mrs . Holcomb stated further that she had reservations about rezoning to commercial around the corner * the multiple residence is another question . Mr . Scannell stated that he would like to have time to go out and visit the land . His first thought is that he has reservations , but in Town of Ithaca Planning Board - 6 - January 16 , 1973 order to be fair , he would like to look at it . Mr . Francese noted that the developer has enough land here to put in 2 or 3 retail establishments . Mr . Cowan , Zoning Officer , noted that the present Zoning Ordinance says that anybody may propose a Zone that has the adequate size without a specific plan and he quoted - - ` ° general site plan , proposed struc - tures , if any . " It is a prerogative of the Planning Board to request asite plan . Mrs . Holcomb said that natter aside , if we did not consider this a suitable site , then we should not ask the developer to submit fur- ther plans . 'It is Mrs . Holcomb ' s opinion that this proposal might be considered spot zoning . Mr . Harris stated that he agreed with Mrs . Holcomb and felt also that this might involve spot zoning . He stated that he would like to see the light industry container) in the presently zoned area . Mr . White referred to a driveway that comes into 13A from the light industrial area but through land not zoned light industrial . He further stated that their prime concern at the moment is with the Madison Electric proposal . Mr . Francese asked Mrs . Holcomb if she wanted to set a Public Hearing on this proposal and she said she did not . Mrs ; Holcomb then proposed that this discussion be tabled until the 20th of February , 1973 . This was agreeable . Mr . Francese asked , for the benefit of Mr . White , if there were anybody who has any objections to the multiple residence portion of the proposal . There were none . Mr . ,White: requested that he be given a copy of the document referred to previously by the planning board on Spot Zoning . The Secretary will. secure a copy for him which he could pick up at the Town Office orL January 17th . QUESTION OF PROPOSED AGRICULTURAL ZONING FOR MARSHALL FARM ON MECKLENBURG ROAD Mr . Francese said that he would request at this time that the Planning Board speak to a question. he had received regarding the Marshall Farm and whether it is going to be zoned Agricultural . Mrs . Holcomb stated that the indications are that it is outside the Agricultural Zone . The Town has also received an inquiry asking if there has been any thought about . a Commercial Zone in that area . • Mrs . Holcomb stated that the Planning Board has not seriously considered the location of a possible commercial zone . Town of .Ithaca Planning Board - 7 - January 16 , 1973 ELLIS HOLLOW ELDERLY HOUSING - - SUTTONI ASSOC . ArICHITECTS Mr . Suttoni , representing the Architectural firm of Suttoni Associates , out of Syracuse , New York , appeared before the Planning Board to press:nt new plans for the proposed housing for the elderly and apartment ,; on their site at Ellis Hollow Road and Judd Falls Rd . Mr . Suttoni stated that his firm was called in after the land had been rezoned , they were not a party to the previous plan that the Planning Board and Town Board had approved . There are 253 apartments in the proposed plan . He stated that they , as architects , now have serious reservations about the original plan . They have talked with the Senior Cit: izes . He stated that his firm thinks they have cone up with a better Site plan for the entire site . Mrs . Holcomb stated that the problem as she saw it is that the plan that was approved was for 258 units - that is not what is being proposed here . The present proposal is for 100 units of elderly housing on part of the land . Mr . Suttoni stated that what the Planning Board is saying is that there could be a two -way approach show a site plan for 100 elderly units and a schematic plan dor the rest of the land - r or present a total package for approval . Fe asked if the Planning Board has any • objections to the redesigning of this proposed site plan . He was told that they had none . Mr . Suttoni asked what is the possibility of taking the land that was reserved for the future by- pass road and starting actual physical development on it as part of this proposal . This would eliminate the need for some parallel interior road : This was deemed a good idea with a single access . Mrs . Holcomb outlined possible guidelines . Upon the presentation of a preliminary site plan , the Planning Board reacts to said plan , holds a public hearing to react to that . The Planning Board makes a recommendation to the Town Board at which point the Town Board holds a public hearing to react to that site plan and approve it or dis - approve it . At that point everything cones to a halt waiting on the results of the tax abatement request to the County and the School District , Mr . Suttoni wished to know what the Planning Board means by preliminary site plan . Mrs . Holcomb stated that a preliminary plan is like the one! Mr . Schickel presented at this meeting . The Planning Board might give preliminary site plan approval and then the developer brings in a plan with drainage , etc . shown before final approval . Then the developer goes back to the Town Board for final approval . Mr . Francese stated that according to State ruling the Planning Board may waive the final public hearing if the plan is not substantially • changed . Mr . Herbert Mahr noted from the floor that it was his opinion that there are people who have the idea that the loop road is a limited access road . Mrs . Holcomb stated that her conception of this road is somewhere half-way between that . Mr . Mahr felt that this would lead to houses lined up along loop roads again . i Town of Ithaca Planning Board - 3 - January 16 , 1973 • Mr . Scannell felt that this particular road is more a residential access road and there will be another one farther out as a limited access road . Mr . Francese asked Mr . Suttoni in connection with the Planning Board meeting scheduled for the 20th of February , 1973 , if he saw any reason why the Planning Board could not schedule a preliminary public hearing; to look at preliminary plansi He asked if Mr . Suttoni could have plums ready . Mr . Suttoni stated that his fire could have plans ready by the first week in February . Mr , Suttoni requested that he be sent a memo on what the Planning; Board wants and some notes on the proposed loop road . Mr . Francese stated that it was his feeling that the Town Board never intended for that road to be a limited access highway . Mr . Scannell felt that people are