TOWN .OF ITHACA PLANNING BOARD
October 19 , 1971
The regular meeting of the Town of Ithaca Planning Board was
held on Tuesday , October 19 , 1971 , at 7 : 30 ` p . m . in the Town of
Ithaca Offices , 108 E . Green Street , Ithaca , New York .
PRESENT : Chairman Barbara Holcomb , Arnold Albrecht , Maurice
Harris , Dari Baker , ' Fred Scott , Robert Scannell Robert ChristiIanson ,
and Peter Francese ( Planning Consultant ) .
APPROVAL OF MINUTES : A motion was made by Robert ' Christi. anson
to approve the minutes of the September 21 , 1971 meting of th- 6
Town of Ithaca Planning Board . The motion ,. seconded ed by Robert
Scannell , was unanimously passed .
The minutes of the special meeting of the Planning Board held
4 on October 6 , 1971 were corrected as follows :
On page 2 , paragraph four ,, the fi rs , s 'entence . of ' that paragraph
should be deleted .
Robert Scannell moved that the minutes of the October ' 6 , . 1971
meeting of the Planning Board be approved as amended . The motion
was seconded by Maurice Harris , and unanimously approved . .

Mrs . Holcomb reported on the meeting of the Town Board .
She also reported that a - public . hearing onothe Monkemeyer proposal
will be held by the . Town Board on . November R , 1971 ,
Peter France'se reported : that he. had talked with Mr . Coon of
the Office of Planning Services in Albany . concerni 'ng certain `
i egal i ti es . It was reported that it i s • , 1 ega.l, , to ;' rezone a piece . of
land for a particular use ; . if that land th 'e:n 1 . 8, n'o,t : d.evd1'o_ped for
Thai: particular use , the zoning ' of that land be , chan'ge 'd back to
I! its original zoning . A public hearing mush be held to do this .
A reversion clause is not legal , but a resolution may be time and
plan conditional

i Mr . Monkemeyer wi 11 put in , at no cost to Miss Staz , ' a water
that goes from the municipal water service , fo •r his development to her

�`��• on the hi l '1 east of her home . ) Mr . Monkemeyer has also agreed to
provide ' a line of trees of evergreen nature to act as a site line
ia1 ong her property , The trees are to be 5 to 8 feet in hei gh It
and will run 46 ' from the ditch located atd the side o .f . the road ,
20from the east property line , .'. 33 ' south of Miss Staz ' south
property 11ne , and will continue : to her west 1i ne . '
Discussion was held concerning the most appropriate way to
i ncorporatc: . this provision i n the present Planning Board recommendation on
� � to the Town Board for rezoning . Robert Christianson made a motion
that the Monkemeyer site plan must regard the buffer zone specified
� i in the agreement between Mr . Evan Monkemeyer and Miss Sharon Staz ;
further , the Planning Board recognizes that there will also be a
contract between Miss Staz and Mr . Monkemeyer : concerning the con
struction of a• water line to h. er home
The motion Vas seconded . by Robert Scannell and unanimously
approved
KENNILWORTH SIGNS : Peter Frar, cese reported that the request
: r . .`. of Kennil 'worth to construct two signs on their development on Judd
i. ` Fal Is Rd . would go directly to ' . the Town Board since i n � ti a 1 1y , i t
was the Town Board which put two restrictions i cti ons on. . the building perm i t

of Kennilworth Associates : ( 1 ) that a further solution to the water
� _. and sewer problem had to be worked out to the satisfaction o . the
Town Board ; and ( 2 ) . that they would have to have Town Board approval
' for the cons trued on o ; any s9 gns - - and no signs were to be higher

Peter reported that condition one had been removed , and it would
be left up . to . the Town Board ' to handle the request for , the con -
struct* on of s7 `gns .