thinking; about County ideas and not the Town ' s ideas for a loop road . Mrss Holcomb asked that Mr . Suttoni notify her before the 6th of February whether or not he can have plans available by the 15th of February . Mr . Suttoni said that he would notify her by February 2nd . Mr . Slack said that he would like to hear Mr . Suttoni ' s comments with regard to pedestrian traffic . Mr . Suttoni stated that the pedes - trian traffics intra- site and getting off the site . By being • pedestrian oriented the site is not cut up by a road . The tenants can really walk anywhere within the site , but the automobile is close enough to allow walking to and from a car . Mr . Slack asked further just why the architects are going from the original plan to another one . Mr . Suttoni Said treat the major reason is really himself - he did not like the original plan , Slicing the site down the middle with a road is not good design: . Mr . Suttoni asked if Mr . Slack objected to a change in the plans . Mr . Slack said that he did not e it is just that the planning; board keeps getting a change in plans , Mr Francese stated that he thought that it was right to have a public hearing both at the preliminary stage and at the final stage . Mr . Slack referred to the side road . He noted that Judd Falls Road is taking all the traffic . He felt that the minute the section of loop road we are talking about is built , it will get all the traffic and not Judd Falls Road . The discussion with Mr . Suttoni ended here with the expectation that he will be in contact with the Planning; Board by the first week , in February . DISCUSSION OF AGRICULTURAL ZONE FOR PROPOSED ZONING ORDINANCE Mrs . Holcomb stated that she had made a unilateral decision on her own . The Planning Board is going to have a set of Tax Maps and on these Tax Maps will be a line drawn showing exactly where the Zones are for the new Zoning Ordinance , Mr . Baker , Mr . Kroohs and Mrs . Holcomb decided to look at each of the properties on West Hill and decide whether they belong in or out of the Agricultural Zone . She referred the members of the Board to Town of Ithaca Planning Board - 9 - Janaury 16 , 1973 • the large nap of the Tom on the wall and pointed out that those parcels narked Q ° Yes " are working fares . She reminded the Planning Board members that there had been a petition from residents in the Coy Glen area that wanted to be included in the Agricultural Zone . She noted that: as shown by the nap , we do not have a contiguous Agricultural i. one . The Perry Farm stands alone with a large amount of land and the rest of the ?Jest Hill area is divided into two separate Agricultural sones . Mr . Slack: asked where is the Agricultural District - - a separate entity quite apart from the Town of Ithaca formed under State Law and County control, and not a part of the proposed Zoning Ordinance . Mr . . Baker said that there is no Agricultural District as yet but one is being formed wh1ch includes part of the West Hill Agricultural Zone . Mrs . Holcomb asked the Planning Board their opinion of the three parcels near the Drew Subdivision as to how they should be classified . Mr . Scannell suggested that they be put in Residential . However , Mr . Christianson voiced a concern for those particular hones stating that they night have built their small house there in hopes that since they were in an agricultural zone they could have a horse . There was continued lengthy discussion led by Mrs . Holcomb who referred several tines to the large tax nap on the wall pointing out many questions and many problems , such as the rather extensive development of houses running along Enfield Falls Road and some more strip development along the roads . Mr :. Francese pointed out that . there is nothing against anyone living w3: thin rein Agricultural Zone . There is nothing non- conforoing about a house in an Agricultural Zone . Mr : Christianson asked about the Millard Brink farm . Mr . Herbert Mahr wondered why the Planning Board could not zone . the land the way the people want in specific instances . Mr . Baker felt very strongly that the Perry Farm should not be included in the Agricultural Zone and more specifically that it should be R- 1 . Mr . Baker felt that before the Planning Board makes a final decision the people involved should be contacted . He said that he would be glad to do so . Mrs . Holcomb requested that the members of the Planning Board give some thought to this proposed agricultural zone . IDEMAN PARCEL # (0)O - 1 - 6 ON MITCHELL STREET Mrs . Holcomb informed the members of the Planning Board that although Mr . Idenan says that his parcel # 60 - 1 - 6 is zoned commercial , it is not . Mr . Idenan has been informed of this fact . TRAFFIC LIGHTS ON HANSHAW ROAD AND WArwREN ROAD Mrs . Holcomb reninded Messrs . Francese Harris and Scannell that they were aCommittee to report on traffic conditions on Hanshaw Road and Warren Road with particular reference to proposing a traffic l Town of Ithaca Planning Board - 10 - January 16 , 1973 light for that intersection . They stated that they had not met ; but that they would get right on it . INTENT FOR THE ZONING ORDINANCE Mrs . Holcomb asked Mr . Francese if he had the proposed " Intent " for the Zoning Ordinance with hin . He did not . Mrs . Holcomb directed Mr . Francese to have the proposed Intent in the nail before February 6th , 1973 . He said he would. PROPOSED USE OF PERCENTAGE FIGURES FOR NEIGHBORHOODS IN THE PROPOSED ZONING ORDINANCE Mrs . Holcomb stated that the Planning Board night look to the use of percentages in the proposed zoning ordinance with regard to density in determining the amount of high density development which would be allowed in a given neighborhood . Mr . Scannell said that he did not think we can do it . Mrs . Holcomb stated that she wanted to have a . handle on density so that the Planning Board could say when a proposal would be too ouch in one neighborhood at some point . I understand you have some objections to the identifying irstituitional name on the building and the memorial beacon , both of which were erected prior to the effective date of the Local Law . I certainly don ' t see how the memorial beacon falls withiau the provisions of the lax ea it in not a " sign" and is not " used to promote i' the . inttrests of any person or business " . , Do you clans that a permit is required for continuation of the " non-conforming signs " beyo��lenamethree year .period" . Do you consider that the identifying on the face of the building , met back several hundred feet from the public road andinsignificant for the size of the building is objectionable!
